		<official-title>To amend the Child Care and Development Block Grant Act
		  of 1990 to ensure access to high-quality child care for homeless children and
		  families, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Improving Access to Child Care for
			 Homeless Families Act of 2012</short-title></quote>.</text>
		</section><section id="id2CD66DA85C98402585EAAEFC789EC10A"><enum>2.</enum><header>Findings; sense
			 of Congress</header>
			<subsection id="id2314F3DC6930404CA2645011A143C8F4"><enum>(a)</enum><header>Findings</header><text>Congress
			 makes the following findings:</text>
				<paragraph id="id0BC88D744E9E43929C2EF3C326F998C9"><enum>(1)</enum><text>Child and youth
			 homelessness has increased by 38 percent during the period since 2006, and Head
			 Start programs have registered a 44 percent increase in the number of homeless
			 children served over that same period.</text>
				</paragraph><paragraph id="id00CBF67294CC4E13962DFAD85BDDA689"><enum>(2)</enum><text>Among homeless
			 children living in shelters supported by the Department of Housing and Urban
			 Development, 50 percent are under 5 years old.</text>
				</paragraph><paragraph id="idAB9DC54139464C10A58FE6D12D183AD0"><enum>(3)</enum><text>A 2010 study by
			 the Eunice Kennedy Shriver National Institute of Child Health and Human
			 Development found that children who had received high-quality care in the first
			 few years of life scored higher on measures of academic and cognitive
			 achievement when the children were 19 years old, and were less likely to
			 misbehave, than children who had been enrolled in low-quality care in those
			 years.</text>
				</paragraph><paragraph id="id7A17904E914C4407B06B42EA75293BDC"><enum>(4)</enum><text>Homelessness has
			 a negative impact on child development that surpasses the harmful impacts of
			 poverty. A Head Start demonstration project serving homeless families indicated
			 that the homeless children served had more instances of developmental delay,
			 learning disabilities, and physical or mental health problems, compared with
			 their low-income peers in stable housing.</text>
				</paragraph><paragraph id="id8016FB897C3F4CFC96BA48910D81EEA5"><enum>(5)</enum><text>For homeless
			 families, residential instability, high mobility, documentation requirements,
			 and lack of transportation are significant obstacles to accessing and retaining
			 child care services.</text>
				</paragraph><paragraph id="id5835B9AB39394F7F8D211BD5FBE8AA55"><enum>(6)</enum><text>According to a
			 study by the Institute for Children, Poverty, and Homelessness, homeless
			 families are less likely to receive government financial assistance for child
			 care than families that are not homeless.</text>
				</paragraph><paragraph id="id702B7BD314EC4828A24B02D8D1B1A3CA"><enum>(7)</enum><text>Without child
			 care, homeless parents of young children struggle to search for employment,
			 maintain employment, and enter job training programs.</text>
				</paragraph><paragraph id="id9c4026cd6a5442348933a7a66342ae53"><enum>(8)</enum><text>Many parents who
			 are domestic violence survivors who flee their homes try to find employment,
			 but the parents are often limited by a lack of child care. In a survey of
			 nearly 1,500 domestic violence survivors in domestic violence shelters, 29
			 percent indicated that they needed help with child care.</text>
				</paragraph></subsection><subsection id="id7E3F6A4BA9EB41E186BB50BBD807AD0B"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that—</text>
				<paragraph id="id2C6BD44E03AB424E8E150A9A1B351413"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0EE1AEABCE784AB78F89A6088533F971"><enum>(A)</enum><text>Congress has enacted
			 successful policies to increase homeless children's access to and stability in
			 public elementary and secondary schools and Head Start programs; and</text>
					</subparagraph><subparagraph id="id275E3F1755C743319E83F8FFDAE2F32C" indent="up1"><enum>(B)</enum><text>in order to increase homeless
			 families' access to and continuity in child care, similar policies should be
			 applied to Federal child care programs; and</text>
					</subparagraph></paragraph><paragraph id="idFE94BA00F10C44159644AA64628C0DC9"><enum>(2)</enum><text>such policies
			 will assist homeless parents in maintaining employment and regaining housing,
			 and will provide critical interventions to support that vulnerable population
			 of children.</text>
				</paragraph></subsection></section><section id="idD64297DAEE3749479675B96475AF3C97"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure access
			 to high-quality child care for homeless children and families.</text>
		</section><section id="id3486C7B4837143BB867A05AA80D45FB7"><enum>4.</enum><header>Child care for
			 homeless children</header>
			<subsection id="idA6324AFF3FAB4880881B21F9638BA400"><enum>(a)</enum><header>Lead agency
			 duties</header><text>Section 658D(b)(1)(D) of the Child Care and Development
			 Block Grant Act of 1990 (42 U.S.C. 9858b(b)(1)(D)) is amended by striking
			 <quote>Federal, State and local child care and early childhood development
			 programs.</quote> and inserting</text>
				<quoted-block display-inline="yes-display-inline" id="idB97055A6ABD6434986892E5935F8A714" style="OLC">
					<text>Federal, State,
			 and local child care, early childhood development, and social service programs
			 that shall include—</text><paragraph id="id7657457DFC824FDAB4AFBFF63B2CFC51"><enum>(1)</enum><text>Head Start and
				Early Head Start programs under the Head Start Act (42 U.S.C. 9831 et
				seq.);</text>
					</paragraph><paragraph id="id2EC0ED51902447479FEB6835963B5601"><enum>(2)</enum><text>programs, and
				services of partners, that serve vulnerable populations, including programs
				serving homeless children and services of local educational agency liaisons for
				homeless children and youths designated under subsection (g)(1)(J)(ii) of
				section 722 of the McKinney-Vento Homeless Assistance Act (42 U.S.C. 11432);
				and</text>
					</paragraph><paragraph id="id7eca1e1bf71a4eefbeb3e8fca8630eda"><enum>(3)</enum><text>programs, and
				services of entities receiving grants, to provide to homeless veterans services
				authorized under chapter 20 of title 38, United States Code, consisting of
				housing, employment-related services (such as services under section 2021 or
				2021A of such title), or supportive services (such as services authorized under
				section 2044 of such
				title).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idC06EF2DCE6B8406695BD89CF2A67A3F0"><enum>(b)</enum><header>Plan
			 requirements</header><text>Section 658E(c) of the Child Care and Development
			 Block Grant Act of 1990 (42 U.S.C. 9858c(c)) is amended—</text>
				<paragraph id="idD6C03176FFEF4E44966D4AFDE1470782"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="id1653426F1668493B92267B192BB0D850"><enum>(A)</enum><text>in subparagraph
			 (D), by inserting <quote>, Head Start and Early Head Start agencies under the
			 Head Start Act (42 U.S.C. 9831 et seq.), State Coordinators designated under
			 subsection (d)(3), and local educational agency liaisons for homeless children
			 and youths designated under subsection (g)(1)(J)(ii), of section 722 of the
			 McKinney-Vento Homeless Assistance Act (42 U.S.C. 11432), local educational
			 agencies and providers of early intervention services under the Individuals
			 with Disabilities Education Act (20 U.S.C. 1400 et seq.),</quote> after
			 <quote>children</quote>;</text>
					</subparagraph><subparagraph id="idFAFD0E15A1BB49AF99668E6759D5405B"><enum>(B)</enum><text>in subparagraph
			 (F)(i), by striking the semicolon and inserting <quote>and the establishment of
			 a grace period that allows homeless children to receive services under this
			 subchapter while their families are taking any necessary action to comply with
			 immunization and other health and safety requirements;</quote>; and</text>
					</subparagraph><subparagraph id="id8DBEF53C5398465F9B50A93A8A17FFD6"><enum>(C)</enum><text>in subparagraph
			 (H)—</text>
						<clause id="idF4708B4644474214B2C9A80D01733CD6"><enum>(i)</enum><text>by
			 striking <quote>and families</quote> and inserting <quote>families</quote>;
			 and</text>
						</clause><clause id="id1B4345B295CE454792241F7D0650F3FC"><enum>(ii)</enum><text>by
			 inserting <quote>, and families of homeless children</quote> before the
			 period;</text>
						</clause></subparagraph></paragraph><paragraph id="idD0D99634058045A5B883E3CA54D1C07A"><enum>(2)</enum><text>in paragraph
			 (3)(B)—</text>
					<subparagraph id="idC5A49FADA0D84344A3832B33C388E74A"><enum>(A)</enum><text>by inserting
			 <quote>activities that improve access to such services (including
			 transportation to child care services, procedures to permit immediate
			 enrollment of homeless children while required documentation is obtained,
			 training and technical assistance on identifying and serving homeless children
			 and their families, and specific outreach to families described in paragraph
			 (2)(H)),</quote> after <quote>availability of such services,</quote>;
			 and</text>
					</subparagraph><subparagraph id="id3FCE2D62C01F4A63B7E6A4AAEB9B7F6E"><enum>(B)</enum><text>by inserting
			 <quote>, to homeless children,</quote> after <quote>family size)</quote>;
			 and</text>
					</subparagraph></paragraph><paragraph id="idD5B5F149868645E5A7BD27EC85592CD7"><enum>(3)</enum><text>in paragraph (5),
			 by adding at the end the following: <quote>Each sliding fee scale shall be
			 applied using measures to ensure that cost sharing is not a barrier to the
			 enrollment of families of homeless children.</quote>.</text>
				</paragraph></subsection><subsection id="idFA19C89FE59D4845A831E6D65168C5B8"><enum>(c)</enum><header>Access and
			 outreach to families of homeless children</header><text>Section 658G of the
			 Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9858e) is
			 amended—</text>
				<paragraph id="id74F348EDBFBC4DC682432FA0DEBF0CA4"><enum>(1)</enum><text>by inserting
			 <quote>(such as resource and referral services)</quote> after <quote>and
			 activities</quote>; and</text>
				</paragraph><paragraph id="id590FF69FBAC64284B17BFE2718108E68"><enum>(2)</enum><text>by striking
			 <quote>(such as resource and referral services).</quote> and inserting <quote>,
			 including developing strategies and partnerships to provide transportation to
			 child care services and specific outreach to families described in section
			 658E(c)(2)(H)).</quote> after <quote>availability of child care</quote>.</text>
				</paragraph></subsection><subsection id="idBA4680E6B09D4C17BFFFA224B18B7FAB"><enum>(d)</enum><header>Reports</header><text>Section
			 658K(a)(1)(B) of the Child Care and Development Block Grant Act of 1990 (42
			 U.S.C. 9858i(a)(1)(B)) is amended—</text>
				<paragraph id="id6F35725837CB412FAFAB011A7B7E8BF5"><enum>(1)</enum><text>in clause (ix),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id9D1E4AB3DCA54DE4B614EB4E2025DD61"><enum>(2)</enum><text>in clause (x), by
			 adding <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="idA64491CF77794ED0B422420A622591D7"><enum>(3)</enum><text>by inserting
			 after clause (x) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBD9D1ED09E6941EE8192EDCE675EEF15" style="OLC">
						<clause id="id17D703C1EE7046E6805C9CDBBC68E9EE"><enum>(xi)</enum><text>whether the
				children receiving assistance under this subchapter are homeless
				children;</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id4C7B80DBF6324695B00D99F753985B5C"><enum>5.</enum><header>Pilot
			 program</header>
			<subsection id="idCFDBC3F8D2204BE59FBC3C3204B271C6"><enum>(a)</enum><header>Redesignation</header><text>Section
			 658L of the Child Care and Development Block Grant Act of 1990 (42 U.S.C.
			 9858j) is amended—</text>
				<paragraph id="idDA872EEA6B9C427DBF9945F84A89B9FA"><enum>(1)</enum><text>by striking the
			 section heading;</text>
				</paragraph><paragraph id="id39E813DB8B3B4806BA7E73D951A0D162"><enum>(2)</enum><text>by inserting
			 <quote>(c) <header-in-text level="subsection" style="OLC">Report by
			 Secretary</header-in-text>.—</quote> before <quote>Not later</quote>;</text>
				</paragraph><paragraph id="id220F0D3048F74FBD8E957FE0A3026F5A"><enum>(3)</enum><text>by striking
			 <quote>section 658K</quote> and inserting <quote>this section</quote>;
			 and</text>
				</paragraph><paragraph id="id92B799E6612840889B6EED1DAFB9D8ED"><enum>(4)</enum><text>by moving
			 subsection (c) (as redesignated by paragraph (2)) to the end of section
			 658K.</text>
				</paragraph></subsection><subsection id="idC010763A790840BDA05EDC7CA3E98AE7"><enum>(b)</enum><header>Establishment
			 of program</header><text>The Child Care and Development Block Grant Act of 1990
			 (42 U.S.C. 9858 et seq.) is amended by inserting after section 658K (42 U.S.C.
			 9858i), as amended by subsection (a), the following:</text>
				<quoted-block display-inline="no-display-inline" id="id39C26DD9504E45D9BF031EDE2DA49693" style="OLC">
					<section id="id0835F2DA31E548EB9F297766FD449AB9"><enum>658L.</enum><header>Pilot
				program</header>
						<subsection id="idE891E72586284BABAC0B9391798F03E6"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall carry out a pilot program to identify
				and implement best practices for increasing access to and continuity of child
				care for homeless children.</text>
						</subsection><subsection id="id8C4D277C44C74091B893CE97E48026CC"><enum>(b)</enum><header>Grants</header><text>In
				carrying out the pilot program, the Secretary shall award to States not more
				than 5 grants of not more than $5,000,000 per grant. Each grant shall be for a
				period of not more than 3 years, beginning not later than March 31,
				2013.</text>
						</subsection><subsection id="id4C6BCE755C044D6BA2BB054F6284BAA3"><enum>(c)</enum><header>Application</header><text>In
				order to be eligible to receive a grant under this section, a State shall
				submit an application to the Secretary at such time, in such manner, and
				containing such information as the Secretary shall require.</text>
						</subsection><subsection id="id92916294D7B541A0B6B923CAEF516174"><enum>(d)</enum><header>Use of
				funds</header><text>A State that receives a grant under this section shall use
				the funds made available under the grant—</text>
							<paragraph id="id8755C66F1C9445B6961F726E630E72F9"><enum>(1)</enum><text>to establish a
				pilot project for—</text>
								<subparagraph id="id8D0F72437F9C4907BD443AFBB30CF190"><enum>(A)</enum><text>implementing
				promising practices for increasing access to and continuity of child care for
				homeless children; and</text>
								</subparagraph><subparagraph id="idE61C4E76F6C04A108B448CC195E2D1B9"><enum>(B)</enum><text>identifying the
				best practices; and</text>
								</subparagraph></paragraph><paragraph id="id484D20ED853249D9B9670DC7D3C2992A"><enum>(2)</enum><text>to carry out
				subsection (e)(1).</text>
							</paragraph></subsection><subsection id="id420EF5CD656345C383D9B7E572C9AB14"><enum>(e)</enum><header>Assessments and
				reports</header>
							<paragraph id="idEAE1C1B08F114F13B2920179905DDF6A"><enum>(1)</enum><header>State
				responsibilities</header>
								<subparagraph id="id65074614CF684D9195481ABD0F3BAC7B"><enum>(A)</enum><header>Assessment</header><text>A
				State that receives a grant under this section shall carry out data collection
				for and an assessment of its pilot project described in subsection
				(d)(1).</text>
								</subparagraph><subparagraph id="id2B68D1A699494730916DCAF904C0A3D1"><enum>(B)</enum><header>Report to the
				Secretary</header><text>Not later than 42 months after the first day of the
				grant period for a pilot project described in subsection (d)(1), the State
				carrying out the pilot project shall submit to the Secretary a report
				containing a summary of the results of the assessment described in subparagraph
				(A), including a description of the best practices identified.</text>
								</subparagraph></paragraph><paragraph id="idCC477DD56B144BC799F225F5DD6C0D01"><enum>(2)</enum><header>Secretarial
				responsibilities</header><text>Not later than 4 years after the first day of
				the latest grant period for a pilot project, the Secretary shall submit to
				Congress a report containing a summary of the reports received under paragraph
				(1) and a recommendation concerning whether and how to expand the pilot
				projects carried out with best practices.</text>
							</paragraph></subsection><subsection id="id2C860F6FB58F41B789F87B31353D2A8C"><enum>(f)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section such sums as may be necessary for each of fiscal years 2013
				through 2015, which shall remain available through fiscal year
				2017.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idB8B851E694024851A219D8F157B43E71"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 658P of the Child Care and
			 Development Block Grant Act of 1990 (42 U.S.C. 9858n) is amended—</text>
			<paragraph id="id096CD5B27F6244D59FCFDF7D0EA58BB4"><enum>(1)</enum><text>in paragraph
			 (4)(C)—</text>
				<subparagraph id="id0AA8D2555C204958A303313F712C7523"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>or</quote> at the end;</text>
				</subparagraph><subparagraph id="idBCC93A48814C4E84828A4F9A7C7C3811"><enum>(B)</enum><text>in clause (ii),
			 by striking the period and inserting <quote>; or</quote>; and</text>
				</subparagraph><subparagraph id="id5E465C2F306340D6A83B6C8CBD80E616"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDFECA4135D7E4B38B17303F71FFCE351" style="OLC">
						<clause id="id59EE135BBBD342C5A840CA7D39E0D814"><enum>(iii)</enum><text>is a homeless
				child.</text>
						</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id0C795EFFC83B4FE7870A188C67B3CC7F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id77910FA476A6490B9327C252E04D85CC" style="OLC">
					<paragraph id="idB16C3122B62E4F09838DF95A75FF509A"><enum>(15)</enum><header>Homeless
				child</header><text>The term <term>homeless child</term> means a homeless child
				or youth, as defined under section 725 of the McKinney-Vento Homeless
				Assistance Act (42 U.S.C.
				11434a).</text>
