		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>End Debt Collector Abuse Act of
			 2012</short-title></quote>.</text>
		</section><section id="idA7C429129B304ABE8F511E1D29458035"><enum>2.</enum><header>Enhanced
			 validation notices</header>
			<subsection id="idEEB6B581EA0D45CCA29DE7CCF50FE157"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 809(a) of the
			 Fair Debt Collection Practices Act (15 U.S.C. 1692g(a)) is amended—</text>
				<paragraph id="id47B64C1CB4A34D74BBBAE4A526121042"><enum>(1)</enum><text>in paragraph (4),
			 by striking <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="id0DEC3408E197446EAD6C0C7DA0C3A558"><enum>(2)</enum><text>by striking
			 paragraph (5) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id915D8EF3A18F4931BB069161A56934CF" style="OLC">
						<paragraph id="id3BEBF56304CB4E7985EAC738492EB393"><enum>(5)</enum><text>the date of the
				last payment made by or on behalf of the consumer on the subject debt and the
				amount of the debt at that time;</text>
						</paragraph><paragraph id="idD3545CAFFC0A4B0D8BDCF96FBE741D57"><enum>(6)</enum><text>the name and
				address of the last person to extend credit with respect to the debt;</text>
						</paragraph><paragraph id="id8B0A5FEC6516490098EAA7A4A0C5A727"><enum>(7)</enum><text>an itemization of
				the principal, fees, interest, and any other charges that make up the debt,
				including any other charges added after the date of the last payment made by or
				on behalf of the consumer on the subject debt;</text>
						</paragraph><paragraph id="idB63EB668F7DE4FD58D38006C653350DD"><enum>(8)</enum><text>a description of
				the rights of the consumer—</text>
							<subparagraph id="id1984E9E5A0244FFC8E2F1F15758B4DD4"><enum>(A)</enum><text>to request that
				the debt collector cease communication with the consumer under section 805(c);
				and</text>
							</subparagraph><subparagraph id="idE10DBB1B6A8C47B28C96D07FDF197904"><enum>(B)</enum><text>to have
				collection efforts stopped under subsection (b); and</text>
							</subparagraph></paragraph><paragraph id="idC2EFA3F9363C496EAD3E4F7D3D835EEA"><enum>(9)</enum><text>the name and
				contact information of the person responsible for handling complaints on behalf
				of the debt
				collector.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id3D0A30E450494FA48E36D301376ADF90"><enum>(b)</enum><header>Effective
			 date</header><text>This section and the amendments made by this section shall
			 become effective 1 year after the date of enactment of this Act.</text>
			</subsection></section><section id="id65300ABAAD2146C48BF2E474026C7CC7"><enum>3.</enum><header>Medical debt
			 provisions</header>
			<subsection id="id3141c09c42bb4984a0e60eac36815575"><enum>(a)</enum><header>Findings</header><text>Section
			 802 of the Fair Debt Collection Practices Act (15 U.S.C. 1692) is
			 amended—</text>
				<paragraph id="id73426DD1676A41DF9BBCF3C2C88DDFB8"><enum>(1)</enum><text>by redesignating
			 subsection (e) as subsection (f); and</text>
				</paragraph><paragraph id="id03A1C2EFC64F45A1A257801F053F134A"><enum>(2)</enum><text>by inserting
			 after subsection (d) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC791678A428E4EF28DB28AF3CA38D61E" style="OLC">
						<subsection id="idE60AADB7C75F4B36B351232C9459A321"><enum>(e)</enum><text>Medical debt is
				unique among types of consumer debt in that—</text>
							<paragraph id="id1F65D2104CAA41C3B9DEF6F0DC9A2B88"><enum>(1)</enum><text>with very few
				exceptions, consumers seek out health care services out of medical need, not
				choice;</text>
							</paragraph><paragraph id="idA6BFE30BBD1D4418A6029ADF0030B8F2"><enum>(2)</enum><text>consumers
				typically do not know the cost of health care services in advance and are not
				in a position to negotiate a lower price; and</text>
							</paragraph><paragraph id="idA8683DF5FFEB424C9C5506B96BEAD6EC"><enum>(3)</enum><text>overly aggressive
				medical debt collection can discourage consumers from seeking needed healthcare
				services, with dire financial, physical and public health consequences for
				themselves and their
				communities.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id416CBE891EC346859EEEFD462E03E5DD"><enum>(b)</enum><header>Prohibiting
			 medical facility contacts</header><text>Section 806 of the Fair Debt Collection
			 Practices Act (15 U.S.C. 1692d) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idEE0374D0D43342E5A07DBCB89DAF7E79" style="OLC">
					<paragraph id="id4F73F057D030407BB9027B45891124C8"><enum>(7)</enum><text>Communicating or
				attempting to communicate with a consumer in connection with the collection of
				any debt in a hospital emergency department, labor and delivery department, or
				any department where critical care medical services are provided, such as the
				intensive care unit. Nothing in this paragraph prohibits a health care provider
				from providing information to a consumer about a debt in response to a direct
				request from the consumer or discussing a debt at the time the consumer is
				discharged.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id385C733C826C4165A35FD6B40014485F"><enum>(c)</enum><header>Actions
			 constituting unfair medical debt collection practices</header><text>Section 808
			 of the Fair Debt Collection Practices Act (15 U.S.C. 1692f) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id31405FD2E7E044B1AEBB09CCBC69D1FF" style="OLC">
					<paragraph id="idA358B0569064469F8D9881699DC10C6E"><enum>(9)</enum><text>Withholding
				emergency medical services, taking action to delay such services, threatening
				to withhold such services, or giving the impression that such services will be
				withheld until a debt is paid.</text>
					</paragraph><paragraph id="id97EABAFA56DE49288B58C21815420D6D"><enum>(10)</enum><text>Using protected
				health information, as defined in regulations promulgated pursuant to section
				264(c) of the Health Insurance Portability and Accountability Act of 1996 (42
				U.S.C. 1320d–2 note), except to the extent as is absolutely necessary to
				provide adequate information to
				consumers.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idbdc6694f406b46b180566b2acf837660"><enum>(d)</enum><header>Treatment of
			 medical debt</header><text>The Fair Debt Collection Practices Act (15 U.S.C.
			 1692a et seq.) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="id88047EDCB65E4D499D4301C6E0509F2E" style="OLC">
					<section id="id48B2EE64E18F41D8908EFDDC1E10F3D4"><enum>820.</enum><header>Treatment of
				medical debt</header>
						<subsection id="idE3B12A821FB64CB0B2B8CE91E1ED680B"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Sections 806, 807
				(other than paragraph (11)), 808, 811, and 813, shall apply to the collection
				of a medical debt, whether or not the debt is being collected directly by the
				creditor or on behalf of the creditor by a third party, and regardless of
				whether such debt is current or past due.</text>
						</subsection><subsection id="idED6529EDCB604FC3807C65CDB5B17D30"><enum>(b)</enum><header>Availability of
				information</header><text>Any person attempting to collect a medical debt
				shall—</text>
							<paragraph id="id7ab4c154c7ea4d719e02676946004a50"><enum>(1)</enum><text>in the initial
				written communication to the consumer—</text>
								<subparagraph id="id9B54128605F84FDF8A2D14DA3DD23687"><enum>(A)</enum><text>prominently
				disclose the availability of any charity care coverage (or the equivalent
				thereof), financial assistance, discounts based on income eligibility, or
				public or private insurance coverage that may assist in the payment of all or
				part of the debt; and</text>
								</subparagraph><subparagraph id="idEBEA9267AFAF47239E96B415B96523A8"><enum>(B)</enum><text>provide the
				consumer with information regarding how to apply for such programs; and</text>
								</subparagraph></paragraph><paragraph id="ide50eb4f66dfd4d8a96fab38c183ba436"><enum>(2)</enum><text>in the initial
				oral communication to the consumer—</text>
								<subparagraph id="id26ED10F877E446C7ADE5A130B62EC8B9"><enum>(A)</enum><text>orally disclose
				the availability of any charity care coverage (or the equivalent thereof),
				financial assistance, discounts based on income eligibility, or public or
				private insurance coverage that may assist in the payment of all or part of the
				debt; and</text>
								</subparagraph><subparagraph id="id8AF474FD67D84CD3AD89C2A014A2A912"><enum>(B)</enum><text>provide the
				consumer with information regarding how to apply for such programs.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="id65735C27967E48429AF27C8D4CB8A758"><enum>(c)</enum><header>Definition</header><text>For
				purposes of this section, the term <term>medical debt</term> means debt arising
				from the receipt of medical services, products, or
				devices.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id2F898560A5D84E33A0AEAC6D0ACE72AC"><enum>4.</enum><header>Dispute
			 investigations and verification</header><text display-inline="no-display-inline">Section 809(b) of the Fair Debt Collection
			 Practices Act (15 U.S.C. 1692g(b)) is amended—</text>
			<paragraph id="id7A5C26B00FE54674A16B15F922FA3DBE"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after <quote>(b)</quote> the
			 following: “<header-in-text level="subsection" style="OLC">Disputed
			 debts</header-in-text>.—</text>
				<quoted-block display-inline="no-display-inline" id="id98129AB509474BC08293B1E901195877" style="OLC">
					<paragraph id="id6B0BE11E0FA247B2B14220C244A6A60A"><enum>(1)</enum><header>In
				general</header>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id68A707A0B14C46FC86EF0DE3A759058C"><enum>(2)</enum><text>by striking
			 <quote>Collection activities</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id26C3AD3FD528491EB127C4A4D46C9BF0" style="OLC">
					<paragraph id="idEDCD59629F5D474A9D6E190419A97E6F"><enum>(2)</enum><header>Reasonable
				investigation and verification required</header><text>Upon receipt of a
				notification under paragraph (1) that a debt is disputed by the consumer, the
				debt collector shall undertake a thorough investigation of the substance of the
				dispute, and shall timely provide to the consumer specific responsive
				information and verification of the disputed debt.</text>
					</paragraph><paragraph id="id2AD6FE053B2D44E2A270E4E479C54870"><enum>(3)</enum><header>Collection

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id18A8C16C99934277AD7CEB270BBA3C70"><enum>5.</enum><header>Award of
			 damages</header>
			<subsection id="idF994F29BCA9B43159081A99F35152BF6"><enum>(a)</enum><header>Additional
			 damages indexed for inflation</header>
				<paragraph id="id70E5D8BB5DBC451BB7A475A2D9A1F98A"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 813 of the
			 Fair Debt Collection Practices Act (15 U.S.C. 1692k) is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC48661F7DC3D4EEAB6DA288293D116B1" style="OLC">
						<subsection id="id11BFA050A71D484684D116F9B7DA2546"><enum>(f)</enum><header>Adjustment for
				inflation</header>
							<paragraph id="id1DB0CF89A40F4BC1BC4F8C5FAED3549B"><enum>(1)</enum><header>Initial
				adjustment</header><text>Not later than 90 days after the date of the enactment
				of this subsection, the Bureau shall provide a percentage increase (rounded to
				the nearest multiple of $100 or $1,000, as applicable) in the amounts set forth
				in such section equal to the percentage by which—</text>
								<subparagraph id="id0BAFFB6B194746B79B48CFA9CFA9F575"><enum>(A)</enum><text>the Consumer
				Price Index for All Urban Consumers (all items, United States city average) for
				the 12-month period ending on the June 30 preceding the date on which the
				percentage increase is provided, exceeds</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45CD6DC9C06E42C08E98280C77AB20AF"><enum>(B)</enum><text>the Consumer
				Price Index for the 12-month period preceding January 1, 1978.</text>
								</subparagraph></paragraph><paragraph id="idBC9AE2CF5BE249FCB7F3023E297EF4CA"><enum>(2)</enum><header>Annual
				adjustments</header><text>With respect to any fiscal year beginning after the
				date of the increase provided under paragraph (1), the Bureau shall provide a
				percentage increase (rounded to the nearest multiple of $100 or $1,000, as
				applicable) in the amounts set forth in this section equal to the percentage by
				which—</text>
								<subparagraph id="idC96D9F3BB2454DF59C80FFEA52D49265"><enum>(A)</enum><text>the Consumer
				Price Index for All Urban Consumers (all items, United States city average) for
				the 12-month period ending on the June 30 preceding the beginning of the fiscal
				year for which the increase is made, exceeds</text>
								</subparagraph><subparagraph id="idF32EC650F3A4486694DB46FCB736DECF"><enum>(B)</enum><text>the Consumer
				Price Index for the 12-month period preceding the 12-month period described in
				subparagraph
				(A).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id20A6E4BF44714FFDA6A86C6E55BBD120"><enum>(2)</enum><header>Applicability</header><text>The
			 increases made under section 813(f) of the Fair Debt Collection Practices Act,
			 as added by paragraph (1) of this subsection, shall apply with respect to
			 failures to comply with a provision of such Act (15 U.S.C. 1601 et seq.)
			 occurring on or after the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="idB99D2F60CD6146CEA59A1389D5C40595"><enum>(b)</enum><header>Injunctive
			 relief</header><text>Section 813(d) of the Fair Debt Collection Practices Act
			 (15 U.S.C. 1692k(d)) is amended by adding at the end the following: <quote>In a
			 civil action alleging a violation of this title, the court may award
			 appropriate relief, including injunctive relief.</quote>.</text>
			</subsection></section><section id="id132CD24688DB437E8EE9E136B2BCD759"><enum>6.</enum><header>Warrant for
			 arrest as unfair debt collection practice</header>
			<subsection id="idC3282524DD9F463CBAF786533376A014"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 808 of the
			 Fair Debt Collection Practices Act (15 U.S.C. 1692f) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id26775FAF39754938A4739D27C9EDD20B" style="OLC">
					<paragraph id="idD338DAC594324F73A86909E15FA595DB"><enum>(11)</enum><text>A request by a
				debt collector to a court or any law enforcement agency for the issuance of a
				warrant for the arrest of a debtor or any other similar request that a debt
				collector knows or should know would lead to the issuance of an arrest warrant,
				in relation to collection of a
				debt.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id7517D1DEDC564E4A948517BA4345D7F4"><enum>(b)</enum><header>Construction</header><text>Paragraph
			 (11) of section 808 of the Fair Debt Collection Practices Act, as added by
			 subsection (a), shall not be construed to limit the inherent authority of a
			 court to hold a debtor in civil contempt, nor to limit the ability of a debt
			 collector to seek a writ of execution or similar remedy to take possession of
			 property in order to satisfy a valid judgment of debt.</text>
