									<subsection commented="no" display-inline="no-display-inline" id="idc3dd8667-da3e-43e3-95b5-f99eab850f3d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">When used in this part, unless the context
				otherwise indicates—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="id37ddc51e-1618-4de9-b9d3-90241eb8d764"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>treaty</term> means the
				Geneva Act of the Hague Agreement Concerning the International Registration of
				Industrial Designs adopted at Geneva on July 2, 1999;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89bed449-9dd5-48bf-94d1-1bd82db15257"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>regulations</term>—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="idadfe7225-688c-44ce-be04-4d081a088ad4"><enum>(A)</enum><text display-inline="yes-display-inline">when capitalized, means the Common
				Regulations under the treaty; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1bb48a3a-8a6c-4b14-b5d4-2403030c8b28"><enum>(B)</enum><text display-inline="yes-display-inline">when not capitalized, means the regulations
				established by the Director under this title;</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idecabf67f161d483f8995ab3f55c75247"><enum>(3)</enum><text display-inline="yes-display-inline">the terms <term>designation</term>,
				<term>designating</term>, and <term>designate</term> refer to a request that an
				international registration have effect in a Contracting Party to the
				treaty;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc5933adf-174c-45a9-8a07-86e9954f3b90"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>International Bureau</term>
				means the international intergovernmental organization that is recognized as
				the coordinating body under the treaty and the Regulations;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85160da1-3576-46bb-a944-0e65d441be55"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>effective registration
				date</term> means the date of international registration determined by the
				International Bureau under the treaty;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2f983169-6a58-4c04-a505-3f2ef83f633a"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>international design
				application</term> means an application for international registration;
				and</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c69d903-a52e-4b09-aa2b-8605f8f173bf"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>international
				registration</term> means the international registration of an industrial
				design filed under the treaty.</text>
										</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9e1ee89a-6d8d-4706-baaa-5e51b913916b"><enum>(b)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Terms and expressions not defined in this
				part are to be taken in the sense indicated by the treaty and the
				Regulations.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="idb1e346e9-db9b-4f22-8b0e-55109f591447" section-type="subsequent-section"><enum>382.</enum><header display-inline="yes-display-inline">Filing international design
				applications</header>
									<subsection commented="no" display-inline="no-display-inline" id="idb4d3f324-4f83-4fe2-9714-fcadf8b8233a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any person who is a national of the United
				States, or has a domicile, a habitual residence, or a real and effective
				industrial or commercial establishment in the United States, may file an
				international design application by submitting to the Patent and Trademark
				Office an application in such form, together with such fees, as may be
				prescribed by the Director.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="ide07bf253-08c0-498d-818c-69521576025d"><enum>(b)</enum><header display-inline="yes-display-inline">Required action</header><text display-inline="yes-display-inline">The Patent and Trademark Office shall
				perform all acts connected with the discharge of its duties under the treaty,
				including the collection of international fees and transmittal thereof to the
				International Bureau. Subject to chapter 17, international design applications
				shall be forwarded by the Patent and Trademark Office to the International
				Bureau, upon payment of a transmittal fee.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="idd77e10e3-dd47-41ac-919a-f9a451277fb7"><enum>(c)</enum><header display-inline="yes-display-inline">Applicability of chapter 16</header><text display-inline="yes-display-inline">Except as otherwise provided in this
				chapter, the provisions of chapter 16 shall apply.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="id5b68f5d6-1226-4dd0-a9ef-1dab92958e3a"><enum>(d)</enum><header display-inline="yes-display-inline">Application filed in another
				country</header><text display-inline="yes-display-inline">An international
				design application on an industrial design made in this country shall be
				considered to constitute the filing of an application in a foreign country
				within the meaning of chapter 17 if the international design application is
				filed—</text>
										<paragraph commented="no" display-inline="no-display-inline" id="id2ed25ce6-6246-42ab-8ff2-5d7179d5d13d"><enum>(1)</enum><text display-inline="yes-display-inline">in a country other than the United
				States;</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf2244226-d331-42d3-988f-44e68d68e0d2"><enum>(2)</enum><text display-inline="yes-display-inline">at the International Bureau; or</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea2e5f82-50df-4478-a515-42f600adfc71"><enum>(3)</enum><text display-inline="yes-display-inline">with an intergovernmental
				organization.</text>
										</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id61c62b03-dc6a-42d3-b26a-f0c721eddade" section-type="subsequent-section"><enum>383.</enum><header display-inline="yes-display-inline">International design
				application</header><text display-inline="no-display-inline">In addition to any
				requirements pursuant to chapter 16, the international design application shall
				contain—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id9eb1d120-7d2d-422a-b06c-4efc2c020b6a"><enum>(1)</enum><text display-inline="yes-display-inline">a request for international registration
				under the treaty;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54a08214-8f3c-4728-8459-dff0a33b3d1a"><enum>(2)</enum><text display-inline="yes-display-inline">an indication of the designated Contracting
				Parties;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8fe391ab-5314-41e3-bd53-1c0b9f41a839"><enum>(3)</enum><text display-inline="yes-display-inline">data concerning the applicant as prescribed
				in the treaty and the Regulations;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbddeb513-d9ec-408e-bfd7-c1d6717345c3"><enum>(4)</enum><text display-inline="yes-display-inline">copies of a reproduction or, at the choice
				of the applicant, of several different reproductions of the industrial design
				that is the subject of the international design application, presented in the
				number and manner prescribed in the treaty and the Regulations;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24238eae-924e-4e7e-a7e5-0d947a9af6bf"><enum>(5)</enum><text display-inline="yes-display-inline">an indication of the product or products
				that constitute the industrial design or in relation to which the industrial
				design is to be used, as prescribed in the treaty and the Regulations;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbffef86c-ed14-4474-8e19-0847922aca3a"><enum>(6)</enum><text display-inline="yes-display-inline">the fees prescribed in the treaty and the
				Regulations; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id492b91f7-af1f-439e-9f75-e1c52d01c107"><enum>(7)</enum><text display-inline="yes-display-inline">any other particulars prescribed in the
				Regulations.</text>
									</paragraph></section><section commented="no" display-inline="no-display-inline" id="id37999a90-ee0c-4b6e-b332-f9f5f008aab5" section-type="subsequent-section"><enum>384.</enum><header display-inline="yes-display-inline">Filing date</header>
									<subsection commented="no" display-inline="no-display-inline" id="id1a320343-621c-46d7-9a53-b943ec863155"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (b), the filing date
				of an international design application in the United States shall be the
				effective registration date. Notwithstanding the provisions of this part, any
				international design application designating the United States that otherwise
				meets the requirements of chapter 16 may be treated as a design application
				under chapter 16.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="idc5e2424e-c2ec-40bd-8d0c-c2bcd7f02f7b"><enum>(b)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">An applicant may request review by the
				Director of the filing date of the international design application in the
				United States. The Director may determine that the filing date of the
				international design application in the United States is a date other than the
				effective registration date. The Director may establish procedures, including
				the payment of a surcharge, to review the filing date under this section. Such
				review may result in a determination that the application has a filing date in
				the United States other than the effective registration date.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="id7b12c399-0e87-454b-839e-e521cef99f9d" section-type="subsequent-section"><enum>385.</enum><header display-inline="yes-display-inline">Effect of international design
				application</header><text display-inline="no-display-inline">An international
				design application designating the United States shall have the effect, for all
				purposes, from its filing date determined in accordance with section 384, of an
				application for patent filed in the Patent and Trademark Office pursuant to
				chapter 16.</text>
								</section><section commented="no" display-inline="no-display-inline" id="id16ee2970-43e9-4853-ae2f-87cce7d530c6" section-type="subsequent-section"><enum>386.</enum><header display-inline="yes-display-inline">Right of priority</header>
									<subsection commented="no" display-inline="no-display-inline" id="idbfb8f810-6ef7-48af-964c-79ee178146aa"><enum>(a)</enum><header display-inline="yes-display-inline">National application</header><text display-inline="yes-display-inline">In accordance with the conditions and
				requirements of subsections (a) through (d) of section 119 and section 172, a
				national application shall be entitled to the right of priority based on a
				prior international design application that designated at least 1 country other
				than the United States.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="id30ab5d1f-a2c7-46af-8d50-152a8dcad812"><enum>(b)</enum><header display-inline="yes-display-inline">Prior foreign application</header><text display-inline="yes-display-inline">In accordance with the conditions and
				requirements of subsections (a) through (d) of section 119 and section 172 and
				the treaty and the Regulations, an international design application designating
				the United States shall be entitled to the right of priority based on a prior
				foreign application, a prior international application as defined in section
				351(c) designating at least 1 country other than the United States, or a prior
				international design application designating at least 1 country other than the
				United States.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="id1c5e7514-4f23-4d71-a960-384d69197b7f"><enum>(c)</enum><header display-inline="yes-display-inline">Prior national application</header><text display-inline="yes-display-inline">In accordance with the conditions and
				requirements of section 120, an international design application designating
				the United States shall be entitled to the benefit of the filing date of a
				prior national application, a prior international application as defined in
				section 351(c) designating the United States, or a prior international design
				application designating the United States, and a national application shall be
				entitled to the benefit of the filing date of a prior international design
				application designating the United States. If any claim for the benefit of an
				earlier filing date is based on a prior international application as defined in
				section 351(c) which designated but did not originate in the United States or a
				prior international design application which designated but did not originate
				in the United States, the Director may require the filing in the Patent and
				Trademark Office of a certified copy of such application together with a
				translation thereof into the English language, if it was filed in another
				language.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="id58b25de7-b48e-4e34-a3ce-cc5d881dc204" section-type="subsequent-section"><enum>387.</enum><header display-inline="yes-display-inline">Relief from prescribed time
				limits</header><text display-inline="no-display-inline">An applicant's failure
				to act within prescribed time limits in connection with requirements pertaining
				to an international design application may be excused as to the United States
				upon a showing satisfactory to the Director of unintentional delay and under
				such conditions, including a requirement for payment of the fee specified in
				section 41(a)(7), as may be prescribed by the Director.</text>
								</section><section commented="no" display-inline="no-display-inline" id="ided51ad84-db93-487e-99eb-8e1d4becc694" section-type="subsequent-section"><enum>388.</enum><header display-inline="yes-display-inline">Withdrawn or abandoned international design
				application</header><text display-inline="no-display-inline">Subject to
				sections 384 and 387, if an international design application designating the
				United States is withdrawn, renounced or canceled or considered withdrawn or
				abandoned, either generally or as to the United States, under the conditions of
				the treaty and the Regulations, the designation of the United States shall have
				no effect after the date of withdrawal, renunciation, cancellation, or
				abandonment and shall be considered as not having been made, unless a claim for
				benefit of a prior filing date under section 386(c) was made in a national
				application, or an international design application designating the United
				States, or a claim for benefit under section 365(c) was made in an
				international application designating the United States, filed before the date
				of such withdrawal, renunciation, cancellation, or abandonment. However, such
				withdrawn, renounced, canceled, or abandoned international design application
				may serve as the basis for a claim of priority under subsections (a) and (b) of
				section 386, or under subsection (a) or (b) of section 365, if it designated a
				country other than the United States.</text>
								</section><section commented="no" display-inline="no-display-inline" id="idc14304b8-6b8d-4b4e-ade1-693f6936755c" section-type="subsequent-section"><enum>389.</enum><header display-inline="yes-display-inline">Examination of international design
				application</header>
									<subsection commented="no" display-inline="no-display-inline" id="idf8947da7-2fde-48d3-9816-d824cfba74e9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director shall cause an examination to
				be made pursuant to this title of an international design application
				designating the United States.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="idbe24013b-a284-4f36-86df-7c62c844d3d9"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability of chapter 16</header><text display-inline="yes-display-inline">All questions of substance and, unless
				otherwise required by the treaty and Regulations, procedures regarding an
				international design application designating the United States shall be
				determined as in the case of applications filed under chapter 16.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="idb7cd3ef2-c3cd-4493-96f2-eecf90c8532b"><enum>(c)</enum><header display-inline="yes-display-inline">Fees</header><text display-inline="yes-display-inline">The Director may prescribe fees for filing
				international design applications, for designating the United States, and for
				any other processing, services, or materials relating to international design
				applications, and may provide for later payment of such fees, including
				surcharges for later submission of fees.</text>
									</subsection><subsection commented="no" display-inline="no-display-inline" id="id833f4e95-851a-4090-8da1-0b80483a6533"><enum>(d)</enum><header display-inline="yes-display-inline">Issuance of patent</header><text display-inline="yes-display-inline">The Director may issue a patent based on an
				international design application designating the United States, in accordance
				with the provisions of this title. Such patent shall have the force and effect
				of a patent issued on an application filed under chapter 16.</text>
									</subsection></section><section commented="no" display-inline="no-display-inline" id="idc2ed4637-d8ca-486a-b107-40335cccfcc3" section-type="subsequent-section"><enum>390.</enum><header display-inline="yes-display-inline">Publication of international design
				application</header><text display-inline="no-display-inline">The publication
				under the treaty of an international design application designating the United
				States shall be deemed a publication under section
				122(b).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id6156be70-ae90-44c2-8b9c-6e334c7df474"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of parts at the beginning of
			 title 35, United States Code, is amended by adding at the end the
			 following:</text>

			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idc2a5c618-0332-4fb8-8262-92f3132fbac8"><enum>(1)</enum><text display-inline="yes-display-inline">in section 100(i)(1)(B) (as amended by the
			 Leahy-Smith America Invents Act (Public Law 112–29; 125 Stat. 284)), by
			 striking <quote>right of priority under section 119, 365(a), or 365(b) or to
			 the benefit of an earlier filing date under section 120, 121, or 365(c)</quote>
			 and inserting <quote>right of priority under section 119, 365(a), 365(b),
			 386(a), or 386(b) or to the benefit of an earlier filing date under section
			 120, 121, 365(c), or 386(c)</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd6806d7-81d5-48f0-a992-48488568a661"><enum>(2)</enum><text display-inline="yes-display-inline">in section 102(d)(2) (as amended by the

				<subsection commented="no" display-inline="no-display-inline" id="id01b55e7f-26cb-4155-8fa8-18fcd61919c4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The amendments made by this title shall
			 take effect on the later of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id6fcd414ba01741c7bade2a41d84f9a60"><enum>(1)</enum><text display-inline="yes-display-inline">the date that is 1 year after the date of
			 the enactment of this Act; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc882a1b7874434c9b0e795e7764b37b"><enum>(2)</enum><text display-inline="yes-display-inline">the date of entry into force of the treaty
			 with respect to the United States.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbd93cf79-1df4-40f6-9c89-2d783d9631b3"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability of amendments</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id8a35c4b6-b6d4-4069-9a6f-0273411f8622"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the amendments
			 made by this title shall apply only to international design applications,
			 international applications, and national applications filed on and after the
			 effective date set forth in subsection (a), and patents issuing thereon.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaaac1733-3f17-426d-aaf3-856edbe21391"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Sections 100(i) and 102(d) of title 35,
			 United States Code, as amended by this title, shall not apply to an
			 application, or any patent issuing thereon, unless it is described in section
			 3(n)(1) of the Leahy-Smith America Invents Act (35 U.S.C. 100 note).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida94340515e2f4266805878c94942ec50"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idfadd41f3f3464f419cfd617a7696c657"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>treaty</term> and
			 <term>international design application</term> have the meanings given those
			 terms in section 381 of title 35, United States Code, as added by this
			 title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3f8f3df578c448ab2eec6aadbe890e0"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>international
			 application</term> has the meaning given that term in section 351(c) of title
			 35, United States Code; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6bcaeadb83b0479fbdf9e95499a4c687"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>national application</term>
			 means <quote>national application</quote> within the meaning of chapter 38 of
			 title 35, United States Code, as added by this title.</text>
					</paragraph></subsection></section></title><title commented="no" id="id20fee6be-dbfd-4f99-8094-be2b3fbc0c14" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Patent Law Treaty implementation</header>
			<section commented="no" display-inline="no-display-inline" id="id449a35a6-f720-48a3-a3d9-23fbe49ebec4" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Provisions to implement the Patent Law
			 Treaty</header>
				<subsection commented="no" display-inline="no-display-inline" id="id3c41e357-7225-4fa7-900c-90c66881d15a"><enum>(a)</enum><header display-inline="yes-display-inline">Application filing date</header><text display-inline="yes-display-inline">Section 111 of title 35, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ide36a00b0-a971-44bd-91ca-6bd8eab54d12"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking paragraphs
			 (3) and (4) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id9ce89a03-b289-4698-8c61-5910f262330e" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="idb2f5a6fb-9b99-4ed5-a2f4-38982493fd7e"><enum>(3)</enum><header display-inline="yes-display-inline">Fee, oath or declaration, and
				claims</header><text display-inline="yes-display-inline">The application shall
				be accompanied by the fee required by law. The fee, oath or declaration, and 1
				or more claims may be submitted after the filing date of the application,
				within such period and under such conditions, including the payment of a
				surcharge, as may be prescribed by the Director. Upon failure to submit the
				fee, oath or declaration, and 1 or more claims within such prescribed period,
				the application shall be regarded as abandoned.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92298f3f-c3f1-432a-8758-2e22d185fcf4"><enum>(4)</enum><header display-inline="yes-display-inline">Filing date</header><text display-inline="yes-display-inline">The filing date of an application shall be
				the date on which a specification, with or without claims, is received in the
				United States Patent and Trademark
				Office.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b1d6125-a251-4142-8b83-234497cbe489"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking paragraphs
			 (3) and (4) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id32e365fa-9c0d-4ad8-bc38-3d10ccb8421a" style="OLC">

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8443f3fa-e0f4-4daf-beaf-f2a9b173f45e"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idCB5A9D329274421DA565F6B7512C2E24" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id0faaf5c7-2253-429b-bd19-3ac4ea73b863"><enum>(c)</enum><header display-inline="yes-display-inline">Prior filed application</header><text display-inline="yes-display-inline">Notwithstanding the provisions of
				subsection (a), the Director may prescribe the conditions, including the
				payment of a surcharge, under which a reference made upon the filing of an
				application under subsection (a) to a previously filed application, specifying
				the previously filed application by application number and the intellectual
				property authority or country in which the application was filed, shall
				constitute the specification and any drawings of the subsequent application for
				purposes of a filing date. A copy of the specification and any drawings of the
				previously filed application shall be submitted within such period and under
				such conditions as may be prescribed by the Director. A failure to submit the
				copy of the specification and any drawings of the previously filed application
				within the prescribed period shall result in the application being regarded as
				abandoned. Such application shall be treated as having never been filed,
				unless—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id5E5AF6F1352740CCAA7EA74E10ED9337"><enum>(1)</enum><text display-inline="yes-display-inline">the application is revived under section
				27; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC652FBDBCC3F453A8D4BC57460588499"><enum>(2)</enum><text display-inline="yes-display-inline">a copy of the specification and any
				drawings of the previously filed application are submitted to the
				Director.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idab5de247-fd5f-49ff-a333-dbff80406d64"><enum>(b)</enum><header display-inline="yes-display-inline">Relief in respect of time limits and
			 reinstatement of rights</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id0eb64fe0-155a-4dfa-bbe5-6f689d8d7eb9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 2 of title 35, United States Code,
			 is amended by adding at the end the following:</text>

				for issuing each patent, or accept an unintentionally delayed response by the
				patent owner in a reexamination proceeding, upon petition by the applicant for
				patent or patent

								<paragraph commented="no" display-inline="no-display-inline" id="id253fcaac-e3d2-4254-92c1-7eb095887f0e"><enum>(7)</enum><header display-inline="yes-display-inline">Revival fees</header><text display-inline="yes-display-inline">On filing each petition for the revival of
				an abandoned application for a patent, for the delayed payment of the fee for
				issuing each patent, for the delayed response by the patent owner in any
				reexamination proceeding, for the delayed payment of the fee for maintaining a
				patent in force, for the delayed submission of a priority or benefit claim, or
				for the extension of the 12-month period for filing a subsequent application,
				$1,700.00. The Director may refund any part of the fee specified in this
				paragraph, in exceptional circumstances as determined by the
				Director</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ebbc80e-0553-4509-b5c1-29dab69a222f"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c), by striking paragraph
			 (1) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id0f6ad05e-68fe-4e70-88e2-3a4405e12e88" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="id466d049e-fac1-4cd1-972c-23c3dafbcc14"><enum>(1)</enum><header display-inline="yes-display-inline">Acceptance</header><text display-inline="yes-display-inline">The Director may accept the payment of any
				maintenance fee required by subsection (b) after the 6-month grace period if
				the delay is shown to the satisfaction of the Director to have been
				unintentional. The Director may require the payment of the fee specified in
				subsection (a)(7) as a condition of accepting payment of any maintenance fee
				after the 6-month grace period. If the Director accepts payment of a
				maintenance fee after the 6-month grace period, the patent shall be considered
				as not having expired at the end of the grace
				period.</text>
								</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97e17942-b3e7-4d2c-b790-93fa543c03ba"><enum>(2)</enum><text display-inline="yes-display-inline">in section 119(b)(2), in the second
			 sentence, by striking <quote>including the payment of a surcharge</quote> and
			 inserting <quote>including the requirement for payment of the fee specified in
			 section 41(a)(7)</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc0233ee7-f309-4440-b93e-fdcc81314843"><enum>(3)</enum><text display-inline="yes-display-inline">in section 120, in the fourth sentence, by
			 striking <quote>including the payment of a surcharge</quote> and inserting
			 <quote>including the requirement for payment of the fee specified in section
			 41(a)(7)</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide40db17f-08a3-40eb-9469-3ab15f506996"><enum>(4)</enum><text display-inline="yes-display-inline">in section 122(b)(2)(B)(iii), in the second
			 sentence, by striking <quote>, unless it is shown</quote> and all that follows
			 through <quote>unintentional</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36819bb6-5ce3-49dd-9780-4a9ef5b7b24a"><enum>(5)</enum><text display-inline="yes-display-inline">in section 133, by striking <quote>, unless
			 it be shown</quote> and all that follows through
			 <quote>unavoidable</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id384c3a8c-a2c6-49aa-8e09-f7f0b4af060d"><enum>(6)</enum><text display-inline="yes-display-inline">by striking section 151 and inserting the
			 following:</text>

							<section commented="no" display-inline="no-display-inline" id="id93ec4e65-7297-407e-8107-58eb309e39bc" section-type="subsequent-section"><enum>151.</enum><header display-inline="yes-display-inline">Issue of patent</header>
								<subsection commented="no" display-inline="no-display-inline" id="id6F0CBF40AF2D425D9B1481590DC76517"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If it appears that an applicant is entitled
				to a patent under the law, a written notice of allowance of the application
				shall be given or mailed to the applicant. The notice shall specify a sum,
				constituting the issue fee and any required publication fee, which shall be
				paid within 3 months thereafter.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id11F6FA539D654D39BA641CA082500F91"><enum>(b)</enum><header display-inline="yes-display-inline">Effect of payment</header><text display-inline="yes-display-inline">Upon payment of this sum the patent may
				issue, but if payment is not timely made, the application shall be regarded as
				abandoned.</text>
								</subsection></section><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2dac06d3-022b-474f-bd11-f5caae87621c"><enum>(7)</enum><text display-inline="yes-display-inline">in section 361, by striking subsection (c)
			 and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id4247bac6-e1dc-43a5-ba8e-ef3974b6e9da" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id9fb73df3-5652-4ee0-8300-c96275d9118b"><enum>(c)</enum><text display-inline="yes-display-inline">International applications filed in the
				Patent and Trademark Office shall be filed in the English language, or an
				English translation shall be filed within such later time as may be fixed by
				the
				Director.</text>
							</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddad4f2f6-8ac8-4b87-8e73-68529ef7c87f"><enum>(8)</enum><text display-inline="yes-display-inline">in section 364, by striking subsection (b)
			 and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idf13abede-72f6-4735-8cdb-c114863199c0" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id6b0ca37e-7571-4fe7-b4b9-aea511f172e0"><enum>(b)</enum><text display-inline="yes-display-inline">An applicant's failure to act within
				prescribed time limits in connection with requirements pertaining to an
				international application may be excused as provided in the treaty and the
				Regulations.</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae134f4f-d9ac-4915-9f91-68c8ee6ece88"><enum>(9)</enum><text display-inline="yes-display-inline">in section 371(d), in the third sentence,
			 by striking <quote>, unless it be shown to the satisfaction of the Director
			 that such failure to comply was unavoidable</quote>.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ida0a5ca42-67a5-4466-b9b1-c786a3724807" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Effective date</header>
				<subsection commented="no" display-inline="no-display-inline" id="id8cf3ea4cfa80443db285501ad4e290e6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The amendments made by this title—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id64b3b5a99c8543b38b90fa3e95095741"><enum>(1)</enum><text display-inline="yes-display-inline">shall take effect on the date that is 1
			 year after the date of the enactment of this Act; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58a31ec9d6544a37b1b38d0d9dd27f98"><enum>(2)</enum><text display-inline="yes-display-inline">shall apply to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id84a7e3ed43904a519576ee937d796686"><enum>(A)</enum><text display-inline="yes-display-inline">any patent issued before, on, or after the
			 effective date set forth in paragraph (1); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a19ef8d34f6424cba55b744c41a2ab7"><enum>(B)</enum><text display-inline="yes-display-inline">any application for patent that is pending
			 on or filed after the effective date set forth in paragraph (1).</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcaca656953d54571a330dc0a2376c438"><enum>(b)</enum><header display-inline="yes-display-inline">Exceptions</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id83295dee3cbf41699d1d4cfdbf9275c2"><enum>(1)</enum><header display-inline="yes-display-inline">Section
			 201<enum-in-header>(a)</enum-in-header></header><text display-inline="yes-display-inline">The amendments made by section 201(a) shall
			 apply only to applications that are filed on or after the effective date set
			 forth in subsection (a)(1).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f1e0637a73f4962901f6ea02f4b1284"><enum>(2)</enum><header display-inline="yes-display-inline">Patents in litigation</header><text display-inline="yes-display-inline">The amendments made by this title shall
			 have no effect with respect to any patent that is the subject of litigation in
			 an action commenced before the effective date set forth in subsection
			 (a)(1).</text>
