		  Compensation, and Liability Act of 1980 to provide grants for the
		  revitalization of waterfront brownfields, and for other
		  purposes.</official-title>

		<section id="HAB2682629F4C4457A17898D82DEE2A9F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Waterfront Brownfields Revitalization
			 Act</short-title></quote>.</text>
		</section><section id="H7911870FFE7B40818FE4519FCE2AF4CD" section-type="subsequent-section"><enum>2.</enum><header>Waterfront brownfields
			 grant</header><text display-inline="no-display-inline">Section 104(k) of the
			 Comprehensive Environmental Response, Compensation, and Liability Act of 1980
			 (42 U.S.C. 9604(k)) is amended—</text>
			<paragraph id="HD02409DE2ECE41C4B7092C5BE7027795"><enum>(1)</enum><text>by redesignating
			 paragraphs (4) through (11) and (12) as paragraphs (5) through (12) and (14),
			 respectively;</text>
			</paragraph><paragraph id="H5F2F1218FAEE4987985323F7A2399BA2"><enum>(2)</enum><text>in paragraph
			 (3)(A), by striking <quote>paragraphs (4) and (5)</quote> and inserting
			 <quote>paragraphs (5) and (6)</quote>;</text>
			</paragraph><paragraph id="H64BC54B618A4431992476A052C96F94E"><enum>(3)</enum><text>by inserting after
			 paragraph (3) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE4C1D4452F3B4486915B3D4A7E08C659" style="OLC">
					<paragraph id="H3E74F2092765476AA430B748E0F52FAE"><enum>(4)</enum><header>Grants for
				waterfront brownfields revitalization</header>
						<subparagraph id="H4802F79C1F394C53B72F636BB434F1B3"><enum>(A)</enum><header>Definition of
				waterfront brownfields site</header><text>In this paragraph, the term
				<term>waterfront brownfields site</term> means a brownfields site that is
				adjacent to a body of water.</text>
						</subparagraph><subparagraph id="id381B1E1C0E5B47739FC601D1A18A032C"><enum>(B)</enum><header>Program</header><text>Subject
				to paragraphs (5) and (6), the Administrator shall establish a program to
				provide grants to eligible entities or nonprofit organizations to be used in
				accordance with subparagraph (C) for 1 or more waterfront brownfields
				sites.</text>
						</subparagraph><subparagraph id="HDB2BAF9B24F54A4C81868A248C4D109A"><enum>(C)</enum><header>Use of
				funds</header><text>A grant under this paragraph may be used for reuse
				planning, site characterization and assessment, or remediation at waterfront
				brownfields sites, including the integration of activities related to the
				design and implementation of water quality improvements, low impact development
				approaches, green infrastructure, remediation and management of sediments, or
				flood damage prevention associated with brownfields remediation and
				reuse.</text>
						</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H63B557D1C60D4676A42D768292EE3701"><enum>(4)</enum><text>in paragraph
			 (5)(A) (as redesignated by paragraph (1)), by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H6753CAC831654132B26AF2FD763C9924" style="OLC">
					<clause id="HD14DECD2ECCE464A998241000831BB9C"><enum>(iii)</enum><header>Waterfront
				brownfields revitalization</header><text>A grant made to an eligible entity or
				nonprofit organization under paragraph (4) may not exceed
				$500,000.</text>
					</clause><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HD77276576CFE42FAAF4CD5014B449D1F"><enum>(5)</enum><text>in paragraph
			 (7)(A) (as redesignated by paragraph (1)) by inserting <quote>waterfront
			 brownfields revitalization,</quote> after <quote>community
			 involvement,</quote>; and</text>
			</paragraph><paragraph id="H2CD043BD6BEC4E00987EB7B436FCF14E"><enum>(6)</enum><text>by striking
			 paragraph (14) (as redesignated by paragraph (1)) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H98AA6D1F18D3419DB56C97634F1620B7" style="OLC">
					<paragraph id="H95E3AFF6B4154502ABD10C8A8BAA94F7"><enum>(13)</enum><header>Annual
				report</header><text>The Administrator shall submit to the Committee on
				Environment and Public Works of the Senate and the Committee on Energy and
				Commerce and the Committee on Transportation and Infrastructure of the House of
				Representatives an annual report on the implementation of the brownfield site
				characterization and assessment grant program under this subsection.</text>
					</paragraph><paragraph id="id1662F77E99D64CB0A9325EAE08B1D958"><enum>(14)</enum><header>Funding</header>
						<subparagraph id="HB669BB49DDA045879D4AE3FB67D47575"><enum>(A)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this subsection $220,000,000 for each of fiscal years 2013 through
				2017.</text>
						</subparagraph><subparagraph id="H86126E14B1CB4977B31E207398BA6816"><enum>(B)</enum><header>Use of certain
				funds</header><text>Of the amount made available under subparagraph (A) for a
				fiscal year, $55,000,000, or, if the amount made available is less than
				$220,000,000, 25 percent of the amount made available, shall be used for site
				characterization, assessment, and remediation of facilities described in
				section 101(39)(D)(ii)(II).</text>
						</subparagraph><subparagraph id="H96E3302A7D3448FDA52A560EBCEDE225"><enum>(C)</enum><header>Waterfront
				brownfields revitalization</header><text>There are authorized to be
				appropriated to carry out paragraph (4) such sums as are
				necessary.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H27D0DC2011C74A60AAF8B88CCA092849"><enum>3.</enum><header>Task
			 Force</header>
			<subsection id="HF9B6378FE5324836861034591D75786E"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency shall establish and serve as chairperson of a task force on
			 the revitalization of waterfront brownfields (as defined in section 104(k)(4)
			 of the Comprehensive Environmental Response, Compensation, and Liability Act of
			 1980) (as added by section 2(3)).</text>
			</subsection><subsection id="H185AE2C02B274A228709501F64831F5C"><enum>(b)</enum><header>Membership</header><text>Members
			 of the task force shall include representatives who have expertise in
			 waterfronts or brownfields revitalization, including representatives
			 from—</text>
				<paragraph id="H7BA4F2C148F14AB3A2B8949C3CFA1DA8"><enum>(1)</enum><text>the Environmental
			 Protection Agency;</text>
				</paragraph><paragraph id="H05CECCB99036436C8B4EDA03EC6CE8D9"><enum>(2)</enum><text>the National
			 Oceanographic and Atmospheric Administration;</text>
				</paragraph><paragraph id="H55007F83DBF94B4CBA9160D971E2654F"><enum>(3)</enum><text>the Corps of
			 Engineers;</text>
				</paragraph><paragraph id="H8E48C8FAE8EE46948EA9080A8B82F708"><enum>(4)</enum><text>the Department of
			 Transportation;</text>
				</paragraph><paragraph id="HABC02F20B2BB4799BC8A7EBFEA05FF0D"><enum>(5)</enum><text>the Department of
			 Housing and Urban Development;</text>
				</paragraph><paragraph id="H49DF711A0C0546058283585DF7D6C234"><enum>(6)</enum><text>the Economic
			 Development Administration;</text>
				</paragraph><paragraph id="HA668ED5394734C01B226600553DABF3E"><enum>(7)</enum><text>the United States
			 Fish and Wildlife Service;</text>
				</paragraph><paragraph id="HC61204A69D00432B9C09E4AF7A849317"><enum>(8)</enum><text>State and local
			 governments;</text>
				</paragraph><paragraph id="H775F5E7B7E7E4D69A552256A9D0B5670"><enum>(9)</enum><text>community-based
			 organizations and other interested parties; and</text>
				</paragraph><paragraph id="H4EE03A2DEADF40F5842C9F0B055B65F8"><enum>(10)</enum><text>any other agency
			 or entity the Administrator determines to be appropriate.</text>
				</paragraph></subsection><subsection id="HF63F977458D04B51AE5247BAFB218F85"><enum>(c)</enum><header>Duties</header><text>The
			 task force shall identify—</text>
				<paragraph id="HBFF5B5B3C20E49E8A6EDCFCEE041493C"><enum>(1)</enum><text>existing and
			 potential funding and technical assistance resources for waterfront brownfields
			 revitalization;</text>
				</paragraph><paragraph id="H4C914D1C00B3440A9E9A251B4552E5AE"><enum>(2)</enum><text>barriers to and
			 solutions for waterfront brownfields revitalization; and</text>
				</paragraph><paragraph id="H9FB5901227A44BBDBDA32C1F238566D3"><enum>(3)</enum><text display-inline="yes-display-inline">methods to coordinate interagency efforts
			 for waterfront brownfields revitalization.</text>
				</paragraph></subsection><subsection id="H03D5EC3BAF4C49298BB19DB2DE701B37"><enum>(d)</enum><header>Report</header><text>Not
			 later than 3 years after the date of enactment of this Act, the Administrator
			 of the Environmental Protection Agency shall submit to the appropriate
			 committees of Congress a report describing the findings of the task force on
			 improving waterfront brownfields revitalization.</text>
