<section id="H59BC0C2FB0784E77B3D7BCBE265EA5FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sexual Assault Forensic Evidence Reporting Act of 2012</short-title></quote> or the <quote><short-title>SAFER Act of 2012</short-title></quote>.</text></section> 
<section id="HA359A764544D410BAAC3C2D6D0648FAB"><enum>2.</enum><header>Debbie Smith grants for auditing sexual assault evidence backlogs</header><text display-inline="no-display-inline">Section 2 of the DNA Analysis Backlog Elimination Act of 2000 (42 U.S.C. 14135) is amended—</text> 
<paragraph id="H8F22158A02BA43B397525DDD08561208"><enum>(1)</enum><text>in subsection (a), by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H52FB32396E044CD89436E0F50DD42D2A" style="OLC"> 
<paragraph id="H647E0B2B099A42518978987DD17A846C"><enum>(6)</enum><text>To conduct an audit consistent with subsection (n) of the samples of sexual assault evidence that are in the possession of the State or unit of local government and are awaiting testing.</text></paragraph> 
<paragraph id="H6221C8D44AFF473E8D1A220708319DDB"><enum>(7)</enum><text>To ensure that the collection and processing of sexual assault evidence that is awaiting testing is carried out in an appropriate and timely manner and in accordance with the advisory guidelines developed under subsection (o)(1).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H100E3E29D6E94004A1353F792850A1D2"><enum>(2)</enum><text>in subsection (c), by adding at the end the following new paragraph:</text> 
<quoted-block id="HDB2D41E24E7447678D7825C3001F1774" style="OLC"> 
<paragraph id="H69D9367DDA704A9FAE83CB4E7C67A336"><enum>(4)</enum><header>Allocation of grant awards for audits</header><text>For each of fiscal years 2014 through 2017, not less than 5 percent, but not more than 7 percent, of the grant amounts distributed under paragraph (1) shall, if sufficient applications to justify such amounts are received by the Attorney General, be awarded for purposes described in subsection (a)(6), provided that none of the funds required to be distributed under this paragraph shall decrease or otherwise limit the availability of funds required to be awarded to States or units of local government under paragraph (3).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H41E17BF87D324CEAB937A09F72FD456C"><enum>(3)</enum><text>by adding at the end the following new subsections:</text> 
<quoted-block display-inline="no-display-inline" id="H5D858A9DCA0E45F2AE9A899B88C2F704" style="OLC"> 
<subsection id="H8407607F972A431FA2C66AD698FC12A7"><enum>(n)</enum><header>Use of Funds for Auditing Sexual Assault Evidence Backlogs</header> 
<paragraph id="HFC2203B17A9E4B2AAF216896057D2B2E"><enum>(1)</enum><header>Eligibility</header><text>The Attorney General may award a grant under this section to a State or unit of local government for the purpose described in subsection (a)(6) only if the State or unit of local government—</text> 
<subparagraph id="H71C129539EF04817A6CF6D859E910876"><enum>(A)</enum><text>submits a plan for performing the audit of samples described in such subsection; and</text></subparagraph> 
<subparagraph id="HBCBB886728B7418789FC026547A0D8AF"><enum>(B)</enum><text>includes in such plan a good-faith estimate of the number of such samples.</text></subparagraph></paragraph> 
<paragraph id="H279716AB8E0847379E6280B785C04314"><enum>(2)</enum><header>Grant conditions</header><text>A State or unit of local government receiving a grant for the purpose described in subsection (a)(6)—</text> 
<subparagraph id="HE7534C6FAE3D46E09058186FB1F6E91F"><enum>(A)</enum><text>may not enter into any contract or agreement with any non-governmental vendor laboratory to conduct an audit described in subsection (a)(6); and</text></subparagraph> 
<subparagraph id="H658328469F08469D9DD8ABE6C76020C9"><enum>(B)</enum><text>shall—</text> 
<clause id="HC80FC47FC2AB40BD812D3447DEBBA3DE"><enum>(i)</enum><text>not later than 1 year after receiving the grant, complete the audit referred to in paragraph (1)(A) in accordance with the plan submitted under such paragraph;</text></clause> 
<clause id="HEE762A4F5EEA4FA7A0AE1ABE17FA3649"><enum>(ii)</enum><text>not later than 60 days after receiving possession of a sample of sexual assault evidence that was not in the possession of the State or unit of local government at the time of the initiation of an audit under paragraph (1)(A), subject to paragraph (4)(F), include in any required reports under clause (v), the information listed under paragraph (4)(B);</text></clause> 
<clause id="H78D28DAEAF164B9D935D5F36BDDD1FDF"><enum>(iii)</enum><text>for each sample of sexual assault evidence that is identified as awaiting testing as part of the audit referred to in paragraph (1)(A)—</text> 
<subclause id="H92C1EC61F8D849B285971FC3F2E10BC9"><enum>(I)</enum><text>assign a unique numeric or alphanumeric identifier to each sample of sexual assault evidence that is in the possession of the State or unit of local government and is awaiting testing; and</text></subclause> 
<subclause id="HC7E54946B84F434399F3D08ED879AEBD"><enum>(II)</enum><text>identify the date or dates after which the State or unit of local government would be barred by any applicable statutes of limitations from prosecuting a perpetrator of the sexual assault to which the sample relates;</text></subclause></clause> 
<clause id="H9B2D370135044EA1A476F07AA1BEAAE5"><enum>(iv)</enum><text>provide that—</text> 
<subclause id="H3AA292E7288A4B2F9CF69B73FE6E28F8"><enum>(I)</enum><text>the chief law enforcement officer of the State or unit of local government, respectively, is the individual responsible for the compliance of the State or unit of local government, respectively, with the reporting requirements described in clause (v); or</text></subclause> 
<subclause id="H3B5DFD0F48694D7FB392C15A2E1FAFF6"><enum>(II)</enum><text>the designee of such officer may fulfill the responsibility described in subclause (I) so long as such designee is an employee of the State or unit of local government, respectively, and is not an employee of any governmental laboratory or non-governmental vendor laboratory; and</text></subclause></clause> 
<clause id="HBF3354F933384CCBBBCCB13390ACC56A"><enum>(v)</enum><text>comply with all grantee reporting requirements described in paragraph (4).</text></clause></subparagraph></paragraph> 
<paragraph id="H25038D892741490D98EA59451BF2E9D8"><enum>(3)</enum><header>Extension of initial deadline</header><text>The Attorney General may grant an extension of the deadline under paragraph (2)(B)(i) to a State or unit of local government that demonstrates that more time is required for compliance with such paragraph.</text></paragraph> 
<paragraph id="H1D1A246B44EE49E4810CD43A1F66B3BA"><enum>(4)</enum><header>Sexual assault forensic evidence reports</header> 
<subparagraph id="H56315B8D02564CE38B2B5337CA12BFCE"><enum>(A)</enum><header>In general</header><text>For not less than 12 months after the completion of an initial count of sexual assault evidence that is awaiting testing during an audit referred to in paragraph (1)(A), a State or unit of local government that receives a grant award under subsection (a)(6) shall, not less than every 60 days, submit a report to the Department of Justice, on a form prescribed by the Attorney General, which shall contain the information required under subparagraph (B).</text></subparagraph> 
<subparagraph id="H0A1E73629F544FAD964E51083D184B74"><enum>(B)</enum><header>Contents of reports</header><text>A report under this paragraph shall contain the following information:</text> 
<clause id="HF87522F31FC443D2A2BFA2BAFC353B01"><enum>(i)</enum><text>The name of the State or unit of local government filing the report.</text></clause> 
<clause id="HD922F89567154CDFABCD02EBF03C30BC"><enum>(ii)</enum><text>The period of dates covered by the report.</text></clause> 
<clause id="HB534CF739B744D4DB93A1E3D312BCD4B"><enum>(iii)</enum><text>The cumulative total number of samples of sexual assault evidence that, at the end of the reporting period—</text> 
<subclause id="H80777528DCA940E7B14A3A2DDE3AA439"><enum>(I)</enum><text>are in the possession of the State or unit of local government at the reporting period;</text></subclause> 
<subclause id="HACA1D819D04B461D84EC39C7FF7ED18C"><enum>(II)</enum><text>are awaiting testing; and</text></subclause> 
<subclause id="HA53C2ABE3BDC4FA68B17A83CED04034C"><enum>(III)</enum><text>the State or unit of local government has determined should undergo DNA or other appropriate forensic analyses.</text></subclause></clause> 
<clause id="H1B2A87BDDB3D488EB6810EEF9F20CE2B"><enum>(iv)</enum><text>The cumulative total number of samples of sexual assault evidence in the possession of the State or unit of local government that, at the end of the reporting period, the State or unit of local government has determined should not undergo DNA or other appropriate forensic analyses, provided that the reporting form shall allow for the State or unit of local government, at its sole discretion, to explain the reasoning for this determination in some or all cases.</text></clause> 
<clause id="H975C97EA43784428AB801DC376218970"><enum>(v)</enum><text>The cumulative total number of samples of sexual assault evidence in a total under clause (iii) that have been submitted to a laboratory for DNA or other appropriate forensic analyses.</text></clause> 
<clause id="H59D641B1136C4A908F56E1E2FE95D09B"><enum>(vi)</enum><text>The cumulative total number of samples of sexual assault evidence identified by an audit referred to in paragraph (1)(A) or under paragraph (2)(B)(ii) for which DNA or other appropriate forensic analysis has been completed at the end of the reporting period.</text></clause> 
<clause id="H5DFF2B2DBC41419D991200095C7D2E23"><enum>(vii)</enum><text>The total number of samples of sexual assault evidence identified by the State or unit of local government under paragraph (2)(B)(ii), since the previous reporting period.</text></clause> 
<clause id="H4B7A3E78990A4CC59C944473BA0534F5"><enum>(viii)</enum><text>The cumulative total number of samples of sexual assault evidence described under clause (iii) for which the State or unit of local government will be barred within 12 months by any applicable statute of limitations from prosecuting a perpetrator of the sexual assault to which the sample relates.</text></clause></subparagraph> 
<subparagraph id="HE8C45D04580D43249D5E78B9F0F33816"><enum>(C)</enum><header>Publication of reports</header><text>Not later than 7 days after the submission of a report under this paragraph by a State or unit of local government, the Attorney General shall, subject to subparagraph (D), publish and disseminate a facsimile of the full contents of such report on an appropriate internet website.</text></subparagraph> 
<subparagraph id="HC4524328DB164E3ABB1CF1AC8B1326F7"><enum>(D)</enum><header>Personally identifiable information</header><text>The Attorney General shall ensure that any information published and disseminated as part of a report under this paragraph, which reports information under this subsection, does not include personally identifiable information or details about a sexual assault that might lead to the identification of the individuals involved.</text></subparagraph> 
<subparagraph id="H65428C7F27C647009C77A733F2E2C23C"><enum>(E)</enum><header>Optional reporting</header><text>The Attorney General shall—</text> 
<clause id="HDABF5077F6A347E397EC95DC9400BD89"><enum>(i)</enum><text>at the discretion of a State or unit of local government required to file a report under subparagraph (A), allow such State or unit of local government, at their sole discretion, to submit such reports on a more frequent basis; and</text></clause> 
<clause id="H1A26B7008C474C6AAC6EABEA1459CB48"><enum>(ii)</enum><text>make available to all States and units of local government the reporting form created pursuant to subparagraph (A), whether or not they are required to submit such reports, and allow such States or units of local government, at their sole discretion, to submit such reports for publication.</text></clause></subparagraph> 
<subparagraph id="H34C46801A2E642779DA7D3E8F3C0916F"><enum>(F)</enum><header>Samples exempt from reporting requirement</header><text>The reporting requirements described in paragraph (2) shall not apply to a sample of sexual assault evidence that—</text> 
<clause id="HED985097F16F4501823206A4385FE81C"><enum>(i)</enum><text>is not considered criminal evidence (such as a sample collected anonymously from a victim who is unwilling to make a criminal complaint); or</text></clause> 
<clause id="H41A310076F0C4DBD97DC7A9AB564B2E0"><enum>(ii)</enum><text>relates to a sexual assault for which the prosecution of each perpetrator is barred by a statute of limitations.</text></clause></subparagraph></paragraph> 
<paragraph id="HF857DC32A61D4AB796B5BA0597796DFA"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H4D90EA9E0049484DB835B66D7BC7E61E"><enum>(A)</enum><header>Awaiting testing</header><text>The term <term>awaiting testing</term> means, with respect to a sample of sexual assault evidence, that—</text> 
<clause id="H4C0E933336684934992A763D5B2600D0"><enum>(i)</enum><text>the sample has been collected and is in the possession of a State or unit of local government;</text></clause> 
<clause id="H554CF460296346549C5EFE3347A7D150"><enum>(ii)</enum><text>DNA and other appropriate forensic analyses have not been performed on such sample; and</text></clause> 
<clause id="HE3FD1F5CABFA4DEE9BB11ECF28CD7D5F"><enum>(iii)</enum><text>the sample is related to a criminal case or investigation in which final disposition has not yet been reached.</text></clause></subparagraph> 
<subparagraph id="HFA1EDBFC2DA948E3BB3653F550754446"><enum>(B)</enum><header>Final disposition</header><text>The term <term>final disposition</term> means, with respect to a criminal case or investigation to which a sample of sexual assault evidence relates—</text> 
<clause id="H8F83531AF3A94C6A816286CFA8476D52"><enum>(i)</enum><text>the conviction or acquittal of all suspected perpetrators of the crime involved;</text></clause> 
<clause id="HF81CE04F9EB64785B0DCF7325B8FC8D6"><enum>(ii)</enum><text>a determination by the State or unit of local government in possession of the sample that the case is unfounded; or</text></clause> 
<clause id="HA24157EECBE64202A5C240BCF29F9B14"><enum>(iii)</enum><text>a declaration by the victim of the crime involved that the act constituting the basis of the crime was not committed.</text></clause></subparagraph> 
<subparagraph id="HFC57927B096C410ABD4A2515D0263777"><enum>(C)</enum><header>Possession</header> 
<clause id="HDAFDC135B89D4480BA5178461CE4372F"><enum>(i)</enum><header>In general</header><text>The term <term>possession</term>, used with respect to possession of a sample of sexual assault evidence by a State or unit of local government, includes possession by an individual who is acting as an agent of the State or unit of local government for the collection of the sample.</text></clause> 
<clause id="H28FCF638E37F485B996D84ED9591A6ED"><enum>(ii)</enum><header>Rule of construction</header><text>Nothing in clause (i) shall be construed to create or amend any Federal rights or privileges for non-governmental vendor laboratories described in regulations promulgated under section 210303 of the DNA Identification Act of 1994 (42 U.S.C. 14131).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H4BCAB39115B24510AEDE4802377F45A8"><enum>(o)</enum><header>Establishment of advisory guidelines, technical assistance, and definitions</header> 
<paragraph id="HD4226342252C48B4A98025A7E5B2AA8E"><enum>(1)</enum><header>Advisory guidelines</header><text>Not later than 18 months after the date of enactment of the <short-title>SAFER Act of 2012</short-title>, the Attorney General, in consultation with Federal, State, and local law enforcement agencies and government laboratories, shall develop and publish a report containing advisory guidelines the Attorney General considers appropriate for the accurate, timely, and effective collection and processing of sexual assault evidence that is awaiting testing, which shall address appropriate steps in the investigation of cases that might involve sexual assault evidence that is awaiting testing, including only—</text> 
<subparagraph id="H994AA059E31E49529BC67DB915D43269"><enum>(A)</enum><text>how to determine—</text> 
<clause id="HD0C2ECB6044641D7B664F695CDB352D8"><enum>(i)</enum><text>which evidence is to be collected by law enforcement personnel and forwarded for testing; and</text></clause> 
<clause id="H82A84DD3FE284F5DA533EE9B4145A1B4"><enum>(ii)</enum><text>what information to take into account when establishing the order in which evidence from different cases is to be tested;</text></clause></subparagraph> 
<subparagraph id="HEB43F782878349ADB07231EB2F67035B"><enum>(B)</enum><text>the establishment of a reasonable period of time in which evidence is to be forwarded by emergency response providers, law enforcement personnel, and prosecutors to a laboratory for testing;</text></subparagraph> 
<subparagraph id="HDF4FE0726CAA4EAAAAC4D0CBF07327C4"><enum>(C)</enum><text>systems to encourage communication within a State or unit of local government among emergency response providers, law enforcement personnel, prosecutors, courts, crime laboratory personnel, and crime victims regarding the status of sexual assault evidence to be tested; and</text></subparagraph> 
<subparagraph id="H0FEDB0BB145841DCA4491EE80986AC21"><enum>(D)</enum><text>standards for conducting the audit of the backlog of sexual assault evidence that is awaiting testing required under subsection (n).</text></subparagraph></paragraph> 
<paragraph id="HEE11C3F64A684570996886CCB88AF51D"><enum>(2)</enum><header>Technical assistance and training</header><text>The Attorney General shall make available technical assistance and training to support States and units of local government in adopting and implementing the guidelines developed under paragraph (1) on and after the date on which the guidelines are published.</text></paragraph> 
<paragraph id="HFDF2657430E647A882D8AF2F07C470FB"><enum>(3)</enum><header>Definitions</header><text>In this subsection, the terms <term>awaiting testing</term> and <term>possession</term> have the meanings given those terms in subsection (n).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HC74A46D306E64DFFA63399C088D46034"><enum>3.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Not later than 90 days after the end of each fiscal year for which a grant is made for the purpose described in section 2(a)(6) of the DNA Analysis Backlog Elimination Act of 2000, as amended by section 2, the Attorney General shall submit to Congress a report that—</text> 
<paragraph id="H1B962680DAB449E5B7962D619D78AC58"><enum>(1)</enum><text>lists the States and units of local government that have been awarded such grants and the amount of the grant received by each such State or unit of local government;</text></paragraph> 
<paragraph id="HB58950C2089B4B0D9F32702D25274ACD"><enum>(2)</enum><text>states the number of extensions granted by the Attorney General under section 2(n)(3) of the DNA Analysis Backlog Elimination Act of 2000, as added by section 2; and</text></paragraph> 
<paragraph id="HE115DD60ACA64BB1A3ECD95A67507BD4" commented="no"><enum>(3)</enum><text>summarizes the processing status of the samples of sexual assault evidence identified in Sexual Assault Forensic Evidence Reports established under section 2(o)(4) of the DNA Analysis Backlog Act of 2000, including the number of samples that have not been tested.</text></paragraph></section> 
<section id="H60E94CC2C2FE4171A23D4F420817556C"><enum>4.</enum><header>Reducing the rape kit backlog</header><text display-inline="no-display-inline">Section 2(c)(3) of the DNA Analysis Backlog Elimination Act of 2000 (42 U.S.C. 14135(c)(3)) is amended—</text> 
<subsection id="HD8195B048D00410C9BDC80E998046F05"><enum>(a)</enum><text>in subparagraph (B), by striking <quote>2014</quote> and inserting <quote>2018</quote>; and</text></subsection> 
<subsection id="H1BE1CED49E914E85B63DC0E8D3AF0AF3"><enum>(b)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H759DAC150C264C6583C117AA916EAFF0" style="OLC"> 
<paragraph id="HFEDE469E518144E0923B2BCA4F63DBD9"><enum>(3)</enum><text>For each of fiscal years 2014 through 2018, not less than 75 percent of the total grant amounts shall be awarded for a combination of purposes under paragraphs (1), (2), and (3) of subsection (a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H6F872A8339184DBC9946D22BA1EA6E52"><enum>5.</enum><header>Oversight and accountability</header><text display-inline="no-display-inline">All grants awarded by the Department of Justice that are authorized under this Act shall be subject to the following:</text> 
<paragraph id="HEEAB4286D54041158D83DBBD62301DD0"><enum>(1)</enum><header>Audit requirement</header><text>Beginning in fiscal year 2013, and each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of grants under this Act to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</text></paragraph> 
<paragraph id="H73F187853CB643458C081B4552DD81C5"><enum>(2)</enum><header>Mandatory exclusion</header><text>A recipient of grant funds under this Act that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this Act during the 2 fiscal years beginning after the 12-month period described in paragraph (5).</text></paragraph> 
<paragraph id="H9BD19AE23B52402D858AF40BEED2863E"><enum>(3)</enum><header>Priority</header><text>In awarding grants under this Act, the Attorney General shall give priority to eligible entities that, during the 3 fiscal years before submitting an application for a grant under this Act, did not have an unresolved audit finding showing a violation in the terms or conditions of a Department of Justice grant program.</text></paragraph> 
<paragraph id="H3ECE09CDAF344A3888705FFE3BA70B80"><enum>(4)</enum><header>Reimbursement</header><text>If an entity is awarded grant funds under this Act during the 2-fiscal-year period in which the entity is barred from receiving grants under paragraph (2), the Attorney General shall—</text> 
<subparagraph id="H665A99ED7A364EE3826045EF791DFEBD"><enum>(A)</enum><text>deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</text></subparagraph> 
<subparagraph id="H6A78A0735C934412B580D2FC4B34A08E"><enum>(B)</enum><text>seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</text></subparagraph></paragraph> 
<paragraph id="H2159DA6CA14A4664B27E7FB13FF7E7FA"><enum>(5)</enum><header>Defined term</header><text>In this section, the term <term>unresolved audit finding</term> means an audit report finding in the final audit report of the Inspector General of the Department of Justice that the grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within a 12-month period beginning on the date when the final audit report is issued.</text></paragraph> 
<paragraph id="H8ADDD777B3D94DECA37BB165D4F10FE3"><enum>(6)</enum><header>Nonprofit organization requirements</header> 
<subparagraph id="H5FC41135CAE44B8F820AB3FB837DA40A"><enum>(A)</enum><header>Definition</header><text>For purposes of this section and the grant programs described in this Act, the term <term>nonprofit organization</term> means an organization that is described in section 501(c)(3) of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text></subparagraph> 
<subparagraph id="H46CC28D4591A4D16AB041C54BF0937CF"><enum>(B)</enum><header>Prohibition</header><text>The Attorney General shall not award a grant under any grant program described in this Act to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in section 511(a) of the Internal Revenue Code of 1986.</text></subparagraph> 
<subparagraph id="H9363B37446EB4FC989D055BC649BAF08"><enum>(C)</enum><header>Disclosure</header><text>Each nonprofit organization that is awarded a grant under a grant program described in this Act and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subsection available for public inspection.</text></subparagraph></paragraph> 
<paragraph id="H162C28540F3D410499A434D687CAB028"><enum>(7)</enum><header>Administrative expenses</header><text>Unless otherwise explicitly provided in authorizing legislation, not more than 7.5 percent of the amounts authorized to be appropriated under this Act may be used by the Attorney General for salaries and administrative expenses of the Department of Justice.</text></paragraph> 
<paragraph id="H87933DE9A7934E52A63F5D907C90633E"><enum>(8)</enum><header>Conference expenditures</header> 
<subparagraph id="H1E9000D6939443898D97087277CE071F"><enum>(A)</enum><header>Limitation</header><text>No amounts authorized to be appropriated to the Department of Justice under this Act may be used by the Attorney General or by any individual or organization awarded discretionary funds through a cooperative agreement under this Act, to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or the appropriate Assistant Attorney General, Director, or principal deputy as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</text></subparagraph> 
<subparagraph id="H721E810052E4488A84CDEF6C83CC2DA0"><enum>(B)</enum><header>Written approval</header><text>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audio/visual equipment, honoraria for speakers, and any entertainment.</text></subparagraph> 
<subparagraph id="H49BC95D570B44039A1C99C6444E159DC"><enum>(C)</enum><header>Report</header><text>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all conference expenditures approved by operation of this paragraph.</text></subparagraph></paragraph> 
<paragraph id="H94FB1159906544DE80B68502C0CC4E93"><enum>(9)</enum><header>Prohibition on lobbying activity</header> 
<subparagraph id="H38F5C7E467894BEE92594C0E52498211"><enum>(A)</enum><header>In general</header><text>Amounts authorized to be appropriated under this Act may not be utilized by any grant recipient to—</text> 
<clause id="HB8D9E17F35454630ABC0A879331753F6"><enum>(i)</enum><text>lobby any representative of the Department of Justice regarding the award of grant funding; or</text></clause> 
<clause id="H2B2DDB02D81A424B8C819E530473E625"><enum>(ii)</enum><text>lobby any representative of a Federal, State, local, or tribal government regarding the award of grant funding.</text></clause></subparagraph> 
<subparagraph id="HCE92A5C7705248CBB6BBC0685D335CDE"><enum>(B)</enum><header>Penalty</header><text>If the Attorney General determines that any recipient of a grant under this Act has violated subparagraph (A), the Attorney General shall—</text> 
<clause id="HCE65E737871F4BA281472791BE8C2A0E"><enum>(i)</enum><text>require the grant recipient to repay the grant in full; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H174CEE9243EF4D41AE65F49ED1AEDD3A"><enum>(ii)</enum><text>prohibit the grant recipient from receiving another grant under this Act for not less than 5 years.</text></clause></subparagraph></paragraph></section> 
<section id="H33D8F035962A4EEB95B8275F4F5EB5DE"><enum>6.</enum><header>Sunset</header><text display-inline="no-display-inline">Effective on December 31, 2018, subsections (a)(6) and (n) of section 2 of the DNA Analysis Backlog Elimination Act of 2000 (42 U.S.C. 14135(a)(6) and (n)) are repealed.</text></section>
