		<section id="HBE95F8C0E96C44F49B22FD619BA6AEB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Goaling Act of
			 2012</short-title></quote>.</text>
		</section><section id="H57E8029505524178AEC4CFD9EF6D2874"><enum>2.</enum><header>Goals for
			 procurement contracts awarded to small business concerns</header>
			<subsection id="H0FB2D2524B4244A885C831DFE09615AF"><enum>(a)</enum><header>Heading</header><text display-inline="yes-display-inline">Section 15(g) of the Small Business Act (15
			 U.S.C. 644(g)) is amended by striking the subsection enumerator and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDD746F167A7E46F090E7B5B3E28B771A" style="OLC">
					<subsection id="HAB0CFC04C6C34E4FB7084A1BCEF252F7"><enum>(g)</enum><header>Goals for
				procurement contracts awarded to small business
				concerns</header>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H16079A9458404654AC3D735ACEFF0491"><enum>(b)</enum><header>Governmentwide
			 goals</header><text>Paragraph (1) of section 15(g) of the Small Business Act
			 (15 U.S.C. 644(g)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H4B38B8F437D14F52A91B77F08C9E72B8" style="OLC">
					<paragraph id="HD9FBEE42339A4D3AACEE5D0F31754531"><enum>(1)</enum><header>Governmentwide
				goals</header><text display-inline="yes-display-inline">The President shall
				annually establish Governmentwide goals for procurement contracts awarded to
				small business concerns, small business concerns owned and controlled by
				service-disabled veterans, qualified HUBZone small business concerns, small
				business concerns owned and controlled by socially and economically
				disadvantaged individuals, and small business concerns owned and controlled by
				women in accordance with the following:</text>
						<subparagraph id="H5203F3725D38407BA968D88F350ABD67"><enum>(A)</enum><text display-inline="yes-display-inline">The Governmentwide goal for participation
				by small business concerns shall be established at not less than 25 percent of
				the total value of all prime contract awards for each fiscal year and 40
				percent of the total value of all subcontract awards for each fiscal
				year.</text>
						</subparagraph><subparagraph id="H805AB593D75E4C67A07F2901E7B55B24"><enum>(B)</enum><text display-inline="yes-display-inline">The Governmentwide goal for participation
				by small business concerns owned and controlled by service-disabled veterans
				shall be established at not less than 3 percent of the total value of all prime
				contract and at not less than 3 percent of the total value of all subcontract
				awards for each fiscal year.</text>
						</subparagraph><subparagraph id="HBC740E28DA434B88BE265001093C1BFA"><enum>(C)</enum><text display-inline="yes-display-inline">The Governmentwide goal for participation
				by qualified HUBZone small business concerns shall be established at not less
				than 3 percent of the total value of all prime contract and at not less than 3
				percent of the total value of all subcontract awards for each fiscal
				year.</text>
						</subparagraph><subparagraph id="HE785B628C4BB4F2AB37E30CC70FC1851"><enum>(D)</enum><text display-inline="yes-display-inline">The Governmentwide goal for participation
				by small business concerns owned and controlled by socially and economically
				disadvantaged individuals shall be established at not less than 5 percent of
				the total value of all prime contract and at not less than 5 percent of the
				total value of all subcontract awards for each fiscal year.</text>
						</subparagraph><subparagraph id="H901CEB5E142A4A7CB69D32643192A1F5"><enum>(E)</enum><text display-inline="yes-display-inline">The Governmentwide goal for participation
				by small business concerns owned and controlled by women shall be established
				at not less than 5 percent of the total value of all prime contract and at not
				less than 5 percent of the total value of all subcontract awards for each
				fiscal year.</text>
						</subparagraph><subparagraph id="idBD26656E25C5406C9249899AF68EACC9"><enum>(F)</enum><text display-inline="yes-display-inline">The Administrator shall ensure that the
				cumulative annual prime contract goals for all agencies meet or exceed the
				annual Government-wide prime contract goal established by the President
				pursuant to this
				paragraph.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6E2117E01A564D7DA2E5F17663858680"><enum>(c)</enum><header>Agency
			 goals</header><text>Paragraph (2) of section 15(g) of the Small Business Act
			 (15 U.S.C. 644(g)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HA4475E17A71B425EAA3E4D54C4208946" style="OLC">
					<paragraph id="HA88EB426D15C4A0AB5A08B7685932D5F"><enum>(2)</enum><header>Agency
				goals</header>
						<subparagraph id="HE9A96D32196347ABAF756B3559381DB6"><enum>(A)</enum><header>Establishment</header><text>The
				head of each Federal agency shall annually establish, for the agency that
				individual heads, goals for procurement contracts awarded to small business
				concerns, small business concerns owned and controlled by service-disabled
				veterans, qualified HUBZone small business concerns, small business concerns
				owned and controlled by socially and economically disadvantaged individuals,
				and small business concerns owned and controlled by women.</text>
						</subparagraph><subparagraph id="H9A8AA5B4222445B29120228F1C0A8AAF"><enum>(B)</enum><header>Relationship to
				Governmentwide goals</header>
							<clause commented="no" id="H1E707E9412E24D6A963A0EF99EED7367"><enum>(i)</enum><header>Scope</header><text display-inline="yes-display-inline">The goals established by the head of a
				Federal agency under subparagraph (A) shall be in the same format as the goals
				established by the President under paragraph (1) and shall address both prime
				contract and subcontract awards.</text>
							</clause><clause id="H5BFCB19F796543388EBEED16B7A400EC"><enum>(ii)</enum><header>Requirement to
				meet or exceed Governmentwide goals</header><text display-inline="yes-display-inline">The participation percentage applicable to
				each goal for a fiscal year established under subparagraph (A) for small
				business concerns owned and controlled by service-disabled veterans, qualified
				HUBZone small business concerns, small business concerns owned and controlled
				by socially and economically disadvantaged individuals, and small business
				concerns owned and controlled by women may not be less than the participation
				percentage applicable to the Governmentwide goal for such fiscal year
				established under paragraph (1) for such category.</text>
							</clause></subparagraph><subparagraph id="HA6AF9F50FEAC4014B7C718EB3CF9E400"><enum>(C)</enum><header>Consultation
				required</header>
							<clause id="H8F53E618BEBD482EA9104F3313ACA6BA"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">In establishing goals
				under subparagraph (A), the head of each Federal agency shall consult with the
				Administrator.</text>
							</clause><clause id="H69E98CA37FD143D6853A6CDE199638A4"><enum>(ii)</enum><header>Disagreements</header><text>If
				the Administrator and the head of a Federal agency fail to agree on a goal
				established under subparagraph (A), the disagreement shall be submitted to the
				Administrator for Federal Procurement Policy for final determination.</text>
							</clause></subparagraph><subparagraph id="H539E7CE850164BEC887B3D1B4B9E1A79"><enum>(D)</enum><header>Plan for
				achieving goals</header><text>After establishing goals under subparagraph (A)
				for a fiscal year, the head of each Federal agency shall develop a plan for
				achieving such goals, which shall apportion responsibilities among the
				employees of such agency having procurement powers.</text>
						</subparagraph><subparagraph commented="no" id="H605677F446EB4050A969FFDB27074A4E"><enum>(E)</enum><header>Expanded
				participation</header><text display-inline="yes-display-inline">In establishing
				goals under subparagraph (A), the head of each Federal agency shall make a
				consistent effort to annually expand participation by small business concerns
				from each industry category in procurement contracts of such agency, including
				participation by small business concerns owned and controlled by
				service-disabled veterans, qualified HUBZone small business concerns, small
				business concerns owned and controlled by socially and economically
				disadvantaged individuals, and small business concerns owned and controlled by
				women.</text>
						</subparagraph><subparagraph commented="no" id="H307EE39698CB424BB6117FFF314D9BA8"><enum>(F)</enum><header>Consideration</header><text display-inline="yes-display-inline">The head of each Federal agency, in
				attempting to attain expanded participation under subparagraph (E), shall
				consider—</text>
							<clause commented="no" id="HB6446A87712C4608A7BA86F5E68EE381"><enum>(i)</enum><text>contracts awarded
				as the result of unrestricted competition; and</text>
							</clause><clause commented="no" id="H5380D31926644FC8BCCC3CCDF6AC8717"><enum>(ii)</enum><text>contracts awarded
				after competition restricted to eligible small business concerns under this
				section and under the program established under section 8(a).</text>
							</clause></subparagraph><subparagraph commented="no" id="HBDAFEDAA6CDD48689FAE1197C39613EE"><enum>(G)</enum><header>Communication
				regarding goals</header>
							<clause commented="no" id="H22019E112DA44A8683605370F1DD1F05"><enum>(i)</enum><header>Importance of
				achieving goals</header><text>Each procurement employee or program manager
				described in clause (ii) shall communicate to the subordinates of the
				procurement employee or program manager the importance of achieving goals
				established under subparagraph (A).</text>
							</clause><clause commented="no" id="H860C83F657CD4D5AAD2E958B2C9EE36F"><enum>(ii)</enum><header>Procurement
				employees or program managers described</header><text>A procurement employee or
				program manager described in this clause is a senior procurement executive,
				senior program manager, or Director of Small and Disadvantaged Business
				Utilization of a Federal agency having contracting
				authority.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3FF135CE05CE48D2995C1A1E06024FE0"><enum>(d)</enum><header>Enforcement;
			 Determinations of the total value of contract awards</header><text>Section
			 15(g) of the Small Business Act (15 U.S.C. 644(g)), as amended by this Act, is
			 further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8BFCB076D05344D394B11EEED4291751" style="OLC">
					<paragraph id="HF44E8B0B899D4D94B8671AE29E0B7809"><enum>(3)</enum><header>Enforcement</header><text>If
				the Administrator does not issue the report required in paragraph (2) on or
				before the date that is 120 days after the end of the prior fiscal year, the
				Administrator may not carry out or establish any pilot program until the date
				on which the Administrator issues the report.</text>
					</paragraph><paragraph id="HADE5EDE3E5834208A4ED34478D42C6AE"><enum>(4)</enum><header>Determinations
				of the total value of contract awards</header><text display-inline="yes-display-inline">For purposes of the goals established under
				paragraphs (1) and (2), the total value of contract awards for a fiscal year
				may not be determined in a manner that excludes the value of a contract based
				on—</text>
						<subparagraph id="H0EB503CBC28D4ACC990DF0789519A4D8"><enum>(A)</enum><text>where the contract
				is awarded;</text>
						</subparagraph><subparagraph id="H9631FC51D8B048DABDC86FB3DB9987EC"><enum>(B)</enum><text>where the contract
				is performed;</text>
						</subparagraph><subparagraph id="H3676BFD10241463BA0A4E64C55BC8F3B"><enum>(C)</enum><text display-inline="yes-display-inline">whether the contract is mandated by Federal
				law to be performed by an entity other than a small business concern;</text>
						</subparagraph><subparagraph id="HD61E16379AD94DF7918CD8A56EC8C1F7"><enum>(D)</enum><text>whether funding
				for the contract is made available in an appropriations Act, if the contract is
				subject to the Competition in Contracting Act; or</text>
						</subparagraph><subparagraph id="H1CBF20CE2C984204A221274ECE2E5335"><enum>(E)</enum><text>whether the
				contract is subject to the Federal Acquisition
				Regulation.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HE8E4BB13D55A458A9F366FC1667224A2"><enum>3.</enum><header>Reporting on
			 goals for procurement contracts awarded to small business
			 concerns</header><text display-inline="no-display-inline">Subsection (h) of
			 section 15 of the Small Business Act (15 U.S.C. 644) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="HE5E53DC446D44CE092F67D0BAB61A86D" style="OLC">
				<subsection id="HD368063138FD410EB84664C3B3CC322D"><enum>(h)</enum><header>Reporting on
				goals for procurement contracts awarded to small business concerns</header>
					<paragraph id="HEB661066134748EAB397F5C0169B5BBB"><enum>(1)</enum><header>Agency
				reports</header><text display-inline="yes-display-inline">At the conclusion of
				each fiscal year, the head of each Federal agency shall submit to the
				Administrator a report describing—</text>
						<subparagraph id="HADBD5817A5DC4653B4D41E37D4544E99"><enum>(A)</enum><text>the extent of the
				participation by small business concerns, small business concerns owned and
				controlled by veterans (including service-disabled veterans), qualified HUBZone
				small business concerns, small business concerns owned and controlled by
				socially and economically disadvantaged individuals, and small business
				concerns owned and controlled by women in the procurement contracts of such
				agency during such fiscal year;</text>
						</subparagraph><subparagraph id="HDDC78B125C1741C6B3442AB5BE6D2538"><enum>(B)</enum><text>whether the agency
				achieved the goals established for the agency under subsection (g)(2)(A) with
				respect to such fiscal year; and</text>
						</subparagraph><subparagraph id="H6E829C2C41AD4163A7101C28933BAA9E"><enum>(C)</enum><text display-inline="yes-display-inline">any justifications for a failure to achieve
				such goals.</text>
						</subparagraph></paragraph><paragraph id="HBCD849C017E54F629A8098D31C91A3A5"><enum>(2)</enum><header>Reports by
				Administrator</header><text>Not later than 60 days after receiving a report
				from each Federal agency under paragraph (1) with respect to a fiscal year, the
				Administrator shall submit to the President and Congress a report that
				includes—</text>
						<subparagraph id="H9F8A537B1C7144D6987ACE102A7979D2"><enum>(A)</enum><text>a copy of each
				report submitted to the Administrator under paragraph (1);</text>
						</subparagraph><subparagraph id="H0420D1972E844742BE1F6C58AC75A679"><enum>(B)</enum><text>a determination of
				whether each goal established by the President under subsection (g)(1) for such
				fiscal year was achieved;</text>
						</subparagraph><subparagraph id="HD008922F7415449CBC83C05570681E80"><enum>(C)</enum><text>a determination of
				whether each goal established by the head of a Federal agency under subsection
				(g)(2)(A) for such fiscal year was achieved;</text>
						</subparagraph><subparagraph id="H2B4331F7D0534C2FA279971B89DB1459"><enum>(D)</enum><text display-inline="yes-display-inline">the reasons for any failure to achieve a
				goal established under paragraph (1) or (2)(A) of subsection (g) for such
				fiscal year and a description of actions planned by the applicable agency to
				address such failure, except that the Administrator must concur with each
				remediation plan;</text>
						</subparagraph><subparagraph id="HF63FD9B68FD64E84A0CDCE81E053E61D"><enum>(E)</enum><text>for the Federal
				Government and each Federal agency, an analysis of the number and dollar amount
				of prime contracts awarded during such fiscal year to—</text>
							<clause id="H57EE109C5781411F87956AD1899F02D2"><enum>(i)</enum><text display-inline="yes-display-inline">small business concerns—</text>
								<subclause id="H80734232886643349B512A22D59AEA40"><enum>(I)</enum><text>in the
				aggregate;</text>
								</subclause><subclause id="HE0F16A9CB76A46FEB5D867BDE3E5C334"><enum>(II)</enum><text>through sole
				source contracts;</text>
								</subclause><subclause id="H232F4777909449A0B4A8775B898A2F11"><enum>(III)</enum><text>through
				competitions restricted to small business concerns; and</text>
								</subclause><subclause id="H6DF6712E1BE84350B30480C2377332BF"><enum>(IV)</enum><text>through
				unrestricted competition;</text>
								</subclause></clause><clause id="H918F86CC01FF48838A6555101C4AABB1"><enum>(ii)</enum><text display-inline="yes-display-inline">small business concerns owned and
				controlled by service-disabled veterans—</text>
								<subclause id="HE3D749F4468143B5B18E6E8F48CF507F"><enum>(I)</enum><text>in the
				aggregate;</text>
								</subclause><subclause id="H08A64BA811CB4405884C0A025DF6755A"><enum>(II)</enum><text>through sole
				source contracts;</text>
								</subclause><subclause id="HB032F96A87954977BAE294BFE55F1EE4"><enum>(III)</enum><text>through
				competitions restricted to small business concerns;</text>
								</subclause><subclause id="HE6531F30B7084CF79A9E382C0CF9B851"><enum>(IV)</enum><text>through
				competitions restricted to small business concerns owned and controlled by
				service-disabled veterans; and</text>
								</subclause><subclause id="HC0A0EA89EB774554983792DA349D6BF5"><enum>(V)</enum><text>through
				unrestricted competition;</text>
								</subclause></clause><clause id="HAE268ECD3B974975976872308573D7A3"><enum>(iii)</enum><text display-inline="yes-display-inline">qualified HUBZone small business
				concerns—</text>
								<subclause id="HF6C1593A057244DE87D0D26873A6985E"><enum>(I)</enum><text>in the
				aggregate;</text>
								</subclause><subclause id="H9D119637A7074FDE982E5611202C2883"><enum>(II)</enum><text>through sole
				source contracts;</text>
								</subclause><subclause id="H3D79B924012E40DAACDA5879E60D90CD"><enum>(III)</enum><text>through
				competitions restricted to small business concerns;</text>
								</subclause><subclause id="HA7D376EA497F47BA9963C0FF4ACF9906"><enum>(IV)</enum><text>through
				competitions restricted to qualified HUBZone small business concerns;</text>
								</subclause><subclause id="HBF7C67D1220742D093634817C2D95B5F"><enum>(V)</enum><text>through
				unrestricted competition where a price evaluation preference was used;
				and</text>
								</subclause><subclause id="HBB1557F0903E4EE38932041D0B83D067"><enum>(VI)</enum><text>through
				unrestricted competition where a price evaluation preference was not
				used;</text>
								</subclause></clause><clause id="H97220A906C81416090EB21A0EDB016AC"><enum>(iv)</enum><text display-inline="yes-display-inline">small business concerns owned and
				controlled by socially and economically disadvantaged individuals—</text>
								<subclause id="H021B07FF2C5E4EAEAC145A2446DEDA77"><enum>(I)</enum><text>in the
				aggregate;</text>
								</subclause><subclause id="H8A8DB3A938124BD18FD6A75D01874B60"><enum>(II)</enum><text display-inline="yes-display-inline">through sole source contracts;</text>
								</subclause><subclause id="H190BEAB9B21645A68DDB6626157AE361"><enum>(III)</enum><text>through
				competitions restricted to small business concerns;</text>
								</subclause><subclause id="H637365B7E5A74FA8AF062446131A40AA"><enum>(IV)</enum><text>through
				competitions restricted to small business concerns owned and controlled by
				socially and economically disadvantaged individuals; and</text>
								</subclause><subclause id="H6DDEE78D0DE641D186882C6DAC43EE2D"><enum>(V)</enum><text>through
				unrestricted competition;</text>
								</subclause></clause><clause id="H32DC649D93F847E09653F20F201FD959"><enum>(v)</enum><text display-inline="yes-display-inline">small business concerns owned by an Alaska
				Native Corporation—</text>
								<subclause id="H39A8110C1C594A01ACCD27E5BA40248D"><enum>(I)</enum><text>in the
				aggregate;</text>
								</subclause><subclause id="HB99E911F2C214436A2BF33470D6B38D7"><enum>(II)</enum><text>through sole
				source contracts;</text>
								</subclause><subclause id="H7159BC203D814B03A0E2A82F4FED3680"><enum>(III)</enum><text>through
				competitions restricted to small business concerns;</text>
								</subclause><subclause id="H850B582E11BE483DAC6F168C19FB19E5"><enum>(IV)</enum><text>through
				competitions restricted to small business concerns owned and controlled by
				socially and economically disadvantaged individuals; and</text>
								</subclause><subclause id="H6A10F9AEA83E418A8D221993CC8E710C"><enum>(V)</enum><text display-inline="yes-display-inline">through unrestricted competition;
				and</text>
								</subclause></clause><clause id="HEB2366DEB5254AD8A46651DDD3B9AB0A"><enum>(vi)</enum><text display-inline="yes-display-inline">small business concerns owned and
				controlled by women—</text>
								<subclause id="H4E7D03A0937648238EBCD14D4B1005CF"><enum>(I)</enum><text>in the
				aggregate;</text>
								</subclause><subclause id="HFD2B9E3328F74CC8B7EE1AE63353E508"><enum>(II)</enum><text>through
				competitions restricted to small business concerns;</text>
								</subclause><subclause id="H599A6660D72544F4A8868A7EAE054E20"><enum>(III)</enum><text>through
				competitions restricted using the authority under section 8(m)(2);</text>
								</subclause><subclause id="HB67FC4A5B6694BA9B40A8BFF9145635B"><enum>(IV)</enum><text display-inline="yes-display-inline">through competitions restricted using the
				authority under section 8(m)(2) and in which the waiver authority under section
				8(m)(3) was used; and</text>
								</subclause><subclause id="HCA8A4D226D0340FE930F20BCBE680057"><enum>(V)</enum><text>through
				unrestricted competition; and</text>
								</subclause></clause></subparagraph><subparagraph id="H09988D4F5D1B4DB7AB9050B0731CD210"><enum>(F)</enum><text display-inline="yes-display-inline">for the Federal Government and each Federal
				agency, the number, dollar amount, and distribution with respect to the North
				American Industry Classification System of subcontracts awarded during such
				fiscal year to small business concerns, small business concerns owned and
				controlled by service-disabled veterans, qualified HUBZone small business
				concerns, small business concerns owned and controlled by socially and
				economically disadvantaged individuals, and small business concerns owned and
				controlled by
				women.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD906D001336445EF8C2DB974E0C3878D"><enum>4.</enum><header>Senior
			 executives</header>
			<subsection id="H933E65499FD5478685A499813AEBFF8C"><enum>(a)</enum><header>Training</header><text display-inline="yes-display-inline">Section 3396(a) of title 5, United States
			 Code, is amended by adding at the end the following: <quote>A program
			 established under this subsection shall include training with respect to
			 Federal procurement requirements, including contracting requirements under the
			 Small Business Act (15 U.S.C. 631 et seq.).</quote>.</text>
			</subsection><subsection id="id4fd607e351874e3eabd6b23259936939"><enum>(b)</enum><header>Performance
			 appraisals</header><text>Section 4313 of title 5, United States Code, is
			 amended—</text>
				<paragraph id="idD12F1F42B66A48AB9E362EEE3F922785"><enum>(1)</enum><text>in paragraph (4),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id163684FDDF19404FBBFC21E5057A2310"><enum>(2)</enum><text>in paragraph (5),
