		<official-title>To require the disclosure of all payments made under the
		  Equal Access to Justice Act. </official-title>

		<section id="id271A97AA27CF44B1BA6F3FC16FE771C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Government Transparency and
			 Recordkeeping Act of 2012</short-title></quote>.</text>
		</section><section id="idC7E42FE5B1284083ACFA3450030D34F5" section-type="subsequent-section"><enum>2.</enum><header>Disclosure of
			 payments</header><text display-inline="no-display-inline">Section 1304 of title
			 31, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id2BD1F7940D9042008961FA0B9BCC9D44" style="OLC">
				<subsection id="id6E9B8AA600334DFEBE02F2D2D00EAFDA"><enum>(d)</enum><header>Disclosure of
				payments</header>
					<paragraph id="id03D46DB3DEDF416BBEFB805BF2F5ACE2"><enum>(1)</enum><header>In
				general</header>
						<subparagraph id="idF9219157F1BF4818A3264D487B00A8C3"><enum>(A)</enum><header>Past
				payments</header><text>Except as provided in paragraph (3), not later than 90
				days after the date of enactment of the <short-title>Government Transparency and Recordkeeping Act of
				2012</short-title>, the Secretary of the Treasury shall make all records of
				individual payments made under this section since January 1, 2003, available to
				Congress and the public in accordance with paragraph (2).</text>
						</subparagraph><subparagraph id="idEB7B0E7645134B70A6489711186BBFFD"><enum>(B)</enum><header>Annual
				update</header><text>Beginning 1 year after the date on which the Secretary of
				the Treasury makes the records available under subparagraph (A), and each year
				thereafter, the Secretary of the Treasury shall make all records of individual
				payments made under this section during the previous year available to Congress
				and the public in accordance with paragraph (2).</text>
						</subparagraph></paragraph><paragraph id="id1A895A6BE1D342AF9BD17B034FF063FC"><enum>(2)</enum><header>Requirements</header><text>In
				making records available under paragraph (1), the Secretary of the Treasury
				shall ensure that—</text>
						<subparagraph id="id7F43AEEA302A44BF9F8050EAC8263A38"><enum>(A)</enum><text>the records are
				made available on a publicly accessible Internet website; and</text>
						</subparagraph><subparagraph id="id1204BB3E6E5549CD8026B57B38F67E3D"><enum>(B)</enum><text>each record
				contains—</text>
							<clause id="id1C135C341C6645A081C1F01859B3A23C"><enum>(i)</enum><text>information that
				clearly identifies the entity receiving the payment;</text>
							</clause><clause id="idDC0CD7EBDE0E43B487ED4769BF7CFD3E"><enum>(ii)</enum><text>a copy of the
				settlement or judgment under which the payment was made;</text>
							</clause><clause id="id678CCC1462E64CB79EDF74594F8242EF"><enum>(iii)</enum><text>the amount of
				the total payment to each entity; and</text>
							</clause><clause id="idDEB68F5A84534F8582719FC5CCD328F4"><enum>(iv)</enum><text>a breakdown of
				the payment showing the specific amount of the damages, interest, and
				attorneys’ fees.</text>
							</clause></subparagraph></paragraph><paragraph id="idFCA0813F436B44348EC694792FBA1D86"><enum>(3)</enum><header>Prohibition</header>
						<subparagraph id="idC556C6DC81B74C749A60384012CF8E48"><enum>(A)</enum><header>In
				general</header><text>The Secretary of the Treasury may not make a record of
				individual payment available under this subsection if—</text>
							<clause id="id14834988E25D4D24ADC79BC3B5ADF9C0"><enum>(i)</enum><text>the payment was
				not the result of any executive branch, Federal department, agency, or
				instrumentality statutory or regulatory approval or permit related case, court
				order, consent decree, or Federal department, agency, or instrumentality
				settlement; or</text>
							</clause><clause id="id4B9E81C0B483418DABBFC55958630FA8"><enum>(ii)</enum><text>the disclosure
				of the information is otherwise prohibited by law or court order, or is not in
				the best interest of national security.</text>
							</clause></subparagraph><subparagraph id="idEC624EC3014945F1A29DBE0A05AB5A3D"><enum>(B)</enum><header>Rationale</header><text>For
				each record of individual payment not disclosed under subparagraph (A), the
				Secretary of the Treasury shall submit to Congress a statement explaining the
				rationale for not disclosing the
				record.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
