			<section id="IDa54388387182475caa5ca1707978c357" section-type="subsequent-section"><enum>101.</enum><header>Clarification of
			 plaintiff affidavit filing requirement for default judgments against
			 servicemembers</header><text display-inline="no-display-inline">Paragraph (1)
			 of section 201(b) of the Servicemembers Civil Relief Act (50 U.S.C. App.
			 521(b)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idD59183380E564A6E9C48C0A1CB3986E8" style="OLC">
					<paragraph id="ID7b7821cf3b154aadb21ed1878aadcc0b"><enum>(1)</enum><header>Plaintiff to
				file affidavit</header>
						<subparagraph id="idF10A43DB8039429C8467920A4585E1ED"><enum>(A)</enum><header>In
				general</header><text>In any action or proceeding covered by this section, the
				plaintiff, before seeking a default judgment, shall file with the court an
				affidavit—</text>
							<clause id="ID72e90ff2cbda449d8d02e23878faabc7"><enum>(i)</enum><text>stating whether
				or not the defendant is in military service and showing necessary facts to
				support the affidavit; or</text>
							</clause><clause id="IDc23bdd70b24f47f2b4cfdad1aedc7ea3"><enum>(ii)</enum><text>if the plaintiff
				is unable to determine whether or not the defendant is in military service,
				stating that the plaintiff is unable to determine whether or not the defendant
				is in military service.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idECED80E66A304A209CFFE039EBCCE324"><enum>(B)</enum><header>Due
				diligence</header><text>Before filing the affidavit, the plaintiff shall
				conduct a diligent and reasonable investigation to determine whether or not the
				defendant is in military service, including a search of available records of
				the Department of Defense and any other information available to the plaintiff.
				The affidavit shall set forth in the affidavit all steps taken to determine the
				defendant’s military
				status.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID6e047994b68a4581a7642b07b3368e47"><enum>102.</enum><header>Residency of
			 military family members</header>
				<subsection id="id71530C647F5F4123AEFFA1FAF27E52B0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 705(b) of the
			 Servicemembers Civil Relief Act (50 U.S.C. App. 595(b)) is amended—</text>
					<paragraph id="id4DD7956876C1401989E4E65C45A84847"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter before paragraph (1), by
			 striking <quote>a person</quote> and all that follows through <quote>that
			 absence</quote> and inserting <quote>a family member of a servicemember who is
			 absent from a State because the servicemember is absent from that same State in
			 compliance with military or naval orders shall not, solely by reason of
			 absence, whether or not accompanying the servicemember</quote>; and</text>
					</paragraph><paragraph id="id4D3DF77A589C48528A4847B544EDA39B"><enum>(2)</enum><text>in paragraph (1),
			 by striking <quote>the person</quote> and inserting <quote>the family
			 member</quote>.</text>
					</paragraph></subsection><subsection id="idC703A889ACC04D28BB78B30D233EA8A7"><enum>(b)</enum><header>Clerical
			 amendments</header><text>Such Act (50 U.S.C. App. 501 et seq.) is
			 amended—</text>
					<paragraph id="id99E5C6C0E46742EEB71CE98B487B8616"><enum>(1)</enum><text>in section 705
			 (50 U.S.C. App. 595)—</text>
						<subparagraph id="id26D7A23162AC4784A6B57A0F8AEFA883"><enum>(A)</enum><text>in the section
			 heading by striking <quote><header-in-text level="section" style="OLC">spouses</header-in-text></quote> and inserting
			 <quote><header-in-text level="section" style="OLC">family
			 members</header-in-text></quote>; and</text>
						</subparagraph><subparagraph id="id79F95D68D9174F3BBFF0A8D0A149794F"><enum>(B)</enum><text>in the heading
			 for subsection (b), by striking <quote><header-in-text level="subsection" style="OLC">Spouses</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="OLC">Family
			 members</header-in-text></quote>; and</text>

			 <quote>$55,000</quote> and inserting <quote>$110,000</quote>; and</text>
				</paragraph><paragraph id="id07C3D84A38944E9BABCF2ED21751A0CE"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>$110,000</quote> and inserting
			 <quote>$220,000</quote>.</text>
				</paragraph></section><section id="ID4b066baf3352412fa0907af0495229de"><enum>104.</enum><header>Authority for
			 issuance and service of civil investigative demands by Attorney General and
			 retroactive application of Attorney General enforcement authority</header>
				<subsection id="idC630173564444934A0B7E2C45766CAA7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 801 of the
			 Servicemembers Civil Relief Act (50 U.S.C. App. 597) is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id33F0FF78F6A6495C91FAB2E0C380DE64" style="OLC">
						<subsection id="ID24ce6af5bfd440d98e156c336903d837"><enum>(d)</enum><header>Issuance and
				service of civil investigative demands</header>
							<paragraph id="id007A359D8D374D4A8218652BF55CFCCC"><enum>(1)</enum><header>In
				general</header><text>Whenever the Attorney General has reason to believe that
				any person may be in possession, custody, or control of any documentary
				material relevant to an investigation under this Act, the Attorney General may,
				before commencing a civil action under subsection (a), issue in writing and
				serve upon such person, a civil investigative demand requiring—</text>
								<subparagraph id="ID917147588668424998d66f39f503b56d"><enum>(A)</enum><text>the production of
				such documentary material for inspection and copying;</text>
								</subparagraph><subparagraph id="ID7b90bffd142945d2a987ab001755b1a4"><enum>(B)</enum><text>that the
				custodian of such documentary material answer in writing written questions with
				respect to such documentary material; or</text>
								</subparagraph><subparagraph id="IDb4611c9f0da54f92a986d3a37eb75b3c"><enum>(C)</enum><text>the production of
				any combination of such documentary material or answers.</text>
								</subparagraph></paragraph><paragraph id="idB8D5DD41FA4E4E50AFE85D4DFDCBC6A1"><enum>(2)</enum><header>Procedures</header><text>The
				provisions of section 3733 of title 31, United States Code, governing the
				authority to issue, use, and enforce civil investigative demands shall apply
				with respect to the authority to issue, use, and enforce civil investigative
				demands under this section, except that, for purposes of applying such section
				3733—</text>
								<subparagraph id="id99741A0AF5884F508CD747285C59D97E"><enum>(A)</enum><text>references to
				false claims law investigators or investigations shall be considered references
				to investigators or investigations under this Act;</text>
								</subparagraph><subparagraph id="idF869647210D94DB59F7E1FDC6A26710B"><enum>(B)</enum><text>references to
				interrogatories shall be considered references to written questions, and
				answers to such need not be under oath;</text>
								</subparagraph><subparagraph id="id7B97AEBCBDB04A6890B665746074462C"><enum>(C)</enum><text>the definitions
				relating to <term>false claims law</term> shall not apply; and</text>
								</subparagraph><subparagraph id="idE5D327C5B6EB475990B743FC1783DA16"><enum>(D)</enum><text>provisions
				relating to qui tam relators shall not
				apply.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="IDf2550d298713464697a6830c5cd41eb5"><enum>(b)</enum><header>Retroactive
			 applicability</header><text>Section 801 of such Act (50 U.S.C. App. 597), as
			 amended by subsection (a), shall apply as if such section were included in the
			 enactment of the Soldiers' and Sailors' Civil Relief Act of 1940 (54 Stat.
			 1178, chapter 888) and included in the restatement of such Act in Public Law
			 108–189.</text>
				</subsection></section><section id="id7045B4572621464C8F6112D97D4E83FC"><enum>105.</enum><header>Retroactive
			 application of private right of action under Servicemembers Civil Relief
			 Act</header><text display-inline="no-display-inline">Section 802 of the
			 Servicemembers Civil Relief Act (50 U.S.C. App. 597a) shall apply as if such
			 section were included in the enactment of the Soldiers' and Sailors' Civil
			 Relief Act of 1940 (54 Stat. 1178, chapter 888) and included in the restatement
			 of such Act in Public Law 108–189.</text>
			</section><section id="ID3849f3c10499456ca008ad79f982dfa8"><enum>106.</enum><header>Related
			 changes to Fair Housing Act—increase in civil penalties</header><text display-inline="no-display-inline">Section 814(d)(1)(C) of the Fair Housing Act
			 (42 U.S.C. 3614(d)(1)(C)) is amended—</text>
				<paragraph id="idC950451A55904491BD3FD25807355D20"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking
			 <quote>$50,000</quote> and inserting <quote>$110,000</quote>; and</text>
				</paragraph><paragraph id="idA030D90605004457A226F97E356C410A"><enum>(2)</enum><text>in clause (ii),
			 by striking <quote>$100,000</quote> and inserting
			 <quote>$220,000</quote>.</text>
				</paragraph></section><section id="IDeb3064b727ad4db496b811b8505e6fba"><enum>107.</enum><header>Related
			 changes to Fair Housing Act—civil investigative demands</header><text display-inline="no-display-inline">Section 814(c) of the Fair Housing Act (42
			 U.S.C. 3614(c)) is amended—</text>
				<paragraph id="id4221D182954E4172A83E129DD3DA0B3B"><enum>(1)</enum><text display-inline="yes-display-inline">in the subsection heading, by inserting
			 <quote><header-in-text level="subsection" style="traditional">and service of
			 civil investigative demands</header-in-text></quote>;</text>
				</paragraph><paragraph id="id7B35999F8F6D4987A7AFC37B7D64317B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> before
			 <quote>The Attorney General</quote>; and</text>
				</paragraph><paragraph id="id93851E2B952045C89318E22B0AF6C380"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDF80A9F8651A47FB9B95516526F66CD6" style="OLC">
						<paragraph id="IDb505b43e60804cf0aad282a9833a4c77"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB9DABEBEF69644C3A2F11060834530B4"><enum>(A)</enum><text>Whenever the Attorney
				General has reason to believe that any person may be in possession, custody, or
				control of any documentary material relevant to an investigation under this
				title, the Attorney General may, before commencing a civil action under
				subsection (a) or (b), issue in writing and serve upon such person, a civil
				investigative demand requiring—</text>
								<clause id="ID6d39c7d9c82b4208a63f7d0787b6bae1" indent="up1"><enum>(i)</enum><text>the production of such documentary
				material for inspection and copying;</text>
								</clause><clause id="ID6161cf3101224bc5abe4caf78e4f876e" indent="up1"><enum>(ii)</enum><text>that the custodian of such
				documentary material answer, in writing, written questions with respect to such
				documentary material; or</text>
								</clause><clause id="ID848f69beb9354237945e163809a1dfea" indent="up1"><enum>(iii)</enum><text>the production of any combination
				of such documentary material or answers.</text>
								</clause></subparagraph><subparagraph id="idB6A860F2DF0346B787CA9C8C090F975E" indent="up1"><enum>(B)</enum><text>Section 3733 of title 31, United
				States Code, shall apply to a civil investigative demand under this paragraph,
				except that—</text>
								<clause id="idC87EB40542BB486DB01D0627341C4940"><enum>(i)</enum><text>such section shall be applied by
				substituting—</text>
									<subclause id="id87206E3C5EE04247900DB78A2C1954B1"><enum>(I)</enum><text>the term <term>fair housing
				investigator</term> for the term <term>false claims law
				investigator</term>;</text>
									</subclause><subclause id="idFA91C5C7441841B8804189F9754E4B55"><enum>(II)</enum><text>the term <term>fair housing
				investigation</term> for the term <term>false claims law investigation</term>;
				and</text>
									</subclause><subclause id="id707AC969112242518024193482BD1EB6"><enum>(III)</enum><text>the term <term>written questions</term>
				for the term <term>interrogatories</term>;</text>
									</subclause></clause><clause id="idCDFD6AB7413D420788232E930CF977DA"><enum>(ii)</enum><text>an answer to written questions
				shall not be required to be made under oath;</text>
								</clause><clause id="idDA0565B4DDDE4F71B893AC0E55F6B47A"><enum>(iii)</enum><text>the definition of the term
				<term>false claims law</term> under section 3722(l)(1) shall not apply;
				and</text>
								</clause><clause id="id3F7129549CE24C54A6DD97A1CD4EB9ED"><enum>(iv)</enum><text>the provisions relating to qui tam
				realtors shall not
				apply.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="IDe85f0c17dca5483e9de640cb47bc2125"><enum>108.</enum><header>Related
			 changes to Equal Credit Opportunity Act—civil investigative
			 demands</header><text display-inline="no-display-inline">Section 706(h) of the
			 Equal Credit Opportunity Act (15 U.S.C. 1691e(h)) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="id7651A4D09B7D40E596B38B3536E9502B" style="OLC">
					<subsection id="ID901e98fe532f49ada1469fe963c4c570"><enum>(h)</enum><header>Authority for
				Attorney General To bring civil action; jurisdiction</header>
						<paragraph id="ID985c2b41c8ac4730ac19590d33b542f9"><enum>(1)</enum><header>In
				general</header><text>When a matter is referred to the Attorney General
				pursuant to subsection (g), or whenever the Attorney General has reason to
				believe that one or more creditors are engaged in a pattern or practice in
				violation of this title, the Attorney General may bring a civil action in any
				appropriate United States district court for such relief as may be appropriate,
				including actual and punitive damages and injunctive relief.</text>
						</paragraph><paragraph id="IDf1fb10490636498bb4cb1100dfbb9fa7"><enum>(2)</enum><header>Issuance and
				service of civil investigative demands</header><text>Whenever the Attorney
				General has reason to believe that any person may be in possession, custody, or
				control of any documentary material relevant to an investigation under this
				title, the Attorney General may, before commencing a civil action under
				paragraph (1), issue in writing and serve upon such person, a civil
				investigative demand requiring—</text>
							<subparagraph id="ID3e4aa35d552649188e4a77d5a98ba4d1"><enum>(A)</enum><text>the production of
				such documentary material for inspection and copying;</text>
							</subparagraph><subparagraph id="IDb7fd66e61a0440f38a5d95fe4465131e"><enum>(B)</enum><text>that the
				custodian of such documentary material answer in writing written questions with
				respect to such documentary material; or</text>
							</subparagraph><subparagraph id="IDdaecaae45f484e83a3f792edc4e4d858"><enum>(C)</enum><text>the production of
				any combination of such documentary material or answers.</text>
							</subparagraph></paragraph><paragraph id="id54E2479B4CD24988B37EB734E22F9C2C"><enum>(3)</enum><header>Procedures</header><text>The
				provisions of law governing the authority to issue, use, and enforce civil
				investigative demands under section 3733 of title 31, United States Code,
				governing the authority to issue, use, and enforce civil investigative demands
				shall apply with respect to the authority to issue, use, and enforce civil
				investigative demands under this section, except that, for purposes of applying
				such section 3733—</text>
							<subparagraph id="id365421FA9BB2467290CADFCC9D85F6A9"><enum>(A)</enum><text>references to
				false claims law investigators or investigations shall be read as references to
				fair lending investigators or investigations;</text>
							</subparagraph><subparagraph id="id24D35CDA7D3C462BBE21C9823C1F08AB"><enum>(B)</enum><text>references to
				interrogatories shall be read as references to written questions, and answers
				to such need not be under oath;</text>
							</subparagraph><subparagraph id="idD9753FB349044C1085A28E6381E468A3"><enum>(C)</enum><text>the statutory
				definitions relating to <term>false claims law</term> shall not apply;
				and</text>

			 reporting requirements on availability and transmission of absentee
			 ballots</header>
				<subsection commented="no" id="idCE16D642B15D4B40B2C65EE67B701B19"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 102 of the Uniformed and Overseas Citizens Absentee Voting Act (42
			 U.S.C. 1973ff–1(c)) is amended by striking <quote>Not later than 90
			 days</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDFFBD2D6EF6A4B4A8A23905A14AD7A53" style="OLC">
						<paragraph commented="no" id="IDc53da8520d904260bc6880b127e6b631"><enum>(1)</enum><header>Pre-election
				report on absentee ballot availability</header><text>Not later than 55 days
				before any election for Federal office held in a State, such State shall submit
				a report to the Attorney General and the Presidential Designee, and make that
				report publicly available that same day, certifying that absentee ballots are
				or will be available for transmission by 46 days before the election. The
				report shall be in a form prescribed by the Attorney General and shall require
				the State to certify specific information about ballot availability from each
				unit of local government which will administer the election.</text>
						</paragraph><paragraph id="ID56dad99caab94f0fb4b60c94d87dbfee"><enum>(2)</enum><header>Pre-election
				report on absentee ballots transmitted</header><text>Not later than 43 days
				before any election for Federal office held in a State, such State shall submit
				a report to the Attorney General and the Presidential Designee, and make that
				report publicly available that same day, certifying whether all absentee
				ballots validly requested by absent uniformed services voters and overseas
				voters whose requests were received by the 46th day before the election have
				been transmitted to such voters by such date. The report shall be in a form
				prescribed by the Attorney General and shall require the State to certify
				specific information about ballot transmission, including the total numbers of
				ballot requests received and ballots transmitted, from each unit of local
				government which will administer the election.</text>
						</paragraph><paragraph id="id7AA0F76C2E2B4544B2C4161C71C68935"><enum>(3)</enum><header>Post election

			 U.S.C. 1973ff–1(a)) is amended to read as follows:</text>

				overseas voter by the date and in the manner determined under subsection
				(g);</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idC36AD6999EE7416BAE4F8C2B08B2A05A"><enum>(b)</enum><header>Ballot
			 transmission requirements and repeal of waiver
			 provision</header><text>Subsection (g) of section 102 of such Act (42 U.S.C.
			 1973ff–1(g)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id38E90786A55B464AA6DF202A513DC2AD" style="OLC">
						<subsection id="idCE3FD276B34746AA8EB8912B743D2071"><enum>(g)</enum><header>Ballot
				transmission requirements</header>
							<paragraph id="id7124A42D313649DF970CE1A174C6DF98"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsection (a)(8), in the case in which a
				valid request for an absentee ballot is received at least 46 days before an
				election for Federal office, the following rules shall apply:</text>
								<subparagraph id="id4B80494A854B47EF9258CBE610DC1DBC"><enum>(A)</enum><header>In
				general</header><text>The State shall transmit the absentee ballot not later
				than 46 days before the election.</text>
								</subparagraph><subparagraph id="id12B6F4582DC641C08FA69E6B6079D076"><enum>(B)</enum><header>Special rules
				in case of failure to transmit on time</header>
									<clause id="id29C2160EA3B64EEB9DC0C1BEB87537EE"><enum>(i)</enum><header>In
				general</header><text>If the State fails to transmit any absentee ballot by the
				46th day before the election as required by subparagraph (A) and the absent
				uniformed services voter or overseas voter did not request electronic ballot
				submission pursuant to subsection (f), the State shall transmit such ballot by
				express delivery.</text>
									</clause><clause id="id3CC73D2796EB445489EE525CD5A3CC44"><enum>(ii)</enum><header>Extended
				failure</header><text>If the State fails to transmit any absentee ballot by the
				41st day before the election, in addition to transmitting the ballot as
				provided in clause (i), the State shall—</text>
										<subclause id="id7D6DC537515643D081474BC119439842"><enum>(I)</enum><text>in the case of
				absentee ballots requested by absent uniformed services voters with respect to
				regularly scheduled general elections, notify such voters of the procedures
				established under section 103A for the collection and delivery of marked
				absentee ballots; and</text>
										</subclause><subclause id="id6F8DBF18A89B4E8DA0A85A9E4C58EAFA"><enum>(II)</enum><text>in any other
				case, provide, at the State's expense, for the return of such ballot by express
				delivery.</text>
										</subclause></clause><clause commented="no" id="id695E338DA76C45DFAB792090ED985A05"><enum>(iii)</enum><header>Enforcement</header><text>A
				State’s compliance with this subparagraph does not bar the Attorney General
				from seeking additional remedies necessary to effectuate the purposes of this
				Act.</text>
									</clause></subparagraph></paragraph><paragraph id="id21CB59F92164466CA74D8FE2BAB0F6B2"><enum>(2)</enum><header>Requests
				received after 46th day before election</header><text>For purposes of
				subsection (a)(8), in the case in which a valid request for an absentee ballot
				is received less than 46 days before an election for Federal office, the State
				shall transmit the absentee ballot—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID1BC7F2A23837479D894C20112BA99120"><enum>(A)</enum><text>in accordance
				with State law; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7BB46775A2CF43678FF2C18D9D624E72"><enum>(B)</enum><text>if practicable
				and as determined appropriate by the State, in a manner that expedites the
				transmission of such absentee
				ballot.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="IDaf7284b461b34dd1930fca9760ad3a5b"><enum>203.</enum><header>Clarification
			 of State responsibility, civil penalties, and private right of action</header>
				<subsection id="ID32d4486a0cdf42fd8a2b524af3c16eda"><enum>(a)</enum><header>Enforcement</header><text>Section
			 105 (42 U.S.C. 1973ff–4) of the Uniformed and Overseas Citizens Absentee Voting
			 Act is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id75C1D39C0A6F4CECB0A2834B18E00EDE" style="OLC">
						<section id="id8558FBD1FCF4402382E89F2F961B4D72"><enum>105.</enum><header>Enforcement</header>
							<subsection id="ID66c1cd104cb14475814beedced8b37b5"><enum>(a)</enum><header>In
				general</header><text>The Attorney General may bring a civil action in an
				appropriate district court for such declaratory or injunctive relief as may be
				necessary to carry out this title. In any such action, the only necessary party
				defendant is the State and it shall not be a defense to such action that local
				election officials are not also named as defendants.</text>
							</subsection><subsection id="ID20d9b3714d8b4942990943352766a7c1"><enum>(b)</enum><header>Civil
				penalty</header><text>In a civil action brought under subsection (a), if the
				court finds that a State violated any provision of this Act, it may, to
				vindicate the public interest, assess a civil penalty against the State—</text>
								<paragraph id="IDd206d7617f484a2f921ae02213fd0b9d"><enum>(1)</enum><text>in an amount not
				exceeding $110,000, for a first violation; and</text>
								</paragraph><paragraph id="ID873305da7cbd4cf69f24844051dd34a4"><enum>(2)</enum><text>in an amount not
				exceeding $220,000, for any subsequent violation.</text>
								</paragraph></subsection><subsection id="IDf433b7d6076d472b8d9ce85a0be251ab"><enum>(c)</enum><header>Report to
				Congress</header><text>Not later than December 31 of each year, the Attorney
				General shall submit to Congress an annual report on any civil action brought
				under subsection (a) during the preceding year.</text>
							</subsection><subsection id="IDa500e6c7505c42c58529b590fb1913f3"><enum>(d)</enum><header>Private right
				of action</header><text>A person who is aggrieved by a State’s violation of
				this Act, may bring a civil action in an appropriate district court for such
				declaratory or injunctive relief as may be necessary to carry out this Act. In
				any such action, the only necessary party defendant is the State, and it shall
				not be a defense to such action that local election officials are not also
				named as defendants.</text>
							</subsection><subsection id="ID72ed9e0f61ef4a3eb071f3c7fbf1387e"><enum>(e)</enum><header>Attorney’s
				fees</header><text>In a civil action under this section, the court may allow
				the prevailing party (other than the United States) reasonable attorney’s fees,
				including litigation expenses, and
				costs.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="IDac8a97b19db14f4aa516af96e50a8e50"><enum>(b)</enum><header>Repeal of
			 clarification regarding delegation of state
			 responsibility</header><text>Section 576 of the Military and Overseas Voter
			 Empowerment Act (42 U.S.C. 1973ff–1 note) is repealed.</text>
				</subsection></section><section id="ID361a862a6f4f470cae4249d1dcd2cc14"><enum>204.</enum><header>Treatment of
			 early ballot requests</header>
				<subsection id="id5CC0D4C5CD924E8192FE1F36C220B33E"><enum>(a)</enum><header>Application of
			 prohibition of refusal of applications on grounds of early submission to
			 overseas voters</header><text display-inline="yes-display-inline">Section 104
			 of the Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C. 1973ff–3)
			 is amended—</text>
					<paragraph id="id33A0949D63734F99A195D2F481192C6C"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>or overseas
			 voter</quote> after <quote>submitted by an absent uniformed services
			 voter</quote>; and</text>
					</paragraph><paragraph id="idE7EFF551E0B34E7387191FBAB729A9AB"><enum>(2)</enum><text>by inserting
			 <quote>or who do not reside outside the United States</quote> after <quote>who
			 are not members of the uniformed services</quote>.</text>
					</paragraph></subsection><subsection id="id16A919EFE3C645D9A7A8FD8F0EA82471"><enum>(b)</enum><header>Use of single
			 application for subsequent elections</header>
					<paragraph id="idBE338C7DCEA643B189CE9BFD4D623DA1"><enum>(1)</enum><header>In
			 general</header><text>Section 104 of the Uniformed and Overseas Citizens
			 Absentee Voting Act (42 U.S.C. 1973ff–3) is amended—</text>
						<subparagraph id="id0188D64781E445B4B9F4C6436139932A"><enum>(A)</enum><text>by striking
			 <quote>A State</quote> and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id897750FF8234434F9B4E674370B59695" style="OLC">
								<subsection id="idEB8CFDFFBDCF4D9297CD8BEFC2C01E6C"><enum>(a)</enum><header>Prohibition of

				general</header><text>If a State accepts and processes a request for an
				absentee ballot by an absent uniformed services voter or overseas voter and the
				voter requests that the application be considered an application for an
				absentee ballot for each subsequent election for Federal office held in the
				State through the next regularly scheduled general election for Federal office
				(including any runoff elections which may occur as a result of the outcome of
				such general election), the State shall provide an absentee ballot to the voter
				for each such subsequent election.</text>
									</paragraph><paragraph id="idBAF322DF3BF54698BD909FCD9F5CB139"><enum>(2)</enum><header>Exception for
				voters changing registration</header><text>Paragraph (1) shall not apply with
				respect to a voter registered to vote in a State for any election held after
				the voter notifies the State that the voter no longer wishes to be registered
				to vote in the State or after the State determines that the voter has
				registered to vote in another
				State.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="idEE935DFEEF714B0CB0B9B9E829C90F8C"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The heading of section 104 of such Act is amended by

			 Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C. 1973ff–6(6)) are
			 each amended by striking <quote>and American Samoa</quote> and inserting
			 <quote>American Samoa, and the Commonwealth of the Northern Mariana
			 Islands</quote>.</text>
			</section><section id="id37C809D37335488F9FFCC0A351EC880C"><enum>206.</enum><header>Related
			 changes to title VI of the Civil Rights Act of 1964—clarification of prohibited
			 discrimination, private right of action, and available relief</header>

			 of prohibited discrimination</header><text>Section 601 of the Civil Rights Act

				person aggrieved, demonstrates that an entity subject to this title has a
				policy or practice with respect to the program or activity that causes a
				disparate impact on the basis of race, color, or national origin; and</text>
									</subparagraph><subparagraph id="idDC70D715880F4C36AA66F592A35ADC56" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id9254A52E94804C7695B89F4FA1DD3EC1"><enum>(i)</enum><text>the entity fails to
				demonstrate that the challenged policy or practice is related to, and necessary
				to achieve, the substantial and legitimate nondiscriminatory goals of the
				program or activity; or</text>
										</clause><clause id="id28A9C5EB93954074A69609C83A880112" indent="up1"><enum>(ii)</enum><text>the Federal department or agency, or
				the person aggrieved, demonstrates that a less discriminatory alternative
				policy or practice exists, and the entity refuses to adopt such alternative
				policy or practice.</text>
										</clause></subparagraph></paragraph><paragraph id="id6F5AAD1EAEF84C7B9CFE14F4857C0061" indent="up1"><enum>(2)</enum><text>In this subsection, the term
				<term>demonstrates</term> means meets the burdens of production and
				persuasion.</text>

			 changes to title IX of the Education Amendments of 1972—clarification of
			 prohibited discrimination, private right of action, and available
			 relief</header>

			 of prohibited discrimination</header><text>Section 901 of the Education
			 Amendments of 1972 (20 U.S.C. 1681) is amended—</text>

				person aggrieved, demonstrates that an entity subject to this title has a
				policy or practice with respect to the program or activity that causes a
				disparate impact on the basis of sex; and</text>
									</subparagraph><subparagraph id="id0E5A31DFEF8E4974AB05F3521317106F" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id8429CB5EAC2640BD9DA2DCE8CC101C12"><enum>(i)</enum><text>the entity fails to
				demonstrate that the challenged policy or practice is related to, and necessary
				to achieve, the substantial and legitimate nondiscriminatory goals of the

										</clause><clause id="idDC5B70D714B247048DD284F8F18F3610" indent="up1"><enum>(ii)</enum><text>the Federal department or agency, or
				the person aggrieved, demonstrates that a less discriminatory alternative
				policy or practice exists, and the entity refuses to adopt such alternative

										</clause></subparagraph></paragraph><paragraph id="id6FAE89AA9AAE4B1CB7C60AE1616166F3" indent="up1"><enum>(2)</enum><text>In this subsection, the term

					</paragraph></subsection></section></title><title id="idA985B263A40D4724ABE5EA0B5926B3A6"><enum>III</enum><header>Amendments to
			 chapter 43 of title 38, United States Code</header>
			<section id="ID67bf0c9252e3478c817baea4ea054842"><enum>301.</enum><header>Enforcement of
			 rights of members of uniformed services with respect to States and private
			 employers</header>
				<subsection id="id44907B76C85A4DD99FB274BA363BED4E"><enum>(a)</enum><header>Action for
			 relief</header><text>Subsection (a) of section 4323 of title 38, United States
			 Code, is amended—</text>
					<paragraph id="idA8AC473B39CD47688F05B1F02B4F6137"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
						<subparagraph id="id9F815FCB5C704F9A87134F25B8D097BD"><enum>(A)</enum><text>by striking
			 <quote>appear on behalf of, and act as attorney for, the person on whose behalf
			 the complaint is submitted and</quote>;</text>
						</subparagraph><subparagraph id="idD8A3BA136F2243F89D9BC5A384480358"><enum>(B)</enum><text>by striking
			 <quote>for such person</quote>;</text>
						</subparagraph><subparagraph id="id000188C2DEA3481788E565553FEB25F6"><enum>(C)</enum><text>by striking the
			 fourth sentence; and</text>
						</subparagraph><subparagraph id="idBAB65ED9CC704066AE079E54F13B9270"><enum>(D)</enum><text>by adding at the
			 end the following: <quote>The person on whose behalf the complaint is referred
			 may, upon timely application, intervene in such action, and may obtain such
			 appropriate relief as is provided in subsections (d) and (e).</quote>;</text>
						</subparagraph></paragraph><paragraph id="id1300441BF09743F698AD99CAA5F5B98A"><enum>(2)</enum><text>by striking
			 paragraph (2) and inserting the following new paragraph (2):</text>
						<quoted-block display-inline="no-display-inline" id="id5C66AFC6E9DB4B9997E45E3CD59B32B9" style="OLC">
							<paragraph id="id09a42dee53ff4f12b27de6e118a41d09" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFB050C6EA72F4F589BFEB350F5EFEA50"><enum>(A)</enum><text>Not later than 60 days
				after the date the Attorney General receives a referral under paragraph (1),
				the Attorney General shall transmit, in writing, to the person on whose behalf
				the complaint is submitted—</text>
									<clause id="id03F22D4B23214A95A60E6CDE027E47B1" indent="up1"><enum>(i)</enum><text>if the Attorney General has made a
				decision to commence an action for relief under paragraph (1) relating to the
				complaint of the person, notice of the decision; and</text>
									</clause><clause id="id5BE6E45D4273471981613D27EF918F60" indent="up1"><enum>(ii)</enum><text>if the Attorney General has not made
				such a decision, notice of when the Attorney General expects to make such a
				decision.</text>
									</clause></subparagraph><subparagraph id="idAC2E73304C3C459C8EC8DF1DC7499300" indent="up1"><enum>(B)</enum><text>If the Attorney General notifies a
				person that the Attorney General expects to make a decision under subparagraph
				(A)(ii), the Attorney General shall, not later than 30 days after the date on
				which the Attorney General makes such decision, notify, in writing, the person
				of such
				decision.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id3E60CA283A4B455BAFF963E0522A341A"><enum>(3)</enum><text>by redesignating
			 paragraph (3) as paragraph (4);</text>
					</paragraph><paragraph id="id4B1E9BBB83BF4FE19F31AB90429B779F"><enum>(4)</enum><text>by inserting
			 after paragraph (2) the following new paragraph (3):</text>
						<quoted-block display-inline="no-display-inline" id="idC0341F7991EB4E458D1D752E3812AD7E" style="OLC">
							<paragraph id="idE0882614140B48D68614D5E2ADF8BC61" indent="up1"><enum>(3)</enum><text>Whenever the Attorney General has
				reasonable cause to believe that a State (as an employer) or a private employer
				is engaged in a pattern or practice of resistance to the full enjoyment of any
				of the rights and benefits provided for under this chapter, and that the
				pattern or practice is of such a nature and denies the full exercise of such
				rights and benefits, the Attorney General may commence an action for relief
				under this chapter.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id7293F2A8E2C945E4B677E7010B3F7295"><enum>(5)</enum><text>in paragraph (4),
			 as redesignated by paragraph (3), by striking subparagraph (C) and inserting
			 the following new subparagraph (C):</text>
						<quoted-block display-inline="no-display-inline" id="idF7E357AD2BF34B7D9CEF594A5EB2FB48" style="OLC">
							<subparagraph id="IDf18c0ddaf7934f66a07358d3b065681a" indent="up1"><enum>(C)</enum><text>has been notified by the Attorney
				General that the Attorney General does not intend to commence an action for
				relief under paragraph (1) with respect to the complaint under such
				paragraph.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="ID37e63bec56324eb696850ad27cac0a2e"><enum>(b)</enum><header>Standing</header><text>Subsection
			 (f) of such section is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id761DDECFD04849E7B1469667CB0BD490" style="OLC">
						<subsection id="IDa1b7265b4f1342f29534f59e52d6b1f0"><enum>(f)</enum><header>Standing</header><text>An
				action under this chapter may be initiated only by the Attorney General or by a
				person claiming rights or benefits under this chapter under subsection
				(a).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID485d6e07dff74d6e879658f2d05a4983"><enum>(c)</enum><header>Conforming
			 amendment</header><text>Subsection (h)(2) of such section is amended by
			 striking <quote>under subsection (a)(2)</quote> and inserting <quote>under
			 paragraph (1) or (4) of subsection (a)</quote>.</text>
				</subsection></section><section id="id088C4DB256D24D11A92C3E1A2B938B27"><enum>302.</enum><header>Issuance and
			 service of civil investigative demands by Attorney General</header><text display-inline="no-display-inline">Section 4323 of title 38, United States
			 Code, is amended—</text>
				<paragraph id="idE27C6B6255634F92AF2D0B48B44F7CD7"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (i) as
			 subsection (j); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id185ECB7724044DDE8AE9E68BA082237B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (h) the
			 following new subsection (i):</text>
					<quoted-block display-inline="no-display-inline" id="id292F204C88654B8A9907D1DCCD08C3FE" style="OLC">
						<subsection id="id0AEE6AEBE77A48E2873E75A940DE9FA7"><enum>(i)</enum><header>Issuance and
				service of civil investigative demands</header><paragraph commented="no" display-inline="yes-display-inline" id="idD34EC8B9A74E457DAAE310314D6A8106"><enum>(1)</enum><text>Whenever the Attorney
				General has reason to believe that any person may be in possession, custody, or
				control of any documentary material relevant to an investigation under this
				subchapter, the Attorney General may, before commencing a civil action under
				subsection (a), issue in writing and serve upon such person, a civil
				investigative demand requiring—</text>
								<subparagraph id="id8391F140C2E54BDE84B9818737AC81E1" indent="up1"><enum>(A)</enum><text>the production of such documentary
				material for inspection and copying;</text>
								</subparagraph><subparagraph id="idDDDD7FDB0D9143D7B34FA41C3AD92526" indent="up1"><enum>(B)</enum><text>that the custodian of such documentary
				material answer in writing written questions with respect to such documentary
				material; or</text>
								</subparagraph><subparagraph id="id24C07CEF471240639931F48FC82FA1F7" indent="up1"><enum>(C)</enum><text>the production of any combination of
				such documentary material or answers.</text>
								</subparagraph></paragraph><paragraph id="id5A327F90A946468A80041841241E926A" indent="up1"><enum>(2)</enum><text>The provisions of section 3733 of
				title 31 governing the authority to issue, use, and enforce civil investigative
				demands shall apply with respect to the authority to issue, use, and enforce
				civil investigative demands under this section, except that, for purposes of
				applying such section 3733—</text>
								<subparagraph id="id691E736995FB46AAB8DA69C98ECB1BDC"><enum>(A)</enum><text>references to false claims law
				investigators or investigations shall be considered references to investigators
				or investigations under this subchapter;</text>
								</subparagraph><subparagraph id="id5A28D930294D45E1B08B5265BFC2F087"><enum>(B)</enum><text>references to interrogatories shall be
				considered references to written questions, and answers to such need not be
				under oath;</text>
								</subparagraph><subparagraph id="id25D9814C40D6424E95FE18D24808DA43"><enum>(C)</enum><text>the definitions relating to
				<term>false claims law</term> shall not apply; and</text>
								</subparagraph><subparagraph id="id58B986A283C24275BFFA095E70A75A9F"><enum>(D)</enum><text>provisions relating to qui tam
				relators shall not
				apply.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="ID83a5b529e14a48c5af8de96e58d4d403"><enum>303.</enum><header>Related
			 changes to title VII of Civil Rights Act of 1964—civil investigative
			 demands</header>
				<subsection id="ID74e02c8ad56f46688689641cf668a792"><enum>(a)</enum><text>Section 707 of
			 the Civil Rights Act of 1964 (42 U.S.C. 2000e–6) is amended—</text>
					<paragraph id="idAE425C72FF724472BE74EFB96824B891"><enum>(1)</enum><text>by redesignating
			 subsections (b) through (e) as subsections (c) through (f), respectively;
			 and</text>
					</paragraph><paragraph id="id3F4FA3DEE3754B509CFE64650F46F43C"><enum>(2)</enum><text>by inserting
			 after subsection (a) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idD6E030ADF65D41548658B745A7A36539" style="OLC">
							<subsection id="ID4e787d1ed1c84ce5b22c921260f11fc5"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id3E544D78B45042ACA690AB40D0880CA3"><enum>(1)</enum><text>Whenever the Attorney
				General has reason to believe that any person may be in possession, custody, or
				control of any documentary material relevant to an investigation under this
				title, the Attorney General may, before commencing a civil action under
				subsection (a), issue in writing and cause to be served upon such person, a
				civil investigative demand requiring—</text>
									<subparagraph id="IDef12b3ef9df44d32870bd526b0d13e05" indent="up1"><enum>(A)</enum><text>the production of such documentary
				material for inspection and copying;</text>
									</subparagraph><subparagraph id="ID27a8a685bf004771860be6e7cd3e700f" indent="up1"><enum>(B)</enum><text>that the custodian of such documentary
				material answer in writing written questions with respect to such documentary
				material; or</text>
									</subparagraph><subparagraph id="ID2de6f7acc33d45e59bde3e41bf576c77" indent="up1"><enum>(C)</enum><text>the production of any combination of
				such documentary material or answers.</text>
									</subparagraph></paragraph><paragraph id="id160A6CCBBC5D4E65B60E0E3D57EFE7AA" indent="up1"><enum>(2)</enum><text>The statutory provisions of section
				3733 of title 31, United States Code, governing the authority to issue, use,
				and enforce civil investigative demands shall apply with respect to the
				authority to issue, use, and enforce civil investigative demands under this
				section, except that, for purposes of applying that section 3733—</text>
									<subparagraph id="idA7BD2D6D98B54803BE7C4F5CADF237F0"><enum>(A)</enum><text>references to false claims law
				investigators or investigations shall be considered to be references to
				employment discrimination investigators or investigations under this
				title;</text>
									</subparagraph><subparagraph id="idA4B9EA8FC14142D09DA5A709A823A20E"><enum>(B)</enum><text>references to interrogatories shall be
				considered to be references to written questions, and answers to such need not
				be under oath;</text>
									</subparagraph><subparagraph id="id83DACC8D8CE84BE093E38B86FD3E9FF0"><enum>(C)</enum><text>the statutory definition relating to
				<term>false claims law</term> shall not apply; and</text>
									</subparagraph><subparagraph id="id27911C8D2F9C4B239D57D3455853CD95"><enum>(D)</enum><text>provisions relating to qui tam
				relators shall not
				apply.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id5C69FFBC9AD3498799BAD13077D06CD1"><enum>(3)</enum><text>in subsection
			 (d), as redesignated by paragraph (1), by striking <quote>subsections (d) and
			 (e)</quote> and inserting <quote>subsections (e) and (f)</quote>; and</text>
					</paragraph><paragraph id="idFD31DA3B71054D01B90AAD1F7AE854EC"><enum>(4)</enum><text>in subsection
			 (e), as redesignated by paragraph (1), by striking <quote>subsection
			 (c)</quote> and inserting <quote>subsection (d)</quote>.</text>
