			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Catastrophic Wildfire
			 Prevention Act of 2012</short-title></quote>.</text>

			</subsection></section><section id="H6E2EF76E97794D6C9336E1946C2FC89A"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="HA7A8B653B8BA42A2A8ED0ADBF932671B"><enum>(1)</enum><text display-inline="yes-display-inline">to expedite wildfire prevention projects to
			 reduce the chances of wildfire (including catastrophic wildfire) on certain
			 Federal land;</text>
			</paragraph><paragraph id="HF457D4CDB84449328D5F7ABD3FB442E2"><enum>(2)</enum><text>to reduce threats
			 to endangered species from wildfires; and</text>
			</paragraph><paragraph id="HAD78CA7105EC4A6DAA4D1BADC14B89C3"><enum>(3)</enum><text>to provide to the
			 Secretary of Agriculture and the Secretary of the Interior tools to streamline
			 projects to reduce the potential for wildfires.</text>
			</paragraph></section><section id="H8A591326C22340CD8F6AFE13DAD89AB8"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HD3403E740B3A40AD87BFC8DA6CCC8475"><enum>(1)</enum><header>At-risk
			 community</header><text display-inline="yes-display-inline">The term
			 <term>at-risk community</term> has the meaning given the term in section 101 of
			 the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6511).</text>
			</paragraph><paragraph id="H4AAB6ABF08274BEDAFAAE32C2AA72454"><enum>(2)</enum><header>At-risk
			 forest</header><text display-inline="yes-display-inline">The term <term>at-risk
			 forest</term> means—</text>
				<subparagraph id="H6697575FA50E4A5EA4020DBCECCC5160"><enum>(A)</enum><text display-inline="yes-display-inline">Federal land on which there is a high risk
			 of losing an at-risk community, key ecosystem, wildlife, or wildlife habitat to
			 wildfire (including catastrophic wildfire and post-fire disturbances), as
			 documented by the Secretary concerned; or</text>
				</subparagraph><subparagraph id="H23DCD7428C5E440D86442C029CE980C5"><enum>(B)</enum><text>Federal land in
			 condition class II or III, as those classes were developed by the Forest
			 Service Rocky Mountain Research Station in the general technical report
			 entitled <quote>Development of Coarse-Scale Spatial Data for Wildland Fire and
			 Fuel Management</quote> (RMRS–87) and dated April 2000 (including any
			 subsequent revision to the report).</text>
				</subparagraph></paragraph><paragraph id="HBBFF31B56B1B49648FE6026A4E1C7885"><enum>(3)</enum><header>Authorized
			 wildfire prevention project</header>
				<subparagraph id="id298B9E2F65684CFE98EC43811A73B8E4"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>authorized wildfire prevention project</term> means the measures and
			 methods developed for a project to be carried out in an at-risk forest or on
			 threatened and endangered species habitat by the Secretary concerned for the
			 purpose of hazardous fuels reduction, forest health, forest restoration,
			 watershed restoration, or threatened and endangered species habitat
			 protection.</text>
				</subparagraph><subparagraph id="idBD39F36D293745A68E7D0D8A67965003"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>authorized wildfire
			 prevention project</term> includes livestock grazing and timber harvest
			 projects carried out for 1 or more of the purposes described in subparagraph
			 (A).</text>
				</subparagraph></paragraph><paragraph id="H5EFFC95A013B44F59302E58F85CDE315"><enum>(4)</enum><header>Federal
			 land</header>
				<subparagraph id="H561527DD41A04971B2BC804BC0844A9A"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>Federal land</term> means—</text>
					<clause id="HF61252A5DCA749DBAF7AD2B84A99A87D"><enum>(i)</enum><text display-inline="yes-display-inline">land of the National Forest System (as
			 defined in section 11(a) of the Forest and Rangeland Renewable Resources
			 Planning Act of 1974 (16 U.S.C. 1609(a))); or</text>
					</clause><clause id="HF8398577A4D542BE83BB72376651770D"><enum>(ii)</enum><text display-inline="yes-display-inline">public land.</text>
					</clause></subparagraph><subparagraph id="H8096BCA61F584D71A7D18011E750DC0D"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>Federal land</term> does not
			 include land in which the removal of vegetation is specifically prohibited by
			 Federal law unless the land is in an inventoried roadless area or wilderness
			 study area.</text>
				</subparagraph></paragraph><paragraph id="idEC3610E828534509B12C0EC3C0B35A38"><enum>(5)</enum><header>Public
			 land</header><text>The term <term>public land</term> has the meaning given the
			 term <term>public lands</term> in section 103 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1702).</text>
			</paragraph><paragraph id="HF0FE1DE05FA542018AD7207E614174B8"><enum>(6)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means—</text>
				<subparagraph id="H5941AF4B5E804E5FB7F6AB4723625788"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, with respect
			 to land of the National Forest System described in paragraph (4)(A)(i);
			 and</text>
				</subparagraph><subparagraph id="H8A1A447629BF4C4E92CC29D13FA9026C"><enum>(B)</enum><text>the Secretary of
			 the Interior, with respect to public land.</text>
				</subparagraph></paragraph><paragraph id="H7D612F9AEE8A4DD6BA96D5619F6D5E95"><enum>(7)</enum><header>Threatened and
			 endangered species habitat</header><text display-inline="yes-display-inline">The term <term>threatened and endangered
			 species habitat</term> means Federal land on which natural fire regimes are
			 identified as being important for, or wildfire is identified as a threat to, an
			 endangered species, a threatened species, or habitat of an endangered species
			 or threatened species in—</text>
				<subparagraph id="H1861323DC5214D529962795550A565A6"><enum>(A)</enum><text>a species recovery
			 plan prepared under section 4 of the Endangered Species Act of 1973 (16 U.S.C.
			 1533); or</text>
				</subparagraph><subparagraph id="HBAA9EB4092674C6A80F31E49BD94C4C9"><enum>(B)</enum><text display-inline="yes-display-inline">a notice published in the Federal Register
			 that—</text>
					<clause id="id8459519E1DE247A7BC162D9FDFF22A6D"><enum>(i)</enum><text display-inline="yes-display-inline">determines a species to be an endangered
			 species or a threatened species; or</text>
					</clause><clause id="id4F2337BEF3F1426D8EBF17965D12D432"><enum>(ii)</enum><text display-inline="yes-display-inline">designates critical habitat for an
			 endangered species or a threatened species.</text>
					</clause></subparagraph></paragraph></section><section id="H8C16941B42F4402788F8CD91EB6B8712"><enum>4.</enum><header>Authorized
			 wildfire prevention projects</header>
			<subsection id="H6CDDB49E9BDC4DEC8B12795EDA73DBC3"><enum>(a)</enum><header>Projects
			 authorized</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Secretary concerned
			 shall implement authorized wildfire prevention projects in at-risk forests and
			 on threatened and endangered species habitat in a manner that focuses on
			 surface, ladder, and canopy fuels reduction activities.</text>
			</subsection><subsection id="H39BE8402EF4E459680E18B034BA31322"><enum>(b)</enum><header>Project
			 elements</header>
				<paragraph id="HAF523330A0D848B0B65D3263436F88E8"><enum>(1)</enum><header>Threatened and
			 endangered species habitat</header><text display-inline="yes-display-inline">In
			 the case of an authorized wildfire prevention project carried out on threatened
			 and endangered species habitat, the project shall be carried out—</text>
					<subparagraph id="H9A468EA3265E4B14A60AC1CBC8DA056D"><enum>(A)</enum><text display-inline="yes-display-inline">to provide enhanced protection from
			 wildfire (including catastrophic wildfire) for the endangered species,
			 threatened species, or habitat of the endangered species or threatened species;
			 and</text>
					</subparagraph><subparagraph id="HA0FFE483EFB342F5864EF545F0E23B7B"><enum>(B)</enum><text display-inline="yes-display-inline">in compliance with any applicable
			 guidelines specified in the species recovery plan prepared under section 4 of
			 the Endangered Species Act of 1973 (16 U.S.C. 1533).</text>
					</subparagraph></paragraph><paragraph id="H945CAF798CFD428C84C54B837F0617CD"><enum>(2)</enum><header>At-risk
			 forests</header><text>In the case of an authorized wildfire prevention project
			 carried out in an at-risk forest, the project shall be carried out so as to
			 move Federal land in condition class II or III toward condition class I, as
			 those classes were developed by the Forest Service Rocky Mountain Research
			 Station in the general technical report entitled <quote>Development of
			 Coarse-Scale Spatial Data for Wildland Fire and Fuel Management</quote>
			 (RMRS–87) and dated April 2000 (including any subsequent revision to the
			 report).</text>
				</paragraph></subsection><subsection id="HB2307DFA711F4570BAFB0E3F54A7488A"><enum>(c)</enum><header>Grazing</header>
				<paragraph id="id3FFD8C94534E4675A8587A1EEEDFA5F1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Domestic livestock
			 grazing may be used in an authorized wildfire prevention project—</text>
					<subparagraph id="idB69E5F6AF4774A07B929683E2F0E20DE"><enum>(A)</enum><text display-inline="yes-display-inline">to reduce surface fuel loads; and</text>
					</subparagraph><subparagraph id="idFF0CFB48AB074D3DA8AB8D333B0896F1"><enum>(B)</enum><text display-inline="yes-display-inline">to recover burned areas.</text>
					</subparagraph></paragraph><paragraph id="id8C7442B17C744A108E2C804A6A9B4C8A"><enum>(2)</enum><header>Utilization
			 standards</header><text display-inline="yes-display-inline">Utilization
			 standards shall not apply in cases in which domestic livestock grazing is used
			 in an authorized wildfire prevention project.</text>
				</paragraph></subsection><subsection id="H6F9ED402E31F48948F5D425B4E4F26CC"><enum>(d)</enum><header>Timber
			 harvesting and thinning</header><text display-inline="yes-display-inline">Timber harvesting and thinning may be used
			 in an authorized wildfire prevention project to reduce ladder and canopy fuel
			 loads to prevent wildfire (including catastrophic wildfire).</text>
			</subsection><subsection id="H105846ADD1A54CDE8C7F688E92E4B1BC"><enum>(e)</enum><header>Relation to land
			 and resource management plans and land use plan</header><text display-inline="yes-display-inline">Nothing in this section requires the
			 Secretary concerned, as a condition of conducting an authorized wildfire
			 prevention project, to revise or amend—</text>
				<paragraph id="id3C7C8367AA2347BFB521DEC0EDD51D9C"><enum>(1)</enum><text display-inline="yes-display-inline">the land and resource management plan
			 applicable to the National Forest System land on which authorized wildfire
			 prevention project is to be conducted; or</text>
				</paragraph><paragraph id="idB09F978E67AB410AAB9C2BB8931BFACB"><enum>(2)</enum><text display-inline="yes-display-inline">the land use plan applicable to the public
			 land on which the authorized wildfire prevention project is to be
			 conducted.</text>
				</paragraph></subsection><subsection id="H08E7E0224F81492BAB9C41DD8DA673E0"><enum>(f)</enum><header>Consideration of
			 public petitions</header><text display-inline="yes-display-inline">Not later
			 than 60 days after the date on which the Secretary receives a public petition
			 for the designation of Federal land as an at-risk forest or as a threatened and
			 endangered species habitat, the Secretary concerned shall—</text>
				<paragraph id="H61D2DD1AB3894AF48DE0F8DF1F78850B"><enum>(1)</enum><text>review the
			 petition; and</text>
				</paragraph><paragraph id="H5D4DB2472CFE44169EAFB7694809E58F"><enum>(2)</enum><text>make a
			 determination regarding the designation.</text>
				</paragraph></subsection></section><section id="H91B051753D434F85BA6AEE9348132026"><enum>5.</enum><header>Public review and
			 environmental analysis</header>
			<subsection id="H86A798A4EDEE45C8B7AF3E8331F61BCA"><enum>(a)</enum><header>Public notice
			 and comment</header>
				<paragraph id="H1E8C67613AC64A2A9B2A550B427F4191"><enum>(1)</enum><header>Initial
			 notice</header><text display-inline="yes-display-inline">The Secretary
			 concerned shall publish in the Federal Register notice of a proposed authorized
			 wildfire prevention project.</text>
				</paragraph><paragraph id="id263AA13CD8F44604B874931C5C18777B"><enum>(2)</enum><header>Written
			 comments</header><text display-inline="yes-display-inline">Not later than 30
			 days after the date of publication of the notice under paragraph (1), any
			 person may submit to the Secretary specific written comments that relate to the
			 proposed authorized wildfire prevention project.</text>
				</paragraph><paragraph id="HF908F67D9F554852BB945F723A1C15B0"><enum>(3)</enum><header>Final designated
			 project</header>
					<subparagraph id="idBFB41A2E3BA141E4B24553CCB925F08D"><enum>(A)</enum><header>In
			 general</header><text>Not later than 60 days after the date on which the notice
			 is published under paragraph (1), after taking into account any comments
			 received under paragraph (2), the Secretary concerned shall—</text>
						<clause id="id56717E7030F04042BD2AF8031B1B48AC"><enum>(i)</enum><text>designate the
			 final authorized wildfire prevention project; and</text>
						</clause><clause id="id9541641131C34751B14EEC454472EB41"><enum>(ii)</enum><text>publish in the
			 Federal Register notice of the final authorized wildfire prevention
			 project.</text>
						</clause></subparagraph><subparagraph id="id20FEE2238C4448FBBE1A6F01C02A66B0"><enum>(B)</enum><header>Written
			 comments</header><text>Not later than 30 days after the date on which the
			 notice is published under subparagraph (A)(ii), any person who submitted
			 comments regarding the proposed authorized wildfire prevention project under
			 paragraph (2) may submit to the Secretary specific written comments that relate
			 to the final designated authorized wildfire prevention project.</text>
					</subparagraph></paragraph></subsection><subsection id="H47260AFEE09846F5A3B657747948767A"><enum>(b)</enum><header>Environmental
			 analysis generally</header><text display-inline="yes-display-inline">Except as
			 otherwise provided in this Act, the Secretary concerned shall comply with the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) and other
			 applicable laws in planning and conducting an authorized wildfire prevention
			 project.</text>
			</subsection><subsection id="H3C109EC7FBA744C396EEEB1BF2E26868"><enum>(c)</enum><header>Interagency
			 cooperation</header><text display-inline="yes-display-inline">The informal
			 consultation requirements in section 402.05 of title 50, Code of Federal
			 Regulations (or a successor regulation), shall apply to an authorized wildfire
			 prevention project.</text>
			</subsection><subsection id="HBFCFF22149E2413CAF969EC7A42615FA"><enum>(d)</enum><header>Special rules
			 for certain projects</header>
				<paragraph id="H9C0115D1138444A6BE0DA471DDCCAFC7"><enum>(1)</enum><header>Covered
			 projects; deadline</header><text display-inline="yes-display-inline">If an
			 authorized wildfire prevention project includes timber harvesting or grazing,
			 the Secretary concerned shall prepare an environmental assessment not later
			 than 30 days after the date on which the notice is published under subsection
			 (a)(1) for the proposed agency action under section 102(2) of the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4332(2)).</text>
				</paragraph><paragraph id="HFAD6F93534704B1C81726C27B8C62F2F"><enum>(2)</enum><header>Effect of
			 failure to meet deadline</header><text display-inline="yes-display-inline">The
			 authorized wildfire prevention project shall be considered to be compliant with
			 all requirements of the National Environmental Policy Act of 1969 (42 U.S.C.
			 4321 et seq.) if the Secretary concerned fails to meet the deadline specified
			 in paragraph (1).</text>
				</paragraph><paragraph id="H6EAD937E1B4743408BCE2F625E988F24"><enum>(3)</enum><header>Project
			 lengths</header>
					<subparagraph id="id869A6A3E0E124CD2B4DB65FC6A83226F"><enum>(A)</enum><header>Livestock
			 grazing projects</header><text>In the case of a livestock grazing project, an
			 environmental assessment conducted under paragraph (1) shall be considered to
			 be sufficient for a minimum of 10 years.</text>
					</subparagraph><subparagraph id="idB9F0A636B7F54CAB93972339F29301F7"><enum>(B)</enum><header>Timber harvest
			 projects</header><text>In the case of a timber harvest project, an
			 environmental assessment conducted under paragraph (1) shall be considered to
			 be sufficient for a minimum of 20 years.</text>
					</subparagraph></paragraph><paragraph id="HD9482B1E969B4834AC4F83AF40170D70"><enum>(4)</enum><header>Alternatives</header><text>Nothing
			 in this section requires the Secretary concerned to study, develop, or describe
			 any alternative to the proposed agency action in the environmental assessment
			 conducted under paragraph (1).</text>
				</paragraph></subsection><subsection id="H326A72B48CA344A58E103C4620C5141B"><enum>(e)</enum><header>Effect of
			 compliance</header><text display-inline="yes-display-inline">Compliance with
			 this section shall be considered to satisfy the requirements of—</text>
				<paragraph id="id0FF4723D03E24361977F627B99A02937"><enum>(1)</enum><text display-inline="yes-display-inline">the National Environmental Policy Act of
			 1969 (42 U.S.C. 4321 et seq.);</text>
				</paragraph><paragraph id="id35F829670205485E99793BBFCEDB8A28"><enum>(2)</enum><text display-inline="yes-display-inline">section 14 of the National Forest
			 Management Act of 1976 (16 U.S.C. 472a);</text>
				</paragraph><paragraph id="id67EF54ADA26D47659DB37EE37A7C0E8C"><enum>(3)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973 (16
			 U.S.C. 1531 et seq.); and</text>
				</paragraph><paragraph id="id8FB4D69FE7B1473F9C0B240C7DF5DC4F"><enum>(4)</enum><text display-inline="yes-display-inline">the Multiple-Use Sustained-Yield Act of
			 1960 (16 U.S.C. 528 et seq.).</text>
				</paragraph></subsection></section><section id="HF1C82D8D1C3E46FAB11EBE10E0FD219C"><enum>6.</enum><header>Administrative
			 and judicial review</header>
			<subsection id="H1AD7439AE9D449B297820E5AD857AA82"><enum>(a)</enum><header>Administrative
			 review</header><text display-inline="yes-display-inline">The special
			 administrative review process established under section 105 of the Healthy
			 Forests Restoration Act of 2003 (16 U.S.C. 6515) shall apply to any
			 administrative review of an authorized wildfire prevention project.</text>
			</subsection><subsection id="HA6D1A08173844CC381FB412F9611BA55"><enum>(b)</enum><header>Judicial
			 review</header><text display-inline="yes-display-inline">Any judicial
			 proceeding relating to an authorized wildfire prevention project shall be
			 conducted in accordance with section 106 of the Healthy Forests Restoration Act
			 of 2003 (16 U.S.C. 6516).</text>
			</subsection></section><section id="HFEDE16E4D7D0479AAD506D00AD3CD162"><enum>7.</enum><header>Threatened and
			 endangered species designations</header>
			<subsection id="idD989A4FCA8A647FEA54680D6C872837F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Before a species may
			 be listed as an endangered species or a threatened species under section 4(c)
			 of the Endangered Species Act of 1973 (16 U.S.C. 1533(c)), the Secretary
			 concerned shall conduct research to determine the impact that the listing would
			 have on forest fuel loads, including forage and timber.</text>
			</subsection><subsection id="id4323B4CFCAFC4E2F85927F7F1AADAAB4"><enum>(b)</enum><header>Wildfire risk
			 assessment analysis</header><text display-inline="yes-display-inline">Recovery
			 plans for threatened species and endangered species under section 4(f) of the
			 Endangered Species Act of 1973 (16 U.S.C. 1533(f)) and critical habitat
			 determinations under the Endangered Species Act of 1973 (16 U.S.C. 1531 et
			 seq.) shall include wildfire risk assessment analysis.</text>
			</subsection></section></legis-body>
