		<official-title>To amend the Servicemembers Civil Relief Act to improve
		  the protections for servicemembers against mortgage foreclosures, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Military Family Home Protection
			 Act</short-title></quote>.</text>
		</section><section id="H624D850E3DDC45D3BB330C25265124F4" section-type="subsequent-section"><enum>2.</enum><header>Mortgage protection
			 for members of the Armed Forces, surviving spouses, and certain
			 veterans</header>
			<subsection id="H772A1D7E924A48C4891741F20B443D69"><enum>(a)</enum><header>Mortgage
			 protection</header>
				<paragraph id="H524F63CD685E4CEC95ED959E8F30B9CF"><enum>(1)</enum><header>In
			 general</header><text>Section 303 of the Servicemembers Civil Relief Act (50
			 U.S.C. App. 533) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HFF48DD81B53D42F0ABE6496CEC92FB81" style="OLC">
						<section id="H6E30544A6EB04EEBB31DFAA9001B5DC9"><enum>303.</enum><header>Mortgages and
				trust deeds</header>
							<subsection id="HEA4EEDEC92624BA0AC03F7BD03837E65"><enum>(a)</enum><header>Mortgage as
				Security</header><text display-inline="yes-display-inline">This section applies
				only to an obligation on real or personal property that is secured by a
				mortgage, trust deed, or other security in the nature of a mortgage and is
				owned by a covered individual as follows:</text>
								<paragraph id="H35AB6393BC6546F48E6264401A536C63"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to an obligation on real or
				personal property owned by a servicemember, such obligation that originated
				before the period of the servicemember's military service and for which the
				servicemember is still obligated.</text>
								</paragraph><paragraph id="HC044CA0898704EA4BF644D08DA852DA4"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to an obligation on real
				property owned by a servicemember serving in support of a contingency operation
				(as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(13)</external-xref> of title 10,
				United States Code), such obligation that originated at any time and for which
				the servicemember is still obligated.</text>
								</paragraph><paragraph id="H7FB16EB33EAD4ABE99AB686E9E4EE12D"><enum>(3)</enum><text display-inline="yes-display-inline">With respect to an obligation on real
				property owned by a veteran described in subsection (f)(1)(B), such obligation
				that originated at any time and for which the veteran is still
				obligated.</text>
								</paragraph><paragraph id="HB2AFDB56584C4D62A84401EB191B6721"><enum>(4)</enum><text display-inline="yes-display-inline">With respect to an obligation on real
				property owned by a surviving spouse described in subsection (f)(1)(C), such
				obligation that originated at any time and for which the spouse is still
				obligated.</text>
								</paragraph></subsection><subsection id="HD3A92E5DBD58407BAB64DCEEDD24B076"><enum>(b)</enum><header>Stay of
				Proceedings and Adjustment of Obligation</header><paragraph commented="no" display-inline="yes-display-inline" id="H6D9D13D479574DB08A9DBC05071A6719"><enum>(1)</enum><text>In an action filed
				during a covered time period to enforce an obligation described in subsection
				(a), the court may after a hearing and on its own motion and shall upon
				application by a covered individual when the individual’s ability to comply
				with the obligation is materially affected by military service—</text>
									<subparagraph id="H0493A3A75D4C451CB3A9AC6A669355F6" indent="up1"><enum>(A)</enum><text>stay the proceedings for a period of
				time as justice and equity require; or</text>
									</subparagraph><subparagraph id="H6233E8A2CEC2480DA135FAB1C2725842" indent="up1"><enum>(B)</enum><text>adjust the obligation to preserve the
				interests of all parties.</text>
									</subparagraph></paragraph><paragraph id="H1A01DF2BD6CE4A16B5192C896885C7AF" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of applying paragraph (1) to a
				covered individual who is a surviving spouse of a servicemember described in
				subsection (f)(1)(C), the term <term>military service</term> means the service
				of such servicemember.</text>
								</paragraph></subsection><subsection id="H0ABBE403009D41A5AB6CC22AF9066AEF"><enum>(c)</enum><header>Sale or
				Foreclosure</header><text>A sale, foreclosure, or seizure of property for a
				breach of an obligation described in subsection (a) shall not be valid during a
				covered time period except—</text>
								<paragraph id="H2BB12E51E3EE4B44A846200837471A1A"><enum>(1)</enum><text>upon a court order
				granted before such sale, foreclosure, or seizure with a return made and
				approved by the court; or</text>
								</paragraph><paragraph id="HBD82F8D8E3624FDBB0B488C82D3957B1"><enum>(2)</enum><text>if made pursuant
				to an agreement as provided in section 107.</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="HF7005554E3E5488599640EF87202F0A0"><enum>(d)</enum><header>Misdemeanor</header><text>A
				person who knowingly makes or causes to be made a sale, foreclosure, or seizure
				of property that is prohibited by subsection (c), or who knowingly attempts to
				do so, shall be fined as provided in title 18, United States Code, or
				imprisoned for not more than one year, or both.</text>
							</subsection><subsection commented="no" id="H834A19FE65964B1FB845FB8F5A82755D"><enum>(e)</enum><header>Proof of
				service</header><paragraph commented="no" display-inline="yes-display-inline" id="H4B079A1A56E44650A14CCA3CC1B19461"><enum>(1)</enum><text>A
				veteran described in subsection (f)(1)(B) shall provide documentation described
				in paragraph (2) to relevant persons to prove the eligibility of the veteran to
				be covered under this section.</text>
								</paragraph><paragraph id="HF0513B55FF314954A99507C2B9948C74" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Documentation described in this paragraph
				is a rating decision or a letter from the Department of Veterans Affairs that
				confirms that the veteran is totally disabled because of one or more
				service-connected injuries or service-connected disability conditions.</text>
								</paragraph></subsection><subsection id="H46B23EE457EE490683DC66A92F90A6E8"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph id="HFFB03821CFC845AFBC7E063BC6E5054C"><enum>(1)</enum><text>The term
				<term>covered individual</term> means the following individuals:</text>
									<subparagraph id="H985807C2AA52461AA19D4C4CBD3C57EE"><enum>(A)</enum><text>A
				servicemember.</text>
									</subparagraph><subparagraph id="H69440127F4B040FE8466C88CB1981D4A"><enum>(B)</enum><text display-inline="yes-display-inline">A veteran who was retired under chapter 61
				of title 10, United States Code, and whom the Secretary of Veterans Affairs, at
				the time of such retirement, determines is a totally disabled veteran.</text>
									</subparagraph><subparagraph id="H3C67C78DFCB64C18BCDE5EBB1078D837"><enum>(C)</enum><text display-inline="yes-display-inline">A surviving spouse of a servicemember
				who—</text>
										<clause id="H86C06BCBB22647F7A21C0188558B0905"><enum>(i)</enum><text>died while serving
				in support of a contingency operation if such spouse is the successor in
				interest to property covered under subsection (a); or</text>
										</clause><clause id="HAA94FABBD4EF4C9885C176976EED2C62"><enum>(ii)</enum><text display-inline="yes-display-inline">died while in military service and whose
				death is service-connected if such spouse is the successor in interest to
				property covered under subsection (a).</text>
										</clause></subparagraph></paragraph><paragraph id="HF436DCAB460D4596B0C3599EFDF9E97B"><enum>(2)</enum><text>The term
				<term>covered time period</term> means the following time periods:</text>
									<subparagraph id="H515125EAE08C49778D48E51BC3581F5D"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to a servicemember, during the
				period beginning on the date on which such servicemember begins military
				service and ending on the date that is 12 months after the date on which such
				servicemember is discharged from such service.</text>
									</subparagraph><subparagraph id="H0F0BFE1BE454432B9BD2E51A90EA94EC"><enum>(B)</enum><text display-inline="yes-display-inline">With respect to a servicemember serving in
				support of a contingency operation, during the period beginning on the date of
				the military orders for such service and ending on the date that is 12 months
				after the date on which such servicemember redeploys from such contingency
				operation.</text>
									</subparagraph><subparagraph id="H98E5627725F24E79B4A9A8C1BB7ED01A"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to a veteran described in
				subsection (f)(1)(B), during the 12-month period beginning on the date of the
				retirement of such veteran described in such subsection.</text>
									</subparagraph><subparagraph commented="no" id="HF5F60AEF826A48A59477ED01EA3E4A75"><enum>(D)</enum><text display-inline="yes-display-inline">With respect to a surviving spouse of a
				servicemember described in subsection (f)(1)(C), during the 12-month period
				beginning on the date of the death of the
				servicemember.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4448E3BC8FA648EAACC3A82610C49538"><enum>(2)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 107 of the
			 Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/517">50 U.S.C. App. 517</external-xref>) is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H46BFE35FBA3847D59791FCF6C2008AC3" style="OLC">
						<subsection id="H8C66150BD233406CA81604BB568AC38A"><enum>(e)</enum><header>Other
				individuals</header><text display-inline="yes-display-inline">For purposes of
				this section, the term <term>servicemember</term> includes any covered
				individual under section
				303(f)(1).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H6A8C8714534B4EFEABEFB663F97532EC"><enum>(3)</enum><header>Repeal of
			 sunset</header><text>Subsection (c) of section 2203 of the Housing and Economic
			 Recovery Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/289">Public Law 110–289</external-xref>; 50 U.S.C. App.
			 533 note) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H59F4111190B54A84B58CD272CA40DBCA" style="OLC">
						<subsection commented="no" id="H4A07541D3E794A82910E19317A2B973E"><enum>(c)</enum><header>Effective
				date</header><text>The amendments made by subsection (a) shall take effect on
				the date of the enactment of this
				Act.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA35FC797A1B2488787D51A57BBA9F9E9"><enum>(b)</enum><header>Increased civil
			 penalties for mortgage violations</header><text display-inline="yes-display-inline">Paragraph (3) of section 801(b) of the
			 Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/597">50 U.S.C. App. 597(b)(3)</external-xref>)
			 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H07C50FDEDCA74FB8B33E4EF9D0B16EDF" style="OLC">
					<paragraph id="HBA5F9350069A48849AD4573B030187D8"><enum>(3)</enum><text>to vindicate the
				public interest, assess a civil penalty—</text>
						<subparagraph id="H079CEFD965704802BE435CA4A6743079"><enum>(A)</enum><text>with respect to a
				violation of section 303 regarding real property—</text>
							<clause id="H3AE8ECC2EFDF4A9ABB03D037A63A4C08"><enum>(i)</enum><text>in
				an amount not exceeding $110,000 for a first violation; and</text>
							</clause><clause id="H4FCA8D5A9A3F4EDCA2B5F4FB81A8B43E"><enum>(ii)</enum><text>in an amount not
				exceeding $220,000 for any subsequent violation; and</text>
							</clause></subparagraph><subparagraph id="H8C9B10E3AD814370BA2BAC874A203807"><enum>(B)</enum><text>with respect to
				any other violation of this Act—</text>
							<clause id="H424DFE1A4E214AD899EB7876A111471C"><enum>(i)</enum><text>in
				an amount not exceeding $55,000 for a first violation; and</text>
							</clause><clause id="HC5418968B5D04B12AED3E5602C36538A"><enum>(ii)</enum><text>in an amount not
				exceeding $110,000 for any subsequent
				violation.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H918219D8812F4B10A1485E2683953CB1"><enum>(c)</enum><header>Credit
			 discrimination</header><text display-inline="yes-display-inline">Section 108 of
			 such Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/518">50 U.S.C. App. 518</external-xref>) is
			 amended—</text>
				<paragraph id="H45766677636E4802B151964681EDD61A"><enum>(1)</enum><text>by striking
			 <quote>Application by</quote> and inserting <quote>(a) Application by</quote>;
			 and</text>
				</paragraph><paragraph id="H5155DE148C15409692F0F61025DEBA02"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H45DBEF6E261C48F8BD8D9FE8E083AA8F" style="OLC">
						<subsection id="HD2BE3B1C0E894AC4A95A60F7C9F311DF"><enum>(b)</enum><text display-inline="yes-display-inline">In addition to the protections under
				subsection (a), an individual who is eligible, or who may likely become
				eligible, for any provision of this Act may not be denied or refused credit or
				be subject to any other action described under paragraphs (1) through (6) of
				subsection (a) solely by reason of such
				eligibility.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H39947BD8AD5543028E3D29F38CAF73DB"><enum>3.</enum><header>Requirements for
			 lending institutions that are creditors for obligations and liabilities covered
			 by the Servicemembers Civil Relief Act</header><text display-inline="no-display-inline">Section 207 of the Servicemembers Civil
			 Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/527">50 U.S.C. App. 527</external-xref>) is
			 amended—</text>
			<paragraph id="H5513122FA261488A9AC91E4B068EB0ED"><enum>(1)</enum><text>by redesignating
			 subsections (d) and (e) as subsections (e) and (f), respectively; and</text>
			</paragraph><paragraph id="HA2BBF538E3B94A35909F7860FDA55DD4"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following new subsection (d):</text>
				<quoted-block display-inline="no-display-inline" id="HB3BDE3254E1243B3B2ACA6421CCE6F3E" style="OLC">
					<subsection id="HA9BFCCC872D04E8AA7E00FDB23EA283F"><enum>(d)</enum><header>Lending
				institution requirements</header>
						<paragraph display-inline="no-display-inline" id="H994CB6BAB82742BABD139B3C369B9312"><enum>(1)</enum><header>Compliance
				officers</header><text>Each lending institution subject to the requirements of
				this section shall designate an employee of the institution as a compliance
				officer who is responsible for ensuring the institution’s compliance with this
				section and for distributing information to servicemembers whose obligations
				and liabilities are covered by this section.</text>
						</paragraph><paragraph id="HB4F7951F808E4003BC83E3D1D0F01A7B"><enum>(2)</enum><header>Toll-free
				telephone number</header><text>During any fiscal year, a lending institution
				subject to the requirements of this section that had annual assets for the
				preceding fiscal year of $10,000,000,000 or more shall maintain a toll-free
				telephone number and shall make such telephone number available on the primary
				Internet Web site of the
				institution.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
