			 hereby authorized to be appropriated for fiscal year 2013 for the conduct of

			 Authorizations</header>
				<subsection commented="no" display-inline="no-display-inline" id="HC70857E08601425285ADAA73B1F07DDF"><enum>(a)</enum><header display-inline="yes-display-inline">Specifications of amounts and personnel
			 levels</header><text display-inline="yes-display-inline">The amounts authorized
			 to be appropriated under section 101 and, subject to section 103, the
			 authorized personnel ceilings as of September 30, 2013, for the conduct of the
			 intelligence activities of the elements listed in paragraphs (1) through (16)
			 of section 101, are those specified in the classified Schedule of
			 Authorizations prepared to accompany the bill S. 3454 of the One Hundred
			 Twelfth Congress.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H8984558D352841818B08B14FA74B29D9"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of classified Schedule of
			 Authorizations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H6FD5A7B58CF84248B3ABE56849CBB86D"><enum>(1)</enum><header display-inline="yes-display-inline">Availability to committees of
			 Congress</header><text display-inline="yes-display-inline">The classified
			 Schedule of Authorizations referred to in subsection (a) shall be made
			 available to the Committee on Appropriations of the Senate, the Committee on
			 Appropriations of the House of Representatives, and to the President.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCC639173C0784F439F4D4C3776E3D5BB"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution by the President</header><text display-inline="yes-display-inline">Subject to paragraph (3), the President
			 shall provide for suitable distribution of the classified Schedule of
			 Authorizations, or of appropriate portions of the Schedule, within the
			 executive branch.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8BEBBB9D94AF42F1B4CE4F26B4C46AF5"><enum>(3)</enum><header display-inline="yes-display-inline">Limits on disclosure</header><text display-inline="yes-display-inline">The President shall not publicly disclose
			 the classified Schedule of Authorizations or any portion of such Schedule
			 except—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H451CECF644E84F6F96308AE061A851A3"><enum>(A)</enum><text display-inline="yes-display-inline">as provided in section 601(a) of the
			 Implementing Recommendations of the 9/11 Commission Act of 2007 (50 U.S.C.
			 415c);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1AB62760935745C499B870584A4E650C"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent necessary to implement the
			 budget; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H427AA666BA5E4E7EA905231A98524AE4"><enum>(C)</enum><text display-inline="yes-display-inline">as otherwise required by law.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idab379026aebf443ca51c4071add8dd79" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Personnel ceiling adjustments</header>
				<subsection commented="no" display-inline="no-display-inline" id="id4612d92ec1d44a258ab9feb9881736c9"><enum>(a)</enum><header display-inline="yes-display-inline">Authority for increases</header><text display-inline="yes-display-inline">The Director of National Intelligence may
			 authorize the employment of civilian personnel in excess of the number of
			 positions for fiscal year 2013 authorized by the classified Schedule of
			 Authorizations referred to in section 102(a) if the Director of National
			 Intelligence determines that such action is necessary to the performance of
			 important intelligence functions, except that the number of personnel employed
			 in excess of the number authorized under such section may not, for any element
			 of the intelligence community, exceed 3 percent of the number of civilian
			 personnel authorized under such section for such element.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id61b452fc751a4932b330d332f841ba17"><enum>(b)</enum><header display-inline="yes-display-inline">Treatment of certain
			 personnel</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall establish guidelines that govern, for each element
			 of the intelligence community, the treatment under the personnel levels
			 authorized under section 102(a), including any exemption from such personnel
			 levels, of employment or assignment in—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id43020c81a86748f8be7392ca725aa7af"><enum>(1)</enum><text display-inline="yes-display-inline">a student program, trainee program, or
			 similar program;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3be4646953c04a68bbfa158ba08b9598"><enum>(2)</enum><text display-inline="yes-display-inline">a reserve corps or as a reemployed
			 annuitant; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6ef69b8e7c1b436ba13949aeeeacc08b"><enum>(3)</enum><text display-inline="yes-display-inline">details, joint duty, or long term,
			 full-time training.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id442555cd7c89451fa2f112f540dab877"><enum>(c)</enum><header display-inline="yes-display-inline">Notice to congressional intelligence
			 committees</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall notify the congressional intelligence committees in
			 writing at least 15 days prior to the initial exercise of an authority
			 described in subsection (a).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H1C46F9B778ED48ACA475A80FA07AECF6" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Intelligence Community Management
			 Account</header>
				<subsection commented="no" display-inline="no-display-inline" id="H8A84CF08BE7F49F79B72D0A75A4BEA4E"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for the Intelligence Community Management Account
			 of the Director of National Intelligence for fiscal year 2013 the sum of
			 $540,721,000. Within such amount, funds identified in the classified Schedule
			 of Authorizations referred to in section 102(a) for advanced research and
			 development shall remain available until September 30, 2014.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HA1734F78F2E4490E9D8347CD5AE6DA3D"><enum>(b)</enum><header display-inline="yes-display-inline">Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence
			 Community Management Account of the Director of National Intelligence are
			 authorized 835 positions as of September 30, 2013. Personnel serving in such
			 elements may be permanent employees of the Office of the Director of National
			 Intelligence or personnel detailed from other elements of the United States
			 Government.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HE96DF3A7621C4EADB86C3808892680AB"><enum>(c)</enum><header display-inline="yes-display-inline">Classified authorizations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H3CC50E706094434F8BADA6E5040F4CFD"><enum>(1)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">In addition to
			 amounts authorized to be appropriated for the Intelligence Community Management
			 Account by subsection (a), there are authorized to be appropriated for the
			 Community Management Account for fiscal year 2013 such additional amounts as
			 are specified in the classified Schedule of Authorizations referred to in
			 section 102(a). Such additional amounts for advanced research and development
			 shall remain available until September 30, 2014.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E20B553FF0D4EA580A6F1E66FE4621C"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by
			 subsection (b) for elements of the Intelligence Community Management Account as
			 of September 30, 2013, there are authorized such additional personnel for the
			 Community Management Account as of that date as are specified in the classified
			 Schedule of Authorizations referred to in section 102(a).</text>
					</paragraph></subsection></section></title><title commented="no" id="id7a5d9d3ea4f54f75bfedebc1bbb471e3" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Central Intelligence Agency Retirement and
			 Disability System</header>
			<section commented="no" display-inline="no-display-inline" id="id1543b45b90b9452089baff7a1a129f1c" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated for the Central Intelligence Agency Retirement
			 and Disability Fund for fiscal year 2013 the sum of $514,000,000.</text>
			</section></title><title commented="no" id="id62a69b91cea0496b9184d47ac6d851e2" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">General intelligence community
			 matters</header>
			<section commented="no" display-inline="no-display-inline" id="id4A39212AD60C497FA19DEDFA318FA988" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Restriction on conduct of intelligence
			 activities</header><text display-inline="no-display-inline">The authorization
			 of appropriations by this Act shall not be deemed to constitute authority for
			 the conduct of any intelligence activity which is not otherwise authorized by
			 the Constitution or the laws of the United States.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id6E13D4C14C7E42ECA17DBB202F4FC7C7" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Increase in employee compensation and
			 benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for
			 salary, pay, retirement, and other benefits for Federal employees may be
			 increased by such additional or supplemental amounts as may be necessary for
			 increases in such compensation or benefits authorized by law.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idb83acead12db44ae8b2d760fe810428e" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Non-reimbursable details</header><text display-inline="no-display-inline">Section 113A of the National Security Act of
			 1947 (50 U.S.C. 404h–1) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id05E97FF4F94C49488F42FA387405F725"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>two years.</quote> and
			 inserting <quote>three years.</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDDC0C4FD12C1469B912CC81E8050DF87"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end <quote>A
			 non-reimbursable detail made under this section shall not be considered an
			 augmentation of the appropriations of the receiving element of the intelligence
			 community.</quote>.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idcc453f170b034cf48f54fb302c140a19" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Automated insider threat detection
			 program</header><text display-inline="no-display-inline">Section 402 of the
			 Intelligence Authorization Act for Fiscal Year 2011 (Public Law 112–18; 50

				<subsection commented="no" display-inline="no-display-inline" id="idB4E6979A08154462937BD118D7717068"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of
			 the enactment of this Act, each chief information officer for an element of the
			 intelligence community, in consultation with the Chief Information Officer of
			 the Intelligence Community, shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id9B75EC43F6D8433F996E05925048C551"><enum>(1)</enum><text display-inline="yes-display-inline">conduct an inventory of software licenses
			 held by such element, including utilized and unutilized licenses; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id344F05D211ED4D7CB5074FFFF641B089"><enum>(2)</enum><text display-inline="yes-display-inline">report the results of such inventory to the
			 Chief Information Officer of the Intelligence Community.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id944826991D4A4E5B9D31CF5D03AA1688"><enum>(b)</enum><header display-inline="yes-display-inline">Reporting to Congress</header><text display-inline="yes-display-inline">The Chief Information Officer of the
			 Intelligence Community shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id637AA36F1E8E4FD89E89BB91CC1D2AE7"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of
			 the enactment of this Act, provide to the congressional intelligence committees
			 a copy of each report received by the Chief Information Officer under
			 subsection (a)(2), along with any comments the Chief Information Officer wishes
			 to provide; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0EB7F64C5C214E34AFA2EED1576CBC70"><enum>(2)</enum><text display-inline="yes-display-inline">transmit any portion of a report submitted
			 under paragraph (1) involving a component of a department of the United States
			 Government to the committees of the Senate and of the House of Representatives
			 with jurisdiction over such department simultaneously with submission of such
			 report to the congressional intelligence committees.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H26BC4C89727344408D0C9882C1693251" section-type="subsequent-section"><enum>306.</enum><header display-inline="yes-display-inline">Strategy for security clearance
			 reciprocity</header>
				<subsection commented="no" display-inline="no-display-inline" id="H39E569F123AB4A38BFB51DFB2A4CD5E0"><enum>(a)</enum><header display-inline="yes-display-inline">Strategy</header><text display-inline="yes-display-inline">The President shall develop a strategy and
			 a schedule for carrying out the requirements of section 3001(d) of the
			 Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C. 435b(d)).
			 Such strategy and schedule shall include—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HF67C487D483A4DE78517281EDB1D5B7E"><enum>(1)</enum><text display-inline="yes-display-inline">a process for accomplishing the reciprocity
			 required under such section for a security clearance issued by a department or
			 agency of the Federal Government, including reciprocity for security clearances
			 that are issued to both persons who are and who are not employees of the
			 Federal Government; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E390D5D5E434CC39590C82D96349339"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the specific circumstances
			 under which a department or agency of the Federal Government may not recognize
			 a security clearance issued by another department or agency of the Federal
			 Government.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H711434C79A6A41E1B3946380E72F91A3"><enum>(b)</enum><header display-inline="yes-display-inline">Congressional notification</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the President shall inform Congress of the strategy
			 and schedule developed under subsection (a).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idCD3A9612DB094857B284E28FE0537C3F" section-type="subsequent-section"><enum>307.</enum><header display-inline="yes-display-inline">Improper Payments Elimination and Recovery
			 Act of 2010 compliance</header>
				<subsection commented="no" display-inline="no-display-inline" id="id3c90db0e19ce40a5a946fff0109d5284"><enum>(a)</enum><header display-inline="yes-display-inline">Plan for compliance</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id33DACB6D31874979A33AE6F5010D0609"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of National Intelligence, the
			 Director of the Central Intelligence Agency, the Director of the Defense
			 Intelligence Agency, the Director of the National Geospatial-Intelligence
			 Agency, and the Director of the National Security Agency shall each develop a
			 corrective action plan, with major milestones, that delineates how the Office
			 of the Director of National Intelligence and each such Agency will achieve
			 compliance, not later than September 30, 2013, with the Improper Payments
			 Elimination and Recovery Act of 2010 (Public Law 111–204; 124 Stat. 2224), and
			 the amendments made by that Act.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74FCE2DC524B4BAE92EFC8848B0DB09E"><enum>(2)</enum><header display-inline="yes-display-inline">Submission to Congress</header><text display-inline="yes-display-inline">Not later than 45 days after the date of
			 the enactment of this Act—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id79D2906F84214DACB9579642BED490C8"><enum>(A)</enum><text display-inline="yes-display-inline">each Director referred to in paragraph (1)
			 shall submit to the congressional intelligence committees the corrective action
			 plan required by such paragraph; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0B754BB42D144E34970F074BEF9E9FA4"><enum>(B)</enum><text display-inline="yes-display-inline">the Director of the Defense Intelligence
			 Agency, the Director of the National Geospatial-Intelligence Agency, and the
			 Director of the National Security Agency shall each submit to the Committee on
			 Armed Services of the Senate and the Committee on Armed Services of the House
			 of Representatives the corrective action plan required by paragraph (1) with
			 respect to the applicable Agency.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida2fa9a6cd55146c1bc3d1793e628c652"><enum>(b)</enum><header display-inline="yes-display-inline">Review by Inspectors General</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id566FAF008DE243EF8E3F0739F397640F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 45 days after the completion
			 of a corrective action plan required by subsection (a)(1), the Inspector
			 General of each Agency required to develop such a plan, and in the case of the
			 Director of National Intelligence, the Inspector General of the Intelligence
			 Community, shall provide to the congressional intelligence committees an
			 assessment of such plan that includes—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idF520A8FBCD6146899C45B016C5128CE1"><enum>(A)</enum><text display-inline="yes-display-inline">the assessment of the Inspector General of
			 whether such Agency or Office is or is not likely to reach compliance with the
			 requirements of the Improper Payments Elimination and Recovery Act of 2010
			 (Public Law 111–204; 124 Stat. 2224), and the amendments made by that Act, by
			 September 30, 2013; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2D7511A68723484892B8066FE4C71641"><enum>(B)</enum><text display-inline="yes-display-inline">the basis of the Inspector General for such
			 assessment.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48D425618814470D8A319BB0965E150A"><enum>(2)</enum><header display-inline="yes-display-inline">Additional submission of reviews of certain
			 Inspectors General</header><text display-inline="yes-display-inline">Not later
			 than 45 days after the completion of a corrective action plan required by
			 subsection (a)(1), the Inspector General of the Defense Intelligence Agency,
			 the Inspector General of the National Geospatial-Intelligence Agency, and the
			 Inspector General of the National Security Agency shall each submit to the
			 Committee on Armed Services of the Senate and the Committee on Armed Services
			 of the House of Representatives the assessment of the applicable plan provided
			 to the congressional intelligence committees under paragraph (1).</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H05996BC98DD04142A9E27A5DA9F2E481" section-type="subsequent-section"><enum>308.</enum><header display-inline="yes-display-inline">Subcontractor notification
			 process</header><text display-inline="no-display-inline">Not later than October
			 1, 2013, the Director of National Intelligence shall submit to the
			 congressional intelligence committees a report assessing the method by which
			 contractors at any tier under a contract entered into with an element of the
			 intelligence community are granted security clearances and notified of
			 classified contracting opportunities within the Federal Government and
			 recommendations for the improvement of such method. Such report shall
			 include—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H97B55BCEC4CE41B1AB42887ED3D45533"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the current method by
			 which contractors at any tier under a contract entered into with an element of
			 the intelligence community are notified of classified contracting
			 opportunities;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H129C51F8323049BEB5407921209717FE"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of any problems that may
			 reduce the overall effectiveness of the ability of the intelligence community
			 to identify appropriate contractors at any tier under such a contract;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28CF65C1AFCA478B8744C2D0973C59BE"><enum>(3)</enum><text display-inline="yes-display-inline">an assessment of the role the existing
			 security clearance process has in enhancing or hindering the ability of the
			 intelligence community to notify such contractors of contracting
			 opportunities;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H31829DA43CE94AF78460D9D733C68610"><enum>(4)</enum><text display-inline="yes-display-inline">an assessment of the role the current
			 security clearance process has in enhancing or hindering the ability of
			 contractors at any tier under a contract entered into with an element of the
			 intelligence community to execute classified contracts;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC6C94698BA9E495CAFCB4708DD57975C"><enum>(5)</enum><text display-inline="yes-display-inline">a description of the method used by the
			 Director of National Intelligence for assessing the effectiveness of the
			 notification process of the intelligence community to produce a talented pool
			 of subcontractors;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4040BE14662E4529B156185E29EA9DAE"><enum>(6)</enum><text display-inline="yes-display-inline">a description of appropriate goals,
			 schedules, milestones, or metrics used to measure the effectiveness of such
			 notification process; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB366E031CC844619BB45AD85DD84FB5F"><enum>(7)</enum><text display-inline="yes-display-inline">recommendations for improving such
			 notification process.</text>

			<section commented="no" display-inline="no-display-inline" id="id8A756F58079C4DC4966FB6FCC6D2D29C" section-type="subsequent-section"><enum>501.</enum><header display-inline="yes-display-inline">Homeland Security Intelligence
			 Program</header><text display-inline="no-display-inline">There is established
			 within the Department of Homeland Security a Homeland Security Intelligence
			 Program. The Homeland Security Intelligence Program constitutes the
			 intelligence activities of the Office of Intelligence and Analysis of the
			 Department that serve predominantly departmental missions.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id2F9E08A227B14E87B46A3E344235B528" section-type="subsequent-section"><enum>502.</enum><header display-inline="yes-display-inline">Extension of National Commission for the
			 Review of the Research and Development Programs of the United States
			 Intelligence Community</header><text display-inline="no-display-inline">Section
			 1007(a) of the Intelligence Authorization Act for Fiscal Year 2003 (Public Law
			 107–306; 50 U.S.C. 401 note) is amended by striking <quote>Not later than one
			 year after the date on which all members of the Commission are appointed
			 pursuant to section 701(a)(3) of the Intelligence Authorization Act for Fiscal
			 Year 2010,</quote> and inserting <quote>Not later than March 31,
			 2013,</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="H50C01D06311643F3A60A19677A557148" section-type="subsequent-section"><enum>503.</enum><header display-inline="yes-display-inline">Protecting the information technology
			 supply chain of the United States</header>
				<subsection commented="no" display-inline="no-display-inline" id="H66E32AB8883A459EAC4EC4922AF20AA8"><enum>(a)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 the enactment of this Act, the Director of National Intelligence shall submit
			 to the congressional intelligence committees a report that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HDF482A3FA7D34BCC9C137C20A663D5C2"><enum>(1)</enum><text display-inline="yes-display-inline">identifies foreign suppliers of information
			 technology (including equipment, software, and services) that are linked
			 directly or indirectly to a foreign government, including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HF74B554A3F134FDF8C6208CFA689A62F"><enum>(A)</enum><text display-inline="yes-display-inline">by ties to the military forces of a foreign
			 government;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7A39F45FF61049CF833B0971799C9E9C"><enum>(B)</enum><text display-inline="yes-display-inline">by ties to the intelligence services of a
			 foreign government; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9AD8D69A842347828E21C3C6E7A34234"><enum>(C)</enum><text display-inline="yes-display-inline">by being the beneficiaries of significant
			 low interest or no interest loans, loan forgiveness, or other support by a
			 foreign government; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1166625DDEDA4326929457A2BAC970CD"><enum>(2)</enum><text display-inline="yes-display-inline">assesses the vulnerability to malicious
			 activity, including cyber crime or espionage, of the telecommunications
			 networks of the United States due to the presence of technology produced by
			 suppliers identified under paragraph (1).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9C6B396B3F604ED6AF47805071A23C14"><enum>(b)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The report required under subsection (a)
			 shall be submitted in unclassified form, but may include a classified
			 annex.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H4AEF0CA859BC4D6FB1F19D3B1444CF1A"><enum>(c)</enum><header display-inline="yes-display-inline">Telecommunications networks of the United
			 States defined</header><text display-inline="yes-display-inline">In this
			 section, the term <quote>telecommunications networks of the United
			 States</quote> includes—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H58FE98FF37A7449F9CF0A54C6B26CF87"><enum>(1)</enum><text display-inline="yes-display-inline">telephone systems;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC81242A210D049E0BEFE1D4FC0A7B2F1"><enum>(2)</enum><text display-inline="yes-display-inline">Internet systems;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5ACD1BFEAD244ECB8C016372CEB0154A"><enum>(3)</enum><text display-inline="yes-display-inline">fiber optic lines, including cable
			 landings;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEC73D57820F2420D8D11C1F040C4E0C5"><enum>(4)</enum><text display-inline="yes-display-inline">computer networks; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE774ED6C16DB4DF9B1D1D841628E5A70"><enum>(5)</enum><text display-inline="yes-display-inline">smart grid technology under development by
			 the Department of Energy.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id487c6a1131d24ae392ad261e14db2f06" section-type="subsequent-section"><enum>504.</enum><header display-inline="yes-display-inline">Notification regarding the authorized
			 public disclosure of national intelligence</header>
				<subsection commented="no" display-inline="no-display-inline" id="idb026a9c793284dc1ba8111bb5703f880"><enum>(a)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">In the event of an authorized disclosure of
			 national intelligence or intelligence related to national security to the
			 persons or entities described in subsection (b), the government official
			 responsible for authorizing the disclosure shall submit to the congressional
			 intelligence committees on a timely basis a notification of the disclosure
			 if—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id0fbe8b2721194235a441c9bc891a0839"><enum>(1)</enum><text display-inline="yes-display-inline">at the time of the disclosure—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idF5092DF2CA374C90AAC66DF6162F7DF7"><enum>(A)</enum><text display-inline="yes-display-inline">such intelligence is classified; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9D1C80F7231B4EF599DE05FBBD3952E8"><enum>(B)</enum><text display-inline="yes-display-inline">is declassified for the purpose of the
			 disclosure; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a603cd2b1174936a5c4adbcb30376a0"><enum>(2)</enum><text display-inline="yes-display-inline">the disclosure will be made by an officer,
			 employee, or contractor of the Executive branch.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7EE1DA0FEE734B3D86BD2254BF951F90"><enum>(b)</enum><header display-inline="yes-display-inline">Persons or entities described</header><text display-inline="yes-display-inline">The persons or entities described in this
			 subsection are as follows:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id1bd35320aceb4cd5af9665e193bf8c5a"><enum>(1)</enum><text display-inline="yes-display-inline">Media personnel.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2dfea943f84b48baacd2ce23b8a8b0bb"><enum>(2)</enum><text display-inline="yes-display-inline">Any person or entity, if the disclosure
			 described in subsection (a) is made with the intent or knowledge that such
			 information will be made publicly available.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id09c9952d7ad84037854463ee23f1cd3f"><enum>(c)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">Each notification required under subsection
			 (a) shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idd94f2539ace54d5fa2813aef48777358"><enum>(1)</enum><text display-inline="yes-display-inline">provide the specific title and authority of
			 the individual authorizing the disclosure;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida57d636d268e4dd295a4c71e146d2156"><enum>(2)</enum><text display-inline="yes-display-inline">if applicable, provide the specific title
			 and authority of the individual who authorized the declassification of the
			 intelligence disclosed; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id720c74df4c9b4ab0994dee4bbd06b62b"><enum>(3)</enum><text display-inline="yes-display-inline">describe the intelligence disclosed,
			 including the classification of the intelligence prior to its disclosure or
			 declassification and the rationale for making the disclosure.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb0ea1ca0fb1a4b8385d256e7b9a1d0e1"><enum>(d)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The notification requirement in this
			 section does not apply to a disclosure made—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idEA0EF2D2ED7049708CD418228E1C96F4"><enum>(1)</enum><text display-inline="yes-display-inline">pursuant to any statutory requirement,
			 including to section 552 of title 5, United States Code (commonly referred to
			 as the <quote>Freedom of Information Act</quote>);</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6C5602DA46CA411AAA87D5811B72B5EF"><enum>(2)</enum><text display-inline="yes-display-inline">in connection with a civil, criminal, or
			 administrative proceeding;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCFECC33C22124CC38C85CFC8897BDC15"><enum>(3)</enum><text display-inline="yes-display-inline">as a result of a declassification review
			 process under Executive Order 13526 (50 U.S.C. 435 note) or any successor
			 order; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0dcbdee2a05442419ba978c4fd2862e3"><enum>(4)</enum><text display-inline="yes-display-inline">to any officer, employee, or contractor of
			 the Federal government or member of an advisory committee to an element of the
			 intelligence community who possesses an active security clearance and a need to
			 know the specific national intelligence or intelligence related to national
			 security, as defined in section 3(5) of the National Security Act of 1947 (50
			 U.S.C. 401a(5)).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id782ADA1A1A2A4C9EBAECDAF983BE82EB"><enum>(e)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The notification requirements of this
			 section shall cease to be effective for any disclosure described in subsection
			 (a) that occurs on or after the date that is one year after the date of the
			 enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9024253dcdad4ebd97c87e95deb2fef5" section-type="subsequent-section"><enum>505.</enum><header display-inline="yes-display-inline">Technical amendments related to the Office
			 of the Director of National Intelligence</header>
				<subsection commented="no" display-inline="no-display-inline" id="idFB800DD0BFEC4624AF55F8C21632B634"><enum>(a)</enum><header display-inline="yes-display-inline">Personnel practices</header><text display-inline="yes-display-inline">Section 2302(a)(2)(C) of title 5, United
			 States Code, is amended by striking clause (ii) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id89BA39D91F5D436BA9A789A3F74A016F" style="OLC">
						<clause commented="no" display-inline="no-display-inline" id="ID1cde6700c7d447afb6c72d20a8c57a71" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idE581D4057BE24751A915405671B0BD4E"><enum>(I)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation, the
				Central Intelligence Agency, the Defense Intelligence Agency, the National
				Geospatial-Intelligence Agency, the National Security Agency, the Office of the
				Director of National Intelligence, and the National Reconnaissance Office;
				and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id81EBC32EF6AC4FB4BF30B8764C83E8B3" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">as determined by the President, any
				executive agency or unit thereof the principal function of which is the conduct
				of foreign intelligence or counterintelligence activities, provided that the
				determination be made prior to a personnel action;
				or</text>
							</subclause></clause><after-quoted-block>. </after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id98A93AB6BA9F47B0BF391F3423CA836C"><enum>(b)</enum><header display-inline="yes-display-inline">Senior executive service</header><text display-inline="yes-display-inline">Section 3132(a)(1)(B) of title 5, United
			 States Code, is amended by inserting <quote>the Office of the Director of
			 National Intelligence,</quote> after <quote>the Central Intelligence
			 Agency,</quote>.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idac9a59a9feee44f8bccc4e08443d8404" section-type="subsequent-section"><enum>506.</enum><header display-inline="yes-display-inline">Technical amendment for definition of
			 intelligence agency</header><text display-inline="no-display-inline">Section
			 606(5) of the National Security Act of 1947 (50 U.S.C. 426) is amended to read
			 as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id62951619abca4adeb9faee44a1fed2a4" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id1edf0beca8944ce58fcfdbb22a8a12eb"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>intelligence agency</term>
				means the elements of the intelligence community, as that term is defined in
				section
				3(4).</text>

			</section><section commented="no" display-inline="no-display-inline" id="id5fd43a6c7a45486dbff052450662009b" section-type="subsequent-section"><enum>507.</enum><header display-inline="yes-display-inline">Budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the
			 purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be
			 determined by reference to the latest statement titled <quote>Budgetary Effects
			 of PAYGO Legislation</quote> for this Act, submitted for printing in the
			 Congressional Record by the Chairman of the Senate Budget Committee, provided
			 that such statement has been submitted prior to the vote on passage.</text>
