		<official-title>To prohibit royalty incentives for deepwater drilling,
		  and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Deepwater Drilling Royalty Relief
			 Prohibition Act</short-title></quote>.</text>
		</section><section id="ID545a564ef9b5481097705898263aba5c"><enum>2.</enum><header>Prohibition on
			 royalty incentives for deepwater drilling</header>
			<subsection id="idCBD9AE6F2FDE4B57A98C52B7FFC5CDF6"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, the Secretary
			 of the Interior shall not issue any oil or gas lease sale under the Outer
			 Continental Shelf Lands Act (43 U.S.C. 1331 et seq.) with royalty-based
			 incentives in any tract located in water depths of 400 meters or more on the
			 outer Continental Shelf.</text>
			</subsection><subsection id="ID4f8dd0bede36477bb0cba564a01f0c25"><enum>(b)</enum><header>Royalty relief
			 for deep water production</header><text>Section 345 of the Energy Policy Act of
			 2005 (42 U.S.C. 15905) is repealed.</text>
			</subsection><subsection id="id4C5405FFC7D54AD98BF7BF3F8034C2A8"><enum>(c)</enum><header>Royalty
			 relief</header><text>Section 8(a)(3) of the Outer Continental Shelf Lands Act
			 (43 U.S.C. 1337(a)(3)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id451AC35FEDC94E91B38ABC5D6C9722AD" style="OLC">
					<subparagraph id="id303AAAD93CDA4774A5FC7474440FF705"><enum>(D)</enum><header>Prohibition</header><text>Notwithstanding
				sub­par­a­graphs (A) through (C) or any other provision of law, the Secretary
				shall not reduce or eliminate any royalty or net profit share for any lease or
				unit located in water depths of 400 meters or more on the outer Continental
				Shelf.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID3b27b18e2c9f47f4a029a9144c628659"><enum>(d)</enum><header>Application</header><text>This
			 section and the amendments made by this section—</text>
				<paragraph id="id892CF9F79D2344F5A278C8A994358035"><enum>(1)</enum><text>apply beginning
			 with the first lease sale held on or after the date of enactment of this Act
			 for which a final notice of sale has not been published as of that date;
			 and</text>
				</paragraph><paragraph id="idB7B021C9324344E7A888BD28106B4A73"><enum>(2)</enum><text>do not apply to a
			 lease in effect on the date of enactment of this Act.</text>
				</paragraph></subsection></section></legis-body>
