			 land public</header>
					<subsection id="idAD3D23F6B5184FBA983F4D15F4204C68"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3 of the Land
			 and Water Conservation Fund Act of 1965 (16 U.S.C. 460l–6) is amended—</text>
						<paragraph id="id773734DF21284E15832F49A22EF08441"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="subsection" style="OLC">Sec. 3.
			 Appropriations</header-in-text>.—Moneys</quote> and inserting the
			 following:</text>

				general</header><text>Subject to the availability of appropriations and
				notwithstanding any other provision of this Act, the Secretary of the Interior
				and the Secretary of Agriculture shall ensure that, of the amounts made
				available for the fund for each fiscal year, not less than 1.5 percent of the
				amounts shall be made available for projects identified on the priority list
				developed under paragraph (2).</text>
									</paragraph><paragraph id="ID7838f6a1ce0542a6a4b10d417eef8e85"><enum>(2)</enum><header>Priority
				list</header><text>The Secretary of the Interior and the Secretary of
				Agriculture, in consultation with the head of each affected Federal agency,
				shall annually develop a priority list for the sites under the jurisdiction of
				the applicable Secretary.</text>
									</paragraph><paragraph id="idB9CAF5777E10415DBC948F2C9225B6DA"><enum>(3)</enum><header>Criteria</header><text>Projects
				identified on the priority list developed under paragraph (2) shall secure
				recreational public access to Federal public land in existence as of the date
				of enactment of this subsection that has significantly restricted access for
				hunting, fishing, and other recreational purposes through rights-of-way or
				acquisition of land (or any interest in land) from willing
				sellers.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="idC72F3C2FAFD64030BAF341B65AFFD2A5"><enum>(b)</enum><header>Conforming
			 amendments</header>
						<paragraph id="id43DB130A58CD421488B029E3733C8794"><enum>(1)</enum><header>Land and Water
			 Conservation Fund Act</header><text>The Land and Water Conservation Fund Act of
			 1965 (16 U.S.C. 460<italic>l</italic>–4 et seq.) is amended—</text>
							<subparagraph id="idE65656F99C704200995E5A33E90A054C"><enum>(A)</enum><text>in the proviso at
			 the end of section 2(c)(2) (16 U.S.C. 460<italic>l</italic>–5(c)(2)), by
			 striking <quote>notwithstanding the provisions of section 3 of this
			 Act</quote>;</text>
							</subparagraph><subparagraph id="id85124B9949F84DC5A3AC8D8FC9525C14"><enum>(B)</enum><text>in the first
			 sentence of section 9 (16 U.S.C. 460<italic>l</italic>–10a), by striking
			 <quote>by section 3 of this Act</quote>; and</text>
							</subparagraph><subparagraph id="id43B6A6209DBF4015BE3DD2682DFCAAF5"><enum>(C)</enum><text>in the third
			 sentence of section 10 (16 U.S.C. 460<italic>l</italic>–10b), by striking
			 <quote>by section 3 of this Act</quote>.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8361F01E8C654A488A0A59A0A9564738"><enum>(2)</enum><header>Federal Land
			 Transaction Facilitation Act</header><text>Section 206(f)(2) of the Federal
			 Land Transaction Facilitation Act (43 U.S.C. 2305(f)(2)) is amended by striking
			 <quote>section 3 of the Land and Water Conservation Fund Act (16 U.S.C.
			 460<italic>l</italic>–6)</quote> and inserting <quote>the Land and Water
			 Conservation Fund Act of 1965 (16 U.S.C. 460<italic>l</italic>–4 et
			 seq.)</quote>.</text>
						</paragraph></subsection></section><section id="id79E29394349445FFB2124EA250EDE641"><enum>102.</enum><header>Permits for
			 importation of polar bear trophies taken in sport hunts in Canada</header><text display-inline="no-display-inline">Section 104(c)(5) of the Marine Mammal
			 Protection Act of 1972 (16 U.S.C. 1374(c)(5)) is amended by striking
			 subparagraph (D) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC9BFF8438C234C62A0D53194745CF02B" style="OLC">
						<subparagraph id="H11A0F68C33F743A79572111CA4F23BBA" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HBB98704359EE4A19B4D038D0C6AF814E"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary of the Interior shall,
				expeditiously after the expiration of the applicable 30-day period under
				subsection (d)(2), issue a permit for the importation of any polar bear part
				(other than an internal organ) from a polar bear taken in a sport hunt in
				Canada to any person who submits, with the permit application, proof that the
				polar bear—</text>
								<subclause id="H49D3B898638F46A6B4631596D7FA016B" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">was legally harvested by the person before
				February 18, 1997; or</text>
								</subclause><subclause id="H4B0BF8CFB739464495DD8BEFF454F667" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">was legally harvested by the person before
				May 15, 2008, from a polar bear population from which a sport-hunted trophy
				could be imported before that date in accordance with section 18.30(i) of title
				50, Code of Federal Regulations (or a successor regulation).</text>
								</subclause></clause><clause id="HE9518123C7D241E5897519554FF4E223" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under
				clause (i)(I) without regard to subparagraphs (A) and (C)(ii) of this
				paragraph, subsection (d)(3), and sections 101 and 102.</text>
							</clause><clause id="H0385BD6AE4354EEAA2FC3B8C0F3D69C8" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary shall issue permits under
				clause (i)(II) without regard to subparagraph (C)(ii) of this paragraph,
				subsection (d)(3), and sections 101 and
				102.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="idc207c97b9dab45d1953a6cf7f4fcb47b"><enum>103.</enum><header>Transporting
			 bows through National Parks</header>
					<subsection id="id74d4fdfe533b4763ad040e97852abd91"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
						<paragraph id="id31931ee096de42fb87eef5689915ad8f"><enum>(1)</enum><text>bowhunters are
			 known worldwide as among the most skilled, ethical, and conservation-minded of
			 all hunters;</text>
						</paragraph><paragraph id="id61c9e9f0387a44fb9e5c00ac337866d9"><enum>(2)</enum><text>bowhunting
			 organizations at the Federal, State, and local level contribute significant
			 financial and human resources to wildlife conservation and youth education
			 programs throughout the United States; and</text>
						</paragraph><paragraph id="id82e940c97b0d4d2e95e65366a79b0a74"><enum>(3)</enum><text>bowhunting
			 contributes $38,000,000,000 each year to the economy of the United
			 States.</text>
						</paragraph></subsection><subsection id="id38B8662937F1400EBA9038D1DCC32CF7"><enum>(b)</enum><header>Possession of
			 bows in units of national park system or national wildlife refuge
			 system</header>
						<paragraph id="id489310D769DA4E1781D2F2527440168C"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the Secretary of the Interior
			 shall permit individuals carrying bows and crossbows to traverse national park
			 land if the traverse is—</text>
							<subparagraph id="id609CB2F88C5D4F88BDBF05D4F2887F6F"><enum>(A)</enum><text>for the sole
			 purpose of hunting on adjacent public or private land; and</text>
							</subparagraph><subparagraph id="idF9B45C2A9200478E9411000679D871A6"><enum>(B)</enum><text>the most direct
			 means of access to the adjacent land.</text>
							</subparagraph></paragraph><paragraph id="ida6b02b467ec04a219c87942d04d6d839"><enum>(2)</enum><header>Use</header><text>Nothing
			 in this section authorizes the use of the bows or crossbows that are being
			 carried while on national park land.</text>
						</paragraph></subsection></section></subtitle><subtitle id="id32280E32A6B34947AB4134ACF426A32E"><enum>B</enum><header>Target practice
			 and marksmanship training support</header>
				<section id="id6609d28c4b3340309b4431325074ec73" section-type="subsequent-section"><enum>111.</enum><header>Target practice and
			 marksmanship training</header><text display-inline="no-display-inline">This
			 subtitle may be cited as the <quote>Target Practice and Marksmanship Training
			 Support Act</quote>.</text>
				</section><section id="idd108463462224d83982f20a5aa8e6d6e"><enum>112.</enum><header>Findings;
			 purpose</header>
					<subsection id="id00f1e4a97a544405ad0c0caf80e40313"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
						<paragraph id="id302e348828cb40bd851def3e5d7bb699"><enum>(1)</enum><text>the use of
			 firearms and archery equipment for target practice and marksmanship training
			 activities on Federal land is allowed, except to the extent specific portions
			 of that land have been closed to those activities;</text>
						</paragraph><paragraph id="idcd360c5af8bc4497bd2f8f8d0408420a"><enum>(2)</enum><text>in recent years
			 preceding the date of enactment of this Act, portions of Federal land have been
			 closed to target practice and marksmanship training for many reasons;</text>
						</paragraph><paragraph id="id75cc4af317644641aab1aa2a62a9e64e"><enum>(3)</enum><text>the availability
			 of public target ranges on non-Federal land has been declining for a variety of
			 reasons, including continued population growth and development near former
			 ranges;</text>
						</paragraph><paragraph id="id2003d1d46ec846a099caffc152430e92"><enum>(4)</enum><text>providing
			 opportunities for target practice and marksmanship training at public target
			 ranges on Federal and non-Federal land can help—</text>
							<subparagraph id="id33042ba400c240fb9c67b46b7047fc49"><enum>(A)</enum><text>to promote
			 enjoyment of shooting, recreational, and hunting activities; and</text>
							</subparagraph><subparagraph id="ida9063c45e23444efa52889437f868b0c"><enum>(B)</enum><text>to ensure safe
			 and convenient locations for those activities;</text>
							</subparagraph></paragraph><paragraph id="id517c2c2672c04f92a706d037c78c80a8"><enum>(5)</enum><text>Federal law in
			 effect on the date of enactment of this Act, including the Pittman-Robertson
			 Wildlife Restoration Act (16 U.S.C. 669 et seq.), provides Federal support for
			 construction and expansion of public target ranges by making available to
			 States amounts that may be used for construction, operation, and maintenance of
			 public target ranges; and</text>
						</paragraph><paragraph id="id21e3db68f23c44929b6b97889ee2a1ad"><enum>(6)</enum><text>it is in the
			 public interest to provide increased Federal support to facilitate the
			 construction or expansion of public target ranges.</text>
						</paragraph></subsection><subsection id="id3157c96bb933437a83cb16dfe9a3bcc9"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this subtitle is to facilitate the construction and expansion of
			 public target ranges, including ranges on Federal land managed by the Forest
			 Service and the Bureau of Land Management.</text>
					</subsection></section><section id="idf826812ac03b4e26a8a2a8c0d62ff7ca"><enum>113.</enum><header>Definition of
			 public target range</header><text display-inline="no-display-inline">In this
			 subtitle, the term <term>public target range</term> means a specific location
			 that—</text>
					<paragraph id="idb88000445ec14d5c8643bc4ced743b99"><enum>(1)</enum><text>is identified by
			 a governmental agency for recreational shooting;</text>
					</paragraph><paragraph id="id965990f87b994544ae7a64153adbccd1"><enum>(2)</enum><text>is open to the
			 public;</text>
					</paragraph><paragraph id="ide12a09c309d04ed5a0aef8ab3c6ad286"><enum>(3)</enum><text>may be
			 supervised; and</text>
					</paragraph><paragraph id="idd5245969d7854d66b08485fee27d0d4c"><enum>(4)</enum><text>may accommodate
			 archery or rifle, pistol, or shotgun shooting.</text>

			 Pittman-Robertson Wildlife Restoration Act</header>
					<subsection id="idd29037975d044205808338989e057512"><enum>(a)</enum><header>Definitions</header><text>Section
			 2 of the Pittman-Robertson Wildlife Restoration Act (16 U.S.C. 669a) is
			 amended—</text>
						<paragraph id="id452cd7d895bd454cbab08c5c4b625479"><enum>(1)</enum><text>by redesignating
			 paragraphs (2) through (8) as paragraphs (3) through (9), respectively;
			 and</text>
						</paragraph><paragraph id="id0fd606c7c51649c39983e6087abe0db9"><enum>(2)</enum><text>by inserting
			 after paragraph (1) the following:</text>

				archery or rifle, pistol, or shotgun

							</subparagraph></paragraph></subsection></section><section id="idd95e9f2be4454fdba497428b84c7ab49"><enum>115.</enum><header>Sense of
			 Congress regarding cooperation</header><text display-inline="no-display-inline">It is the sense of Congress that, consistent
			 with applicable laws (including regulations), the Chief of the Forest Service
			 and the Director of the Bureau of Land Management should cooperate with State
			 and local authorities and other entities to implement best practices for waste
			 management and removal and carry out other related activities on any Federal
			 land used as a public target range to encourage continued use of that land for
			 target practice or marksmanship training.</text>
				</section></subtitle><subtitle id="id070303E5B38A45779AA7576B1B99F471"><enum>C</enum><header>Fishing</header>
				<section id="H165CACED0DC94BCE8ED372A67636CF63"><enum>121.</enum><header>Modification of
			 definition of toxic substance to exclude sport fishing equipment</header>
					<subsection id="id12A919BC9DE94E808853E55C226FEDD1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3(2)(B) of
			 the Toxic Substances Control Act (15 U.S.C. 2602(2)(B)) is amended—</text>
						<paragraph id="H3C6C5A565BA84706BC3A5F67EC82B179"><enum>(1)</enum><text>in clause (v), by
			 striking <quote>, and</quote> and inserting <quote>, or any component of any
			 such article including, without limitation, shot, bullets and other
			 projectiles, propellants, and primers,</quote>;</text>
						</paragraph><paragraph id="H0D20E3BF19954EE2B9028209512B2C1C"><enum>(2)</enum><text>in clause (vi) by
			 striking the period at the end and inserting <quote>, and</quote>; and</text>

				term is defined in section 4162(a) of the Internal Revenue Code of 1986,
				without regard to paragraphs (6) through (9) thereof) the sale of which is
				subject to the tax imposed by section 4161(a) of such Code (determined without
				regard to any exemptions from such tax as provided by section 4162 or 4221 or
				any other provision of such Code), and sport fishing equipment
				components.</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="id4ad407c15cd14925863b0db5f4da5c40"><enum>(b)</enum><header>Relationship to
			 other law</header><text display-inline="yes-display-inline">Nothing in this
			 section or any amendment made by this section affects or limits the application
			 of or obligation to comply with any other Federal, State or local law.</text>
					</subsection></section><section id="idE87719BA814A49B4A66338ECEB7936C7"><enum>122.</enum><header>Prohibition on
			 sale of billfish</header>
					<subsection display-inline="no-display-inline" id="H6324158F67504FE3A961533950D29AF9"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
						<paragraph id="H54C889EF01BF44E48A59E5DF0F1FB2AC"><enum>(1)</enum><text>the United States
			 carefully regulates its domestic fisheries for billfish and participates in
			 international fishery management bodies in the Atlantic and Pacific
			 Oceans;</text>
						</paragraph><paragraph id="HDAE2CB8B2A1D49D68F114A2617A15339"><enum>(2)</enum><text>global billfish
			 populations have declined significantly because of overfishing primarily
			 through retention of bycatch by non-United States commercial fishing fleets;
			 and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H72A3CC1E24DD44C49EE9A0EF879F9114"><enum>(3)</enum><text>ending the
			 importation of foreign-caught billfish for sale in the United States aligns
			 with United States management measures relating to billfish and protects the
			 significant economic benefits to the United States economy of recreational
			 fishing and marine commerce and the traditional cultural fisheries.</text>
						</paragraph></subsection><subsection id="HC31D9DA90FFF458CAA9B0EDA81503B56"><enum>(b)</enum><header>Definition of
			 billfish</header><text>In this section:</text>
						<paragraph id="H0E1FF9632F6640FF85E67AC4B881267D"><enum>(1)</enum><header>In
			 general</header><text>The term <term>billfish</term> means any fish of the
			 species—</text>

			 (blue marlin);</text>
							</subparagraph><subparagraph id="HF8B71AFD862648BE8B1845128C744567"><enum>(B)</enum><text>Kajikia audax
			 (striped marlin);</text>
							</subparagraph><subparagraph id="HE27F572A94824557B62D73BC609E9593"><enum>(C)</enum><text>Istiompax indica
			 (black marlin);</text>
							</subparagraph><subparagraph id="HD5558CF11A184B268E942556569F863D"><enum>(D)</enum><text>Istiophorus
			 platypterus (sailfish);</text>
							</subparagraph><subparagraph id="HC696BA1339744E20B9E03891AD7CBF48"><enum>(E)</enum><text>Tetrapturus
			 angustirostris (shortbill spearfish);</text>
							</subparagraph><subparagraph id="H806EA705E3EB4126B13FA2CDEDA9DD32"><enum>(F)</enum><text>Kajikia albida
			 (white marlin);</text>
							</subparagraph><subparagraph id="H913B0CF956E948F298C29C35378E08C3"><enum>(G)</enum><text>Tetrapturus
			 georgii (roundscale spearfish);</text>
							</subparagraph><subparagraph id="H597882118A9341F09F6F28D9C958A006"><enum>(H)</enum><text>Tetrapturus belone
			 (Mediterranean spearfish); or</text>
							</subparagraph><subparagraph id="H183BB9D012DF4C3192F546C378F5E8DE"><enum>(I)</enum><text>Tetrapturus
			 pfluegeri (longbill spearfish).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E653C0CFF384C848CC4C418DCF4FC20"><enum>(2)</enum><header>Exclusion</header><text>The
			 term <term>billfish</term> does not include the species Xiphias gladius
			 (swordfish).</text>
						</paragraph></subsection><subsection id="H0A5D865FB1344815BDE7D7A1909E8D4E"><enum>(c)</enum><header>Prohibition</header><text>Except
			 as provided in subsection (e), no person shall offer for sale, sell, or have
			 custody, control, or possession of for purposes of offering for sale or selling
			 billfish or products containing billfish.</text>
					</subsection><subsection id="H94DB07561224482FBE54DC5E24F6B07D"><enum>(d)</enum><header>Penalty</header><text>For
			 purposes of section 308(a) of the Magnuson-Stevens Fishery Conservation and
			 Management Act (16 U.S.C. 1858(a)), a violation of this section shall be
			 treated as an act prohibited by section 307 of that Act (16 U.S.C.
			 1857).</text>
					</subsection><subsection display-inline="no-display-inline" id="H77EDB34AA432459D8D0E90E767B7C6AF"><enum>(e)</enum><header>Exemptions for
			 traditional fisheries and markets</header>
						<paragraph id="H07319EFC80364098A805C56B83706728"><enum>(1)</enum><header>United States
			 fishing vessels</header><text>Subsection (c) does not apply to billfish caught
			 by United States fishing vessels and landed in the State of Hawaii or a Pacific
			 Insular Area (as defined in section 3 of the Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1802)).</text>
						</paragraph><paragraph id="H960B7687705B4CB28E803752640B63D2"><enum>(2)</enum><header>Foreign fishing
			 vessels</header><text>Subsection (c) does not apply to billfish landed by
			 foreign fishing vessels in a Pacific Insular Area (as so defined) if the
			 foreign-caught billfish is exported to non-United States markets or retained
			 within the State of Hawaii and the Pacific Insular Areas for local
			 consumption.</text>
						</paragraph></subsection><subsection id="HB1E93EC02D5D4B5BACAC88AA56F9BF7B"><enum>(f)</enum><header>Statement of
			 constitutional authority</header><text display-inline="yes-display-inline">Congress enacts this section pursuant to
			 clause 3 of section 8 of article I of the Constitution.</text>
					</subsection></section><section id="idd11393dbfa5f4d7e83e7fa418cf93457"><enum>123.</enum><header>Report on
			 artificial reefs in the Gulf of Mexico</header>
					<subsection id="id8715811d5e114d88ad260bb583a4c505"><enum>(a)</enum><header>Initial
			 report</header><text>Not later than 90 days after the date of enactment of this
			 Act, the Secretary of the Interior, in coordination with the Secretary of
			 Commerce and the heads of other Federal and State agencies, shall submit to the
			 Committee on Energy and Natural Resources of the Senate and the Committee on
			 Natural Resources of the House of Representatives a plan to assess how best to
			 integrate the goals of the National Fishing Enhancement Act of 1984 (33 U.S.C.
			 2101 et seq.) and the Outer Continental Shelf Lands Act (43 U.S.C. 1331 et
			 seq.).</text>
					</subsection><subsection id="id417a0e3c81cb496ba6249d502ec261dd"><enum>(b)</enum><header>Contents of
			 plan</header><text>The plan required under subsection (a) shall include—</text>
						<paragraph id="idbc9acef80b4d4e7abe1e4f157d13b2c5"><enum>(1)</enum><text>an assessment of
			 the capability of the Department of the Interior to identify and issue a public
			 notice of platforms and related structures scheduled to be removed in 2012 and
			 2013 pursuant to sections 250.1700 through 250.1754 of title 30, Code of
			 Federal Regulations (as in effect on the date of enactment of this Act), and
			 the timeframe set out in the notice to lessees on the decommissioning for
			 platforms and related structures in the Gulf of Mexico OCS Region (NTL No.
			 2010–G05) of the Department of the Interior;</text>
						</paragraph><paragraph id="id7eb3ce394e104842b20099830c60f15d"><enum>(2)</enum><text>strategies for
			 coordination with relevant Federal and State agencies and accredited marine
			 research institutes and university marine biology departments to assess the
			 biodiversity and critical habitat present at platforms and related structures
			 subject to removal pursuant to sections 250.1700 through 250.1754 of title 30,
			 Code of Federal Regulations (as in effect on the date of enactment of this
			 Act), and the timeframe set out in NTL No. 2010–G05;</text>
						</paragraph><paragraph id="id0b761544880d4433b4e71d0f44d1ae71"><enum>(3)</enum><text>an assessment of
			 the potential impacts of the removal of the platforms and related structures
			 pursuant to sections 250.1700 through 250.1754 of title 30, Code of Federal
			 Regulations (as in effect on the date of enactment of this Act), and the
			 timeframe set out in NTL No. 2010–G05 on the Gulf of Mexico ecosystem and
			 marine habitat;</text>
						</paragraph><paragraph id="id211a541e99a7447e93ccee6889a23e30"><enum>(4)</enum><text>an assessment of
			 the potential impacts of not removing the platforms and related structures
			 pursuant to sections 250.1700 through 250.1754 of title 30, Code of Federal
			 Regulations (as in effect on the date of enactment of this Act), and the
			 timeframe set out in NTL NO. 2010–G05, including potential damage as a result
			 of hurricanes and other incidents; and</text>
						</paragraph><paragraph id="idc91fcd3304e24e70bd7d16ca171ea0d2"><enum>(5)</enum><text>an assessment of
			 the potential impacts of the removal of platforms and related structures on the
			 rebuilding plans for Gulf reef fish and habitat, as developed by the National
			 Marine Fisheries Service of the Department of Commerce.</text>
						</paragraph></subsection><subsection id="id9ed82f40bc24406db4c2d546c801830c"><enum>(c)</enum><header>Final
			 report</header><text>Not later than 18 months after the date of submission of
			 the plan developed under subsection (a), the Secretary shall submit to the
			 Committee on Energy and Natural Resources of the Senate and the Committee on
			 Natural Resources of the House of Representatives a final report that
			 includes—</text>
						<paragraph id="id346f7916731d4b858433f09be767c727"><enum>(1)</enum><text>a description of
			 public comments from regional stakeholders, including recreational anglers,
			 divers, offshore oil and gas companies, marine biologists, and commercial
			 fisherman; and</text>
						</paragraph><paragraph id="id1973201ce33243f1a4b3d5abd5dfbe5b"><enum>(2)</enum><text>findings relative
			 to comments developed under this subsection, including options to mitigate
			 potential adverse impacts on marine habitat associated with the removal of
			 platforms and related structures pursuant to sections 250.1700 through 250.1754
			 of title 30, Code of Federal Regulations (as in effect on the date of enactment
			 of this Act), and the timeframe set out in NTL No. 2010–G05.</text>
						</paragraph></subsection><subsection id="idf72660c3abaf4c29bb16100e40b3893a"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to the
			 Secretary of the Interior to carry out this section such sums as are
			 necessary.</text>
					</subsection></section></subtitle></title><title id="id3B61821657864FA49FCD1F6748DF727A"><enum>II</enum><header>National Fish
			 Habitat</header>
			<subtitle id="id9EF276B4EB1F4B6BB0E4EC0B40A22F36"><enum>A</enum><header>National Fish
			 Habitat</header>
				<section id="id70dfda01-5013-4850-add0-8530e973ff09"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
					<paragraph id="id33b7bccf-c70e-4311-9f68-086328ca88c8"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means—</text>
						<subparagraph id="id62260710-f086-41f3-a8b2-169cea2c93b8"><enum>(A)</enum><text>the Committee
			 on Commerce, Science, and Transportation and the Committee on Environment and
			 Public Works of the Senate; and</text>
						</subparagraph><subparagraph id="id06297792-5b40-4d5a-b033-702049d27932"><enum>(B)</enum><text>the Committee
			 on Natural Resources of the House of Representatives.</text>
						</subparagraph></paragraph><paragraph id="id00f86226-38de-4e79-aafe-4a77f95dcb86"><enum>(2)</enum><header>Aquatic
			 habitat</header>
						<subparagraph id="id425f88de-0080-46f9-9a8e-5f472f5b549a"><enum>(A)</enum><header>In
			 general</header><text>The term <term>aquatic habitat</term> means any area on
			 which an aquatic organism depends, directly or indirectly, to carry out the
			 life processes of the organism, including an area used by the organism for
			 spawning, incubation, nursery, rearing, growth to maturity, food supply, or
			 migration.</text>
						</subparagraph><subparagraph id="idd4ab31ea-6d79-43f1-ba91-d8326226948c"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>aquatic habitat</term> includes an area adjacent to an aquatic
			 environment, if the adjacent area—</text>
							<clause id="id2fb8dd38-26ab-4755-8a04-9e3f21d1639c"><enum>(i)</enum><text>contributes
			 an element, such as the input of detrital material or the promotion of a
			 planktonic or insect population providing food, that makes fish life
			 possible;</text>
							</clause><clause id="id3da8c2d7-1c6e-44c8-a239-696e404fe25c"><enum>(ii)</enum><text>protects the
			 quality and quantity of water sources;</text>
							</clause><clause id="id8fddb64e-d666-4001-b460-36c946f1c8e2"><enum>(iii)</enum><text>provides
			 public access for the use of fishery resources; or</text>
							</clause><clause id="ida2a2087d-764c-458f-aa90-d722003c39f7"><enum>(iv)</enum><text>serves as a
			 buffer protecting the aquatic environment.</text>
							</clause></subparagraph></paragraph><paragraph id="id5c74e191-6beb-4f6d-9d2c-e07e0921cb8c"><enum>(3)</enum><header>Assistant
			 Administrator</header><text>The term <term>Assistant Administrator</term> means
			 the Assistant Administrator for Fisheries of the National Oceanic and
			 Atmospheric Administration.</text>
					</paragraph><paragraph id="id03abe9ab-3c97-421f-9511-8b959be3576f"><enum>(4)</enum><header>Board</header><text>The
			 term <term>Board</term> means the National Fish Habitat Board established by
			 section 202(a)(1).</text>
					</paragraph><paragraph id="idb6b96b83-0cb5-4d3a-ad9b-b4bffb6be765"><enum>(5)</enum><header>Conservation;
			 conserve; manage; management</header><text>The terms <term>conservation</term>,
			 <term>conserve</term>, <term>manage</term>, and <term>management</term> mean to
			 protect, sustain, and, where appropriate, restore and enhance, using methods
			 and procedures associated with modern scientific resource programs (including
			 protection, research, census, law enforcement, habitat management, propagation,
			 live trapping and transplantation, and regulated taking)—</text>
						<subparagraph id="id1a6e5564-a31d-4719-b487-4cc9af31fca0"><enum>(A)</enum><text>a healthy
			 population of fish, wildlife, or plant life;</text>
						</subparagraph><subparagraph id="id1250c7e1-8200-4cb0-8659-9744a5807f68"><enum>(B)</enum><text>a habitat
			 required to sustain fish, wildlife, or plant life; or</text>
						</subparagraph><subparagraph id="idebdad102-33d3-4103-9567-222023f42773"><enum>(C)</enum><text>a habitat
			 required to sustain fish, wildlife, or plant life productivity.</text>
						</subparagraph></paragraph><paragraph id="id03efb24f-d45e-4424-80b5-8e18def12019"><enum>(6)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the United States Fish and
			 Wildlife Service.</text>
					</paragraph><paragraph id="ide913b08b-a01c-4da3-90d0-3bc56e9b6acd"><enum>(7)</enum><header>Fish</header>
						<subparagraph id="id06393c48-bef9-4cf4-9bb5-f9c9c33ecf19"><enum>(A)</enum><header>In
			 general</header><text>The term <term>fish</term> means any freshwater,
			 diadromous, estuarine, or marine finfish or shellfish.</text>
						</subparagraph><subparagraph id="idbad49998-4044-471f-951d-35082ecd6023"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>fish</term> includes the egg, spawn, spat, larval, and other
			 juvenile stages of an organism described in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="id911e4c0d-3b5b-4500-948b-9126a0adcef8"><enum>(8)</enum><header>Fish
			 habitat conservation project</header>
						<subparagraph id="id31d8752d-ca6f-4cf6-9129-ededd4574ef5"><enum>(A)</enum><header>In
			 general</header><text>The term <term>fish habitat conservation project</term>
			 means a project that—</text>
							<clause id="id37f51541-1f72-40cc-b2ed-c04febbf4763"><enum>(i)</enum><text>is submitted
			 to the Board by a Partnership and approved by the Secretary under section 204;
			 and</text>
							</clause><clause id="id9641cc94-3504-46d4-8cbc-57a5d6aecab1"><enum>(ii)</enum><text>provides for
			 the conservation or management of an aquatic habitat.</text>
							</clause></subparagraph><subparagraph id="id2115de01-33e0-4d2a-a73a-13846d638850"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>fish habitat conservation project</term> includes—</text>
							<clause id="ida6c3915a-ae0b-4701-9cb7-71a76ecc5e54"><enum>(i)</enum><text>the provision
			 of technical assistance to a State, Indian tribe, or local community by the
			 National Fish Habitat Conservation Partnership Office or any other agency to
			 facilitate the development of strategies and priorities for the conservation of
			 aquatic habitats; or</text>
							</clause><clause id="idb1bfd755-4e7b-4940-9e42-b6240f319052"><enum>(ii)</enum><text>the
			 obtaining of a real property interest in land or water, including water rights,
			 in accordance with terms and conditions that ensure that the real property will
			 be administered for the long-term conservation of—</text>
								<subclause id="id6da4d3f7-0fcc-4a6c-bede-6d74adde225c"><enum>(I)</enum><text>the land or
			 water; and</text>
								</subclause><subclause id="id412601e0-94f5-4d03-8302-47731adba8f8"><enum>(II)</enum><text>the fish
			 dependent on the land or water.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="id2a5bdc7d-ee29-42f9-a718-7b4b9fc40f2c"><enum>(9)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 450b).</text>
					</paragraph><paragraph id="idc02e90f8-21d6-4a5d-9098-aff8286c1e5f"><enum>(10)</enum><header>National
			 Fish Habitat Action Plan</header><text>The term <term>National Fish Habitat
			 Action Plan</term> means the National Fish Habitat Action Plan dated April 24,
			 2006, and any subsequent revisions or amendments to that plan.</text>
					</paragraph><paragraph id="id5638ff28-a650-46fa-897f-be91175d8d13"><enum>(11)</enum><header>Partnership</header><text>The
			 term <term>Partnership</term> means an entity designated by the Board as a Fish
			 Habitat Conservation Partnership pursuant to section 203(a).</text>
					</paragraph><paragraph id="id1f219b5e-416d-4258-8702-bcd18c8d6fe8"><enum>(12)</enum><header>Real
			 property interest</header><text>The term <term>real property interest</term>
			 means an ownership interest in—</text>
						<subparagraph id="id49f959e7-5221-472a-9253-c488bbc4672c"><enum>(A)</enum><text>land;</text>
						</subparagraph><subparagraph id="ida8b4707c-7149-4c4d-b895-eef0b8cbf39f"><enum>(B)</enum><text>water
			 (including water rights); or</text>
						</subparagraph><subparagraph id="idb7d45957-b551-45cb-b5e6-d2ffe7726eb4"><enum>(C)</enum><text>a building or
			 object that is permanently affixed to land.</text>
						</subparagraph></paragraph><paragraph id="id65ad2880-18c9-4ddd-b179-978600faa6ec"><enum>(13)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
					</paragraph><paragraph id="id81f51436-6ef8-4021-8874-5b0d9850a280"><enum>(14)</enum><header>State
			 agency</header><text>The term <term>State agency</term> means—</text>
						<subparagraph id="ide75d9af5-ce7f-4532-9136-6d843a57ba70"><enum>(A)</enum><text>the fish and
			 wildlife agency of a State;</text>
						</subparagraph><subparagraph id="ided7504fb-bed7-4275-ad9a-0359c683f0de"><enum>(B)</enum><text>any
			 department or division of a department or agency of a State that manages in the
			 public trust the inland or marine fishery resources or the habitat for those
			 fishery resources of the State pursuant to State law or the constitution of the
			 State; or</text>
						</subparagraph><subparagraph id="id3282ca2d-eca9-4ff7-978d-5c7ffff3bf2f"><enum>(C)</enum><text>the fish and
			 wildlife agency of the Commonwealth of Puerto Rico, Guam, the Virgin Islands,
			 or any other territory or possession of the United States.</text>
						</subparagraph></paragraph></section><section id="idff2b7f94-8ef8-4777-9bc2-b177708478f2"><enum>202.</enum><header>National
			 Fish Habitat Board</header>
					<subsection id="id6864066f-3a32-4ba1-b85c-b375226b82fc"><enum>(a)</enum><header>Establishment</header>
						<paragraph id="id152ba82e-6d23-4cd1-b4c9-aea8f7f5795e"><enum>(1)</enum><header>In
			 general</header><text>There is established a board, to be known as the
			 <quote>National Fish Habitat Board</quote>—</text>
							<subparagraph id="id3cffe0db-e059-4ff4-a6b9-88cad5cfdae4"><enum>(A)</enum><text>to promote,
			 oversee, and coordinate the implementation of this subtitle and the National
			 Fish Habitat Action Plan;</text>
							</subparagraph><subparagraph id="idf722128d-dccf-42a6-9ee6-edd1bbdc0374"><enum>(B)</enum><text>to establish
			 national goals and priorities for aquatic habitat conservation;</text>
							</subparagraph><subparagraph id="id82af719d-1e79-4b2f-9910-032ad34ee581"><enum>(C)</enum><text>to designate
			 Partnerships; and</text>
							</subparagraph><subparagraph id="id199f1ee2-9a99-4ab5-9c0a-38df50bdfb62"><enum>(D)</enum><text>to review and
			 make recommendations regarding fish habitat conservation projects.</text>
							</subparagraph></paragraph><paragraph id="id33c98558-88c9-4686-948b-205b41b0c744"><enum>(2)</enum><header>Membership</header><text>The
			 Board shall be composed of 27 members, of whom—</text>
							<subparagraph id="ida03c1943-3d8c-44b7-88c6-7593d1e05ee9"><enum>(A)</enum><text>1 shall be
			 the Director;</text>
							</subparagraph><subparagraph id="idac325c0f-39de-4408-9f29-ab620307a79d"><enum>(B)</enum><text>1 shall be
			 the Assistant Administrator;</text>
							</subparagraph><subparagraph id="id6dd5f039-9fee-4a30-aa0f-9a46b0a5e603"><enum>(C)</enum><text>1 shall be
			 the Chief of the Natural Resources Conservation Service;</text>
							</subparagraph><subparagraph id="idf085cc71-92cc-45d4-8829-1406b759c59d"><enum>(D)</enum><text>1 shall be
			 the Chief of the Forest Service;</text>
							</subparagraph><subparagraph id="id50fb0698-f8ff-4ee2-824c-9db36199a3e6"><enum>(E)</enum><text>1 shall be
			 the Assistant Administrator for Water of the Environmental Protection
			 Agency;</text>
							</subparagraph><subparagraph id="id18cae530-95cb-46db-9b00-5af07abba3b7"><enum>(F)</enum><text>1 shall be
			 the President of the Association of Fish and Wildlife Agencies;</text>
							</subparagraph><subparagraph id="id90af7f89-7e65-4f4d-bba0-e086daf8deb4"><enum>(G)</enum><text>1 shall be
			 the Secretary of the Board of Directors of the National Fish and Wildlife
			 Foundation appointed pursuant to section 3(g)(2)(B) of the National Fish and
			 Wildlife Foundation Establishment Act (16 U.S.C. 3702(g)(2)(B));</text>
							</subparagraph><subparagraph id="idad9aa9ec-5098-46e5-b4c8-5693de8a49b8"><enum>(H)</enum><text>4 shall be
			 representatives of State agencies, 1 of whom shall be nominated by a regional
			 association of fish and wildlife agencies from each of the Northeast,
			 Southeast, Midwest, and Western regions of the United States;</text>
							</subparagraph><subparagraph id="id8cdf8b2d-8dc4-4dc5-809f-cb49982e66ce"><enum>(I)</enum><text>1 shall be a
			 representative of the American Fisheries Society;</text>
							</subparagraph><subparagraph id="ide40e46bf-2673-4af4-ad66-295bdf4e2b1f"><enum>(J)</enum><text>2 shall be
			 representatives of Indian tribes, of whom—</text>
								<clause id="id35688fb3-a245-4ee7-a0d1-fffee4a8600a"><enum>(i)</enum><text>1 shall
			 represent Indian tribes from the State of Alaska; and</text>
								</clause><clause id="ida437109a-1095-4b9a-9071-3ee0e275caa0"><enum>(ii)</enum><text>1 shall
			 represent Indian tribes from the other States;</text>
								</clause></subparagraph><subparagraph id="id4390e93e-bb86-44f0-90e6-f72a0e9b5bc2"><enum>(K)</enum><text>1 shall be a
			 representative of the Regional Fishery Management Councils established under
			 section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (16
			 U.S.C. 1852);</text>
							</subparagraph><subparagraph id="ida7443fe4-3418-4a5f-a823-632756f3d1cb"><enum>(L)</enum><text>1 shall be a
			 representative of the Marine Fisheries Commissions, which is composed
			 of—</text>
								<clause id="id3ccb1660-91a8-46f4-9d7a-e4302045994f"><enum>(i)</enum><text>the Atlantic
			 States Marine Fisheries Commission;</text>
								</clause><clause id="id65582940-ba64-44a4-95b7-1bb68cba9d9f"><enum>(ii)</enum><text>the Gulf
			 States Marine Fisheries Commission; and</text>
								</clause><clause id="idcb1315ef-f6ff-47c0-b910-c77ff96fc2e9"><enum>(iii)</enum><text>the Pacific
			 States Marine Fisheries Commission;</text>
								</clause></subparagraph><subparagraph id="id2b6f9a6b-ba10-4966-b8ba-68f3a0f0b789"><enum>(M)</enum><text>1 shall be a
			 representative of the Sportfishing and Boating Partnership Council; and</text>
							</subparagraph><subparagraph id="id509c8bd3-cd27-4258-9f27-6bd2e733323f"><enum>(N)</enum><text>10 shall be
			 representatives selected from each of the following groups:</text>
								<clause id="id7ee1a747-8f9a-48b6-8e07-40f3a2220d79"><enum>(i)</enum><text>The
			 recreational sportfishing industry.</text>
								</clause><clause id="idb4fedade-d9a0-491a-abd6-e8d3f3bf3035"><enum>(ii)</enum><text>The
			 commercial fishing industry.</text>
								</clause><clause id="idaa714923-faa4-468c-beff-f6876a527fa3"><enum>(iii)</enum><text>Marine
			 recreational anglers.</text>
								</clause><clause id="id2ab352fd-7a16-43e0-aa7b-a6c35244652c"><enum>(iv)</enum><text>Freshwater
			 recreational anglers.</text>
								</clause><clause id="ida65b422c-92df-4279-acee-75d75a25b8b7"><enum>(v)</enum><text>Terrestrial
			 resource conservation organizations.</text>
								</clause><clause id="idfa1ea91f-bcb7-4d3b-935c-812ec52cc7cf"><enum>(vi)</enum><text>Aquatic
			 resource conservation organizations.</text>
								</clause><clause id="ide9d748d3-75ce-4608-883a-19b33222dd29"><enum>(vii)</enum><text>The
			 livestock and poultry production industry.</text>
								</clause><clause id="ide78825aa-33c9-41ba-9748-1350be28e3ac"><enum>(viii)</enum><text>The land
			 development industry.</text>
								</clause><clause id="id16cbd451-f811-4369-8020-d00d7a53037f"><enum>(ix)</enum><text>The row crop
			 industry.</text>
								</clause><clause id="id56756cb7-2d81-4bb4-aa87-7a004ef61900"><enum>(x)</enum><text>Natural
			 resource commodity interests, such as petroleum or mineral extraction.</text>
								</clause></subparagraph></paragraph><paragraph id="id53a6bb7b-3220-455a-bbfd-2d5ed1a408be"><enum>(3)</enum><header>Compensation</header><text>A
			 member of the Board shall serve without compensation.</text>
						</paragraph><paragraph id="id9b81c6ff-5608-4b37-9b3f-a10230f8f8f9"><enum>(4)</enum><header>Travel
			 expenses</header><text>A member of the Board shall be allowed travel expenses,
			 including per diem in lieu of subsistence, at rates authorized for an employee
			 of an agency under subchapter I of chapter 57 of title 5, United States Code,
			 while away from the home or regular place of business of the member in the
			 performance of the duties of the Board.</text>
						</paragraph></subsection><subsection id="id500f3f9f-1da4-4afc-982b-dab3e6424ef7"><enum>(b)</enum><header>Appointment
			 and terms</header>
						<paragraph id="ida42006c4-e4bf-4706-b3e9-b1952a940e17"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise provided in this subsection, a member
			 of the Board described in any of subparagraphs (H) through (N) of subsection
			 (a)(2) shall serve for a term of 3 years.</text>
						</paragraph><paragraph id="idc0b82062-5128-47ab-b5fe-809bbafcb8a9"><enum>(2)</enum><header>Initial
			 board membership</header>
							<subparagraph id="id2EFD7C2585F24A86A38F0020780DD7F5"><enum>(A)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the representatives of the board established by the National Fish
			 Habitat Action Plan shall appoint the initial members of the Board described in
			 subparagraphs (H) through (I) and (K) through (N) of subsection (a)(2).</text>
							</subparagraph><subparagraph id="idEC098B0FAF4943468D157CD6A9733F9E"><enum>(B)</enum><header>Tribal
			 representatives</header><text>Not later than 180 days after the enactment of
			 this Act, the Secretary shall provide to the board established by the National
			 Fish Habitat Action Plan a recommendation of not less than 4 tribal
			 representatives, from which that board shall appoint 2 representatives pursuant
			 to subparagraph (J) of subsection (a)(2).</text>
							</subparagraph></paragraph><paragraph id="ida6c8f43e-713f-4d9c-b3d7-4474a5c0b4c0"><enum>(3)</enum><header>Transitional
			 terms</header><text>Of the members described in subsection (a)(2)(N) initially
			 appointed to the Board—</text>
							<subparagraph id="id30b2c335-9b9f-4f21-8265-b47dde40a4c9"><enum>(A)</enum><text>4 shall be
			 appointed for a term of 1 year;</text>
							</subparagraph><subparagraph id="id9f6fd7a5-ff38-469a-b21a-95085d655128"><enum>(B)</enum><text>4 shall be
			 appointed for a term of 2 years; and</text>
							</subparagraph><subparagraph id="idf7818c98-f770-4afd-b1fc-c396812efd1b"><enum>(C)</enum><text>3 shall be
			 appointed for a term of 3 years.</text>
							</subparagraph></paragraph><paragraph id="id6b9ceb5e-7ef5-465b-9397-ff44e54ff211"><enum>(4)</enum><header>Vacancies</header>
							<subparagraph id="id015013D0464C4B78B55F7B739BB7BA30"><enum>(A)</enum><header>In
			 general</header><text>A vacancy of a member of the Board described in any of
			 subparagraphs (H) through (I) or (K) through (N) of subsection (a)(2) shall be
			 filled by an appointment made by the remaining members of the Board.</text>
							</subparagraph><subparagraph id="ID6534aa2677a04076be876be351440ba5"><enum>(B)</enum><header>Tribal
			 representatives</header><text>Following a vacancy of a member of the Board
			 described in subparagraph (J) of subsection (a)(2), the Secretary shall
			 recommend to the Board not less than 4 tribal representatives, from which the
			 remaining members of the Board shall appoint a representative to fill the
			 vacancy.</text>
							</subparagraph></paragraph><paragraph id="id791ea50e-8d27-4acf-a66a-526616bae0de"><enum>(5)</enum><header>Continuation
			 of service</header><text>An individual whose term of service as a member of the
			 Board expires may continue to serve on the Board until a successor is
			 appointed.</text>
						</paragraph><paragraph id="id1755d58a-37b6-440b-a0b5-8a966fe38007"><enum>(6)</enum><header>Removal</header><text>If
			 a member of the Board described in any of subparagraphs (H) through (N) of
			 subsection (a)(2) misses 3 consecutive regularly scheduled Board meetings, the
			 members of the Board may—</text>
							<subparagraph id="idae87edf7-e22f-4ecf-9904-37a54c641946"><enum>(A)</enum><text>vote to
			 remove that member; and</text>
							</subparagraph><subparagraph id="idc8f6d1c0-e53c-453d-bd3b-10702ebc9708"><enum>(B)</enum><text>appoint
			 another individual in accordance with paragraph (4).</text>
							</subparagraph></paragraph></subsection><subsection id="idd6baa2d7-20a6-4533-bfe7-d00c9bee5611"><enum>(c)</enum><header>Chairperson</header>
						<paragraph id="id44e9b875-5f77-4a28-90bc-9d3a53f180cb"><enum>(1)</enum><header>In
			 general</header><text>The Board shall elect a member of the Board to serve as
			 Chairperson of the Board.</text>
						</paragraph><paragraph id="id378fbf2c-097e-4e46-bb03-d4b16b62b577"><enum>(2)</enum><header>Term</header><text>The
			 Chairperson of the Board shall serve for a term of 3 years.</text>
						</paragraph></subsection><subsection id="idac1294f5-220d-4ec9-b99e-90c26bef3119"><enum>(d)</enum><header>Meetings</header>
						<paragraph id="id21cf34be-381e-4a91-9b80-01011261de40"><enum>(1)</enum><header>In
			 general</header><text>The Board shall meet—</text>
							<subparagraph id="id84f30937-935a-4bc5-a8de-459941222426"><enum>(A)</enum><text>at the call
			 of the Chairperson; but</text>
							</subparagraph><subparagraph id="id3ce6b9b4-c290-474e-96a6-182c57b5851a"><enum>(B)</enum><text>not less
			 frequently than twice each calendar year.</text>
							</subparagraph></paragraph><paragraph id="id65809744-9f48-4c14-8165-897e9b0b03ac"><enum>(2)</enum><header>Public
			 access</header><text>All meetings of the Board shall be open to the
			 public.</text>
						</paragraph></subsection><subsection id="idcee43394-8c3f-4345-8112-74dafe929919"><enum>(e)</enum><header>Procedures</header>
						<paragraph id="ida144d34a-1bb9-4ebc-bb06-7b5bbb4dbcbe"><enum>(1)</enum><header>In
			 general</header><text>The Board shall establish procedures to carry out the
			 business of the Board, including—</text>
							<subparagraph id="id94f2fc33-123c-40b1-80fd-a778a3fa52e5"><enum>(A)</enum><text>a requirement
			 that a quorum of the members of the Board be present to transact
			 business;</text>
							</subparagraph><subparagraph id="idb81d29b2-c19c-48de-b9e0-74bdc348a29d"><enum>(B)</enum><text>a requirement
			 that no recommendations may be adopted by the Board, except by the vote of
			 <fraction>2/3</fraction> of all members present and voting;</text>
							</subparagraph><subparagraph id="id5f0caecc-c6c9-4ffc-bda9-0c5bd180ecf0"><enum>(C)</enum><text>procedures
			 for establishing national goals and priorities for aquatic habitat conservation
			 for the purposes of this subtitle;</text>
							</subparagraph><subparagraph id="iddf57f3b7-ec51-4b24-8ce1-866e2efca1bd"><enum>(D)</enum><text>procedures
			 for designating Partnerships under section 203; and</text>
							</subparagraph><subparagraph id="idb06a6509-284c-401c-93a0-50d8b640c180"><enum>(E)</enum><text>procedures
			 for reviewing, evaluating, and making recommendations regarding fish habitat
			 conservation projects.</text>
							</subparagraph></paragraph><paragraph id="idf76fbfbd-0db1-4db6-846f-3bbd42a66849"><enum>(2)</enum><header>Quorum</header><text>A
			 majority of the members of the Board shall constitute a quorum.</text>
						</paragraph></subsection></section><section id="id1e9560df-396c-436d-b1e0-fff88d04457c"><enum>203.</enum><header>Fish
			 habitat partnerships</header>
					<subsection id="id248c1e66-9ed0-4b29-bd5f-478700d9d585"><enum>(a)</enum><header>Authority
			 To designate</header><text>The Board may designate Fish Habitat Partnerships in
			 accordance with this section.</text>
					</subsection><subsection id="id4e811d19-4344-4b91-9dfe-bdc99f81a142"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of a Partnership shall be—</text>
						<paragraph id="id965136ef-191a-4c9a-a746-1cf67f75cbc6"><enum>(1)</enum><text>to coordinate
			 the implementation of the National Fish Habitat Action Plan at a regional
			 level;</text>
						</paragraph><paragraph id="id57338b2d-45cb-4223-8a81-d89613881262"><enum>(2)</enum><text>to identify
			 strategic priorities for fish habitat conservation;</text>
						</paragraph><paragraph id="id01155502-924e-43e1-8aaf-e81e1ff284ac"><enum>(3)</enum><text>to recommend
			 to the Board fish habitat conservation projects that address a strategic
			 priority of the Board; and</text>
						</paragraph><paragraph id="id6d90945a-7ea0-4e02-ac74-86559e609839"><enum>(4)</enum><text>to develop
			 and carry out fish habitat conservation projects.</text>
						</paragraph></subsection><subsection id="id95fa0f10-3668-4f68-bd39-88f44a6ae25f"><enum>(c)</enum><header>Applications</header><text>An
			 entity seeking to be designated as a Partnership shall submit to the Board an
			 application at such time, in such manner, and containing such information as
			 the Board may reasonably require.</text>
					</subsection><subsection id="ida01656f0-e1af-4ec8-ba9e-a45764ea3519"><enum>(d)</enum><header>Approval</header><text>The
			 Board may approve an application for a Partnership submitted under subsection
			 (c) if the Board determines that the applicant—</text>
						<paragraph id="idef101e68-0a37-447e-a59f-99a53a1c5208"><enum>(1)</enum><text>includes
			 representatives of a diverse group of public and private partners, including
			 Federal, State, or local governments, nonprofit entities, Indian tribes, and
			 private individuals, that are focused on conservation of aquatic habitats to
			 achieve results across jurisdictional boundaries on public and private
			 land;</text>
						</paragraph><paragraph id="id3b108bbe-bc23-45d7-998d-e1810232660c"><enum>(2)</enum><text>is organized
			 to promote the health of important aquatic habitats and distinct geographical
			 areas, keystone fish species, or system types, including reservoirs, natural
			 lakes, coastal and marine environments, and estuaries;</text>
						</paragraph><paragraph id="id367143c8-f89f-4bd6-9c1c-5a07acd54123"><enum>(3)</enum><text>identifies
			 strategic fish and aquatic habitat priorities for the Partnership area in the
			 form of geographical focus areas or key stressors or impairments to facilitate
			 strategic planning and decisionmaking;</text>
						</paragraph><paragraph id="id0a1cb9b1-5b1e-40ef-ba00-0390e92f7c67"><enum>(4)</enum><text>is able to
			 address issues and priorities on a nationally significant scale;</text>
						</paragraph><paragraph id="id9cbbcc7a-8225-45e7-b189-e1644a48fd63"><enum>(5)</enum><text>includes a
			 governance structure that—</text>
							<subparagraph id="id7e3b8fb4-6bc3-4a5b-9295-3d417189f87b"><enum>(A)</enum><text>reflects the
			 range of all partners; and</text>
							</subparagraph><subparagraph id="ideb2791d8-0a2e-437c-830c-2e8717eb2cac"><enum>(B)</enum><text>promotes
			 joint strategic planning and decisionmaking by the applicant;</text>
							</subparagraph></paragraph><paragraph id="id084ded1c-b5b7-401b-83a0-7861a7ca75e2"><enum>(6)</enum><text>demonstrates
			 completion of, or significant progress toward the development of, a strategic
			 plan to address the causes of system decline in fish populations, rather than
			 simply treating symptoms in accordance with the National Fish Habitat Action
			 Plan; and</text>
						</paragraph><paragraph id="id982ca341-27d2-4ea3-943b-a3ac383fb87d"><enum>(7)</enum><text>ensures
			 collaboration in developing a strategic vision and implementation program that
			 is scientifically sound and achievable.</text>
						</paragraph></subsection></section><section id="id800f5f0b-9381-4e74-9ba9-1f914bd122a7"><enum>204.</enum><header>Fish
			 habitat conservation projects</header>
					<subsection id="ide0c76474-a78e-4d48-ac2e-6a49e4c78b09"><enum>(a)</enum><header>Submission
			 to Board</header><text>Not later than March 31 of each calendar year, each
			 Partnership shall submit to the Board a list of fish habitat conservation
			 projects recommended by the Partnership for annual funding under this
			 subtitle.</text>
					</subsection><subsection id="id6217d4a4-b09f-41b7-a899-5f46f38f32d0"><enum>(b)</enum><header>Recommendations
			 by Board</header><text>Not later than July 1 of each calendar year, the Board
			 shall submit to the Secretary a description, including estimated costs, of each
			 fish habitat conservation project that the Board recommends that the Secretary
			 approve and fund under this subtitle, in order of priority, for the following
			 fiscal year.</text>
					</subsection><subsection id="ide8fe8484-76cc-4f81-b10f-165eda4b2b1f"><enum>(c)</enum><header>Considerations</header><text>The
			 Board shall select each fish habitat conservation project to be recommended to
			 the Secretary under subsection (b)—</text>
						<paragraph id="id084d7f77-cc53-4bc6-81dd-aa4521fc411c"><enum>(1)</enum><text>based on a
			 recommendation of the Partnership that is, or will be, participating actively
			 in carrying out the fish habitat conservation project; and</text>
						</paragraph><paragraph id="id486158ad-d24d-4983-b9fd-37a29441dac8"><enum>(2)</enum><text>after taking
			 into consideration—</text>
							<subparagraph id="id9fe5a849-7038-4a20-96ca-ddadc3a062d5"><enum>(A)</enum><text>the extent to
			 which the fish habitat conservation project fulfills a purpose of this subtitle
			 or a goal of the National Fish Habitat Action Plan;</text>
							</subparagraph><subparagraph id="id00df1e39-94d8-4b00-a172-7d9a005a6c70"><enum>(B)</enum><text>the extent to
			 which the fish habitat conservation project addresses the national priorities
			 established by the Board;</text>
							</subparagraph><subparagraph id="id7fd7f0d9-7a97-4990-adf1-3b632303aec6"><enum>(C)</enum><text>the
			 availability of sufficient non-Federal funds to match Federal contributions for
			 the fish habitat conservation project, as required by subsection (e);</text>
							</subparagraph><subparagraph id="id8d249995-f9de-43fc-8cca-cfd354bb492b"><enum>(D)</enum><text>the extent to
			 which the fish habitat conservation project—</text>
								<clause id="id8df911ce-be2a-45b0-8174-683fd70f73f3"><enum>(i)</enum><text>increases
			 fishing opportunities for the public;</text>
								</clause><clause id="id1eff091f-8a12-4345-afeb-4114bb95cca5"><enum>(ii)</enum><text>will be
			 carried out through a cooperative agreement among Federal, State, and local
			 governments, Indian tribes, and private entities;</text>
								</clause><clause id="id42e744b6-fe83-405d-bb0b-f96a00d976c8"><enum>(iii)</enum><text>increases
			 public access to land or water;</text>
								</clause><clause id="id52d01a21-2bb5-41c2-a903-3552edb3c039"><enum>(iv)</enum><text>advances the
			 conservation of fish and wildlife species that are listed, or are candidates to
			 be listed, as threatened species or endangered species under the Endangered
			 Species Act of 1973 (16 U.S.C. 1531 et seq.);</text>
								</clause><clause id="ida407d643-0455-4df6-9115-666427b241eb"><enum>(v)</enum><text>where
			 appropriate, advances the conservation of fish and fish habitats under the
			 Magnuson-Stevens Act (16 U.S.C. 1801 et seq.) and other relevant Federal law
			 and State wildlife action plans; and</text>
								</clause><clause id="idfc3073f2-9ac1-4822-aa63-d39042a3c3ac"><enum>(vi)</enum><text>promotes
			 resilience such that desired biological communities are able to persist and
			 adapt to environmental stressors such as climate change; and</text>
								</clause></subparagraph><subparagraph id="id5d24cd0d-a62a-4bb9-9d2e-2d3d3bb34e8d"><enum>(E)</enum><text>the
			 substantiality of the character and design of the fish habitat conservation
			 project.</text>
							</subparagraph></paragraph></subsection><subsection id="idedd7bce1-cdc4-445b-bfe6-7feac71f7ac5"><enum>(d)</enum><header>Limitations</header>
						<paragraph id="id2899ebec-8959-4038-b041-92ffdf87e3c5"><enum>(1)</enum><header>Requirements
			 for evaluation</header><text>No fish habitat conservation project may be
			 recommended by the Board under subsection (b) or provided financial assistance
			 under this subtitle unless the fish habitat conservation project includes an
			 evaluation plan designed—</text>
							<subparagraph id="id493ad3b3-e61b-400f-8729-1642cd891048"><enum>(A)</enum><text>to
			 appropriately assess the biological, ecological, or other results of the
			 habitat protection, restoration, or enhancement activities carried out using
			 the assistance;</text>
							</subparagraph><subparagraph id="idffe590ad-c522-4827-a980-68fd7b00912d"><enum>(B)</enum><text>to reflect
			 appropriate changes to the fish habitat conservation project if the assessment
			 substantiates that the fish habitat conservation project objectives are not
			 being met; and</text>
							</subparagraph><subparagraph id="id2f455aba-99f4-483f-beb4-093edd8c7a5c"><enum>(C)</enum><text>to require
			 the submission to the Board of a report describing the findings of the
			 assessment.</text>
							</subparagraph></paragraph><paragraph id="id10dc3630-b4d9-4dac-b8f2-6136173541c8"><enum>(2)</enum><header>Acquisition
			 of real property interests</header>
							<subparagraph id="id6375f40f-5672-47f5-9c7a-08b3da8e403e"><enum>(A)</enum><header>In
			 general</header><text>No fish habitat conservation project that will result in
			 the acquisition by the State, local government, or other non-Federal entity, in
			 whole or in part, of any real property interest may be recommended by the Board
			 under subsection (b) or provided financial assistance under this subtitle
			 unless the project meets the requirements of subparagraph (B).</text>
							</subparagraph><subparagraph id="idb6f88b4c-a45e-4f1b-98b0-4e4acdb54867"><enum>(B)</enum><header>Requirements</header>
								<clause id="ide33b453a-8f56-4afd-b422-d42202caec4e"><enum>(i)</enum><header>In
			 general</header><text>A real property interest may not be acquired pursuant to
			 a fish habitat conservation project by a State, public agency, or other
			 non-Federal entity unless the State, agency, or other non-Federal entity is
			 obligated to undertake the management of the property being acquired in
			 accordance with the purposes of this subtitle.</text>
								</clause><clause id="idb35fa487-56f3-4e7a-8e2f-91d4ecd664da"><enum>(ii)</enum><header>Additional
			 conditions</header><text>Any real property interest acquired by a State, local
			 government, or other non-Federal entity pursuant to a fish habitat conservation
			 project shall be subject to terms and conditions that ensure that the interest
			 will be administered for the long-term conservation and management of the
			 aquatic ecosystem and the fish and wildlife dependent on that ecosystem.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="id912ca7bf-737b-44af-b58b-246c5f0f8be3"><enum>(e)</enum><header>Non-Federal
			 contributions</header>
						<paragraph id="idbe96873c-6ca8-413a-9f7c-777d2c951cae"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), no fish habitat
			 conservation project may be recommended by the Board under subsection (b) or
			 provided financial assistance under this subtitle unless at least 50 percent of
			 the cost of the fish habitat conservation project will be funded with
			 non-Federal funds.</text>
						</paragraph><paragraph id="ide0dd8d4e-db75-413b-904f-8e68eb407ce9"><enum>(2)</enum><header>Projects on
			 Federal land or water</header><text>Notwithstanding paragraph (1), Federal
			 funds may be used for payment of 100 percent of the costs of a fish habitat
			 conservation project located on Federal land or water.</text>
						</paragraph><paragraph id="idba959294-0cfb-4c05-9706-611643b627b9"><enum>(3)</enum><header>Non-Federal
			 share</header><text>The non-Federal share of the cost of a fish habitat
			 conservation project—</text>
							<subparagraph id="idfdcc0b7f-9250-42fd-a3e0-643598ddb039"><enum>(A)</enum><text>may not be
			 derived from a Federal grant program; but</text>
							</subparagraph><subparagraph id="id69ef966a-13b8-4b7e-b67e-d2c83245b6b3"><enum>(B)</enum><text>may include
			 in-kind contributions and cash.</text>
							</subparagraph></paragraph><paragraph id="idf3c26bff-93f5-4db4-b9e3-f8d06beca19b"><enum>(4)</enum><header>Special
			 rule for Indian tribes</header><text>Notwithstanding paragraph (1) or any other
			 provision of law, any funds made available to an Indian tribe pursuant to this
			 subtitle may be considered to be non-Federal funds for the purpose of paragraph
			 (1).</text>
						</paragraph></subsection><subsection id="id512c8059-1674-47cb-bef2-025d15a8a67f"><enum>(f)</enum><header>Approval</header>
						<paragraph id="id84412e31-d98e-4827-a73d-ebbd04cc792d"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of receipt of the
			 recommendations of the Board for fish habitat conservation projects under
			 subsection (b), and based, to the maximum extent practicable, on the criteria
			 described in subsection (c)—</text>
							<subparagraph id="id692D28C953BC4040B55AC1612F98CC6A"><enum>(A)</enum><text>the Secretary
			 shall approve, reject, or reorder the priority of any fish habitat conservation
			 project recommended by the Board that is not within a marine or estuarine
			 habitat; and</text>
							</subparagraph><subparagraph id="idF4FE32DE9F0944C08D1D7346DFCAF943"><enum>(B)</enum><text>the Secretary and
			 the Secretary of Commerce shall jointly approve, reject, or reorder the
			 priority of any fish habitat conservation project recommended by the Board that
			 is within a marine or estuarine habitat.</text>
							</subparagraph></paragraph><paragraph id="id30ee874c-793e-4bf2-8f78-6664abf27b6e"><enum>(2)</enum><header>Funding</header><text>If
			 the Secretary, or the Secretary and the Secretary of Commerce jointly, approves
			 a fish habitat conservation project under paragraph (1), the Secretary, or the
			 Secretary and the Secretary of Commerce jointly, shall use amounts made
			 available to carry out this subtitle to provide funds to carry out the fish
			 habitat conservation project.</text>
						</paragraph><paragraph id="id08b2667b-f106-4699-a627-01405555acfb"><enum>(3)</enum><header>Notification</header><text>If
			 the Secretary, or the Secretary and the Secretary of Commerce jointly, rejects
			 or reorders the priority of any fish habitat conservation project recommended
			 by the Board under subsection (b), the Secretary, or the Secretary and the
			 Secretary of Commerce jointly, shall provide to the Board and the appropriate
			 Partnership a written statement of the reasons that the Secretary, or the
			 Secretary and the Secretary of Commerce jointly, rejected or modified the
			 priority of the fish habitat conservation project.</text>
						</paragraph><paragraph id="ID60100ce8b24d4ff9ba128daecc715dd7"><enum>(4)</enum><header>Limitation</header><text>If
			 the Secretary, or the Secretary and the Secretary of Commerce jointly, has not
			 approved, rejected, or reordered the priority of the recommendations of the
			 Board for fish habitat conservation projects by the date that is 180 days after
			 the date of receipt of the recommendations, the recommendations shall be
			 considered to be approved.</text>
						</paragraph></subsection></section><section id="id3c767d77-dea6-481c-9e5b-a279a7882fb1"><enum>205.</enum><header>National
			 Fish Habitat Conservation Partnership Office</header>
					<subsection id="id7f576bca-941a-4ae7-ba07-f97b78823e9a"><enum>(a)</enum><header>Establishment</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Director shall
			 establish an office, to be known as the <quote>National Fish Habitat
			 Conservation Partnership Office</quote>, within the United States Fish and
			 Wildlife Service.</text>
					</subsection><subsection id="id35a3d8ca-ea6d-4a0c-86ba-ae47f8e4b185"><enum>(b)</enum><header>Functions</header><text>The
			 National Fish Habitat Conservation Partnership Office shall—</text>
						<paragraph id="ida0912645-2bc5-4cec-9666-a278f4ea4789"><enum>(1)</enum><text>provide
			 funding for the operational needs of the Partnerships, including funding for
			 activities such as planning, project development and implementation,
			 coordination, monitoring, evaluation, communication, and outreach;</text>
						</paragraph><paragraph id="id34dbe1ec-820a-4706-8354-c7970ab81a23"><enum>(2)</enum><text>provide
			 funding to support the detail of State and tribal fish and wildlife staff to
			 the Office;</text>
						</paragraph><paragraph id="ide1dc8623-0625-4159-aeef-f3387be4403e"><enum>(3)</enum><text>facilitate
			 the cooperative development and approval of Partnerships;</text>
						</paragraph><paragraph id="idcd021690-b3c6-4374-af3a-f79260138efd"><enum>(4)</enum><text>assist the
			 Secretary and the Board in carrying out this subtitle;</text>
						</paragraph><paragraph id="id605afdb0-defc-4b0b-860e-a3537075caea"><enum>(5)</enum><text>assist the
			 Secretary in carrying out the requirements of sections 206 and 208;</text>
						</paragraph><paragraph id="id87273a07-e331-425a-a19b-4d35b219fce9"><enum>(6)</enum><text>facilitate
			 communication, cohesiveness, and efficient operations for the benefit of
			 Partnerships and the Board;</text>
						</paragraph><paragraph id="idcf31e053-b11a-458b-8651-b4ef060bbd29"><enum>(7)</enum><text>facilitate,
			 with assistance from the Director, the Assistant Administrator, and the
			 President of the Association of Fish and Wildlife Agencies, the consideration
			 of fish habitat conservation projects by the Board;</text>
						</paragraph><paragraph id="id99557c2f-41e6-47ce-a34d-66f5ba275a20"><enum>(8)</enum><text>provide
			 support to the Director regarding the development and implementation of the
			 interagency operational plan under subsection (c);</text>
						</paragraph><paragraph id="id6f5d0858-931a-4e10-a29c-ef00dd3a8fa2"><enum>(9)</enum><text>coordinate
			 technical and scientific reporting as required by section 209;</text>
						</paragraph><paragraph id="id992af6ef-0ade-4946-a06a-f62d3c31a51e"><enum>(10)</enum><text>facilitate
			 the efficient use of resources and activities of Federal departments and
			 agencies to carry out this subtitle in an efficient manner; and</text>
						</paragraph><paragraph id="idb94fb6a7-6b7b-4cfe-9938-c37a1787da78"><enum>(11)</enum><text>provide
			 support to the Board for national communication and outreach efforts that
			 promote public awareness of fish habitat conservation.</text>
						</paragraph></subsection><subsection id="id624954b8-e4f8-44ef-a76a-c93c26f88ee5"><enum>(c)</enum><header>Interagency
			 operational plan</header><text>Not later than 1 year after the date of
			 enactment of this Act, and every 5 years thereafter, the Director, in
			 cooperation with the Assistant Administrator and the heads of other appropriate
			 Federal departments and agencies, shall develop an interagency operational plan
			 for the National Fish Habitat Conservation Partnership Office that
			 describes—</text>
						<paragraph id="id602b8f2e-3b4c-4391-a192-acb9f22f03e9"><enum>(1)</enum><text>the
			 functional, operational, technical, scientific, and general staff,
			 administrative, and material needs of the Office; and</text>
						</paragraph><paragraph id="idfb100fb9-aabb-48f1-8d6c-baa5ff9c7333"><enum>(2)</enum><text>any
			 interagency agreements between or among Federal departments and agencies to
			 address those needs.</text>
						</paragraph></subsection><subsection id="id88075de1-a370-4da5-9e2d-8c7359f2139e"><enum>(d)</enum><header>Staff and
			 support</header>
						<paragraph id="id071ada4b-1349-4111-a7f7-6bbad8cd3e8d"><enum>(1)</enum><header>Departments
			 of Interior and Commerce</header><text>The Director and the Assistant
			 Administrator shall each provide appropriate staff to support the National Fish
			 Habitat Conservation Partnership Office, subject to the availability of funds
			 under section 213.</text>
						</paragraph><paragraph id="idbf2a7e66-5b4a-4e73-adbf-7a1f75c2546e"><enum>(2)</enum><header>States and
			 Indian tribes</header><text>Each State and Indian tribe is encouraged to
			 provide staff to support the National Fish Habitat Conservation Partnership
			 Office.</text>
						</paragraph><paragraph id="id9af0bc64-7490-42bf-b25d-e2f6fd08dd64"><enum>(3)</enum><header>Detailees
			 and contractors</header><text>The National Fish Habitat Conservation
			 Partnership Office may accept staff or other administrative support from other
			 entities—</text>
							<subparagraph id="idef787576-16a4-4bda-a6b6-5fcdd225d7fe"><enum>(A)</enum><text>through
			 interagency details; or</text>
							</subparagraph><subparagraph id="id015b0a38-5afd-4240-a187-ca8df14d06bf"><enum>(B)</enum><text>as
			 contractors.</text>
							</subparagraph></paragraph><paragraph id="ida452c520-75ae-4173-a587-be1af57afe9a"><enum>(4)</enum><header>Qualifications</header><text>The
			 staff of the National Fish Habitat Conservation Partnership Office shall
			 include members with education and experience relating to the principles of
			 fish, wildlife, and aquatic habitat conservation.</text>
						</paragraph><paragraph id="idd58035b9-02a6-48d7-a19b-01de7a0d47b8"><enum>(5)</enum><header>Waiver of
			 requirement</header><text>The Secretary may waive all or part of the
			 non-Federal contribution requirement under section 204(e)(1) if the Secretary
			 determines that—</text>
							<subparagraph id="idf4588afc-34dd-4f12-a156-7e68b9e24204"><enum>(A)</enum><text>no reasonable
			 means are available through which the affected applicant can meet the
			 requirement; and</text>
							</subparagraph><subparagraph id="idbc7cfe81-522c-4eaf-927f-3ed0d0b1e98d"><enum>(B)</enum><text>the probable
			 benefit of the relevant fish habitat conservation project outweighs the public
			 interest in meeting the requirement.</text>
							</subparagraph></paragraph></subsection><subsection id="id4eb4e26b-d84d-4c89-8e53-1eec491ef60a"><enum>(e)</enum><header>Reports</header><text>Not
			 less frequently than once each year, the Director shall provide to the Board a
			 report describing the activities of the National Fish Habitat Conservation
			 Partnership Office.</text>
					</subsection></section><section id="id4676a070-72e1-46b0-8e0c-71c126d4c01a"><enum>206.</enum><header>Technical
			 and scientific assistance</header>
					<subsection id="id9EECAAC38D7D4C17BEFADB222A57C4CF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director, the
			 Assistant Administrator, and the Director of the United States Geological
			 Survey, in coordination with the Forest Service and other appropriate Federal
			 departments and agencies, shall provide scientific and technical assistance to
			 the Partnerships, participants in fish habitat conservation projects, and the
			 Board.</text>
					</subsection><subsection id="id92D6E12FD12C40D1A56586F589309552"><enum>(b)</enum><header>Inclusions</header><text>Scientific
			 and technical assistance provided pursuant to subsection (a) may
			 include—</text>
						<paragraph id="id1ff1991a-3336-428c-b7a5-8851d6b5cb23"><enum>(1)</enum><text>providing
			 technical and scientific assistance to States, Indian tribes, regions, local
			 communities, and nongovernmental organizations in the development and
			 implementation of Partnerships;</text>
						</paragraph><paragraph id="idad428a90-01dc-4d9f-ad57-3c5c89a37ab4"><enum>(2)</enum><text>providing
			 technical and scientific assistance to Partnerships for habitat assessment,
			 strategic planning, and prioritization;</text>
						</paragraph><paragraph id="ida498ad8a-17fd-486c-ae88-6fd297b67b79"><enum>(3)</enum><text>supporting
			 the development and implementation of fish habitat conservation projects that
			 are identified as high priorities by Partnerships and the Board;</text>
						</paragraph><paragraph id="ide743d9fc-f729-4464-8eb8-b23d6dee504b"><enum>(4)</enum><text>supporting
			 and providing recommendations regarding the development of science-based
			 monitoring and assessment approaches for implementation through
			 Partnerships;</text>
						</paragraph><paragraph id="id20d04519-e55e-46c4-b283-971d2156633e"><enum>(5)</enum><text>supporting
			 and providing recommendations for a national fish habitat assessment;
			 and</text>
						</paragraph><paragraph id="idb7b1e6c7-66fa-4bbf-9c4c-2134b9b9240c"><enum>(6)</enum><text>ensuring the
			 availability of experts to conduct scientifically based evaluation and
			 reporting of the results of fish habitat conservation projects.</text>
						</paragraph></subsection></section><section id="idd9417e3d-343b-4db7-ba96-356269889800"><enum>207.</enum><header>Conservation
			 of aquatic habitat for fish and other aquatic organisms on Federal
			 land</header><text display-inline="no-display-inline">To the extent consistent
			 with the mission and authority of the applicable department or agency, the head
			 of each Federal department and agency responsible for acquiring, managing, or
			 disposing of Federal land or water shall cooperate with the Assistant
			 Administrator and the Director to conserve the aquatic habitats for fish and
			 other aquatic organisms within the land and water of the department or
			 agency.</text>
				</section><section id="idcc6fe8ad-6720-49b5-b628-9766eb03ce00"><enum>208.</enum><header>Coordination
			 with States and Indian tribes</header><text display-inline="no-display-inline">The Secretary shall provide a notice to, and
			 coordinate with, the appropriate State agency or tribal agency, as applicable,
			 of each State and Indian tribe within the boundaries of which an activity is
			 planned to be carried out pursuant to this subtitle by not later than 30 days
			 before the date on which the activity is implemented.</text>
				</section><section id="iddc538f39-b960-4d4e-a664-9f9c4e20bd06"><enum>209.</enum><header>Accountability
			 and reporting</header>
					<subsection id="id8c50e9e0-2474-456c-ae6a-852bef601544"><enum>(a)</enum><header>Implementation
			 reports</header>
						<paragraph id="id6b120afd-b94b-4bd8-9749-dfe30d742d39"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, and every 2 years thereafter, the Board shall submit to the
			 appropriate congressional committees a report describing the implementation
			 of—</text>
							<subparagraph id="idccd655c4-2972-49a4-8f04-5de44359a191"><enum>(A)</enum><text>this
			 subtitle; and</text>
							</subparagraph><subparagraph id="idbe8f18e9-4542-4a5c-ae09-04793c0aaac5"><enum>(B)</enum><text>the National
			 Fish Habitat Action Plan.</text>
							</subparagraph></paragraph><paragraph id="id9a9b29ee-030f-4d9a-8c47-a9cf16b98f40"><enum>(2)</enum><header>Contents</header><text>Each
			 report submitted under paragraph (1) shall include—</text>
							<subparagraph id="id4886aabc-2227-432c-b652-8a5c8df59a29"><enum>(A)</enum><text>an estimate
			 of the number of acres, stream miles, or acre-feet (or other suitable measure)
			 of aquatic habitat that was protected, restored, or enhanced under the National
			 Fish Habitat Action Plan by Federal, State, or local governments, Indian
			 tribes, or other entities in the United States during the 2-year period ending
			 on the date of submission of the report;</text>
							</subparagraph><subparagraph id="idf31be3ab-a0da-4a1c-8715-442806dc9a85"><enum>(B)</enum><text>a description
			 of the public access to aquatic habitats protected, restored, or established
			 under the National Fish Habitat Action Plan during that 2-year period;</text>
							</subparagraph><subparagraph id="id3ed54f05-59ee-4d82-85be-dbfd3f53a1f0"><enum>(C)</enum><text>a description
			 of the opportunities for public fishing established under the National Fish
			 Habitat Action Plan during that period; and</text>
							</subparagraph><subparagraph id="idb76220d9-c4df-440d-b4d6-306003e169bd"><enum>(D)</enum><text>an assessment
			 of the status of fish habitat conservation projects carried out with funds
			 provided under this subtitle during that period, disaggregated by year,
			 including—</text>
								<clause id="id6c48bb07-a692-48e2-bac7-51698a7dccd3"><enum>(i)</enum><text>a description
			 of the fish habitat conservation projects recommended by the Board under
			 section 204(b);</text>
								</clause><clause id="id57f23334-e782-484a-af23-1e936f772239"><enum>(ii)</enum><text>a
			 description of each fish habitat conservation project approved by the Secretary
			 under section 204(f), in order of priority for funding;</text>
								</clause><clause id="id54ab9751-0216-4c65-9605-d106420ac3b0"><enum>(iii)</enum><text>a
			 justification for—</text>
									<subclause id="id6f0a6f4d-3726-43fe-9bef-5df68b795406"><enum>(I)</enum><text>the approval
			 of each fish habitat conservation project; and</text>
									</subclause><subclause id="id84324d07-4318-42a3-89fd-7870167e8128"><enum>(II)</enum><text>the order of
			 priority for funding of each fish habitat conservation project;</text>
									</subclause></clause><clause id="idca57d844-93af-417b-b7cd-ad771c6b4f3d"><enum>(iv)</enum><text>a
			 justification for any rejection or reordering of the priority of each fish
			 habitat conservation project recommended by the Board under section 204(b) that
			 was based on a factor other than the criteria described in section 204(c);
			 and</text>
								</clause><clause id="idd057becb-2c14-4706-81cd-cada43b8dbe4"><enum>(v)</enum><text>an accounting
			 of expenditures by Federal, State, or local governments, Indian tribes, or
			 other entities to carry out fish habitat conservation projects.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="idf454e6ae-7f11-4b64-ab28-37edfbf4038b"><enum>(b)</enum><header>Status and
			 trends report</header><text>Not later than December 31, 2012, and every 5 years
			 thereafter, the Board shall submit to the appropriate congressional committees
			 a report describing the status of aquatic habitats in the United States.</text>
					</subsection><subsection id="id0c292bd8-9db8-4e3c-9397-e7c98eaff1f7"><enum>(c)</enum><header>Revisions</header><text>Not
			 later than December 31, 2013, and every 5 years thereafter, the Board shall
			 revise the goals and other elements of the National Fish Habitat Action Plan,
			 after consideration of each report required by subsection (b).</text>
					</subsection></section><section id="id7ebf60e9-9890-468b-a666-b5878e8d2b53"><enum>210.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary may promulgate such
			 regulations as the Secretary determines to be necessary to carry out this
			 subtitle.</text>
				</section><section id="id7fc9a4f6-eb0a-4dc7-ac6a-d5de7d96551b"><enum>211.</enum><header>Effect of
			 subtitle</header>
					<subsection id="idb1824fc8-ede4-45ae-92ee-009fb86d596b"><enum>(a)</enum><header>Water
			 rights</header><text>Nothing in this subtitle—</text>
						<paragraph id="id4938d9ec-e15a-46ce-be51-054fecfd0c50"><enum>(1)</enum><text>establishes
			 any express or implied reserved water right in the United States for any
			 purpose;</text>
						</paragraph><paragraph id="id839b2c6a-7d1a-407e-8b7a-e42d56d93707"><enum>(2)</enum><text>affects any
			 water right in existence on the date of enactment of this Act;</text>
						</paragraph><paragraph id="ID35af6823331d4e27af3a4aca08a77f00"><enum>(3)</enum><text>preempts or
			 affects any State water law or interstate compact governing water; or</text>
						</paragraph><paragraph id="id0d2293dd-10a7-43cc-addb-43a03a024d26"><enum>(4)</enum><text>affects any
			 Federal or State law in existence on the date of enactment of the Act regarding
			 water quality or water quantity.</text>
						</paragraph></subsection><subsection id="id77589390-1499-4222-9604-9d60305aceab"><enum>(b)</enum><header>State
			 authority</header><text>Nothing in this subtitle—</text>
						<paragraph id="idb01346bb-ba27-4c12-85a9-e53aa99f2477"><enum>(1)</enum><text>affects the
			 authority, jurisdiction, or responsibility of a State to manage, control, or
			 regulate fish and wildlife under the laws and regulations of the State;
			 or</text>
						</paragraph><paragraph id="idc672907d-e219-41b6-9e06-9c92e1f7c60a"><enum>(2)</enum><text>authorizes
			 the Secretary to control or regulate within a State the fishing or hunting of
			 fish and wildlife.</text>
						</paragraph></subsection><subsection id="id5121aa81-8ea9-4ea0-b83e-5576c727721a"><enum>(c)</enum><header>Effect on
			 Indian tribes</header><text>Nothing in this subtitle abrogates, abridges,
			 affects, modifies, supersedes, or alters any right of an Indian tribe
			 recognized by treaty or any other means, including—</text>
						<paragraph id="id18b95264-be45-4482-81ea-f17813ebdd2b"><enum>(1)</enum><text>an agreement
			 between the Indian tribe and the United States;</text>
						</paragraph><paragraph id="id05f4b211-b662-43fb-8e80-44568e10fbd7"><enum>(2)</enum><text>Federal law
			 (including regulations);</text>
						</paragraph><paragraph id="id44126129-d379-4f98-adda-ff8691d19183"><enum>(3)</enum><text>an Executive
			 order; or</text>
						</paragraph><paragraph id="iddb1b358d-0ab4-4204-9c8d-5f24cca6a9c9"><enum>(4)</enum><text>a judicial
			 decree.</text>
						</paragraph></subsection><subsection id="ida507fd77-65b0-4622-8eb5-b62138bc50cd"><enum>(d)</enum><header>Adjudication
			 of water rights</header><text>Nothing in this subtitle diminishes or affects
			 the ability of the Secretary to join an adjudication of rights to the use of
			 water pursuant to subsection (a), (b), or (c) of section 208 of the Department
			 of Justice Appropriation Act, 1953 (43 U.S.C. 666).</text>
					</subsection><subsection id="id2f04b36b-23ae-4f62-8f9a-dfa8af7b4829"><enum>(e)</enum><header>Effect on
			 other authorities</header>
						<paragraph id="id4e846997-0047-47e0-ae9e-464bc8759e5e"><enum>(1)</enum><header>Acquisition
			 of land and water</header><text>Nothing in this subtitle alters or otherwise
			 affects the authorities, responsibilities, obligations, or powers of the
			 Secretary to acquire land, water, or an interest in land or water under any
			 other provision of law.</text>
						</paragraph><paragraph id="id445a9709-4f50-4d1d-b072-799fb8ca5ec8"><enum>(2)</enum><header>Private
			 property protection</header><text>Nothing in this subtitle permits the use of
			 funds made available to carry out this subtitle to acquire real property or a
			 real property interest without the written consent of each owner of the real
			 property or real property interest.</text>
						</paragraph><paragraph id="id1f83c7c4-2ea3-4a86-8c05-b2de4119b74b"><enum>(3)</enum><header>Mitigation</header><text>Nothing
			 in this subtitle permits the use of funds made available to carry out this
			 subtitle for fish and wildlife mitigation purposes under—</text>
							<subparagraph id="idd4367e1b-432f-4683-967d-c3203cf8af2a"><enum>(A)</enum><text>the Federal
			 Water Pollution Control Act (33 U.S.C. 1251 et seq.);</text>
							</subparagraph><subparagraph id="ide101cab9-3482-4716-a3ef-be948054e89f"><enum>(B)</enum><text>the Fish and
			 Wildlife Coordination Act (16 U.S.C. 661 et seq.);</text>
							</subparagraph><subparagraph id="id111adf9f-0695-49ed-a919-96d5cc694536"><enum>(C)</enum><text>the Water
			 Resources Development Act of 1986 (Public Law 99–662; 100 Stat. 4082);
			 or</text>
							</subparagraph><subparagraph id="id79de4c47-ddbe-4d89-8afc-eefe09287db5"><enum>(D)</enum><text>any other
			 Federal law or court settlement.</text>
							</subparagraph></paragraph></subsection></section><section id="idc3d5c5c4-7e79-434f-8230-02423487130c"><enum>212.</enum><header>Nonapplicability
			 of Federal Advisory Committee Act</header><text display-inline="no-display-inline">The Federal Advisory Committee Act (5 U.S.C.
			 App.) shall not apply to—</text>
					<paragraph id="id913aafd5-5ad1-4941-93b9-c0d9c6453abb"><enum>(1)</enum><text>the Board;
			 or</text>
					</paragraph><paragraph id="id7e8a4174-2e32-4f94-bd54-43fd9dc42d37"><enum>(2)</enum><text>any
			 Partnership.</text>
					</paragraph></section><section id="iddf94e0b4-2ac6-4b3c-a9e0-c082d8fe1489"><enum>213.</enum><header>Funding</header>
					<subsection id="ide1b8a06d-d7dd-4bc8-8f33-e721ae171b52"><enum>(a)</enum><header>Authorization
			 of appropriations</header>
						<paragraph id="ID269c53c652284cb5be126d93e36844c3"><enum>(1)</enum><header>Fish habitat
			 conservation projects</header><text>There is authorized to be appropriated to
			 the Secretary $7,200,000 for each of fiscal years 2012 through 2016 to provide
			 funds for fish habitat conservation projects approved under section 204(f), of
			 which 5 percent shall be made available for each fiscal year for projects
			 carried out by Indian tribes.</text>
						</paragraph><paragraph id="id20a9ffff-b577-49e0-9b11-3c01b7d2777f"><enum>(2)</enum><header>National
			 Fish Habitat Conservation Partnership Office</header>
							<subparagraph id="id663fb58b-c56f-466d-b043-8fae2024f294"><enum>(A)</enum><header>In
			 general</header><text>There is authorized to be appropriated to the Secretary
			 for each of fiscal years 2012 through 2016 for the National Fish Habitat
			 Conservation Partnership Office, and to carry out section 209, an amount equal
			 to 5 percent of the amount appropriated for the applicable fiscal year pursuant
			 to paragraph (1).</text>
							</subparagraph><subparagraph id="idb880ee94-21b2-4fe8-9d6c-02b74dd5d96d"><enum>(B)</enum><header>Required
			 transfers</header><text>The Secretary shall annually transfer to other Federal
			 departments and agencies such percentage of the amounts made available pursuant
			 to subparagraph (A) as is required to support participation by those
			 departments and agencies in the National Fish Habitat Conservation Partnership
			 Office pursuant to the interagency operational plan under section
			 205(c).</text>
							</subparagraph></paragraph><paragraph id="id5a027021-b7ba-45ac-b962-8e241010a6a3"><enum>(3)</enum><header>Technical
			 and scientific assistance</header><text>There are authorized to be appropriated
			 for each of fiscal years 2012 through 2016 to carry out, and provide technical
			 and scientific assistance under, section 206—</text>
							<subparagraph id="id4ba74f03-0795-4885-a518-b5dda64cc50f"><enum>(A)</enum><text>$500,000 to
			 the Secretary for use by the United States Fish and Wildlife Service;</text>
							</subparagraph><subparagraph id="id77cd7b0e-785a-4b95-a4b4-08551daea15f"><enum>(B)</enum><text>$500,000 to
			 the Assistant Administrator for use by the National Oceanic and Atmospheric
			 Administration; and</text>
							</subparagraph><subparagraph id="id7a220c36-b0fc-4b04-b3ba-d6bfc5f0f953"><enum>(C)</enum><text>$500,000 to
			 the Secretary for use by the United States Geological Survey.</text>
							</subparagraph></paragraph><paragraph id="id064aba0d-a61f-472f-8276-dd7933f1753b"><enum>(4)</enum><header>Planning
			 and administrative expenses</header><text>There is authorized to be
			 appropriated to the Secretary for each of fiscal years 2012 through 2016 for
			 use by the Board, the Director, and the Assistant Administrator for planning
			 and administrative expenses an amount equal to 3 percent of the amount
			 appropriated for the applicable fiscal year pursuant to paragraph (1).</text>
						</paragraph></subsection><subsection id="id322be949-a92b-4131-9906-406129c27d3a"><enum>(b)</enum><header>Agreements
			 and grants</header><text>The Secretary may—</text>
						<paragraph id="id24432678-77a2-41c6-bb1b-796f7b4e56c3"><enum>(1)</enum><text>on the
			 recommendation of the Board, and notwithstanding sections 6304 and 6305 of
			 title 31, United States Code, and the Federal Financial Assistance Management
			 Improvement Act of 1999 (31 U.S.C. 6101 note; Public Law 106–107), enter into a
			 grant agreement, cooperative agreement, or contract with a Partnership or other
			 entity for a fish habitat conservation project or restoration or enhancement
			 project;</text>
						</paragraph><paragraph id="id6460e4be-4005-45c1-bd5b-4417e5521406"><enum>(2)</enum><text>apply for,
			 accept, and use a grant from any individual or entity to carry out the purposes
			 of this subtitle; and</text>
						</paragraph><paragraph id="id56e6f9e4-9489-4a1b-a299-6bf41c2256e2"><enum>(3)</enum><text>make funds
			 available to any Federal department or agency for use by that department or
			 agency to provide grants for any fish habitat protection project, restoration
			 project, or enhancement project that the Secretary determines to be consistent
			 with this subtitle.</text>
						</paragraph></subsection><subsection id="idab46e10e-a0e1-4826-9182-518ac6771dcb"><enum>(c)</enum><header>Donations</header>
						<paragraph id="id5f89a893-23e8-4100-95a7-e5cbd67d4a34"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may—</text>
							<subparagraph id="id6eca4e7b-1b6f-496e-a692-eac5c1c3cf56"><enum>(A)</enum><text>enter into an
			 agreement with any organization described in section 501(c)(3) of the Internal
			 Revenue Code of 1986 that is exempt from taxation under section 501(a) of that
			 Code to solicit private donations to carry out the purposes of this subtitle;
			 and</text>
							</subparagraph><subparagraph id="idd58e13a9-7227-4b4f-9a3d-dc0516b51a92"><enum>(B)</enum><text>accept
			 donations of funds, property, and services to carry out the purposes of this
			 subtitle.</text>
							</subparagraph></paragraph><paragraph id="id07134d93-406d-423c-b29c-95cfe8cfa32e"><enum>(2)</enum><header>Treatment</header><text>A
			 donation accepted under this section—</text>
							<subparagraph id="idf02fd266-a601-49e6-926a-126f5117321c"><enum>(A)</enum><text>shall be
			 considered to be a gift or bequest to, or otherwise for the use of, the United
			 States; and</text>
							</subparagraph><subparagraph id="idcb1a8549-641c-43cf-8a97-adf0322d8a2b"><enum>(B)</enum><text>may
			 be—</text>
								<clause id="id17354661-d0ec-4fbf-b9a5-63d056ad7489"><enum>(i)</enum><text>used directly
			 by the Secretary; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idfe07afd2-d8b8-40f7-b0a6-12e0e05fc9fe"><enum>(ii)</enum><text>provided to
			 another Federal department or agency through an interagency agreement.</text>
								</clause></subparagraph></paragraph></subsection></section></subtitle><subtitle id="id74C1D346FA494DD1BBC3901D5F459B59"><enum>B</enum><header>Duck stamps
			 </header>
				<section commented="no" id="idc0aed7dd8e864a51bab6923d2c479806"><enum>221.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
					<paragraph commented="no" id="id6def824efc4849708202576b7029f637"><enum>(1)</enum><text>Federal Migratory
			 Bird Hunting and Conservation Stamps (commonly known as <quote>duck
			 stamps</quote>) were created in 1934 as Federal licenses required for hunting
			 migratory waterfowl;</text>
					</paragraph><paragraph commented="no" id="id09ec895cdbf445df80b40099a4e5311d"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id522545358AFC48FBB34EC404D85479B0"><enum>(A)</enum><text>duck stamps are a vital
			 tool for wetland conservation;</text>
						</subparagraph><subparagraph commented="no" id="ida85d859360b0430c9612bd2adb83ca06" indent="up1"><enum>(B)</enum><text>98 percent of the receipts from duck
			 stamp sales are used to acquire important migratory bird breeding, migration,
			 and wintering habitat, which are added to the National Wildlife Refuge System;
			 and</text>
						</subparagraph><subparagraph commented="no" id="id92ef5459626b49eb9d22317a5fc270e5" indent="up1"><enum>(C)</enum><text>those benefits extend to all wildlife,
			 not just ducks;</text>
						</subparagraph></paragraph><paragraph commented="no" id="idda12539bc38e4fc5b407267c0ad29906"><enum>(3)</enum><text>since inception,
			 the Federal duck stamp program—</text>
						<subparagraph commented="no" id="id998910be111f4ff7a803751311c76b8b"><enum>(A)</enum><text>has generated
			 more than $750,000,000;</text>
						</subparagraph><subparagraph commented="no" id="ida5a0e9168267465b8e5ae178895a0a91"><enum>(B)</enum><text>has preserved
			 more than 5,000,000 acres of wetland and wildlife habitat; and</text>
						</subparagraph><subparagraph commented="no" id="idd4de7d2547b64b26b30fe413a8915e55"><enum>(C)</enum><text>is considered
			 among the most successful conservation programs ever initiated;</text>
						</subparagraph></paragraph><paragraph commented="no" id="idb40bbf0b6d3e4e31bc41ab4a85a0ccbf"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE8D1A69B62D04FE690D739D09BF74C18"><enum>(A)</enum><text>since 1934, when duck
			 stamps cost $1, the price has been increased 7 times to the price in effect on
			 the date of enactment of this Act of $15, which took effect in 1991; and</text>
						</subparagraph><subparagraph commented="no" id="id7021e939a63f43ef954829bdf85028f6" indent="up1"><enum>(B)</enum><text>the price of the duck stamp has not
			 increased since 1991, the longest single period without an increase in program
			 history; and</text>
						</subparagraph></paragraph><paragraph commented="no" id="id6edc8955467f46029f85e9d99b0ccc4d"><enum>(5)</enum><text>with the price
			 unchanged during the 20-year period ending on the date of enactment of this
			 Act, duck stamps have lost 40 percent of the value of the duck stamps based on
			 the consumer price index, while the United States Fish and Wildlife Service
			 reports the price of land in targeted wetland areas has tripled from an average
			 of $306 to $1,091 per acre.</text>
					</paragraph></section><section commented="no" id="id467fa192180a4818a203928c9891dde2"><enum>222.</enum><header>Cost of
			 stamps</header><text display-inline="no-display-inline">Section 2 of the
			 Migratory Bird Hunting and Conservation Stamp Act (16 U.S.C. 718b) is amended
			 by striking subsection (b) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id138cf4f3b18c444491bb2e0a79469954" style="OLC">
						<subsection commented="no" id="id09976071584a4e6394a5dda5e98e4b24"><enum>(b)</enum><header>Cost of
				stamps</header>
							<paragraph commented="no" id="idd73efc08720744ee9a8d27fa141a8a59"><enum>(1)</enum><header>In
				general</header><text>For the 3-calendar-year period beginning with calendar
				year 2013, and for each 3-calendar-year period thereafter, the Secretary, in
				consultation with the Migratory Bird Conservation Commission, shall establish
				the amount to be collected under paragraph (2) for each stamp sold under this
				section.</text>
							</paragraph><paragraph commented="no" id="id56224f6850674d71a1b205d4967fc7d1"><enum>(2)</enum><header>Collection of
				amounts</header><text>The United States Postal Service, the Department of the
				Interior, or any other agent approved by the Department of the Interior shall
				collect the amount established under paragraph (1) for each stamp sold under
				this section for a hunting year if the Secretary determines, at any time before
				February 1 of the calendar year during which the hunting year begins, that all
				amounts described in paragraph (3) have been obligated for expenditure.</text>
							</paragraph><paragraph commented="no" id="idd6cb746c43c440119cf9f6b16e3cc1bc"><enum>(3)</enum><header>Amounts</header><text>The
				amounts described in this paragraph are amounts in the Migratory Bird
				Conservation Fund that are available for obligation and attributable to—</text>
								<subparagraph commented="no" id="id56c3a69841804dba98bf0697b1ddecbe"><enum>(A)</enum><text>amounts
				appropriated pursuant to this Act for the fiscal year ending in the immediately
				preceding calendar year; and</text>
								</subparagraph><subparagraph commented="no" id="ide61816253ce2400fbecf51cbb919ae9b"><enum>(B)</enum><text>the sale of
				stamps under this section during that fiscal
				year.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section commented="no" id="idbad641d4f8b046c8960e0a4e69fa9df4"><enum>223.</enum><header>Waivers</header><text display-inline="no-display-inline">Section 1(a) of the Migratory Bird Hunting
			 and Conservation Stamp Act (16 U.S.C. 718a(a)) is amended—</text>
					<paragraph commented="no" id="idfacbc06eb10c431ea65f7ed14fed21e1"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>and subsection (d)</quote> after <quote>paragraph
			 (2)</quote>; and</text>
					</paragraph><paragraph commented="no" id="id95084eb6ea2d4bb2a2ffef6eb1783a69"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id469cdacee9484864be62aef21184359b" style="OLC">
							<subsection commented="no" id="id27c5e5a322a046988ab609aadc156de8"><enum>(d)</enum><header>Waivers</header>
								<paragraph commented="no" id="idbb68bca2435c4ec58c26910cfdff80ad"><enum>(1)</enum><header>In
				general</header><text>The Secretary, in consultation with the Migratory Bird
				Conservation Commission, may waive requirements under this section for such
				individuals as the Secretary, in consultation with the Migratory Bird
				Conservation Commission, determines to be appropriate.</text>
								</paragraph><paragraph commented="no" id="idcfc9cfca2d804b91919c2a14e1af1ded"><enum>(2)</enum><header>Limitation</header><text>In
				making the determination described in paragraph (1), the Secretary shall grant
				only those waivers the Secretary determines will have a minimal adverse effect
				on funds to be deposited in the Migratory Bird Conservation Fund established
				under section
				4(a)(3).</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section commented="no" id="id81d3dd46c163470fb130d4af79f9ac85"><enum>224.</enum><header>Permanent
			 electronic duck stamps</header>
					<subsection commented="no" id="id521c4543c38448aab73beb46434516c1"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph commented="no" id="idb255f415264947d7ae884b3bcd31bdf6"><enum>(1)</enum><header>Actual
			 stamp</header><text>The term <term>actual stamp</term> means a Federal
			 migratory-bird hunting and conservation stamp required under the Act of March
			 16, 1934 (16 U.S.C. 718a et seq.) (popularly known as the <quote>Duck Stamp
			 Act</quote>), that is printed on paper and sold through the means established
			 by the authority of the Secretary immediately before the date of enactment of
			 this Act.</text>
						</paragraph><paragraph commented="no" id="id0a6bea0adbdf4c3ebcff8a539d8239da"><enum>(2)</enum><header>Automated
			 licensing system</header>
							<subparagraph commented="no" id="ida2a8b97524844355b7af7ed173a6a548"><enum>(A)</enum><header>In
			 general</header><text>The term <term>automated licensing system</term> means an
			 electronic, computerized licensing system used by a State fish and wildlife
			 agency to issue hunting, fishing, and other associated licenses and
			 products.</text>
							</subparagraph><subparagraph commented="no" id="iddf600843db0b4ac48d3529197306858b"><enum>(B)</enum><header>Inclusion</header><text>The
			 term <term>automated licensing system</term> includes a point-of-sale,
			 Internet, telephonic system, or other electronic applications used for a
			 purpose described in subparagraph (A).</text>
							</subparagraph></paragraph><paragraph commented="no" id="id3c1ceca80d314633b130bf2b71925317"><enum>(3)</enum><header>Electronic
			 stamp</header><text>The term <term>electronic stamp</term> means an electronic
			 version of an actual stamp that—</text>
							<subparagraph commented="no" id="idea5b73f2d0c14f3088d2bcd451fb7fdd"><enum>(A)</enum><text>is a unique
			 identifier for the individual to whom it is issued;</text>
							</subparagraph><subparagraph commented="no" id="ide731bc8fead849398290c69940637187"><enum>(B)</enum><text>can be printed on
			 paper or produced through an electronic application with the same indicators as
			 the State endorsement provides;</text>
							</subparagraph><subparagraph commented="no" id="id1e38d3595279483c845ec36bd0970aea"><enum>(C)</enum><text>is issued through
			 a State automated licensing system that is authorized, under State law and by
			 the Secretary under this section, to issue electronic stamps;</text>
							</subparagraph><subparagraph commented="no" id="id3861bdb8a9e34b6bae7e1bea1ab0cbb9"><enum>(D)</enum><text>is compatible
			 with the hunting licensing system of the State that issues the electronic
			 stamp; and</text>
							</subparagraph><subparagraph commented="no" id="id03c69ee41cda411c8bb64cb8b568163b"><enum>(E)</enum><text>is described in
			 the State application approved by the Secretary under subsection (c).</text>
							</subparagraph></paragraph><paragraph commented="no" id="id666d894794bc43879276fdf96a0017c9"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
						</paragraph></subsection><subsection commented="no" id="idc3ce0dda59324498b966d980e4293335"><enum>(b)</enum><header>Authority to
			 issue electronic duck stamps</header>
						<paragraph commented="no" id="idf776e5fd48584b96ab70f025cdd28e78"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may authorize any State to issue electronic
			 stamps in accordance with this section.</text>
						</paragraph><paragraph commented="no" id="id3c5a0533e31942e182e822f97ab24f7b"><enum>(2)</enum><header>Consultation</header><text>The
			 Secretary shall implement this subsection in consultation with State management
			 agencies.</text>
						</paragraph></subsection><subsection commented="no" id="id06c5151af8234dd687cfda0d077e19a3"><enum>(c)</enum><header>State
			 application</header>
						<paragraph commented="no" id="id64db185138944e368abb412cc65d0eb1"><enum>(1)</enum><header>Approval of
			 application required</header><text>The Secretary may not authorize a State to
			 issue electronic stamps under this section unless the Secretary has received
			 and approved an application submitted by the State in accordance with this
			 subsection.</text>
						</paragraph><paragraph commented="no" id="id3F50C4B6CCB64C299B3B415A9729E5F7"><enum>(2)</enum><header>Number of new
			 States</header><text>The Secretary may determine the number of new States per
			 year to participate in the electronic stamp program.</text>
						</paragraph><paragraph commented="no" id="idcb8b332c12084cc9bef66f3ba9faa0bb"><enum>(3)</enum><header>Contents of
			 application</header><text>The Secretary may not approve a State application
			 unless the application contains—</text>
							<subparagraph commented="no" id="ide654ae42a810418f8753cb36f6d7ddef"><enum>(A)</enum><text>a description of
			 the format of the electronic stamp that the State will issue under this
			 section, including identifying features of the licensee that will be specified
			 on the stamp;</text>
							</subparagraph><subparagraph commented="no" id="id736fa7a50ef147408dd88c3057fc6187"><enum>(B)</enum><text>a description of
			 any fee the State will charge for issuance of an electronic stamp;</text>
							</subparagraph><subparagraph commented="no" id="id1a76c79472294791906b116fa41b16df"><enum>(C)</enum><text>a description of
			 the process the State will use to account for and transfer to the Secretary the
			 amounts collected by the State that are required to be transferred to the
			 Secretary under the program;</text>
							</subparagraph><subparagraph commented="no" id="id4bf34d10d06648f3991f299c24079806"><enum>(D)</enum><text>the manner by
			 which the State will transmit electronic stamp customer data to the
			 Secretary;</text>
							</subparagraph><subparagraph commented="no" id="id0f85b762e12f494bb4bb716a5f313d50"><enum>(E)</enum><text>the manner by
			 which actual stamps will be delivered;</text>
							</subparagraph><subparagraph commented="no" id="ide74343b06e294653a4df48f865b61507"><enum>(F)</enum><text>the policies and
			 procedures under which the State will issue duplicate electronic stamps;
			 and</text>
							</subparagraph><subparagraph commented="no" id="id5e4481ac9aae4c10b4b33449c219b397"><enum>(G)</enum><text>such other
			 policies, procedures, and information as may be reasonably required by the
			 Secretary.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="ide8dc4fb646904d6ea1e2d28b3cf68181"><enum>(d)</enum><header>Publication of
			 deadlines, eligibility requirements, and selection criteria</header><text>Not
			 later than 30 days before the date on which the Secretary begins accepting
			 applications under this section, the Secretary shall publish—</text>
						<paragraph commented="no" id="id8204631e15b746a6a2fc16dd3b256185"><enum>(1)</enum><text>deadlines for
			 submission of applications;</text>
						</paragraph><paragraph commented="no" id="idac0f3a79ae9445f1ba647bf86efe1795"><enum>(2)</enum><text>eligibility
			 requirements for submitting applications; and</text>
						</paragraph><paragraph commented="no" id="id5213abe7b4714c0c8490e38add7bba13"><enum>(3)</enum><text>criteria for
			 approving applications.</text>
						</paragraph></subsection><subsection commented="no" id="id989959652c1043b5990654429a1a05b8"><enum>(e)</enum><header>State
			 obligations and authorities</header>
						<paragraph commented="no" id="idD81993B34AF94B489951AD7397A2D6F7"><enum>(1)</enum><header>Delivery of
			 actual stamp</header><text>The Secretary shall require that each individual to
			 whom a State sells an electronic stamp under this section shall receive an
			 actual stamp—</text>
							<subparagraph commented="no" id="idd60d736e293f40ee9b2348d37e4ee153"><enum>(A)</enum><text>by not later than
			 the date on which the electronic stamp expires under subsection (f)(3);
			 and</text>
							</subparagraph><subparagraph commented="no" id="idefa08f6d50284fa38bc0d51a0d461506"><enum>(B)</enum><text>in a manner
			 agreed on by the State and Secretary.</text>
							</subparagraph></paragraph><paragraph commented="no" id="id5968c735358c415984296d7b0a318af8"><enum>(2)</enum><header>Collection and
			 transfer of electronic stamp revenue and customer information</header>
							<subparagraph commented="no" id="id6a7643b55b684d8299aefa74485bcb07"><enum>(A)</enum><header>Requirement to
			 transmit</header><text>The Secretary shall require each State authorized to
			 issue electronic stamps to collect and submit to the Secretary in accordance
			 with this subsection—</text>
								<clause commented="no" id="id1fad0f0712e24c21953700d291439301"><enum>(i)</enum><text>the first name,
			 last name, and complete mailing address of each individual that purchases an
			 electronic stamp from the State;</text>
								</clause><clause commented="no" id="id4dc7727b3f384f72bf53916667cd496e"><enum>(ii)</enum><text>the face value
			 amount of each electronic stamp sold by the State; and</text>
								</clause><clause commented="no" id="id7fb4630c1c1e46e383308b0aa8ecd8d7"><enum>(iii)</enum><text>the amount of
			 the Federal portion of any fee required by the agreement for each stamp
			 sold.</text>
								</clause></subparagraph><subparagraph commented="no" id="id03be13e6422d4edb876506f79889890b"><enum>(B)</enum><header>Time of
			 transmittal</header><text>The Secretary shall require the submission under
			 subparagraph (A) to be made with respect to sales of electronic stamps by a
			 State according to the written agreement between the Secretary and the State
			 agency.</text>
							</subparagraph><subparagraph commented="no" id="iddad389227d5947cf9caf2161e6548c5e"><enum>(C)</enum><header>Additional fees
			 not affected</header><text>This subsection shall not apply to the State portion
			 of any fee collected by a State under paragraph (3).</text>
							</subparagraph></paragraph><paragraph commented="no" id="id81880e9dc95749f3b40e23531c984690"><enum>(3)</enum><header>Electronic
			 stamp issuance fee</header><text>A State authorized to issue electronic stamps
			 may charge a reasonable fee to cover costs incurred by the State and the
			 Department of the Interior in issuing electronic stamps under this section,
			 including costs of delivery of actual stamps.</text>
						</paragraph><paragraph commented="no" id="id9cc05d8a8a854c7784561957b6854b1d"><enum>(4)</enum><header>Duplicate
			 electronic stamps</header><text>A State authorized to issue electronic stamps
			 may issue a duplicate electronic stamp to replace an electronic stamp issued by
			 the State that is lost or damaged.</text>
						</paragraph><paragraph commented="no" id="id94ab7c2934cb447d85b89e0d6bce1d62"><enum>(5)</enum><header>Limitation on
			 authority to require purchase of State license</header><text>A State may not
			 require that an individual purchase a State hunting license as a condition of
			 issuing an electronic stamp under this section.</text>
						</paragraph></subsection><subsection commented="no" id="id7a411ad2cd7f47b8bcd52aeae58e6b33"><enum>(f)</enum><header>Electronic
			 stamp requirements; recognition of electronic stamp</header>
						<paragraph commented="no" id="id665cfee1965a470293896e511259a5e4"><enum>(1)</enum><header>Stamp
			 requirements</header><text>The Secretary shall require an electronic stamp
			 issued by a State under this section—</text>
							<subparagraph commented="no" id="idf5b6c4ad3de74f09a0657a9659de6de0"><enum>(A)</enum><text>to have the same
			 format as any other license, validation, or privilege the State issues under
			 the automated licensing system of the State; and</text>
							</subparagraph><subparagraph commented="no" id="id8855c934324c4b92b853c9c4c04c2a70"><enum>(B)</enum><text>to specify
			 identifying features of the licensee that are adequate to enable Federal,
			 State, and other law enforcement officers to identify the holder.</text>
							</subparagraph></paragraph><paragraph commented="no" id="id501b34eb1614441fb3aae1cfdb1a70c1"><enum>(2)</enum><header>Recognition of
			 electronic stamp</header><text>Any electronic stamp issued by a State under
			 this section shall, during the effective period of the electronic stamp—</text>
							<subparagraph commented="no" id="ideddf56b5a529407992c96c5745f840ec"><enum>(A)</enum><text>bestow on the
			 licensee the same privileges as are bestowed by an actual stamp;</text>
							</subparagraph><subparagraph commented="no" id="id73cb8f46036143feb798a4f7403e1404"><enum>(B)</enum><text>be recognized
			 nationally as a valid Federal migratory bird hunting and conservation stamp;
			 and</text>
							</subparagraph><subparagraph commented="no" id="ide80d67626cfe41eab76fc6033739be91"><enum>(C)</enum><text>authorize the
			 licensee to hunt migratory waterfowl in any other State, in accordance with the
			 laws of the other State governing that hunting.</text>
							</subparagraph></paragraph><paragraph commented="no" id="ide2cdc558614240428a016fa57b55090a"><enum>(3)</enum><header>Duration</header><text>An
			 electronic stamp issued by a State shall be valid for a period agreed to by the
			 State and the Secretary, which shall not exceed 45 days.</text>
						</paragraph></subsection><subsection commented="no" id="id508b8017700f461c8861543f1886a78c"><enum>(g)</enum><header>Termination of
			 State participation</header><text>The authority of a State to issue electronic
			 stamps under this section may be terminated—</text>
						<paragraph commented="no" id="id62d905d55f794e209be78ed0668c9ba8"><enum>(1)</enum><text>by the Secretary,
			 if the Secretary—</text>
							<subparagraph commented="no" id="id56310c5e030e4709aba1470ff3d998db"><enum>(A)</enum><text>finds that the
			 State has violated any of the terms of the application of the State approved by
			 the Secretary under subsection (c); and</text>
							</subparagraph><subparagraph commented="no" id="idc32a0c7f0d2144169aef064bd5d37893"><enum>(B)</enum><text>provides to the
			 State written notice of the termination by not later than the date that is 30
			 days before the date of termination; or</text>
							</subparagraph></paragraph><paragraph commented="no" id="id3611d18169de45c5aa9bf97546c8e290"><enum>(2)</enum><text>by the State, by
			 providing written notice to the Secretary by not later than the date that is 30
			 days before the termination date.</text>
						</paragraph></subsection></section></subtitle><subtitle id="id690B05256C104946AC194356B7BB581C"><enum>C</enum><header>Joint ventures to
			 protect migratory bird populations</header>
				<section id="HDD980BE31D9D4255B2FD1A3C871F0DCD"><enum>231.</enum><header>Purposes</header><text display-inline="no-display-inline">The purpose of this subtitle is to authorize
			 the Secretary of the Interior, acting through the Director, to carry out a
			 partnership program called the <quote>Joint Ventures Program</quote>, in
			 coordination with other Federal agencies with management authority over fish
			 and wildlife resources and the States, to develop, implement, and support
			 innovative, voluntary, cooperative, and effective conservation strategies and
			 conservation actions—</text>
					<paragraph id="H5C8F0EE57B2E4B1AA2BA7B7E6EE41371"><enum>(1)</enum><text>to promote,
			 primarily, sustainable populations of migratory birds, and, secondarily, the
			 fish and wildlife species associated with their habitats;</text>
					</paragraph><paragraph id="H686B7FE8A2A242CCB87B55B4FBA42887"><enum>(2)</enum><text>to encourage
			 stakeholder and government partnerships consistent with the goals of
			 protecting, improving, and restoring habitat;</text>
					</paragraph><paragraph id="H7063BB9125504607AF014B392D7BFBFE"><enum>(3)</enum><text>to establish,
			 implement, and improve science-based migratory bird conservation plans and
			 promote and facilitate broader landscape-level conservation of fish and
			 wildlife habitat; and</text>
					</paragraph><paragraph id="HE155E00AADBF423C9CC293A65B0910A7"><enum>(4)</enum><text>to support the
			 goals and objectives of the North American Waterfowl Management Plan and other
			 relevant national and regional, multipartner conservation initiatives,
			 treaties, conventions, agreements, or strategies entered into by the United
			 States, and implemented by the Secretary, that promote the conservation of
			 migratory birds and the habitats of migratory birds.</text>
					</paragraph></section><section id="H2D2673B699B5405FAF0861DD6D982C21"><enum>232.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
					<paragraph id="H3FF2897190964108A4F91BF923CDA44B"><enum>(1)</enum><header>Conservation
			 action</header><text>The term <quote>conservation action</quote> means
			 activities that—</text>
						<subparagraph id="H59041D43BF2D452DB8565E92739E8B88"><enum>(A)</enum><text display-inline="yes-display-inline">support the protection, restoration,
			 adaptive management, conservation, or enhancement of migratory bird
			 populations, their terrestrial, wetland, marine, or other habitats, and other
			 wildlife species supported by those habitats, including—</text>
							<clause id="HA37AAD3D81064F209773261CA37A6A78"><enum>(i)</enum><text>biological and
			 geospatial planning;</text>
							</clause><clause id="H547BDA3DF36D493ABEEC4B56A4E85D8F"><enum>(ii)</enum><text>landscape and
			 conservation design;</text>
							</clause><clause id="H156FFD5CB0EC4669BB0644DAE5EB3B9F"><enum>(iii)</enum><text>habitat
			 protection, enhancement, and restoration;</text>
							</clause><clause id="H03004E5F87CA4AF5A21E39712277E83E"><enum>(iv)</enum><text>monitoring and
			 tracking;</text>
							</clause><clause id="H253908CDA3E143FFB6831C35507C39A4"><enum>(v)</enum><text>applied research;
			 and</text>
							</clause><clause id="HD207017F24A14BE79F95387C78BCA531"><enum>(vi)</enum><text>public outreach
			 and education; and</text>
							</clause></subparagraph><subparagraph id="H4DEA3656153F4C50A40CE67C4F033CCE"><enum>(B)</enum><text>incorporate
			 adaptive management and science-based monitoring, where applicable, to improve
			 outcomes and ensure efficient and effective use of Federal funds.</text>
						</subparagraph></paragraph><paragraph id="HA04387E124D94ED197CCDCACAEFE3D04"><enum>(2)</enum><header>Director</header><text>The
			 term <quote>Director</quote> means the Director of the United States Fish and
			 Wildlife Service.</text>
					</paragraph><paragraph id="H605318A9E0E940E28EB6D5EFFB5B4700"><enum>(3)</enum><header>Implementation
			 Plan</header><text>The term <quote>Implementation Plan</quote> means an
			 Implementation Plan approved by the Director under section 232.</text>
					</paragraph><paragraph id="HC21885B99A794E9EBC25311C4DF422E7"><enum>(4)</enum><header>Indian
			 tribe</header><text>The term <quote>Indian tribe</quote> has the meaning given
			 that term in section 4 of the Indian Self-Determination and Education
			 Assistance Act (25 U.S.C. 450b).</text>
					</paragraph><paragraph id="H6F93659B44574EC0929BA79CC1DFA7B5"><enum>(5)</enum><header>Joint
			 venture</header><text>The term <quote>Joint Venture</quote> means a
			 self-directed, voluntary partnership, established and conducted for the
			 purposes described in section 231 and in accordance with section 233.</text>
					</paragraph><paragraph id="H24D9957BC1B345CC8992FC23822EA672"><enum>(6)</enum><header>Management
			 board</header><text>The term <quote>Management Board</quote> means a Joint
			 Venture Management Board established in accordance with section 233.</text>
					</paragraph><paragraph id="H378D6390651D44828A0F319133D7ED39"><enum>(7)</enum><header>Migratory
			 birds</header><text>The term <quote>migratory birds</quote> means those species
			 included in the list of migratory birds that appears in section 10.13 of title
			 50, Code of Federal Regulations, under the authority of the Migratory Bird
			 Treaty Act.</text>
					</paragraph><paragraph id="H9937AAF6E9FB46AB8599E09EEF0C27F4"><enum>(8)</enum><header>Program</header><text>The
			 term <quote>Program</quote> means the Joint Ventures Program conducted in
			 accordance with this subtitle.</text>
					</paragraph><paragraph id="H7F1601C2D5524750B212FD91EC35EE43"><enum>(9)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior.</text>
					</paragraph><paragraph id="H20BF9F3CF5CD456483A90F5AF2C53DF9"><enum>(10)</enum><header>Service</header><text>The
			 term <quote>Service</quote> means the United States Fish and Wildlife
			 Service.</text>
					</paragraph><paragraph id="HB414D8C639CE4E9385AC9FD308D78715"><enum>(11)</enum><header>State</header><text>The
			 term <quote>State</quote> means—</text>
						<subparagraph id="H72C5FB3A4E7A467BB71DCD060185BCAD"><enum>(A)</enum><text>any State of the
			 United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam,
			 the Virgin Islands, American Samoa, and the Commonwealth of the Northern
			 Mariana Islands; and</text>
						</subparagraph><subparagraph id="HD8DF715F80C244F28F2FEB83973EF566"><enum>(B)</enum><text>one or more
			 agencies of a State government responsible under State law for managing fish or
			 wildlife resources.</text>
						</subparagraph></paragraph></section><section id="H215A46CDEB2848F196672876EE4312E2"><enum>233.</enum><header>Joint Ventures
			 Program</header>
					<subsection id="HA1507BE58AE842DCA5ADBE1C0071AC1D"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, acting through the Director, shall carry
			 out a Joint Ventures Program that—</text>
						<paragraph id="H675560F5822943808C3E451311B89113"><enum>(1)</enum><text>provides financial
			 and technical assistance to support regional migratory bird conservation
			 partnerships;</text>
						</paragraph><paragraph id="H2CFC584972AA4D20A955FA182911CC3B"><enum>(2)</enum><text>develops and
			 implements plans to protect and enhance migratory bird populations throughout
			 their range, that are focused on regional landscapes and habitats that support
			 those populations; and</text>
						</paragraph><paragraph id="HA0F3CF631C5646E6B2D0DCAEC3E8A845"><enum>(3)</enum><text>complements and
			 supports activities by the Secretary and the Director to fulfill obligations
			 under—</text>
							<subparagraph id="H3325738AC9BE40609A63CD790C5A27FC"><enum>(A)</enum><text>the Migratory Bird
			 Treaty Act (16 U.S.C. 701 et seq.);</text>
							</subparagraph><subparagraph id="HE7838DE03F0F45C2913279AE9B5ACF2F"><enum>(B)</enum><text>the Migratory Bird
			 Conservation Act (16 U.S.C. 715 et seq.);</text>
							</subparagraph><subparagraph id="H1E39D799D0BC46369946B2D94B65EC92"><enum>(C)</enum><text display-inline="yes-display-inline">the Neotropical Migratory Bird Conservation
			 Act (16 U.S.C. 6101 et seq.);</text>
							</subparagraph><subparagraph id="H0C6504B2AFFD41F2931F1DAEED51EC29"><enum>(D)</enum><text>the North American
			 Wetlands Conservation Act (16 U.S.C. 4401 et seq.);</text>
							</subparagraph><subparagraph id="HFC89FFF5DAE14ABE9F93B8A98B5D4938"><enum>(E)</enum><text>the Fish and
			 Wildlife Conservation Act of 1980 (16 U.S.C. 2901 et seq.); and</text>
							</subparagraph><subparagraph id="H2A78F038FB574F35863955CC42800705"><enum>(F)</enum><text display-inline="yes-display-inline">the Partners for Fish and Wildlife Act (16
			 U.S.C. 3771 et seq.).</text>
							</subparagraph></paragraph></subsection><subsection id="H262058FE37954570B76B5760F5B420A8"><enum>(b)</enum><header>Coordination
			 with States</header><text>In the administration of the program authorized under
			 this section, the Director shall coordinate and cooperate with the States to
			 fulfill the purposes of this subtitle.</text>
					</subsection></section><section id="H002305C6D0FB440CB4AB573C54F52963"><enum>234.</enum><header>
			 Administration</header>
					<subsection id="HD6327A02D6B442168F38FEF443009D1B"><enum>(a)</enum><header>Partnership
			 agreements</header>
						<paragraph id="HD0F4D5C8E2B44832AF1BCA5C6B383655"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director may
			 enter into an agreement with eligible partners to achieve the purposes
			 described in section 231.</text>
						</paragraph><paragraph id="HF3878B3263D4440DAF2E93BB2F5A82F0"><enum>(2)</enum><header>Eligible
			 partners</header><text>The eligible partners referred to in paragraph (1) are
			 the following:</text>
							<subparagraph id="HC3D10BAD0B214AC4BA0FCD39A54A31DA"><enum>(A)</enum><text display-inline="yes-display-inline">Federal and State agencies and Indian
			 tribes.</text>
							</subparagraph><subparagraph id="H52D1EA50D29F4F6D8B78922836D7309E"><enum>(B)</enum><text display-inline="yes-display-inline">Affected regional and local governments,
			 private landowners, land managers, and other private stakeholders.</text>
							</subparagraph><subparagraph id="H4D6B19D73AF84A388A614F07391C89F0"><enum>(C)</enum><text>Nongovernmental
			 organizations with expertise in bird conservation or fish and wildlife
			 conservation or natural resource and landscape management generally.</text>
							</subparagraph><subparagraph id="H6372801974F64DF98F2D99B16B7B6A97"><enum>(D)</enum><text>Other relevant
			 stakeholders, as determined by the Director.</text>
							</subparagraph></paragraph></subsection><subsection id="HC42658756AB44DC69017849F230067EE"><enum>(b)</enum><header>Management
			 Board</header>
						<paragraph id="HC0441F8ED9B54EA6BF2ABEC35A593F8B"><enum>(1)</enum><header>In
			 general</header><text>A partnership agreement for a Joint Venture under this
			 section shall establish a Management Board in accordance with this
			 subsection.</text>
						</paragraph><paragraph id="H40E8B611F3C541C8A55DA84EE87D55B9"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">The Management Board shall include a
			 diversity of members representing stakeholder interests from the appropriate
			 geographic region, including, as appropriate, representatives from the Service
			 and other Federal agencies that have management authority over fish and
			 wildlife resources on public lands or in the marine environment, or that
			 implement programs that affect migratory bird habitats, and representatives
			 from the States, Indian tribes, and other relevant stakeholders, and may
			 include—</text>
							<subparagraph id="H25F5AECB021041149AAAFC4987EF5167"><enum>(A)</enum><text>regional
			 governments and Indian tribes;</text>
							</subparagraph><subparagraph id="H7458DFF54B2948BA97C6A11849454E3F"><enum>(B)</enum><text>academia or the
			 scientific community;</text>
							</subparagraph><subparagraph id="H64E21F97877F4CE5928B893FCE54900B"><enum>(C)</enum><text>nongovernmental
			 landowners or land managers;</text>
							</subparagraph><subparagraph id="HBBA0115DC0AC4E59A7408D884E704151"><enum>(D)</enum><text>nonprofit
			 conservation or other relevant organizations with expertise in migratory bird
			 conservation, or in fish and wildlife conservation generally; and</text>
							</subparagraph><subparagraph id="H045B7EB11367451FA4A251C7CADAE275"><enum>(E)</enum><text display-inline="yes-display-inline">private organizations with a dedicated
			 interest in conserving migratory birds and their habitats.</text>
							</subparagraph></paragraph><paragraph id="HB9661A39A5A7440FB82E7317007F5268"><enum>(3)</enum><header>Functions and
			 responsibilities</header><text>Subject to applicable Federal and State law, the
			 Management Board shall—</text>
							<subparagraph id="H13950E3405F6481986420C68051F940D"><enum>(A)</enum><text display-inline="yes-display-inline">appoint a coordinator for the Joint Venture
			 in consultation with the Director;</text>
							</subparagraph><subparagraph id="HA9D760ADB1C44631AC4D3738A8E122BF"><enum>(B)</enum><text>identify other
			 full- or part-time administrative and technical non-Federal employees necessary
			 to perform the functions of the Joint Venture and meet objectives specified in
			 the Implementation Plan; and</text>
							</subparagraph><subparagraph id="H25567C918009412ABD6EBC04B0932C55"><enum>(C)</enum><text>establish
			 committees or other organizational entities necessary to implement the
			 Implementation Plan in accordance with subsection (c).</text>
							</subparagraph></paragraph><paragraph id="HEE347E3CA3BA4DE9972EADD4FB437FAB"><enum>(4)</enum><header>Use of Service
			 and Federal agency employees</header><text>Subject to the availability of
			 appropriations and upon the request from a Management Board, and after
			 consultation with and approval of the Director, the head of any Federal agency
			 may detail to the Management Board, on a reimbursable or nonreimbursable basis,
			 any agency personnel to assist the Joint Venture in performing its functions
			 under this subtitle.</text>
						</paragraph></subsection><subsection id="HCEC7660B6069417B94BD34BC1220CDED"><enum>(c)</enum><header>Implementation
			 plan</header>
						<paragraph id="HDA8EEB341EED4A0690AADE6A8FBA1A78"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each Joint Venture
			 Management Board shall develop and maintain an Implementation Plan that shall
			 contain, at a minimum, the following elements:</text>
							<subparagraph id="HB7FE38DA94D143D19968916528CE5616"><enum>(A)</enum><text>A strategic
			 framework for migratory bird conservation.</text>
							</subparagraph><subparagraph id="H9F18EB195ABB4468BA564D672AF6B107"><enum>(B)</enum><text>Provisions for
			 effective communication among member participants within the Joint
			 Venture.</text>
							</subparagraph><subparagraph id="HB50D6093AE4549FE8898DB5D0B507E3D"><enum>(C)</enum><text>A long-term
			 strategy to conduct public outreach and education regarding the purposes and
			 activities of the Joint Venture and activities to regularly communicate to the
			 general public information generated by the Joint Venture.</text>
							</subparagraph><subparagraph id="H991E110F60B64282836183CC0A364044"><enum>(D)</enum><text display-inline="yes-display-inline">Coordination with laws and conservation
			 plans that are relevant to migratory birds, and other relevant regional,
			 national, or international initiatives identified by the Director to conserve
			 migratory birds, their habitats, ecological functions, and associated
			 populations of fish and wildlife.</text>
							</subparagraph><subparagraph id="H4666E4ABE87943D097ECDA202F8601D3"><enum>(E)</enum><text display-inline="yes-display-inline">An organizational plan that—</text>
								<clause id="H4D012DDAC7584358B9974D956834531E"><enum>(i)</enum><text>identifies the
			 representative membership of the Management Board and includes procedures for
			 updating the membership of the Management Board as appropriate;</text>
								</clause><clause id="H0E75C5ECF7CE42FEA6E853CC42EFFEA4"><enum>(ii)</enum><text>describes the
			 organizational structure of the Joint Venture, including proposed committees
			 and subcommittees, and procedures for revising and updating the structure, as
			 necessary; and</text>
								</clause><clause id="HDE66465529DA42C2B00C5B3D3964512B"><enum>(iii)</enum><text>provides a
			 strategy to increase stakeholder participation or membership in the Joint
			 Venture.</text>
								</clause></subparagraph><subparagraph id="HA4DB1EDF28CF4D6EB8CD7B84B5246066"><enum>(F)</enum><text>Procedures to
			 coordinate the development, implementation, oversight, monitoring, tracking,
			 and reporting of conservation actions approved by the Management Board and an
			 evaluation process to determine overall effectiveness of activities undertaken
			 by the Joint Venture.</text>
							</subparagraph></paragraph><paragraph id="H4C101E67676945088995126C196915AD"><enum>(2)</enum><header>Review</header><text display-inline="yes-display-inline">A Joint Venture Implementation Plan shall
			 be submitted to the Director for approval.</text>
						</paragraph><paragraph id="HA60F9C6E2D4D4FFA8BFB4EFD368DCE56"><enum>(3)</enum><header>Approval</header><text>The
			 Director shall approve an Implementation Plan submitted by the Management Board
			 for a Joint Venture if the Director finds that—</text>
							<subparagraph id="H7BE8C7CCD3DE419091DB9A550D46168D"><enum>(A)</enum><text display-inline="yes-display-inline">implementation of the plan would promote
			 the purposes of this subtitle described in section 231;</text>
							</subparagraph><subparagraph id="HCCFA2445C7EF456A9459AB432E1F6D75"><enum>(B)</enum><text>the members of the
			 Joint Venture have demonstrated the capacity to implement conservation actions
			 identified in the Implementation Plan; and</text>
							</subparagraph><subparagraph id="H9A5DCEE8477042F8B20E18154D28E76F"><enum>(C)</enum><text display-inline="yes-display-inline">the plan includes coordination with other
			 relevant and active conservation plans or programs within the geographic scope
			 of the Joint Venture.</text>
							</subparagraph></paragraph></subsection></section><section id="HF530195362F04373AE8CFED8F2C83847"><enum>235.</enum><header>Grants and
			 other assistance</header>
					<subsection id="H21C2AB8BB0224DD98B70CD0A775C559A"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b), and subject to the
			 availability of appropriations, the Director may award financial assistance to
			 implement a Joint Venture through—</text>
						<paragraph id="H9429B9EFE1E9496D83E13F0E2DE1DDAF"><enum>(1)</enum><text>support of the
			 activities of the Management Board of the Joint Venture and to pay for
			 necessary administrative costs and services, personnel, and meetings, travel,
			 and other business activities; and</text>
						</paragraph><paragraph id="H7840E647EA9B45E7B765E09F0FD85CEF"><enum>(2)</enum><text>support for
			 specific conservation actions and other activities necessary to carry out the
			 Implementation Plan.</text>
						</paragraph></subsection><subsection id="HB05297A7E9074BA9BAEBC163B3BFAD93"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">A Joint Venture is not eligible for
			 assistance or support authorized in this section unless the Joint Venture is
			 operating under an Implementation Plan approved by the Director under section
			 234.</text>
					</subsection><subsection id="H75FD63D631804D72BB16BC25D48305E7"><enum>(c)</enum><header>Technical
			 assistance</header><text>The Secretary, through the Director, may provide
			 technical and administrative assistance for implementation of Joint Ventures
			 and the expenditure of financial assistance under this subsection.</text>
					</subsection><subsection id="H345AFC49D58C4E3A89AD3820C7C40A2F"><enum>(d)</enum><header>Acceptance and
			 use of donations</header><text>The Secretary, through the Director, may accept
			 and use donations of funds, gifts, and in-kind contributions to provide
			 assistance under this section.</text>
					</subsection></section><section id="H5B6B7056C2704FDCB2C289E118E6FFD7"><enum>236.</enum><header>Reporting</header>
					<subsection id="H705EC391AE594DB9BA108B13D1354098"><enum>(a)</enum><header>Annual reports
			 by management boards</header><text display-inline="yes-display-inline">The
			 Secretary, acting through the Director, shall—</text>
						<paragraph id="HDC456A2A26E3471B91124688F868BA8D"><enum>(1)</enum><text>require each
			 Management Board to submit annual reports for all approved Joint Ventures of
			 the Management Board; and</text>
						</paragraph><paragraph id="id022A87A6B9C94CB98B4A553CE6318ED9"><enum>(2)</enum><text>establish
			 guidance for Joint Venture annual reports, including contents and any necessary
			 processes or procedures.</text>
						</paragraph></subsection><subsection id="H14E5FCCE8AEF449B872244E19FC2D707"><enum>(b)</enum><header>Joint Venture
			 Program <enum-in-header>5</enum-in-header>-Year reviews</header>
						<paragraph id="H979D8CF7E78F461D96BF4EAC84006FB2"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, acting through the Director, shall at 5
			 years after the date of enactment of this Act and at 5-year intervals
			 thereafter, complete an objective and comprehensive review and evaluation of
			 the Program.</text>
						</paragraph><paragraph id="H0F139ABF1B5D491083DC4FF46E936485"><enum>(2)</enum><header>Review
			 contents</header><text>Each review under this subsection shall include—</text>
							<subparagraph id="H4439958585964666B8912093B2727136"><enum>(A)</enum><text>an evaluation of
			 the effectiveness of the Program in meeting the purpose of this subtitle
			 specified in section 231;</text>
							</subparagraph><subparagraph id="H06AB2702388640BAA5AD19CC6AD6CCE0"><enum>(B)</enum><text>an evaluation of
			 all approved Implementation Plans, especially the effectiveness of existing
			 conservation strategies, priorities, and methods to meet the objectives of such
			 plans and fulfill the purpose of this subtitle; and</text>
							</subparagraph><subparagraph id="HBE360B23AEC34B24B329AF42D5CC78A2"><enum>(C)</enum><text>recommendations to
			 revise the Program or to amend or otherwise revise Implementation Plans to
			 ensure that activities undertaken pursuant to this subtitle address the effects
			 of climate change on migratory bird populations and their habitats, and fish
			 and wildlife habitats, in general.</text>
							</subparagraph></paragraph><paragraph id="H6F900DF075C54C4BAD980FBF8C40BABC"><enum>(3)</enum><header>Consultation</header><text>The
			 Secretary, acting through the Director, in the implementation of this
			 subsection—</text>
							<subparagraph id="HD05F114F96404580880A15A969D0CBE5"><enum>(A)</enum><text>shall consult with
			 other appropriate Federal agencies with responsibility for the conservation or
			 management of fish and wildlife habitat and appropriate State agencies;
			 and</text>
							</subparagraph><subparagraph id="H80DC43E17A9B4831A89A617D0CB4D55E"><enum>(B)</enum><text display-inline="yes-display-inline">may consult with appropriate, Indian
			 tribes, Flyway Councils, or regional conservation organizations, public and
			 private landowners, members of academia and the scientific community, and other
			 nonprofit conservation or private stakeholders.</text>
							</subparagraph></paragraph><paragraph id="H96033F733F4F456E80F07B42005FCF78"><enum>(4)</enum><header>Public
			 comment</header><text>The Secretary, through the Director, shall provide for
			 adequate opportunities for general public review and comment of the Program as
			 part of the 5-year evaluations conducted pursuant to this subsection.</text>
						</paragraph></subsection></section><section id="HDE89D5A9F0C0489EA7119DFAE0820A62"><enum>237.</enum><header>Relationship to
			 other authorities</header>
					<subsection id="H41D93298C5674423A46E2DC2092D7B56"><enum>(a)</enum><header>Authorities,
			 etc. of Secretary</header><text>Nothing in this subtitle affects authorities,
			 responsibilities, obligations, or powers of the Secretary under any other
			 Act.</text>
					</subsection><subsection id="H0079B7F6F7DA48F9B60D011DE268F518"><enum>(b)</enum><header>State
			 Authority</header><text>Nothing in this subtitle preempts any provision or
			 enforcement of a State statute or regulation relating to the management of fish
			 and wildlife resources within such State.</text>
					</subsection></section><section id="H5EC6203B09224792909A8916C510F2CA"><enum>238.</enum><header>Federal
			 Advisory Committee Act</header><text display-inline="no-display-inline">The
			 Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to any boards,
			 committees, or other groups established under this subtitle.</text>
				</section></subtitle><subtitle id="idD9515ED3B9BF43FBB9430708BD5173D9"><enum>D</enum><header>Reauthorizations</header>
				<section id="H511C01C9DCFE4995AFF4D124EF5D4ADC"><enum>241.</enum><header>North American
			 Wetlands Conservation Act</header><text display-inline="no-display-inline">Section 7(c)(5) of the North American
			 Wetlands Conservation Act (16 U.S.C. 4406(c)(5)) is amended by striking

				fees</header><text>The Foundation may assess and collect fees for the
				management of amounts received under this
				paragraph.</text>

				instrumentality shall have discretion to waive any competitive process of that
				department, agency, or instrumentality for entering into contracts, agreements,
				or partnerships with the Foundation if the purpose of the waiver is—</text>
											<clause id="id7EDAE0A20C514C42BD8F70106E30FF35"><enum>(i)</enum><text>to address an
				environmental emergency resulting from a natural or other disaster; or</text>
											</clause><clause id="idA92E1A3BA3BD46A08D96B024BCD6F31E"><enum>(ii)</enum><text>as determined by
				the head of the applicable Federal department, agency, or instrumentality, to
				reduce administrative expenses and expedite the conservation and management of
				fish, wildlife, plants, and other natural resources.</text>
											</clause></subparagraph><subparagraph id="id77F415631F4746D282A92B643C80AE3F"><enum>(B)</enum><header>Reports</header><text>The
				Foundation shall include in the annual report submitted under section 7(b) a
				description of any use of the authority under subparagraph (A) by a Federal
				department, agency, or instrumentality in that fiscal
				year.</text>
										</subparagraph></paragraph><after-quoted-block>; and
				</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="idDDD6068B22B646AB929B3589BB1D55BD"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

			 authority</header><text display-inline="yes-display-inline">Section 11 of the
			 National Fish and Wildlife Foundation Establishment Act (16 U.S.C. 3710) is
			 amended by inserting <quote>exclusive</quote> before

									</paragraph><paragraph id="idD4489080EFE04FA5806B3BD5074BF910"><enum>(4)</enum><text display-inline="yes-display-inline">This Act and the Coastal Wetlands Planning,
				Protection, and Restoration Act (16 U.S.C. 3951 et seq.) authorize the
				Coastwide Nutria Control Program, which has reduced nutria-impacted wetland
				acres in the State of Louisiana from 80,000 acres to 23,141 acres.</text>
									</paragraph><paragraph id="id24CF1D6907E24669A21D66A1436A8AFF"><enum>(5)</enum><text display-inline="yes-display-inline">The proven techniques developed under this
				Act that are eradicating nutria in the State of Maryland and reducing the acres
				of nutria-impacted wetlands in the State of Louisiana should be applied to
				nutria eradication or control programs in other nutria-infested coastal
				States</text>
									</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="id852A830FAEBC499E9B74ACC4FA225190"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting
			 the following:</text>

			 2003 (Public Law 108–16; 117 Stat. 621) is amended—</text>

				public officials and affected communities, local citizens, nongovernmental
				organizations, or other entities or persons in the private sector.</text>
									</paragraph><paragraph id="idC098F9FF1B8341B79574304951DB6678"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
				Secretary of the
				Interior.</text>
									</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="idF28DA5F5438F42AA87FE04A644DC26C9"><enum>(c)</enum><header>Nutria
			 eradication program</header><text display-inline="yes-display-inline">Section 4
			 of the Nutria Eradication and Control Act of 2003 (Public Law 108–16; 117 Stat.
			 621) (as redesignated by subsection (b)) is amended—</text>
						<paragraph id="id52054B49CB144241B0B46A7AD5A795AB"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting
			 the following:</text>
							<quoted-block display-inline="no-display-inline" id="idE9EB6E9E5E3D4D28900A809504819CD5" style="OLC">
								<subsection id="id2AB19CC241344AF291D5F92D34A1831A"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may,
				subject to the availability of appropriations, provide financial assistance to
				the States of Maryland and Louisiana and the coastal States to implement
				measures—</text>
									<paragraph id="id1C255638AB334DD189064DDBAC08249C"><enum>(1)</enum><text display-inline="yes-display-inline">to eradicate or control nutria; and</text>
									</paragraph><paragraph id="id3038F067D37647159DFA76FBAF364CC9"><enum>(2)</enum><text display-inline="yes-display-inline">to restore wetlands damaged by
				nutria.</text>
									</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
						</paragraph><paragraph id="id2E9AC0ABC1354B5591DCC1C4FC76DE78"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
							<subparagraph id="id35D81BB8794A45E080A34FA64E3CB70B"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>the
			 State of</quote> before <quote>Maryland</quote>;</text>
							</subparagraph><subparagraph id="idC5B0C03C70A24B96AE14BB12C930228D"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>other
			 States</quote> and inserting <quote>the coastal States</quote>; and</text>
							</subparagraph><subparagraph id="id022F119A794F4645BEC3454CB1F3A317"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking
			 <quote>marshland</quote> and inserting <quote>wetlands</quote>;</text>
							</subparagraph></paragraph><paragraph id="id0CBDE9D64B9141CD884913D7662DE865"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
							<subparagraph id="idCFE7FEDAB6E64B2094917287A2FABA17"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(c)
			 <header-in-text level="subsection" style="OLC">Activities</header-in-text></quote> and inserting <quote>(c)
			 <header-in-text level="subsection" style="OLC">Activities in the State of
			 Maryland</header-in-text></quote>; and</text>
							</subparagraph><subparagraph id="idA4AE117506E54791B44EA958E4BC8170"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, and updated in March
			 2009</quote> before the period at the end;</text>
							</subparagraph></paragraph><paragraph id="id9184F7AA55BC43049A23B9437D6B0332"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (e), by striking
			 <quote>financial assistance provided by the Secretary under this
			 section</quote> and inserting <quote>the amounts made available under
			 subsection (f) to carry out the program</quote>; and</text>
						</paragraph><paragraph id="id22B252A1604A42C8A61397182552E29A"><enum>(5)</enum><text display-inline="yes-display-inline">by striking subsection (f) and inserting
			 the following:</text>
							<quoted-block display-inline="no-display-inline" id="id306CB46702F54EF7B8116697A8D5D7BD" style="OLC">
								<subsection id="id27674FB3C7FF4C81B8EC5B972B18EE62"><enum>(f)</enum><header>Authorization
				of appropriations</header><text>Subject to subsection (e), there is authorized
				to be appropriated to the Secretary to carry out the program $6,000,000 for
				each of fiscal years 2012 through 2016, of which—</text>
									<paragraph id="idCC8E39B06D25484B8C8DAB285A1EDBB8"><enum>(1)</enum><text>$2,000,000 shall
				be used to provide financial assistance to the State of Maryland;</text>
									</paragraph><paragraph id="id923AC159B9614C7FB96A3CC0A8D26168"><enum>(2)</enum><text>$2,000,000 shall
				be used to provide financial assistance to the State of Louisiana; and</text>
									</paragraph><paragraph id="id272A65F35A7E4AB68EAEC8AE4F44933E"><enum>(3)</enum><text>$2,000,000 shall
				be used to provide financial assistance, on a competitive basis, to other
				coastal
				States.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="id7F83E3FE53E14AEFACAEF3ADFB8E92C8"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Section 5 of the Nutria Eradication and
			 Control Act of 2003 (Public Law 108–16; 117 Stat. 621) (as redesignated by
			 subsection (b)) is amended—</text>
						<paragraph id="idDF6822BA1C4D4BBD9DCE5994164FE6DC"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>2002
			 document entitled <quote>Eradication Strategies for Nutria in the Chesapeake
			 and Delaware Bay Watersheds</quote>; and </quote> and inserting <quote>March
			 2009 update of the document entitled <quote>Eradication Strategies for Nutria
			 in the Chesapeake and Delaware Bay Watersheds</quote> and originally dated
			 March 2002;</quote>;</text>
						</paragraph><paragraph id="id782E53B38A384A26B613FBB4C2DD89ED"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
							<subparagraph id="id8EA0B6E8EE7C413481B145DB657C9738"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>develop</quote> and
			 inserting <quote>continue</quote>; and</text>
							</subparagraph><subparagraph id="id9742F8D2AB89430899C8616404646AE5"><enum>(B)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
							</subparagraph></paragraph><paragraph id="idA6DDAF8808EC4A3CA288E21A2F79426C"><enum>(3)</enum><text display-inline="yes-display-inline">by adding after paragraph (2) the
			 following:</text>
							<quoted-block display-inline="no-display-inline" id="id262AD2FFD0D34AFFA9D3728DB1D2D475" style="OLC">
								<paragraph id="idF4D84225679142A78BFB7AD968D9B38C"><enum>(3)</enum><text display-inline="yes-display-inline">develop, in cooperation with the State of
				Delaware Department of Natural Resources and Environmental Control, the State
				of Virginia Department of Game and Inland Fisheries, the State of Oregon
				Department of Fish and Wildlife, the State of North Carolina Department of
				Environment and Natural Resources, and the State of Washington Department of
				Fish and Wildlife, long-term nutria control or eradication programs, as
				appropriate, with the objective of—</text>
									<subparagraph id="id1C264212187C42A5AD2894ED3F1A3D6C"><enum>(A)</enum><text display-inline="yes-display-inline">significantly reducing and restoring the
				damage nutria cause to coastal wetlands in the coastal States; and</text>
									</subparagraph><subparagraph id="idBA9C28F86C034D4FB29C69E07CA6279A"><enum>(B)</enum><text display-inline="yes-display-inline">promoting voluntary, public-private
				partnerships to eradicate or control nutria and restoring nutria-damaged
				wetlands in the coastal
				States.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
