		<official-title>To amend the Fair Housing Act to protect servicemembers
		  and veterans from housing discrimination, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Ending Housing Discrimination
			 Against Servicemembers and Veterans Act of 2012</short-title></quote>.</text>
		</section><section id="id9981D479CB164ED1886915CFE685366E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="id839896AF9BB34F15A7C2618E95AACD73"><enum>(1)</enum><text>Servicemembers
			 and veterans have given the United States the ultimate commitment to preserve
			 freedom and national security.</text>
			</paragraph><paragraph id="idd59d73f98a9d4b55b958ecc7c9246e98"><enum>(2)</enum><text>Those who are
			 serving or have served in the Armed Forces deserve the maximum protection
			 possible from discrimination based upon their military service.</text>
			</paragraph><paragraph id="id0182f12a5ca24e03929b2f255fb609bb"><enum>(3)</enum><text>Veterans have
			 historically suffered from homelessness at a higher rate than the general
			 population and ending this disgrace should be a national priority.</text>
			</paragraph><paragraph id="iddc9923bda21a4d34870c796d197d00b2"><enum>(4)</enum><text>Those who are
			 wearing or have worn the uniform of the United States should be entitled to
			 Federal protection from housing discrimination.</text>
			</paragraph></section><section id="id16DF65F97E0649B689134286993D19FA"><enum>3.</enum><header>Ending housing
			 discrimination against servicemembers and veterans</header>
			<subsection id="id65BA87BBC8B2478B83E96EEE21F822BF"><enum>(a)</enum><header>Definitions</header><text>Section
			 802 of the Fair Housing Act (42 U.S.C. 3602) is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2A474DB845DE421193E101AE84D27DCA" style="OLC">
					<subsection id="id40BAE1CDDF284D2F98378D39C074275A"><enum>(p)</enum><text><term>Servicemember
				or veteran</term> means an individual who serves or served in the Armed Forces,
				including in the National Guard or the Reserves (or in the National Guard in
				State status under title 32, United States Code), except that such term does
				not include an individual who was discharged or released from service under
				dishonorable
				conditions.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id93EDC0D4C592441B828064053EEDB9AB"><enum>(b)</enum><header>Discrimination
			 in the sale or rental of housing and other prohibited practices</header><text display-inline="yes-display-inline">Section 804 of the Fair Housing Act (42
			 U.S.C. 3604) is amended—</text>
				<paragraph id="idB81FE573CFA64EB385FF1E11475FE17D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>or
			 because the person is a servicemember or veteran</quote> after <quote>national
			 origin</quote>;</text>
				</paragraph><paragraph id="id5F53407B4587479488116D9EB7B85DD6"><enum>(2)</enum><text>in subsection
			 (b), by inserting <quote>or because the person is a servicemember or
			 veteran</quote> after <quote>national origin</quote>;</text>
				</paragraph><paragraph id="id11346CDF4D3345078C13DB4C7C9D21D2"><enum>(3)</enum><text>in subsection
			 (c), by inserting <quote>or because a person is a servicemember or
			 veteran,</quote> after <quote>national origin,</quote>; and</text>
				</paragraph><paragraph id="id41B7611EC2244BE78F60BECDAF2F9EC9"><enum>(4)</enum><text>in subsection
			 (d), by inserting <quote>, or because the person is a servicemember or
			 veteran,</quote> after <quote>national origin</quote>.</text>
				</paragraph></subsection><subsection id="idA0DB3F001A1D42F6801B3B1B2939D607"><enum>(c)</enum><header>Discrimination
			 in residential real estate-Related transactions</header><text>Section 805 of
			 the Fair Housing Act (42 U.S.C. 3605) is amended—</text>
				<paragraph id="idA027008B8526463A91DE0AC43688D6BA"><enum>(1)</enum><text>in subsection
			 (a), by inserting <quote>or because the person is a servicemember or
			 veteran</quote> after <quote>national origin</quote>; and</text>
				</paragraph><paragraph id="idB29960B9871343C19B2F34CD988B1CCE"><enum>(2)</enum><text>in subsection
			 (c), by striking <quote>, or familial status</quote> and inserting
			 <quote>familial status, or whether a person is a servicemember or
			 veteran</quote>.</text>
				</paragraph></subsection><subsection id="id51D656EE8DFB47D3B95EF1F1A3336666"><enum>(d)</enum><header>Discrimination
			 in the provision of brokerage services</header><text>Section 806 of the Fair
			 Housing Act (42 U.S.C. 3606) is amended by inserting <quote>or because a person
			 is a servicemember or veteran</quote> after <quote>national
			 origin</quote>.</text>
			</subsection><subsection id="id49A199A71D214B70BEA4132558B4FB42"><enum>(e)</enum><header>Religious
			 organization or private club exemption</header><text>Section 807(a) of the Fair
			 Housing Act (42 U.S.C. 3607(a)) is amended, in the first sentence by inserting
			 <quote>or to persons who are not servicemembers or veterans</quote> after
			 <quote>national origin</quote>.</text>
			</subsection><subsection id="idF5CD96100DFF4CC0BB94DE9CAF5187B0"><enum>(f)</enum><header>Administration</header><text>Section
			 808(e)(6) of the Fair Housing Act (42 U.S.C. 3608(e)(6)) is amended, in the
			 first sentence, by inserting <quote>(including whether such persons and
			 households are or include servicemembers or veterans)</quote> after
			 <quote>persons and households</quote>.</text>
			</subsection><subsection id="id40D2B18494A14932A2A0DE98F2EF6BFF"><enum>(g)</enum><header>Prevention of
			 discrimination</header><text>Section 901 of the Civil Rights Act of 1968 (42
			 U.S.C. 3631) is amended—</text>
				<paragraph id="id033E1A6444FF405B8299E4FB09D49F67"><enum>(1)</enum><text>in subsection
			 (a), by inserting <quote>, or because the person is a servicemember or veteran
			 (as such term is defined in section 802 of this Act),</quote> after
			 <quote>national origin</quote>;</text>
				</paragraph><paragraph id="idCE2528408CF749C3B81D717910672D74"><enum>(2)</enum><text>in subsection
			 (b)(1), by inserting <quote>or because a person is a servicemember or veteran
			 (as such term is defined in section 802 of this Act),</quote> after
			 <quote>national origin,</quote>; and</text>
				</paragraph><paragraph id="idE2A9147867B94FDE8FAC0B56955A1C2B"><enum>(3)</enum><text>in subsection
			 (c), by inserting <quote>or because a person is a servicemember or veteran (as
			 such term is defined in section 802 of this Act),</quote> after <quote>national
			 origin,</quote>.</text>
				</paragraph></subsection><subsection id="idD4A7CD901756435EB520ED7EB487B1A5"><enum>(h)</enum><header>Rule of
			 construction</header><text>The Fair Housing Act (42 U.S.C. 3601 et seq.) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id984CA0CD083E4E41ABC8E98DF0302E3E" style="OLC">
					<section id="idC3932553A166458CB590744C94E0FC2E"><enum>821.</enum><header>Rule of
				construction relating to the treatment of servicemembers and veterans</header>
						<subsection id="id5DCDF6338AEA4235AAE0A8C2119E650C"><enum>(a)</enum><header>Rule of
				construction</header><text display-inline="yes-display-inline">Nothing in this
				Act may be construed to prohibit any person from—</text>
							<paragraph id="idC3DBADF8BE68478481CAAE415CF51F39"><enum>(1)</enum><text display-inline="yes-display-inline">making available to an individual a benefit
				with respect to a dwelling, a residential real estate-related transaction (as
				defined in section 805 of this Act), or a service described in section 806 of
				this Act because the individual is a servicemember or veteran; or</text>
							</paragraph><paragraph id="idF458EAB816124488B9B8CA7B23D1F922"><enum>(2)</enum><text>selling or
				renting a dwelling only to servicemembers or veterans.</text>
							</paragraph></subsection><subsection id="idADF8CEE1E9314C4CBEFC52F741E78906"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>benefit</term> includes a term, condition, privilege, promotion,
				discount, or other favorable treatment (including an advertisement for such
				treatment) having the purpose or effect of providing an advantage to a
				servicemember or
				veteran.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
