		<section id="idD378DADE6D934CFCAC11CC49CB791BFC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Strengthening Our Commitment to Legal
			 Immigration and America’s Security Act</short-title></quote>.</text>
		</section><section id="id60FB460F31A64D299CE0E45F3BCC6B0A" section-type="subsequent-section"><enum>2.</enum><header>Deferred action and
			 parole</header><text display-inline="no-display-inline">Section 212(d)(5) of
			 the Immigration and Nationality Act (8 U.S.C. 1182(d)(5)) is amended by adding
			 at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id835A7EBC46094CECB216CF521A897533" style="OLC">
				<subparagraph id="idD6D37CE21F5F4AB4AEEB30B72B2D72D0" indent="up2"><enum>(C)</enum><text>Notwithstanding any other provision
				of law, an alien may only be paroled into the United States or granted deferred
				action of a final order of removal on a case-by-case basis for urgent
				humanitarian reasons or significant public
				benefit.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF0DDCB110D734A5486C5D8EB23094E09"><enum>3.</enum><header>State Criminal
			 Alien Assistance Program</header><text display-inline="no-display-inline">Section 241(i) of the Immigration and
			 Nationality Act (8 U.S.C. 1231(i)) is amended—</text>
			<paragraph id="idCE0E31D9E2A449238844A2EF56A4F74B"><enum>(1)</enum><text>by redesignating
			 paragraphs (5) and (6) as paragraphs (6) and (7), respectively;</text>
			</paragraph><paragraph id="id8F1EF79CCD064FEF86E8C62C1EDAEF91"><enum>(2)</enum><text>in paragraph (7),
			 as redesignated, by striking <quote>paragraph (5)</quote> and inserting
			 <quote>paragraph (6)</quote>; and</text>
			</paragraph><paragraph id="idF8CA0E1EE1E24B34B8E6E9CB3F836DFB"><enum>(3)</enum><text>by inserting
			 after paragraph (4) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE5158C512F0B45DAAFC0D03B0D1BC327" style="OLC">
					<paragraph id="id8D9A19732F8B4428A3682B7EDEFCA6A3"><enum>(5)</enum><text>A State or local
				law enforcement agency, detention center, or correction facility selected and
				enrolled in the Secure Communities Program or selected and enrolled to perform
				immigration law enforcement functions pursuant to section 287(g) and
				subsequently fails to fully comply with the requirements of such programs may
				not be reimbursed for incarceration expenses under this
				subsection.</text>
					</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</paragraph></section><section id="id8ADA8C9EB3C14E3FB894EC1B74433AC3"><enum>4.</enum><header>Visa
			 reform</header>
			<subsection id="id3C982F3AFDA74B5DAD7DACC68E6496D2"><enum>(a)</enum><header>Visa
			 ineligibility for organized crime members</header><text>Section 212(a)(2) of
			 the Immigration and Nationality Act (8 U.S.C. 1182(a)(2)) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA9AE5087FBF5491CA5F6ECA7B4620CB2" style="OLC">
					<subparagraph id="IDef4f13989b00436a8f18e92234f0ea13"><enum>(J)</enum><header>Aliens engaged
				in organized crime</header><text>Any alien who the consular officer or the
				Attorney General knows, or has reason to believe, is a member of a known
				criminal organization that regularly engages in transnational criminal
				activity, is
				inadmissible.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id915ECB930E3B4C10A259052CF7EFD988"><enum>(b)</enum><header>Exit procedures
			 for foreign visitors</header><text>Not later than 120 days after the date of
			 the enactment of this Act, the Secretary of Homeland Security, in coordination
			 with the Secretary of State and the aviation industry, as appropriate, shall
			 create a mandatory exit procedure for foreign visitors, based upon—</text>
				<paragraph id="id161E1E7DE81246EFA088C0450F3001E3"><enum>(1)</enum><text>the results of
			 the programs piloted by United States Customs and Border Protection to track
			 the departure of foreign visitors, including US–VISIT; and</text>
				</paragraph><paragraph id="idC9AC324064E84B36A967100F8356FE49"><enum>(2)</enum><text>the feasibility
			 and benefits of the departure confirmation systems tested under such exit pilot
			 programs.</text>
				</paragraph></subsection><subsection id="idE872347510CC4387A8AB1753F8608E15"><enum>(c)</enum><header>Elimination of
			 Diversity Visa Program</header>
				<paragraph id="id5B8DF57878424BC69E532431273B4391"><enum>(1)</enum><header>In
			 general</header><text>Section 203 of the Immigration and Nationality Act (8
			 U.S.C. 1153) is amended by striking subsection (c).</text>
				</paragraph><paragraph id="idF54281F82E474654BCB6D5B24FAEC91B"><enum>(2)</enum><header>Technical and
			 conforming amendments</header><text>Title II of the Immigration and Nationality
			 Act (8 U.S.C. 1151) is amended—</text>
					<subparagraph id="idA30465446EB24C7F920C70CBB2972FD6"><enum>(A)</enum><text>in section
			 201—</text>
						<clause id="ID368b84ecf4604acab53c08906588e910"><enum>(i)</enum><text>in
			 subsection (a)—</text>
							<subclause id="ID01f8a0574ad34595b7b980b7b5e1ff46"><enum>(I)</enum><text>in paragraph (1),
			 by adding <quote>and</quote> at the end; and</text>
							</subclause><subclause id="ID328ecd0b9d2b4b3b98d90ce82b90101f"><enum>(II)</enum><text>in paragraph
			 (2), by striking <quote>; and</quote> at the end and inserting a period;
			 and</text>

			 204(a)(1), is amended by striking subparagraph (I).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id465029934A28459E9AF4A48A2B1C631F"><enum>(3)</enum><header>Report</header><text>Not
			 later than 60 days after the date of the enactment of this Act, the Secretary
			 of State shall submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>
			 and the <committee-name committee-id="">Committee on the Judiciary of the House
			 of Representatives</committee-name> that includes recommended changes to the
			 Diversity Visa Program to combat fraud and eliminate abuse.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB6F633DA8F245359320D5BFD211816F"><enum>(4)</enum><header>Sense of
			 congress</header><text>It is the sense of Congress that the Diversity Visa
			 Program will be discontinued as of the effective date set forth in paragraph
			 (5) unless Congress enacts legislation to authorize the continuation of the
			 Diversity Visa Program with appropriate changes to reduce fraud and
			 abuse.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id05DEB69674CD450996EF28982E17D336"><enum>(5)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall become
			 effective on the first day of the first fiscal year beginning on or after the
			 date that is 120 days after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="idF612BABA8B094E6EA530A9498ACDF039"><enum>5.</enum><header>Annual
			 accountability of Federal welfare benefits received by aliens unlawfully
			 present in the United States</header><text display-inline="no-display-inline">The Secretary of Health and Human Services,
			 in consultation with the Secretary of Homeland Security and the head of any
			 other appropriate Federal agency, shall submit to Congress an annual report
			 that includes, for each State (and including the District of Columbia)—</text>
			<paragraph id="IDa07ce4dae0bb4cee94febfca01960224"><enum>(1)</enum><text>the total amount
			 of Federal welfare benefits provided to such State during the most recent
			 fiscal year, disaggregated by State; and</text>
			</paragraph><paragraph id="IDc0386c7a1db44b98b2b7e2a2871dadf7"><enum>(2)</enum><text>the total amount
			 of Federal welfare benefits provided to households with any persons who resided
			 in the United States illegally during the most recent fiscal year.</text>
			</paragraph></section><section id="id9C4C876057914B27800DF8C331874BAF"><enum>6.</enum><header>Limitation on
			 State option to expand CHIP coverage to noncitizen children or noncitizen
			 pregnant women</header><text display-inline="no-display-inline">Section 2107 of
			 the Social Security Act (42 U.S.C. 1397gg) is amended—</text>
			<paragraph id="idC23C92212D4A4B689D5ACC76F9480616"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (e)(1)(J), by inserting
			 <quote>and only if the State satisfies the requirements described in subsection
			 (g)</quote> before the period at the end; and</text>
			</paragraph><paragraph id="id8D4F49956DCD424C86E3FE4D71012095"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA1B491B7DFFC483F9423040B1C37DC99" style="OLC">
					<subsection id="idE40A9F0DC6124AFD8B826B0AD2AE4B0F"><enum>(g)</enum><header>Demonstration
				of coverage and maintenance of effort</header><text>For purposes of subsection
				(e)(1)(J), the requirements described in this subsection are the
				following:</text>
						<paragraph id="idE614785210724B038E575771276D3E5F"><enum>(1)</enum><text>The State
				demonstrates to the Secretary (on the basis of the best data reasonably
				available to the Secretary and in accordance with such techniques for sampling
				and estimating as the Secretary determines appropriate) that the State has
				enrolled in the State plan under title XIX, the State child health plan under
				this title, or under a waiver of either such plan, at least 90 percent of the
				children residing in the State who are citizens or nationals of the United
				States, whose family income does not exceed 200 percent of the poverty line (as
				determined before January 1, 2014, without regard to the application of any
				general exclusion or disregard of a block of income that is not determined by
				type of expense or type of income, and as determined on or after January 1,
				2014, in accordance with section 1902(e)(14)), and who are eligible for medical
				assistance under the State plan under title XIX or child health assistance
				under the State child health plan under this title.</text>
						</paragraph><paragraph id="id5E79CD47F2B048FD8C4231083592E5B3"><enum>(2)</enum><text>The State
				provides assurances that the amount of State or other non-Federal funds
				expended annually by the State to provide medical assistance, child health
				assistance, or other health benefits coverage to lawfully residing immigrant
				children or lawfully residing immigrant pregnant women will not be less than
				the amount of such funds expended for such purposes for fiscal year
				2009.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id6432C8820E7547468A5894FA6885CBC1"><enum>7.</enum><header>Identity
			 theft</header>
			<subsection commented="no" id="id51C58025450F442AB1235B654E9FA882"><enum>(a)</enum><header>Amendments to
			 the criminal code</header><text>Chapter 47 of title 18, United States Code, is
			 amended—</text>
				<paragraph commented="no" id="idBC778E70E1D84F31BA8913AECD8AACB5"><enum>(1)</enum><text>in section
			 1028—</text>
					<subparagraph commented="no" id="idB3A13DE32B09465590F32E0EFF27F52B"><enum>(A)</enum><text>in subsection
			 (a)(7), by striking <quote>of another person</quote> and inserting <quote>other
			 than his or her own</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="id13860B488B58411688B3D037E5FEE0BF"><enum>(B)</enum><text>in subsection
			 (b)(3)—</text>
						<clause commented="no" id="id4DB030ACB6CB453D88096A4025123EA8"><enum>(i)</enum><text>in subparagraph
			 (B), by striking <quote>or</quote> at the end;</text>
						</clause><clause commented="no" id="id690209405D7C401D991555FF9EEBDF61"><enum>(ii)</enum><text>in subparagraph
			 (C), by adding <quote>or</quote> at the end; and</text>
						</clause><clause commented="no" id="idBA094E7D0F3F41D082AB2BA4693C947E"><enum>(iii)</enum><text>by adding at
			 the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id24BC11F24A2E44E991689045B7011469" style="OLC">
								<subparagraph commented="no" id="id9CF2EF2E1EBA46A2A4F8315381C9BE0D"><enum>(C)</enum><text>to facilitate or
				assist in harboring or hiring unauthorized workers in violation of section 274,
				274A or 274C of the Immigration and Nationality Act (8 U.S.C. 1324, 1324a, and
				1324c)</text>
								</subparagraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph></subsection><subsection id="ID396161d975a1417180e1fe31f51c8a42"><enum>(b)</enum><header>IRS
			 notification requirement</header>
				<paragraph id="IDb8d9b888212d4a6eba7a6c569bbe505a"><enum>(1)</enum><header>Requirement to
			 notify Social Security account number holders</header><text>If the Commissioner
			 of Internal Revenue sends a notice to an employer that an inaccurate Social
			 Security account number has been discovered for an employee and the employer
			 does not respond to the notice within 60 days to correct such account number,
			 the Commissioner shall send such a notice—</text>
					<subparagraph id="idFDC3FD746AB14BD7A38FEE50D3A7A22D"><enum>(A)</enum><text>to the individual
			 who was originally issued such Social Security account number; or</text>
					</subparagraph><subparagraph id="id05708D4656A14E9E8AE3134B89A50B56"><enum>(B)</enum><text>if such
			 individual is a minor, to the individual's legal guardian.</text>
					</subparagraph></paragraph><paragraph id="ID33a3567e82404530a230fcf01c9a49e3"><enum>(2)</enum><header>Content of
			 notice</header><text>A notice sent to an individual under paragraph (1) shall
			 include the following:</text>
					<subparagraph id="idE2AB5DC44B3B4F5297A2ABE2F7446E01"><enum>(A)</enum><text>A request that
			 the individual respond to such notice within 60 days to correct the information
			 associated with the Social Security account number.</text>
					</subparagraph><subparagraph id="idE2834432BEBA43D499055B4BD09A59CA"><enum>(B)</enum><text>Information on
			 how to respond to the notice.</text>
					</subparagraph><subparagraph id="id21656D35066F41318A5539C79934DB20"><enum>(C)</enum><text>Notification that
			 if a response is not received by the Commissioner within 60 days, the
			 Commissioner shall provide notice of the inaccurate Social Security account
			 number to the appropriate agencies for possible investigation, including the
			 Department of Homeland Security, the Department of Justice, and the Federal
			 Trade Commission.</text>
					</subparagraph><subparagraph id="ID53c1141f2e284d98addcf5fbcbbd0fed"><enum>(D)</enum><text>Notification—</text>
						<clause id="id053F301A90EA4EBBBEB1B875913347C8"><enum>(i)</enum><text>that if the
			 individual suspects that the individual's Social Security account number may
			 have been used fraudulently, the individual should notify the Federal Trade
			 Commission and the various credit bureaus; and</text>
						</clause><clause id="id55321CC1BE66424E98042D765F90DE86"><enum>(ii)</enum><text>information on
			 how to provide the notifications described in clause (i).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idB1054E8437C14833B4884F493FCCD717"><enum>(c)</enum><header>Study and
			 report</header>
				<paragraph id="idB764F05210154BF3AD64CA2ECC9DF253"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of the Treasury, the Chairman of the
			 Federal Trade Commission, and the Commissioner of Social Security, in
			 consultation with the Secretary of Commerce and other appropriate Federal
			 officials, shall conduct a study to determine the most feasible and cost
			 effective ways to protect the credit worthiness of individuals, especially
			 children.</text>
				</paragraph><paragraph id="id8672C3F956B14D2D94524F335BBA1E80"><enum>(2)</enum><header>Issues to be
			 studied</header><text>The study conducted under paragraph (1) shall—</text>
					<subparagraph id="IDe5107afc780440b689b719fc04247b1f"><enum>(A)</enum><text>assess the types
			 of data held by the Federal Government and the private sector that could prove
			 beneficial in protecting and verifying identity;</text>
					</subparagraph><subparagraph id="IDb5f26017c69f4196ad854c065dc198f2"><enum>(B)</enum><text>assess current
			 government and industry practices designed to protect personal privacy and
			 determine how such practices could be improved to protect and verify
			 individuals’ credit worthiness;</text>
					</subparagraph><subparagraph id="ID418f401781e5482fa3b915cbf7da2e78"><enum>(C)</enum><text>analyze the
			 estimated impact of alternative systems of achieving effective protection of
			 credit on the financial industry (including small banks, rural financial
			 institutions, and credit unions), consumers, and the government with respect
			 to—</text>
						<clause id="id9CBA20FFEE8D45DC87A0551495922F49"><enum>(i)</enum><text>costs;</text>
						</clause><clause id="idE0108B6122314FC2BFE350BEB0E30B28"><enum>(ii)</enum><text>credit
			 availability;</text>
						</clause><clause id="id9290E7D13FF84EC8AC1A6AC3EE230D82"><enum>(iii)</enum><text>convenience;</text>
						</clause><clause id="id91FDF1301CB449DAAABAE748F78CBCD4"><enum>(iv)</enum><text>privacy;
			 and</text>
						</clause><clause id="id7D3C486D586A4B7E89E6F0ECF5738D39"><enum>(v)</enum><text>other
			 nonfinancial burdens, including any effects on personal privacy; and</text>
						</clause></subparagraph><subparagraph id="id7F9D0E6028C24841B0A9902A22B6435E"><enum>(D)</enum><text>determine the
			 most effective ways to protect and verify credit information.</text>
					</subparagraph></paragraph><paragraph id="idE582BDF3765244A388DF3E90681C9DDF"><enum>(3)</enum><header>Participation</header><text>Representatives
			 of the financial industry, members of the public, government agencies, and
			 other interested groups shall be given opportunities to provide information for
			 the study conducted under paragraph (1).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF7D07D9F53EA4E639871712DFED96A51"><enum>(4)</enum><header>Report</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Secretary of
			 the Treasury shall submit a report containing the results of the study
			 conducted under paragraph (1), including any recommendations for legislative or
			 administrative actions, to the <committee-name committee-id="SSFI00">Committee
			 on Finance of the Senate</committee-name> and the
			 <committee-name committee-id="">Committee on Ways and Means of the House of
			 Representatives</committee-name>.</text>
				</paragraph></subsection></section><section id="id77264EE1F7AA43C581D5FA82CA0A8C60"><enum>8.</enum><header>Enhanced
			 penalties for certain drug offenses on Federal lands</header>
			<subsection id="ID8b1db721c94944ad969604f45fe51800"><enum>(a)</enum><header>Cultivating or
			 manufacturing controlled substances on Federal property</header><text>Section
			 401(b)(5) of the Controlled Substances Act (21 U.S.C. 841(b)(5)) is amended by
			 striking <quote>as provided in this subsection</quote> and inserting <quote>for
			 not more than 10 years, in addition to any other term of imprisonment imposed
			 under this subsection,</quote>.</text>
			</subsection><subsection id="ID4ed6d27145984d6fb9b06d7061737eb2"><enum>(b)</enum><header>Use of
			 hazardous substances</header><text>Pursuant to its authority under section 994
			 of title 28, United States Code, the United States Sentencing Commission shall
			 amend the Federal Sentencing Guidelines and policy statements to ensure that
			 the guidelines provide an additional penalty increase of 2 offense levels above
			 the sentence otherwise applicable for a violation of section 401(a) of the
			 Controlled Substances Act (21 U.S.C. 841(a)) if the offense—</text>
				<paragraph id="id1E66E97748C24C7E8E01BE9AFFDE8196"><enum>(1)</enum><text>includes the use
			 of a poison, chemical, or other hazardous substance to cultivate or manufacture
			 controlled substances on Federal property;</text>
				</paragraph><paragraph id="id16468AF9B1C3419CA932254CADD07454"><enum>(2)</enum><text>creates a hazard
			 to humans, wildlife, or domestic animals;</text>
				</paragraph><paragraph id="id09CED5EE39794D3588D3990C9D20FAC7"><enum>(3)</enum><text>degrades or harms
			 the environment or natural resources; or</text>
				</paragraph><paragraph id="id3103DE9B0A8D4E55BD2132F82A595CF0"><enum>(4)</enum><text>pollutes an
			 aquifer, spring, stream, river, or body of water.</text>
				</paragraph></subsection><subsection id="IDd58d1e2667dc4c38bcc28b3cbc924796"><enum>(c)</enum><header>Stream
			 diversion or clear cutting on Federal property</header>
				<paragraph id="idC93A0F7058394CAD98D3EBBB53B42714"><enum>(1)</enum><header>Prohibition on
			 stream diversion or clear cutting on federal property</header><text>Section
			 401(b) of the Controlled Substances Act (21 U.S.C. 841(b)) is amended by adding
			 at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id3FB756F2CCED4E528CAEC9B6B5B8B087" style="OLC">
						<paragraph id="idCC010895FFFA47A4A2AB955806F44F97"><enum>(8)</enum><header>Destruction of
				bodies of water</header><text>Any person who violates subsection (a) in a
				manner that diverts, redirects, obstructs, or drains an aquifer, spring,
				stream, river, or body of water or clear cuts timber while cultivating or
				manufacturing a controlled substance on Federal property shall be fined in
				accordance with title 18, United States
				Code.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idF038EEECA0C34D67BD29AEB76ED2F191"><enum>(2)</enum><header>Federal
			 sentencing guidelines enhancement</header><text>Pursuant to its authority under
			 section 994 of title 28, United States Code, the United States Sentencing
			 Commission shall amend the Federal Sentencing Guidelines and policy statements
			 to ensure that the guidelines provide an additional penalty increase of 2
			 offense levels for above the sentence otherwise applicable for a violation of
			 section 401(a) of the Controlled Substances Act (21 U.S.C. 841(a)) if the
			 offense involves the diversion, redirection, obstruction, or draining of an
			 aquifer, spring, stream, river, or body of water or the clear cut of timber
			 while cultivating or manufacturing a controlled substance on Federal
			 property.</text>
				</paragraph></subsection><subsection id="ID31f189ae06874a71a22a09af6ca5e247"><enum>(d)</enum><header>Booby traps on
			 Federal land</header><text>Section 401(d)(1) of the Controlled Substances Act
			 (21 U.S.C. 841(d)(1)) is amended by inserting <quote>cultivated,</quote> after
			 <quote>is being</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID607f934fe57241e0a46a1c4ebf99c5f4"><enum>(e)</enum><header>Use or
			 possession of firearms in connection with drug offenses on Federal
			 lands</header><text>Pursuant to its authority under section 994 of title 28,
			 United States Code, the United States Sentencing Commission shall amend the
			 Federal Sentencing Guidelines and policy statements to ensure that the
			 guidelines provide an additional penalty increase of 2 offense levels above the
			 sentence otherwise applicable for a violation of section 401(a) of the
			 Controlled Substances Act (21 U.S.C. 841(a)) if the offense involves the
			 possession of a firearm while cultivating or manufacturing controlled
			 substances on Federal lands.</text>
			</subsection></section><section id="id58FCDAFA2696490E959B5670160D6D9E"><enum>9.</enum><header>Federal Lands
			 Counterdrug Action Plan</header>
			<subsection id="idE9747DDC84934B1086872FE29C967217"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id31B43B0AFBCD44718A1C808F1E671825"><enum>(1)</enum><header>Controlled
			 substance</header><text>The term <term>controlled substance</term> has the
			 meaning given the term in section 102 of the Controlled Substances Act (21
			 U.S.C. 802).</text>
				</paragraph><paragraph id="idAB8E9FFFC55A4272833C892DD7394102"><enum>(2)</enum><header>Covered
			 lands</header><text>The term <term>covered lands</term> means—</text>
					<subparagraph id="id5C359EC430564F6784B1EEC3A4C8FAA0"><enum>(A)</enum><text>units of the
			 National Park System;</text>
					</subparagraph><subparagraph id="idDDCACDD6BA9D494FB4C60BEB86D1F118"><enum>(B)</enum><text>National Forest
			 System land;</text>
					</subparagraph><subparagraph id="idCF084BF0C63D4341AD9C5E1DFEAE34F3"><enum>(C)</enum><text>public lands (as
			 defined by section 103(e) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1702(e)); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9752A504C75C410DA580CF903778174D"><enum>(D)</enum><text>all land
			 administered by the Bureau of Land Management.</text>
					</subparagraph></paragraph></subsection><subsection id="id37FCA906F9F14A5E9E4C7822E38117AB"><enum>(b)</enum><header>Implementation
			 of Federal Lands Counterdrug Action Plan</header>
				<paragraph id="idFD49B70BFB0F4BD18873045E2D8BCF98"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="idB74C62B94B5D48E38DD145564BF58EE3"><enum>(A)</enum><header>Requirement for
			 action plan</header><text>Not later than 90 days after the date of the
			 enactment of this Act, the Director of National Drug Control Policy shall
			 implement an action plan for keeping controlled substances off of Federal lands
			 (referred to in this section as the <term>Federal Lands Counterdrug Action
			 Plan</term>).</text>
					</subparagraph><subparagraph id="idC7BF7C5CB2444F23A3E05A54B6ACDAA1"><enum>(B)</enum><header>Report to
			 Congress</header><text>Not later than 2 years after the implementation of the
			 Federal Lands Counterdrug Action Plan, the Director shall submit a report to
			 Congress that describes the progress made in carrying out such Action
			 Plan.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9d8b6c789ae94370a2da46dd5a485f29"><enum>(2)</enum><header>Consultation
			 requirement</header><text>In implementing the Federal Lands Counterdrug Action
			 Plan, the Director of National Drug Control Policy shall consult with the heads
			 of relevant Federal agencies, including the Drug Enforcement Administration,
			 the Forest Service, the National Park Service, the Bureau of Land Management,
			 and any relevant State, local, and tribal law enforcement agencies.</text>
				</paragraph></subsection><subsection id="id06A0EE812C904E8095EBF959F1E60A5C"><enum>(c)</enum><header>Contents</header><text>The
			 Federal Lands Counterdrug Action Plan shall include—</text>
				<paragraph id="ID6c1e2acc7be64dafa101e7b01ac62955"><enum>(1)</enum><text>the Federal
			 Government’s action plan for preventing the illegal production, cultivation,
			 manufacture, and trafficking of controlled substances on covered lands;</text>
				</paragraph><paragraph id="id5E147CB5C9004B4CADBA4FF738C158DC"><enum>(2)</enum><text>the specific
			 roles of relevant Federal agencies, including the Drug Enforcement
			 Administration and relevant agencies within the Department of the Interior for
			 implementing such an action plan;</text>
				</paragraph><paragraph id="idE8BE4B358D6C48FAADB56CDCCD9DB3BC"><enum>(3)</enum><text>the specific
			 resources required to enable the agencies referred to in paragraph (2) to
			 implement that strategy;</text>
				</paragraph><paragraph id="IDe698769f171a4ee2854e27be4a310cd3"><enum>(4)</enum><text>a strategy to
			 reduce the cultivation and trafficking of marijuana on covered lands by Mexican
			 drug trafficking organizations;</text>
				</paragraph><paragraph id="idEE895A4D287E43E6A02742EBC900A835"><enum>(5)</enum><text>the use of
			 available technology to reduce the cultivation and trafficking of marijuana on
			 covered lands;</text>
				</paragraph><paragraph id="id92A6121589CF4DD9B7F7F5EDBEB74639"><enum>(6)</enum><text>the impact of
			 Federal land management statutes on law enforcement efforts; and</text>
				</paragraph><paragraph id="id85EE302447B041F1A7E1852368F111DC"><enum>(7)</enum><text>the costs
			 associated with marijuana eradication programs through high intensity drug
			 trafficking areas.</text>
				</paragraph></subsection><subsection id="idE49FE95A32244EEF95F9457FF820D486"><enum>(d)</enum><header>Effect on
			 existing law</header><text>The Federal Lands Counterdrug Action Plan—</text>
				<paragraph id="idACDB91E7F2354673B12A07923CB5A8B2"><enum>(1)</enum><text>may not change
			 existing agency authorities or laws governing interagency relationships;
			 and</text>
				</paragraph><paragraph id="idC000A9CC78CC494AAE9D87AC2B7A8EB9"><enum>(2)</enum><text>may provide
			 recommendations for changes to such authorities or laws.</text>
				</paragraph></subsection><subsection id="ID9f24a59967a74a85a8aab5f4f266fda7"><enum>(e)</enum><header>Distribution</header>
				<paragraph id="idC3DAC1483EAD40688FD806B1C8B01B2B"><enum>(1)</enum><header>In
			 general</header><text>The Director of the Office of National Drug Control
			 Policy shall provide a copy of the Federal Lands Counterdrug Action Plan
			 to—</text>
					<subparagraph id="id5A2D98565AE14584A3891C01FB163094"><enum>(A)</enum><text>the
			 <committee-name committee-id="SSJU00">Committee on the Judiciary of the
			 Senate;</committee-name></text>
					</subparagraph><subparagraph id="idC24F481D645943A390C5982F95171A19"><enum>(B)</enum><text>the
			 <committee-name committee-id="SSAP00">Committee on Appropriations of the
			 Senate;</committee-name></text>
					</subparagraph><subparagraph id="id3DA2389070D14D46A3BEC9A44656EEBB"><enum>(C)</enum><text>the
			 <committee-name committee-id="SSGA00">Committee on Homeland Security and
			 Governmental Affairs of the Senate;</committee-name></text>
					</subparagraph><subparagraph id="idAB88CD7AC13345AD9DF23AEED752D964"><enum>(D)</enum><text>the United States
			 Senate Caucus on International Narcotics Control;</text>
					</subparagraph><subparagraph id="id95F05F96DF0D43C38016133B7F7E3628"><enum>(E)</enum><text>the
			 <committee-name committee-id="">Committee on the Judiciary of the House of
			 Representatives</committee-name>;</text>
					</subparagraph><subparagraph id="idE5ABDF3777514153B0C347C8EE0F3727"><enum>(F)</enum><text>the
			 <committee-name committee-id="">Committee on Appropriations of the House of
			 Representatives</committee-name>; and</text>
					</subparagraph><subparagraph id="idB5D7F35298E544058D0C4AC0B612C675"><enum>(G)</enum><text>the
			 <committee-name committee-id="">Committee on Homeland Security of the House of
			 Representatives</committee-name>.</text>
					</subparagraph></paragraph><paragraph id="id8621BFB139DA4237ACC48A02700A1BBA"><enum>(2)</enum><header>Classified
			 information</header><text>Any classified or law enforcement sensitive
			 information contained in the Federal Lands Counterdrug Action Plan may be
			 submitted in a classified annex to accompany the Action Plan.</text>
