		  grants to State courts to develop and implement State court interpreter

		<section commented="no" display-inline="no-display-inline" id="idee537592-a6fd-4a30-a5a1-b47f544cd57d" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>State Court Interpreter Grant Program
			 Act of 2012</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idB91FA37D479A4C88A20860450408F057" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id10ef4a84-a019-4999-9449-ceb12a65b678"><enum>(1)</enum><text display-inline="yes-display-inline">the fair administration of justice depends
			 on the ability of all participants in a courtroom proceeding to understand that
			 proceeding, regardless of their English proficiency;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc4bf97aa-1164-4414-9227-3ba2e08a8747"><enum>(2)</enum><text display-inline="yes-display-inline">21 percent of the population of the United
			 States over 5 years of age speaks a language other than English at home;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9fc21a03-e41f-4e4f-a2df-897f03096df6"><enum>(3)</enum><text display-inline="yes-display-inline">only qualified and certified court
			 interpreters can ensure that persons with limited English proficiency
			 comprehend judicial proceedings in which they are a party;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09C5623BF9E54487B13595AC07C0AEA0"><enum>(4)</enum><text>the knowledge and
			 skills required of a qualified court interpreter differ substantially from
			 those required in other interpretation settings, such as social service,
			 medical, diplomatic, and conference settings;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71bc878f-4244-4c17-972e-cd15f24b6a63"><enum>(5)</enum><text display-inline="yes-display-inline">the Federal Government has demonstrated its
			 commitment to equal administration of justice, regardless of English
			 proficiency;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13e9dddf-d806-4705-b989-0dfedafaf4b5"><enum>(6)</enum><text display-inline="yes-display-inline">regulations implementing title VI of the
			 Civil Rights Act of 1964 (42 U.S.C. 2000d et seq.), as well as the guidance
			 issued by the Department of Justice pursuant to Executive Order 13166, issued
			 August 11, 2000, clarify that all recipients of Federal financial assistance,
			 including State courts, are required to take reasonable steps to provide
			 meaningful access to their proceedings for persons with limited English
			 proficiency;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc553d922-00d8-45a7-8aa8-7e5c2b4b9697"><enum>(7)</enum><text display-inline="yes-display-inline">43 States have developed, or are
			 developing, qualified court interpreter programs;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b8eb65e-18f9-411a-b2bb-acf2930163a3"><enum>(8)</enum><text display-inline="yes-display-inline">a robust and effective court interpreter
			 program—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id669e1ae9-a331-4648-9b94-c0de68011056"><enum>(A)</enum><text display-inline="yes-display-inline">actively recruits skilled individuals to
			 serve as court interpreters;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37c7c208-1029-4d01-9044-132c1c7502ea"><enum>(B)</enum><text display-inline="yes-display-inline">trains those individuals in the
			 interpretation of court proceedings;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6db15a18-73aa-4d8e-8828-db2dcf59bdcf"><enum>(C)</enum><text display-inline="yes-display-inline">develops and uses a thorough, systematic
			 certification process for court interpreters;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide054db63-d7cf-4181-80df-1d65afd23130"><enum>(D)</enum><text display-inline="yes-display-inline">has sufficient funding to ensure that a
			 qualified and certified interpreter will be available to the court whenever
			 necessary; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id64BC63BEECBB4CC4B864E7226C49601D"><enum>(E)</enum><text>efficiently uses
			 funding to create substantial cost savings; and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e228b16-d74e-4aab-8ed9-e8168de7bac1"><enum>(9)</enum><text display-inline="yes-display-inline">Federal funding is necessary to—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idaba68dfe-af49-494d-a43b-85e7b3dbe543"><enum>(A)</enum><text display-inline="yes-display-inline">encourage State courts that do not have
			 court interpreter programs to develop them;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4308b63b-f979-43d9-b676-ea506985bac7"><enum>(B)</enum><text display-inline="yes-display-inline">assist State courts with nascent court
			 interpreter programs to implement them;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfa6433db-9bf7-4ade-8669-f156fde6bdd7"><enum>(C)</enum><text display-inline="yes-display-inline">assist State courts with limited court
			 interpreter programs to enhance them; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc49fdc2f-cd24-45b2-b4b5-c3271825f87f"><enum>(D)</enum><text display-inline="yes-display-inline">assist State courts with robust court
			 interpreter programs to make further improvements and share successful cost
			 saving programs with other States.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idFA1505C2C6354E4981292A87063D827E" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">State court interpreter program</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1f6c4d9a-d353-47af-aa90-b22fb3b86111"><enum>(a)</enum><header display-inline="yes-display-inline">Grants authorized</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2397f097-c380-402a-a77a-c26eb5837994"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the Office of Justice
			 Programs of the Department of Justice (referred to in this section as the
			 <quote>Administrator</quote>) shall make grants, in accordance with such
			 regulations as the Attorney General may prescribe, to State courts to develop
			 and implement programs to assist individuals with limited English proficiency
			 to access and understand State court proceedings in which they are a
			 party.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id351593C887FF4760838D6B6604A612AA"><enum>(2)</enum><header>Use of
			 Grants</header><text display-inline="yes-display-inline">A State court may use
			 a grant awarded under this subsection to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idfd6386b3-c441-490d-8cb3-418b09a6f22b"><enum>(A)</enum><text display-inline="yes-display-inline">develop or enhance a court interpreter
			 program for the State court;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb0b1655a-0c04-4bbd-8811-149118e43b1a"><enum>(B)</enum><text display-inline="yes-display-inline">develop, institute, and administer language
			 certification examinations;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2b9df479-2c82-41bb-9cd8-b43500fd3333"><enum>(C)</enum><text display-inline="yes-display-inline">recruit, train, and certify qualified court
			 interpreters;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id760b8c24-3719-4c51-aae5-1c2fea3174c3"><enum>(D)</enum><text display-inline="yes-display-inline">pay for salaries, transportation, and
			 technology necessary to implement the court interpreter program developed or
			 enhanced under subparagraph (A);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32D933C59CD846F3A44D84E474D6A782"><enum>(E)</enum><text display-inline="yes-display-inline">provide for remote interpretation services
			 to facilitate certified court interpretations when costs prohibit in-person
			 interpretation; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideaaada67-b409-4de5-a257-e27b3e44810a"><enum>(F)</enum><text display-inline="yes-display-inline">engage in other related activities, as
			 prescribed by the Attorney General.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0522e4dc-785f-4a55-a7a9-d95e6d300c6c"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id0c9174c3-fa4d-444c-b324-e5ee4fa8c140"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The highest State court of each State
			 seeking a grant under this section shall submit an application to the
			 Administrator at such time, in such manner, and accompanied by such information
			 as the Administrator may reasonably require.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4f761f9b-20bd-4c37-8bc3-d97f9b5174e7"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The highest State court of each State
			 submitting an application under paragraph (1) shall include in the
			 application—</text>
					<subparagraph id="id2A9166084E4B4C82A2F33F7CC25CD809"><enum>(A)</enum><text>a demonstration
			 of need for the development, implementation, or expansion of a State court
			 interpreter program;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfbed33ec-b288-422c-b7c1-db6c98233fc0"><enum>(B)</enum><text display-inline="yes-display-inline">an identification of each State court in
			 that State that would receive funds from the grant;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb28e8f42-12b1-4468-899c-3cdf5febbc88"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of funds that each State court
			 identified under subparagraph (B) would receive from the grant; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id106e07d0-c6a6-48cd-85e8-488257102537"><enum>(D)</enum><text display-inline="yes-display-inline">the procedures that the highest State court
			 would use to directly distribute grant funds to State courts identified under
			 subparagraph (B).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4856b84c-0d58-4a57-89b8-664790a2eb50"><enum>(c)</enum><header display-inline="yes-display-inline">State court allotments</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id85cf3e19-dbe1-4bbb-9fb1-aec4883b565c"><enum>(1)</enum><header display-inline="yes-display-inline">Base
			 allotment</header><text display-inline="yes-display-inline">From amounts
			 appropriated for each fiscal year pursuant to section 5, the Administrator
			 shall allocate $100,000 to the highest court of each State that has an
			 application approved under subsection (b).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7596288c-b3c2-4f00-88f6-8c781eccb58e"><enum>(2)</enum><header display-inline="yes-display-inline">Additional allotment</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5A47EC35158543DEA88CC2B067890979"><enum>(A)</enum><header>In
			 general</header><text>From amounts appropriated for each fiscal year pursuant
			 to section 5, the Administrator shall allocate $5,000,000 to be distributed
			 among the highest State courts that—</text>
						<clause commented="no" display-inline="no-display-inline" id="id0FFE77D2ABBE46A28F995FDD8558AB77"><enum>(i)</enum><text>have an
			 application approved under subsection (b); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idEA9AE0F7FDB042F881E35B225935BFA2"><enum>(ii)</enum><text>are located in a
			 State with extraordinary needs that prevent the development, implementation, or
			 expansion of a State court interpreter program.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4AAFC6E6FCFE44A0A5FBD19F9C2910DC"><enum>(B)</enum><header>Determining
			 need</header><text>In determining whether a State has extraordinary needs
			 required under subparagraph (A), the Administrator shall consider—</text>
						<clause commented="no" display-inline="no-display-inline" id="id7567BF88D4AF40D6BA06EACFDAAD14EF"><enum>(i)</enum><text>based on data
			 from the Bureau of the Census, the ratio between the number of people over 5
			 years of age who speak a language other than English at home and identify as
			 speaking English less than very well—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id68DFB4DD950345D1AF294E14C61043BD"><enum>(I)</enum><text>in that State;
			 and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id558F5A9F05E4439AB7196D2ED245BD14"><enum>(II)</enum><text>in all of the
			 States that receive an allocation under paragraph (1); and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id30F1E4BEED444C75BD0B3489E1676EAE"><enum>(ii)</enum><text>any efficiency
			 or substantial cost savings expected from a State court interpreter
			 program.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id289E054D511A42AB8D76D397AA1878CD"><enum>(C)</enum><header>Priority
			 consideration</header><text>In allocating amounts under subparagraph (A), the
			 Administrator shall give priority to any State that does not have and has not
			 begun to develop a qualified court interpreter program.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idad85f4a8-a48d-4dd3-82b7-3fc33c21a83c"><enum>(d)</enum><header display-inline="yes-display-inline">Treatment of District of
			 Columbia</header><text display-inline="yes-display-inline">For purposes of this
			 section—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ida21494b6-0ba7-4a1d-9425-247c42c5948d"><enum>(1)</enum><text display-inline="yes-display-inline">the District of Columbia shall be treated
			 as a State; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idca76867d-11ce-41b2-8b0c-0ebbaf6ff475"><enum>(2)</enum><text display-inline="yes-display-inline">the District of Columbia Court of Appeals
			 shall act as the highest State court for the District of Columbia.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id74568AD437A14111A2168898DD28E9C1"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date on
			 which the first grant is made under section 3, the Administrator shall submit a
			 report to Congress that describes how each highest State court has used the
			 funds from each grant made under section 3 in a manner consistent with section
			 3(a)(2).</text>
		</section><section commented="no" display-inline="no-display-inline" id="id99bc37bd-174f-43c8-bbac-09b1f9c662db" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated $10,000,000 for each of fiscal years 2013 through
			 2017 to carry out this Act.</text>
