		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Medicare Diabetes Prevention Act
			 of 2012</short-title></quote>.</text>
		</section><section id="id003183D74A024A5599580F7E83528E40"><enum>2.</enum><header>Diabetes
			 prevention under the Medicare program</header>
			<subsection id="id1f9e4caaf86a4c4d9adbce57a5fad87e"><enum>(a)</enum><header>Coverage of
			 diabetes prevention program services</header>
				<paragraph id="id4802f922016d41d7be69c18bf9e27fd3"><enum>(1)</enum><header>Coverage of
			 services</header>
					<subparagraph id="id915ab4bd920e478a896fc6a4c5797241"><enum>(A)</enum><header>In
			 general</header><text>Section 1861(s)(2) of the Social Security Act (42 U.S.C.
			 1395x(s)(2)) is amended—</text>
						<clause id="idab2f6265e0ef40eeaa6075a442957e65"><enum>(i)</enum><text>in
			 subparagraph (EE), by striking <quote>and</quote> after the semicolon at the
			 end;</text>
						</clause><clause id="id83ab7120151c4d4d97dd0d3711806a16"><enum>(ii)</enum><text>in
			 subparagraph (FF), by inserting <quote>and</quote> after the semicolon at the
			 end; and</text>
						</clause><clause id="id56d2d5bbe90b4330809af3e126e8f625"><enum>(iii)</enum><text>by adding at
			 the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="id7c7a18111bd549c5b934d7131f2f703d" style="OLC">
								<subitem id="id976ad54f3b554457adcd25b2f0c33798" indent="up5"><enum>(GG)</enum><text>items and services furnished under a
				diabetes prevention program (as defined in subsection (iii)(1)) to an eligible
				diabetes prevention program individual (as defined in subsection
				(iii)(2));</text>
								</subitem><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="iddb4b3ab72dd84ea38a269adb71e7f35d"><enum>(B)</enum><header>Definitions</header><text>Section
			 1861 of the Social Security Act (42 U.S.C. 1395x) is amended by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="idA4D5AD5228B0400F8BCF7157C6486D62" other-style="archaic" style="other">
							<subsection id="idbd08e6ab561b4e70bdc57b9dfa2e9eec"><enum>(iii)</enum><header>Diabetes prevention program; eligible diabetes prevention
		  program individual; qualified diabetes prevention program
		  provider</header><paragraph commented="no" display-inline="yes-display-inline" id="id7629543C50F14C3D8C441009BFD0FE14"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDC8D97353B9044BEBD4A26E58DEC7751"><enum>(A)</enum><text>The term <term>diabetes
				prevention program</term> means a program that—</text>
										<clause id="id14c40708d9d541f59fb7a2919c2e96b4" indent="up2"><enum>(i)</enum><text>meets the criteria described in
				subparagraph (B); and</text>
										</clause><clause id="id60f0b6ffce8241d39a245fb43307a17d" indent="up2"><enum>(ii)</enum><text>is furnished by a qualified diabetes
				prevention program provider (as defined in paragraph (3)(A)).</text>
										</clause></subparagraph><subparagraph id="ida7ac3073842849ea8babb8c3091ca34c" indent="up2"><enum>(B)</enum><text>The Secretary shall establish the
				criteria for a diabetes prevention program. Such criteria shall be in
				accordance with the standards under the National Diabetes Prevention Program,
				as established by the Centers for Disease Control and Prevention, and shall
				require that the program complies with the Federal regulations (concerning the
				privacy of individually identifiable health information) promulgated under
				section 264(c) of the Health Insurance Portability and Accountability Act of
				1996. In establishing such criteria, the Secretary may also consider other
				factors or clinical evidence as the Secretary determines appropriate.</text>
									</subparagraph><subparagraph id="idcbc7f861206b4588ab64de14eee953b8" indent="up2"><enum>(C)</enum><text>Items and services furnished under a
				diabetes prevention program may be furnished in a community setting, as defined
				by the Secretary.</text>
									</subparagraph><subparagraph id="id9a0038ca1f654e04907660b2500b04b4" indent="up2"><enum>(D)</enum><text>The Secretary shall establish
				procedures under which a qualified diabetes prevention program provider may
				contract with a diabetes prevention program delivery partner to furnish the
				items and services under a diabetes prevention program. For purposes of this
				subsection, the term <term>diabetes prevention program delivery partner</term>
				means an entity, including non-profit organizations, public and private
				hospitals, State and local departments of public health, and Federally
				qualified health centers, that meets criteria established by the Secretary.
				Such criteria shall be in accordance with the standards under the National
				Diabetes Prevention Program, as established by the Centers for Disease Control
				and Prevention. In establishing such criteria, the Secretary may also consider
				other factors or clinical evidence as the Secretary determines
				appropriate.</text>
									</subparagraph></paragraph><paragraph id="id4bdefd1b931844c49e2a0874c40364d7" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id2DEF3B231AAA40FC8B57F49E544A16A7"><enum>(A)</enum><text>The term <term>eligible
				diabetes prevention program individual</term> means an individual at risk for
				diabetes (as defined in subsection (yy)(2)) who would benefit from items and
				services under a diabetes prevention program, as determined based on criteria
				established by the Secretary.</text>
									</subparagraph><subparagraph id="id74B9910DFDFB450EB17E94F3D49C158D" indent="up1"><enum>(B)</enum><text>The criteria established under
				subparagraph (A) shall be in accordance with the standards under the National
				Diabetes Prevention Program, as established by the Centers for Disease Control
				and Prevention. In establishing such criteria, the Secretary may also consider
				other factors or clinical evidence as the Secretary determines
				appropriate.</text>
									</subparagraph></paragraph><paragraph id="id3d58cd78a9fe4eae8710cd13e9cded4b" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6A457E0DCE584A78A058A13AE33F890D"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id80E93FAE718C4EB9BD16A4C3F57C4C0A"><enum>(i)</enum><text>The term
				<term>qualified diabetes prevention program provider</term> means any entity,
				including a Federally qualified health center, that the Secretary
				determines—</text>
											<subclause id="id7E28E21A34C04A80AC8AFD4ECB1B1195" indent="up2"><enum>(I)</enum><text>is appropriate to furnish items and
				services under a diabetes prevention program; and</text>
											</subclause><subclause id="id2143A481A8B04C9F9CEFE8488AFE68EE" indent="up2"><enum>(II)</enum><text>meets criteria established by the
				Secretary, in consultation with the Centers for Disease Control and
				Prevention.</text>
											</subclause></clause><clause id="id533A7D6F87CA48CF92764270539FD4B9" indent="up2"><enum>(ii)</enum><text>A qualified diabetes prevention
				program provider may be, as determined appropriate by the Secretary, a supplier
				(as defined in subsection (d)), a provider of services (as defined in
				subsection (u)), a health insurance or services company, a community-based
				organization, or any other appropriate entity.</text>
										</clause></subparagraph><subparagraph id="id91efcd8231e44b549e27d094177e2765" indent="up1"><enum>(B)</enum><text>A qualified diabetes prevention
				program provider shall—</text>
										<clause id="id2188D1994428416AAFC9FDDE3811E1A7"><enum>(i)</enum><text>furnish the items and services under
				the diabetes prevention program through a delivery partner (pursuant to
				paragraph (1)(D)) unless no such delivery partner is available;</text>
										</clause><clause id="ide5515cef564d4976a427588f1840c2cf"><enum>(ii)</enum><text>manage and track the outcomes of a
				diabetes prevention program (including attendance and weight loss of
				participating individuals) through defined systems, including outcomes of
				programs furnished under contract with a diabetes prevention program delivery
				partner as defined in paragraph (1)(D);</text>
										</clause><clause id="ide4cb2b0f05c84b9ebece033b88ba4cc9"><enum>(iii)</enum><text>implement business processes to
				manage program workflow, such as eligibility, reporting, claims billing, class
				scheduling, and enrollment;</text>
										</clause><clause id="id7303c2424e484e509e33c28347d6744b"><enum>(iv)</enum><text>manage and verify billing accuracy
				and beneficiary eligibility (as described in paragraph (2));</text>
										</clause><clause id="id3d83ba4882a04c64b7ad3254f6304177"><enum>(v)</enum><text>comply with applicable laws and
				regulations and ensure such compliance by a diabetes prevention program
				delivery partner;</text>
										</clause><clause id="id6488656B13624555A2F55BE8A2467A4C"><enum>(vi)</enum><text>perform various forms of engagement
				with, and outreach to, eligible diabetes prevention program individuals,
				including those participating in programs furnished under contract with a
				diabetes prevention program delivery partner;</text>
										</clause><clause id="idBADE099C1D224492A4D2711F06C149B1"><enum>(vii)</enum><text>comply with all program integrity
				requirements as established by the Secretary; and</text>
										</clause><clause id="id799ffbe5368e4b03aa6df62809a22706"><enum>(viii)</enum><text>perform such other functions as
				established by the
				Secretary.</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ida17f25a3763c4ab6a0db676af758e339"><enum>(2)</enum><header>Amount of
			 payment</header><text>Section 1833(a)(1) of the Social Security Act (42 U.S.C.
			 1395l(a)(1)) is amended—</text>
					<subparagraph id="id751cfad8ade041f6be0902553b05da43"><enum>(A)</enum><text>by striking
			 <quote>and (Z)</quote> and inserting <quote>(Z)</quote>; and</text>
					</subparagraph><subparagraph id="id9c9943c8f40349a387809cd803a6b17f"><enum>(B)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (AA) with respect
			 to items and services furnished under a diabetes prevention program (as defined
			 in section 1861(iii)(1)), the amount paid shall be 100 percent of (i) except as
			 provided in clause (ii), the lesser of the actual charge for the items and
			 services or the amount determined under the fee schedule that applies to such
			 items and services under this part, as determined by the Secretary, and (ii) in
			 the case of such items and services that are covered OPD services (as defined
			 in subsection (t)(1)(B)), the amount determined under subsection
			 (t)</quote>.</text>
					</subparagraph></paragraph><paragraph id="id8f43609f717e45f5929ed13770f25458"><enum>(3)</enum><header>Waiver of
			 application of deductible</header><text>The first sentence of section 1833(b)
			 of the Social Security Act (42 U.S.C. 1395l(b)) is amended—</text>
					<subparagraph id="id52c29c45625e47f390eba6a7479c15ee"><enum>(A)</enum><text>by striking
			 <quote>and</quote> before <quote>(10)</quote>; and</text>
					</subparagraph><subparagraph id="idbf563176bece455c9f1428570c70775a"><enum>(B)</enum><text>by inserting
			 before the period the following: <quote>, and (11) such deductible shall not
			 apply with respect to items and services under a diabetes prevention program
			 (as defined in section 1861(iii)(1))</quote>.</text>
					</subparagraph></paragraph><paragraph id="idD31C6E40AB8D41BEA62CD0E6FFAF3DB1"><enum>(4)</enum><header>Assignment of
			 claims</header><text>Section 1842(b)(18)(C) of the Social Security Act (42
			 U.S.C. 1395u(b)(18)(C)) is amended by adding at the end the following new
			 clause:</text>
					<quoted-block act-name="Social" id="H2FD66F3238A14806AFA243151DDB1104" style="OLC">
						<clause commented="no" id="HAC5253037CC3417C9F1FC3D0C1F01C7E" indent="up2"><enum>(vii)</enum><text>A qualified diabetes prevention
				program provider (as defined in section
				1861(iii)(3)(A)).</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ida69e57a68ebd4a418628e824a0e8e98c"><enum>(5)</enum><header>Exclusion of
			 items and services under a diabetes prevention program from skilled nursing
			 facility prospective payment system</header><text>Section 1888(e)(2)(A)(ii) of
			 the Social Security Act (42 U.S.C. 1395yy(e)(2)(A)(ii)) is amended by inserting
			 <quote>items and services under a diabetes prevention program (as defined in
			 section 1861(iii)(1)),</quote> after <quote>qualified psychologist
			 services,</quote>.</text>
				</paragraph><paragraph id="idD709F72A49C04008ADA55056C0047164"><enum>(6)</enum><header>Inclusion in
			 Federally qualified health center services</header><text>Section 1861(aa)(3) of
			 the Social Security Act (42 U.S.C. 1395x(aa)(3)) is amended—</text>
					<subparagraph id="id1C2661935068415EB15D811C800D647F"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="id67E43C7C00BB4055B779D2F4C07002C4"><enum>(B)</enum><text>in subparagraph
			 (B), by striking the comma at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="id9B64ECCE1A1C4DB4ABE03CA268B7340E"><enum>(C)</enum><text>by adding after
			 subparagraph (B) the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="id52981A0A631A4C75B8EC201894390B43" style="OLC">
							<subparagraph id="idAE4E24030EFF47D4846079EBF34956F9" indent="up1"><enum>(C)</enum><text>items and services under a diabetes
				prevention program (as defined in section
				1861(iii)(1)),</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id63128fffdc3a4b9593d475b9bf7cc426"><enum>(7)</enum><header>Special
			 consideration for the dual eligible population</header><text>In implementing
			 the amendments made by this subsection, the Secretary of Health and Human
			 Services shall give special consideration to the needs of individuals who are
			 dually eligible for benefits under the Medicare and Medicaid programs.</text>
				</paragraph><paragraph id="id7c74377c1efb4c3382ada53d1a785f31"><enum>(8)</enum><header>Evaluation and
			 report to congress</header>
					<subparagraph id="id4c9327e6f6cf478988db613de4a643dd"><enum>(A)</enum><header>Evaluation</header><text>The
			 Secretary of Health and Human Services shall conduct an evaluation on the
			 coverage of items and services under a diabetes prevention program under the
			 Medicare program, as added by the amendments made by this subsection. Such
			 evaluation shall include an analysis of—</text>
						<clause id="idd56371a90798424fae97d2343fe740e1"><enum>(i)</enum><text>the
			 impact of the provision of such coverage on Medicare beneficiaries, including
			 the impact on various populations, such as individuals who are dually eligible
			 for benefits under the Medicare and Medicaid programs, and the impact of the
			 provision of such coverage on health disparities;</text>
						</clause><clause id="id1b6de4b215aa4555b59cca3b83f4e606"><enum>(ii)</enum><text>the rate at
			 which physicians refer eligible diabetes prevention program individuals to
			 diabetes prevention programs under the Medicare program;</text>
						</clause><clause id="id1e629297d7cd442d9c96da0cd9387d6f"><enum>(iii)</enum><text>Medicare
			 beneficiary participation levels in diabetes prevention programs under the
			 Medicare program and the awareness of Medicare beneficiaries of the
			 benefit;</text>
						</clause><clause id="id0a4e3302c57c4db79a5c18e68b18a606"><enum>(iv)</enum><text>the health
			 outcomes resulting from completion of a diabetes prevention program under the
			 Medicare program;</text>
						</clause><clause id="iddfd2e61cd5424f19b32792bad7118ba2"><enum>(v)</enum><text>program integrity
			 protections important to diabetes prevention programs under the Medicare
			 program; and</text>
						</clause><clause id="id5a6dbe8d63d64b289aeca493167d9a34"><enum>(vi)</enum><text>other areas
			 determined appropriate by the Secretary.</text>
						</clause></subparagraph><subparagraph id="idffd9495775a24f3bb3f21353af3f8e2f"><enum>(B)</enum><header>Report</header><text>Not
			 later than January 1, 2018, the Secretary of Health and Human Services shall
			 submit to Congress a report on the evaluation conducted under subparagraph (A),
			 together with recommendations for such legislation and administrative actions
			 as the Secretary determines appropriate.</text>
					</subparagraph></paragraph><paragraph id="id8d4b53f3687a466b875e5682b9153a90"><enum>(9)</enum><header>Effective
			 date</header><text>The amendments made by paragraphs (1) through (6) shall
			 apply with respect to services furnished on or after January 1, 2014.</text>
				</paragraph></subsection><subsection id="idfc5e9229bea74473883c2581d8a09a87"><enum>(b)</enum><header>Inclusion of
			 referral rates to diabetes prevention programs in the medicare physician
			 quality reporting system</header><text>Section 1848(k)(2)(C)(i) of the Social
			 Security Act (42 U.S.C. 1395w–4(k)(2)(C)(i)) is amended by adding at the end
			 the following new sentence: <quote>For purposes of reporting data on quality
			 measures for covered professional services furnished during 2017 and each
			 subsequent year, the quality measures specified under this paragraph shall
			 include a measure with respect to referrals of eligible diabetes prevention
			 program individuals (as defined in paragraph (2) of section 1861(iii)) to
			 diabetes prevention programs (as defined in paragraph (1) of such
			 section).</quote>.</text>
			</subsection><subsection id="idca6a3764be364f54b2e3503278357e08"><enum>(c)</enum><header>Inclusion of
			 diabetes risk assessment in medicare personalized prevention plan</header>
				<paragraph id="idee560b3a53b4425391cbb1ebf147e7cc"><enum>(1)</enum><header>In
			 general</header><text>Section 1861(hhh)(2)(C) of the Social Security Act (42
			 U.S.C. 1395x(hhh)(2)(C)) is amended by inserting before the period at the end
			 the following: <quote>, and an assessment of whether the individual is an
			 individual at risk for diabetes (as defined in subsection
			 (yy)(2))</quote>.</text>
				</paragraph><paragraph id="id6d7a6f80951d447e81ce1de240441fc3"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply to
			 personalized prevention plans created or updated on or after January 1,
			 2014.</text>
				</paragraph></subsection></section><section id="id0747DE0AC41F451582E0DC3772804F9D"><enum>3.</enum><header>Findings; sense
			 of the Senate regarding diabetes prevention under the Medicaid program</header>
			<subsection id="id0B004A8730E14C2DB70803D68DAB74D6"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
				<paragraph id="idbc6f8bd0f4e1419c9e10cf51fc4d7b1a"><enum>(1)</enum><text>The prevalence
			 and cost of diabetes is a significant concern for State Medicaid programs. By
			 2020, the Medicaid program is expected to cover 13,000,000 people with diabetes
			 and about 9,000,000 people who may have pre-diabetes. By 2020, States will
			 spend an estimated $83,000,000,000 on individuals with diabetes or
			 pre-diabetes.</text>
				</paragraph><paragraph id="idb8b53b88f1e64909ae6e6580d39be6e6"><enum>(2)</enum><text>The National
			 Diabetes Prevention Program, as established by the Centers for Disease Control
			 and Prevention, has been proven to reduce the onset of diabetes in at-risk
			 adults by 58 percent, using a cost-effective, community-based
			 intervention.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id030287EE862A4ED183451787085AA744"><enum>(b)</enum><header>Sense of the
			 Senate</header><text>It is the sense of the Senate that the National Diabetes
			 Prevention Program presents an opportunity for States to reduce the incidence
			 of diabetes among individuals enrolled in their Medicaid programs.</text>
