		  Notification Act to minimize the adverse effects of employment dislocation, and

		<section id="H375F942F29204662BC05EBF3387EAD93" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Forewarn
			 Act</short-title></quote>.</text>
		</section><section id="H89695712284A4567B6AD5331534AFB1E"><enum>2.</enum><header>Amendments to the
			 WARN Act</header>
			<subsection id="HED4192639F5549308BFFAFF86447188C"><enum>(a)</enum><header>Definitions</header>
				<paragraph commented="no" id="HEA86BCD28A5441678D0CC2888967AC7E"><enum>(1)</enum><header>Employer, plant
			 closing, and mass layoff</header><text display-inline="yes-display-inline">Paragraphs (1) through (3) of section 2(a)
			 of the Worker Adjustment and Retraining Notification Act (29 U.S.C. 2101(a)
			 (1)–(3)) are amended to read as follows:</text>
					<quoted-block id="H459F79C0FAE1471EB78101B8562CF052" style="OLC">
						<paragraph commented="no" id="HE2F59F20D2CE4FBC8FE0C7C5B5676765"><enum>(1)</enum><text>the term
				<term>employer</term> means any business enterprise that employs 75 or more
				employees and includes any parent corporation of which such business enterprise
				is a subsidiary;</text>
						</paragraph><paragraph commented="no" id="H734883A206EF4BF3AAE337C120173AFB"><enum>(2)</enum><text>the term
				<term>plant closing</term> means the permanent or temporary shutdown of a
				single site of employment, or of one or more facilities or operating units
				within a single site of employment, which results in an employment loss at such
				site, during any 30-day period, for 25 or more employees;</text>
						</paragraph><paragraph commented="no" id="HBCD6FBFF22314D47B67F82363FEFEAEB"><enum>(3)</enum><text>the term
				<term>mass layoff</term> means a reduction in force at a single site of
				employment which results in an employment loss at such site, during any 30-day
				period, for 25 or more
				employees;</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H029EDCE2B2DD4D3DBDB52D1CAFF4A4C0"><enum>(2)</enum><header>Secretary of
			 labor</header>
					<subparagraph id="H6B92EB86632F422886A1CFF01D5EFDDF"><enum>(A)</enum><header>Definition</header><text>Paragraph
			 (8) of section 2(a) of such Act (29 U.S.C. 2101(a)(8)) is amended to read as
			 follows:</text>
						<quoted-block id="H9451D8861B48419CBF86E1DD8F11FEBE" style="OLC">
							<paragraph id="H81F5DF0C27B943C38C04F3E8CCB4052B"><enum>(8)</enum><text>the term
				<term>Secretary</term> means the Secretary of Labor or a representative of the
				Secretary of

					</subparagraph><subparagraph id="HAD582033BDC0426DA8D8BCD5F82A97B3"><enum>(B)</enum><header>Regulations</header><text>Section
			 8(a) of such Act (29 U.S.C. 2107(a)) is amended by striking <quote>of
			 Labor</quote>.</text>
					</subparagraph></paragraph><paragraph id="HE221BE96B40C4603B10F2F5F5F916F11"><enum>(3)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H546DA5FF50D243BAADCDDED7CFE80F1C"><enum>(A)</enum><header>Notice</header><text>Section
			 3(d) of such Act (29 U.S.C. 2102(d)) is amended by striking out <quote>, each
			 of which is less than the minimum number of employees specified in section
			 2(a)(2) or (3) but which in the aggregate exceed that minimum number,</quote>
			 and inserting <quote>which in the aggregate exceed the minimum number of
			 employees specified in section 2(a) (2) or (3)</quote>.</text>
					</subparagraph><subparagraph id="H00DC69B9F737466C8F8B242E5AA019A1"><enum>(B)</enum><header>Definitions</header><text>Section
			 2(b)(1) of such Act (29 U.S.C. 2101(b)(1)) is amended by striking <quote>(other
			 than a part-time employee)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H3053D48445664FDE93DCAF6F77B0897E"><enum>(b)</enum><header>Notice</header>
				<paragraph id="HCB6E981438F54A7F9E3AC4EB473B3A54"><enum>(1)</enum><header>Notice
			 period</header><text>Section 3 of the Worker Adjustment and Retraining
			 Notification Act (29 U.S.C. 2102) is amended by striking <quote>60-day
			 period</quote> and inserting <quote>90-day period</quote> each place it
			 appears.</text>
				</paragraph><paragraph id="HC2E42131E1B6454EBFDD90C200526941"><enum>(2)</enum><header>Recipients</header><text>Section
			 3(a) of such Act (29 U.S.C. 2102(a)) is amended—</text>
					<subparagraph id="HFCCC6A5AADEE44EABFC0F1E47EF39FB8"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>or, if there is no such representative at that time, to each
			 affected employee; and</quote> and inserting <quote>and to each affected
			 employee;</quote>; and</text>
					</subparagraph><subparagraph id="HD32DE14AABF74D36A6440AEC760E575F"><enum>(B)</enum><text>by redesignating
			 paragraph (2) as paragraph (3) and inserting after paragraph (1) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H6467BF3926CA4564B4D80B3245A5A0F7" style="OLC">
							<paragraph id="HB14D84B68C8340EABFEEF80A39139FB2"><enum>(2)</enum><text display-inline="yes-display-inline">to the Secretary and the Governor of the
				State where the plant closing or mass layoff is to occur;
				and</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HA7A023C4A30F4116B5525E7330F81DE5"><enum>(3)</enum><header>Notice Excused
			 Where Caused by Terrorist Attack</header><text display-inline="yes-display-inline">Section 3(b)(2) of the Worker Adjustment
			 and Retraining Notification Act (29 U.S.C. 2102(b)(2)) is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H73B44AE8C0AD4182AB7A1C60242F16DE" style="traditional">
						<subparagraph id="H463DEA05219E40B2846D6EE2AF4D5DE4" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">No notice under this Act shall be required
				if the plant closing or mass layoff is due directly to a terrorist attack on
				the United
				States.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H93CB6C92FFC24772B2E94FDAC9D9FDF3"><enum>(4)</enum><header>Content of
			 notice</header><text display-inline="yes-display-inline">Section 3 of such Act
			 (29 U.S.C. 2102) is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD2A8636BED414D6BA32CD4604E1504A6" style="OLC">
						<subsection id="H26981344A1FB4A97B5A09DB9726A9729"><enum>(e)</enum><header>Content of
				Notices</header><text display-inline="yes-display-inline">An employer who is
				required to provide notice as required under subsection (a) shall
				include—</text>
							<paragraph id="H193BF1DF853F4F4E8C8B7DE7947B66F1"><enum>(1)</enum><text display-inline="yes-display-inline">in each notice required under such
				subsection—</text>
								<subparagraph id="HAF448985A5CD497E95C8D039618175D0"><enum>(A)</enum><text>a statement of the
				number of affected employees;</text>
								</subparagraph><subparagraph id="H817329FDDB2A415C9911FC1CD2FE13DD"><enum>(B)</enum><text>the reason for the
				plant closing or mass layoff;</text>
								</subparagraph><subparagraph id="H2EDEB30795ED43718EC34EB7AF006034"><enum>(C)</enum><text>the availability
				of employment at other establishments owned by the employer;</text>
								</subparagraph><subparagraph id="H50BDB2E5FD76497B9F3F35370E6C535D"><enum>(D)</enum><text>a statement of
				each employee’s rights with respect to wages and severance and employee
				benefits; and</text>
								</subparagraph><subparagraph id="HE34AF23E11794DA4A4B294223B6328BE"><enum>(E)</enum><text display-inline="yes-display-inline">a statement of the available employment and
				training services provided by the Department of Labor; and</text>
								</subparagraph></paragraph><paragraph id="H8236311EBAFB4154A4AE43C355CDD1C6"><enum>(2)</enum><text>in each notice
				required under such subsection except for the notice provided to individual
				employees, the names, addresses, and occupations of the affected
				employees.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H45DCE4C2F7DA4E7CA0902BB828F89F22"><enum>(5)</enum><header>Information
			 regarding benefits and services available to workers and DOL notice to
			 Congress</header><text>Section 3 of such Act (29 U.S.C. 2102) is further
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC6CF196C654A433B849F557CC8A718B9" style="OLC">
						<subsection id="H3C9E5F2B7DF54FD4B690A3083878A66B"><enum>(f)</enum><header>Information
				regarding benefits and services available to employees</header><text display-inline="yes-display-inline">Concurrent with or immediately after
				providing the notice required under subsection (a)(1), an employer shall
				provide affected employees with information regarding the benefits and services
				available to such employees, as described in the guide compiled by the
				Secretary under section 13.</text>
						</subsection><subsection id="HEC9CB908621A43DE929F1B7768624190"><enum>(g)</enum><header>Access of rapid
				response teams</header><text display-inline="yes-display-inline">An employer
				who is required to provide notice under subsection (a) shall permit, during
				work hours, reasonable on-site access to any Federal, State, or local rapid
				response team under section 134(a)(2)(A) of the Workforce Investment Act of
				1998 (29 U.S.C. 2864(a)(2)(A)) responsible for providing reemployment, training
				services, and related services to affected employees.</text>
						</subsection><subsection id="H32067B3865C744B684508591FB0DA166"><enum>(h)</enum><header>DOL Notice to
				Congress</header><text>As soon as practicable and not later than 15 days after
				receiving notice under subsection (a)(2), the Secretary of Labor shall notify
				the appropriate Senators and Members of the House of Representatives who
				represent the area or areas where the plant closing or mass layoff is to
				occur.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB80A8FD0A65345368F5334994EBF162B"><enum>(c)</enum><header>Enforcement</header>
				<paragraph id="HD2521B480EF64A8C92BF0C62CF55F744"><enum>(1)</enum><header>Amount</header><text display-inline="yes-display-inline">Section 5(a)(1) of the Worker Adjustment
			 and Retraining Notification Act (29 U.S.C. 2104(a)(1)) is amended—</text>
					<subparagraph id="H33FCC070B4DF4BB89791611395FAD9ED"><enum>(A)</enum><text>in subparagraph
			 (A)—</text>
						<clause id="HAB00BAABE0FF457E9653592F65F647A4"><enum>(i)</enum><text>by
			 striking <quote>back pay for each day of violation</quote> and inserting
			 <quote>two days’ pay multiplied by the number of calendar days for which the
			 employer was required but failed to provide notice before such closing or
			 layoff</quote>; and</text>
						</clause><clause id="H7613E8C2A4454F4189C4E030E3C747CA"><enum>(ii)</enum><text>in
			 clause (ii), by striking <quote>and</quote> at the end thereof;</text>
						</clause></subparagraph><subparagraph id="H0E8C1176685A4EDD80CADEED2545DD42"><enum>(B)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (C);</text>
					</subparagraph><subparagraph id="H264EF30730274C4D941907BE4B6BB070"><enum>(C)</enum><text>by inserting after
			 subparagraph (A) the following:</text>
						<quoted-block id="H096C2CC13B584D269A93FCD03FB9C5D7" style="OLC">
							<subparagraph id="H5B655C7403A44BCF8BFDB4663DDF0E71" indent="up1"><enum>(B)</enum><text>interest on the amount described in
				subparagraph (A) calculated at the prevailing rate;
				and</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HCE50F80F27014312A73AC4FC6F17C613"><enum>(D)</enum><text>by striking the
			 matter following subparagraph (C) (as so redesignated).</text>
					</subparagraph></paragraph><paragraph id="HEA0DB95CC3A746E49C74AF98B7A0C463"><enum>(2)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 5(a)(3) of
			 such Act (29 U.S.C. 2104(a)(3)) is amended by inserting <quote>, the Secretary,
			 or the Governor</quote> after <quote>unit of local government</quote>.</text>
				</paragraph><paragraph id="HEDBB19D9B3834877BA4D28658DF2432A"><enum>(3)</enum><header>Exemption</header><text display-inline="yes-display-inline">Section 5(a)(4) of such Act (29 U.S.C.
			 2104(a)(4)) is amended by striking <quote>reduce the amount of the liability or
			 penalty provided for in this section</quote> and inserting <quote>reduce the
			 amount of the liability under paragraph (1) and reduce the amount of the
			 penalty provided for in paragraph (3)</quote>.</text>
				</paragraph><paragraph id="HE6528216872E49B1AD45F86E9F0FEE21"><enum>(4)</enum><header>Administrative
			 complaint</header><text>Section 5(a)(5) of such Act (29 U.S.C. 2104(a)(5)) is
			 amended—</text>
					<subparagraph id="HCCCC4967E8BA407581CF66E95BEAD5BE"><enum>(A)</enum><text>by striking
			 <quote>may sue</quote> and inserting <quote>may,</quote>;</text>
					</subparagraph><subparagraph id="HE841DD592299437796451AFF8CD6DCEB"><enum>(B)</enum><text>by inserting after
			 <quote>both,</quote> the following: <quote>(A) file a complaint with the
			 Secretary alleging a violation of section 3, or (B) bring suit,</quote>;
			 and</text>
					</subparagraph><subparagraph id="H2D396D87B4774D949E83EF03A17F2FDD"><enum>(C)</enum><text>by adding at the
			 end thereof the following new sentence: <quote>A person seeking to enforce such
			 liability may use one or both of the enforcement mechanisms described in
			 subparagraphs (A) and (B).</quote>.</text>
					</subparagraph></paragraph><paragraph id="H3120D1F01F8E4DDB9AD690F88DB2CEDC"><enum>(5)</enum><header>Action by the
			 Secretary</header><text>Section 5 of such Act (29 U.S.C. 2104) is further
			 amended—</text>
					<subparagraph id="H2117C9F4F7AB4AE59D6E43CF555DDD1F"><enum>(A)</enum><text>by redesignating
			 subsection (b) as subsection (d); and</text>
					</subparagraph><subparagraph id="H0A027FD43DB04DF2965E590BAFAB7E1A"><enum>(B)</enum><text>by inserting after
			 subsection (a) the following new subsections:</text>
						<quoted-block id="H5F442ABE056F4C0E8EA60EAEE16A8F16" style="OLC">
							<subsection id="HEB3EF8F1C12F44A4AC973582C247251B"><enum>(b)</enum><header>Action by the
				Secretary</header>
								<paragraph id="H04C6AAAA412941CDBE01C826358014CC"><enum>(1)</enum><header>Administrative
				action</header><text>The Secretary shall receive, investigate, and attempt to
				resolve complaints of violations of section 3 by an employer in the same manner
				that the Secretary receives, investigates, and attempts to resolve complaints
				of violations of sections 6 and 7 of the Fair Labor Standards Act of 1938 (29
				U.S.C. 206 and 207).</text>
								</paragraph><paragraph id="H297447549F9941E0BC133C0B8313C412"><enum>(2)</enum><header>Subpoena
				powers</header><text>For the purposes of any investigation provided for in this
				section, the Secretary shall have the subpoena authority provided for under
				section 9 of the Fair Labor Standards Act of 1938 (29 U.S.C. 209).</text>
								</paragraph><paragraph commented="no" id="HD999C2E8A163497EA854B7F94AD257F2"><enum>(3)</enum><header>Civil
				action</header><text>The Secretary may bring an action in any court of
				competent jurisdiction to recover on behalf of an employee the backpay,
				interest, benefits, and liquidated damages described in subsection (a).</text>
								</paragraph><paragraph id="H3FE1CD7CA0F84FFDAF96308D89D2ACC7"><enum>(4)</enum><header>Sums
				recovered</header><text>Any sums recovered by the Secretary on behalf of an
				employee under subparagraphs (A) and (B) of subsection (a)(1) shall be held in
				a special deposit account and shall be paid, on order of the Secretary,
				directly to each employee affected. Any such sums not paid to an employee
				because of inability to do so within a period of 3 years, and any sums
				recovered by the Secretary under subparagraph (C) of subsection (a)(1), shall
				be credited as an offsetting collection to the appropriations account of the
				Secretary for expenses for the administration of this Act and shall remain
				available to the Secretary until expended.</text>
								</paragraph><paragraph id="H78127A3C8AAB49A8AA2361D194604093"><enum>(5)</enum><header>Action to compel
				relief by secretary</header><text>The district courts of the United States
				shall have jurisdiction, for cause shown, over an action brought by the
				Secretary to restrain the withholding of payment of back pay, interest,
				benefits, or other compensation, plus interest, found by the court to be due to
				employees under this Act.</text>
								</paragraph></subsection><subsection id="HCED2D834FEFB46FE9B417CCB72A79605"><enum>(c)</enum><header>Limitation</header><text>An
				action may be brought under this section not later than 2 years after the date
				of the last event constituting the alleged violation for which the action is
				brought.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HC355C356812C4F77839835988F6BA9E5"><enum>(d)</enum><header>Posting of
			 notices; penalties</header><text>Section 11 of the Worker Adjustment and
			 Retraining Notification Act (29 U.S.C. 2101 note) is amended to read as
			 follows:</text>
				<quoted-block id="H0DA609CA8135454EA032E217F43CD4B1" style="OLC">
					<section id="H1DC3884C0DAD4CE7810DA3654BD4DEEC"><enum>11.</enum><header>Posting of
				notices; penalties</header>
						<subsection id="HBA279FAB83EB4FCC899A314A8125E067"><enum>(a)</enum><header>Posting of
				notices</header><text>Each employer shall post and keep posted in conspicuous
				places upon its premises where notices to employees are customarily posted a
				notice to be prepared or approved by the Secretary setting forth excerpts from,
				or summaries of, the pertinent provisions of this Act and information pertinent
				to the filing of a complaint.</text>
						</subsection><subsection id="H29A988C9331F4B90BD32268371B33536"><enum>(b)</enum><header>Penalties</header><text>The
				Secretary may impose a civil penalty on any person who willfully violates this
				section of not more than $500 for each separate
				offense.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE3741488A067465396749896180DA7C3"><enum>(e)</enum><header>Non-Waiver of
			 rights and remedies; Information regarding benefits and services available to
			 employees</header><text>Such Act (29 U.S.C. 2101 et seq.) is further amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3850DFFF185A4CEF92643C7E27F81408" style="OLC">
					<section id="HBC7B45CDE0264C169EB183AEA7F3A1A9"><enum>12.</enum><header>Rights and
				remedies not subject to waiver</header>
						<subsection id="H1E097387EE3242A29BDCD935BC8A6F3F"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The rights and
				remedies provided under this Act (including the right to maintain a civil
				action) may not be waived, deferred, or lost pursuant to any agreement or
				settlement other than an agreement or settlement described in subsection
				(b).</text>
						</subsection><subsection id="H3C94F2F229AC436A94116E5623551FF7"><enum>(b)</enum><header>Agreement or
				settlement</header><text>An agreement or settlement referred to in subsection
				(a) is an agreement or settlement negotiated by the Secretary, an attorney
				general of any State, or a private attorney on behalf of affected
				employees.</text>
						</subsection></section><section id="H708B8B1DF4254A00B61502D13FA1B918"><enum>13.</enum><header>Information
				regarding benefits and services available to workers</header><text display-inline="no-display-inline">The Secretary of Labor shall maintain a
				guide of benefits and services which may be available to affected employees,
				including unemployment compensation, trade adjustment assistance, COBRA
				benefits, and early access to training services and other services, including
				counseling services, available under title I of the Workforce Investment Act of
				1998 (29 U.S.C. 2801). Such guide shall be available on the Internet website of
				the Department of Labor and shall include a description of the benefits and
				services, the eligibility requirements, and the means of obtaining such
				benefits and services. Upon receiving notice from an employer under section
				3(a)(2), the Secretary shall immediately transmit such guide to such
				employer.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H32C47011D6FD48D8AE102EF1B4296EF1"><enum>3.</enum><header>Authorization of
			 Appropriations</header><text display-inline="no-display-inline">In addition to
			 funds authorized to be appropriated for the general enforcement of the Worker
			 Adjustment and Retraining Notification Act (29 U.S.C. 2101 et seq.), there is
			 authorized to be appropriated to the Secretary of Labor such additional sums as
			 may be necessary for the additional enforcement authority authorized by the
			 amendments made by this Act.</text>
