		<official-title>To appropriately limit the authority to award bonuses to
		  employees and to require approval of high cost Government conferences and
		  reporting regarding Government conferences. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Stop Wasteful Federal Bonuses and
			 Conferences Act of 2012</short-title></quote>.</text>
		</section><section id="id8A35DE33FB2F41EDAA3A143DA62450FB" section-type="subsequent-section"><enum>2.</enum><header>Bonuses</header>
			<subsection id="id25B3BC0870164196A594634B8E2F6F12"><enum>(a)</enum><header>Adverse
			 findings and employees under investigation</header><text>Chapter 45 of title 5,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9C40B3271F98432DA107B9BB3427FBA6" style="USC">
					<subchapter id="id1185D2F7C7D7491EA93A6A063125DE59"><enum>IV</enum><header>Limitations on
				bonus authority</header>
						<section id="id9C3FFA6BC068416EA2DB8DBF8BA46AE5"><enum>4531.</enum><header>Certain forms
				of misconduct</header>
							<subsection id="idA7C14A88C23A4B328718F290555EB3C7"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
								<paragraph id="idB9EA59D3B3544730B701EEC9C109AC4A"><enum>(1)</enum><text>the term
				<term>adverse finding</term> relating to a employee means a determination that
				the conduct of the employee resulted in fraud, waste, abuse, or a violation of
				contracting requirements;</text>
								</paragraph><paragraph id="id87C370877CF240A68B57E041F3891DFC"><enum>(2)</enum><text>the term
				<term>agency</term> has the meaning given that term under section 551;
				and</text>
								</paragraph><paragraph id="idF9DE7717ACF1404BAC74EA4435150242"><enum>(3)</enum><text>the term
				<term>bonus</term> means any bonus or cash award, including—</text>
									<subparagraph id="id81B8131166CC4C34A9FE8A25B6CDACB2"><enum>(A)</enum><text>an award under
				this chapter;</text>
									</subparagraph><subparagraph id="id30305572E9124DF6B443D24C1634D7EC"><enum>(B)</enum><text>an award under
				section 5384; and</text>
									</subparagraph><subparagraph id="id394E1472EF4F4C7DB491058F9FB1C1F8"><enum>(C)</enum><text>a retention bonus
				under section 5754.</text>
									</subparagraph></paragraph></subsection><subsection id="id7091BF96005249A7BC5637EE0D2E7ABC"><enum>(b)</enum><header>Adverse
				findings</header>
								<paragraph id="idDBC2857E483943F094123AA96F36AF81"><enum>(1)</enum><header>In
				general</header><text>The head of an agency shall not award a bonus to an
				employee of the agency until 2 years after the end of the fiscal year in which
				the Inspector General of the agency or the Comptroller General of the United
				States makes an adverse finding relating to the employee.</text>
								</paragraph><paragraph id="id296BDB3BAF9B4572B4150016C2734D45"><enum>(2)</enum><header>Previously
				awarded bonuses</header><text>If the Inspector General of an agency or the
				Comptroller General of the United States makes an adverse finding relating to
				an employee, the head of the agency employing the employee, after notice and an
				opportunity for a hearing, may issue an order directing the employee to repay
				the amount of any bonus awarded to the employee during the year during which
				the adverse finding is
				made.</text>
								</paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idDF5335A5AC094A868178E90FBB589EBF"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 45 of
			 title 5, United States Code, is amended by adding at the end the
			 following:</text>

			</subsection></section><section id="idAEA3A3766F594909BA598E66C397D48C" section-type="subsequent-section"><enum>3.</enum><header>Government
			 conferences</header>
			<subsection id="id26F4DF63050A433D8172D52F9E3EA6AD"><enum>(a)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="id413B0A057DD74E91A9F355E29EF839E8"><enum>(1)</enum><text>the term
			 <term>agency</term> has the meaning given that term under section 551 of title
			 5, United States Code;</text>
				</paragraph><paragraph id="id04FE06A8CABB45E4BF375677AD0966AB"><enum>(2)</enum><text>the term
			 <term>conference</term> means a meeting that—</text>
					<subparagraph id="idFC8FAE2C10DC4605B51B49A267F0C011"><enum>(A)</enum><text>is held for
			 consultation, education, or discussion;</text>
					</subparagraph><subparagraph id="idFCA40CE772CB4F7DB99EBA29577D8E8A"><enum>(B)</enum><text>is not held
			 entirely at an agency facility;</text>
					</subparagraph><subparagraph id="idDC6E5A7C227645E2B8C523B24E012500"><enum>(C)</enum><text>involves costs
			 associated with travel and lodging for some participants; and</text>
					</subparagraph><subparagraph id="idF0FF3D52E60B4471BB52955AF5019239"><enum>(D)</enum><text>is sponsored by 1
			 or more agencies, 1 or more organizations that are not agencies, or a
			 combination of such agencies or organizations; and</text>
					</subparagraph></paragraph><paragraph id="id538451D4A2174B2C9A492DAEBC2DB16E"><enum>(3)</enum><text>the term
			 <term>employee</term> means an employee of an agency.</text>
				</paragraph></subsection><subsection id="id3e9245bc92284c6fb2f5a191bc806b4b"><enum>(b)</enum><header>High-Cost
			 conferences</header>
				<paragraph id="id41CE7BEC708743AD8260374DEE183F2C"><enum>(1)</enum><header>In
			 general</header><text>An agency may not sponsor a conference the total cost to
			 the Government of which is expected to be more than $200,000 without the
			 approval of the head of the agency.</text>
				</paragraph><paragraph id="id1F1EA08462D448A889DDDD5B8221F98B"><enum>(2)</enum><header>Limitation on
			 delegation</header><text>The head of an agency may only delegate the authority
			 under this subsection to the Chief Management Officer of the agency or, for an
			 agency that does not have a Chief Management Officer, an employee of the agency
			 in an equivalent position.</text>
				</paragraph></subsection><subsection id="id48611C1701C146CDA1D2667912D5A901"><enum>(c)</enum><header>Conference
			 reporting</header>
				<paragraph id="id3EAA6C90C78A409181FF471BEC6F4256"><enum>(1)</enum><header>In
			 general</header><text>The head of an agency shall submit to each committee of
			 Congress with jurisdiction of the activities of the agency a report regarding
			 each conference sponsored by the agency.</text>
				</paragraph><paragraph id="id69b74d7c844a43caba6c834246e41a49"><enum>(2)</enum><header>Contents</header><text>Each
			 report submitted by the head of an agency under paragraph (1) shall provide
			 detailed information about the conference, including—</text>
					<subparagraph id="id03589A735D6749568CD2C98C4AAADF70"><enum>(A)</enum><text>the location of
			 the conference;</text>
					</subparagraph><subparagraph id="idCB7DF466946C4973B82A6171A483E9BF"><enum>(B)</enum><text>number of
			 employees attending the conference;</text>
					</subparagraph><subparagraph id="id4344698486E14AB08061FBBA094D3A16"><enum>(C)</enum><text>a list of the
			 titles of the employees attending the conference;</text>
					</subparagraph><subparagraph id="id5F35C55D2D8D4B878CA767AF1DF10A25"><enum>(D)</enum><text>the total cost to
			 the Government of the conference; and</text>
					</subparagraph><subparagraph id="id3FBDCAEBDA7E4956866BD80DBD439ECD"><enum>(E)</enum><text>a breakdown of
			 the cost to the Government relating to the conference for—</text>
						<clause commented="no" display-inline="no-display-inline" id="idFB22A57092964C74AC3EADAC8819E2C1"><enum>(i)</enum><text display-inline="yes-display-inline">scouting for and selecting the location of
			 the conference;</text>
						</clause><clause id="idACEE7C1E66D64080A618CAED1F3D0951"><enum>(ii)</enum><text>travel;</text>
						</clause><clause id="id31E54632B7214DCABB7B757F75B0F283"><enum>(iii)</enum><text>lodging;</text>
						</clause><clause id="idB43BD1A66C694C2683ADA551AA8089A3"><enum>(iv)</enum><text>food;</text>
						</clause><clause id="idC022813BFD814A418A11C55F4658E4A7"><enum>(v)</enum><text>speakers or
			 entertainment; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id077925B3223840DE8938046CFCFC1926"><enum>(vi)</enum><text>gifts provided
			 to conference attendees.</text>
						</clause></subparagraph></paragraph></subsection></section></legis-body>
