								<section id="id866def5d9f8c4ad08225c7a794d4fdbe"><enum>381.</enum><header>Definitions</header>
									<subsection id="idA43346A07E6F428D95ABDC03849AC0B9"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">When used in this
				part, unless the context otherwise indicates—</text>
										<paragraph id="idced0f9880a71403c85f71dd52d25fe7c"><enum>(1)</enum><text>the term
				<term>treaty</term> means the Geneva Act of the Hague Agreement Concerning the
				International Registration of Industrial Designs adopted at Geneva on July 2,
				1999;</text>
										</paragraph><paragraph id="id20d1658c69df4062b5e56bb1a5daaf12"><enum>(2)</enum><text>the term
				<term>regulations</term>—</text>
											<subparagraph id="id05C1DE288B1A4392BAC66A40BD395F21"><enum>(A)</enum><text>when capitalized,
				means the Common Regulations under the treaty; and</text>
											</subparagraph><subparagraph id="id4411424AD3804C249CA3EABB8BF28827"><enum>(B)</enum><text>when not
				capitalized, means the regulations established by the Director under this
				title;</text>
											</subparagraph></paragraph><paragraph id="idf116bf1a1941443088e6c2fe3ba259fb"><enum>(3)</enum><text>the term
				<term>designation</term> means a request that an international registration
				have effect in a Contracting Party to the treaty;</text>
										</paragraph><paragraph id="idf2e9435bfff44bbebbab984a0c2aba2e"><enum>(4)</enum><text>the term
				<term>International Bureau</term> means the international intergovernmental
				organization that is recognized as the coordinating body under the treaty and
				the Regulations;</text>
										</paragraph><paragraph id="idaf0c1900e0bb4b9d91095b57963763c9"><enum>(5)</enum><text>the term
				<term>effective registration date</term> means the date of international
				registration indicated by the International Bureau under the treaty;</text>
										</paragraph><paragraph id="id79d5096e0c2f4cd9b02bec8260e2aa80"><enum>(6)</enum><text>the term
				<term>international design application</term> means an application for
				international registration; and</text>
										</paragraph><paragraph id="id609948ccc6bb49069409521593bef7fe"><enum>(7)</enum><text>the term
				<term>international registration</term> means the international registration of
				an industrial design filed under the treaty.</text>
										</paragraph></subsection><subsection id="id23e9191dd1044fcc89f5fa0be848ee17"><enum>(b)</enum><header>Rule of
				construction</header><text>Terms and expressions not defined in this part are
				to be taken in the sense indicated by the treaty and the Regulations.</text>
									</subsection></section><section id="id49fb750c311e420eb6d0e09d38d6a790"><enum>382.</enum><header>Filing
				international design applications</header>
									<subsection id="id4d6667f4d3584dcaadb54245bdb1f078"><enum>(a)</enum><header>In
				general</header><text>Any person who is a national of the United States, or has
				a domicile, a habitual residence, or a real and effective industrial or
				commercial establishment in the United States, may file an international design
				application by submitting to the Patent and Trademark Office an application in
				such form, together with such fees, as may be prescribed by the
				Director.</text>
									</subsection><subsection id="id4f56f201f66d45a199af21e90b19dd69"><enum>(b)</enum><header>Required
				action</header><text>The Patent and Trademark Office shall perform all acts
				connected with the discharge of its duties under the treaty, including the
				collection of international fees and transmittal thereof to the International
				Bureau. Subject to chapter 17 of this title, international design applications
				shall be forwarded by the Patent and Trademark Office to the International
				Bureau, upon payment of a transmittal fee.</text>
									</subsection><subsection id="id212479be0a604022accb39d939d8a696"><enum>(c)</enum><header>Applicability of
				chapter 16</header><text>Except as otherwise provided in this chapter, the
				provisions of chapter 16 of this title shall apply.</text>
									</subsection><subsection id="id6ffdcd5432b041f5b141c3cb016a7afc"><enum>(d)</enum><header>Application
				filed in another country</header><text>An international design application on
				an industrial design made in this country shall be considered to constitute the
				filing of an application in a foreign country within the meaning of chapter 17
				of this title if the international design application is filed—</text>
										<paragraph id="idDB8D0692EFED4D0E83DA14C937D151AF"><enum>(1)</enum><text>in a country other
				than the United States;</text>
										</paragraph><paragraph id="idDDC8FCA7142C43248313DB7AEFD78E73"><enum>(2)</enum><text>at the
				International Bureau; or</text>
										</paragraph><paragraph id="id8E775DD17E0A4538A281C2A359CC25B3"><enum>(3)</enum><text>with an
				intergovernmental organization.</text>
										</paragraph></subsection></section><section id="id6314c473039d42e58e02db53e3e327d5"><enum>383.</enum><header>International
				design application</header><text display-inline="no-display-inline">In addition
				to any requirements pursuant to chapter 16 of this title, the international
				design application shall contain—</text>
									<paragraph id="id5094909ea1094bbb8a374a7241163163"><enum>(1)</enum><text>a request for
				international registration under the treaty;</text>
									</paragraph><paragraph id="id1b5e4d2b6dda42c6bdbc067030262e69"><enum>(2)</enum><text>an indication of
				the designated Contracting Parties;</text>
									</paragraph><paragraph id="idfd952d170d0d49ef9c88d2f584dcfb28"><enum>(3)</enum><text>data concerning
				the applicant as prescribed in the treaty and the Regulations;</text>
									</paragraph><paragraph id="id88bc4aa5d1164d05a688a2b5b071b283"><enum>(4)</enum><text>copies of a
				reproduction or, at the choice of the applicant, of several different
				reproductions of the industrial design that is the subject of the international
				application, presented in the number and manner prescribed in the treaty and
				the Regulations;</text>
									</paragraph><paragraph id="id003d5cf7a2be4765ba80626fc79106ab"><enum>(5)</enum><text>an indication of
				the product or products which constitute the industrial design or in relation
				to which the industrial design is to be used, as prescribed in the treaty and
				the Regulations;</text>
									</paragraph><paragraph id="idd3f44d601d35484a91fa54831138c573"><enum>(6)</enum><text>the fees
				prescribed in the treaty and the Regulations; and</text>
									</paragraph><paragraph id="id2e4239fd91044e44b4767c873452e7ab"><enum>(7)</enum><text>any other
				particulars prescribed in the Regulations.</text>
									</paragraph></section><section id="id7b7679d1cd0d4c7ab9e7b82e384c5a71"><enum>384.</enum><header>Filing
				date</header>
									<subsection id="id3039245a9e504ccba63b4cb8ca2687e6"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b), the filing date of an
				international design application in the United States shall be the effective
				registration date. Notwithstanding the provisions of this part, any
				international design application designating the United States that otherwise
				meets the requirements of chapter 16 of this title may be treated as a design
				application under chapter 16 of this title.</text>
									</subsection><subsection id="idcd8bc7e8310a4c7d9fd27a18e2bfc285"><enum>(b)</enum><header>Review</header><text>An
				applicant may request review by the Director of the filing date of the
				international design application in the United States. The Director may
				determine that the filing date of the international design application in the
				United States is a date other than the effective registration date. The
				Director may establish procedures, including the payment of a surcharge, to
				review the filing date under this section. Such review may result in a
				determination that the application has a filing date in the United States other
				than the effective registration date.</text>
									</subsection></section><section id="id6afe1fb6997d4f5fb0cca8edca4a7c1d"><enum>385.</enum><header>Effect of
				international design application</header><text display-inline="no-display-inline">An international design application
				designating the United States shall have the effect, for all purposes, from its
				filing date determined in accordance with section 384 of this part, of an
				application for patent filed in the Patent and Trademark Office pursuant to
				chapter 16 of this title.</text>
								</section><section id="id440e18e2bac84504827b309b130ee96f"><enum>386.</enum><header>Right of
				priority</header>
									<subsection id="id3b099eee705a49cb9bdff6401c225075"><enum>(a)</enum><header>National
				application</header><text>In accordance with the conditions and requirements of
				subsections (a) through (d) of section 119 of this title and section 172 of
				this title, a national application shall be entitled to the right of priority
				based on a prior international design application which designated at least one
				country other than the United States.</text>
									</subsection><subsection id="id56b3d4f481b645e784fe060886f49bb7"><enum>(b)</enum><header>Prior foreign
				application</header><text>In accordance with the conditions and requirements of
				subsections (a) through (d) of section 119 of this title and section 172 of
				this title and the treaty and the Regulations, an international design
				application designating the United States shall be entitled to the right of
				priority based on a prior foreign application, a prior international
				application as defined in section 351(c) of this title designating at least one
				country other than the United States, or a prior international design
				application designating at least one country other than the United
				States.</text>
									</subsection><subsection id="id0ae52267f60a4b5cb18691a767edb3f7"><enum>(c)</enum><header>Prior national
				application</header><text>In accordance with the conditions and requirements of
				section 120 of this title, an international design application designating the
				United States shall be entitled to the benefit of the filing date of a prior
				national application, a prior international application as defined in section
				351(c) of this title designating the United States, or a prior international
				design application designating the United States, and a national application
				shall be entitled to the benefit of the filing date of a prior international
				design application designating the United States. If any claim for the benefit
				of an earlier filing date is based on a prior international application as
				defined in section 351(c) of this title which designated but did not originate
				in the United States or a prior international design application which
				designated but did not originate in the United States, the Director may require
				the filing in the Patent and Trademark Office of a certified copy of such
				application together with a translation thereof into the English language, if
				it was filed in another language.</text>
									</subsection></section><section id="idfeec375aeaff4f1aae292acc7c433eed"><enum>387.</enum><header>Relief from
				prescribed time limits</header><text display-inline="no-display-inline">An
				applicant's failure to act within prescribed time limits in connection with
				requirements pertaining to an international design application may be excused
				as to the United States upon a showing satisfactory to the Director of
				unintentional delay and under such conditions, including a requirement for
				payment of the fee specified in section 41(a)(7) of this title, as may be
				prescribed by the Director.</text>
								</section><section id="id83abce6f370a49718e9736088f6f3473"><enum>388.</enum><header>Withdrawn or
				abandoned international design application</header><text display-inline="no-display-inline">Subject to sections 384 and 387 of this
				part, if an international design application designating the United States is
				withdrawn, renounced or canceled or considered withdrawn or abandoned, either
				generally or as to the United States, under the conditions of the treaty and
				the Regulations, the designation of the United States shall have no effect
				after the date of withdrawal, renunciation, cancellation, or abandonment and
				shall be considered as not having been made, unless a claim for benefit of a
				prior filing date under section 386(c) of this part was made in a national
				application, or an international design application designating the United
				States, or a claim for benefit under section 365(c) was made in an
				international application designating the United States, filed before the date
				of such withdrawal, renunciation, cancellation, or abandonment. However, such
				withdrawn, renounced, canceled, or abandoned international design application
				may serve as the basis for a claim of priority under subsections (a) and (b) of
				section 386, or under subsection (a) or (b) of section 365, if it designated a
				country other than the United States.</text>
								</section><section id="id5ffb373f53264e4680f43bb3a94206d4"><enum>389.</enum><header>Examination of
				international design application</header>
									<subsection id="id919c3fd41d8e4322a691215a829a22ff"><enum>(a)</enum><header>In
				general</header><text>The Director shall cause an examination pursuant to this
				title of an international design application designating the United
				States.</text>
									</subsection><subsection id="id4e9814bce3e84fa389c240d3b7d1a4d6"><enum>(b)</enum><header>Applicability of
				chapter 16</header><text>All questions of substance, and, unless otherwise
				required by the treaty and Regulations, procedures regarding an international
				design application designating the United States shall be determined as in the
				case of applications filed under chapter 16 of this title.</text>
									</subsection><subsection id="idc58382c26d1d4c0d8eb0c072a5d43698"><enum>(c)</enum><header>Fees</header><text>The
				Director may prescribe fees for filing international design applications, for
				designating the United States, and for any other processing, services, or
				materials relating to international design applications, and may provide for
				later payment of such fees, including surcharges for later submission of
				fees.</text>
									</subsection><subsection id="id0c80136f62dd4cb8a74eaf0d3fa02ca6"><enum>(d)</enum><header>Issuance of
				patent</header><text>The Director may issue a patent based on an international
				design application designating the United States, in accordance with the
				provisions of this title. Such patent shall have the force and effect of a
				patent issued on an application filed under chapter 16 of this title.</text>
									</subsection></section><section id="idf7e8eb7899d1492eaa635f0622bf6802"><enum>390.</enum><header>Publication of
				international design application</header><text display-inline="no-display-inline">The publication under the treaty defined in
				section 381(a)(1) of an international design application designating the United
				States shall be deemed a publication under section
				122(b).</text>

				</subsection><subsection id="idDA211DB0632D43C78AA51412837607A4"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of parts at the beginning of title 35, United
			 States Code, is amended by adding at the end the following:</text>

			 date</header>
				<subsection id="id983005ab1e7f46dc89148fee3e0d280b"><enum>(a)</enum><header>In
			 general</header><text>The amendments made by this title shall be effective on
			 the later of—</text>
					<paragraph id="idc2aa1f6e8de34fc4b2472b1e1bed925b"><enum>(1)</enum><text>the date that is 1
			 year after the date of enactment of this Act, or</text>
					</paragraph><paragraph id="id566b6ca184eb4ec591a0634b6236b624"><enum>(2)</enum><text>the date of entry
			 into force of the treaty, as defined in section 381 of title 35, as amended by
			 this Act, with respect to the United States.</text>
					</paragraph></subsection><subsection id="id630f95bc5f4a445e9566fe41272d4dac"><enum>(b)</enum><header>Applicability of
			 amendments</header>
					<paragraph id="idB52C460E701A4F6BB1FF64EAA899C4ED"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the amendments made by this
			 title shall apply only to international design applications, international
			 applications as defined in section 351(c) of title 35, United States Code, and
			 national applications filed on and after the effective date set forth in
			 subsection (a), and patents issuing thereon.</text>
					</paragraph><paragraph id="id2468C7C481E3403AB2CF1DDECDEBCC10"><enum>(2)</enum><header>Exception</header><text>Sections
			 100(i) and 102(d) of title 35, United States Code, as amended by this title,
			 shall not apply to an application, or any patent issuing thereon, unless it is
			 described in section 3(n)(1) of the Leahy-Smith America Invents Act (35 U.S.C.
			 100 note).</text>

			 implement the Patent Law Treaty</header>
				<subsection id="idF79EB63F1E1E41E48C8993D8812C456E"><enum>(a)</enum><header>Application
			 filing date</header><text>Section 111 of title 35, United States Code, is
			 amended—</text>
					<paragraph id="id275B99D374704E659EF39F9C75CF8F23"><enum>(1)</enum><text>in subsection (a),
			 by striking paragraphs (3) and (4) and inserting the following:</text>
						<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id25E06C0F7F1F462E82A3419BB8CFFF30" reported-display-style="strikethrough" style="OLC">
							<paragraph id="ID660be53499e042bc9bbb2c626fdda1e6"><enum>(3)</enum><header>Fee, oath or
				declaration, and claims</header><text>The application shall be accompanied by
				the fee required by law. The fee, oath or declaration, and 1 or more claims may
				be submitted after the filing date of the application, within such period and
				under such conditions, including the payment of a surcharge, as may be
				prescribed by the Director. Upon failure to submit the fee, oath or
				declaration, and 1 or more claims within such prescribed period, the

				the payment of a surcharge, under which a reference made upon the filing of an
				application under subsection (a) to a previously filed application, specifying
				the previously filed application by application number and the intellectual
				property authority or country in which the application was filed, shall
				constitute the specification and any drawings of the subsequent application for
				purposes of a filing date. A copy of the specification and any drawings of the
				previously filed application shall be submitted within such period and under
				such conditions as may be prescribed by the Director. A failure to submit the
				copy of the specification and any drawings of the previously filed application
				within the prescribed period shall result in application being regarded as
				abandoned and treated as having never been
				filed.</text>

			 to accept an unintentionally delayed claim for priority under the treaty and
			 the Regulations, and to accept a priority claim where such priority claim
			 pertains to an application that was not filed within the priority period
			 specified in the treaty and Regulations, but was filed within the additional
			 2-month period specified under section 119(a) or the treaty and
			 Regulations.”.</text>
					</paragraph></subsection><subsection id="idDE5B3D3B01E647D6878A95D907E89BD1"><enum>(d)</enum><header>Recordation of
			 ownership interests</header><text>Section 261 of title 35, United States Code,
			 is amended—</text>
					<paragraph id="ID5de1f3b626904fbb9eacc9e2695bac13"><enum>(1)</enum><text>in the first
			 undesignated paragraph by adding at the end the following: “The Patent and
			 Trademark Office shall maintain a register of interests in applications for
			 patents and patents and shall record any document related thereto upon request,
			 and may require a fee therefor.”; and</text>
					</paragraph><paragraph id="ID3fe90242e2e245e0bf8d86ad248f1351"><enum>(2)</enum><text>in the fourth
			 undesignated paragraph by striking <quote>An assignment</quote> and inserting
			 <quote>An interest that constitutes an assignment</quote>.</text>
					</paragraph></subsection></section><section id="id27A49727FD184BAA8BE3B4E692E20BF7"><enum>202.</enum><header>Conforming
			 amendments</header>
				<subsection id="id4FF31998B65A4228AE3752442484C380"><enum>(a)</enum><header>In
			 general</header><text>Section 171 of title 35, United States Code, is amended
			 by adding at the end the following:</text>

			 41—</text>
						<subparagraph id="id97C4B28022374BA6A83F66CCEF2B84DC"><enum>(A)</enum><text>in subsection (a),
			 by striking subsection (7) and inserting the following:</text>

				Director may accept the payment of any maintenance fee required by subsection
				(b) after the 6-month grace period if the delay is shown to the satisfaction of

				any maintenance fee after the 6-month grace period. If the Director accepts
				payment of a maintenance fee after the 6-month grace period, the patent shall
				be considered as not having expired at the end of the grace

				issue, but if payment is not timely made, the application shall be regarded as
				abandoned.</text>

					</paragraph><paragraph id="idAC83DF7E24F343D68ED7CEF6A7218372"><enum>(7)</enum><text>in section 361, by

			 <enum-in-header>201(a)</enum-in-header></header><text>The amendments made by
			 section 201(a) shall apply only to applications filed on or after the date that
			 is 1 year after the date of enactment of this Act.</text>
					</paragraph><paragraph id="id3732862CA9E6441EAC1C180877BC79FF"><enum>(2)</enum><header>Patent that is
			 subject of litigation</header><text>The amendments made by this title shall
			 have no effect with respect to any patent that is the subject of litigation in
			 an action commenced before the date that is 1 year after the date of enactment

										</paragraph><paragraph id="id89bed449-9dd5-48bf-94d1-1bd82db15257"><enum>(2)</enum><text>the term
				<term>regulations</term>—</text>
											<subparagraph id="idadfe7225-688c-44ce-be04-4d081a088ad4"><enum>(A)</enum><text>when capitalized, means
				the Common Regulations under the treaty; and</text>
											</subparagraph><subparagraph id="id1bb48a3a-8a6c-4b14-b5d4-2403030c8b28"><enum>(B)</enum><text>when not capitalized,
				means the regulations established by the Director under this title;</text>
											</subparagraph></paragraph><paragraph id="idecabf67f161d483f8995ab3f55c75247"><enum>(3)</enum><text>the terms
				<term>designation</term>, <term>designating</term>, and <term>designate</term>
				refer to a request that an international registration have effect in a
				Contracting Party to the treaty;</text>
										</paragraph><paragraph id="idc5933adf-174c-45a9-8a07-86e9954f3b90"><enum>(4)</enum><text>the term
				<term>International Bureau</term> means the international intergovernmental
				organization that is recognized as the coordinating body under the treaty and
				the Regulations;</text>
										</paragraph><paragraph id="id85160da1-3576-46bb-a944-0e65d441be55"><enum>(5)</enum><text>the term <term>effective
				registration date</term> means the date of international registration
				determined by the International Bureau under the treaty;</text>
										</paragraph><paragraph id="id2f983169-6a58-4c04-a505-3f2ef83f633a"><enum>(6)</enum><text>the term
				<term>international design application</term> means an application for
				international registration; and</text>
										</paragraph><paragraph id="id9c69d903-a52e-4b09-aa2b-8605f8f173bf"><enum>(7)</enum><text>the term
				<term>international registration</term> means the international registration of
				an industrial design filed under the treaty.</text>
										</paragraph></subsection><subsection id="id9e1ee89a-6d8d-4706-baaa-5e51b913916b"><enum>(b)</enum><header>Rule of
				construction</header><text>Terms and expressions not defined in this part are
				to be taken in the sense indicated by the treaty and the Regulations.</text>
									</subsection></section><section id="idb1e346e9-db9b-4f22-8b0e-55109f591447"><enum>382.</enum><header>Filing international
				design applications</header>
									<subsection id="idb4d3f324-4f83-4fe2-9714-fcadf8b8233a"><enum>(a)</enum><header>In
				general</header><text>Any person who is a national of the United States, or has
				a domicile, a habitual residence, or a real and effective industrial or
				commercial establishment in the United States, may file an international design
				application by submitting to the Patent and Trademark Office an application in
				such form, together with such fees, as may be prescribed by the
				Director.</text>
									</subsection><subsection id="ide07bf253-08c0-498d-818c-69521576025d"><enum>(b)</enum><header>Required
				action</header><text>The Patent and Trademark Office shall perform all acts
				connected with the discharge of its duties under the treaty, including the
				collection of international fees and transmittal thereof to the International
				Bureau. Subject to chapter 17, international design applications shall be
				forwarded by the Patent and Trademark Office to the International Bureau, upon
				payment of a transmittal fee.</text>
									</subsection><subsection id="idd77e10e3-dd47-41ac-919a-f9a451277fb7"><enum>(c)</enum><header>Applicability of
				chapter 16</header><text>Except as otherwise provided in this chapter, the
				provisions of chapter 16 shall apply.</text>
									</subsection><subsection id="id5b68f5d6-1226-4dd0-a9ef-1dab92958e3a"><enum>(d)</enum><header>Application filed in
				another country</header><text>An international design application on an
				industrial design made in this country shall be considered to constitute the
				filing of an application in a foreign country within the meaning of chapter 17
				if the international design application is filed—</text>
										<paragraph id="id2ed25ce6-6246-42ab-8ff2-5d7179d5d13d"><enum>(1)</enum><text>in a country other than
				the United States;</text>
										</paragraph><paragraph id="idf2244226-d331-42d3-988f-44e68d68e0d2"><enum>(2)</enum><text>at the International
				Bureau; or</text>
										</paragraph><paragraph id="idea2e5f82-50df-4478-a515-42f600adfc71"><enum>(3)</enum><text>with an intergovernmental
				organization.</text>
										</paragraph></subsection></section><section id="id61c62b03-dc6a-42d3-b26a-f0c721eddade"><enum>383.</enum><header>International design
				application</header><text display-inline="no-display-inline">In addition to any
				requirements pursuant to chapter 16, the international design application shall
				contain—</text>
									<paragraph id="id9eb1d120-7d2d-422a-b06c-4efc2c020b6a"><enum>(1)</enum><text>a request for
				international registration under the treaty;</text>
									</paragraph><paragraph id="id54a08214-8f3c-4728-8459-dff0a33b3d1a"><enum>(2)</enum><text>an indication of the
				designated Contracting Parties;</text>
									</paragraph><paragraph id="id8fe391ab-5314-41e3-bd53-1c0b9f41a839"><enum>(3)</enum><text>data concerning the
				applicant as prescribed in the treaty and the Regulations;</text>
									</paragraph><paragraph id="idbddeb513-d9ec-408e-bfd7-c1d6717345c3"><enum>(4)</enum><text>copies of a reproduction
				or, at the choice of the applicant, of several different reproductions of the
				industrial design that is the subject of the international design application,
				presented in the number and manner prescribed in the treaty and the
				Regulations;</text>
									</paragraph><paragraph id="id24238eae-924e-4e7e-a7e5-0d947a9af6bf"><enum>(5)</enum><text>an indication of the
				product or products that constitute the industrial design or in relation to
				which the industrial design is to be used, as prescribed in the treaty and the
				Regulations;</text>
									</paragraph><paragraph id="idbffef86c-ed14-4474-8e19-0847922aca3a"><enum>(6)</enum><text>the fees prescribed in
				the treaty and the Regulations; and</text>
									</paragraph><paragraph id="id492b91f7-af1f-439e-9f75-e1c52d01c107"><enum>(7)</enum><text>any other particulars
				prescribed in the Regulations.</text>
									</paragraph></section><section id="id37999a90-ee0c-4b6e-b332-f9f5f008aab5"><enum>384.</enum><header>Filing date</header>
									<subsection id="id1a320343-621c-46d7-9a53-b943ec863155"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b), the filing date of an
				international design application in the United States shall be the effective
				registration date. Notwithstanding the provisions of this part, any
				international design application designating the United States that otherwise
				meets the requirements of chapter 16 may be treated as a design application
				under chapter 16.</text>
									</subsection><subsection id="idc5e2424e-c2ec-40bd-8d0c-c2bcd7f02f7b"><enum>(b)</enum><header>Review</header><text>An
				applicant may request review by the Director of the filing date of the
				international design application in the United States. The Director may
				determine that the filing date of the international design application in the
				United States is a date other than the effective registration date. The
				Director may establish procedures, including the payment of a surcharge, to
				review the filing date under this section. Such review may result in a
				determination that the application has a filing date in the United States other
				than the effective registration date.</text>
									</subsection></section><section id="id7b12c399-0e87-454b-839e-e521cef99f9d"><enum>385.</enum><header>Effect of
				international design application</header><text display-inline="no-display-inline">An international design application
				designating the United States shall have the effect, for all purposes, from its
				filing date determined in accordance with section 384, of an application for
				patent filed in the Patent and Trademark Office pursuant to chapter 16.</text>
								</section><section id="id16ee2970-43e9-4853-ae2f-87cce7d530c6"><enum>386.</enum><header>Right of
				priority</header>
									<subsection id="idbfb8f810-6ef7-48af-964c-79ee178146aa"><enum>(a)</enum><header>National
				application</header><text>In accordance with the conditions and requirements of
				subsections (a) through (d) of section 119 and section 172, a national
				application shall be entitled to the right of priority based on a prior
				international design application that designated at least 1 country other than
				the United States.</text>
									</subsection><subsection id="id30ab5d1f-a2c7-46af-8d50-152a8dcad812"><enum>(b)</enum><header>Prior foreign
				application</header><text>In accordance with the conditions and requirements of
				subsections (a) through (d) of section 119 and section 172 and the treaty and
				the Regulations, an international design application designating the United
				States shall be entitled to the right of priority based on a prior foreign
				application, a prior international application as defined in section 351(c)
				designating at least 1 country other than the United States, or a prior
				international design application designating at least 1 country other than the
				United States.</text>
									</subsection><subsection id="id1c5e7514-4f23-4d71-a960-384d69197b7f"><enum>(c)</enum><header>Prior national
				application</header><text>In accordance with the conditions and requirements of
				section 120, an international design application designating the United States
				shall be entitled to the benefit of the filing date of a prior national
				application, a prior international application as defined in section 351(c)
				designating the United States, or a prior international design application
				designating the United States, and a national application shall be entitled to
				the benefit of the filing date of a prior international design application
				designating the United States. If any claim for the benefit of an earlier
				filing date is based on a prior international application as defined in section
				351(c) which designated but did not originate in the United States or a prior
				international design application which designated but did not originate in the
				United States, the Director may require the filing in the Patent and Trademark
				Office of a certified copy of such application together with a translation
				thereof into the English language, if it was filed in another language.</text>
									</subsection></section><section id="id58b25de7-b48e-4e34-a3ce-cc5d881dc204"><enum>387.</enum><header>Relief from prescribed
				time limits</header><text display-inline="no-display-inline">An applicant's
				failure to act within prescribed time limits in connection with requirements
				pertaining to an international design application may be excused as to the
				United States upon a showing satisfactory to the Director of unintentional
				delay and under such conditions, including a requirement for payment of the fee
				specified in section 41(a)(7), as may be prescribed by the Director.</text>
								</section><section id="ided51ad84-db93-487e-99eb-8e1d4becc694"><enum>388.</enum><header>Withdrawn or abandoned
				international design application</header><text display-inline="no-display-inline">Subject to sections 384 and 387, if an
				international design application designating the United States is withdrawn,
				renounced or canceled or considered withdrawn or abandoned, either generally or
				as to the United States, under the conditions of the treaty and the
				Regulations, the designation of the United States shall have no effect after
				the date of withdrawal, renunciation, cancellation, or abandonment and shall be
				considered as not having been made, unless a claim for benefit of a prior
				filing date under section 386(c) was made in a national application, or an
				international design application designating the United States, or a claim for
				benefit under section 365(c) was made in an international application
				designating the United States, filed before the date of such withdrawal,
				renunciation, cancellation, or abandonment. However, such withdrawn, renounced,
				canceled, or abandoned international design application may serve as the basis
				for a claim of priority under subsections (a) and (b) of section 386, or under
				subsection (a) or (b) of section 365, if it designated a country other than the
				United States.</text>
								</section><section id="idc14304b8-6b8d-4b4e-ade1-693f6936755c"><enum>389.</enum><header>Examination of
				international design application</header>
									<subsection id="idf8947da7-2fde-48d3-9816-d824cfba74e9"><enum>(a)</enum><header>In
				general</header><text>The Director shall cause an examination to be made
				pursuant to this title of an international design application designating the
				United States.</text>
									</subsection><subsection id="idbe24013b-a284-4f36-86df-7c62c844d3d9"><enum>(b)</enum><header>Applicability of
				chapter 16</header><text>All questions of substance and, unless otherwise
				required by the treaty and Regulations, procedures regarding an international
				design application designating the United States shall be determined as in the
				case of applications filed under chapter 16.</text>
									</subsection><subsection id="idb7cd3ef2-c3cd-4493-96f2-eecf90c8532b"><enum>(c)</enum><header>Fees</header><text>The
				Director may prescribe fees for filing international design applications, for
				designating the United States, and for any other processing, services, or
				materials relating to international design applications, and may provide for
				later payment of such fees, including surcharges for later submission of
				fees.</text>
									</subsection><subsection id="id833f4e95-851a-4090-8da1-0b80483a6533"><enum>(d)</enum><header>Issuance of
				patent</header><text>The Director may issue a patent based on an international
				design application designating the United States, in accordance with the
				provisions of this title. Such patent shall have the force and effect of a
				patent issued on an application filed under chapter 16.</text>
									</subsection></section><section id="idc2ed4637-d8ca-486a-b107-40335cccfcc3"><enum>390.</enum><header>Publication of
				international design application</header><text display-inline="no-display-inline">The publication under the treaty of an
				international design application designating the United States shall be deemed
				a publication under section
				122(b).</text>

				</subsection><subsection id="id6156be70-ae90-44c2-8b9c-6e334c7df474"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of parts at the beginning of title 35, United

					</subparagraph></paragraph></section><section id="id77c2ac77-4155-4ab1-a4ff-8a128a452e92"><enum>103.</enum><header>Effective
			 date</header>
				<subsection id="id01b55e7f-26cb-4155-8fa8-18fcd61919c4"><enum>(a)</enum><header>In
			 general</header><text>The amendments made by this title shall take effect on
			 the later of—</text>
					<paragraph id="id6fcd414ba01741c7bade2a41d84f9a60"><enum>(1)</enum><text>the date that is 1 year
			 after the date of the enactment of this Act; or</text>
					</paragraph><paragraph id="idfc882a1b7874434c9b0e795e7764b37b"><enum>(2)</enum><text>the date of entry into
			 force of the treaty with respect to the United States.</text>
					</paragraph></subsection><subsection id="idbd93cf79-1df4-40f6-9c89-2d783d9631b3"><enum>(b)</enum><header>Applicability of
			 amendments</header>
					<paragraph id="id8a35c4b6-b6d4-4069-9a6f-0273411f8622"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the amendments made by this
			 title shall apply only to international design applications, international
			 applications, and national applications filed on and after the effective date
			 set forth in subsection (a), and patents issuing thereon.</text>
					</paragraph><paragraph id="idaaac1733-3f17-426d-aaf3-856edbe21391"><enum>(2)</enum><header>Exception</header><text>Sections
			 100(i) and 102(d) of title 35, United States Code, as amended by this title,
			 shall not apply to an application, or any patent issuing thereon, unless it is
			 described in section 3(n)(1) of the Leahy-Smith America Invents Act (35 U.S.C.
			 100 note).</text>
					</paragraph></subsection><subsection id="ida94340515e2f4266805878c94942ec50"><enum>(c)</enum><header>Definitions</header><text>For
			 purposes of this section—</text>
					<paragraph id="idfadd41f3f3464f419cfd617a7696c657"><enum>(1)</enum><text>the terms
			 <term>treaty</term> and <term>international design application</term> have the
			 meanings given those terms in section 381 of title 35, United States Code, as
			 added by this title;</text>
					</paragraph><paragraph id="idc3f8f3df578c448ab2eec6aadbe890e0"><enum>(2)</enum><text>the term
			 <term>international application</term> has the meaning given that term in
			 section 351(c) of title 35, United States Code; and</text>
					</paragraph><paragraph id="id6bcaeadb83b0479fbdf9e95499a4c687"><enum>(3)</enum><text>the term <term>national
			 application</term> means <quote>national application</quote> within the meaning
			 of chapter 38 of title 35, United States Code, as added by this title.</text>

			 implementation</header>
			<section id="id449a35a6-f720-48a3-a3d9-23fbe49ebec4"><enum>201.</enum><header>Provisions to
			 implement the Patent Law Treaty</header>
				<subsection id="id3c41e357-7225-4fa7-900c-90c66881d15a"><enum>(a)</enum><header>Application filing
			 date</header><text>Section 111 of title 35, United States Code, is
			 amended—</text>
					<paragraph id="ide36a00b0-a971-44bd-91ca-6bd8eab54d12"><enum>(1)</enum><text>in subsection (a), by
			 striking paragraphs (3) and (4) and inserting the following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id9ce89a03-b289-4698-8c61-5910f262330e" reported-display-style="italic" style="OLC">

				under such conditions, including the payment of a surcharge, as may be
				prescribed by the Director. Upon failure to submit the fee, oath or
				declaration, and 1 or more claims within such prescribed period, the
				application shall be regarded as abandoned.</text>
							</paragraph><paragraph id="id92298f3f-c3f1-432a-8758-2e22d185fcf4"><enum>(4)</enum><header>Filing
				date</header><text>The filing date of an application shall be the date on which
				a specification, with or without claims, is received in the United States
				Patent and Trademark
				Office.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id1b1d6125-a251-4142-8b83-234497cbe489"><enum>(2)</enum><text>in subsection (b), by
			 striking paragraphs (3) and (4) and inserting the following:</text>

				submitted after the filing date of the application, within such period and
				under such conditions, including the payment of a surcharge, as may be
				prescribed by the Director. Upon failure to submit the fee within such
				prescribed period, the application shall be regarded as abandoned.</text>
							</paragraph><paragraph id="id5e172c95-01c5-4bf2-aecc-56ee715b3f53"><enum>(4)</enum><header>Filing
				date</header><text>The filing date of a provisional application shall be the
				date on which a specification, with or without claims, is received in the
				United States Patent and Trademark
				Office.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id8443f3fa-e0f4-4daf-beaf-f2a9b173f45e"><enum>(3)</enum><text>by adding at the end the
			 following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idCB5A9D329274421DA565F6B7512C2E24" reported-display-style="italic" style="OLC">
							<subsection id="id0faaf5c7-2253-429b-bd19-3ac4ea73b863"><enum>(c)</enum><header>Prior filed
				application</header><text>Notwithstanding the provisions of subsection (a), the
				Director may prescribe the conditions, including the payment of a surcharge,
				under which a reference made upon the filing of an application under subsection
				(a) to a previously filed application, specifying the previously filed
				application by application number and the intellectual property authority or
				country in which the application was filed, shall constitute the specification
				and any drawings of the subsequent application for purposes of a filing date. A
				copy of the specification and any drawings of the previously filed application
				shall be submitted within such period and under such conditions as may be
				prescribed by the Director. A failure to submit the copy of the specification
				and any drawings of the previously filed application within the prescribed
				period shall result in the application being regarded as abandoned. Such
				application shall be treated as having never been filed, unless—</text>
								<paragraph id="id5E5AF6F1352740CCAA7EA74E10ED9337"><enum>(1)</enum><text>the application is
				revived under section 27; and</text>
								</paragraph><paragraph id="idC652FBDBCC3F453A8D4BC57460588499"><enum>(2)</enum><text>a copy of the
				specification and any drawings of the previously filed application are
				submitted to the
				Director.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idab5de247-fd5f-49ff-a333-dbff80406d64"><enum>(b)</enum><header>Relief in respect of
			 time limits and reinstatement of rights</header>
					<paragraph id="id0eb64fe0-155a-4dfa-bbe5-6f689d8d7eb9"><enum>(1)</enum><header>In
			 general</header><text>Chapter 2 of title 35, United States Code, is amended by
			 adding at the end the following:</text>

				including the requirement for payment of the fee specified in section 41(a)(7),
				to revive an unintentionally abandoned application for patent, accept an
				unintentionally delayed payment of the fee for issuing each patent, or accept
				an unintentionally delayed response by the patent owner in a reexamination
				proceeding, upon petition by the applicant for patent or patent
				owner.</text>

					</paragraph><paragraph id="idb3dff9fc-f021-48d2-a01d-9dc5bc785978"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The table of sections for chapter 2 of title 35, United
			 States Code, is amended by adding at the end the following:</text>

						<subparagraph id="ida49a091b-e96e-4b7b-a209-8a1437c69bb0"><enum>(A)</enum><text>in subsection (a)—</text>
							<clause id="id1BFDF9C1699346FF9CA56E0AC113B2D9"><enum>(i)</enum><text>by striking
			 <quote>twelve</quote> and inserting <quote>12</quote>; and</text>
							</clause><clause id="idBCB07A28F310441194D78B3A50F1B4D5"><enum>(ii)</enum><text>by adding at the end the
			 following: “The Director may prescribe regulations, including the requirement
			 for payment of the fee specified in section 41(a)(7), pursuant to which the
			 12-month period set forth in this subsection may be extended by an additional 2
			 months if the delay in filing the application in this country within the
			 12-month period was unintentional.”; and</text>
							</clause></subparagraph><subparagraph id="id200cac1b-661a-4e41-8b4b-3b98e0075b5d"><enum>(B)</enum><text>in subsection (e)—</text>
							<clause id="id587e8af4-cc98-4c06-ae58-3090566d7a23"><enum>(i)</enum><text>in paragraph (1)—</text>
								<subclause id="id045554f9-5368-4d4e-9093-90469ad8ffa1"><enum>(I)</enum><text>by inserting after the
			 first sentence the following: “The Director may prescribe regulations,
			 including the requirement for payment of the fee specified in section 41(a)(7),
			 pursuant to which the 12-month period set forth in this subsection may be
			 extended by an additional 2 months if the delay in filing the application under
			 section 111(a) or section 363 within the 12-month period was unintentional.”;
			 and</text>
								</subclause><subclause id="id25d69745-f6a6-4df7-8d80-a5f76907f424"><enum>(II)</enum><text>in the last
			 sentence—</text>

			 shall be extended as provided under the treaty and Regulations as defined in
			 section 351.</quote>; and</text>
							</clause></subparagraph></paragraph><paragraph id="id54ecf430-576b-480c-a890-64739a3ef924"><enum>(2)</enum><text>in section 365(b), by
			 adding at the end the following: “The Director may establish procedures,
			 including the requirement for payment of the fee specified in section 41(a)(7),
			 to accept an unintentionally delayed claim for priority under the treaty and
			 the Regulations, and to accept a priority claim that pertains to an application
			 that was not filed within the priority period specified in the treaty and
			 Regulations, but was filed within the additional 2-month period specified under
			 section 119(a) or the treaty and Regulations.”.</text>
					</paragraph></subsection><subsection id="id457dd12e-3fa1-4004-8b5a-24d96fb47ad0"><enum>(d)</enum><header>Recordation of
			 ownership interests</header><text>Section 261 of title 35, United States Code,
			 is amended—</text>
					<paragraph id="ide8d1e987-15f7-4950-9d80-fb67b0a557ea"><enum>(1)</enum><text>in the first undesignated
			 paragraph by adding at the end the following: “The Patent and Trademark Office
			 shall maintain a register of interests in patents and applications for patents
			 and shall record any document related thereto upon request, and may require a
			 fee therefor.”; and</text>
					</paragraph><paragraph id="idde8c075c-82c1-4f59-b7d3-9fe7cb8cda40"><enum>(2)</enum><text>in the fourth
			 undesignated paragraph by striking <quote>An assignment</quote> and inserting
			 <quote>An interest that constitutes an assignment</quote>.</text>

						<subparagraph id="id71009039-ec22-44fd-b67b-405679a86714"><enum>(A)</enum><text>in subsection (a), by
			 striking paragraph (7) and inserting the following:</text>
							<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id2a66a2c3-c08d-4ebd-b33a-6dc33ab06ef6" reported-display-style="italic" style="OLC">

				extension of the 12-month period for filing a subsequent application,

				paragraph, in exceptional circumstances as determined by the

								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="id1ebbc80e-0553-4509-b5c1-29dab69a222f"><enum>(B)</enum><text>in subsection (c), by
			 striking paragraph (1) and inserting the following:</text>
							<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id0f6ad05e-68fe-4e70-88e2-3a4405e12e88" reported-display-style="italic" style="OLC">
								<paragraph id="id466d049e-fac1-4cd1-972c-23c3dafbcc14"><enum>(1)</enum><header>Acceptance</header><text>The
				Director may accept the payment of any maintenance fee required by subsection
				(b) after the 6-month grace period if the delay is shown to the satisfaction of
				the Director to have been unintentional. The Director may require the payment
				of the fee specified in subsection (a)(7) as a condition of accepting payment
				of any maintenance fee after the 6-month grace period. If the Director accepts
				payment of a maintenance fee after the 6-month grace period, the patent shall
				be considered as not having expired at the end of the grace
				period.</text>
								</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="id97e17942-b3e7-4d2c-b790-93fa543c03ba"><enum>(2)</enum><text>in section 119(b)(2), in
			 the second sentence, by striking <quote>including the payment of a
			 surcharge</quote> and inserting <quote>including the requirement for payment of
			 the fee specified in section 41(a)(7)</quote>;</text>

				applicant is entitled to a patent under the law, a written notice of allowance
				of the application shall be given or mailed to the applicant. The notice shall
				specify a sum, constituting the issue fee and any required publication fee,
				which shall be paid within 3 months thereafter.</text>
								</subsection><subsection id="id11F6FA539D654D39BA641CA082500F91"><enum>(b)</enum><header>Effect of
				payment</header><text display-inline="yes-display-inline">Upon payment of this
				sum the patent may issue, but if payment is not timely made, the application
				shall be regarded as
				abandoned.</text>
								</subsection></section><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id2dac06d3-022b-474f-bd11-f5caae87621c"><enum>(7)</enum><text>in section 361, by
			 striking subsection (c) and inserting the following:</text>

			 third sentence, by striking <quote>, unless it be shown to the satisfaction of
			 the Director that such failure to comply was unavoidable</quote>.</text>
					</paragraph></subsection></section><section id="ida0a5ca42-67a5-4466-b9b1-c786a3724807"><enum>203.</enum><header>Effective
			 date</header>
				<subsection id="id8cf3ea4cfa80443db285501ad4e290e6"><enum>(a)</enum><header>In
			 general</header><text>The amendments made by this title—</text>
					<paragraph id="id64b3b5a99c8543b38b90fa3e95095741"><enum>(1)</enum><text>shall take effect on the
			 date that is 1 year after the date of the enactment of this Act; and</text>
					</paragraph><paragraph id="id58a31ec9d6544a37b1b38d0d9dd27f98"><enum>(2)</enum><text>shall apply to—</text>
						<subparagraph id="id84a7e3ed43904a519576ee937d796686"><enum>(A)</enum><text>any patent issued before,
			 on, or after the effective date set forth in paragraph (1); and</text>
						</subparagraph><subparagraph id="id5a19ef8d34f6424cba55b744c41a2ab7"><enum>(B)</enum><text>any application for
			 patent that is pending on or filed after the effective date set forth in
			 paragraph (1).</text>
						</subparagraph></paragraph></subsection><subsection id="idcaca656953d54571a330dc0a2376c438"><enum>(b)</enum><header>Exceptions</header>
					<paragraph id="id83295dee3cbf41699d1d4cfdbf9275c2"><enum>(1)</enum><header>Section
			 201<enum-in-header>(a)</enum-in-header></header><text>The amendments made by
			 section 201(a) shall apply only to applications that are filed on or after the
			 effective date set forth in subsection (a)(1).</text>
					</paragraph><paragraph id="id6f1e0637a73f4962901f6ea02f4b1284"><enum>(2)</enum><header>Patents in
			 litigation</header><text>The amendments made by this title shall have no effect
			 with respect to any patent that is the subject of litigation in an action
			 commenced before the effective date set forth in subsection (a)(1).</text>
