		<section id="H5BDACC9E4C9C471881EDE2E178EAF478" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Child Protection Act of
			 2012</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H46EACDC68B1243E8B30A391A35631502" section-type="subsequent-section"><enum>2.</enum><header>Enhanced penalties for
			 possession of child pornography</header>
			<subsection id="H055F940183174E1B9D79439C48CD2766"><enum>(a)</enum><header>Certain
			 activities relating to material involving the sexual exploitation of
			 minors</header><text>Section 2252(b)(2) of title 18, United States Code, is
			 amended by inserting after <quote>but if</quote> the following: <quote>any
			 visual depiction involved in the offense involved a prepubescent minor or a
			 minor who had not attained 12 years of age, such person shall be fined under
			 this title and imprisoned for not more than 20 years, or if</quote>.</text>
			</subsection><subsection id="H563F8A8AE9A5466AB510B98058971CCF"><enum>(b)</enum><header>Certain
			 activities relating to material constituting or containing child
			 pornography</header><text>Section 2252A(b)(2) of title 18, United States Code,
			 is amended by inserting after <quote>but, if</quote> the following: <quote>any
			 image of child pornography involved in the offense involved a prepubescent
			 minor or a minor who had not attained 12 years of age, such person shall be
			 fined under this title and imprisoned for not more than 20 years, or
			 if</quote>.</text>
			</subsection></section><section id="HC60C2BF1DB1D4E96992315DD0521B784"><enum>3.</enum><header>Protection of
			 child witnesses</header>
			<subsection id="H8D7B510BB60048B297B0B8CA21190172"><enum>(a)</enum><header>Civil action To
			 restrain harassment of a victim or witness</header><text display-inline="yes-display-inline">Section 1514 of title 18, United States
			 Code, is amended—</text>
				<paragraph id="H70BBA08E92BF475EB7CC6B17021A8B00"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H6ADA5FDE6B0F4A95972C71DD3B7E2897"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="HF82D476E757E43EBBEF57968F1DD6946"><enum>(i)</enum><text>by
			 inserting <quote>or its own motion,</quote> after <quote>attorney for the
			 Government,</quote>; and</text>
						</clause><clause id="HC2B8DBF71CED4D6AAF652256FF3FA9E4"><enum>(ii)</enum><text>by
			 inserting <quote>or investigation</quote> after <quote>Federal criminal
			 case</quote> each place it appears;</text>
						</clause></subparagraph><subparagraph id="H91BE38A0BA5E41B194D52870E251D2E0"><enum>(B)</enum><text>by redesignating
			 paragraphs (2), (3), and (4) as paragraphs (3), (4), and (5),
			 respectively;</text>
					</subparagraph><subparagraph id="HCF8B041A57CC49D29D2C14979A844160"><enum>(C)</enum><text>by inserting after
			 paragraph (1) the following:</text>
						<quoted-block id="H4FFE307AC85E406D848563855B6CE603" style="OLC">
							<paragraph id="H56FF2350E5474B65B19FABA746D5FE4F"><enum>(2)</enum><text>In the case of a
				minor witness or victim, the court shall issue a protective order prohibiting
				harassment or intimidation of the minor victim or witness if the court finds
				evidence that the conduct at issue is reasonably likely to adversely affect the
				willingness of the minor witness or victim to testify or otherwise participate
				in the Federal criminal case or investigation. Any hearing regarding a
				protective order under this paragraph shall be conducted in accordance with
				paragraphs (1) and (3), except that the court may issue an ex parte emergency
				protective order in advance of a hearing if exigent circumstances are present.
				If such an ex parte order is applied for or issued, the court shall hold a
				hearing not later than 14 days after the date such order was applied for or is
				issued.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HD367A868AFE44D7C8DF1C6B085D4F826"><enum>(D)</enum><text>in paragraph (4),
			 as so redesignated, by striking <quote>(and not by reference to the complaint
			 or other document)</quote>; and</text>
					</subparagraph><subparagraph id="HEE52A3F65B914F17818FA1CFF3091807"><enum>(E)</enum><text>in paragraph (5),
			 as so redesignated, in the second sentence, by inserting before the period at
			 the end the following: <quote>, except that in the case of a minor victim or
			 witness, the court may order that such protective order expires on the later of
			 3 years after the date of issuance or the date of the eighteenth birthday of
			 that minor victim or witness</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HA8681261075340DB99F1461AC9344272"><enum>(2)</enum><text>by striking
			 subsection (c) and inserting the following:</text>
					<quoted-block id="HFD13003B70DA4E21B8807C578FBDBD37" style="OLC">
						<subsection id="H6104FACA3012488AAFD102EBAF74A136"><enum>(c)</enum><text>Whoever knowingly
				and intentionally violates or attempts to violate an order issued under this
				section shall be fined under this title, imprisoned not more than 5 years, or
				both.</text>
						</subsection><subsection id="H74ED5B684CEE4EC2B9EF3CF1C8AB7F10"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H289F711B5C65486E91F527C349C128D3"><enum>(1)</enum><text>As used in this
				section—</text>
								<subparagraph id="H790017AA2D324BEE8A92EB38A51F7007" indent="up1"><enum>(A)</enum><text>the term <term>course of
				conduct</term> means a series of acts over a period of time, however short,
				indicating a continuity of purpose;</text>
								</subparagraph><subparagraph id="H5421CD72B140410BBF50FBE7C2B0B06F" indent="up1"><enum>(B)</enum><text>the term <term>harassment</term> means
				a serious act or course of conduct directed at a specific person that—</text>
									<clause id="H15E41568D84B47B49063ADBE15D90B01"><enum>(i)</enum><text>causes substantial emotional
				distress in such person; and</text>
									</clause><clause id="HDF36C04D7C68419BA792F96FA347A5E0"><enum>(ii)</enum><text>serves no legitimate
				purpose;</text>
									</clause></subparagraph><subparagraph id="HC877EDA335164B2ABB5D8EE2DCA8C621" indent="up1"><enum>(C)</enum><text>the term <term>immediate family
				member</term> has the meaning given that term in section 115 and includes
				grandchildren;</text>
								</subparagraph><subparagraph id="HC9E12C3849214C278D08DE2C4FFE9419" indent="up1"><enum>(D)</enum><text>the term <term>intimidation</term>
				means a serious act or course of conduct directed at a specific person
				that—</text>
									<clause id="HA86F9EF5CCCE489F9A74E3D5FB4CA7F0"><enum>(i)</enum><text>causes fear or apprehension in such
				person; and</text>
									</clause><clause id="H6A2A567709D54099981827766BD04ED4"><enum>(ii)</enum><text>serves no legitimate
				purpose;</text>
									</clause></subparagraph><subparagraph id="H8E757BDAE708488F8255873049CF31F3" indent="up1"><enum>(E)</enum><text>the term <term>restricted personal
				information</term> has the meaning given that term in section 119;</text>
								</subparagraph><subparagraph id="H35491E99A5C648C0862C799DD9611F68" indent="up1"><enum>(F)</enum><text>the term <term>serious act</term>
				means a single act of threatening, retaliatory, harassing, or violent conduct
				that is reasonably likely to influence the willingness of a victim or witness
				to testify or participate in a Federal criminal case or investigation;
				and</text>
								</subparagraph><subparagraph id="H5B1EBC73DD3C40129E68613F44833714" indent="up1"><enum>(G)</enum><text>the term <term>specific person</term>
				means a victim or witness in a Federal criminal case or investigation, and
				includes an immediate family member of such a victim or witness.</text>
								</subparagraph></paragraph><paragraph id="HDE3CE5B2DB8549CF98518E6BC359816C" indent="up1"><enum>(2)</enum><text>For purposes of subparagraphs (B)(ii)
				and (D)(ii) of paragraph (1), a court shall presume, subject to rebuttal by the
				person, that the distribution or publication using the Internet of a photograph
				of, or restricted personal information regarding, a specific person serves no
				legitimate purpose, unless that use is authorized by that specific person, is
				for news reporting purposes, is designed to locate that specific person (who
				has been reported to law enforcement as a missing person), or is part of a
				government-authorized effort to locate a fugitive or person of interest in a
				criminal, antiterrorism, or national security
				investigation.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9D25551710B14AC98DAD3B7C9AD8738A"><enum>(b)</enum><header>Sentencing
			 guidelines</header><text>Pursuant to its authority under section 994 of title
			 28, United States Code, and in accordance with this section, the United States
			 Sentencing Commission shall review and, if appropriate, amend the Federal
			 sentencing guidelines and policy statements to ensure—</text>
				<paragraph id="H46595CC197C349379DFB9039747631C4"><enum>(1)</enum><text>that the
			 guidelines provide an additional penalty increase above the sentence otherwise
			 applicable in Part J of Chapter 2 of the Guidelines Manual if the defendant was
			 convicted of a violation of section 1591 of title 18, United States Code, or
			 chapters 109A, 109B, 110, or 117 of title 18, United States Code; and</text>
				</paragraph><paragraph id="H4F4294DCABB84EA2958AA8F3EA53B0A6"><enum>(2)</enum><text>if the offense
			 described in paragraph (1) involved causing or threatening to cause physical
			 injury to a person under 18 years of age, in order to obstruct the
			 administration of justice, an additional penalty increase above the sentence
			 otherwise applicable in Part J of Chapter 2 of the Guidelines Manual.</text>
				</paragraph></subsection></section><section id="H162EFACF413149488C05B360327C2925"><enum>4.</enum><header>Subpoenas to
			 Facilitate the Arrest of Fugitive Sex Offenders</header>
			<subsection id="H127392E897FA465EB36F32383948184D"><enum>(a)</enum><header>Administrative
			 subpoenas</header>
				<paragraph id="HDAD435AC643A461AB01C34787E982167"><enum>(1)</enum><header>In
			 General</header><text>Section 3486(a)(1) of title 18, United States Code, is
			 amended—</text>
					<subparagraph id="H50C024364A9146CE96DF979C31C4530A"><enum>(A)</enum><text>in subparagraph
			 (A)—</text>
						<clause id="HB0F227D3E7E34A7B8F7BEEADCBD587E6"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>or</quote> at the end;</text>
						</clause><clause id="H839BBBA900C64588BE0B88D28DFE2F14"><enum>(ii)</enum><text>by
			 redesignating clause (ii) as clause (iii); and</text>
						</clause><clause id="H0226E2C54596488981BD7CBF47DC5413"><enum>(iii)</enum><text>by
			 inserting after clause (i) the following:</text>
							<quoted-block id="H998359832E66446C9A9E1038F6D78A7F" style="OLC">
								<clause id="H871B818AC612434CB4108185FBB6C997" indent="up2"><enum>(ii)</enum><text>an unregistered sex offender
				conducted by the United States Marshals Service, the Director of the United
				States Marshals Service; or</text>
								</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HC8870BC98BF342B09CE5A68E26C9FFFE"><enum>(B)</enum><text>in subparagraph
			 (D)—</text>
						<clause id="H6660AB9B65974F2B900C46944C0D6D17"><enum>(i)</enum><text>by
			 striking <quote>paragraph, the term</quote> and inserting the
			 following:</text>
							<quoted-block display-inline="yes-display-inline" id="HC4C972932C4C4D258F40B99B3085AE68" style="OLC">
								<text>paragraph—</text><clause id="H7A94AFB855D04801BC8ACEA0036C054C" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">the

			 striking the period at the end and inserting <quote>; and</quote>; and</text>
						</clause><clause id="HEF03A8ED46414B3886B5214368EE135E"><enum>(iii)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block id="H5B76C3CDA04548BA997ED63EBB65FCFD" style="OLC">
								<clause id="HAFF68E6EC13B42F1B13AA849ADE3280E" indent="up2"><enum>(ii)</enum><text>the term <term>sex offender</term>
				means an individual required to register under the Sex Offender Registration
				and Notification Act (42 U.S.C. 16901 et
				seq.).</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="HE4EF03DC4A13434BBFC3F22672A65995"><enum>(2)</enum><header>Technical and
			 Conforming Amendments</header><text>Section 3486(a) of title 18, United States
			 Code, is amended—</text>
					<subparagraph id="HD49F47CCD7104992B27EBBC7F258A44D"><enum>(A)</enum><text>in paragraph
			 (6)(A), by striking <quote>United State</quote> and inserting <quote>United
			 States</quote>;</text>
					</subparagraph><subparagraph id="H4D90251B0BE2444EB3F147BC98FB71B9"><enum>(B)</enum><text>in paragraph (9),
			 by striking <quote>(1)(A)(ii)</quote> and inserting <quote>(1)(A)(iii)</quote>;
			 and</text>
					</subparagraph><subparagraph id="H9002A1C490E548F8AEBEBDE6722A0598"><enum>(C)</enum><text>in paragraph (10),
			 by striking <quote>paragraph (1)(A)(ii)</quote> and inserting <quote>paragraph
			 (1)(A)(iii)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HC4E6CAC915AF4C7A8322DAA0AA034733"><enum>(b)</enum><header>Judicial
			 subpoenas</header><text>Section 566(e)(1) of title 28, United States Code, is
			 amended—</text>
				<paragraph id="H03E88C6BE29E441C8AB1D3C5F62A45A1"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H81F874E667864648AFD5D83C5C5C18DB"><enum>(2)</enum><text>in subparagraph
			 (B), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H23B79316A54B4E38BC78F40A42CB63E4"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HFAAEB46841C94F0C8E4D355DB828C273" style="OLC">
						<subparagraph id="HC2DC4594285947D385B4C4DAC22BFC0D" indent="up1"><enum>(C)</enum><text>issue administrative subpoenas in
				accordance with section 3486 of title 18, solely for the purpose of
				investigating unregistered sex offenders (as defined in such section
				3486).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H7676C2F2339740CFBC511D33AA3C1579"><enum>5.</enum><header>Increase in
			 funding limitation for training courses for ICAC task forces</header><text display-inline="no-display-inline">Section 102(b)(4)(B) of the PROTECT Our
			 Children Act of 2008 (42 U.S.C. 17612(b)(4)(B)) is amended by striking
			 <quote>$2,000,000</quote> and inserting <quote>$4,000,000</quote>.</text>
		</section><section commented="no" id="H4BE6463ED89040A1B26EEEF5BAF869C9"><enum>6.</enum><header>National
			 Coordinator for Child Exploitation Prevention and Interdiction</header><text display-inline="no-display-inline">Section 101(d)(1) of the PROTECT Our
			 Children Act of 2008 (42 U.S.C. 17611(d)(1)) is amended—</text>
			<paragraph commented="no" id="H69147CAD00AF4302BC0E42CDBC8C3578"><enum>(1)</enum><text>by striking
			 <quote>to be responsible</quote> and inserting the following: <quote>with
			 experience in investigating or prosecuting child exploitation cases as the
			 National Coordinator for Child Exploitation Prevention and Interdiction who
			 shall be responsible</quote>; and</text>
			</paragraph><paragraph commented="no" id="H936440914D014F24945C8DBE43CCF041"><enum>(2)</enum><text>by adding at the
			 end the following: <quote>The National Coordinator for Child Exploitation
			 Prevention and Interdiction shall be a position in the Senior Executive
			 Service.</quote>.</text>
			</paragraph></section><section id="HA4BB8F3FEBC6446B8A9525804CCDB786"><enum>7.</enum><header>Reauthorization
			 of ICAC task forces</header><text display-inline="no-display-inline">Section
			 107(a) of the PROTECT Our Children Act of 2008 (42 U.S.C. 17617(a)) is
			 amended—</text>
			<paragraph id="H63AE1E02324B4E078B9589B35E5BC769"><enum>(1)</enum><text>in paragraph (4),
			 by striking <quote>and</quote>;</text>
			</paragraph><paragraph id="H5745C6DF601446DEBA017BDC770DD80B"><enum>(2)</enum><text>in paragraph (5),
			 by striking the period at the end; and</text>
			</paragraph><paragraph id="HE61841B43A394E72A46C041725375990"><enum>(3)</enum><text>by inserting after
			 paragraph (5) the following:</text>

				2018.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H81B9233135FF48DFADD03004AF0CF408"><enum>8.</enum><header>Clarification of
			 <quote>high-priority suspect</quote></header><text display-inline="no-display-inline">Section 105(e)(1)(B)(i) of the PROTECT Our
			 Children Act of 2008 (42 U.S.C. 17615(e)(1)(B)(i)) is amended by striking
			 <quote>the volume</quote> and all that follows through <quote>or
			 other</quote>.</text>
		</section><section id="H58D0C5029F724309BA3BB5141033C7FF"><enum>9.</enum><header>Report to
			 Congress</header><text display-inline="no-display-inline">Not later than 90
			 days after the date of enactment of this Act, the Attorney General shall submit
			 to the Committee on the Judiciary of the House of Representatives and the
			 Committee on the Judiciary of the Senate a report on the status of the Attorney
			 General’s establishment of the National Internet Crimes Against Children Data
			 System required to be established under section 105 of the PROTECT Our Children
			 Act of 2008 (42 U.S.C. 17615).</text>
