		<section id="H49F389D61C654BF884818142104273DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Taking Essential Steps for Testing
			 Act</short-title></quote> or the <quote><short-title>TEST
			 Act</short-title></quote>.</text>
		</section><section id="H692A329A35F24C52B6FFD1C743029564"><enum>2.</enum><header>Suspension,
			 revocation, and limitation of laboratory certification</header><text display-inline="no-display-inline">Section 353 of the Public Health Service Act
			 (42 U.S.C. 263a) is amended—</text>
			<paragraph id="H8EC0D7092B004A229660E395A2AF1CBA"><enum>(1)</enum><text>in subsection
			 (d)(1)(E), by inserting <quote>, except that no proficiency testing sample
			 shall be referred to another laboratory for analysis as prohibited under
			 subsection (i)(4)</quote> before the period at the end; and</text>
			</paragraph><paragraph id="HE0EAF2FBB27643229C55CCE03DCCB57A"><enum>(2)</enum><text>in subsection
			 (i)—</text>
				<subparagraph id="H50780DA0B3894B5A90854ACB1308F394"><enum>(A)</enum><text>in paragraph (3),
			 by inserting before the period at the end of the first sentence the following:
			 <quote>, except that if the revocation occurs pursuant to paragraph (4) the
			 Secretary may substitute intermediate sanctions under subsection (h) instead of
			 the 2-year prohibition against ownership or operation which would otherwise
			 apply under this paragraph</quote>; and</text>
				</subparagraph><subparagraph id="HD085C6699E2E4065AC954F3DDA7B863A"><enum>(B)</enum><text>in paragraph (4),
			 by striking <quote>shall</quote> the first place it appears and inserting
			 <quote>may</quote>.</text>
