		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Innovative Design Protection Act
			 of 2012</short-title></quote>.</text>
		</section><section id="id43ac5318f4e24334b73104ef275b87d8"><enum>2.</enum><header>Amendments to
			 title 17, United States Code</header>
			<subsection id="id06cbd550539a4cf38a7489ffee0a7d5e"><enum>(a)</enum><header>Designs
			 protected</header><text>Section 1301 of title 17, United States Code, is
			 amended—</text>
				<paragraph id="id608248ccad7744678bb55208f6626727"><enum>(1)</enum><text>in subsection
			 (a), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idc337d09dd164407d9471fcb36528730b" style="OLC">
						<paragraph id="idd50cbff070b14b07bc4e910c325a7fdd"><enum>(4)</enum><header>Fashion
				design</header><text>A fashion design is subject to protection under this
				chapter.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id20021e774cc940fd986a28d32fe63327"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="ide6faecad72084241a862a48bc5070b9f"><enum>(A)</enum><text>in paragraph (2),
			 by inserting <quote>, or an article of apparel,</quote> after <quote>plug or
			 mold</quote>; and</text>
					</subparagraph><subparagraph id="idf2e6c61292ff49ce8b6b303b8bac945b"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id5bb0ca4fe3904143be9d5767d1b753ac" style="OLC">
							<paragraph id="ida475e52452ca457aa9c6eadb959b7037"><enum>(8)</enum><text>A <term>fashion
				design</term>—</text>
								<subparagraph id="id78463653b5ba467f95be8cfe5b25f1be"><enum>(A)</enum><text>is the appearance
				as a whole of an article of apparel, including its ornamentation; and</text>
								</subparagraph><subparagraph id="id4b19e1b0781e49328c023d4e1cf0f0c7"><enum>(B)</enum><text>includes original
				elements of the article of apparel or the original arrangement or placement of
				original or non-original elements as incorporated in the overall appearance of
				the article of apparel that—</text>
									<clause id="id8b10de265dc74d29a8b4b223ff71b1f5"><enum>(i)</enum><text>are the result of
				a designer’s own creative endeavor; and</text>
									</clause><clause id="id218803b0ac594fd19d82ae454ffa8cbe"><enum>(ii)</enum><text>provide a
				unique, distinguishable, non-trivial and non-utilitarian variation over prior
				designs for similar types of articles.</text>
									</clause></subparagraph></paragraph><paragraph id="ida1cfbfb9f36a46b4a5cff519ac8397ab"><enum>(9)</enum><text>The term
				<term>design</term> includes fashion design, except to the extent expressly
				limited to the design of a vessel.</text>
							</paragraph><paragraph id="id5a98d4b7076b4be98491da0f0810e6bd"><enum>(10)</enum><text>The term
				<term>apparel</term> means—</text>
								<subparagraph id="ide7f08935ba154887a65ed03b6fc1718b"><enum>(A)</enum><text>an article of
				men’s, women’s, or children’s clothing, including undergarments, outerwear,
				gloves, footwear, and headgear;</text>
								</subparagraph><subparagraph id="id2cce9c2bef92431a811fcfb9853e70ac"><enum>(B)</enum><text>handbags, purses,
				wallets, tote bags, and belts; and</text>
								</subparagraph><subparagraph id="id38319e4efb2c4602bae12fdd2fdd9999"><enum>(C)</enum><text>eyeglass
				frames.</text>
								</subparagraph></paragraph><paragraph id="id6d1715b0874f4e8391bdd0d29f394a70"><enum>(11)</enum><text>In the case of a
				fashion design, the term <term>substantially identical</term> means an article
				of apparel which is so similar in appearance as to be likely to be mistaken for
				the protected design, and contains only those differences in construction or
				design which are merely trivial.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id922a930f251b4e93bb45b7701783c7f1"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idd9123ac8ff8c47bfa5b94f7ed463e22f" style="OLC">
						<subsection id="id427ab56f85274c79a52b9fc80b2357ef"><enum>(c)</enum><header>Rule of
				construction</header><text>In the case of a fashion design under this chapter,
				those differences or variations which are considered non-trivial for the
				purposes of establishing that a design is subject to protection under
				subsection (b)(8) shall be considered non-trivial for the purposes of
				establishing that a defendant’s design is not substantially identical under
				subsection (b)(11) and section
				1309(e).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idd37c9102461c4956bedabb6b7df3a67f"><enum>(b)</enum><header>Designs not
			 subject to protection</header><text>Section 1302(5) of title 17, United States
			 Code, is amended—</text>
				<paragraph id="id76801f83ada449e887a8346d72347317"><enum>(1)</enum><text>by striking
			 <quote>(5)</quote> and inserting <quote>(5)(A) in the case of a design of a
			 vessel hull,</quote>;</text>
				</paragraph><paragraph id="idf5caf24e0d8e48c78d98559f92d26f0d"><enum>(2)</enum><text>by striking the
			 period and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="idf9d3a3ac94da467794210a40f70f0cfa"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8d26942199474f0c9c4974b853e4c436" style="OLC">
						<subparagraph id="id74b7827276784ed3b8f6eff929031dd9"><enum>(B)</enum><text>in the case of a
				fashion design, embodied in a useful article that was made public by the
				designer or owner in the United States or a foreign country before the date of
				enactment of this chapter or more than 3 years before the date upon which
				protection of the design is asserted under this
				chapter.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id468b3d16d5d34e43a6d84dbcbcd1269d"><enum>(c)</enum><header>Revisions,
			 adaptations, and rearrangements</header><text>Section 1303 of title 17, United
			 States Code, is amended by adding at the end the following: <quote>The presence
			 or absence of a particular color or colors or of a pictorial or graphic work
			 imprinted on fabric shall not be considered in determining the protection of a
			 fashion design under section 1301 or 1302 or in determining infringement under
			 section 1309.</quote>.</text>
			</subsection><subsection id="id1f6d1d495cbf40548e7ba1f70a0b404c"><enum>(d)</enum><header>Term of
			 protection</header><text>Section 1305(a) of title 17, United States Code, is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id4abde90d14424d10b6b050413b6de0ad" style="OLC">
					<subsection id="id716ea8d21c8f4ea586f38446d9c188c6"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b), the protection provided under
				this chapter—</text>
						<paragraph id="id02ef1805eb84458485091b265c6e3e8f"><enum>(1)</enum><text>for a design of a
				vessel hull, shall continue for a term of 10 years beginning on the date of the
				commencement of protection under section 1304; and</text>
						</paragraph><paragraph id="id4581b1c2096944b1b8214f045b77f917"><enum>(2)</enum><text>for a fashion
				design, shall continue for a term of 3 years beginning on the date of the
				commencement of protection under section
				1304.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idb1f36cc8f96049f68b72539a5eb5bdf1"><enum>(e)</enum><header>Notice</header><text>Section
			 1306 of title 17, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id0ce4992795ba4331ba9e70e4351409c5" style="OLC">
					<subsection id="idf0da15859d5b471bac3a5f5decc2042f"><enum>(d)</enum><header>Fashion
				design</header>
						<paragraph id="ide101b100632046cdbca77b0986692690"><enum>(1)</enum><header>In
				general</header><text>In the case of a fashion design, the owner of the design
				shall provide written notice of the design protection to any person the design
				owner has reason to believe has violated or will violate this chapter.</text>
						</paragraph><paragraph id="id387a3b3aea2e43a78eb88dc2ebaab86d"><enum>(2)</enum><header>Contents</header><text>The
				written notice required under paragraph (1) shall contain, at a minimum—</text>
							<subparagraph id="ide7eba8ce8056408fbc9561be564fa580"><enum>(A)</enum><text>the date on which
				protection for the design commenced;</text>
							</subparagraph><subparagraph id="idb3e46d1230fb463a91038a7c68457f76"><enum>(B)</enum><text>a description of
				the protected design which specifies how the protected design falls within the
				meaning of section 1301(b)(8);</text>
							</subparagraph><subparagraph id="id3f7b01d4e7ea465887351211c23ecf87"><enum>(C)</enum><text>a description of
				the allegedly infringing design which specifies how the allegedly infringing
				design infringed upon the protected design as described under section 1309(e);
				and</text>
							</subparagraph><subparagraph id="id02fd53f204b44c67b3b9aef99ee35423"><enum>(D)</enum><text>the date on which
				the protected design or an image thereof was available such that it could be
				reasonably inferred from the totality of the surrounding facts and
				circumstances that the owner of the allegedly infringing design saw or
				otherwise had knowledge of the protected design.</text>
							</subparagraph></paragraph><paragraph id="id5c8747c45c7647e0a37675d7c34917ee"><enum>(3)</enum><header>Commencement of
				action</header><text>An action for infringement of a fashion design under this
				chapter shall not commence until the date that is 21 days after the date on
				which written notice required under this subsection was provided to the
				defendant.</text>
						</paragraph><paragraph id="idbdaaf0e5917e415ab0095a7d5284cbb3"><enum>(4)</enum><header>Limitation on
				damages</header><text>A person alleged to be undertaking action leading to
				infringement under this chapter shall be held liable only for damages and
				profits accrued after the date on which the action for infringement is
				commenced against such person under paragraph
				(3).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idb68458c42cda4f49b1d2c4404acbf313"><enum>(f)</enum><header>Infringement</header><text>Section
			 1309 of title 17, United States Code, is amended—</text>
				<paragraph id="id0deb7664514c479e8b41395b55df90ae"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="iddbb5c0c4efe84e39ba854c9a53788e87"><enum>(A)</enum><text>by amending the
			 matter preceding paragraph (1) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="ide7508c08545548128b6e41182699e503" style="OLC">
							<subsection id="idde48782e8a72445f994b84ed14b9c93d"><enum>(b)</enum><header>Acts of
				sellers, importers and distributors</header><text>A retailer, seller, importer
				or distributor of an infringing article who did not make the article shall be
				deemed to have infringed on a design protected under this chapter only if that
				person—</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id6ee43b0a58184843a38d2d2f7cbf87ac"><enum>(B)</enum><text>in paragraph (1),
			 by striking <quote>, or an importer to import</quote>;</text>
					</subparagraph></paragraph><paragraph id="idd0dbc69677c5459f9a0d617f454c200a"><enum>(2)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="id95d5b10f165b418a88e2762dd1405260"><enum>(A)</enum><text>by inserting
			 <quote>offer for sale</quote> after <quote>sell,</quote>; and</text>
					</subparagraph><subparagraph id="id13431e4f4c3e4807979056845ae88ef9"><enum>(B)</enum><text>by inserting
			 <quote>either actual or reasonably inferred from the totality of the
			 circumstances,</quote> after <quote>created without knowledge</quote>;</text>
					</subparagraph></paragraph><paragraph id="idf497e53adb8b4dab9802f83a3359c1c5"><enum>(3)</enum><text>by redesignating
			 subsections (e), (f), and (g) as subsections (f), (g), and (h),
			 respectively;</text>
				</paragraph><paragraph id="idE8C2F534C0884BC4BFF3EDA21ACB8458"><enum>(4)</enum><text>by inserting
			 after subsection (d) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id3d2a3465b3f44c6bb4730af6a9cc6e87" style="OLC">
						<subsection id="id21c7a96e2bd34fe685c899ffa58b6f45"><enum>(e)</enum><header>Acts of third
				parties</header><text>Acts that do not constitute acts of infringement under
				subsections (a) or (b) do not otherwise constitute acts of infringement under
				this chapter. It shall not be infringement under this section to be engaged
				in—</text>
							<paragraph id="idaa2f4bbc1bee4bf6bb8876e15713eedf"><enum>(1)</enum><text>the provision of
				a telecommunications service, or of an Internet access service or Internet
				information location tool (as those terms are defined in section 231 the
				Communications Act of 1934 (47 U.S.C. 231)); or</text>
							</paragraph><paragraph id="idc87d77a43e9f4d7ca650d3958bbe9189"><enum>(2)</enum><text>the transmission,
				storage, retrieval, hosting, formatting, or translation (or any combination
				thereof) of a communication, without selection or alteration of the content of
				the communication, except that deletion of a particular communication or
				material made by another person in a manner consistent with section 230(c) of
				the Communications Act of 1934 (47 U.S.C.
				230(c)).</text>
							</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idcbce2ae9582343daa03ad9461d93d9fe"><enum>(5)</enum><text>by amending
			 subsection (f), as so redesignated, to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id60d2f4bf44184c8c99edd3307e55b7de" style="OLC">
						<subsection id="id63f726aa0585457088c5c39b26fff4ba"><enum>(f)</enum><header>Infringing
				article defined</header>
							<paragraph id="id063458ca48654eed8fcad41c45a24226"><enum>(1)</enum><header>In
				general</header><text>As used in this section, an <term>infringing
				article</term> is any article the design of which has been copied from a design
				protected under this chapter, or from an image thereof, without the consent of
				the owner of the protected design. An infringing article is not an illustration
				or picture of a protected design in an advertisement, book, periodical,
				newspaper, photograph, broadcast, motion picture, or similar medium.</text>
							</paragraph><paragraph id="idbfd9a59bdb874ce190208d1687456398"><enum>(2)</enum><header>Vessel hull
				design</header><text>In the case of a design of a vessel hull, a design shall
				not be deemed to have been copied from a protected design if it is original and
				not substantially similar in appearance to a protected design.</text>
							</paragraph><paragraph id="id97cdd512fdd44fb0afd0e2fbb80bc41b"><enum>(3)</enum><header>Fashion
				design</header><text>In the case of a fashion design, a design shall not be
				deemed to have been copied from a protected design if that design—</text>
								<subparagraph id="ide251e2259a0b404b8f6a42d244e16078"><enum>(A)</enum><text>is not
				substantially identical in overall visual appearance to and as to the original
				elements of a protected design; or</text>
								</subparagraph><subparagraph id="id387ffb9cf76e4d8cb9149f1c1a99e755"><enum>(B)</enum><text>is the result of
				independent creation.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id3ee74e72871d4c3fb56252e9d1f40134"><enum>(6)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id80a09b6475124a7da5128356d3f262bf" style="OLC">
						<subsection id="id250cdd6db2394b639df1e6d803d00563"><enum>(i)</enum><header>Home sewing
				exception</header>
							<paragraph id="id9020b661f6bd4c439e30c51c47c22c1b"><enum>(1)</enum><header>In
				general</header><text>It is not an infringement of the exclusive rights of a
				design owner for a person to produce a single copy of a protected design for
				personal use or for the use of an immediate family member, if that copy is not
				offered for sale or use in trade during the period of protection.</text>
							</paragraph><paragraph id="id1ef1ff46a2e4463995e46cd1457f329e"><enum>(2)</enum><header>Rule of
				construction</header><text>Nothing in this subsection shall be construed to
				permit the publication or distribution of instructions or patterns for the
				copying of a protected
				design.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id43067742d41b46459fc4e87139fc2058"><enum>(g)</enum><header>Application for
			 registration</header><text>Section 1310(a) of title 17, United States Code, is
			 amended—</text>
				<paragraph id="idf7e1116300be40348424e82c3ada6661"><enum>(1)</enum><text>by striking
			 <quote>Protection under this chapter</quote> and inserting <quote>In the case
			 of a design of a vessel hull, protection under this chapter</quote>; and</text>
				</paragraph><paragraph id="id836b24ad47b141d5a1e8d01456bc0ce6"><enum>(2)</enum><text>by adding
			 <quote>Registration shall not apply to fashion designs.</quote> after
			 <quote>first made public.</quote>.</text>
				</paragraph></subsection><subsection id="idcffd6a64802e49e0b3e2ba89d711540b"><enum>(h)</enum><header>Remedy for
			 infringement</header><text>Section 1321 of title 17, United States Code, is
			 amended—</text>
				<paragraph id="id4cec36e0a7ea438d8b6a2a74ed870fcd"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idc36f1c7e104a41839b17d1981deecb25" style="OLC">
						<subsection id="id17fbdbe1b77c4893a2a93611592aa06a"><enum>(a)</enum><header>In
				general</header>
							<paragraph id="id7714dfefff5f4808a11e4e74623bc8ed"><enum>(1)</enum><header>Vessel
				hull</header><text>In the case of a vessel hull, the owner of a design is
				entitled, after issuance of a certificate of registration of the design under
				this chapter, to institute an action for any infringement of the design.</text>
							</paragraph><paragraph id="id326d279483b34b72be9cacc538a64709"><enum>(2)</enum><header>Fashion
				design</header><text>In the case of a fashion design, the owner of a design is
				entitled to institute an action for any infringement of the design
				after—</text>
								<subparagraph id="id24c37a8770be4a17827a535624957ae4"><enum>(A)</enum><text>the design is
				made public under the terms of section 1310(b) of this chapter; and</text>
								</subparagraph><subparagraph id="idf619fc92ac94418e83d028bd4b0ba667"><enum>(B)</enum><text>the 21-day period
				described in section 1306(d).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id3384a4d2cef549b2ac93d321f6c5aa9c"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1d8d90a3c7e94b978c925613b6d23e00" style="OLC">
						<subsection id="id48704d62a4b348b8997dfb2a2dac43dc"><enum>(e)</enum><header>Pleading
				requirement for fashion designs</header>
							<paragraph id="id3a92c21748cb47efb710fce4459a30a2"><enum>(1)</enum><header>In
				general</header><text>In the case of a fashion design, a claimant in an action
				for infringement shall plead with particularity facts establishing that—</text>
								<subparagraph id="id2235d54e6a414640a0f2296c05f1bf8b"><enum>(A)</enum><text>the design of the
				claimant is a fashion design within the meaning of section 1301(b)(8) of this
				title and thus entitled to protection under this chapter;</text>
								</subparagraph><subparagraph id="idf8e29f1a416e4916ab59d130cf46d235"><enum>(B)</enum><text>the design of the
				defendant infringes upon the protected design as described under section
				1309(e); and</text>
								</subparagraph><subparagraph id="ida2b60285f1174ef5a055f6de10f0f0ab"><enum>(C)</enum><text>the protected
				design or an image thereof was available in such location or locations, in such
				a manner, and for such duration that it can be reasonably inferred from the
				totality of the surrounding facts and circumstances that the defendant saw or
				otherwise had knowledge of the protected design.</text>
								</subparagraph></paragraph><paragraph id="iddebb1598db784895a0d21146a91f39b0"><enum>(2)</enum><header>Considerations</header><text>In
				considering whether a claim for infringement has been adequately pleaded, the
				court shall consider the totality of the
				circumstances.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id81a773b2bb16457cbd05944a1b13b649"><enum>(i)</enum><header>Penalty for
			 false representation</header><text display-inline="yes-display-inline">Section
			 1327 of title 17, United States Code, is amended—</text>
				<paragraph id="id2d3b2f3141cd4eff9644e91a3182cded"><enum>(1)</enum><text>by inserting
			 <quote>or for purposes of obtaining recovery based on a claim of infringement
			 under this chapter</quote> after <quote>registration of a design under this
			 chapter</quote>;</text>
				</paragraph><paragraph id="id48b503866a174d04beb8be78e74ec114"><enum>(2)</enum><text>by striking
			 <quote>$500</quote> and inserting <quote>5,000</quote>; and</text>
				</paragraph><paragraph id="idee8c967e44d84987a698e0c6cd6f2c0d"><enum>(3)</enum><text>by striking
			 <quote>$1,000</quote> and inserting <quote>$10,000</quote>.</text>
				</paragraph></subsection><subsection id="id2946532c646544668c2c096e4bcf174f"><enum>(j)</enum><header>Nonapplicability
			 of enforcement by treasury and postal service</header><text>Section 1328 of
			 title 17, United States Code, is amended—</text>
				<paragraph id="id9508c66173ec4ec3a53e8a2e5863896f"><enum>(1)</enum><text>in subsection
			 (a), in the first sentence, by striking <quote>The Secretary</quote> and
			 inserting <quote>In the case of designs of vessel hulls protected under this
			 chapter, the Secretary</quote>;</text>
				</paragraph><paragraph id="idc21f83c2ea4a410196bba096ec3d71f2"><enum>(2)</enum><text>in subsection
			 (b), in the first sentence, by striking <quote>Articles</quote> and inserting
			 <quote>In the case of designs of vessel hulls protected under this chapter,
			 articles</quote>; and</text>
				</paragraph><paragraph id="idf2666a7b898a408bb071dacf071aec45"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

						<subsection id="id8a65e3b5e8a849959d51184287301dda"><enum>(c)</enum><header>Nonapplicability</header><text>This
				section shall not apply to fashion designs protected under this
				chapter.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id0fcaa84a686640a9bea913f5e38d2c0b"><enum>(k)</enum><header>Common law and
			 other rights unaffected</header><text>Section 1330 of title 17, United States
			 Code, is amended—</text>
				<paragraph id="idbce152ab9be84a3987a6212661343e03"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="id4cbcc138a3f44b509ba9033796ad2623"><enum>(2)</enum><text>in paragraph (2),
			 by striking the period and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="id9dba7877463247aeb7f332125a02af69"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8bcacba3494d4c6da3fbdd5a912f5526" style="OLC">
						<paragraph id="ideaa820c0355748558d4a135187b5fb87"><enum>(3)</enum><text>any rights that
				may exist under provisions of this title other than this
				chapter.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idc61418bbab7b4910ac3ea71057524933"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect on the date of enactment of this
			 Act.</text>
