			 whenever in this title an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of the Internal
			 Revenue Code of 1986.</text>

			 temporary exclusion of 100 percent of gain on certain small business
			 stock</header>
				<subsection id="id9B420680F9DF4B428BFEBB07F57AEA41"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (4) of section 1202(a) is amended—</text>

			 <quote>January 1, 2012</quote> and inserting <quote>January 1, 2014</quote>,
			 and</text>

			 <quote>, 2012, or 2013</quote> after <quote>2010</quote>, and</text>
					</paragraph><paragraph id="id2DC86F0A27D544F89679A90F40FFC839"><enum>(2)</enum><text>by inserting
			 <quote><header-in-text level="paragraph" style="OLC">2012, and
			 2013</header-in-text></quote> in the heading thereof.</text>

			 date</header><text>The amendments made by this section shall apply to amounts
			 paid or incurred in taxable years beginning after December 31, 2011.</text>

			 reduction in recognition period for built-in gains tax</header>

			 general</header><text>Paragraph (7) of section 1374(d) is amended—</text>

			 subparagraph (C) as subparagraph (D), and</text>
					</paragraph><paragraph id="idFB8188146D4148D6A687718830149B8E"><enum>(2)</enum><text>by inserting
			 after subparagraph (B) the following new subparagraph:</text>

			 amendment</header><text>Subparagraph (B) of section 1374(d)(2) is amended by
			 inserting <quote>described in subparagraph (A)</quote> after <quote>, for any
			 taxable year</quote>.</text>

			 date</header><text>The amendments made by subsection (a) shall apply to taxable
			 years beginning after December 31, 2011.</text>

			 5-year carryback of general business credits of eligible small
			 businesses</header>

			 general</header><text>Subparagraph (A) of section 39(a)(4) is amended by
			 inserting <quote>or in taxable years beginning in 2012, or 2013</quote> after
			 <quote>2010</quote>.</text>
				</subsection><subsection commented="no" id="idA59BB69C2EE64674B0F2B00E9F93BA87"><enum>(b)</enum><header>Technical
			 amendment</header><text>Section 38(c)(5)(B) is amended—</text>
					<paragraph commented="no" id="id313911ACCEBB409B91208BE790550946"><enum>(1)</enum><text>by striking
			 <quote>the sum of</quote>, and</text>
					</paragraph><paragraph commented="no" id="id51E95CA75D0747238B39CCEB41CB1A25"><enum>(2)</enum><text>by inserting
			 <quote>for any taxable year to which subparagraph (A) applies</quote> after
			 <quote>or (4)</quote>.</text>

				businesses receiving capital since fund inception.</text>
							</paragraph><paragraph id="id7ba026577751458aa0bca0d4ceba5286"><enum>(5)</enum><text>Industry sectors

			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
					<paragraph id="id857B9EB1231942C195406E191545CA06"><enum>(1)</enum><text>small business
			 investment companies would benefit from partnerships with community banks and
			 other lenders, and should work with community banks and other lenders, to
			 ensure that if community banks and other lenders deny an application by a small
			 business concern for a loan, the community banks or other lenders will refer
			 the small business concern to small business investment companies; and</text>
					</paragraph><paragraph id="id6A75855BA06944579613B5AC7610A1B1"><enum>(2)</enum><text>the Administrator
			 of the Small Business Administration (in this Act referred to as the
			 <quote>Administrator</quote>) should—</text>
						<subparagraph id="id4E1E4B716B7D4EE183074CB20FED0B37"><enum>(A)</enum><text>increase outreach
			 to community banks and other lenders to encourage community banks and other
			 lenders to invest in small business investment companies;</text>
						</subparagraph><subparagraph id="id90E75F5514E44888A4E3D7FF63463A99"><enum>(B)</enum><text>use the Internet
			 to make publicly available in a timely manner which small business investment
			 companies are actively soliciting investments and making investments in small
			 business concerns;</text>
						</subparagraph><subparagraph id="idA696421FA959406C852C474A1C501701"><enum>(C)</enum><text>partner with
			 governors, mayors, States, and municipalities to increase outreach by small
			 business investment companies to underserved and rural areas; and</text>
						</subparagraph><subparagraph id="idE429786B97254D59BBB9EFD227D8629E"><enum>(D)</enum><text>continue to make
			 changes to the webpage for the small business investment company program, to
			 make the webpage—</text>
							<clause id="id71DB94753B6E4D399AD32B9581CE39AA"><enum>(i)</enum><text>a
			 more prominent part of the website of the Administration; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idBA5CD1BD023F497A8B0BBD5223E6E0FC"><enum>(ii)</enum><text>more
			 user-friendly.</text>
							</clause></subparagraph></paragraph></section></subtitle><subtitle id="idC28A10BD33B343F784E7E610D96B2D22"><enum>B</enum><header>Low-Interest
			 Refinancing</header>
				<section id="id6C94059B67184742A188B8CE223F9BBF" section-type="subsequent-section"><enum>221.</enum><header>Low-interest
			 refinancing under the local development business loan program</header><text display-inline="no-display-inline">Section 1122(b) of the Small Business Jobs
			 Act of 2010 (15 U.S.C. 696 note) is amended by striking <quote>2 years</quote>
			 and inserting <quote>on the date that is 3 years and 6 months</quote>.</text>

				included</header>
								<subparagraph id="id176E5D7C879E4916B2A2B3C25D08B087"><enum>(A)</enum><header>In
				general</header><text>The database made available under paragraph (2) shall
				include, for each lender making a covered loan—</text>
									<clause id="id1cd4d346ffea45efbebd1693ce01b50d"><enum>(i)</enum><text>the name of the
				lender;</text>

				covered loans made by the lender;</text>

				covered loan is for an existing business or a new business;</text>
									</clause><clause id="idc9d32d9d8aa64fd6b7054687dc5e0d26"><enum>(vii)</enum><text>the number and
				total dollar amount of covered loans made by the lender to—</text>
										<subclause id="id7b9cb6f271884f78810bd39b1975b89b"><enum>(I)</enum><text>small business
				concerns owned and controlled by women;</text>
										</subclause><subclause id="ida6cfafc8f54f4db4a09605da3627a7d0"><enum>(II)</enum><text>socially and
				economically disadvantaged small business concerns (as defined in section
				8(a)(4)(A)); and</text>

				concerns owned and controlled by veterans; and</text>

				database made available under paragraph (2) information relating to covered
				loans made during fiscal years 2009, 2010, 2011, and 2012; and</text>

				information relating to covered loans on an ongoing basis.</text>

				availability</header><text>The Administrator shall retain information relating
				to a covered loan in the database made available under paragraph (2) until not
				earlier than the end of the third fiscal year beginning after the fiscal year

			 Global Markets</header>
			<section id="id93585103D734405584AF5A6ABE9241A6"><enum>301.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Small Business Export Growth
			 Act of 2012</short-title></quote>.</text>
			</section><section id="id2BEE8CCC359C4025A912144A173B4AE7"><enum>302.</enum><header>Report on
			 improvements to Export.gov as a single window for export information</header>
				<subsection id="id7649FDEA883646199E1DA47AC5AED823"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Director of International
			 Trade of the Small Business Administration shall, after consultation with the
			 entities specified in subsection (b), submit to the Committee on Small Business
			 and Entrepreneurship and the Committee on Banking, Housing, and Urban Affairs
			 of the Senate and the Committee on Small Business and the Committee on Foreign
			 Affairs of the House of Representatives a report that includes the
			 recommendations of the Director for improving the experience provided by the
			 website Export.gov (or a successor website) as—</text>
					<paragraph id="id2F3685BC734C4EE28FF93A16F2DB98FF"><enum>(1)</enum><text display-inline="yes-display-inline">a comprehensive resource for information
			 about exporting articles from the United States; and</text>
					</paragraph><paragraph id="id6015F25B032747A7B3935E157F67D4B6"><enum>(2)</enum><text>a single website
			 for exporters to submit all information required by the Federal Government with
			 respect to the exportation of articles from the United States.</text>
					</paragraph></subsection><subsection id="id65AABECAF87A4329A064DC4D325A51B5"><enum>(b)</enum><header>Entities
			 specified</header><text>The entities specified in this subsection are—</text>
					<paragraph id="id2698ECD2F92441AA8AE3B867E1BA50C5"><enum>(1)</enum><text>small business
			 concerns (as defined in section 3 of the Small Business Act (15 U.S.C. 632))
			 that are exporters; and</text>
					</paragraph><paragraph id="id4B70D34419BD4DD7AC8F768C0E0B85CD"><enum>(2)</enum><text>the President's
			 Export Council, State agencies with responsibility for export promotion or
			 export financing, district export councils, and trade associations.</text>
					</paragraph></subsection></section><section id="id315A7EB3BA3D4D2AAE6431440829BF31"><enum>303.</enum><header>Report on
			 developing a single window for information about export control
			 compliance</header>
				<subsection id="id8314B0506C454BDBA891C22C657656C3"><enum>(a)</enum><header>In

			 days after the date of enactment of this Act, the Chief Counsel for Advocacy of
			 the Small Business Administration shall submit to the appropriate congressional
			 committees a report assessing the benefits of developing a website to serve
			 as—</text>
					<paragraph id="id412F284815824B04BCEA8D800F7D1DC1"><enum>(1)</enum><text display-inline="yes-display-inline">a comprehensive resource for complying with
			 and information about the export control laws and regulations of the United
			 States; and</text>
					</paragraph><paragraph id="id9ADCE55948324F749DE57203FCBADA71"><enum>(2)</enum><text>a single website
			 for exporters to submit all information required by the Federal Government with
			 respect to export controls.</text>
					</paragraph></subsection><subsection id="idF24A21CE09C144F5AC22270EF202C300"><enum>(b)</enum><header>Appropriate
			 congressional committees defined</header><text>In this section, the term
			 <term>appropriate congressional committees</term> means—</text>
					<paragraph id="idE26A6F8EB883416F85404655C5B6B5D0"><enum>(1)</enum><text>the Committee on
			 Commerce, Science, and Transportation, the Committee on Banking, Housing, and
			 Urban Affairs, and the Committee on Small Business and Entrepreneurship of the
			 Senate; and</text>

			 which shall include conducting not fewer than 1 outreach event each fiscal year
			 in each State that promotes exporting as a business development opportunity for
			 small business concerns</quote> before the semicolon.</text>
			</section><section id="id5763191BFB1D4632A133D703EAFD3A94"><enum>305.</enum><header>Export control
			 education</header><text display-inline="no-display-inline">Section 22 of the
			 Small Business Act (15 U.S.C. 649) is amended—</text>

				</paragraph></section><section id="id03462CD17A7A4AD9A7508AF41596CFDE"><enum>306.</enum><header>Small Business
			 Inter-Agency Task Force on Export Financing</header><text display-inline="no-display-inline">The Administrator, in consultation with the
			 Secretary of Agriculture, the President of the Export-Import Bank of the United
			 States, and the President of the Overseas Private Investment Corporation shall
			 jointly establish a Small Business Inter-Agency Task Force on Export Financing
			 to—</text>
				<paragraph id="idFBE478AD93EF49808D6129068908E777"><enum>(1)</enum><text>review and
			 improve Federal export finance programs for small business concerns; and</text>
				</paragraph><paragraph id="id20352760DF264368B64F52718C1F2D24"><enum>(2)</enum><text>coordinate the
			 activities of the Federal Government to assist small business concerns seeking
			 to export.</text>
				</paragraph></section><section id="IDd503120d7aad45818c89f76a0f31a347"><enum>307.</enum><header>Promotion of
			 exports by rural small businesses</header>
				<subsection id="id77850E9AABC54814806E550FFF02E657"><enum>(a)</enum><header>Small Business
			 Administration-United States Department of Agriculture interagency
			 coordination</header>
					<paragraph id="id78A77D5248B74DC3BF0D3D236911E31F"><enum>(1)</enum><header>Export
			 financing programs</header><text display-inline="yes-display-inline">In
			 coordination with the Secretary of Agriculture, the Administrator shall develop
			 a program to cross-train export finance specialists and personnel from the
			 Office of International Trade of the Administration on the export financing
			 programs of the Department of Agriculture and the Foreign Agricultural
			 Service.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5c689e52d75240a7a1b4d867dfd04dc3"><enum>(2)</enum><header>Export
			 assistance and business counseling programs</header><text>In coordination with
			 the Secretary of Agriculture and the Foreign Agricultural Service, the
			 Administrator shall develop a program to cross-train export finance
			 specialists, personnel from the Office of International Trade of the
			 Administration, Small Business Development Centers, women's business centers,
			 the Service Corps of Retired Executives authorized by section 8(b)(1) of the
			 Small Business Act (15 U.S.C. 637(b)(1)), Export Assistance Centers, and other
			 resource partners of the Administration on the export assistance and business
			 counseling programs of the Department of Agriculture.</text>
					</paragraph></subsection><subsection id="idEDD4D86AC15B41F5BB01188D5E7CD088"><enum>(b)</enum><header>Report on
			 lenders</header><text display-inline="yes-display-inline">Section 7(a)(16)(F)
			 of the Small Business Act (15 U.S.C. 636(a)(16)(F)) is amended—</text>
					<paragraph id="id0F724BD4941A4ECD8CE738CFF57A4121"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i)—</text>
						<subparagraph id="id6D25259F555E47C2A8B5F8830401EE30"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subclauses (I) through

				assistance or business counseling services to rural small businesses concerns;
				and</text>

					</paragraph></subsection></section><section id="IDa644392b78d04e928a8971c8d24cdf86"><enum>308.</enum><header>Registry of
			 export management and export trading companies</header>
				<subsection id="idE16B9BC70CA24EAFA38BDD4DC3A46996"><enum>(a)</enum><header>Coordination
			 with export management companies and export trading companies</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Administrator
			 shall establish a program to register export management companies, as that term
			 is defined by the Department of Commerce, and export trading companies, as that
			 term is defined in section 103 of the Export Trading Company Act of 1982 (15
			 U.S.C. 4002).</text>
				</subsection><subsection id="ID0aabdb98657c4b38acb3f4d19fac8139"><enum>(b)</enum><header>Requirements</header><text>The
			 program established under subsection (a) shall—</text>
					<paragraph id="idA36982F75CD74C67B2382A8C024E1146"><enum>(1)</enum><text>be similar to the
			 program of the Administration for registering franchise companies, as in effect
			 on the date of enactment of this Act; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id691414CF7FA442D7B82782B28166FA27"><enum>(2)</enum><text>require that a
			 list of the export management companies and export trading companies that
			 register under the program, categorized by the type of product exported by the
			 company, be made available on the website of the Administration.</text>
					</paragraph></subsection></section><section id="ID2f348e1a696547878ea655400b20818b"><enum>309.</enum><header>Reverse trade
			 missions</header><text display-inline="no-display-inline">Section 22(c) of the
			 Small Business Act (15 U.S.C. 649(c)) is amended—</text>
				<paragraph id="id84CC10A3CDA046BEB0C64723341C03C0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (12), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id005CC0F706E74F979513D869FC434408"><enum>(2)</enum><text>in paragraph
			 (13), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>

			 Jobs Act of 2010 (15 U.S.C. 649b note) is amended by inserting after
			 <quote>Guam,</quote> the following: <quote>the Commonwealth of the Northern
			 Mariana Islands,</quote>.</text>
			</section><section id="IDdae00947e582473dbd3304e792b39327"><enum>311.</enum><header>Promotion of
			 interagency details</header><text display-inline="no-display-inline">It is the
			 sense of Congress that the Administrator should periodically detail staff of
			 the Administration to other Federal agencies that are members of the Trade
			 Promotion Coordinating Committee, to facilitate the cross training of the staff
			 of the Administration on the export assistance programs of such other
			 agencies.</text>
			</section><section id="IDc32339fcd8b14dd1b377a14884391f0e"><enum>312.</enum><header>Annual export
			 strategy</header><text display-inline="no-display-inline">Section 22 of the
			 Small Business Act (15 U.S.C. 649), as amended by section 305 of this Act, is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9E4FD9EA875742658B23DFC13285B50E" style="OLC">
					<subsection id="ID94d991c885c948b68eb18718d666d6f9"><enum>(m)</enum><header>Small business
				trade strategy</header>
						<paragraph id="ID8c97af8f2ede4b019c32e0767708b9aa"><enum>(1)</enum><header>Development of
				small business trade strategy</header><text>The Associate Administrator shall
				develop and maintain a small business trade strategy that is included in the
				report on the governmentwide strategic plan for Federal trade promotion
				required to be submitted to Congress by the Trade Promotion Coordinating
				Committee under section 2312(f)(1) of the Export Enhancement Act of 1988 (15
				U.S.C. 4727(f)(1)) that includes, at a minimum—</text>
							<subparagraph id="ID5dd9d4b528e04309bd4d4215c864ffe9"><enum>(A)</enum><text>strategies to
				increase export opportunities for small business concerns, including a specific
				strategy to increase opportunities for small business concerns that are new to
				exporting;</text>
							</subparagraph><subparagraph id="IDa72a6caded9c43469e34d33e907fff44"><enum>(B)</enum><text>recommendations
				to increase the competitiveness in the global economy of small business
				concerns in the United States that are part of industries in which small
				business concerns account for a high proportion of participating
				businesses;</text>
							</subparagraph><subparagraph id="IDecdce6f8ad644883b0c47dbcb60e1af5"><enum>(C)</enum><text>recommendations
				to protect small business concerns from unfair trade practices, including
				intellectual property violations;</text>
							</subparagraph><subparagraph id="idE7252096DFD44218B918B85E7F5C4E8A"><enum>(D)</enum><text>recommendations
				for strategies to promote and facilitate opportunities in the foreign markets
				that are most accessible for small business concerns that are new to exporting;
				and</text>
							</subparagraph><subparagraph id="ID3ddd3edc6ce149da8fbdab1c4128598b"><enum>(E)</enum><text>strategies to
				expand the representation of small business concerns in the formation and
				implementation of United States trade policy.</text>
							</subparagraph></paragraph><paragraph id="ID9276f44234f14b8986f04ebbecfbb564"><enum>(2)</enum><header>Annual report
				to Congress</header><text>At the beginning of each fiscal year, the Associate
				Administrator shall submit to the Committee on Small Business and
				Entrepreneurship of the Senate and the Committee on Small Business of the House
				of Representatives a report on the small business trade strategy required under
				paragraph (1), which shall contain, at a minimum—</text>
							<subparagraph id="id0B1EBFB67E344246AF95AED18A46E399"><enum>(A)</enum><text>a description of
				each strategy and recommendation described in paragraph (1);</text>
							</subparagraph><subparagraph id="id86D084B96F8A467D9B3E1282577EB00F"><enum>(B)</enum><text>specific policies
				and objectives, together with timelines for the implementation of such policies
				and objectives; and</text>
							</subparagraph><subparagraph id="id37B7DCA4920844E8A94294B9B78288A1"><enum>(C)</enum><text>a description of
				the progress of the Administration in implementing the strategies and
				recommendations contained in the report submitted for the preceding fiscal
				year.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 Mentoring, Education, and Strategic Partnerships</header>

				in consultation with a representative from each entrepreneurial development
				program of the Administration, shall develop and submit to Congress a plan for
				using the entrepreneurial development programs of the Administration to create
				jobs during fiscal years 2013 and 2014.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6F72897F942149E9BEFF5B7E320B1115"><enum>(B)</enum><header>Contents of
				plan</header><text display-inline="yes-display-inline">The plan required under
				subparagraph (A) shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="idD3A2C0331A734ACBBD72C90A6BEA971E"><enum>(i)</enum><text display-inline="yes-display-inline">include the plan of the Administrator for
				using existing programs, including small business development centers, women’s
				business centers, the Service Corps of Retired Executives authorized by section
				8(b)(1), Veterans Business Outreach Centers, and programs of the Office of
				Native American Affairs, to create jobs;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id823EE46FD7984FEF8ED51F6D754C3857"><enum>(ii)</enum><text display-inline="yes-display-inline">identify a strategy for each region of the
				Administration to use programs of the Administration to create or retain jobs
				in the region; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idC35E96DA73DF445EBDF1D5D20D8B8085"><enum>(iii)</enum><text display-inline="yes-display-inline">establish performance measures and
				criteria, including goals for job creation, job retention, and job retraining,
				to evaluate the success of the plan.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF93CA8A0900842A6B809CB7479600675"><enum>(2)</enum><header display-inline="yes-display-inline">Data collection process</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id476214C9F7A044ACA41023EAE238A90E"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Administrator
				shall, after notice and opportunity for comment, promulgate a rule to develop
				and implement a consistent data collection process for the entrepreneurial
				development programs.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99DAABD63BB0455C8A9CA6319E57DD5B"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The data collection process developed under
				subparagraph (A) shall collect data relating to job creation and performance
				and any other data determined appropriate by the Administrator.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H261E80E59A7B46639ED64E4D3E538F3C"><enum>(3)</enum><header display-inline="yes-display-inline">Coordination and Alignment of SBA
				Entrepreneurial Development Programs</header><text display-inline="yes-display-inline">The Administrator, in consultation with
				other Federal departments and agencies as the Administrator determines is
				appropriate, shall submit an annual report to Congress describing opportunities
				to foster coordination of, limit duplication among, and improve program
				delivery for Federal entrepreneurial development programs.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB744BC288234434B8DD34406D8D33245"><enum>(4)</enum><header display-inline="yes-display-inline">Database of Entrepreneurial Development
				Service Providers</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="idEE1B77F4993E47CCBD6B9461B08E5713"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">After providing a period of 60 days for
				public comment, the Administrator shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="id7994B48BC6C64AE4932152E9AF301D1C"><enum>(i)</enum><text display-inline="yes-display-inline">establish a database of providers of
				entrepreneurial development services; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idF07EFBE615D8457B9FA93BA889ABA405"><enum>(ii)</enum><text display-inline="yes-display-inline">make the database available through the
				website of the Administration.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3884225420C64759B08B1AFC6B8E223C"><enum>(B)</enum><header>Searchability</header><text display-inline="yes-display-inline">The database established under subparagraph
				(A) shall be searchable by industry, geographic location, and service
				required.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4311EFDD4AF74F2BB953632846B328E4"><enum>(5)</enum><header display-inline="yes-display-inline">Community specialist</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id51F86D690AAC46A7BC86F132795B73C1"><enum>(A)</enum><header>Designation</header><text display-inline="yes-display-inline">The Administrator shall designate not fewer
				than 1 staff member in each district office of the Administration as a
				community specialist whose full-time responsibility is working with local
				providers of entrepreneurial development services to increase coordination with
				Federal entrepreneurial development programs.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87F4D0D25FE3463FBC97C37C090B5A64"><enum>(B)</enum><header>Performance</header><text display-inline="yes-display-inline">The Administrator shall develop benchmarks
				for measuring the performance of community specialists under this
				paragraph.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				Administrator may provide annual programmatic and financial examination
				training for women’s business ownership representatives and district office
				technical representatives of the Administration to enable representatives to
				carry out their responsibilities.</text>
								</paragraph><paragraph id="idf19f26a4-977c-48ae-a8c2-03c1e85260ad"><enum>(4)</enum><header>Program and
				transparency improvements</header><text>The Administrator shall maximize the
				transparency of the women’s business center financial assistance proposal
				process and the programmatic and financial examination process by—</text>
									<subparagraph id="id66c3be8e-178e-43e7-a5a6-ea317ceca83c"><enum>(A)</enum><text>providing
				public notice of any announcement for financial assistance under subsection (b)
				or a grant under subsection (l) not later than the end of the first quarter of
				each fiscal year;</text>
									</subparagraph><subparagraph id="id2bcc6463-3c17-42b8-a97a-da02658eb8b4"><enum>(B)</enum><text>in the
				announcement described in subparagraph (A), outlining award and program
				evaluation criteria and describing the weighting of the criteria for financial
				assistance under subsection (b) and grants under subsection (l);</text>
									</subparagraph><subparagraph id="id012dca20-2dca-429a-a14c-3034602d3e4c"><enum>(C)</enum><text>minimizing
				paperwork and reporting requirements for applicants for and recipients of
				financial assistance under this section;</text>
									</subparagraph><subparagraph id="id42bdb955-4689-48f0-82f8-46beaed88500"><enum>(D)</enum><text>standardizing
				the programmatic and financial examination process; and</text>
									</subparagraph><subparagraph id="ida350310d-8f18-40df-8993-3678436b6813"><enum>(E)</enum><text>providing to
				each women’s business center, not later than 60 days after the completion of a
				site visit to the women's business center (whether conducted for an audit,
				performance review, or other reason), a copy of any site visit reports or
				evaluation reports prepared by district office technical representatives or
				officers or employees of the
				Administration.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="id52caa876-a89e-483d-9476-50f07282f52e"><enum>(b)</enum><header>Change of
			 title</header>
						<paragraph id="ida817f7cb-d825-4a66-9909-6b507f08d4de"><enum>(1)</enum><header>In
			 general</header><text>Section 29 of the Small Business Act (15 U.S.C. 656) is
			 amended—</text>

			 Business Center Program</header>
					<subsection id="id933a3f52-521c-4af5-8543-034768bc6ea6"><enum>(a)</enum><header>Women’s
			 Business Center financial assistance</header><text>Section 29 of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 656) is
			 amended—</text>
						<paragraph id="ida1b5e0df-11ec-4dd4-9e0c-e6474d1ada15"><enum>(1)</enum><text>in subsection
			 (a), as amended by section 423(b) of this Act—</text>
							<subparagraph id="id10708542-3767-4209-b668-e543353dfd27"><enum>(A)</enum><text>by inserting
			 before paragraph (2) the following:</text>
								<quoted-block id="ide044b36a-5dc1-4f84-b8ce-89f8fa3a5646" style="OLC">
									<paragraph id="id6b30f4b8-6666-4784-bc42-9d6c490caac2"><enum>(1)</enum><text>the term
				<term>association of women’s business centers</term> means an
				organization—</text>

				represents not less than 51 percent of the women’s business centers that
				participate in a program under this section; and</text>

				purpose is to represent women’s business
				centers;</text>

							</subparagraph><subparagraph id="id4ccb80b7-33e2-457a-b3db-458041f58433"><enum>(B)</enum><text>by inserting
			 after paragraph (2) the following:</text>

				nonprofit organization;</text>
										</subparagraph><subparagraph id="iddca19449-89a7-4c94-8e3d-888977ed6e47"><enum>(B)</enum><text>a State,
				regional, or local economic development organization;</text>
										</subparagraph><subparagraph id="ida67335cd-34c3-47ff-bb6f-d4d09c3111fa"><enum>(C)</enum><text>a
				development, credit, or finance corporation chartered by a State;</text>
										</subparagraph><subparagraph id="idaa249aa6-9d1f-4d9d-9cd4-54fb236e360f"><enum>(D)</enum><text>a junior or
				community college, as defined in section 312(f) of the Higher Education Act of
				1965 (20 U.S.C. 1058(f)); or</text>
										</subparagraph><subparagraph id="id39e91dfa-b6fa-499e-975a-0268c70cfc9a"><enum>(E)</enum><text>any
				combination of entities listed in subparagraphs (A) through
				(D);</text>
										</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subparagraph><subparagraph id="id146aa9aa-6223-4af0-9029-533b0100f99b"><enum>(C)</enum><text>by adding
			 after paragraph (5) the following:</text>
								<quoted-block display-inline="no-display-inline" id="id485fea0d-e944-4eb5-9923-734ac112fdc2" style="OLC">
									<paragraph id="id17df88ee-8bd3-4260-8630-5c044254a0f3"><enum>(6)</enum><text>the term
				<term>women's business center</term> means a project conducted by an eligible
				entity under this
				section.</text>
									</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="idb1c85481-8bde-41bb-949b-07de52240f85"><enum>(2)</enum><text>in subsection
			 (b)—</text>
							<subparagraph id="id8ca70430-e962-456b-81e6-f52f73b8e03a"><enum>(A)</enum><text>by
			 redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C),
			 and adjusting the margins accordingly;</text>

			 <quote>The projects shall</quote> and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="idf66a8170-b531-4e4e-885b-f0571b5bdc73" style="OLC">
									<paragraph id="id9f21c430-f16b-45af-a748-3ad16cada6e8"><enum>(2)</enum><header>Use of
				funds</header><text>The project shall be designed to provide training and
				counseling that meets the needs of women, especially socially and economically
				disadvantaged women, and shall</text>
									</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subparagraph><subparagraph id="id40485cc0-6784-4c4b-b312-7693c9635ce3"><enum>(D)</enum><text>by adding at
			 the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="idbf685923-a2e6-46d3-af21-9613a70fa560" style="OLC">
									<paragraph id="id91bf2070-c55a-4cfe-b0fa-1bea0cb31afb"><enum>(3)</enum><header>Amount of
				financial assistance</header>
										<subparagraph id="id4c13069c-bac1-4cca-9157-61e019e0ed29"><enum>(A)</enum><header>In
				general</header><text>The Administrator may award financial assistance under
				this subsection of not less than $100,000 and not more than $150,000 per
				year.</text>
										</subparagraph><subparagraph id="id1DF92A94D6D1464E972A4130EDE2E318"><enum>(B)</enum><header>Lower
				amount</header><text>The Administrator may award financial assistance under
				this subsection to a recipient in an amount that is less than $100,000 if the
				Administrator determines that the recipient is unable to make a non-Federal
				contribution of $100,000 or more, as required under subsection (c).</text>
										</subparagraph><subparagraph id="iddabbdb26-4a27-469d-b4bf-93acffc2400e"><enum>(C)</enum><header>Equal
				allocations</header><text>If the Administration has insufficient funds to
				provide financial assistance of not less than $100,000 for each recipient of
				financial assistance under this subsection in any fiscal year, the
				Administrator shall provide an equal amount of financial assistance to each
				recipient in the fiscal year, unless a recipient requests a lower amount than
				the allocated amount.</text>
										</subparagraph></paragraph><paragraph id="iddb2fe2e7-aa50-4c88-ad1a-f4254ffa446b"><enum>(4)</enum><header>Consultation
				with associations of women’s business centers</header><text>The Administrator
				shall consult with each association of women’s business centers to
				develop—</text>
										<subparagraph id="idb341f69a-81d5-4134-8320-a8509b0910ad"><enum>(A)</enum><text>a training
				program for the staff of women’s business centers and the Administration;
				and</text>
										</subparagraph><subparagraph id="id92f015ab-1c35-4ada-b2a5-125b055b077d"><enum>(B)</enum><text>recommendations
				to improve the policies and procedures for governing the general operations and
				administration of the women’s business center program, including grant program
				improvements under subsection (g)(4).</text>
										</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="id86327674-1eb1-46dd-bced-37232dcf4f6c"><enum>(3)</enum><text>in subsection
			 (c)—</text>
							<subparagraph id="id71040b42-f1c5-4b7c-a4ac-0eb37b3121fd"><enum>(A)</enum><text>in paragraph
			 (1) by striking <quote>the recipient organization</quote> and inserting
			 <quote>an eligible entity</quote>;</text>

				project under this section separately from other projects, if any, of the
				eligible entity; and</text>
										</subparagraph><subparagraph id="id47E0A8C4471348A697E15ADB58FFD7CB"><enum>(B)</enum><text>separately
				maintain and account for any financial assistance under this
				section.</text>
										</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="ida9cb32ce-4141-4f1d-8152-50898e869b77"><enum>(4)</enum><text>in subsection
			 (e)—</text>
							<subparagraph id="idddc8c966-c239-4a1a-aabc-70a127794273"><enum>(A)</enum><text>by striking
			 <quote>applicant organization</quote> and inserting <quote>eligible
			 entity</quote>;</text>
							</subparagraph><subparagraph id="id87b368bc-2db9-4dcb-be38-b1897d9d3f87"><enum>(B)</enum><text>by striking
			 <quote>a recipient organization</quote> and inserting <quote>an eligible
			 entity</quote>; and</text>
							</subparagraph><subparagraph commented="no" id="id484fe0ea-087f-4c16-aa57-7f8a6fc2247f"><enum>(C)</enum><text>by striking
			 <quote>site</quote>;</text>
							</subparagraph></paragraph><paragraph id="id295cad88-5f35-41a0-9fa2-384adef14c0c"><enum>(5)</enum><text>by striking
			 subsection (f) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="ida20e9c86-ac0e-4f06-bac2-93de99ccb51e" style="OLC">
								<subsection id="id06cbf90d-d9c9-459b-b511-d22fec739ad8"><enum>(f)</enum><header>Applications
				and criteria for initial financial assistance</header>
									<paragraph id="idf054b39e-6aed-4242-8b64-ed8f9c76905c"><enum>(1)</enum><header>Application</header><text>Each
				eligible entity desiring financial assistance under subsection (b) shall submit
				to the Administrator an application that contains—</text>
										<subparagraph id="id41c93006-c29c-4794-89a3-d325d778a634"><enum>(A)</enum><text>a
				certification that the eligible entity—</text>
											<clause id="id3e2843de-5865-4439-8438-6820e5a98c67"><enum>(i)</enum><text>has
				designated an executive director or program manager, who may be compensated
				using financial assistance under subsection (b) or other sources, to manage the
				center on a full-time basis;</text>
											</clause><clause id="id085e1dad-1fc1-4e3d-8642-090b00d2a1a5"><enum>(ii)</enum><text>as a
				condition of receiving financial assistance under subsection (b),
				agrees—</text>
												<subclause id="id36abeffe-6afc-4bf1-824b-acda44b05db5"><enum>(I)</enum><text>to receive a
				site visit by the Administrator as part of the final selection process;</text>
												</subclause><subclause id="id6ea603eb-5a8e-41c4-9fcd-86f012cda89b"><enum>(II)</enum><text>to undergo
				an annual programmatic and financial examination; and</text>
												</subclause><subclause id="id8b047a9c-3d91-4867-8b8f-a9167ccf3621"><enum>(III)</enum><text>to the
				maximum extent practicable, to remedy any problems identified pursuant to the
				site visit or examination under subclause (I) or (II); and</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3f703a4b-420c-4937-bc40-78fd990d9ac2"><enum>(iii)</enum><text display-inline="yes-display-inline">meets the accounting and reporting
				requirements established by the Director of the Office of Management and
				Budget;</text>
											</clause></subparagraph><subparagraph id="id9e0ee235-2f3d-44a6-8049-f578127856b6"><enum>(B)</enum><text>information
				demonstrating that the eligible entity has the ability and resources to meet
				the needs of the market to be served by the women's business center for which
				financial assistance under subsection (b) is sought, including the ability to
				obtain the non-Federal contribution required under subsection (c);</text>
										</subparagraph><subparagraph id="id7514f207-9d6c-4fe4-951e-e8160c04e287"><enum>(C)</enum><text>information
				relating to the assistance to be provided by the women's business center for
				which financial assistance under subsection (b) is sought in the area in which
				the women's business center is located;</text>
										</subparagraph><subparagraph id="ida20d1960-75b9-49a7-8c00-2a5477c0ecf0"><enum>(D)</enum><text>information
				demonstrating the experience and effectiveness of the eligible entity
				in—</text>
											<clause id="id3f20054c-c648-4e3a-baa4-53d26c1b8932"><enum>(i)</enum><text>conducting
				financial, management, and marketing assistance programs, as described in
				subsection (b)(2), which are designed to teach or upgrade the business skills
				of women who are business owners or potential business owners;</text>
											</clause><clause id="id6bf6501b-4abc-41d2-8b43-61a2bd0c20fd"><enum>(ii)</enum><text>providing
				training and services to a representative number of women who are socially and
				economically disadvantaged; and</text>
											</clause><clause id="id25f0f0b4-4f5e-47fd-afd7-68697e2b1ebc"><enum>(iii)</enum><text>working
				with resource partners of the Administration and other entities, such as
				universities; and</text>
											</clause></subparagraph><subparagraph id="idcacf056a-4de4-467f-8654-2d608a97bb50"><enum>(E)</enum><text>a 5-year plan
				that describes the ability of the women's business center for which financial
				assistance is sought—</text>
											<clause id="idfe9cdf0a-5a67-49b3-ad20-738c47208690"><enum>(i)</enum><text>to serve
				women who are business owners or potential business owners by conducting
				training and counseling activities; and</text>
											</clause><clause id="idb8e70afe-edfa-42c4-93c8-d185e107098b"><enum>(ii)</enum><text>to provide
				training and services to a representative number of women who are socially and
				economically disadvantaged.</text>
											</clause></subparagraph></paragraph><paragraph id="idf081457b-991f-4e98-9a3a-521d4f4d74ea"><enum>(2)</enum><header>Additional
				information</header><text>The Administrator shall make any request for
				additional information from an organization applying for financial assistance
				under subsection (b) that was not requested in the original announcement in
				writing.</text>
									</paragraph><paragraph id="id892333f3-aafb-4369-a167-2349f966b772"><enum>(3)</enum><header>Review and
				approval of applications for initial financial assistance</header>
										<subparagraph id="id0e9abbae-d8ee-47fc-855f-a2a0797a98e8"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall—</text>
											<clause id="idab1fa9e5-8c5c-4263-a8bc-0ee7fc4559dd"><enum>(i)</enum><text>review each
				application submitted under paragraph (1), based on the information described
				in such paragraph and the criteria set forth under subparagraph (B) of this
				paragraph; and</text>
											</clause><clause id="id5210e91d-0a8c-4837-9b60-6885b0b4122f"><enum>(ii)</enum><text>to the
				extent practicable, as part of the final selection process, conduct a site
				visit to each women's business center for which financial assistance under
				subsection (b) is sought.</text>
											</clause></subparagraph><subparagraph id="idf7d747a0-04c7-4526-a86a-2d3dd733ad63"><enum>(B)</enum><header>Selection
				criteria</header>
											<clause id="idba433d4e-62b2-405b-931b-3742be04bf49"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall evaluate applicants for financial
				assistance under subsection (b) in accordance with selection criteria that
				are—</text>
												<subclause id="id80265b24-c175-411d-be52-69376dee5252"><enum>(I)</enum><text>established
				before the date on which applicants are required to submit the
				applications;</text>
												</subclause><subclause id="id8f532050-7a25-4e72-9807-829611336424"><enum>(II)</enum><text>stated in
				terms of relative importance; and</text>
												</subclause><subclause id="id066c343a-6270-4def-b8e4-7a806f43bca9"><enum>(III)</enum><text>publicly
				available and stated in each solicitation for applications for financial
				assistance under subsection (b) made by the Administrator.</text>
												</subclause></clause><clause id="ide402d19b-edf4-4c47-b0a9-e1e41b6e3640"><enum>(ii)</enum><header>Required
				criteria</header><text>The selection criteria for financial assistance under
				subsection (b) shall include—</text>
												<subclause id="idf0e56ea5-1d9d-48ae-b280-464b21c6c452"><enum>(I)</enum><text>the
				experience of the applicant in conducting programs or ongoing efforts designed
				to teach or enhance the business skills of women who are business owners or
				potential business owners;</text>
												</subclause><subclause id="id9e88192a-8328-4839-aaac-b14cb6422206"><enum>(II)</enum><text>the ability
				of the applicant to begin a project within a minimum amount of time;</text>
												</subclause><subclause id="id0e55fba3-1753-419b-a5d8-bb8779b1430b"><enum>(III)</enum><text>the ability
				of the applicant to provide training and services to a representative number of
				women who are socially and economically disadvantaged; and</text>
												</subclause><subclause id="id87b25b84-7c08-4b13-89e6-ab39e139dadb"><enum>(IV)</enum><text>the location
				for the women's business center proposed by the applicant, including whether
				the applicant is located in a State in which there is not a women's business
				center receiving funding from the Administration.</text>
												</subclause></clause></subparagraph><subparagraph id="id27501ece-5b87-40cf-842d-498f730a7c82"><enum>(C)</enum><header>Proximity</header><text>If
				the principal place of business of an applicant for financial assistance under
				subsection (b) is located less than 50 miles from the principal place of
				business of a women’s business center that received funds under this section on
				or before the date of the application, the applicant shall not be eligible for
				the financial assistance, unless the applicant submits a detailed written
				justification of the need for an additional center in the area in which the
				applicant is located.</text>
										</subparagraph><subparagraph id="id52333bb8-f304-4959-9e4c-123043722972"><enum>(D)</enum><header>Record
				retention</header><text>The Administrator shall maintain a copy of each
				application submitted under this subsection for not less than 7
				years.</text>
										</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</paragraph><paragraph id="idb88a2e5d-e912-4b6c-955c-8b7d4dbb8cd7"><enum>(6)</enum><text>in subsection
			 (m)—</text>
							<subparagraph id="id2784C54184FD4BB892254D3DD184EAD1"><enum>(A)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="idfd293125-7c7a-481e-8381-87077d35fb52" style="OLC">
									<paragraph id="idde04663d-db06-4ac4-8e46-f84a8a09a865"><enum>(3)</enum><header>Application
				and approval for renewal grants</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="idD9FCE61885954AE6BA984F875EFFB6E7"><enum>(A)</enum><header display-inline="yes-display-inline">Solicitation of applications</header><text display-inline="yes-display-inline">The Administrator shall solicit
				applications and award grants under this subsection for the first fiscal year
				beginning after the date of enactment of the <short-title>Women's Small Business Ownership Act of
				2012</short-title>, and every third fiscal year thereafter.</text>
										</subparagraph><subparagraph id="idbeb23d75-4497-4612-ad8b-229615e3257c"><enum>(B)</enum><header>Contents of
				application</header><text>Each eligible entity desiring a grant under this
				subsection shall submit to the Administrator an application that
				contains—</text>
											<clause id="id0ad456e3-6acd-4fb8-b235-91729e26f739"><enum>(i)</enum><text>a
				certification that the applicant—</text>
												<subclause id="id7e980a1d-3497-436e-9e33-93d8ffc1f63f"><enum>(I)</enum><text>is an
				eligible entity;</text>
												</subclause><subclause id="id965460a2-302a-4b3c-9bb5-5d6667063113"><enum>(II)</enum><text>has
				designated a full-time executive director or program manager to manage the
				women's business center operated by the applicant; and</text>
												</subclause><subclause id="id3be2caf7-9a4b-49a1-a5b1-4c952d66b41b"><enum>(III)</enum><text>as a
				condition of receiving a grant under this subsection, agrees—</text>
													<item id="id07c15a44-6f3f-47e0-b4cd-9b47cc81f00c"><enum>(aa)</enum><text>to receive a
				site visit as part of the final selection process;</text>
													</item><item id="idb74cc68e-2bd9-46c7-bf53-5d0edbeac2bd"><enum>(bb)</enum><text>to submit,
				for the 2 full fiscal years before the date on which the application is
				submitted, annual programmatic and financial examination reports or certified
				copies of the compliance supplemental audits under OMB Circular A–133 of the
				applicant; and</text>
													</item><item id="id6016ee29-9d4a-4dd9-a22c-9d7c185bfa06"><enum>(cc)</enum><text>to remedy
				any problem identified pursuant to the site visit or examination under item
				(aa) or (bb);</text>
													</item></subclause></clause><clause id="id7fa3d318-4808-44bb-8393-f4c5021bcf9e"><enum>(ii)</enum><text>information
				demonstrating that the applicant has the ability and resources to meet the
				needs of the market to be served by the women's business center for which a
				grant under this subsection is sought, including the ability to obtain the
				non-Federal contribution required under paragraph (4)(C);</text>
											</clause><clause id="ida741d333-311b-4a83-91e6-9f81e7696171"><enum>(iii)</enum><text>information
				relating to assistance to be provided by the women's business center in the
				area served by the women's business center for which a grant under this
				subsection is sought;</text>
											</clause><clause id="id2427438d-b576-4a84-96e1-b3d33d44c99c"><enum>(iv)</enum><text>information
				demonstrating that the applicant has worked with resource partners of the
				Administration and other entities;</text>
											</clause><clause id="idad42a552-f3a7-46fb-9be9-919d4c96f169"><enum>(v)</enum><text>a 3-year plan
				that describes the ability of the women's business center for which a grant
				under this subsection is sought—</text>
												<subclause id="id66033e54-3893-4520-9751-7c0aa5b4ed32"><enum>(I)</enum><text>to serve
				women who are business owners or potential business owners by conducting
				training and counseling activities; and</text>
												</subclause><subclause id="id6b9e0163-a63c-4f82-bf6e-6a32c874d8a6"><enum>(II)</enum><text>to provide
				training and services to a representative number of women who are socially and
				economically disadvantaged; and</text>
												</subclause></clause><clause id="id27c4ecce-a4b6-46c4-a17e-1e16c9bb770c"><enum>(vi)</enum><text>any
				additional information that the Administrator may reasonably require.</text>
											</clause></subparagraph><subparagraph id="id30ba3cc9-fbb4-41d0-a8b5-e3b972763fb0"><enum>(C)</enum><header>Review and
				approval of applications for grants</header>
											<clause id="id82acbef0-7c11-4945-b16d-3f31688d1e26"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall—</text>
												<subclause id="ide3253555-f790-42ab-a3fc-31564b7df3bc"><enum>(I)</enum><text>review each
				application submitted under subparagraph (B), based on the information
				described in such subparagraph and the criteria set forth under clause (ii) of
				this subparagraph; and</text>
												</subclause><subclause id="id03c63dc1-2c80-4344-9745-3aa7bf5aae28"><enum>(II)</enum><text>whenever
				practicable, as part of the final selection process, conduct a site visit to
				each women's business center for which a grant under this subsection is
				sought.</text>
												</subclause></clause><clause id="id98b32ee3-0411-43e1-b026-df53e9967c4a"><enum>(ii)</enum><header>Selection
				criteria</header>
												<subclause id="idbcc806ef-6cb9-4899-b4c8-913426b8359d"><enum>(I)</enum><header>In
				general</header><text>The Administrator shall evaluate applicants for grants
				under this subsection in accordance with selection criteria that are—</text>
													<item id="idb063995b-8b3c-4bd1-b808-c5c50f384afe"><enum>(aa)</enum><text>established
				before the date on which applicants are required to submit the
				applications;</text>
													</item><item id="idcaa69d79-38cc-437f-8bb7-de392ff67424"><enum>(bb)</enum><text>stated in
				terms of relative importance; and</text>
													</item><item id="idee7f234d-19bf-42d0-8f94-fab5b1b2b8bf"><enum>(cc)</enum><text>publicly
				available and stated in each solicitation for applications for grants under
				this subsection made by the Administrator.</text>
													</item></subclause><subclause id="idc7d3821a-7ca4-4282-9b9e-98e5a135641a"><enum>(II)</enum><header>Required
				criteria</header><text>The selection criteria for a grant under this subsection
				shall include—</text>
													<item id="idfc77a910-d85e-4ce3-852e-582d62a3f994"><enum>(aa)</enum><text>the total
				number of entrepreneurs served by the applicant;</text>
													</item><item id="id3880450e-e24d-4fb1-9751-870cccb2d55b"><enum>(bb)</enum><text>the total
				number of new startup companies assisted by the applicant;</text>
													</item><item id="ida319d649-280a-4d81-a2c7-f768ce48050b"><enum>(cc)</enum><text>the
				percentage of clients of the applicant that are socially or economically
				disadvantaged; and</text>
													</item><item id="ida83d34dc-b5ee-4e52-bdc3-451c4696f87e"><enum>(dd)</enum><text>the
				percentage of individuals in the community served by the applicant who are
				socially or economically disadvantaged.</text>
													</item></subclause></clause><clause id="idb22fa078-6ab8-45d2-b6a9-51a4bd828b6b"><enum>(iii)</enum><header>Conditions
				for continued funding</header><text>In determining whether to make a grant
				under this subsection, the Administrator—</text>
												<subclause id="idad4e11a8-c429-4e8e-a5bc-ff3d169db680"><enum>(I)</enum><text>shall
				consider the results of the most recent evaluation of the women's business
				center for which a grant under this subsection is sought, and, to a lesser
				extent, previous evaluations; and</text>
												</subclause><subclause id="id904696d7-7d00-461b-a798-5ab757cdc0ee"><enum>(II)</enum><text>may withhold
				a grant under this subsection, if the Administrator determines that the
				applicant has failed to provide the information required to be provided under
				this paragraph, or the information provided by the applicant is
				inadequate.</text>
												</subclause></clause></subparagraph><subparagraph id="id86b0399f-b6dd-4e7b-b7b0-cecc4c340db8"><enum>(D)</enum><header>Notification</header><text>Not
				later than 60 days after the date of each deadline to submit applications, the
				Administrator shall approve or deny any application under this paragraph and
				notify the applicant for each such application of the approval or
				denial.</text>
										</subparagraph><subparagraph id="id4178aca4-83d0-45a6-ba8f-5686117e9893"><enum>(E)</enum><header>Record
				retention</header><text>The Administrator shall maintain a copy of each
				application submitted under this paragraph for not less than 7
				years.</text>
										</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subparagraph><subparagraph id="id14883A02C0834A08A88A9CD9A31FCFA2"><enum>(B)</enum><text>by striking
			 paragraph (5) and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="id73214792D546468B86105DC7BE68BB67" style="OLC">
									<paragraph id="id54058253FB454B53B05EBE078A6AE463"><enum>(5)</enum><header>Award to
				previous recipients</header><text>There shall be no limitation on the number of
				times the Administrator may award a grant to an applicant under this
				subsection.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection id="id2128f39e-c8db-434a-b011-406a2477b5e1"><enum>(b)</enum><header>Technical
			 and conforming amendments</header>
						<paragraph id="id18A4202C1C92478E8F1428905BD82FD9"><enum>(1)</enum><header>In
			 general</header><text>Section 29 of the <act-name parsable-cite="SBA">Small
			 Business Act</act-name> (15 U.S.C. 656) is amended—</text>
							<subparagraph id="idb9bd44d4-aa82-4940-8cfd-8ac80a3e64b1"><enum>(A)</enum><text>in subsection
			 (h)(2), by striking <quote>to award a contract (as a sustainability grant)
			 under subsection (l) or</quote>;</text>
							</subparagraph><subparagraph id="idc7dbb429-c6c0-4d6a-a166-25c7a03ae6ff"><enum>(B)</enum><text>in subsection
			 (j)(1), by striking <quote>The Administration</quote> and inserting <quote>Not
			 later than November 1 of each year, the Administrator</quote>;</text>
							</subparagraph><subparagraph id="id0c86ab5c-e86e-4c76-abce-b349e88e296b"><enum>(C)</enum><text>in subsection
			 (k)—</text>
								<clause id="id18e7e896-7900-4102-9681-9223eacfdf8a"><enum>(i)</enum><text>by striking
			 paragraphs (1), (2), and (4);</text>
								</clause><clause id="idfa0f86fc-b72e-403a-820f-b45aa8d5145a"><enum>(ii)</enum><text>by
			 redesignating paragraph (3) as paragraph (4); and</text>
								</clause><clause id="idc0dc4ec2-e19a-4de7-8652-f42b2e2cf866"><enum>(iii)</enum><text>by
			 inserting before paragraph (4), as so redesignated, the following:</text>

										<paragraph id="id7d494f03-095e-48cf-a0af-d6e28da3dc1e"><enum>(1)</enum><header>In
				general</header><text>There are authorized to be appropriated to the
				Administration to carry out this section, to remain available until expended,
				$14,500,000 for each of fiscal years 2013, 2014, and 2015.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87ae9c43-f537-4f05-b142-4c0a5ceb55d9"><enum>(2)</enum><header>Use of
				funds</header><text display-inline="yes-display-inline">Amounts made available
				under this subsection may only be used for grant awards and may not be used for
				costs incurred by the Administration in connection with the management and
				administration of the program under this section.</text>
										</paragraph><paragraph id="idfb19e6d0-ca24-4eb2-8d11-7b0e33e1cbb5"><enum>(3)</enum><header>Continuing
				grant and cooperative agreement authority</header>
											<subparagraph id="idc3b9cf34-6363-42d9-890a-a8f30519921f"><enum>(A)</enum><header>Prompt
				disbursement</header><text>Upon receiving funds to carry out this section for a
				fiscal year, the Administrator shall, to the extent practicable, promptly
				reimburse funds to any women’s business center awarded financial assistance
				under this section if the center meets the eligibility requirements under this
				section.</text>
											</subparagraph><subparagraph id="ideb5270f2-a091-4c0a-a46c-26e104729027"><enum>(B)</enum><header>Suspension
				or termination</header><text>If the Administrator has entered into a grant or
				cooperative agreement with a women's business center under this section, the
				Administrator may not suspend or terminate the grant or cooperative agreement,
				unless the Administrator—</text>
												<clause id="id07c76664-4071-40ed-ab53-da9b0afee890"><enum>(i)</enum><text>provides the
				women's business center with written notification setting forth the reasons for
				that action; and</text>
												</clause><clause id="id73b9bb57-4ea2-44b7-b402-e3013dc44004"><enum>(ii)</enum><text>affords the
				women's business center an opportunity for a hearing, appeal, or other
				administrative proceeding under chapter 5 of title 5, United States
				Code.</text>
												</clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
								</clause></subparagraph><subparagraph id="id11478395-be47-407f-85f9-2ce9239d9727"><enum>(D)</enum><text>in subsection
			 (m)—</text>
								<clause id="idE87BBA49C86048C58540A975CDB467E7"><enum>(i)</enum><text>in
			 paragraph (2), by striking <quote>subsection (b) or (l)</quote> and inserting
			 <quote>this subsection or subsection (b)</quote>; and</text>
								</clause><clause id="idB64BEA27916E4385A472C901DCE634A3"><enum>(ii)</enum><text>in
			 paragraph (4)(D), by striking <quote>or subsection (l)</quote>; and</text>

			 (15 U.S.C. 636 note) is amended—</text>
							<subparagraph id="id0ECF16C05F16441A976A42FA91C4520A"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> at the end;</text>
							</subparagraph><subparagraph id="id2145EAE1D3B947199BE8736267ED1EDA"><enum>(B)</enum><text>in subparagraph
			 (B), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
							</subparagraph><subparagraph id="id8ED07921998940699880DFC354F62850"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

									</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection id="idF317177F95784400A4792242594744E5"><enum>(c)</enum><header>Effect on
			 existing grants</header>
						<paragraph id="idC2D6DFCE8AB24EC98F42EDD4F65B5C3C"><enum>(1)</enum><header>Terms and
			 conditions</header><text>A nonprofit organization receiving a grant under
			 section 29(m) of the Small Business Act (15 U.S.C. 656(m)), as in effect on the
			 day before the date of enactment of this Act, shall continue to receive the
			 grant under the terms and conditions in effect for the grant on the day before
			 the date of enactment of this Act, except that the nonprofit organization may
			 not apply for a renewal of the grant under section 29(m)(5) of the Small
			 Business Act (15 U.S.C. 656(m)(5)), as in effect on the day before the date of
			 enactment of this Act.</text>
						</paragraph><paragraph id="id6C392927E2C845BFB327FF06E026E980"><enum>(2)</enum><header>Length of
			 renewal grant</header><text>The Administrator may award a grant under section
			 29(l) of the Small Business Act, as so redesignated by subsection (b)(1)(E) of
			 this section, to a nonprofit organization receiving a grant under section 29(m)
			 of the Small Business Act (15 U.S.C. 656(m)), as in effect on the day before
			 the date of enactment of this Act, for the period—</text>
							<subparagraph id="idDB2A2C6B9FD64F3D89F57D33AC03C74B"><enum>(A)</enum><text>beginning on the
			 day after the last day of the grant agreement under such section 29(m);
			 and</text>
							</subparagraph><subparagraph id="id470851F4FC2243B987637E10694C8E3D"><enum>(B)</enum><text>ending at the end
			 of the third fiscal year beginning after the date of enactment of this
			 Act.</text>
							</subparagraph></paragraph></subsection></section><section id="id3e217445-6f42-448b-a36c-ea4e2bc13707"><enum>425.</enum><header>Study and
			 report on economic issues facing women's business centers</header>
					<subsection id="idc0107c34-4a69-40d0-a2ca-1b127a77e675"><enum>(a)</enum><header>Study</header><text>The
			 Comptroller General of the United States shall conduct a broad study of the
			 unique economic issues facing women's business centers located in covered areas
			 to identify—</text>
						<paragraph id="ide4c87a23-1666-4e7f-841d-72cc32c44dfb"><enum>(1)</enum><text>the
			 difficulties such centers face in raising non-Federal funds;</text>
						</paragraph><paragraph id="id46e77e66-6ef0-489f-be35-9c514e7182a8"><enum>(2)</enum><text>the
			 difficulties such centers face in competing for financial assistance,
			 non-Federal funds, or other types of assistance;</text>
						</paragraph><paragraph id="id4d0369d6-be5e-4b04-82cf-e4eed625d606"><enum>(3)</enum><text>the
			 difficulties such centers face in writing grant proposals; and</text>
						</paragraph><paragraph id="id724bf45c-c858-4274-b99b-cc6f7f3bb9b9"><enum>(4)</enum><text>other
			 difficulties such centers face because of the economy in the type of covered
			 area in which such centers are located.</text>
						</paragraph></subsection><subsection id="idf513fefe-d547-4397-9d2f-294b9dff719f"><enum>(b)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Comptroller
			 General shall submit to Congress a report containing the results of the study
			 under subsection (a), which shall include recommendations, if any, regarding
			 how to—</text>
						<paragraph id="id947ba4f8-6c1f-44e0-89e8-3b8354e67fe4"><enum>(1)</enum><text>address the
			 unique difficulties women's business centers located in covered areas face
			 because of the type of covered area in which such centers are located;</text>
						</paragraph><paragraph id="idb6f6f3a8-d36a-4df3-a0b1-633997113d1b"><enum>(2)</enum><text>expand the
			 presence of, and increase the services provided by, women's business centers
			 located in covered areas; and</text>
						</paragraph><paragraph id="ida35e2071-961a-46dc-866e-65200609040a"><enum>(3)</enum><text>best use
			 technology and other resources to better serve women business owners located in
			 covered areas.</text>
						</paragraph></subsection><subsection id="id4d843b07-0223-42e6-9852-525a7aa21ffa"><enum>(c)</enum><header>Definition
			 of covered area</header><text>In this section, the term <term>covered
			 area</term> means—</text>
						<paragraph id="id0b8c9f65-4030-4cc2-8f95-35e2bfb11ee1"><enum>(1)</enum><text>any State
			 that is predominantly rural, as determined by the Administrator;</text>
						</paragraph><paragraph id="id4212ee2e-3484-4652-8f42-76ad3c05218b"><enum>(2)</enum><text>any State
			 that is predominantly urban, as determined by the Administrator; and</text>
						</paragraph><paragraph id="id26274e23-a05a-4913-a1f7-851f65a634c0"><enum>(3)</enum><text>any State or
			 territory that is an island.</text>
						</paragraph></subsection></section><section id="id50373050B3A543E28AD970EE0DF454BE"><enum>426.</enum><header>Study and
			 report on oversight of women's business centers</header>
					<subsection id="id0D07111175AA45238B9203FF7513925D"><enum>(a)</enum><header>Study</header><text>The
			 Comptroller General of the United States shall conduct a study of the oversight
			 of women's business centers by the Administrator, which shall include—</text>
						<paragraph id="id8FE966911CFB4AC6A1D732B6E8C38241"><enum>(1)</enum><text>an analysis of
			 the coordination by the Administrator of the activities of women's business
			 centers with the activities of small business development centers, the Service
			 Corps of Retired Executives, and Veterans Business Outreach Centers;</text>
						</paragraph><paragraph id="idFEA2CCC53A58486F96D422E2B875A84B"><enum>(2)</enum><text>a comparison of
			 the types of individuals and small business concerns served by women's business
			 centers and the types of individuals and small business concerns served by
			 small business development centers, the Service Corps of Retired Executives,
			 and Veterans Business Outreach Centers; and</text>
						</paragraph><paragraph id="id2560C375707F4E5BAAEFF96972194D49"><enum>(3)</enum><text>an analysis of
			 performance data for women's business centers that evaluates how well women's
			 business centers are carrying out the mission of women's business centers and
			 serving individuals and small business concerns.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id44C219D966D942D7A10D962C39AB795F"><enum>(b)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Comptroller
			 General shall submit to Congress a report containing the results of the study
			 under subsection (a), which shall include recommendations, if any, for
			 eliminating the duplication of services provided by women's business centers,
			 small business development centers, the Service Corps of Retired Executives,
			 and Veterans Business Outreach Centers.</text>
					</subsection></section></subtitle><subtitle id="id2190417418EE48E290EA0F3A83E1D081"><enum>C</enum><header>Strengthening
			 America's Small Business Development Centers</header>
				<section id="id3D8DB74FF1504B1EA5FB2E4C94127C49"><enum>431.</enum><header>Institutions
			 of higher education</header><text display-inline="no-display-inline">Section 21
			 of the Small Business Act (15 U.S.C. 648) is amended—</text>
					<paragraph id="idCE141E2160AE4081803C9632606FE27B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by striking <quote>:
			 <italic>Provided, </italic>That</quote> and all that follows through <quote>on

				disaster recovery facilities</header><text>For purposes of this subparagraph,
				the Administrator shall, to the maximum extent practicable, permit the
				personnel of a small business development center to use any site or facility
				designated by the Administrator for use to provide disaster recovery
				assistance.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1DDA3EB3910643FCB38E39FA504C95D9"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>recertification</term> means
			 a determination by the Administrator that a business concern that was
			 previously determined to be a qualified HUBZone small business concern is a
			 qualified HUBZone small business concern under section 3(p)(5) of the Small
			 Business Act (15 U.S.C. 632(p)(5)).</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="id67D60D14D234426A91A26FC614440862" section-type="subsequent-section"><enum>523.</enum><header display-inline="yes-display-inline">Fraud deterrence at the Small Business
			 Administration</header><text display-inline="no-display-inline">Section 16 of
			 the Small Business Act (15 U.S.C. 645) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id4755867569D64D56866C70AF15DABC55"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id7C5599D54BF840B296108F542D371B53"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
							<clause commented="no" display-inline="no-display-inline" id="idB7E376671C1546C7A5D42CC1892CB7E8"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 by striking <quote>Whoever</quote> and all that follows through <quote>oneself
			 or another</quote> and inserting the following: <quote>A person shall be
			 subject to the penalties and remedies described in paragraph (2) if the person
			 misrepresents the status of any concern or person as a small business concern,
			 a qualified HUBZone small business concern, a small business concern owned and
			 controlled by socially and economically disadvantaged individuals, a small
			 business concern owned and controlled by women, or a small business concern
			 owned and controlled by service-disabled veterans, in order to obtain for any

			 follows:</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="idFB97AF590B8C420B85891C5F6DA07817" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">prime contract, subcontract, grant, or
				cooperative agreement to be awarded under subsection (a) or (m) of section 8,
				or section 9, 15, 31, or
				35;</text>
									</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>

				and</after-quoted-block></quoted-block>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52168F1DA83A4823BC917A0924C1F86A"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idF7A3C684EECA444BA1F6CDE53A2597DD" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="idFA50B90DA7C946E8B5330B364B870ABF" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id97AB3A960FC442CB99B978EFE344CB40"><enum>(A)</enum><text display-inline="yes-display-inline">In the case of a violation of paragraph
				(1)(A) or subsection (g) or (h), for purposes of a proceeding described in
				subparagraph (A) or (C) of paragraph (2), the amount of the loss to the Federal
				Government or the damages sustained by the Federal Government, as applicable,
				shall be an amount equal to the amount that the Federal Government paid to the
				person that received a contract, grant, or cooperative agreement described in
				paragraph (1)(A), (g), or (h), respectively.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2107A7C99B2F4E7ABCA7362E1477C6E8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of a violation of subparagraph
				(B) or (C) of paragraph (1), for the purpose of a proceeding described in
				subparagraph (A) or (C) of paragraph (2), the amount of the loss to the Federal
				Government or the damages sustained by the Federal Government, as applicable,
				shall be an amount equal to the portion of any payment by the Federal
				Government under a prime contract that was used for a subcontract described in
				subparagraph (B) or (C) of paragraph (1), respectively.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA3C1286647164D7DAC7A7720C114B82F" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">In a proceeding described in subparagraph
				(A) or (B), no credit shall be applied against any loss or damages to the
				Federal Government for the fair market value of the property or services
				provided to the Federal
				Government.</text>
									</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE22350BB2EBB43B6AC11EC3A3915746E"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (e) and inserting
			 the following:</text>
						<quoted-block display-inline="no-display-inline" id="id248BA52478A74A58BB1A341906A0D661" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="idB646DB9DC4A1443786CA4ACA749BECD6"><enum>(e)</enum><text display-inline="yes-display-inline">Any representation of the status of any
				concern or person as a small business concern, a HUBZone small business
				concern, a small business concern owned and controlled by socially and
				economically disadvantaged individuals, a small business concern owned and
				controlled by women, or a small business concern owned and controlled by
				service-disabled veterans, in order to obtain any prime contract, subcontract,
				grant, or cooperative agreement described in subsection (d)(1) shall be made in
				writing or through the Online Representations and Certifications Application
				process required under section 4.1201 of the Federal Acquisition Regulation, or
				any successor thereto.</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5512A414D94949A1B206F45C1BF210FF"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id1D7552A5364F41C4B74A2983E7E6BC0C" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="idAE6EA44EEDB646D78618033721272DB5"><enum>(g)</enum><text display-inline="yes-display-inline">A person shall be subject to the penalties
				and remedies described in subsection (d)(2) if the person misrepresents the
				status of any concern or person as a small business concern, a qualified
				HUBZone small business concern, a small business concern owned and controlled
				by socially and economically disadvantaged individuals, a small business
				concern owned and controlled by women, or a small business concern owned and
				controlled by service-disabled veterans—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id9C6E1366F9034E33B32B0DD437544C0F"><enum>(1)</enum><text display-inline="yes-display-inline">in order to allow any person to participate
				in any program of the Administration; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA704639FE567426C858B3FBC139AC931"><enum>(2)</enum><text display-inline="yes-display-inline">in relation to a protest of a contract
				award or proposed contract award made under regulations issued by the
				Administration.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1D8AB923BB214300B1732B45F780699A"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id46900635EE304C9A9F69A841D226EFAF"><enum>(1)</enum><text display-inline="yes-display-inline">A person that submits a request for payment
				on a contract or subcontract that is awarded under subsection (a) or (m) of
				section 8, or section 9, 15, 31, or 35, shall be deemed to have submitted a
				certification that the person complied with regulations issued by the
				Administration governing the percentage of work that the person is required to
				perform on the contract or subcontract, unless the person states, in writing,
				that the person did not comply with the regulations.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6DB17D1C03540A7B58A6D3BFEAA9628" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A
				person shall be subject to the penalties and remedies described in subsection
				(d)(2) if the person—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id06C0E9D162BA46D3B12942B7B05108D6"><enum>(A)</enum><text display-inline="yes-display-inline">uses the services of a business other than
				the business awarded the contract or subcontract to perform a greater
				percentage of work under a contract than is permitted by regulations issued by
				the Administration; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14FDEDD4EDD94D5096704D680B45FA19"><enum>(B)</enum><text display-inline="yes-display-inline">willfully participates in a scheme to
				circumvent regulations issued by the Administration governing the percentage of
				work that a contractor is required to perform on a
				contract.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="idCDD6AB92D66646E39259EFA4D818E191" section-type="subsequent-section"><enum>524.</enum><header display-inline="yes-display-inline">Veterans integrity in contracting</header>
					<subsection commented="no" display-inline="no-display-inline" id="id3411756557F741DFB4A529675B8C875F"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">Section 3(q)(1) of the Small Business Act
			 (15 U.S.C. 632(q)(1)) is amended by striking <quote>means a veteran</quote> and
			 all that follows and inserting the following: “means—</text>
						<quoted-block display-inline="no-display-inline" id="id0A708ED8F62F4FF2B834F693E34CC741" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="idC206F37B68544C569D58C85CCE65AB0E"><enum>(A)</enum><text display-inline="yes-display-inline">a veteran with a service-connected
				disability rated by the Secretary of Veterans Affairs as zero percent or more
				disabling; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD2E886133C23482DB2D623208D2CA56A"><enum>(B)</enum><text display-inline="yes-display-inline">a former member of the Armed Forces who is
				retired, separated, or placed on the temporary disability retired list for
				physical disability under chapter 61 of title 10, United States
				Code.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id89FE8CC5C04F46AB9E573E3000C08702"><enum>(b)</enum><header display-inline="yes-display-inline">Veterans contracting</header><text display-inline="yes-display-inline">Section 4 of the Small Business Act (15
			 U.S.C. 633), as amended by this Act, is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="id3E357747E2744958AD7FC38E9E559E37" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="idEA992039971246AE877E4D594E8368A5"><enum>(i)</enum><header display-inline="yes-display-inline">Veteran status</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idC8B37C02A6CE46A293A5F9587A6E4D17"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A business concern seeking status as a
				small business concern owned and controlled by service-disabled veterans
				shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id936621329B9B4E299435F4B7D802DD33"><enum>(A)</enum><text display-inline="yes-display-inline">submit an annual certification indicating
				that the business concern is a small business concern owned and controlled by
				service-disabled veterans by means of the Online Representations and
				Certifications Application process required under section 4.1201 of the Federal
				Acquisition Regulation, or any successor thereto; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77C1E579F68748FFB72A078A351082EA"><enum>(B)</enum><text display-inline="yes-display-inline">register with—</text>
										<clause commented="no" display-inline="no-display-inline" id="idFDA628A5A23D415AB8FCD7B67DA7FAFA"><enum>(i)</enum><text display-inline="yes-display-inline">the Central Contractor Registration
				database maintained under subpart 4.11 of the Federal Acquisition Regulation,
				or any successor thereto; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id237AE9ED08DF4F24989AD83C267EACC9"><enum>(ii)</enum><text display-inline="yes-display-inline">the VetBiz database of the Department of
				Veterans Affairs, or any successor thereto.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68CE56450A274EA883B577C7502DDE86"><enum>(2)</enum><header display-inline="yes-display-inline">Verification of status</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id3426348DD08743D0BD8042DB7A3FAA35"><enum>(A)</enum><header display-inline="yes-display-inline">Veterans Affairs</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
				determine whether a business concern registered with the VetBiz database of the
				Department of Veterans Affairs, or any successor thereto, as a small business
				concern owned and controlled by veterans or a small business concern owned and
				controlled by service-disabled veterans is owned and controlled by a veteran or
				a service-disabled veteran, as the case may be.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id36CD32CE05244C8F8C83B8FF8D75EC36"><enum>(B)</enum><header display-inline="yes-display-inline">Federal agencies generally</header><text display-inline="yes-display-inline">The head of each Federal agency
				shall—</text>
										<clause commented="no" display-inline="no-display-inline" id="id7DBB39AB54D740D2B0BF37FC3ABA4A95"><enum>(i)</enum><text display-inline="yes-display-inline">for a sole source contract awarded to a
				small business concern owned and controlled by service-disabled veterans or a
				contract awarded with competition restricted to small business concerns owned
				and controlled by service-disabled veterans under section 35, determine whether
				a business concern submitting a proposal for the contract is a small business
				concern owned and controlled by service-disabled veterans; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id0AADA49C083F4F2BA27027CE1E2EA8AA"><enum>(ii)</enum><text display-inline="yes-display-inline">use the VetBiz database of the Department
				of Veterans Affairs, or any successor thereto, in determining whether a
				business concern is a small business concern owned and controlled by
				service-disabled veterans.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idADEA30456C0343CCB1CDCFF546AE937D"><enum>(3)</enum><header display-inline="yes-display-inline">Debarment and suspension</header><text display-inline="yes-display-inline">If the Administrator determines that a
				business concern knowingly and willfully misrepresented that the business
				concern is a small business concern owned and controlled by service-disabled
				veterans, the Administrator may debar or suspend the business concern from
				contracting with the United
				States.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id626F6BDE56C34F95BB7EEA1F048BB416"><enum>(c)</enum><header display-inline="yes-display-inline">Integration of databases</header><text display-inline="yes-display-inline">The Administrator for Federal Procurement
			 Policy and the Secretary of Veterans Affairs shall ensure that data is shared
			 on an ongoing basis between the VetBiz database of the Department of Veterans
			 Affairs and the Central Contractor Registration database maintained under
			 subpart 4.11 of the Federal Acquisition Regulation.</text>
					</subsection><subsection id="idC5FBFB67912E41C19C07A8EB294C01CB"><enum>(d)</enum><header>Effective
			 date</header>
						<paragraph id="idC1B41A00E88F4224B92D21334A47DA30"><enum>(1)</enum><header>In
			 general</header><text>The amendment made by subsection (b) and the requirements
			 under subsection (c) shall take effect on the date on which the Secretary of
			 Veterans Affairs (referred to in this subsection as the
			 <quote>Secretary</quote>) publishes in the Federal Register a determination
			 that the Department of Veterans Affairs has the necessary resources and
			 capacity to carry out the additional responsibility of determining whether
			 small business concerns registered with the VetBiz database of the Department
			 of Veterans Affairs are owned and controlled by a veteran or a service-disabled
			 veteran, as the case may be, in accordance with subsection (i) of section 4 of
			 the Small Business Act (15 U.S.C. 633), as added by subsection (b).</text>
						</paragraph><paragraph id="id0B687BDBCC2F411A9320E448AE0D5B42"><enum>(2)</enum><header>Timeline</header><text>If
			 the Secretary determines that the Secretary is not able to publish the
			 determination under paragraph (1) before the date that is 1 year after the date
			 of enactment of this Act, the Secretary shall, not later than 1 year after the
			 date of enactment of this Act, submit a report containing an estimate of the
			 date on which the Secretary will publish the determination under paragraph (1)
			 to the Committee on Small Business and Entrepreneurship and the Committee on
			 Veterans’ Affairs of the Senate and the Committee on Small Business and the
			 Committee on Veterans’ Affairs of the House of Representatives.</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id6C081F40101D41EB8DF30EBA2A819A1C" section-type="subsequent-section"><enum>525.</enum><header display-inline="yes-display-inline">Section
			 8<enum-in-header>(a)</enum-in-header> program improvements</header>
					<subsection commented="no" display-inline="no-display-inline" id="id668064F4A20D45049886F8BD649CEB1C"><enum>(a)</enum><header display-inline="yes-display-inline">Review of effectiveness</header><text display-inline="yes-display-inline">Section 8(a) of the Small Business Act (15
			 U.S.C. 637(a)) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id2C2133CDFA204036B672E10340F0FA98" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="idD03BAA81695D4117A0ED66F338ABEE83" indent="up1"><enum>(22)</enum><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this paragraph, and every 3 years thereafter, the Comptroller
				General of the United States shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id8C4E40E29A7640F1952F7ED8F21CC5D7"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an evaluation of the effectiveness
				of the program under this subsection, including an examination of—</text>
									<clause commented="no" display-inline="no-display-inline" id="idFCF5052037734A939A054608EF13B531"><enum>(i)</enum><text display-inline="yes-display-inline">the number and size of contracts applied
				for, as compared to the number received by, small business concerns after
				successfully completing the program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idF848E1236D244711B226D7D034360A66"><enum>(ii)</enum><text display-inline="yes-display-inline">the percentage of small business concerns
				that continue to operate during the 3-year period beginning on the date on
				which the small business concerns successfully complete the program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id5B0A0A00DD0C4F92B3C52E26052A36AE"><enum>(iii)</enum><text display-inline="yes-display-inline">whether the business of small business
				concerns increases during the 3-year period beginning on the date on which the
				small business concerns successfully complete the program; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idE426264E57FC4DE98392A0A12AA50F3D"><enum>(iv)</enum><text display-inline="yes-display-inline">the number of training sessions offered
				under the program; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAAE180155E0C4DDA8A086DF02946E2E3"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the Committee on Small Business
				and Entrepreneurship of the Senate and the Committee on Small Business of the
				House of Representatives a report regarding each evaluation under subparagraph
				(A).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id5C3C6BE0D8764F769D88E95D1A8CE2EF"><enum>(b)</enum><header display-inline="yes-display-inline">Other improvements</header><text display-inline="yes-display-inline">In order to improve the 8(a) program, the
			 Administrator shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idB433F763C5DE496E89165F1187620A65"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 90 days after the date of
			 enactment of this Act, begin to—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id56AB6B2E323A419DAD5A9EA6E5F050E4"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate the feasibility of—</text>
								<clause commented="no" display-inline="no-display-inline" id="idC5D4657ED8DF471997B3454837FDF6F0"><enum>(i)</enum><text display-inline="yes-display-inline">using additional third-party data
			 sources;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idD43F47553030428FB96B9868ADAB8E1A"><enum>(ii)</enum><text display-inline="yes-display-inline">making unannounced visits of sites that are
			 selected randomly or using risk-based criteria;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id9FB25277F31E41178DE2B068C2AF101F"><enum>(iii)</enum><text display-inline="yes-display-inline">using fraud detection tools, including
			 data-mining techniques; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id5E807E54DA5640D8902B85A6BAE3B6C0"><enum>(iv)</enum><text display-inline="yes-display-inline">conducting financial and analytical
			 training for the business opportunity specialists of the Administration;</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88201492C96A4E678523922F3D211A05"><enum>(B)</enum><text display-inline="yes-display-inline">evaluate the feasibility and advisability
			 of amending regulations applicable to the 8(a) program to require that
			 calculations of the adjusted net worth or total assets of an individual include
			 assets held by the spouse of the individual; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52072058ADB8459B9E12751656349289"><enum>(C)</enum><text display-inline="yes-display-inline">develop a more consistent enforcement
			 strategy that includes the suspension or debarment of contractors that
			 knowingly make misrepresentations in order to qualify for the 8(a) program;
			 and</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0EA228EBA0974D7191A3DEFB1495540D"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 1 year after the date on
			 which the Comptroller General submits the report under section 8(a)(22)(B) of
			 the Small Business Act, as added by subsection (c), issue, in final form,
			 proposed regulations of the Administration that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idC1427C12FA324570A55BDCDFBDF26F58"><enum>(A)</enum><text display-inline="yes-display-inline">determine the economic disadvantage of a
			 participant in the 8(a) program based on the income and asset levels of the
			 participant at the time of application and annual recertification for the 8(a)
			 program; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D534569EB15435FAC9E88B57A132E11"><enum>(B)</enum><text display-inline="yes-display-inline">limit the ability of a small business
			 concern to participate in the 8(a) program if an immediate family member of an
			 owner of the small business concern is, or has been, a participant in the 8(a)
			 program, in the same industry.</text>
							</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id14F75EF363654CC2B2C11DE23F24C6DF" section-type="subsequent-section"><enum>526.</enum><header display-inline="yes-display-inline">HUBZone improvements</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID22dd438a2b2642349f1e25a30641b479"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to reform
			 and improve the HUBZone program of the Administration.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id74497F77891E4667B5E0B9BB4115C924"><enum>(b)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDecc252dc32a94bda99ca5cda06a78684"><enum>(1)</enum><text display-inline="yes-display-inline">ensure the HUBZone map is—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id87B220122FA64029B987191F7FE808BC"><enum>(A)</enum><text display-inline="yes-display-inline">accurate and up-to-date; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC4DD8657C3794E0C87FD3838E8F246FF"><enum>(B)</enum><text display-inline="yes-display-inline">revised as new data is made available to
			 maintain the accuracy and currency of the HUBZone map;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfbb91bc9979d4bee82933720e6ec54ab"><enum>(2)</enum><text display-inline="yes-display-inline">implement policies for ensuring that only
			 HUBZone small business concerns determined to be qualified under section
			 3(p)(5) of the Small Business Act (15 U.S.C. 632(p)(5)) are participating in
			 the HUBZone program, including through the appropriate use of technology to
			 control costs and maximize, among other benefits, uniformity, completeness,
			 simplicity, and efficiency;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID410f499289a84d8d8870ee8cbd379cbb"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the Committee on Small Business
			 and Entrepreneurship of the Senate and the Committee on Small Business of the
			 House of Representatives a report regarding any application to be designated as
			 a HUBZone small business concern or for recertification for which the
			 Administrator has not made a determination as of the date that is 60 days after
			 the date on which the application was submitted or initiated, which shall
			 include a plan and timetable for ensuring the timely processing of the
			 applications; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID17e9196638f94b618b9b0f56432ddf4c"><enum>(4)</enum><text display-inline="yes-display-inline">develop measures and implement plans to
			 assess the effectiveness of the HUBZone program that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idEF0C5C3385DE46DD833EF117D6A366D1"><enum>(A)</enum><text display-inline="yes-display-inline">require the identification of a baseline
			 point in time to allow the assessment of economic development under the HUBZone
			 program, including creating additional jobs; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72DACE381CAE42E99F5DCD0FCDA74B71"><enum>(B)</enum><text display-inline="yes-display-inline">take into account—</text>
								<clause commented="no" display-inline="no-display-inline" id="idDD5B57BD945640A2BFC60A501C842812"><enum>(i)</enum><text display-inline="yes-display-inline">the economic characteristics of the
			 HUBZone; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idF279644068BD4F9DBBE8496FB4CF2457"><enum>(ii)</enum><text display-inline="yes-display-inline">contracts being counted under multiple
			 socioeconomic subcategories.</text>
								</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE53C8DF39BD449A7A006E44C019A09BD"><enum>(c)</enum><header display-inline="yes-display-inline">Employment percentage</header><text display-inline="yes-display-inline">Section 3(p) of the Small Business Act (15
			 U.S.C. 632(p)) is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id5DB54A5988464B3CB69AA5A2DF60140B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (5), by adding at the end the
			 following:</text>

				Administrator determines that a HUBZone small business concern is qualified
				under subparagraph (A) and ending on the day before the date on which a
				contract under the HUBZone program for which the HUBZone small business concern
				submits a bid is awarded.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idF122639991584E2D9CF1E52411C14AA6"><enum>(ii)</enum><header display-inline="yes-display-inline">Interim
				period</header><text display-inline="yes-display-inline">During the interim
				period, the Administrator may not determine that the HUBZone small business is
				not qualified under subparagraph (A) based on a failure to meet the applicable
				employment percentage under subparagraph (A)(i)(I), unless the HUBZone small
				business concern—</text>
										<subclause commented="no" display-inline="no-display-inline" id="id84D51A26145E4532A8D198A1E297D838"><enum>(I)</enum><text display-inline="yes-display-inline">has not attempted to maintain the
				applicable employment percentage under subparagraph (A)(i)(I); or</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idAA16BB9B5A744096AA9098EF862D7889"><enum>(II)</enum><text display-inline="yes-display-inline">does not meet the applicable employment
				percentage—</text>

				5-year period ending on the date of the

			 15(k)(2) of the Small Business Act (15 U.S.C. 644(k)(2)) is amended by striking
			 <quote>such agency,</quote> and inserting <quote>such agency to a position that
			 is a Senior Executive Service position (as such term is defined under section
			 3132(a) of title 5, United States Code), except that, for any agency in which
			 the positions of Chief Acquisition Officer and senior procurement executive (as
			 such terms are defined under section 43(a) of this Act) are not Senior

					</subsection><subsection id="H95D348BAB42F4190AB2702378B287EF2"><enum>(b)</enum><header>Performance
			 appraisals</header><text>Section 15(k)(3) of the Small Business Act (15 U.S.C.
			 644(k)(3)) is amended—</text>
						<paragraph id="H06BD4CD28E094FC7B1FFF1E20CA0E2EC"><enum>(1)</enum><text>by striking
			 <quote>be responsible only to, and report directly to, the head</quote> and
			 inserting <quote>shall be responsible only to (including with respect to
			 performance appraisals), and report directly and exclusively to, the
			 head</quote>; and</text>
						</paragraph><paragraph id="HCEBC06E8478D44AA86D5EB5A1E52A63A"><enum>(2)</enum><text>by striking
			 <quote>be responsible only to, and report directly to, such Secretary</quote>

			 the Small Business Act (15 U.S.C. 644(k)) is amended by inserting after
			 paragraph (10) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF8DF86D2B2174C58B9BDC61B762BA85D" style="OLC">
							<paragraph id="H7056A8D66B0A446EA90EE54B00D2E4C7"><enum>(11)</enum><text display-inline="yes-display-inline">shall review and advise such agency on any
				decision to convert an activity performed by a small business concern to an
				activity performed by a Federal employee;</text>
							</paragraph><paragraph id="H0E97827825D14A7A8673ABB219947F48"><enum>(12)</enum><text>shall provide to
				the Chief Acquisition Officer and senior procurement executive of such agency
				advice and comments on acquisition strategies, market research, and
				justifications related to section 43 of this Act;</text>
							</paragraph><paragraph id="H5366D865F96A40D9A74E6145B97AF8C8"><enum>(13)</enum><text>may provide
				training to small business concerns and contract specialists, except that such
				training may only be provided to the extent that the training does not
				interfere with the Director carrying out other responsibilities under this
				subsection;</text>
							</paragraph><paragraph id="H8287C08D7BB04E7D8973637646183065"><enum>(14)</enum><text>shall carry out
				exclusively the duties enumerated in this Act, and shall, while the Director,
				not hold any other title, position, or responsibility, except as necessary to
				carry out responsibilities under this subsection;</text>
							</paragraph><paragraph id="HE4CBD9F62CF5400C9BC89D62CCE8061A"><enum>(15)</enum><text display-inline="yes-display-inline">shall submit, each fiscal year, to the
				Committee on Small Business of the House of Representatives and the Committee
				on Small Business and Entrepreneurship of the Senate a report
				describing—</text>
								<subparagraph id="H2A177796C38B4AD398C620CD917203BD"><enum>(A)</enum><text>the training
				provided by the Director under paragraph (13) in the most recently completed

			<subtitle id="id8B07AA9307D14823B3B2136410BB4F68"><enum>A</enum><header>Small business
			 common application</header>
				<section id="id981B26D44D12443BBE7C0031089CAA64"><enum>611.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle—</text>
					<paragraph id="id0FCC8B9902294D5FAA484E934C6F1299"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>Administration</term> and
			 <term>Administrator</term> mean the Small Business Administration and the
			 Administrator thereof, respectively;</text>
					</paragraph><paragraph id="idECACCBFCC21A4EF2BB16DFF86C20FC2D"><enum>(2)</enum><text>the term
			 <term>Executive agency</term> has the meaning given that term under section 105
			 of title 5, United States Code;</text>
					</paragraph><paragraph id="id7716D9C12F28469283CFC59D0034021D"><enum>(3)</enum><text>the term
			 <term>Executive Committee</term> means the Executive Committee on a Small
			 Business Common Application established under section 613(a); and</text>

			 <term>small business concern</term> has the meaning given that term under

					</paragraph></section><section id="id10917AD0C1E7483487008802FCAE7D98"><enum>612.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that Executive agencies should—</text>
					<paragraph id="id0634d8db164a48ec9abdf3a29dd79e67"><enum>(1)</enum><text>reduce paperwork
			 burdens on small business concerns pursuant to section 3501 of title 44, United
			 States Code;</text>
					</paragraph><paragraph id="idaa18df567761480abc16c640a961d941"><enum>(2)</enum><text>maximize the
			 ability of small business concerns to use common applications, where
			 practicable, and use consolidated web portals to interact with Executive
			 agencies;</text>
					</paragraph><paragraph id="id7f021fc4c61d4ee8a2d7ed7ef232b0a4"><enum>(3)</enum><text>maintain high
			 standards for data privacy and security;</text>
					</paragraph><paragraph id="id7681a67c358a4bc5a5aef239ec02b790"><enum>(4)</enum><text>increase the
			 degree and ease of information sharing and coordination among programs serving
			 small business concerns that are carried out by Executive agencies, including
			 State and local offices of Executive agencies; and</text>
					</paragraph><paragraph id="idad12e569e9bf49189bac9447f9ab4038"><enum>(5)</enum><text>minimize
			 redundancy in the administration of programs that can utilize common
			 applications, where practicable, and consolidated web portals.</text>
					</paragraph></section><section id="id7baf5a1c49464e79a28ae53ef8a4788f"><enum>613.</enum><header>Executive
			 Committee On a Small Business Common Application</header>
					<subsection id="id7fea216cd7094738b4714a5275dde4d6"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Administration an Executive Committee on a Small Business
			 Common Application, which shall make recommendations regarding the
			 establishment, if practicable, of a small business common application and web
			 portal.</text>
					</subsection><subsection id="id6f2119c864884c7c823c1f3549dd9dca"><enum>(b)</enum><header>Membership</header>
						<paragraph id="id974b705686f348a7a0ae8b28a5780bed"><enum>(1)</enum><header>In
			 general</header><text>The members of the Executive Committee shall consist
			 of—</text>
							<subparagraph id="idc52f1c16bbed45bc8c313a395563363a"><enum>(A)</enum><text>the
			 Administrator;</text>
							</subparagraph><subparagraph id="id743c22ecb55c46b3a689df6d4667dbaa"><enum>(B)</enum><text>the Assistant
			 Secretary of Commerce for Economic Development; and</text>
							</subparagraph><subparagraph id="idb626eb2de6df443cb184695d47c11d4b"><enum>(C)</enum><text>1 senior officer
			 or employee having policy and technical expertise appointed by each of—</text>
								<clause id="id13594fc8bb594b32a957ca2a97bdf2e4"><enum>(i)</enum><text>the
			 Administrator of the General Services Administration;</text>
								</clause><clause id="idadfaa5c36d5d4d95afc9f1acc391e5c6"><enum>(ii)</enum><text>the Director of
			 the National Institutes of Health;</text>
								</clause><clause id="ide06e3cd0fc154feb90effcbf2981e4d6"><enum>(iii)</enum><text>the Director of
			 the National Science Foundation;</text>
								</clause><clause id="id2db996ef8e7d422e861f2970933205be"><enum>(iv)</enum><text>the President of
			 the Export-Import Bank;</text>
								</clause><clause id="idb64afcfcc3244e7bb0469ed0ab457016"><enum>(v)</enum><text>the
			 Secretary of Agriculture;</text>
								</clause><clause id="idd8e52b62fe2142a19d51815827063b69"><enum>(vi)</enum><text>the Secretary of
			 Defense;</text>
								</clause><clause id="id8a72057a894446a4a5dc3cac0defd4dd"><enum>(vii)</enum><text>the Secretary
			 of Health and Human Services;</text>
								</clause><clause id="id89b8f0c01b76422ba350c52605d0c111"><enum>(viii)</enum><text>the Secretary
			 of Labor;</text>
								</clause><clause id="id46d2d5518f5548318bc22a56b21c79a0"><enum>(ix)</enum><text>the Secretary of
			 State;</text>
								</clause><clause id="id42f19f7529f2428dbd6d02a0ed8f69f1"><enum>(x)</enum><text>the
			 Secretary of the Treasury; and</text>
								</clause><clause id="idd433b163c5ab4543ba9894aa3b7e96cd"><enum>(xi)</enum><text>the Secretary of
			 Veterans Affairs.</text>
								</clause></subparagraph></paragraph><paragraph id="id7bd53efd5b214cf6b883956980580438"><enum>(2)</enum><header>Chairperson</header><text>The
			 Administrator shall serve as chairperson of the Executive Committee.</text>
						</paragraph><paragraph id="id9d504435255940c3b081b15d95199efd"><enum>(3)</enum><header>Period of
			 appointment</header><text>Members of the Executive Committee shall be appointed
			 for a term of 1 year.</text>
						</paragraph><paragraph id="id2b75ce9789814622bde8d67aba4a8979"><enum>(4)</enum><header>Vacancies</header><text>A
			 vacancy in the Executive Committee shall be filled in the same manner as the
			 original appointment, not later than 30 days after the date on which the
			 vacancy occurs.</text>
						</paragraph></subsection><subsection id="idb352d63e4d684a36a067ae8d5e08e13f"><enum>(c)</enum><header>Meetings</header>
						<paragraph id="id1fe526ed9aa94b47a80d8aea75e88b4a"><enum>(1)</enum><header>In
			 general</header><text>The Executive Committee shall meet at the call of the
			 chairperson of the Executive Committee.</text>
						</paragraph><paragraph id="id9fe1d114191440ef81159b617c0d408e"><enum>(2)</enum><header>Quorum</header><text>A
			 majority of the members of the Executive Committee shall constitute a
			 quorum.</text>
						</paragraph><paragraph id="id2e6237da7ac64f5e9b066d63a4af477e"><enum>(3)</enum><header>First
			 meeting</header><text>The first meeting of the Executive Committee shall take
			 place not later than 30 days after the date of enactment of this
			 subtitle.</text>
						</paragraph><paragraph id="ida3b01dbf34d04b44b87fd1701fd1771d"><enum>(4)</enum><header>Public
			 meeting</header><text>The Executive Committee shall hold at least 1 public
			 meeting before the date described in subsection (d)(1) to receive comments from
			 small business concerns and other interested parties.</text>
						</paragraph></subsection><subsection id="id4dc585afb6f944e3a9fe4d3b3950b105"><enum>(d)</enum><header>Duties</header>
						<paragraph id="id17bc2195c7444fe6b859c26d8889f1ac"><enum>(1)</enum><header>Recommendations</header><text>Not
			 later than 270 days after the date of enactment of this Act, upon a vote of the
			 majority of members of the Executive Committee then serving, the Executive
			 Committee shall submit to the Administrator recommendations relating to the
			 feasibility of establishing a small business common application and web portal
			 in order to meet the goals described in section 612.</text>
						</paragraph><paragraph id="idf9e7a17d28e342c2b16d8791191fb647"><enum>(2)</enum><header>Transmission to
			 executive agencies</header><text>The Executive Committee shall transmit to each
			 Executive agency a complete copy of the recommendations submitted under
			 paragraph (1).</text>
						</paragraph><paragraph id="id6824e08ad75747dd82c6875149ea3294"><enum>(3)</enum><header>Transmission to
			 Congress</header><text>The Executive Committee shall transmit to each relevant
			 committee of Congress a complete copy of the recommendations submitted under
			 paragraph (1).</text>
						</paragraph><paragraph id="idb537abb429a549c4867aae8246030314"><enum>(4)</enum><header>Recommendations
			 by executive agencies</header><text>Not later than 30 days after the date on
			 which the Executive Committee transmits recommendations to the Executive agency
			 under paragraph (2), each Executive agency that provides Federal assistance to
			 small business concerns shall submit to Congress recommendations, if any, for
			 legislative changes necessary for the Executive agency to carry out the
			 recommendations under paragraph (1).</text>
						</paragraph></subsection><subsection id="ide44ebec0f93442b1a8ae630de8fddc20"><enum>(e)</enum><header>Personnel
			 matters</header>
						<paragraph id="id841e734f209d48f3848ee69a7aa78c68"><enum>(1)</enum><header>Compensation of
			 members</header><text>The members of the Executive Committee shall serve
			 without compensation in addition to that received for their services as
			 officers or employees of the United States.</text>
						</paragraph><paragraph id="id76d3ad550bf3405982bdcdbdfc8e8fe1"><enum>(2)</enum><header>Detail of
			 employees</header><text>The Administrator may detail to the Executive Committee
			 any employee of the Economic Development Administration, and such detail shall
			 be without interruption or loss of civil service status or privilege.</text>
						</paragraph></subsection><subsection id="id2ccda038b2fc49f383fa3693752ac6e3"><enum>(f)</enum><header>Federal
			 advisory committee Act</header><text>Section 14 of the Federal Advisory
			 Committee Act (5 U.S.C. App.) shall not apply with respect to the Executive
			 Committee.</text>
					</subsection></section><section id="ide0fd07eaa60741438ce814191a7d3de7"><enum>614.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Administrator such sums as may be
			 necessary to carry out this subtitle.</text>
				</section></subtitle><subtitle id="id8C50315EC78B4264903D81A15D19FBD9"><enum>B</enum><header>Government
			 Accountability Office review</header>
				<section id="id4541FA7D76264A7494CE8D00F698E276"><enum>621.</enum><header>Government
			 Accountability Office review</header><text display-inline="no-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 submit a report to the Committee on Small Business and Entrepreneurship of the
			 Senate and the Committee on Small Business of the House of Representatives that
			 evaluates the status of the programs authorized under this Act and the
			 amendments made by this Act, including the extent to which such programs have
			 been funded and implemented and have contributed to promoting job creation
			 among small business concerns.</text>
