		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Mni Wiconi Project Act Amendments
			 of 2012</short-title></quote>.</text>
		</section><section id="id011C89DAA88F46ACA2F050F0B3B17BF7" section-type="subsequent-section"><enum>2.</enum><header>Clarification</header><text display-inline="no-display-inline">Section 2(b)(1) of the Mni Wiconi Project
			 Act of 1988 (Public Law 100–516; 102 Stat. 2566; 108 Stat. 4539) is amended by
			 striking <quote>in South Dakota</quote>.</text>
		</section><section id="id904F7EA662864B1EBA14B39DC9ECA0FD"><enum>3.</enum><header>Oglala Sioux
			 Rural Water Supply System</header>
			<subsection id="id442CF214A8FA480386FE960DCB542552"><enum>(a)</enum><header>Service
			 area</header><text>Section 3(c) of the Mni Wiconi Project Act of 1988 (Public
			 Law 100–516; 102 Stat. 2568) is amended by inserting <quote>, including the
			 tract of land in the State of Nebraska set aside as part of the Pine Ridge
			 Indian Reservation by the Executive order dated February 20, 1904</quote>
			 before the period at the end.</text>
			</subsection><subsection id="id95840854534A4485AB37E69226FB72ED"><enum>(b)</enum><header>Other agency
			 assistance</header><text>Section 3 of the Mni Wiconi Project Act of 1988
			 (Public Law 100–516; 102 Stat. 2568; 106 Stat. 4661; 108 Stat. 4539) is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2C1148F931F24CC0A222E89F7005FBF8" style="OLC">
					<subsection id="id4b3d1408ee0f42b98968e9dd613c260e"><enum>(i)</enum><header>Plan for
				completing the Oglala Sioux Rural Water Supply System</header>
						<paragraph id="id93b6fb973baa4a2289e34f0d178f2955"><enum>(1)</enum><header>In
				general</header><text>In carrying out paragraphs (4) and (8) of subsection (a)
				and subsection (b)(3), the Secretary shall develop, in consultation with the
				Oglala Sioux Tribe and the Federal agencies listed in subsection (j), a plan
				for completing the Oglala Sioux Rural Water Supply System, including the
				improvement, repair, and replacement of existing water systems on the Pine
				Ridge Indian Reservation and the transfer of those systems to the United States
				to be held in trust for the Oglala Sioux Tribe and made part of the Oglala
				Sioux Rural Water Supply System.</text>
						</paragraph><paragraph id="id0F41A71B5D6444358F1AE8AF0E84D59C"><enum>(2)</enum><header>Contents</header><text>Not
				later than 2 years after the date of enactment of this subsection, the
				Secretary shall submit to the Committee on Energy and Natural Resources of the
				Senate and the Committee on Natural Resources of the House of Representatives
				the plan described in paragraph (1), which shall include—</text>
							<subparagraph id="idF0806707A50548AC9DC293E7E1F55E78"><enum>(A)</enum><text>a schedule for
				full implementation of the plan;</text>
							</subparagraph><subparagraph id="id2966D040174F4130AC45276F6FCFF17B"><enum>(B)</enum><text>a report that
				includes—</text>
								<clause id="id7D235E0D31D84EB0B37D8F39F632E51A"><enum>(i)</enum><text>a
				description of the roles and responsibilities of the Federal agencies referred
				to in subsection (j) (including the Bureau of Reclamation) for completing the
				improvement, repair, and replacement of the existing water systems;</text>
								</clause><clause id="id9EC3D84800E748FAB3A4745C401BF80F"><enum>(ii)</enum><text>the program
				authorities of each Federal agency and a description of how those agencies will
				work together to complete and implement the plan; and</text>
								</clause><clause id="idAE832CB3D33B452BA29F68B37D836F3B"><enum>(iii)</enum><text>the funding
				requirements and other needs necessary to complete and implement the plan;
				and</text>
								</clause></subparagraph><subparagraph id="id30867c07df8a48ddb1f9ba0a910a988f"><enum>(C)</enum><text>as applicable, a
				description of the roles and responsibilities of other Federal agencies that
				have existing authorities to provide assistance to the Oglala Sioux
				Tribe.</text>
							</subparagraph></paragraph></subsection><subsection id="id2f84ebdb32be493a896feab23971aae3"><enum>(j)</enum><header>Interagency
				agreements</header>
						<paragraph id="idE52C0D989409413F8458F64876CB02E3"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, after the
				date on which the Secretary submits the plan under subsection (i) to Congress,
				the Secretary shall enter into agreements with the agency heads described in
				paragraph (4) to fulfill the trust responsibility of the United States and
				complete the Oglala Sioux Rural Water Supply System in accordance with the
				Final Engineering Report dated May 1993, including the transfer of existing
				systems.</text>
						</paragraph><paragraph id="id4C8428D63A2945C2BD5F5349862C0D69"><enum>(2)</enum><header>Lead
				agency</header><text>The Department of the Interior, acting through the Bureau
				of Reclamation, shall act as the lead agency in carrying out this
				section.</text>
						</paragraph><paragraph id="id2EAC92595FC84693B18AF48DCF0948D2"><enum>(3)</enum><header>Administration</header>
							<subparagraph id="id724E7EE7D0054ACF8ACBBF0665A98175"><enum>(A)</enum><header>In
				general</header><text>Each agency head described in paragraph (4) shall carry
				out the duties of the agency head under this subsection out of amounts made
				available to the agency head under annual appropriations and existing
				programmatic authority.</text>
							</subparagraph><subparagraph id="idAF562B2F6A6F42F1B6128106AF29CF88"><enum>(B)</enum><header>Additional
				funding requests</header><text>Nothing in this subsection prohibits the Oglala
				Sioux Tribe from applying for, seeking, or obtaining amounts from the agency
				heads described in paragraph (4) for any other purpose.</text>
							</subparagraph></paragraph><paragraph id="idf460ee5ff9e84a9b98caf07c01ecd5cc"><enum>(4)</enum><header>Agency
				responsibilities</header><text>The agency heads referred to in this subsection
				are—</text>
							<subparagraph id="id6D6EF0586A40456BB4F0576474FE30A1"><enum>(A)</enum><text>the Administrator
				of the Environmental Protection Agency, who shall assist the Secretary
				in—</text>
								<clause id="id7CA85727F7364C9EA7C0F60F519C3526"><enum>(i)</enum><text>meeting the
				environmental and safe drinking water needs of the Pine Ridge Indian
				Reservation, including complying with the Safe Drinking Water Act (42 U.S.C.
				300f et seq.); and</text>
								</clause><clause id="idABEE861BD24A48038E1EE0657AA0319A"><enum>(ii)</enum><text>completing the
				Oglala Sioux Rural Water Supply System, including by—</text>
									<subclause id="idEC10FE4E62E546158B00E4830A442E30"><enum>(I)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (i);
				and</text>
									</subclause><subclause id="id0B648AD754A646509CF51EFE33670241"><enum>(II)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features;</text>
									</subclause></clause></subparagraph><subparagraph id="id958302F30CB74B4A934A9FA9D2A19C92"><enum>(B)</enum><text>the Secretary of
				Agriculture, who, through the rural development program and other applicable
				programs of the Department, shall assist the Secretary in completing the Oglala
				Sioux Rural Water Supply System, including by—</text>
								<clause id="id045089A4B2A748C09B4E0698E5B616C5"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (i);
				and</text>
								</clause><clause id="id6A5E7D2D59B34A638227DB5E0CB41358"><enum>(ii)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features;</text>
								</clause></subparagraph><subparagraph id="idAEC82E7801D2434C8CC649DF115807C3"><enum>(C)</enum><text>the Secretary of
				Health and Human Services, who, acting through the Director of the Indian
				Health Service, shall assist the Secretary in meeting the water supply and
				public health needs of the Pine Ridge Indian Reservation under subsection
				(a)(8), including by—</text>
								<clause id="idBB9316C0A4104C1885C4178FB8840A5D"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection
				(i);</text>
								</clause><clause id="id368C4EFE190D4AF299673965C8A01216"><enum>(ii)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features; and</text>
								</clause><clause id="id492AC09E1516469DB2D3A306D4FB1367"><enum>(iii)</enum><text>complying with
				the Act of August 5, 1954 (commonly known as the <quote>Indian Sanitation
				Facilities Act</quote>) (68 Stat. 674); and</text>
								</clause></subparagraph><subparagraph id="id6d7ebd6bfd5a4738a5098924239245ac"><enum>(D)</enum><text>the Secretary of
				Housing and Urban Development, who shall assist the Secretary in completing the
				Oglala Sioux Rural Water Supply System pursuant to subsection (a)(8), including
				by—</text>
								<clause id="idEABAB0CFC4324E1CB06B986939BB99B2"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (i);
				and</text>
								</clause><clause id="id296F28709B6E40D7B1E03FF1C580EBE5"><enum>(ii)</enum><text>completing the
				plumbing, water pipes, appurtenances, and interconnections of houses to the
				Oglala Sioux Rural Water Supply System to meet the water conservation standards
				of the system.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="id24c65f8d31f8469fa06b4702c9f3d74a"><enum>(k)</enum><header>Upgrading
				standards for connecting homes</header><text>The Director of the Bureau of
				Indian Affairs shall, through the use of existing programs and annual
				appropriations, assist the Secretary in completing the Oglala Sioux Rural Water
				Supply System by constructing, repairing, and upgrading plumbing fixtures,
				skirting, and other necessary features, such as septic tanks and drainfields,
				to ensure that houses within the service area are able to meet the standards
				for connecting to the Oglala Sioux Rural Water Supply System.</text>
					</subsection><subsection id="id38826E8405384BD7AF6C7B8930B07A88"><enum>(l)</enum><header>Livestock
				distribution system</header>
						<paragraph id="idBE11437A64034E5CA5ED1D7DCB8027C6"><enum>(1)</enum><header>In
				general</header><text>The Secretary and the Secretary of Agriculture shall,
				through the use of the water resources development authorities of the Bureau of
				Indian Affairs and the environmental quality incentives program established
				under chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (16
				U.S.C. 3839aa et seq.), respectively, complete, during a period not to exceed
				15 years, the livestock distribution system for the Oglala Sioux Rural Water
				Supply System consistent with the Final Engineering Report dated May
				1993.</text>
						</paragraph><paragraph id="id1E3F6A4C16D84317A128AFA41E8A9689"><enum>(2)</enum><header>Requirements</header><text>In
				carrying out this subsection—</text>
							<subparagraph id="id3F4C68CB16334FF499C15EEF6EC5B6EE"><enum>(A)</enum><text>the Department of
				the Interior shall serve as the lead agency;</text>
							</subparagraph><subparagraph id="id2322871C446F409CB9C43C733A8E0F57"><enum>(B)</enum><text>the Secretary and
				the Secretary of Agriculture shall enter into an interagency agreement that
				sets forth the specific responsibilities of each agency concerning the
				construction of the livestock distribution system; and</text>
							</subparagraph><subparagraph id="id3F816CA066BA4271841766B41E338319"><enum>(C)</enum><text>the Natural
				Resources Conservation Service and the Bureau of Indian Affairs shall carry out
				the respective duties of the agencies under this subsection out of amounts made
				available to the respective agencies under annual appropriations and existing
				programmatic
				authority.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idFAE3FC65326F418EB58C6617ABDFD5F5"><enum>4.</enum><header>Rosebud Sioux
			 Rural Water System</header><text display-inline="no-display-inline">Section 3A
			 of the Mni Wiconi Project Act of 1988 (Public Law 100–516; 108 Stat. 4540) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id0AE6691BADB649EC964CC8190CA6299A" style="OLC">
				<subsection id="id2E48E846057242F7BE4CBBEE5FABD7A6"><enum>(h)</enum><header>Plan for
				completing the Rosebud Sioux Rural Water Supply System</header>
					<paragraph id="idF42BD89F5AF742CAB8639D452E6EE072"><enum>(1)</enum><header>In
				general</header><text>In carrying out paragraphs (4) and (8) of subsection (a)
				and subsection (b)(3), the Secretary shall develop, in consultation with the
				Rosebud Sioux Tribe and the Federal agencies listed in subsection (i), a plan
				for completing the Rosebud Sioux Rural Water Supply System, including the
				improvement, repair, and replacement of existing water systems on the Rosebud
				Indian Reservation and the transfer of those systems to the United States to be
				held in trust for the Rosebud Sioux Tribe and made part of the Rosebud Sioux
				Rural Water Supply System.</text>
					</paragraph><paragraph id="id91E3B4C604524BFDA2F51CC9ADD2F163"><enum>(2)</enum><header>Contents</header><text>Not
				later than 2 years after the date of enactment of this subsection, the
				Secretary shall submit to the Committee on Energy and Natural Resources of the
				Senate and the Committee on Natural Resources of the House of Representatives
				the plan described in paragraph (1), which shall include—</text>
						<subparagraph id="id8A646A5E1CCC4BD2A62BA21AB17E69AD"><enum>(A)</enum><text>a schedule for

				authorities of each Federal agency and a description of how those agencies will
				work together to complete and implement the plan; and</text>
							</clause><clause id="id6ab55ee27a6b41a0afe08a487d002082"><enum>(iii)</enum><text>the funding
				requirements and other needs necessary to complete and implement the plan;
				and</text>
							</clause></subparagraph><subparagraph id="id328d4ccce22d4565b7699cc17ba1ee6f"><enum>(C)</enum><text>as applicable, a
				description of the roles and responsibilities of other Federal agencies that
				have existing authorities to provide assistance to the Rosebud Sioux
				Tribe.</text>
						</subparagraph></paragraph></subsection><subsection id="idED13C0FF398949CE9DEC6C659294299C"><enum>(i)</enum><header>Interagency
				agreements</header>
					<paragraph id="id1C8004E2AFD043C6839D3EAEE4674693"><enum>(1)</enum><header>In

						</subparagraph></paragraph><paragraph id="id31C323CDE27A460DAC4119E5426754BD"><enum>(4)</enum><header>Agency
				responsibilities</header><text>The agency heads referred to in this subsection

						<subparagraph id="id3849661FA19D4A6AB7F50E5A949E0E01"><enum>(A)</enum><text>the Administrator
				of the Environmental Protection Agency, who shall assist the Secretary
				in—</text>
							<clause id="idFC98BAD32488416FBE021659B6495081"><enum>(i)</enum><text>meeting the
				environmental and safe drinking water needs of the Rosebud Indian Reservation,
				including complying with the Safe Drinking Water Act (42 U.S.C. 300f et seq.);
				and</text>
							</clause><clause id="id0A2EEC809DA349DB8C03485CFB4B78E1"><enum>(ii)</enum><text>completing the
				Rosebud Sioux Rural Water Supply System, including by—</text>
								<subclause id="id88062209538D46F0A381B120010D91F1"><enum>(I)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (h);
				and</text>
								</subclause><subclause id="id497A32E3014245A885E1BDD0AA60F126"><enum>(II)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features;</text>
								</subclause></clause></subparagraph><subparagraph id="id319CDFFF4BAC48ADB6E30F162ADFD24F"><enum>(B)</enum><text>the Secretary of
				Agriculture, who, through the rural development program and other applicable
				programs of the Department, shall assist the Secretary in completing the
				Rosebud Sioux Rural Water Supply System, including by—</text>
							<clause id="id6349D877635C478AB9D391C08C0A9759"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (h);
				and</text>
							</clause><clause id="idF8125471C721420D87BBA34AB0D724C4"><enum>(ii)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features;</text>
							</clause></subparagraph><subparagraph id="id9CEA455A61114ABCBD3A7AEEA8C87720"><enum>(C)</enum><text>the Secretary of
				Health and Human Services, who, acting through the Director of the Indian
				Health Service, shall assist the Secretary in meeting the water supply and
				public health needs of the Rosebud Indian Reservation under subsection (a)(8),
				including by—</text>
							<clause id="id73B10C92DC1C4A58877B599342CDE299"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection
				(h);</text>
							</clause><clause id="id3F3A3ED20AAC4F9E91BF46A6932340AB"><enum>(ii)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features; and</text>
							</clause><clause id="idCFD3F9B60E8D41FA9D972E225709FD6F"><enum>(iii)</enum><text>complying with
				the Act of August 5, 1954 (commonly known as the <quote>Indian Sanitation
				Facilities Act</quote>) (68 Stat. 674); and</text>
							</clause></subparagraph><subparagraph id="id2B617D02D09A42F2B5081F865ABA1854"><enum>(D)</enum><text>the Secretary of
				Housing and Urban Development, who shall assist the Secretary in completing the
				Rosebud Sioux Rural Water Supply System pursuant to subsection (a)(8),
				including by—</text>
							<clause id="id6EF360C21E944E348ED6E6A979AEDCFE"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (h);
				and</text>
							</clause><clause id="id627DC4F819A04FEBA23496C484C91B4A"><enum>(ii)</enum><text>completing the
				plumbing, water pipes, appurtenances, and interconnections of houses to the
				Rosebud Sioux Rural Water Supply System to meet the water conservation
				standards of the system.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id4849FD32F8B2483F93F653FE211DEF97"><enum>(j)</enum><header>Upgrading
				standards for connecting homes</header><text>The Director of the Bureau of
				Indian Affairs shall, through the use of existing programs and annual
				appropriations, assist the Secretary in completing the Rosebud Sioux Rural

				general</header><text>The Secretary and the Secretary of Agriculture shall,

		</section><section id="idE2A1D712F9664B2BB6921B1B61004BFC"><enum>5.</enum><header>Lower Brule
			 Sioux Rural Water System</header><text display-inline="no-display-inline">Section 3B of the Mni Wiconi Project Act of
			 1988 (Public Law 100–516; 108 Stat. 4542) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id801ED756159F403F936DE0EB8F010EE1" style="OLC">
				<subsection id="id71ADB4FFD7D44E128D3BB5FC6B2E6889"><enum>(h)</enum><header> Plan for
				Completing the Lower Brule Sioux Rural Water Supply System</header>
					<paragraph id="id0A69589823B24D66AB5E6945A4253F99"><enum>(1)</enum><header>In
				general</header><text>In carrying out paragraphs (4) and (8) of subsection (a)
				and subsection (b)(3), the Secretary shall develop, in consultation with the
				Lower Brule Sioux Tribe and the Federal agencies listed in subsection (i), a
				plan for completing the Lower Brule Sioux Rural Water Supply System, including
				the improvement, repair, and replacement of existing water systems on the Lower
				Brule Indian Reservation and the transfer of those systems to the United States
				to be held in trust for the Lower Brule Sioux Tribe and made part of the Lower
				Brule Sioux Rural Water Supply System.</text>
					</paragraph><paragraph id="id9880988F739C4760A64AE3FBE79D68E1"><enum>(2)</enum><header>Contents</header><text>Not
				later than 2 years after the date of enactment of this subsection, the
				Secretary shall submit to the Committee on Energy and Natural Resources of the
				Senate and the Committee on Natural Resources of the House of Representatives
				the plan described in paragraph (1), which shall include—</text>
						<subparagraph id="idBD5FDA3280C44D269F1E038DF07B89C8"><enum>(A)</enum><text>a schedule for
				full implementation of the plan;</text>
						</subparagraph><subparagraph id="id6A42180775DD4D2E868BF92ADE61ED86"><enum>(B)</enum><text>a report that
				includes—</text>
							<clause id="id049E323B7A904A018C5A7E7260C2D83A"><enum>(i)</enum><text>a
				description of the roles and responsibilities of the Federal agencies referred
				to in subsection (i) (including the Bureau of Reclamation) for completing the
				improvement, repair, and replacement of the existing water systems;</text>
							</clause><clause id="id09CEEF9EE3814E329A0E7CA3C1CC7731"><enum>(ii)</enum><text>the program
				authorities of each Federal agency and a description of how those agencies will
				work together to complete and implement the plan; and</text>
							</clause><clause id="id2b9f00f2d7604894a58384c72f146057"><enum>(iii)</enum><text>the funding
				requirements and other needs necessary to complete and implement the plan;
				and</text>
							</clause></subparagraph><subparagraph id="id620b04baceca4c389976b61c6269d8a5"><enum>(C)</enum><text>as applicable, a
				description of the roles and responsibilities of other Federal agencies that
				have existing authorities to provide assistance to the Lower Brule Sioux
				Tribe.</text>
						</subparagraph></paragraph></subsection><subsection id="id92B23A914C334B51B4639AD316F7B4A2"><enum>(i)</enum><header>Interagency
				agreements</header>
					<paragraph id="id53700F3403E341E2BED8D678D1AA556A"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, after the
				date on which the Secretary submits the plan under subsection (h) to Congress,
				the Secretary shall enter into agreements with the agency heads described in
				paragraph (4) to fulfill the trust responsibility of the United States and
				complete the Lower Brule Sioux Rural Water Supply System in accordance with the
				Final Engineering Report dated May 1993, including the transfer of existing
				systems.</text>
					</paragraph><paragraph id="id4F4BE3DA188A4286929C790DCA51990D"><enum>(2)</enum><header>Lead
				agency</header><text>The Department of the Interior, acting through the Bureau
				of Reclamation, shall act as the lead agency in carrying out this
				section.</text>
					</paragraph><paragraph id="id8D90E730DE6B410CAF218B7E1AC36B5A"><enum>(3)</enum><header>Administration</header>
						<subparagraph id="id062A45EFAC664829A87F6C98C6825EAD"><enum>(A)</enum><header>In
				general</header><text>Each agency head described in paragraph (4) shall carry
				out the duties of the agency head under this subsection out of amounts made
				available to the agency head under annual appropriations and existing
				programmatic authority.</text>
						</subparagraph><subparagraph id="id922CAF349F10416ABE81D2D2D83664B4"><enum>(B)</enum><header>Additional
				funding requests</header><text>Nothing in this subsection prohibits the Lower
				Brule Sioux Tribe from applying for, seeking, or obtaining amounts from the
				agency heads described in paragraph (4) for any other purpose.</text>
						</subparagraph></paragraph><paragraph id="id96B3E2113CE644AABFA3AB809358A418"><enum>(4)</enum><header>Agency
				responsibilities</header><text>The agency heads referred to in this subsection
				are—</text>
						<subparagraph id="idB9508D289DBD4C6382A3AA0955ACE850"><enum>(A)</enum><text>the Administrator
				of the Environmental Protection Agency, who shall assist the Secretary
				in—</text>
							<clause id="id5655BAB04E884B0EA490AAAE5AD67696"><enum>(i)</enum><text>meeting the
				environmental and safe drinking water needs of the Lower Brule Indian
				Reservation, including complying with the Safe Drinking Water Act (42 U.S.C.
				300f et seq.); and</text>
							</clause><clause id="idE726928E355B4049A6E11F2BC45572E8"><enum>(ii)</enum><text>completing the
				Lower Brule Sioux Rural Water Supply System, including by—</text>
								<subclause id="idAA14E3BE177B42AC95DCBCEEE1047013"><enum>(I)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (h);
				and</text>
								</subclause><subclause id="id0C3153F3F5DD459DB251928B39564194"><enum>(II)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features;</text>
								</subclause></clause></subparagraph><subparagraph id="id3CDB6B1A65FD46A896EC3C86E4510111"><enum>(B)</enum><text>the Secretary of
				Agriculture, who, through the rural development program and other applicable
				programs of the Department, assist the Secretary in completing the Lower Brule
				Sioux Rural Water Supply System, including by—</text>
							<clause id="idC0611B67D26F4AB5B58968404E5A19EB"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (h);
				and</text>
							</clause><clause id="id967A869003964F45AF837F4BE5D6AB1C"><enum>(ii)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features;</text>
							</clause></subparagraph><subparagraph id="id942BD9AA13E04D80B458BDCE2E00BB63"><enum>(C)</enum><text>the Secretary of
				Health and Human Services, who, acting through the Director of the Indian
				Health Service, shall assist the Secretary in meeting the water supply and
				public health needs of the Lower Brule Indian Reservation under subsection
				(a)(8), including by—</text>
							<clause id="idB1499364FB164DA58442DFFCFB6F0CFF"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection
				(h);</text>
							</clause><clause id="id4ED94742F508415595DADBBEE24F086E"><enum>(ii)</enum><text>constructing new
				rural water facilities, service lines, and other necessary features; and</text>
							</clause><clause id="id0FDA9E4BD07E4E0888523A920AED21E7"><enum>(iii)</enum><text>complying with
				the Act of August 5, 1954 (commonly known as the <quote>Indian Sanitation
				Facilities Act</quote>) (68 Stat. 674); and</text>
							</clause></subparagraph><subparagraph id="id6C42E91F89A14B92B7B66C813EBF0C8A"><enum>(D)</enum><text>the Secretary of
				Housing and Urban Development, who shall assist the Secretary in completing the
				Lower Brule Sioux Rural Water Supply System pursuant to subsection (a)(8),
				including by—</text>
							<clause id="id2D8D130232A84009ABC6FC1F88707AA0"><enum>(i)</enum><text>improving and
				repairing existing water systems as set forth in the plan under subsection (h);
				and</text>
							</clause><clause id="id87F6A2E5E40040D4A857AE140C5A7744"><enum>(ii)</enum><text>completing the
				plumbing, water pipes, appurtenances, and interconnections of houses to the
				Lower Brule Sioux Rural Water Supply System to meet the water conservation
				standards of the system.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id78B4F9EC0019459D9C884C78CAFA5737"><enum>(j)</enum><header>Upgrading
				standards for connecting homes</header><text>The Director of the Bureau of
				Indian Affairs shall, through the use of existing programs and annual
				appropriations, assist the Secretary in completing the Lower Brule Sioux Rural
				Water Supply System by constructing, repairing, and upgrading plumbing
				fixtures, skirting, and other necessary features, such as septic tanks and
				drainfields, to ensure that houses within the service area are able to meet the
				standards for connecting to the Lower Brule Sioux Rural Water Supply
				System.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id84D2732100E140B78333BC7E4EFA2844"><enum>6.</enum><header>Mitigation of
			 fish and wildlife losses</header><text display-inline="no-display-inline">Section 6 of the Mni Wiconi Project Act of
			 1988 (Public Law 100–516; 102 Stat. 2570; 108 Stat. 4544) is amended by
			 striking subsection (b) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="idA7A6D4B6FCF440B8806957DB0EAB7BA7" style="OLC">
				<subsection id="id75EA585A00D646E3B790AF74D9FAFDB2"><enum>(b)</enum><header>Oahe, big bend,
				and fort randall dams and reservoirs</header>
					<paragraph id="idB544C968664D45CEB66E959BC85027A4"><enum>(1)</enum><header>In
				general</header><text>The Secretary, in cooperation with the State of South
				Dakota, all Indian tribes residing on reservations within the State of South
				Dakota, and other Federal agencies, shall develop and submit to Congress not
				later than January 2014, recommendations for financing and implementing
				mitigation plans for—</text>
						<subparagraph id="id48FE07F233AC4892A58332AC5776F289"><enum>(A)</enum><text>fish and wildlife
				and terrestrial losses, including the loss of Native American cultural
				resources, human remains, ceremonial plants and herbs, gathering rights, access
				to sacred sites, and other usufructuary rights, resulting from the construction
				and operation of the Oahe Dam and Reservoir, Big Bend Dam and Reservoir, and
				Fort Randall Dam and Reservoir; and</text>
						</subparagraph><subparagraph id="idCAA72227FCED41AEB33AA1BF7E25E5F0"><enum>(B)</enum><text>fish and wildlife
				and terrestrial losses and any impacts to groundwater resulting from the
				construction and operation of the dams and reservoirs on the Missouri River
				tributaries within the State of South Dakota.</text>
						</subparagraph></paragraph><paragraph id="id9504952EC8734E428A9226EED3BE63DE"><enum>(2)</enum><header>Administration</header><text>In
				carrying out this section—</text>
						<subparagraph id="idC94DCD2FC10F43B49CA386F4EA0C4145"><enum>(A)</enum><text>the Secretary
				shall—</text>
							<clause id="id761BF8BA77C84D078D612A54CDA5FF53"><enum>(i)</enum><text>issue regulations
				that set forth procedures for meaningful consultation with the Indian tribes
				concerning the preservation and protection of Native American cultural
				resources, human remains, ceremonial plants and herbs, gathering rights, and
				access to sacred sites; and</text>
							</clause><clause id="id4E30F2FE46314CAA946040FCDABE3A48"><enum>(ii)</enum><text>provide the
				Indian tribes with the opportunity to participate and concur in the development
				of the recommendations described in paragraph (1) before the Secretary submits
				the recommendations to Congress; and</text>
							</clause></subparagraph><subparagraph id="idF65A8BA103EC46ACB5976518060A62EB"><enum>(B)</enum><text>the Chief of
				Engineers, the Director of the National Park Service, and the Director of the
				United States Fish and Wildlife Service shall, at the request of the Secretary,
				provide any assistance the Secretary requires in preparing and completing the
				recommendations described in paragraph
				(1).</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF8D7D83BE8964FFD82B9B47BDB7C8352"><enum>7.</enum><header>Authorization of
			 Appropriations</header>
			<subsection id="idD346319646234D93974C09FB9AD1ACA9"><enum>(a)</enum><header>Planning,
			 design, and construction</header><text>Section 10(a) of the Mni Wiconi Project
			 Act of 1988 (Public Law 100–516; 102 Stat. 2571; 108 Stat. 4545; 116 Stat.

				the water systems described in subparagraph (A) shall be supplemented and used
				for the improvement, repair, and replacement of those systems, as determined by
				the Secretary pursuant to sections 3(i)(2)(B)(iii), 3A(h)(2)(B)(iii), and
				3B(h)(2)(B)(iii), after the date on which those systems are interconnected and
				transferred to the respective rural water supply system pursuant to sections
				3(a)(4), 3A(a)(4), and 3B(a)(4).</text>
							</subparagraph><subparagraph id="id37D3B73D04E54617BC08B7677EA27C33"><enum>(C)</enum><header>Initial
				improvements and repairs</header><text>Initial improvement and repairs of the
				transferred systems described in subparagraph (A) shall be completed in
				accordance with the plans under sections 3(i), 3A(h) and
				3B(h).</text>

				Chief of Engineers, the Director of the Indian Health Service, the
				Administrator of the Rural Housing Service, and the Administrator of the
				Economic Development Administration.</text>
						</subparagraph><subparagraph id="idC4937F66706647A784ED1067D534B8B2"><enum>(B)</enum><header>Submission</header><text>For
				each feasibility study updated under subparagraph (A), the Secretary shall, not
				later than 1 year after the date of enactment of this paragraph, submit to the
				Committee on Energy and Natural Resources of the Senate and the Committee on
				Natural Resources of the House of Representatives, a copy of the updated
				feasibility study, which shall address—</text>
							<clause id="idF16FC253D2FA44D6A39D36E57E7A4E72"><enum>(i)</enum><text>the rural,
				municipal, and industrial waste water disposal facilities and systems needs of
				the applicable reservation;</text>
							</clause><clause id="idB4865C922FA34F3DB812DB076578CD32"><enum>(ii)</enum><text>any deficiency
				assessments of the existing waste water disposal facilities and systems;</text>
							</clause><clause id="id89B0FD83811C4CDEB53B3EC327282BB8"><enum>(iii)</enum><text>cost estimates
				for construction of new facilities and systems and rehabilitating existing
				systems; and</text>
							</clause><clause id="id2453D74DD9A649018450C13941869432"><enum>(iv)</enum><text>cost estimates
				for the operation, maintenance, and replacement of the waste water disposal
				facilities and
				systems.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 Project emergency assistance planning act</header>
			<subsection id="id44BCA8C8C45F4FDEAA662B770F31AAA4"><enum>(a)</enum><header>Amendments</header><text>The
			 Mni Wiconi Project Act of 1988 (Public Law 100–516; 102 Stat. 2566) is amended
			 by adding at the end the following:</text>

				Assistance Planning Act of 2012</short-title></quote>.</text>
						</section><section id="id739088bfc94c43f289d4cc041dfd967f"><enum>202.</enum><header>Findings;
				purpose</header>
							<subsection id="id59ECB6535CF04CB7B8A6786AEE4E05AD"><enum>(a)</enum><header>Findings</header><text>Congress
				finds that—</text>
								<paragraph id="id905b2e1d44dd4ee894f5a04925448d92"><enum>(1)</enum><text>substantial
				amounts of Federal funds have been expended and will be expended on the
				planning, design, construction, operation, maintenance, and replacement of the
				Mni Wiconi Project Rural Water Systems for Indian tribes in fulfillment of
				tribal treaties and agreements and Federal law recognizing the trust
				responsibility and obligation of the United States to protect Indian
				tribes;</text>
								</paragraph><paragraph id="id8653152d3ab845d8a1d458ab65b6f53a"><enum>(2)</enum><text>the Mni Wiconi
				Project Rural Water Systems have been constructed, or will be constructed,
				pursuant to this Act;</text>
								</paragraph><paragraph id="id1f262509b3db4deea2d3efd2e68e6ab7"><enum>(3)</enum><text>the Mni Wiconi
				Project Rural Water Systems, or portions of the Mni Wiconi Project Rural Water
				Systems, have been paid for by the Secretary out of amounts authorized and
				appropriated by Congress;</text>
								</paragraph><paragraph id="id8b3f01723eca42059a90ae6179bcfd94"><enum>(4)</enum><text>no plan exists
				for providing emergency funding to the Mni Wiconi Project Rural Water Systems
				in the event of a major breakdown of 1 or more of the Systems; and</text>
								</paragraph><paragraph id="id9fafcbf9d9a44f539710fb2bda3c68ce"><enum>(5)</enum><text>the Secretaries
				shall develop a congressionally approved plan to meet the needs of the Mni
				Wiconi Project Rural Water Systems in emergency situations involving a major
				breakdown of a rural water system.</text>
								</paragraph></subsection><subsection id="id0a978e70144343ba8800dc2e472171ec"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this title is to direct the
				Secretaries to develop a comprehensive plan to fund and rehabilitate each rural
				water system authorized and funded by Congress under this Act.</text>
							</subsection></section><section id="id21fa3b357f6842af9cee78ce0afb074f"><enum>203.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph id="id42bdce823b274f3f973720de7f0ea28c"><enum>(1)</enum><header>Mni Wiconi
				Project Rural Water Systems</header><text>The term <term>Mni Wiconi Project
				Rural Water Systems</term> means—</text>
								<subparagraph id="id69BC404185514D079486FEFFC96913E0"><enum>(A)</enum><text>the Oglala Sioux
				Rural Water Supply System;</text>
								</subparagraph><subparagraph id="id032A3868392A40D6B406590E79A0CF15"><enum>(B)</enum><text>the Rosebud Sioux
				Rural Water Supply System;</text>
								</subparagraph><subparagraph id="id47B8B32B048048949757625A3347DD38"><enum>(C)</enum><text>the Lower Brule
				Sioux Rural Water Supply System; and</text>
								</subparagraph><subparagraph id="id0E94BD7188F84FA9A61EAD0C4CABD640"><enum>(D)</enum><text>the West River
				and Lyman-Jones Rural Water Systems.</text>
								</subparagraph></paragraph><paragraph id="idDCCCF5AB518C462D994C6A9C7FBE3660"><enum>(2)</enum><header>Secretaries</header><text>The
				term <term>Secretaries</term> means—</text>
								<subparagraph id="id22FFB3385EDA4813BB8661F8309EB7A1"><enum>(A)</enum><text>the Secretary of
				the Interior;</text>
								</subparagraph><subparagraph id="id4B627A332F5D4E149B19258D82CDC880"><enum>(B)</enum><text>the Secretary of
				Defense; and</text>
								</subparagraph><subparagraph id="idCF3A58A9BE8A44F6B4F1810CE74CA637"><enum>(C)</enum><text>the Secretary of
				Homeland Security.</text>
								</subparagraph></paragraph></section><section id="id67af5dec6ce84cc984addae724d41131"><enum>204.</enum><header>Mni Wiconi
				Project Rural Water Systems Emergency Plan</header>
							<subsection id="idd81b1e2f4def40a793932bc146060214"><enum>(a)</enum><header>In
				general</header><text>The Secretaries shall develop and implement a 5-year plan
				to meet the needs of the Mni Wiconi Project Rural Water Systems in emergency
				situations that include—</text>
								<paragraph id="id001e6c4977bc40b787ab17f5d0590c29"><enum>(1)</enum><text>an event that
				threatens the security of the Mni Wiconi Project Rural Water Systems;</text>
								</paragraph><paragraph id="idae1bbfca69424d1793d976b3ed733481"><enum>(2)</enum><text>a natural or
				manmade disaster; and</text>
								</paragraph><paragraph id="id619656004f7d46c19ec17e57cac1269c"><enum>(3)</enum><text>an act of
				terrorism.</text>
								</paragraph></subsection><subsection id="ide4f8dca0174847f3bff35a345daf2291"><enum>(b)</enum><header>Contents</header><text>Not
				later than January 1, 2014, the Secretaries, in consultation with the Indian
				tribes who own or have an interest in the Mni Wiconi Project Rural Water
				Systems, shall develop the plan described in subsection (a), which, at a
				minimum, shall include—</text>
								<paragraph id="id592E61F718FB44EFBAC5DE092CA008B8"><enum>(1)</enum><text>an assessment of
				the emergency management needs of each rural water system in the Mni Wiconi
				Project Rural Water Systems;</text>
								</paragraph><paragraph id="id5fd76e1d78a04ee6a05c089f22023ec7"><enum>(2)</enum><text>a description of
				the procedures for responding to emergency needs;</text>
								</paragraph><paragraph id="id8d3f7958e4e24e338cedfc0c7ccb13cd"><enum>(3)</enum><text>the
				classification of emergencies in the plan; and</text>
								</paragraph><paragraph id="idb25094d04aa44675ac65fad6fca0a3cd"><enum>(4)</enum><text>a description of
				the manner in which the emergency fund established by section 205 will be
				assessed to pay for the costs of emergencies.</text>
								</paragraph></subsection><subsection id="idc5f09fb52bb146348d79a113ec9c85da"><enum>(c)</enum><header>Updates</header><text>The
				Secretaries shall update the plan annually.</text>
							</subsection></section><section id="id2cdb473f36574ccd8b48926f1e2664c3"><enum>205.</enum><header>Mni Wiconi
				Project Emergency Assistance Fund</header>
							<subsection id="ID44ebc5c84ee04e7d993decdc4f53cfa4"><enum>(a)</enum><header>Establishment
				of Fund</header><text>There is established in the Treasury of the United States
				a fund to be known as the <quote>Mni Wiconi Emergency Assistance Fund</quote>
				(referred to in this section as the <quote>Fund</quote>), to be administered by
				the Secretary of the Interior, to be available without fiscal year limitation
				and subject to appropriation, to carry out this title.</text>
							</subsection><subsection id="ID9ead6bf495b5447f8b8d6ddc26cab559"><enum>(b)</enum><header>Transfers to
				Fund</header><text>The Fund shall consist of such amounts as are appropriated
				to the Fund.</text>
							</subsection><subsection id="IDe28214dbd69b4183b86261ba8eaa5e20"><enum>(c)</enum><header>Prohibition</header><text>Amounts
				in the Fund may not be made available for any purpose other than a purpose
				described in subsection (a).</text>
							</subsection><subsection id="ID07da58b629734be4945f49dadf73323a"><enum>(d)</enum><header>Annual
				reports</header>
								<paragraph id="id6888A87F785B4826BE72B08EB7FCB7EA"><enum>(1)</enum><header>In
				general</header><text>Not later than 60 days after the end of each fiscal year
				beginning with fiscal year 2013, the Secretary of the Interior shall submit to
				the Committee on Appropriations of the House of Representatives, the Committee
				on Appropriations of the Senate, and authorizing committees a report on the
				operation of the Fund during the fiscal year.</text>
								</paragraph><paragraph id="id282CC27FC11648EDA4ACAFB5B7C746E5"><enum>(2)</enum><header>Contents</header><text>Each
				report shall include, for the fiscal year covered by the report, the
				following:</text>
									<subparagraph id="ID885d3878ca8c42bba3c906ed4daf03ab"><enum>(A)</enum><text>A statement of
				the amounts deposited into the Fund.</text>
									</subparagraph><subparagraph id="ID0496eab1575648ada51a8420957ec2ba"><enum>(B)</enum><text>A description of
				the expenditures made from the Fund for the fiscal year, including the purpose
				of the expenditures.</text>
									</subparagraph><subparagraph id="IDff6136e44a714883835cca0b49673ade"><enum>(C)</enum><text>Recommendations
				for additional authorities to fulfill the purpose of the Fund.</text>
									</subparagraph><subparagraph id="IDd893a10175174d29ab0a83f45cb33bab"><enum>(D)</enum><text>A statement of
				the balance remaining in the Fund at the end of the fiscal
				year.</text>
									</subparagraph></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="idCFAF5C0DE678488683249962C7346E6C"><enum>(b)</enum><header>Separate
			 appropriations account</header><text>Section 1105(a) of title 31, United States
			 Code is amended—</text>
				<paragraph commented="no" id="idA1AA24827B0246269A60306B4321625D"><enum>(1)</enum><text>by redesignating
			 the second paragraph (37) (relating to a list of plans and reports) as
			 paragraph (39); and</text>
				</paragraph><paragraph id="idFBBC1E772727484E96693BB2BCFDBD4C"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDBF92F08F63649BFA96B8DD952C22435" style="OLC">
						<paragraph id="idE0628E2C1DF44F5D986404D76ED63410"><enum>(40)</enum><text>a separate
				statement for the Mni Wiconi Emergency Assistance Fund established under
				section 205 of the <short-title>Mni Wiconi Project
				Emergency Assistance Planning Act of 2012</short-title>, which shall include
				the estimated amount of deposits into the Fund, obligations, and outlays from
				the
				Fund.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idDE27B40F664A47E1A4FAC1B4C739A280"><enum>(c)</enum><header>Conforming
			 amendment</header><text>The Mni Wiconi Project Act of 1988 (Public Law 100–516;
			 102 Stat. 2566) is amended by inserting before the first section the
			 following:</text>
