		<official-title display="yes">To prohibit purchases by the Federal
		  Government of Chinese goods and services until the People's Republic of China
		  becomes a party to the Agreement on Government Procurement, and for other
		  purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>China Fair Trade Act of
			 2012</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id485D2E03D1E145C09D7BB5BF1DBFB6D9" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Reciprocal competitive trade
			 practices</header>
			<subsection commented="no" display-inline="no-display-inline" id="id6FF736FD36884BB2955E0E1AB7CE3F6E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 302(a)(2) of the Trade Agreements
			 Act of 1979 (19 U.S.C. 2512(a)(2)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idC6F5EB8B88D940FB84F85E2C0446A5F8" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="IDb7e079a14247425ab2ef8d3aac0162c4"><enum>(2)</enum><header display-inline="yes-display-inline">Exceptions</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9028114548204365ACED48B985318E07"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply in the case
				of procurements for which—</text>
							<clause commented="no" display-inline="no-display-inline" id="id60062AB908B941DFAB8141601755AEC6"><enum>(i)</enum><text display-inline="yes-display-inline">there are no offers of products or services
				of the United States or of eligible products; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id434F4350C7D440A893933ECFCFB11118"><enum>(ii)</enum><text display-inline="yes-display-inline">the offers of products or services of the
				United States or of eligible products are insufficient to fulfill the
				requirements of the United States Government.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD090DB4EA0AA445E80BBDC6FBC52C138"><enum>(B)</enum><header display-inline="yes-display-inline">Special rule with respect to the People's
				Republic of China</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply in the
				case of procurements of products or services of the People's Republic of
				China.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id007C75871011468C9F07C46C76E03957"><enum>(b)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">Section 302(b) of the Trade Agreements Act
			 of 1979 (19 U.S.C. 2512(b)) is amended, in the matter preceding paragraph (1),
			 by inserting <quote>, except in the case of the People's Republic of
			 China,</quote> before <quote>may</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idFA6483BD15394BFD987EBC42BB7E4F4F" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Requirements to buy certain items from
			 American sources</header>
			<subsection commented="no" display-inline="no-display-inline" id="idA2702E94700C4FE192D0F33A83AB0860"><enum>(a)</enum><header display-inline="yes-display-inline">Buy American Act</header><text>Chapter 83
			 of title 41, United States Code (commonly known as the <quote>Buy American
			 Act</quote>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id76E557213F6B4EC8B96CE0FB37F76B10"><enum>(1)</enum><text>in section
			 8302—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7B2FD4B4DA4943959EF5CD2055F577EA"><enum>(A)</enum><text>in subsection
			 (a), by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idB59993D5EB57493FBFD14AD0FE7A49BF" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="id0B990E4C7498409AAACBB4E287D3C43B"><enum>(3)</enum><header>Special rule
				with respect to the People's Republic of China</header><text>The exceptions
				provided under paragraph (1) and subparagraphs (A) and (B) of paragraph (2)
				shall not apply with respect to articles, materials, or supplies mined,
				produced, or manufactured in the People's Republic of China until the date on
				which China becomes a party to the Agreement on Government Procurement
				(described in section 101(d)(17) of the Uruguay Round Agreements Act (19 U.S.C.
				3511(d)(17))).</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57F1C09B15F94D248BE0833BBE85B651"><enum>(B)</enum><text>in subsection
			 (b)(2)(A), by inserting <quote>and the country in which such articles,
			 materials, or supplies were manufactured</quote> after <quote>United
			 States</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id743B3BA703ED493FAFC6AB81D3AF6984"><enum>(2)</enum><text>in section
			 8303(b), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idEF21037EDA724A31B78F1AF9E4FB2C81" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id18F782D687704284B04303FCBDF340CB"><enum>(4)</enum><header>Special rule
				with respect to the People's Republic of China</header><text>The exceptions
				provided under subparagraphs (A) and (B) of paragraph (1) and paragraphs (2)
				and (3) shall not apply with respect to articles, materials, or supplies mined,
				produced, or manufactured in the People's Republic of China until the date on
				which China becomes a party to the Agreement on Government Procurement
				(described in section 101(d)(17) of the Uruguay Round Agreements Act (19 U.S.C.
				3511(d)(17))).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC9394B9F10BC44B98750D6567DD5A282"><enum>(b)</enum><header display-inline="yes-display-inline">Defense contracts for certain
			 articles</header><text display-inline="yes-display-inline">Section 2533a of
			 title 10, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block act-name="" display-inline="no-display-inline" id="idD68611BA0D76487985D609C19D8AEEAF" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="idC80333BACF3847FCABD80AEA3CD4A395"><enum>(l)</enum><header display-inline="yes-display-inline">Inapplicability of exceptions to articles
				from the People's Republic of China</header><text display-inline="yes-display-inline">The exceptions to the requirement in
				subsection (a) provided under subsections (c) through (h) shall not apply with
				respect to items grown, reprocessed, reused, or produced in the People's
				Republic of China until the date on which China becomes a party to the
				Agreement on Government Procurement (described in section 101(d)(17) of the
				Uruguay Round Agreements Act (19 U.S.C.
				3511(d)(17))).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id9C904A3C54664967A281816EE921EC66"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements To use American iron, steel,
			 and manufactured goods under the American Recovery and Reinvestment Act of
			 2009</header><text display-inline="yes-display-inline">Section 1605 of the
			 American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat.
			 303) is amended by adding at the end the following:</text>
				<quoted-block act-name="" display-inline="no-display-inline" id="id44739A7E3D77466DB1E61C7E6ABA7230" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id7685A6443E6A48E580DD0DE34835A5BC"><enum>(e)</enum><text display-inline="yes-display-inline">The exceptions in subsection (b) shall not
				apply with respect to iron, steel, or manufactured goods from the People's
				Republic of China until the date on which China becomes a party to the
				Agreement on Government Procurement (described in section 101(d)(17) of the
				Uruguay Round Agreements Act (19 U.S.C.
				3511(d)(17))).</text>
					</subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id3D45DEF0CD8A421C99D37C2C4632195A" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Report on productive capacity of the
			 People's Republic of China</header>
			<subsection commented="no" display-inline="no-display-inline" id="id3CF21240DF154EBDBB0FB2E0DA17DFD9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary of Commerce shall submit to Congress a
			 report on the productive capacity of the major industrial sectors in the
			 People's Republic of China.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idEA955F1E885145C2BE79ECDB44367794"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report required by subsection (a) shall
			 include an assessment of any steps taken by the Government of the People's
			 Republic of China to develop, expand, retract, or otherwise alter the
			 productive capacity of the sectors identified in the report.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idDCF775BCF5BC49509433A47FF3A97174" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Report on subsidies provided by the
			 People's Republic of China for renewable energy products and
			 technology</header>
			<subsection commented="no" display-inline="no-display-inline" id="id612EE4A9ADB040EABA1FE22810019709"><enum>(a)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary of Energy, in consultation with other
			 appropriate agencies, shall report to Congress regarding the policies of the
			 Government of the People's Republic of China with respect to, and the subsidies
			 provided by the People's Republic of China for, the development and exportation
			 of renewable energy products and technologies. The report shall include an
			 analysis of the impact of those policies and subsidies on United States
			 manufacturers of renewable energy products and technologies.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD0980DC794D94CF3A31AF5777CB4FC20"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idE0FD2DCC26844164B82317965BB9CD83"><enum>(1)</enum><header display-inline="yes-display-inline">Renewable energy</header><text display-inline="yes-display-inline">The term <term>renewable energy</term>
			 means energy generated by a renewable energy resource.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD02EDEE1D0434AEAA43AC9FCEBF84698"><enum>(2)</enum><header display-inline="yes-display-inline">Renewable energy product or
			 technology</header><text display-inline="yes-display-inline">The term
			 <term>renewable energy product or technology</term> means any product,
			 technology, or component of a product used in the development or production of
			 renewable energy.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id222E48672DD548DE92D4AFD25B58A646"><enum>(3)</enum><header display-inline="yes-display-inline">Renewable energy resource</header><text display-inline="yes-display-inline">The term <term>renewable energy
			 resource</term> means—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5BDC68B1A8CA4CB1A24B134C88B2939A"><enum>(A)</enum><text display-inline="yes-display-inline">solar, wind, ocean, tidal, hydrokinetic, or
			 geothermal energy;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91E319325EEF4DED9815084B01753755"><enum>(B)</enum><text display-inline="yes-display-inline">biofuel, biomass, or hydropower; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id334B6123C5B942CB996C9EE80A16144F"><enum>(C)</enum><text display-inline="yes-display-inline">any other renewable energy resource, as
			 determined by the Secretary of Energy.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
