			<paragraph id="id61048a3ddf044b5b95728dea95b8fd7a"><enum>(1)</enum><header>Congressional
			 intelligence committees</header><text>The term <quote>congressional
			 intelligence committees</quote> means—</text>
				<subparagraph id="id6f7d662908d04e359f5b1b1176b7faf5"><enum>(A)</enum><text>the Select
			 Committee on Intelligence of the Senate; and</text>
				</subparagraph><subparagraph id="id51c199b08e614afd953916352dcf822f"><enum>(B)</enum><text>the Permanent
			 Select Committee on Intelligence of the House of Representatives.</text>
				</subparagraph></paragraph><paragraph id="idd07ac8bdf95846fe8d995c051eb3e99a"><enum>(2)</enum><header>Intelligence
			 community</header><text>The term <quote>intelligence community</quote> has the
			 meaning given that term in section 3(4) of the National Security Act of 1947
			 (50 U.S.C. 401a(4)).</text>
			</paragraph></section><title id="idec4c1741e375445698fede108523a2e8"><enum>I</enum><header>Budget and
			 personnel authorizations</header>
			<section id="idecb8773aa7564c19bd285b429c470ee9"><enum>101.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Funds are
			 hereby authorized to be appropriated for fiscal year 2013 for the conduct of
			 the intelligence and intelligence-related activities of the following elements
			 of the United States Government:</text>
				<paragraph id="idf1ec30827dd94f8c9b2d40ea6ffd32da"><enum>(1)</enum><text>The Office of the
			 Director of National Intelligence.</text>
				</paragraph><paragraph id="iddb92636e711e4563b0812a85449003e9"><enum>(2)</enum><text>The Central
			 Intelligence Agency.</text>
				</paragraph><paragraph id="id4ef2ccdda9a14a7da86994e6b86bc30e"><enum>(3)</enum><text>The Department of
			 Defense.</text>
				</paragraph><paragraph id="idfd096309daa74a3eb6ff97bd559d567c"><enum>(4)</enum><text>The Defense
			 Intelligence Agency.</text>

				</paragraph></section><section id="id1c9832ad4d9e40969e6b0f033a84919a"><enum>102.</enum><header>Classified
			 schedule of authorizations</header>
				<subsection id="id2dddfa2ea9a348989b87f994aeee3fed"><enum>(a)</enum><header>Specifications
			 of amounts and personnel levels</header><text>The amounts authorized to be
			 appropriated under section 101 and the authorized total personnel levels by
			 program (expressed as full-time equivalent positions) for the conduct of the
			 intelligence activities of the elements listed in paragraphs (1) through (16)
			 of section 101, are those specified in the classified Schedule of
			 Authorizations prepared to accompany the bill S. _______ of the One Hundred
			 Twelfth Congress. The classified Schedule of Authorizations is incorporated by
			 reference into this Act and has the legal status of a public law.</text>
				</subsection><subsection id="id69ED3D377421424FAB516B7670509DA0"><enum>(b)</enum><header>Availability of
			 classified schedule of authorizations</header><text>The classified Schedule of
			 Authorizations referred to in subsection (a) shall be made available to the
			 Committee on Appropriations of the Senate, the Committee on Appropriations of
			 the House of Representatives, and to the President. The President shall provide
			 for suitable distribution of the Schedule, or of appropriate portions of the
			 Schedule, within the executive branch.</text>
				</subsection></section><section id="idab379026aebf443ca51c4071add8dd79"><enum>103.</enum><header>Personnel
			 ceiling adjustments</header>
				<subsection id="id4612d92ec1d44a258ab9feb9881736c9"><enum>(a)</enum><header>Authority for
			 increases</header><text>The Director of National Intelligence may authorize the
			 employment of civilian personnel in excess of the number of full-time
			 equivalent positions for fiscal year 2013 authorized by the classified Schedule
			 of Authorizations referred to in section 102(a) if the Director of National
			 Intelligence determines that such action is necessary to the performance of
			 important intelligence functions, except that the number of personnel employed
			 in excess of the number authorized under such section may not, for any element
			 of the Intelligence Community, exceed 3 percent of the number of civilian
			 personnel authorized under such section for such element.</text>
				</subsection><subsection id="id61b452fc751a4932b330d332f841ba17"><enum>(b)</enum><header>Treatment of
			 certain personnel</header><text>The Director of National Intelligence shall
			 establish guidelines that govern, for each element of the Intelligence
			 Community, the treatment under the personnel levels authorized under section
			 102(a), including any exemption from such personnel levels, of employment or
			 assignment in—</text>
					<paragraph id="id43020c81a86748f8be7392ca725aa7af"><enum>(1)</enum><text>a student
			 program, trainee program, or similar program;</text>
					</paragraph><paragraph id="id3be4646953c04a68bbfa158ba08b9598"><enum>(2)</enum><text>a reserve corps
			 or as a reemployed annuitant; or</text>
					</paragraph><paragraph id="id6ef69b8e7c1b436ba13949aeeeacc08b"><enum>(3)</enum><text>details, joint
			 duty, or long term, full-time training.</text>
					</paragraph></subsection><subsection commented="no" id="id442555cd7c89451fa2f112f540dab877"><enum>(c)</enum><header>Notice to
			 congressional intelligence committees</header><text>The Director of National
			 Intelligence shall notify the congressional intelligence committees in writing
			 at least 15 days prior to the initial exercise of an authority described in
			 subsection (a).</text>
				</subsection></section><section id="id82025066aa0f4d1b9561c05e85422b92"><enum>104.</enum><header>Intelligence
			 community management account</header>
				<subsection id="ida3be06a3eddb454584bd7900191b5d34"><enum>(a)</enum><header>Authorization
			 of appropriations</header>
					<paragraph id="idCC856760A31640D3BBF60660A3110C2E"><enum>(1)</enum><header>In
			 general</header><text>There is authorized to be appropriated for the
			 Intelligence Community Management Account of the Director of National
			 Intelligence for fiscal year 2013 the sum of $542,346,000.</text>
					</paragraph><paragraph id="id77264F4E1F6942A3949ABAEF86FF0041"><enum>(2)</enum><header>Availability of
			 certain funds</header><text>Of the amounts authorized to be appropriated by
			 paragraph (1), funds identified in the classified Schedule of Authorizations
			 referred to in section 102(a) for advanced research and development shall
			 remain available until September 30, 2014.</text>
					</paragraph></subsection><subsection id="id7906da2fda6c433e98b02811c643300a"><enum>(b)</enum><header>Authorized
			 personnel levels</header><text>The elements within the Intelligence Community
			 Management Account of the Director of National Intelligence are authorized 827
			 full-time or full-time equivalent personnel as of September 30, 2013. Personnel
			 serving in such elements may be permanent employees of the Office of the
			 Director of National Intelligence or personnel detailed from other elements of
			 the United States Government.</text>
				</subsection><subsection id="id696C3F02C6814FD79195CEFFB23DCDFD"><enum>(c)</enum><header>Classified
			 authorization of appropriations</header>
					<paragraph id="id6A40C76017C944709644196DFAF56232"><enum>(1)</enum><header>Authorization
			 of appropriations</header><text>In addition to amounts authorized to be
			 appropriated for the Intelligence Community Management Account by subsection
			 (a), there are authorized to be appropriated for the Community Management
			 Account for fiscal year 2013 such additional amounts as are specified in the
			 classified Schedule of Authorizations referred to in section 102(a). Such
			 additional amounts for advanced research and development shall remain available
			 until September 30, 2014.</text>
					</paragraph><paragraph id="id1dd07a76ea9d40f1893f339a250e135d"><enum>(2)</enum><header>Authorization
			 of personnel</header><text>In addition to the personnel authorized by
			 subsection (b) for elements of the Intelligence Community Management Account as
			 of September 30, 2013, there are authorized such additional personnel for the
			 Community Management Account as of that date as are specified in the classified
			 Schedule of Authorizations referred to in section 102(a).</text>
					</paragraph></subsection></section></title><title id="id7a5d9d3ea4f54f75bfedebc1bbb471e3"><enum>II</enum><header>Central
			 Intelligence Agency Retirement and Disability System</header>
			<section id="id1543b45b90b9452089baff7a1a129f1c"><enum>201.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated for the Central Intelligence Agency Retirement
			 and Disability Fund for fiscal year 2013 the sum of $514,000,000.</text>
			</section></title><title id="id62a69b91cea0496b9184d47ac6d851e2"><enum>III</enum><header>General
			 intelligence community matters</header>
			<section id="id4A39212AD60C497FA19DEDFA318FA988"><enum>301.</enum><header>Restriction on
			 conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this
			 Act shall not be deemed to constitute authority for the conduct of any
			 intelligence activity which is not otherwise authorized by the Constitution or
			 the laws of the United States.</text>
			</section><section id="id6E13D4C14C7E42ECA17DBB202F4FC7C7"><enum>302.</enum><header>Increase in
			 employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for
			 salary, pay, retirement, and other benefits for Federal employees may be
			 increased by such additional or supplemental amounts as may be necessary for
			 increases in such compensation or benefits authorized by law.</text>
			</section><section id="idb83acead12db44ae8b2d760fe810428e"><enum>303.</enum><header>Non-reimbursable
			 details</header><text display-inline="no-display-inline">Section 113A of the
			 National Security Act of 1947 (50 U.S.C. 404h–1) is amended—</text>
				<paragraph id="id05E97FF4F94C49488F42FA387405F725"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>two years.</quote> and
			 inserting <quote>three years.</quote>; and</text>
				</paragraph><paragraph id="idDDC0C4FD12C1469B912CC81E8050DF87"><enum>(2)</enum><text>by adding at the
			 end <quote>A non-reimbursable detail made under this section shall not be
			 considered an augmentation of the appropriations of the receiving element of
			 the intelligence community.</quote>.</text>
				</paragraph></section><section id="id4C5AAADB62AE466FB84D07F1D5B6E8C1"><enum>304.</enum><header>Software
			 licensing</header>
				<subsection id="idB4E6979A08154462937BD118D7717068"><enum>(a)</enum><header>In
			 general</header><text>Not later than 120 days after the date of the enactment
			 of this Act, each chief information officer for an element of the intelligence
			 community, in consultation with the Chief Information Officer of the
			 intelligence community, shall—</text>
					<paragraph id="id9B75EC43F6D8433F996E05925048C551"><enum>(1)</enum><text>conduct an
			 inventory of software licenses held by such element, including utilized and
			 unutilized licenses; and</text>
					</paragraph><paragraph id="id344F05D211ED4D7CB5074FFFF641B089"><enum>(2)</enum><text>report the
			 results of such inventory to the Chief Information Officer of the intelligence
			 community.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id944826991D4A4E5B9D31CF5D03AA1688"><enum>(b)</enum><header>Reporting to
			 Congress</header><text>The Chief Information Officer of the intelligence
			 community shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id637AA36F1E8E4FD89E89BB91CC1D2AE7"><enum>(1)</enum><text>not later than
			 180 days after the date of the enactment of this Act, provide to the
			 congressional intelligence committees a copy of each report received by the
			 Chief Information Officer under subsection (a)(2), along with any comments the
			 Chief Information Officer wishes to provide; and</text>
					</paragraph><paragraph id="id0EB7F64C5C214E34AFA2EED1576CBC70"><enum>(2)</enum><text>transmit any
			 portion of a report submitted under paragraph (1) involving a component of a
			 department of the United States Government to the committees of the Senate and
			 of the House of Representatives with jurisdiction over such department
			 simultaneously with submission of such report to the congressional intelligence
			 committees.</text>
					</paragraph></subsection></section><section id="idCD3A9612DB094857B284E28FE0537C3F"><enum>305.</enum><header>Improper
			 Payments Elimination and Recovery Act of 2010 compliance</header>
				<subsection id="id3c90db0e19ce40a5a946fff0109d5284"><enum>(a)</enum><header>Plan for
			 compliance</header>
					<paragraph id="id33DACB6D31874979A33AE6F5010D0609"><enum>(1)</enum><header>In
			 general</header><text>The Director of National Intelligence, the Director of
			 the Central Intelligence Agency, the Director of the Defense Intelligence
			 Agency, the Director of the National Geospatial-Intelligence Agency, and the
			 Director of the National Security Agency shall each develop a corrective action
			 plan, with major milestones, that delineates how the Office of the Director of
			 National Intelligence and each such Agency will achieve compliance, not later
			 than September 30, 2013, with Improper Payments Elimination and Recovery Act of
			 2010 (Public Law 111–204; 124 Stat. 2224), and the amendments made by that
			 Act.</text>
					</paragraph><paragraph id="id74FCE2DC524B4BAE92EFC8848B0DB09E"><enum>(2)</enum><header>Submission to
			 Congress</header><text>Not later than 45 days after the date of the enactment
			 of this Act—</text>
						<subparagraph id="id79D2906F84214DACB9579642BED490C8"><enum>(A)</enum><text>each Director
			 referred to in paragraph (1) shall submit to the congressional intelligence
			 committees the corrective action plan required by such paragraph; and</text>
						</subparagraph><subparagraph id="id0B754BB42D144E34970F074BEF9E9FA4"><enum>(B)</enum><text>the Director of
			 the Defense Intelligence Agency, the Director of the National
			 Geospatial-Intelligence Agency, and the Director of the National Security
			 Agency shall each submit to the Committees on Armed Services of the Senate and
			 the House of Representatives the corrective action plan required by paragraph
			 (1) with respect to the applicable Agency.</text>
						</subparagraph></paragraph></subsection><subsection id="ida2fa9a6cd55146c1bc3d1793e628c652"><enum>(b)</enum><header>Review by
			 Inspectors General</header>
					<paragraph id="id566FAF008DE243EF8E3F0739F397640F"><enum>(1)</enum><header>In
			 general</header><text>Not later than 45 days after the completion of a
			 corrective action plan required by subsection (a)(1), the Inspector General of
			 the appropriate Agency, and in the case of the Director of National
			 Intelligence, the Inspector General of the Intelligence Community, shall
			 provide to the congressional intelligence committees an assessment of such plan
			 that includes—</text>
						<subparagraph id="idF520A8FBCD6146899C45B016C5128CE1"><enum>(A)</enum><text>the assessment of
			 the Inspector General of whether such Agency or Office is or is not likely to
			 reach compliance with the requirements of the Improper Payments Elimination and
			 Recovery Act of 2010 (Public Law 111–204; 124 Stat. 2224), and the amendments
			 made by that Act, by September 30, 2013; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D7511A68723484892B8066FE4C71641"><enum>(B)</enum><text>the basis of the
			 Inspector General for such assessment.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48D425618814470D8A319BB0965E150A"><enum>(2)</enum><header>Additional
			 submission of reviews of certain Inspectors General</header><text>Not later
			 than 45 days after the completion of a corrective action plan required by
			 subsection (a)(1), the Inspector General of the Defense Intelligence Agency,
			 the Inspector General of the National Geospatial-Intelligence Agency, and the
			 Inspector General of the National Security Agency shall each submit to the
			 Committees on Armed Services of the Senate and the House of Representatives the
			 assessment of the applicable plan provided to the congressional intelligence
			 committees under paragraph (1).</text>
					</paragraph></subsection></section><section commented="no" id="HCD94D10A978348F5BAE4C0F8D939A270"><enum>306.</enum><header>Authorities of
			 the Inspector General of the Intelligence Community</header><text display-inline="no-display-inline">Section 103H(j) of the National Security Act
			 of 1947 (50 U.S.C. 403–3h(j)) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H5EC215E82B774385B570A959EC034D0A" style="traditional">

			 unauthorized disclosures of classified information</header>
			<section id="id487c6a1131d24ae392ad261e14db2f06"><enum>501.</enum><header>Notification
			 regarding the authorized public disclosure of national intelligence</header>
				<subsection id="idb026a9c793284dc1ba8111bb5703f880"><enum>(a)</enum><header>Notification</header><text>Concurrent
			 with an authorized disclosure of national intelligence or intelligence related
			 to national security to the persons or entities described in subsection (b),
			 the government official responsible for authorizing the disclosure shall submit
			 to the congressional intelligence committees a notification of the disclosure
			 if—</text>
					<paragraph id="id0fbe8b2721194235a441c9bc891a0839"><enum>(1)</enum><text>at the time of
			 the disclosure—</text>
						<subparagraph id="idF5092DF2CA374C90AAC66DF6162F7DF7"><enum>(A)</enum><text>such intelligence
			 is classified; or</text>
						</subparagraph><subparagraph id="id9D1C80F7231B4EF599DE05FBBD3952E8"><enum>(B)</enum><text>is declassified
			 for the purpose of the disclosure; and</text>
						</subparagraph></paragraph><paragraph id="id8a603cd2b1174936a5c4adbcb30376a0"><enum>(2)</enum><text>the disclosure
			 will be made by an officer, employee, or contractor of the Executive
			 branch.</text>
					</paragraph></subsection><subsection id="id7EE1DA0FEE734B3D86BD2254BF951F90"><enum>(b)</enum><header>Persons or
			 entities described</header><text>The persons or entities described in this
			 subsection are as follows:</text>
					<paragraph id="id1bd35320aceb4cd5af9665e193bf8c5a"><enum>(1)</enum><text>Media personnel,
			 including any person or entity under contract or other binding agreement with
			 the media to provide analysis or commentary.</text>
					</paragraph><paragraph id="id2dfea943f84b48baacd2ce23b8a8b0bb"><enum>(2)</enum><text>Any person or
			 entity, if the disclosure described in subsection (a) is made with the intent
			 or knowledge that such information will be made publicly available.</text>
					</paragraph></subsection><subsection id="id09c9952d7ad84037854463ee23f1cd3f"><enum>(c)</enum><header>Content</header><text>Each
			 notification required under subsection (a) shall—</text>
					<paragraph id="idd94f2539ace54d5fa2813aef48777358"><enum>(1)</enum><text>provide the
			 specific title and authority of the individual authorizing the
			 disclosure;</text>
					</paragraph><paragraph id="ida57d636d268e4dd295a4c71e146d2156"><enum>(2)</enum><text>if applicable,
			 provide the specific title and authority of the individual who authorized the
			 declassification of the intelligence disclosed; and</text>
					</paragraph><paragraph id="id720c74df4c9b4ab0994dee4bbd06b62b"><enum>(3)</enum><text>describe the
			 intelligence disclosed, including the classification of the intelligence prior
			 to its disclosure or declassification and the rationale for making the
			 disclosure.</text>
					</paragraph></subsection><subsection id="idb0ea1ca0fb1a4b8385d256e7b9a1d0e1"><enum>(d)</enum><header>Exception</header><text>The
			 notification requirement in this section does not apply to a disclosure
			 made—</text>
					<paragraph id="idEA0EF2D2ED7049708CD418228E1C96F4"><enum>(1)</enum><text>pursuant to any
			 statutory requirement, including to section 552 of title 5, United States Code
			 (commonly referred to as the <quote>Freedom of Information Act</quote>);</text>
					</paragraph><paragraph id="id6C5602DA46CA411AAA87D5811B72B5EF"><enum>(2)</enum><text>in connection
			 with a civil, criminal, or administrative proceeding;</text>
					</paragraph><paragraph id="idCFECC33C22124CC38C85CFC8897BDC15"><enum>(3)</enum><text>as a result of a
			 declassification review process under Executive Order 13526 (50 U.S.C. 435
			 note) or any successor order; or</text>
					</paragraph><paragraph id="id0dcbdee2a05442419ba978c4fd2862e3"><enum>(4)</enum><text>to any officer,
			 employee, or contractor of the Federal government or member of an advisory
			 board to an element of the intelligence community who possesses an active
			 security clearance and a need to know the specific national intelligence or
			 intelligence related to national security, as defined in section 3(5) of the
			 National Security Act of 1947 (50 U.S.C. 401a(5)).</text>
					</paragraph></subsection></section><section id="id21af9b53e80a47ab939bf20cbcaecda1"><enum>502.</enum><header>Requirement to
			 record authorized disclosures of classified information</header>
				<subsection id="id943e8118f2a741809e15087ee089fa89"><enum>(a)</enum><header>Record
			 requirement</header><text>The head of each element of the intelligence
			 community shall ensure that such element creates and maintains a record of all
			 authorized disclosures of classified information to media personnel, including
			 any person or entity under contract or other binding agreement with the media
			 to provide analysis or commentary, or to any person or entity if the disclosure
			 is made with the intent or knowledge that such information will be made
			 publicly available.</text>
				</subsection><subsection id="id788f1d9ee8a54e1aaec64789a044923f"><enum>(b)</enum><header>Review by
			 congressional intelligence committees</header><text>A record under subsection
			 (a) shall be available for review by the congressional intelligence committees
			 in a manner jointly agreed to by the committee and the head of such
			 element.</text>
				</subsection></section><section id="idd6e8db20421649769493f0ee032a4ee9"><enum>503.</enum><header>Procedures for
			 conducting administrative investigations of unauthorized disclosures</header>
				<subsection id="idbdd6f88e122c49c9a474a89deea4622e"><enum>(a)</enum><header>Requirement</header><text>Not
			 later than 90 days after the date of the enactment of this Act, the Director of
			 National Intelligence shall—</text>
					<paragraph id="idE8A3F0EC59084163BC8488085549C6E7"><enum>(1)</enum><text>establish
			 procedures as described in subsection (b); and</text>
					</paragraph><paragraph id="idC27756A34BE34CA2A2BB229D4DDF92BD"><enum>(2)</enum><text>provide a copy of
			 the procedures to the congressional intelligence committees.</text>
					</paragraph></subsection><subsection id="id9424f25ac7624415b0ca8738d8e924f9"><enum>(b)</enum><header>Procedures</header><text>The
			 procedures described in this subsection are procedures that shall be
			 implemented by each element of the intelligence community for the conduct of
			 administrative investigations of unauthorized disclosures of classified
			 information and shall include—</text>
					<paragraph id="id60d7aae5b23d4ea8a4e71141f76a00e0"><enum>(1)</enum><text>designation of an
			 office with responsibility for proactively identifying unauthorized disclosures
			 of classified information;</text>
					</paragraph><paragraph id="idbcd2701a8dda4026bd508b75a6dd5a25"><enum>(2)</enum><text>submission and
			 prioritization of crimes reports to the Attorney General for purposes of
			 criminal investigation concerning unauthorized disclosures of classified
			 information;</text>
					</paragraph><paragraph id="idc6cd492c78364cd0aae67dfd6c5d7a6d"><enum>(3)</enum><text>conduct of
			 independent administrative investigations of unauthorized disclosures of
			 classified information, if a criminal investigation is not pursued or is
			 discontinued;</text>
					</paragraph><paragraph id="id88d5f77934314c5c80ab3eb52895f50b"><enum>(4)</enum><text>guidelines
			 approved by the Attorney General that authorize the Director of the Federal
			 Bureau of Investigation to provide relevant documents and other information in
			 the Director's possession to appropriate elements of the intelligence community
			 for purposes of conducting administrative investigations of the unauthorized
			 disclosure of classified information;</text>
					</paragraph><paragraph id="idbd4b9991253145e6920a957125dfcdc3"><enum>(5)</enum><text>procedures for
			 the heads of elements of the intelligence community to apply disciplinary
			 measures, if appropriate, following an administrative investigation, up to and
			 including termination of employment;</text>
					</paragraph><paragraph id="id117c39c96ae64b51930f8bfab17b033b"><enum>(6)</enum><text>in cases where an
			 administrative investigation identifies information that may enable or inform a
			 criminal investigation, procedures for providing such information to the
			 Attorney General;</text>
					</paragraph><paragraph id="idb14212d8e06f4f73abe00eb600fbb71d"><enum>(7)</enum><text>procedures for
			 keeping the National Counterintelligence Executive and the congressional
			 intelligence committees informed of the status of all administrative
			 investigations and crimes reports; and</text>
					</paragraph><paragraph id="id030a93b6f1f24569ba796dc66d357b2e"><enum>(8)</enum><text>other procedures
			 as determined by the Director.</text>
					</paragraph></subsection></section><section id="idf49ceb6909f844f399cf7768e3c95f50"><enum>504.</enum><header>Assessment of
			 procedures for detecting and preventing unauthorized disclosures</header>
				<subsection id="id877B3A8718134E00B1C6D445BD4DEC13"><enum>(a)</enum><header>Director of
			 National Intelligence Assessment</header><text display-inline="yes-display-inline">Not later than 120 days after the date of
			 the enactment of this Act, the Director of National Intelligence shall provide
			 the congressional intelligence committees with an assessment of—</text>
					<paragraph id="idf9e0d03053d242cdbc24ec950c40fa4e"><enum>(1)</enum><text>the practical
			 feasibility of extending the use of the polygraph to additional Executive
			 branch personnel and standardizing the questions used during polygraph
			 examinations regarding disclosure of classified information and contact with
			 the media;</text>
					</paragraph><paragraph id="idb9e0a3fb67a74e5283cda3e5d37839ab"><enum>(2)</enum><text>the benefits of
			 extending the automated insider threat detection capabilities described in
			 section 402 of the Intelligence Authorization Act of Fiscal Year 2011 (Public
			 Law 112–18; 50 U.S.C. 403–1 note) to sensitive compartmented information level
			 computer systems used by agencies or personnel outside the intelligence
			 community; and</text>
					</paragraph><paragraph id="idd92df00911bb43de8f841801ea991b52"><enum>(3)</enum><text>a description of
			 actions that could be taken to address improper classification of
			 material.</text>
					</paragraph></subsection><subsection id="id4ed851730d454454a601b9093ef505f3"><enum>(b)</enum><header>Inspector
			 General of the Intelligence Community assessment</header><text>Not later than
			 120 days after the date of the enactment of this Act, the Inspector General of
			 the Intelligence Community shall provide the congressional intelligence
			 committees with an assessment of the effectiveness of the process used by each
			 element of the intelligence community for preventing, detecting, and
			 investigating unauthorized disclosures of classified information and a
			 description of any best practices that could be replicated throughout the
			 intelligence community.</text>
				</subsection></section><section id="iddfa2d402d0ff4f1c8dc2cb9864e546a7"><enum>505.</enum><header>Prohibition on
			 certain individuals serving as consultants</header>
				<subsection id="id32317185dc9d4fe99d44302726d06d7f"><enum>(a)</enum><header>Prohibition</header><text>No
			 person described in subsection (b) may enter into a contract or other binding
			 agreement with the media in order to provide, or otherwise assist in providing,
			 analysis or commentary on matters concerning the classified intelligence
			 activities of any element of the intelligence community or intelligence related
			 to national security, as defined in section 3(5) of the National Security Act
			 of 1947 (50 U.S.C. 401a(5)).</text>
				</subsection><subsection id="idbedfddb662d4435aa7cd18a230690f9c"><enum>(b)</enum><header>Person
			 described</header><text>A person described in this subsection is—</text>
					<paragraph id="idab45fa377b5c4db59a658d5f62483bfb"><enum>(1)</enum><text>any officer,
			 employee, or contractor of the Federal government who possesses an active
			 security clearance;</text>
					</paragraph><paragraph id="id671334CA73004717B0A3FEE909ACA30E"><enum>(2)</enum><text>any member of an
			 advisory board to an element of the intelligence community who possesses an
			 active security clearance; or</text>
					</paragraph><paragraph id="id8D730141C6974BB6BF895DB71A2739D9"><enum>(3)</enum><text>any former
			 officer, employee, or contractor of the Federal government or former member of
			 an advisory board to an element of the intelligence community who—</text>
						<subparagraph id="id1AF110C6EF514A1CAE4073CEF5EE19E6"><enum>(A)</enum><text>has left the
			 employment or service of the Federal government during the previous 1 year
			 period; and</text>
						</subparagraph><subparagraph id="idC71B9E8679EB42D2A7628DA99B4BC622"><enum>(B)</enum><text>possessed a
			 security clearance allowing access to top secret, sensitive compartmented
			 information at any time during the 3 years prior to leaving such employment or
			 service.</text>
						</subparagraph></paragraph></subsection></section><section id="id8f6c998cd6d14a0ba78a848519f82096"><enum>506.</enum><header>Limitation on
			 persons authorized to communicate with the media</header>
				<subsection id="id57e4f873279e482b99e07fb6cc31c894"><enum>(a)</enum><header>Limitation</header>
					<paragraph id="id92EE6CA54FC14D8895EE2B414EBD125A"><enum>(1)</enum><header>In
			 general</header><text>For each element of the intelligence community, only the
			 Director and Deputy Director of such element, or individuals in equivalent
			 positions within such element, and individuals in the offices of public affairs
			 who are specifically designated by the Director (or the individual in an
			 equivalent position), may provide background or off-the-record information
			 regarding intelligence activities to the media, or to any person affiliated
			 with the media.</text>
					</paragraph><paragraph id="id83069751FEE64966A3425E76F18AE872"><enum>(2)</enum><header>Designation in
			 writing</header><text>Each designation made under paragraph (1) by a Director
			 (or an individual in an equivalent position) shall be in writing.</text>
					</paragraph></subsection><subsection id="id7961b38ff8084dfb8d6bb024b3ea4458"><enum>(b)</enum><header>Construction</header><text>Nothing
			 in this section shall be construed to prohibit an appropriate officer or
			 employee of an element of the intelligence community from providing authorized,
			 unclassified, on-the-record briefings to the media, or to any person affiliated
			 with the media.</text>
				</subsection></section><section id="idd657da8ce3f94ec287a5e5ef915ede99"><enum>507.</enum><header>Responsibilities
			 of intelligence community personnel with access to classified
			 information</header>
				<subsection id="idb30855fd2ae944c7a3cc50592b2ebde2"><enum>(a)</enum><header>In
			 general</header><text>Not later than 120 days after the date of the enactment
			 of this Act, the Director of National Intelligence shall—</text>
					<paragraph id="ida08e78ae1412498f97219bd7b5ad695c"><enum>(1)</enum><text>prescribe
			 regulations outlining the responsibilities of, and a process for, all covered
			 persons to report oral and written contact with the media to the security
			 office of the appropriate element of the intelligence community;</text>
					</paragraph><paragraph id="id90b4c0155fce418aa52583d54e144d0d"><enum>(2)</enum><text>prescribe
			 regulations that ensure that any covered person, prior to leaving the
			 employment or services of the Federal Government, is informed of the ongoing
			 responsibility to comply with all provisions of the written nondisclosure
			 agreements governing access to classified information;</text>
					</paragraph><paragraph id="idbcc5b3cce4ca48c291c0eb91870435e3"><enum>(3)</enum><text>establish
			 appropriate requirements for covered persons to comply, during and subsequent
			 to any period of employment, with all prepublication review requirements
			 contained in any nondisclosure agreement between the covered person and any and
			 all elements of the intelligence community to which such person has been
			 assigned, employed, contracted, or detailed;</text>
					</paragraph><paragraph id="id87db92085d6e4d78a53bc04b22fc3998"><enum>(4)</enum><text>establish
			 appropriate requirements for covered persons, during and subsequent to any
			 period of employment or service, to submit any written materials and
			 anticipated oral comments for prepublication review;</text>
					</paragraph><paragraph id="id190337bb9a6f4c4f8bfccb0b1d020c13"><enum>(5)</enum><text>update, and
			 require current acknowledgment of, the written nondisclosure agreements
			 governing access to classified information to comply with the provisions of
			 this Act; and</text>
					</paragraph><paragraph id="id4efa5bebea0a45699aca2e0aca0d96fa"><enum>(6)</enum><text>prescribe
			 regulations that specify appropriate disciplinary actions to be taken against
			 any covered person, during and subsequent to any period of employment or
			 service, determined by the Director of National Intelligence to have violated a
			 written agreement under this section, which may include—</text>
						<subparagraph id="id7FE3EEAEEAA94F399AFD9CC57DF58FEE"><enum>(A)</enum><text>issuance of
			 letters of reprimand;</text>
						</subparagraph><subparagraph id="id38A79D5DAAD84D17B607D3D790827EC9"><enum>(B)</enum><text>placing notices
			 of violations in personnel files and informing the congressional oversight
			 committees of such notices;</text>
						</subparagraph><subparagraph id="id0C5C8CDFF9EF40C4A4D8A3B89C6AD58C"><enum>(C)</enum><text>revocation of
			 security clearances;</text>
						</subparagraph><subparagraph id="idAC411CE7ABCE4687A83FEE42DD2BDA2A"><enum>(D)</enum><text>prohibition on
			 obtaining new security clearances; and</text>
						</subparagraph><subparagraph id="idD5117CEBB8CA4265A4FAF879C4E4E9B0"><enum>(E)</enum><text>termination of
			 employment.</text>
						</subparagraph></paragraph></subsection><subsection id="id6edb09d05a9c46c5b59c35f33e07a701"><enum>(b)</enum><header>Covered person
			 defined</header><text>In this section, the term <term>covered person</term>
			 means a current employee or contractor of, or member of an advisory board to,
			 an element of the intelligence community who has an active security
			 clearance.</text>
				</subsection></section><section id="idaaeccda8002d4f738676f2fa9830fc2f"><enum>508.</enum><header>Report on
			 improvements to the criminal process for investigating and prosecuting
			 unauthorized disclosures of classified information</header>
				<subsection id="id160725e1ff554829807c7667193ddb72"><enum>(a)</enum><header>Requirement for
			 report</header><text>Not later than 180 days after the date of the enactment of
			 this Act, the Attorney General, in coordination with the Director of National
			 Intelligence, shall submit to the congressional intelligence committees and the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representatives a report on the effectiveness of and potential
			 improvements to the process for investigating and prosecuting unauthorized
			 disclosures of classified information, which shall include—</text>
					<paragraph id="id79e5dc81af5e4122805f25a074d55301"><enum>(1)</enum><text>potential
			 modifications to the process used by elements of the intelligence community to
			 submit crimes reports of unauthorized disclosures of classified information to
			 the Attorney General;</text>
					</paragraph><paragraph id="idcfde52c90a4a4ee481a033a3688e51fe"><enum>(2)</enum><text>potential
			 modifications to the policies of the Department of Justice on issuing subpoenas
			 directed at members of the news media, as described in section 50.10(b) of
			 title 28, Code of Federal Regulations (or any similar successor regulation);
			 and</text>
					</paragraph><paragraph id="ida4be495c75314cdabc3280d97a0c0bb9"><enum>(3)</enum><text>potential
			 modifications to the Classified Information Procedures Act (Public Law 96–456;
			 94 Stat. 2025).</text>
					</paragraph></subsection></section><section id="idb607587e633e47e69d019c40879b9857"><enum>509.</enum><header>Improving
			 insider threat initiatives</header>
				<subsection commented="no" id="id067944A94FC34E879FCD86CF413AE3CA"><enum>(a)</enum><header>Designation of
			 insider threat program managers</header>
					<paragraph commented="no" id="id99f7c21e33c043b795b35d7cd4a1d958"><enum>(1)</enum><header>Requirement to
			 designate</header><text>Not later than 90 days after the date of the enactment
			 of this Act, each head of an element of the intelligence community shall
			 designate an insider threat program manager with responsibility for developing
			 a comprehensive insider threat program management plan as described in
			 subsection (b) for such element.</text>
					</paragraph><paragraph commented="no" id="id3fc48dfeebd7419b9072cc6e5b3e3b0c"><enum>(2)</enum><header>Information
			 access</header><text>Each insider threat program manager designated under
			 paragraph (1) for an element of the intelligence community shall have access to
			 all relevant information regarding the allocation of resources to efforts by
			 such element to counter insider threats, including resources for
			 counterintelligence, physical security, information security, and human
			 resources, except that such relevant information shall not be deemed to include
			 information concerning specific counterintelligence or security investigations,
			 unless the head of the element so directs.</text>
					</paragraph></subsection><subsection commented="no" id="id136b412244574ff1acfe7f0fc3df9874"><enum>(b)</enum><header>Development of
			 a comprehensive insider threat program management plan</header>
					<paragraph commented="no" id="id91724c4f24074062a1e16d360c687f40"><enum>(1)</enum><header>Requirement to
			 develop</header><text>Not later than 1 year after the date of the enactment of
			 this Act, each insider threat program manager designated under subsection
			 (a)(1) for an element of the intelligence community shall develop, in
			 coordination with the Office of the National Counterintelligence Executive and
			 such other components of the Office of the Director of National Intelligence as
			 the Director of National Intelligence deems appropriate, a comprehensive
			 insider threat program management plan for such element that describes a
			 comprehensive insider threat detection program for such element.</text>
					</paragraph><paragraph commented="no" id="id2b3a584563174b69887e4ad7ea1779e9"><enum>(2)</enum><header>Review and
			 approval</header><text>Upon completion, each comprehensive insider threat
			 program management plan developed under paragraph (1) shall be submitted to the
			 head of the relevant element of the intelligence community for review,
			 modification, and approval, and then to the Director of National Intelligence,
			 for review, modification and approval.</text>
					</paragraph><paragraph commented="no" id="idb4eba298fc864b90b13a70f05c96ba7b"><enum>(3)</enum><header>Submission to
			 Congress</header><text>A copy of each comprehensive insider threat program
			 management plan approved by the Director of National Intelligence under
			 paragraph (2) shall be submitted—</text>
						<subparagraph commented="no" id="id096E1FB34B374293AAFE0C441F2B7AAE"><enum>(A)</enum><text>to the
			 congressional intelligence committees, not later than 30 days after the date
			 such plan is approved; and</text>
						</subparagraph><subparagraph id="idb6f1d7a8e5e948799844e79aeab94700"><enum>(B)</enum><text>if such plan
			 involves a component of a department of the United States Government, to the
			 committees of the Senate and of the House of Representatives with jurisdiction
			 over such department simultaneously with submission of such copy to the
			 congressional intelligence committees under subparagraph (A).</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="ided916c15efa84c0e966e8e862a21fe46"><enum>(c)</enum><header>Implementing a
			 comprehensive insider threat detection program</header>
					<paragraph commented="no" id="idc67348ac65fd4b669a554b470ede28d8"><enum>(1)</enum><header>Initial
			 operating capability</header><text>Not later than 18 months after the date of
			 the enactment of this Act, each head of an element of the intelligence
			 community, in coordination with the Office of the National Counterintelligence
			 Executive and the Office of the Director of National Intelligence, shall
			 establish an initial operating capability for the comprehensive insider threat
			 detection program for such element as described in the comprehensive insider
			 threat program management plan developed under subsection (b).</text>
					</paragraph><paragraph commented="no" id="id2b9250532c314a7cacb9d1fd2280550f"><enum>(2)</enum><header>Full operating
			 capability</header><text>Not later than 2 years after the date of the enactment
			 of this Act, the Director of National Intelligence shall—</text>
						<subparagraph commented="no" id="id434625fdb4064794a067f251ff9c518e"><enum>(A)</enum><text>establish a full
			 operating capability for each comprehensive insider threat detection program
			 developed under subsection (b) for each element of the intelligence community;
			 and</text>
						</subparagraph><subparagraph commented="no" id="id8b643cc3561b433c9aa3990ded0a4747"><enum>(B)</enum><text>ensure that each
			 such full operating capability is reached.</text>
						</subparagraph></paragraph></subsection></section><section id="idcc453f170b034cf48f54fb302c140a19"><enum>510.</enum><header>Automated
			 insider threat detection program</header><text display-inline="no-display-inline">Section 402 of the Intelligence
			 Authorization Act for Fiscal Year 2011 (Public Law 112–18; 50 U.S.C. 403–1
			 note) is amended—</text>
				<paragraph id="idca3ce440e134485cbb1b6167eaa61f68"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote>October 1, 2012,</quote> and inserting <quote>October
			 1, 2013,</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc791d84777f41cd9eeee49b7abfd60c"><enum>(2)</enum><text>in subsection
			 (b), by striking <quote>October 1, 2013,</quote> and inserting <quote>October
			 1, 2014,</quote>.</text>
				</paragraph></section><section id="ide888bc57d18e4c3ea8bf799964f58e4a"><enum>511.</enum><header>Surrender of
			 certain benefits</header>
				<subsection id="ide7b86d9554d7479fabed13274f8f2bb8"><enum>(a)</enum><header>Requirement for
			 prohibition</header><text>Not later than 120 days after the date of the
			 enactment of this Act, the Director of National Intelligence, in coordination
			 with the head of each element of the intelligence community, shall publish
			 regulations that—</text>
					<paragraph id="id129c43e08e1240959119f9ea34a4ec38"><enum>(1)</enum><text>are consistent
			 with any procedures established by Executive order or regulation under section
			 801 of the National Security Act of 1947 (50 U.S.C. 435);</text>
					</paragraph><paragraph id="idb93746af587643ada4bdcd7614530db0"><enum>(2)</enum><text>require each
			 employee of an element of the intelligence community to sign a written
			 agreement as described in subsection (b); and</text>
					</paragraph><paragraph id="id3546a6134ca44407a1c653ddc545173a"><enum>(3)</enum><text>set forth the
			 administrative procedures applicable to an employee who violates the terms of
			 such an agreement.</text>
					</paragraph></subsection><subsection id="id9a828558dee9465c87a074776b0c6ea6"><enum>(b)</enum><header>Agreement
			 described</header><text>An agreement described in this subsection is an
			 agreement, with respect to an individual employed by an element of the
			 intelligence community, that—</text>
					<paragraph id="id1cd2f36a4adb470fa701020e281a62bf"><enum>(1)</enum><text>prohibits the
			 individual from disclosing classified information without authorization at any
			 time during or subsequent to employment with an element of the intelligence
			 community;</text>
					</paragraph><paragraph id="ide617f3d374ba4b79b67cce9b4ead903f"><enum>(2)</enum><text>requires the
			 individual to comply with all prepublication review requirements contained in
			 any nondisclosure agreement between the individual and an element of the
			 intelligence community;</text>
					</paragraph><paragraph id="id93de36f519ad49bea5a1b36df20d1379"><enum>(3)</enum><text>specifies
			 appropriate disciplinary actions, including the surrender of any current or
			 future Federal Government pension benefit, to be taken against the individual
			 if the Director of National Intelligence or the head of the appropriate element
			 of the intelligence community determines that the individual has knowingly
			 violated the prepublication review requirements contained in a nondisclosure
			 agreement between the individual and an element of the intelligence community
			 in a manner that disclosed classified information to an unauthorized person or
			 entity; and</text>
					</paragraph><paragraph id="id74757fc1b1ec4085a11de040d2b4bc7e"><enum>(4)</enum><text>describes
			 procedures for making and reviewing determinations under paragraph (3) in a
			 manner that is consistent with the due process and appeal rights otherwise
			 available to an individual who is subject to the same or similar disciplinary
			 action under other law.</text>
					</paragraph></subsection><subsection id="idc02d031556d2480e8886be1e8b87392a"><enum>(c)</enum><header>Federal
			 government pension benefit described</header><text>In this section, the term
			 <term>Federal Government pension benefit</term> means the specific government
			 contribution to a covered person’s Federal Government pension plan, in its fair
			 market value, but does not include the following:</text>
					<paragraph id="id6781a3a8d620454da04e67f91dc18f4a"><enum>(1)</enum><text>Any contributions
			 by a person to a Federal Government pension plan, in their fair market
			 value.</text>
					</paragraph><paragraph id="id9b20ef0c7ed14570ac3f452c0dd4c3d7"><enum>(2)</enum><text>Any old age
			 benefits payable to a person under title II of the Social Security Act (42
			 U.S.C. 401 et seq.).</text>
					</paragraph><paragraph id="idff2bc4cc7c844e2e9e4ecddc2195257d"><enum>(3)</enum><text>Any employee
			 benefits or contributions of a person under the Thrift Savings Plan under
			 subchapter III of chapter 84 of title 5, United States Code, or any successor
			 benefit program.</text>
					</paragraph></subsection></section><section id="id5FAF167287EB42E39D40A9E6410467C3"><enum>512.</enum><header>Prohibition on
			 security clearances for individuals who disclose to the public evidence or
			 information on United States covert actions</header>
				<subsection id="idD9F06003811941E49090E817DB7DC291"><enum>(a)</enum><header>Prohibition</header><text>Consistent
			 with administrative procedures and due process afforded under otherwise
			 applicable laws and regulations, an individual described in subsection (b) may
			 not receive, retain, or otherwise possess a security clearance for access to
			 classified information.</text>
				</subsection><subsection id="id00b95c2d6bdf46d6b57dc4fd4b52d2c1"><enum>(b)</enum><header>Covered
			 individuals</header><text>An individual described in this subsection is any
			 individual—</text>
					<paragraph id="id022d64da694248ddb3682595d0967624"><enum>(1)</enum><text>who—</text>
						<subparagraph id="id604755f0d8594f3b8ae6786a8d9a2063"><enum>(A)</enum><text>serves as an
			 officer, employee, contractor, or member of an advisory board of the Federal
			 Government; or</text>
						</subparagraph><subparagraph id="id022c4f20f36047c284a6d923eb0e9584"><enum>(B)</enum><text>otherwise
			 possesses an active security clearance;</text>
						</subparagraph></paragraph><paragraph id="id6c2936ce9e324a108ac93758932e2936"><enum>(2)</enum><text>who is known or
			 determined, in accordance with applicable law or regulations, to have knowingly
			 made a public disclosure of the existence of, or discussed classified details
			 relating to, a classified covert action (as that term is defined in section
			 503(e) of the National Security Act of 1947 (50 U.S.C. 413b(e)); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide828ce8cd7d44ba393bd2bac0d2d0f1d"><enum>(3)</enum><text>who makes the
			 disclosure, or discusses the details, described in paragraph (2) without prior
			 authorization from an original classification authority.</text>
					</paragraph></subsection></section></title><title id="id9E160EC586304A2099411FEC3B818F82"><enum>VI</enum><header>Other
			 matters</header>
			<section id="id8A756F58079C4DC4966FB6FCC6D2D29C"><enum>601.</enum><header>Homeland
			 Security Intelligence Program</header><text display-inline="no-display-inline">There is established within the Department
			 of Homeland Security a Homeland Security Intelligence Program. The Homeland
			 Security Intelligence Program constitutes the intelligence activities of the
			 Office of Intelligence and Analysis of the Department that serve predominantly
			 departmental missions.</text>
			</section><section id="id2F9E08A227B14E87B46A3E344235B528"><enum>602.</enum><header>Extension of
			 National Commission for the Review of the Research and Development Programs of
			 the United States Intelligence Community</header><text display-inline="no-display-inline">Section 1007(a) of the Intelligence
			 Authorization Act for Fiscal Year 2003 (Public Law 107–306; 50 U.S.C. 401 note)
			 is amended by striking <quote>Not later than one year after the date on which
			 all members of the Commission are appointed pursuant to section 701(a)(3) of
			 the Intelligence Authorization Act for Fiscal Year 2010,</quote> and inserting
			 <quote>Not later than March 31, 2013,</quote>.</text>

				<subsection id="id7aa013d0af934bd7ab01f44d9a60cc5e"><enum>(a)</enum><header>Subsequent
			 appointment</header><text>Section 703(c)(2)(D) of the Public Interest
			 Declassification Act of 2000 (Public Law 106–567; 50 U.S.C. 435 note) is
			 amended by striking the period at the end and inserting <quote>from the date of
			 the appointment.</quote>.</text>
				</subsection><subsection id="id509d61bac82840279ebff4d3f3428ffa"><enum>(b)</enum><header>Vacancy</header><text>Section
			 703(c)(3) of the Public Interest Declassification Act of 2000 (Public Law
			 106–567; 50 U.S.C. 435 note) is amended by striking <quote>A member of the
			 Board appointed to fill a vacancy before the expiration of a term shall serve
			 for the remainder of the term.</quote>.</text>
				</subsection><subsection id="idFA1E53D63CE64B40A5DCF88CB8F7EF10"><enum>(c)</enum><header>Extension of
			 sunset</header><text>Section 710 of the Public Interest Declassification Act of
			 2000 (Public Law 106–567; 50 U.S.C. 435 note) is amended by striking
			 <quote>2012.</quote> inserting <quote>2018.</quote>.</text>
				</subsection></section><section id="idFE6C458C49344A0A9AEF5AE141F38152"><enum>604.</enum><header>Provision of
			 classified opinions of the Office of Legal Counsel to Congress</header>
				<subsection id="idd3adbd96089e47b481dad593d980c111"><enum>(a)</enum><header>Requirement to
			 provide</header><text>Except as provided in subsections (c) and (d), not later
			 than 180 days after the date of the enactment of this Act, the Attorney
			 General, in coordination with the Director of National Intelligence, shall
			 provide to the congressional intelligence committees a copy of every classified
			 opinion of the Office of Legal Counsel of the Department of Justice that was
			 provided to an element of the intelligence community on or after September 11,
			 2001.</text>
				</subsection><subsection id="idd972098fb06b4f12b13dd4115f8adc5f"><enum>(b)</enum><header>Annual
			 submission</header>
					<paragraph id="ida8956a75de444b2ab5ab23d2941c6b13"><enum>(1)</enum><header>Requirement to
			 provide</header><text>Except as provided in subsections (c) and (d), not later
			 than 180 days after the date of the enactment of this Act, and annually
			 thereafter, the Attorney General, in coordination with the Director of National
			 Intelligence, shall provide to the congressional intelligence committees a
			 listing of every opinion of the Office of Legal Counsel of the Department of
			 Justice that has been provided to an element of the intelligence community on
			 or after September 11, 2001.</text>
					</paragraph><paragraph id="id74752F1F9FC74A0ABD57E8C0D3BB1BC2"><enum>(2)</enum><header>Content</header><text>Each
			 listing submitted under paragraph (1) shall include—</text>
						<subparagraph id="id226C85A4B12649DA818BE9142E228764"><enum>(A)</enum><text>as much detail as
			 possible about the subject of each opinion;</text>
						</subparagraph><subparagraph id="id74cf287855bd4b43a6588a83991a88f9"><enum>(B)</enum><text>the date the
			 opinion was issued;</text>
						</subparagraph><subparagraph id="id90bbfa74ff3443a29419f425cb6dedbe"><enum>(C)</enum><text>the recipient
			 agency or agencies;</text>
						</subparagraph><subparagraph id="id2d315f1d2d3e40858c3ecf362aea2a2e"><enum>(D)</enum><text>whether the
			 opinion has been made available to Congress or specific congressional
			 committees, including the identity of each such committee; and</text>
						</subparagraph><subparagraph id="id0726f1de181f4524a7a548d8d511ddf4"><enum>(E)</enum><text>for any opinion
			 that has not been made available to Congress or specific congressional
			 committees, the basis for such withholding.</text>
						</subparagraph></paragraph></subsection><subsection id="id23ec522b9485463b968016096e39bb52"><enum>(c)</enum><header>Exception for
			 covert action</header><text>If the President determines that it is essential to
			 limit access to a covert action finding under section 503(c)(2) of the National
			 Security Act (50 U.S.C. 413b(c)(2)), the President may limit access to
			 information concerning such finding that is subject to disclosure under
			 subsection (a) or (b) to those members of Congress who have been granted access
			 to the relevant finding under such section 503(c)(2).</text>
				</subsection><subsection id="idd4688dea6cbf478f973a33017acda4dd"><enum>(d)</enum><header>Exception for
			 information subject to executive privilege</header><text>If the President
			 determines that a particular opinion subject to disclosure under subsection (a)
			 or listing subject to disclosure under subsection (b) is subject to an
			 executive privilege that protects against such disclosure, the Attorney General
			 shall not be required to disclose such opinion or listing, if the Attorney
			 General notifies the congressional intelligence committees, in writing, of the
			 legal justification for such assertion of executive privilege prior to the date
			 by which the opinion or listing is required to be disclosed.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9024253dcdad4ebd97c87e95deb2fef5" section-type="subsequent-section"><enum>605.</enum><header display-inline="yes-display-inline">Technical amendments related to the Office
			 of the Director of National Intelligence</header>
				<subsection commented="no" display-inline="no-display-inline" id="idFB800DD0BFEC4624AF55F8C21632B634"><enum>(a)</enum><header display-inline="yes-display-inline">Personnel practices</header><text display-inline="yes-display-inline">Section 2302(a)(2)(C) of title 5, United
			 States Code, is amended by striking clause (ii) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id89BA39D91F5D436BA9A789A3F74A016F" style="OLC">
						<clause commented="no" display-inline="no-display-inline" id="ID1cde6700c7d447afb6c72d20a8c57a71"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idE581D4057BE24751A915405671B0BD4E"><enum>(I)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation, the
				Central Intelligence Agency, the Defense Intelligence Agency, the National
				Geospatial-Intelligence Agency, the National Security Agency, the Office of the
				Director of National Intelligence, and the National Reconnaissance Office;
				and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id81EBC32EF6AC4FB4BF30B8764C83E8B3" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">as determined by the President, any
				executive agency or unit thereof the principal function of which is the conduct
				of foreign intelligence or counterintelligence activities, provided that the
				determination be made prior to a personnel action;
				or</text>
							</subclause></clause><after-quoted-block>. </after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id98A93AB6BA9F47B0BF391F3423CA836C"><enum>(b)</enum><header>Senior
			 executive service</header><text>Section 3132(a)(1)(B) of title 5, United States
			 Code, is amended by inserting <quote>the Office of the Director of National
			 Intelligence,</quote> after <quote>the Central Intelligence
			 Agency,</quote>.</text>
				</subsection></section><section id="idac9a59a9feee44f8bccc4e08443d8404"><enum>606.</enum><header>Technical
			 amendment for definition of intelligence agency</header><text display-inline="no-display-inline">Section 606(5) of the National Security Act
			 of 1947 (50 U.S.C. 426) is amended as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id62951619abca4adeb9faee44a1fed2a4" style="OLC">
					<paragraph id="id1edf0beca8944ce58fcfdbb22a8a12eb"><enum>(5)</enum><text>The term
				<term>intelligence agency</term> means the elements of the intelligence
				community.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id5fd43a6c7a45486dbff052450662009b"><enum>607.</enum><header>Budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the Senate Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>
