		<official-title>To amend the Federal Water Pollution Control Act to
		  ensure that sewage treatment plants monitor for and report discharges of raw
		  sewage, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Sewage Overflow Community
			 Right-to-Know Act</short-title></quote>.</text>
		</section><section id="IDbf6bfc60ba294d5ca6f86391bcb899a0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 502 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1362) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idFA3B7593929040AB94CD41F142E6C0ED" style="OLC">
				<paragraph id="ID2557e7df50c444c993b5e11a2d959074"><enum>(26)</enum><header>Treatment
				works</header><text>The term <term>treatment works</term> has the meaning given
				the term in section
				212.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID06e8679d9c434bab9c15f318486d96fc"><enum>3.</enum><header>Monitoring,
			 reporting, and public notification of sewer overflows</header><text display-inline="no-display-inline">Section 402 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1342) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idEA4D9DC9924E4EC19AF9E1B78A90C2B8" style="OLC">
				<subsection id="IDf45263afdb7147d9b626b40d68e342f7"><enum>(s)</enum><header>Sewer overflow
				monitoring, reporting, and notifications</header>
					<paragraph id="id4A47E905062246B59C960EABBCC19E0D"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
						<subparagraph id="ID1749644ef9e7478b939ab4e59fa2be74"><enum>(A)</enum><header>Sanitary sewer
				overflow</header>
							<clause id="idFCB7D242E6364F4CB0600501FEBB2B36"><enum>(i)</enum><header>In
				general</header><text>The term <term>sanitary sewer overflow</term> means an
				overflow, spill, release, or diversion of wastewater from a sanitary sewer
				system.</text>
							</clause><clause id="id6188C3CCBEE44711B2C383A6651FA184"><enum>(ii)</enum><header>Inclusions</header><text>The
				term <term>sanitary sewer overflow</term> includes—</text>
								<subclause id="id125135674DEB41A58CB5B9E4318BE8BC"><enum>(I)</enum><text>overflows or
				releases of wastewater that reach waters of the United States;</text>
								</subclause><subclause id="id40D030E0943841E2B1205EB7EBC1DBE2"><enum>(II)</enum><text>overflows or
				releases of wastewater in the United States that do not reach waters of the
				United States; and</text>
								</subclause><subclause id="id4B410220229849829F6385FF23ADBCC3"><enum>(III)</enum><text>wastewater
				backups into buildings that are caused by blockages or flow conditions in a
				sanitary sewer other than a building lateral.</text>
								</subclause></clause><clause id="idDAEF9A3A34AF418099832D3B046D649A"><enum>(iii)</enum><header>Exclusions</header><text>The
				term <term>sanitary sewer overflow</term> does not include—</text>
								<subclause id="idCD729B02A0B14797856EFA4143FCB323"><enum>(I)</enum><text>municipal
				combined sewer overflows or other discharges from the combined portion of a
				municipal combined storm and sanitary sewer system; or</text>
								</subclause><subclause id="id003AC0EEEB8849B9AC5F69EB54D62936"><enum>(II)</enum><text>wastewater
				backups into buildings caused by a blockage or other malfunction of a building
				lateral that is privately owned.</text>
								</subclause></clause></subparagraph><subparagraph id="IDe549e223f806473999d2228c30a7fedd"><enum>(B)</enum><header>Sewer
				overflow</header><text>The term <term>sewer overflow</term> means a sanitary
				sewer overflow or a municipal combined sewer overflow.</text>
						</subparagraph><subparagraph id="ID0535f765fce3407ebc85225e261f9141"><enum>(C)</enum><header>Single-family
				residence</header>
							<clause id="id62082D4B5A52433ABF8E4CC432DF0AA3"><enum>(i)</enum><header>In
				general</header><text>The term <term>single-family residence</term> means an
				individual dwelling unit.</text>
							</clause><clause id="idDAD35216763F422DA7464F0C57E94AC5"><enum>(ii)</enum><header>Inclusions</header><text>The
				term <term>single-family residence</term> includes—</text>
								<subclause id="id456013945CC84D5391CEA78528691D99"><enum>(I)</enum><text>an
				apartment;</text>
								</subclause><subclause id="idD0FE49F1EFB249E1872231E8509B873E"><enum>(II)</enum><text>a
				condominium;</text>
								</subclause><subclause id="id03BA4F5CD69D47B2B2C5365DC4F07725"><enum>(III)</enum><text>a house;
				and</text>
								</subclause><subclause id="id0018D39A32EE4BECA09BE337A4A77D43"><enum>(IV)</enum><text>a
				dormitory.</text>
								</subclause></clause><clause id="id8733DD1EDCED4EFDBE10F89B7AA78EB5"><enum>(iii)</enum><header>Exclusions</header><text>The
				term <term>single-family residence</term> does not include the common areas of
				a multidwelling structure.</text>
							</clause></subparagraph></paragraph><paragraph id="ID47c1ecf2cc024579906c3d8886755734"><enum>(2)</enum><header>General
				requirements</header><text>After the last day of the 180-day period beginning
				on the date on which regulations are promulgated under paragraph (5), a permit
				issued, renewed, or modified under this section by the Administrator or the
				State, as applicable, for a publicly owned treatment works shall require, at a
				minimum, beginning on the date of the issuance, modification, or renewal, that
				the owner or operator of the treatment works—</text>
						<subparagraph id="IDfefe89a85d1d4c9c8404089a45cd59e4"><enum>(A)</enum><text>institute and use
				a feasible methodology, technology, or management program for monitoring sewer
				overflows to alert the owner or operator to the occurrence of a sewer overflow
				in a timely manner;</text>
						</subparagraph><subparagraph id="ID3668e333b58d44d88d3178b50687ad43"><enum>(B)</enum><text>in the case of a
				sewer overflow that has the potential to affect human health, notify the public
				of the overflow as soon as practicable but not later than 24 hours after the
				time the owner or operator knows of the overflow;</text>
						</subparagraph><subparagraph id="IDd5a39cf9decd4934bf91b8ffc2c67c67"><enum>(C)</enum><text>in the case of a
				sewer overflow that may imminently and substantially endanger human health,
				notify public health authorities and other affected entities, such as public
				water systems, of the overflow immediately after the owner or operator knows of
				the overflow;</text>
						</subparagraph><subparagraph id="ID68255d373ec54da584c528acd13325d9"><enum>(D)</enum><text>report each sewer
				overflow on the discharge monitoring report of the owner or operator to the
				Administrator or the State, as applicable, by describing—</text>
							<clause id="IDaf52fa87f7ae4422a08f4711a7943391"><enum>(i)</enum><text>the magnitude,
				duration, and suspected cause of the overflow;</text>
							</clause><clause id="IDe7235048e7af492e9c848edf7f782905"><enum>(ii)</enum><text>the steps taken
				or planned to reduce, eliminate, or prevent recurrence of the overflow;
				and</text>
							</clause><clause id="IDf9601a186b544a82b31b43e40e88f8be"><enum>(iii)</enum><text>the steps taken
				or planned to mitigate the impact of the overflow; and</text>
							</clause></subparagraph><subparagraph id="IDcf1e2584ea854dd58b6ecc6a6eeaf7f4"><enum>(E)</enum><text>annually report
				to the Administrator or the State, as applicable, the total number of sewer
				overflows in a calendar year, including—</text>
							<clause id="ID6f07277f445c4c2ea9a29b1586e4967a"><enum>(i)</enum><text>the details of
				how much wastewater was released per incident;</text>
							</clause><clause id="ID62fd40115d454922bcea843b0c38523e"><enum>(ii)</enum><text>the duration of
				each sewer overflow;</text>
							</clause><clause id="IDc33574417b7c4dacbf83c6b433a74037"><enum>(iii)</enum><text>the location of
				the overflow and any potentially affected receiving waters;</text>
							</clause><clause id="IDb6b8a8b39c2341109d0da115c6fedf6b"><enum>(iv)</enum><text>the responses
				taken to clean up the overflow; and</text>
							</clause><clause id="IDf20c7cc14cf34210bdb65a394ea6b765"><enum>(v)</enum><text>the actions taken
				to mitigate impacts and avoid further sewer overflows at the site.</text>
							</clause></subparagraph></paragraph><paragraph id="ID01d880aa8e92435c8c18cf8583bbfee4"><enum>(3)</enum><header>Exceptions</header>
						<subparagraph id="ID992ef9ba31984594b6c3f6a0eb47cd0d"><enum>(A)</enum><header>Notification
				requirements</header><text>The notification requirements of subparagraphs (B)
				and (C) of paragraph (2) shall not apply to a sewer overflow that is a
				wastewater backup into a single-family residence.</text>
						</subparagraph><subparagraph id="ID6305c91672014141ac28bb55ccec1d8c"><enum>(B)</enum><header>Reporting
				requirements</header><text>The reporting requirements of subparagraphs (D) and
				(E) of paragraph (2) shall not apply to a sewer overflow that is a release of
				wastewater that—</text>
							<clause id="id241847CAE0DC4F6A82F5B2A12CFD904C"><enum>(i)</enum><text>occurs in the
				course of maintenance of the treatment works;</text>
							</clause><clause id="id84496BAD64214D649FA6F63B54C510F9"><enum>(ii)</enum><text>is managed
				consistently with the best management practices of the treatment works;
				and</text>
							</clause><clause id="id8C42DDA66CE24C5886926F65BA46FA80"><enum>(iii)</enum><text>is intended to
				prevent sewer overflows.</text>
							</clause></subparagraph></paragraph><paragraph id="IDe00d52d8fce04212bbee8d522c875320"><enum>(4)</enum><header>Report to
				EPA</header><text>Each State shall provide to the Administrator annually a
				summary of sewer overflows that occur in the State.</text>
					</paragraph><paragraph id="ID64d3d438d10c4b2084d69ac81642251b"><enum>(5)</enum><header>Rulemaking by
				EPA</header><text>Not later than 1 year after the date of enactment of this
				subsection, the Administrator, after providing notice and an opportunity for
				public comment, shall promulgate regulations to implement this subsection,
				including regulations—</text>
						<subparagraph id="IDa1622161ce84458a9b6c883f21415c54"><enum>(A)</enum><text>to establish a
				set of criteria to guide the owner or operator of a publicly owned treatment
				works in—</text>
							<clause id="ID3bb4a849ae9a48d0951ff0b7a5c08444"><enum>(i)</enum><text>assessing whether
				a sewer overflow may imminently and substantially endanger human health;
				and</text>
							</clause><clause id="IDc4df94d8134f465e8baa33adb34dedb7"><enum>(ii)</enum><text>developing
				communication measures that are sufficient to give notice under subparagraphs
				(B) and (C) of paragraph (2); and</text>
							</clause></subparagraph><subparagraph id="IDb83930b7f4fe4a3dba1517d682466a2d"><enum>(B)</enum><text>to define the
				terms <term>feasible</term> and <term>timely</term> as those terms apply to
				paragraph (2)(A), including site specific conditions.</text>
						</subparagraph></paragraph><paragraph id="IDedd84d9f18744fcc8364815c29b28333"><enum>(6)</enum><header>Approval of
				State notification programs</header>
						<subparagraph id="ID57f4281d760e4344af6c60eeba4003a4"><enum>(A)</enum><header>Requests for
				approval</header>
							<clause id="IDd13a59c13a8144f7a767b97f7f70a66d"><enum>(i)</enum><header>In
				general</header><text>After the date on which regulations are promulgated under
				paragraph (5), a State may submit to the Administrator evidence that the State
				has in place a legally enforceable notification program that is substantially
				equivalent to the requirements of subparagraphs (B) and (C) of paragraph
				(2).</text>
							</clause><clause id="ID2a4111d3eb1f49cf980bcc1e62bf16bc"><enum>(ii)</enum><header>Program review
				and authorization</header><text>If the evidence submitted by a State under
				clause (i) shows the notification program of the State to be substantially
				equivalent to the requirements of subparagraphs (B) and (C) of paragraph (2),
				the Administrator shall authorize the State to carry out that program instead
				of those requirements.</text>
							</clause><clause id="ID0b21dd4e8b5440c08e5cddfb9851ea6a"><enum>(iii)</enum><header>Factors for
				determining substantial equivalency</header><text>In carrying out a review of a
				State notification program under clause (ii), the Administrator shall take into
				account—</text>
								<subclause id="id09EF2C94E44D4CA4ABF51382E784FC09"><enum>(I)</enum><text>the scope of
				sewer overflows for which notification is required;</text>
								</subclause><subclause id="id4D16D4844A1F47B084665ECC17FAE5D3"><enum>(II)</enum><text>the length of
				time during which notification must be made;</text>
								</subclause><subclause id="id47028C73A48D4B3C8BE705CD7B2B5A17"><enum>(III)</enum><text>the number of
				persons that must be notified of sewer overflows;</text>
								</subclause><subclause id="id22D260E482D94EA98D3F21BE1A5CEA24"><enum>(IV)</enum><text>the scope of
				enforcement activities ensuring that notifications of sewer overflows are made;
				and</text>
								</subclause><subclause id="idC02AF1C6E66B47A380CB2CA311F3EA3A"><enum>(V)</enum><text>such other
				factors as the Administrator considers to be appropriate.</text>
								</subclause></clause></subparagraph><subparagraph id="IDe35d4dadd64049758ac114580f7bedba"><enum>(B)</enum><header>Review
				period</header><text>If a State submits evidence with respect to a notification
				program under subparagraph (A)(i) in the 30-day period beginning on the date of
				promulgation of regulations under paragraph (5), the requirements of
				subparagraphs (B) and (C) of paragraph (2) shall not apply to a publicly owned
				treatment works located in the State until the date on which the Administrator
				completes a review of the notification program under subparagraph
				(A)(ii).</text>
						</subparagraph><subparagraph id="IDdc19977a4acc41ce9e4a6fe331fe0a66"><enum>(C)</enum><header>Withdrawal of
				authorization</header><text>If the Administrator, after conducting a public
				hearing, determines that a State is not administering and enforcing a State
				notification program authorized under subparagraph (A)(ii) in accordance with
				the requirements of this paragraph, the Administrator shall so notify the State
				and, if appropriate corrective action is not taken within a reasonable time,
				not to exceed 90 days, the Administrator shall withdraw authorization of the
				program and enforce the requirements of subparagraphs (B) and (C) of paragraph
				(2) with respect to the State.</text>
						</subparagraph></paragraph><paragraph id="ID1964b119d4524bb08335974e02462f70"><enum>(7)</enum><header>Special rules
				concerning application of notification requirements</header><text>Beginning on
				the day after the 30-day period that begins on the date of promulgation of
				regulations under paragraph (5), the requirements of subparagraphs (B) and (C)
				of paragraph (2) shall—</text>
						<subparagraph id="ID1a437d78ab46468da20400f6ce6870c5"><enum>(A)</enum><text>apply to the
				owner or operator of a publicly owned treatment works and be subject to
				enforcement under section 309; and</text>
						</subparagraph><subparagraph id="id99C49EAFA7FA4A88B54659AC22F75169"><enum>(B)</enum><text>supersede any
				notification requirements contained in a permit issued under this section for
				the treatment works to the extent that the notification requirements are less
				stringent than the notification requirements of subparagraphs (B) and (C) of
				paragraph (2), until such date as a permit is issued, renewed, or modified
				under this section for the treatment works in accordance with paragraph
				(2).</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDcabe01c2803648e1ae194f6478a52a0f"><enum>4.</enum><header>Eligibility for
			 assistance</header>
			<subsection id="id987AE113FE35450E8711BC228DE6C90D"><enum>(a)</enum><header>Purpose of
			 State revolving fund</header><text display-inline="yes-display-inline">Section
			 601(a) of the Federal Water Pollution Control Act (33 U.S.C. 1381(a)) is
			 amended—</text>
				<paragraph id="ID792ed62a5daf49d6ade163ef7aeabb2f"><enum>(1)</enum><text>by striking
			 <quote>and</quote> the first place it appears; and</text>
				</paragraph><paragraph id="ID9def683a182e43bfb6d92c09abf771c4"><enum>(2)</enum><text>by inserting
			 after <quote>section 320</quote> the following: <quote>, and (4) for the
			 implementation of requirements to monitor for sewer overflows under section
			 402</quote>.</text>
				</paragraph></subsection><subsection id="ID02ff1454543f4b25a5b0b203070402fa"><enum>(b)</enum><header>Water pollution
			 control revolving loan funds</header><text>Section 603(c) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1383(c)) is amended—</text>
				<paragraph id="IDb2a5aefbc6324e17b596d00ef75df271"><enum>(1)</enum><text>by striking
			 <quote>and</quote> the first place it appears; and</text>
				</paragraph><paragraph id="ID6353673dfe514871af4d97d14ad1fab1"><enum>(2)</enum><text>by inserting
			 after <quote>section 320 of this Act</quote> the following: <quote>, and (4)
			 for the implementation of requirements to monitor for sewer overflows under
			 section 402</quote>.</text>
				</paragraph></subsection></section><section id="IDce5e96ca9c8d46fc88df032fb1e44e38"><enum>5.</enum><header>Effect of
			 Act</header><text display-inline="no-display-inline">Nothing in this Act or an
			 amendment made by this Act—</text>
			<paragraph id="id7BB1D36F87E44DCA898A39BE1A76B5DD"><enum>(1)</enum><text display-inline="yes-display-inline">limits the ability of any State to
			 implement or enforce a more stringent monitoring or notification standard than
			 the applicable standard under the Federal Water Pollution Control Act (33
			 U.S.C. 1251 et seq.);</text>
			</paragraph><paragraph id="idB6FF78DD356E4CE29C28CFCEFEE5D15E"><enum>(2)</enum><text display-inline="yes-display-inline">authorizes any sewer overflow; or</text>
			</paragraph><paragraph id="id35A473D5C07B47238FCAAD42B8E83E56"><enum>(3)</enum><text display-inline="yes-display-inline">supplants or diminishes any obligation to
			 comply with any requirement of the Federal Water Pollution Control Act (33
			 U.S.C. 1251 et seq.) or any other Federal or State law.</text>
