			 purposes</header>
			<subsection id="idb46bd5a210c042e3aa5241510090ebcb"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="id9098a46f2e5a4e1cbdef536091c676b5"><enum>(1)</enum><text>to fulfill the
			 trust responsibility of the United States to Indian tribes and to promote
			 tribal sovereignty and economic self-sufficiency, it is the policy of the
			 United States to settle water rights claims of Indian tribes without lengthy
			 and costly litigation;</text>
				</paragraph><paragraph id="id0f1fbbdc48fb49d5999d8b56342a3b15"><enum>(2)</enum><text>the Fort Belknap
			 Reservation was established in the State of Montana as a homeland for the Gros
			 Ventre and Assiniboine Tribes;</text>
				</paragraph><paragraph id="id24902e08065c4347bf4682993e1ec79a"><enum>(3)</enum><text>an adequate water
			 supply for the Fort Belknap Indian Community is important to a permanent,
			 sustainable, and sovereign homeland for the Gros Ventre and Assiniboine Tribes
			 and the members of those Indian tribes;</text>
				</paragraph><paragraph id="idaa48151ce7a249aebb44e7871e3c8ec5"><enum>(4)</enum><text>the sovereignty
			 of the Fort Belknap Indian Community and the economy of the Reservation depend
			 on the development of the water and other resources of the Reservation;</text>
				</paragraph><paragraph id="id1e01ad5a6d394fa5ad374e30332d8d23"><enum>(5)</enum><text>the planning,
			 design, and construction of the facilities needed to use reservation water
			 supplies and other resources effectively are necessary for—</text>
					<subparagraph id="id78edb951b1b242e1837342ab104728f0"><enum>(A)</enum><text>the development
			 of a viable Reservation economy; and</text>
					</subparagraph><subparagraph id="id0a909ec6c6c14bf38a64e02cea4f7202"><enum>(B)</enum><text>the
			 implementation of the water rights compact between the Fort Belknap Indian
			 Community and the State of Montana;</text>
					</subparagraph></paragraph><paragraph id="idd8f7af5b9c2c4b5090825c729e0a1179"><enum>(6)</enum><text>recognizing that
			 a final resolution of the adjudications of the Fort Belknap Indian Community
			 water rights pending in Federal and State courts will require many years and
			 great expense to all parties of the adjudications, prolong uncertainty
			 regarding the availability of water supplies, and seriously impair the
			 long-term economic planning and development of the parties, the Fort Belknap
			 Indian Community and the State entered into the Fort Belknap-Montana Water
			 Rights Compact on April 16, 2001;</text>
				</paragraph><paragraph id="id3348b938ced44aabb05aa06259965e52"><enum>(7)</enum><text>the allocation of
			 water resources from Lake Elwell to the Fort Belknap Indian Community under
			 this Act is uniquely suited to the geographical, social, and economic
			 characteristics of the area and situation;</text>
				</paragraph><paragraph id="ida2b3fd3df41546ea892e1e47af52e6e4"><enum>(8)</enum><text>changes in the
			 administration of the Milk River Project are necessary to satisfy the water
			 rights of the Fort Belknap Indian Community;</text>
				</paragraph><paragraph id="id6f0a884d1aab4051b69ece990adffcd6"><enum>(9)</enum><text>the Fort Belknap
			 Indian Community has held sacred certain land within and adjacent to the
			 present boundaries of the Fort Belknap Reservation that is now held in State,
			 public, and fee ownership status;</text>
				</paragraph><paragraph id="id8A6AE10248F6419DAAC491F7864F738B"><enum>(10)</enum><text>the land
			 described in paragraph (9) is within the ancestral territory of the Fort
			 Belknap Indian Community and has historical, cultural, and spiritual
			 significance for the Fort Belknap Indian Community; and</text>
				</paragraph><paragraph id="id3165904afbfe44adbddf08de6bb25dae"><enum>(11)</enum><text>the exchange,
			 acquisition, and transfer to trust status of the Federal, State, and fee land
			 land described in paragraph (9) for the benefit of the Fort Belknap Indian
			 Community will—</text>
					<subparagraph id="id730CFFAE3A26493587995C77F28896E4"><enum>(A)</enum><text>enable the Fort
			 Belknap Indian Community to consolidate and restore the trust land ownership of
			 the Reservation; and</text>
					</subparagraph><subparagraph id="id557209E4BED24729848B1179823E971C"><enum>(B)</enum><text>restore the
			 sacred, political, and legal bond the Fort Belknap Indian Community has
			 maintained to that land since time immemorial.</text>
					</subparagraph></paragraph></subsection><subsection id="id3ab8b0c6d8744e8189016542180d8797"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="idc77b411cf62142fa9a2704b98de1199d"><enum>(1)</enum><text>to achieve a
			 fair, equitable, and final settlement of all claims to water rights in the
			 State of Montana for—</text>
					<subparagraph id="idd9b2dc895fd14f07bc2c095f934926fe"><enum>(A)</enum><text>the Fort Belknap
			 Indian Community, the members of the Fort Belknap Indian Community, and
			 allottees of the Fort Belknap Indian Community living on the Reservation;
			 and</text>
					</subparagraph><subparagraph id="id9542f6156742449a92731d521f4c6098"><enum>(B)</enum><text>the United States
			 for the benefit of the Fort Belknap Indian Community, the members of the Fort
			 Belknap Indian Community, and allottees of the Fort Belknap Indian
			 Community;</text>
					</subparagraph></paragraph><paragraph id="id353298d2446f4510af2582df844572ec"><enum>(2)</enum><text>to authorize,
			 approve, and confirm the Fort Belknap Indian Community-Montana Water Rights
			 Compact entered into by the Fort Belknap Indian Community and the State of
			 Montana on April 16, 2001;</text>
				</paragraph><paragraph id="id15c712947ea24727af6cf4b4d72ae05a"><enum>(3)</enum><text>to authorize and
			 direct the Secretary—</text>
					<subparagraph id="id68ce7435291f4f5b8c9f311857b21304"><enum>(A)</enum><text>to execute the
			 Fort Belknap Indian Community-Montana Water Rights Compact;</text>
					</subparagraph><subparagraph id="id2f490624a7b5427da25c5fc17b7bf120"><enum>(B)</enum><text>to make available
			 funding from the Reclamation Water Settlement Fund established by section 10501
			 of the Omnibus Public Land Management Act of 2009 (43 U.S.C. 407); and</text>
					</subparagraph><subparagraph id="idf94a09dd05ea460eae6201feb9821017"><enum>(C)</enum><text>to take any other
			 action the Secretary determines to be necessary to implement the Compact in
			 accordance with this Act;</text>
					</subparagraph></paragraph><paragraph id="id72cf578f87f5462fae465fb1fc0ac7cc"><enum>(4)</enum><text>to authorize
			 certain economic development initiatives and projects on the
			 Reservation—</text>
					<subparagraph id="id1b917c84841a40d482049af35516edd5"><enum>(A)</enum><text>to implement the
			 Compact;</text>
					</subparagraph><subparagraph id="idedb45c8dadaa4e48812eb5af55072c2e"><enum>(B)</enum><text>to maximize the
			 benefits of the water rights memorialized in the Compact; and</text>
					</subparagraph><subparagraph id="idcf906ae590594affb0616e7258d503f8"><enum>(C)</enum><text>to ensure that
			 the cultural, economic, and social needs of the Fort Belknap Indian Community
			 are addressed in a manner that promotes self-sufficiency and
			 sovereignty;</text>
					</subparagraph></paragraph><paragraph id="id5195b7936e75423f94926e1e86202f7e"><enum>(5)</enum><text>to authorize
			 certain modifications to—</text>
					<subparagraph id="idd435fb574c9c4b639b783ed8a4dbaba7"><enum>(A)</enum><text>the purposes and
			 operation of the projects of the Bureau of Reclamation for Tiber Dam and Lake
			 Elwell on the Marias River in the State in order to provide the Fort Belknap
			 Indian Community with an allocation of water from Lake Elwell; and</text>
					</subparagraph><subparagraph id="id2e41bac7ca914657a5737fc50470b6e7"><enum>(B)</enum><text>the operations
			 and facilities of the Milk River Project in order to implement the
			 Compact;</text>
					</subparagraph></paragraph><paragraph id="id8914731fbc264df2b3c5c328864df0d0"><enum>(6)</enum><text>to ensure the
			 availability of amounts necessary for the implementation of the Compact and
			 this Act; and</text>
				</paragraph><paragraph id="idf066fe40186540cba85c10e9e490b444"><enum>(7)</enum><text>to authorize the
			 exchange, acquisition, and transfer of certain Federal, State, and fee
			 land.</text>
				</paragraph></subsection></section><section id="id1a547850d33a463b8b79f1aae1595331"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id71dbe75077664c75a975352367690716"><enum>(1)</enum><header>Allottee</header><text>The
			 term <term>allottee</term> means an individual Indian (or the successor of an
			 individual Indian) who owns or holds a trust allotment or interest in a trust
			 allotment on the Reservation under the Act of March 3, 1921 (41 Stat. 1355,
			 chapter 135), subject to the terms and conditions of that Act.</text>
			</paragraph><paragraph id="id91a94f2129ec4a3d9101fb8d61bd6668"><enum>(2)</enum><header>Commissioner</header><text>The
			 term <term>Commissioner</term> means the Commissioner of Reclamation.</text>
			</paragraph><paragraph id="idB45FE385E38443C4822B03C94AF9FA9C"><enum>(3)</enum><header>Compact</header><text>The
			 term <term>Compact</term> means the water rights agreement between the Fort
			 Belknap Indian Community and the State contained in section 85–20–1001 of the
			 Montana Code Annotated (2011), including any exhibit, part, or amendment to the
			 Compact.</text>
			</paragraph><paragraph id="id71a1b11a426b4ac993636bfea8c5047c"><enum>(4)</enum><header>Enforceability
			 date</header><text>The term <term>enforceability date</term> means the date on
			 which the Secretary publishes in the Federal Register the statement of findings
			 described in section 10(d).</text>
			</paragraph><paragraph id="id20bda71cb5de41fcb9ea887c14f17ed1"><enum>(5)</enum><header>Final</header><text>The
			 term <term>final</term>, with respect to the approval of the decree described
			 in section 4(c), means the completion of—</text>
				<subparagraph id="idb61d3ce4264c405bb6df53ed03864d02"><enum>(A)</enum><text>a direct appeal
			 to the Montana Supreme Court of a decree by the Montana Water Court, including
			 the expiration of time for filing of a direct appeal; or</text>
				</subparagraph><subparagraph id="idb6986ca93af74afbbfa84f4a773e4dac"><enum>(B)</enum><text>an appeal to the
			 appropriate court of the United States, including the expiration of time in
			 which a petition for certiorari may be filed in the Supreme Court, denial of
			 such a petition, or issuance of a final judgment of the Supreme Court,
			 whichever occurs last.</text>
				</subparagraph></paragraph><paragraph id="idd72bf417cb564fd9a2f11aeb3e2bcca9"><enum>(6)</enum><header>Fort belknap
			 indian community council</header><text>The term <term>Fort Belknap Indian
			 Community Council</term> means the governing body of the Fort Belknap Indian
			 Community.</text>
			</paragraph><paragraph id="id978c25c8ceb843228eb6410c7b21ae5a"><enum>(7)</enum><header>Fort belknap
			 indian community</header><text>The term <term>Fort Belknap Indian
			 Community</term> means the Gros Ventre and Assiniboine Tribes and members and
			 allottees of those Tribes, including the respective successors, heirs, and
			 assigns of the members and allottees, of the Fort Belknap Reservation of
			 Montana.</text>
			</paragraph><paragraph id="ideceddb0075a5471f9f5485cfdef5cb00"><enum>(8)</enum><header>Fresno
			 reservoir</header><text>The term <term>Fresno Reservoir</term> means the dam
			 and reservoir of the Milk River Project, located on the Milk River 14 miles
			 west of Havre, Montana, and authorized by the Act of June 16, 1933 (48 Stat.
			 195, chapter 90) (commonly known as the <quote>National Industrial Recovery
			 Act</quote>).</text>
			</paragraph><paragraph id="id91317b4004e7433a890014c0dd3c5a61"><enum>(9)</enum><header>Fund</header><text>The
			 term <quote>Fund</quote> means the Fort Belknap Indian Community Settlement
			 Fund established by section 11(a).</text>
			</paragraph><paragraph id="id303C6F4A7007404CB09E912FE369405C"><enum>(10)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 450b).</text>
			</paragraph><paragraph id="id9a6734dfa73544bbb2578d4e657f3da9"><enum>(11)</enum><header>Joint
			 board</header><text>The term <term>Joint Board</term> means the joint board of
			 control for the Milk River Project established in accordance with State
			 law.</text>
			</paragraph><paragraph id="id8f8e5d87f0e541229013fa44881d643c"><enum>(12)</enum><header>Malta
			 irrigation district</header><text>The term <term>Malta Irrigation
			 District</term> means the public corporation—</text>
				<subparagraph id="id38d28981ab794458a0ebcd9f6f0ee19e"><enum>(A)</enum><text>created on
			 December 28, 1923, pursuant to the laws of the State relating to irrigation
			 districts; and</text>
				</subparagraph><subparagraph id="id633732db48344d04b3fa4c3e9d6a7937"><enum>(B)</enum><text>headquartered in
			 Malta, Montana.</text>
				</subparagraph></paragraph><paragraph id="id19d623b359cb49bd95b33cdd7628e4ca"><enum>(13)</enum><header>Milk river
			 coordinating committee</header><text>The term <term>Milk River Coordinating
			 Committee</term> means the committee established by article IV.C of the
			 Compact.</text>
			</paragraph><paragraph id="id1dede8adc6b24ca4bd6aca31a8b3ebd2"><enum>(14)</enum><header>Milk river
			 project</header>
				<subparagraph id="idd149a092679f44938b0e6dd16e9ab4e7"><enum>(A)</enum><header>In
			 general</header><text>The term <term>Milk River Project</term> means the Bureau
			 of Reclamation project conditionally approved by the Secretary on March 14,
			 1903, pursuant to the Act of June 17, 1902 (32 Stat. 388, chapter 1093),
			 commencing at Lake Sherburne Reservoir and providing water through a point
			 approximately 6 miles east of Nashua, Montana.</text>
				</subparagraph><subparagraph id="idee6e579b8f3c4efc9d89724373c0d809"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>Milk River Project</term> includes—</text>
					<clause id="idd17540ecb29c4212b07e88063b843e0a"><enum>(i)</enum><text>the
			 St. Mary storage unit;</text>
					</clause><clause id="idb17bb57325b64ca3ba38bd0d796b522d"><enum>(ii)</enum><text>the Fresno Dam;
			 and</text>
					</clause><clause id="idd4c7b4504db249019b794acaa6f0c874"><enum>(iii)</enum><text>the Dodson
			 pumping unit.</text>
					</clause></subparagraph></paragraph><paragraph id="id2988c624cf414613bab00dfe54dd6682"><enum>(15)</enum><header>Missouri river
			 basin</header><text>The term <term>Missouri River Basin</term> means the
			 hydrologic basin of the Missouri River (including tributaries), except as
			 limited by the 1909 Boundary Waters Treaty between Canada and United
			 States.</text>
			</paragraph><paragraph id="ida992f23d1b704e7aae9d60d66581af72"><enum>(16)</enum><header>Pick-sloan
			 missouri river basin program</header><text>The term <term>Pick-Sloan Missouri
			 River Basin Program</term> means the Pick-Sloan Missouri River Basin Program
			 (authorized by section 9 of the Act of December 22, 1944 (commonly known as the
			 <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665)).</text>
			</paragraph><paragraph id="id1c4daf94284f47b7ba8db2874d7fba56"><enum>(17)</enum><header>Reservation</header>
				<subparagraph id="id4280EB482CB945DF99F7E9828ABD6D26"><enum>(A)</enum><header>In
			 general</header><text>The term <term>Reservation</term> means the area of the
			 Fort Belknap Reservation in the State, as defined in the Compact.</text>
				</subparagraph><subparagraph id="id963AE5F0FA8845DBA5F468A57795B0AE"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>Reservation</term> includes all land and interest in land that is
			 held in trust by the United States for the benefit of the Gros Ventre and
			 Assiniboine Tribes, including the land within the boundary established by the
			 Treaty ratified by the Act of May 1, 1888 (25 Stat. 113, chapter 212), as
			 modified by the Grinnell Agreement of October 9, 1895 (ratified by the Act of
			 June 10, 1896 (29 Stat. 350, chapter 398) and the Act of March 3, 1931 (41
			 Stat. 1355, chapter 135).</text>
				</subparagraph></paragraph><paragraph id="id851f18a94fc44d60876124b8ecfb067b"><enum>(18)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id6ef73c30b72f468a9ed8be5c026aabc0"><enum>(19)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Montana.</text>
			</paragraph><paragraph id="id4b7a89fd4f2f48eaa3a1dbf17804e9cc"><enum>(20)</enum><header>Tribal water
			 code</header><text>Notwithstanding the requirements of Article IV, section A.2.
			 of the Compact, the term <term>Tribal Water Code</term> means a water code
			 adopted by the Fort Belknap Indian Community in accordance with section
			 5(c).</text>
			</paragraph><paragraph id="id697a8673d1224fa1ad330b07381a5645"><enum>(21)</enum><header>Tribal water
			 rights</header><text>The term <term>tribal water rights</term> means—</text>
				<subparagraph id="id8a7eb10bccec43568f651c89c381c2c4"><enum>(A)</enum><text>the water rights
			 of the Fort Belknap Indian Community established in Article III of the
			 Compact;</text>
				</subparagraph><subparagraph id="id279c6a96e99b4d3f9d865bacacbb5e49"><enum>(B)</enum><text>the allocation of
			 water to the Fort Belknap Indian Community from Lake Elwell under section 7;
			 and</text>
				</subparagraph><subparagraph id="ida5fef5617c6d4ff5aa0a2392baf7cc5b"><enum>(C)</enum><text>the water rights
			 of allottees.</text>
				</subparagraph></paragraph></section><section id="id9f40269c20294418b6afbc5025ff6901"><enum>4.</enum><header>Approval of
			 compact and judicial decree</header>
			<subsection id="idb1017a0e2ecb45e0927f61a5d5d3cfeb"><enum>(a)</enum><header>Approval of
			 compact</header>
				<paragraph id="id681362e382f84c669b80ab7ccd980d9e"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise provided in this Act and to the
			 extent the Compact does not conflict with this Act, the Compact is authorized,
			 approved, and confirmed.</text>
				</paragraph><paragraph id="id11c9b0b541654d14bbd26eb6f561d53a"><enum>(2)</enum><header>Amendments to
			 compact</header><text>If amendments are executed to make the Compact consistent
			 with this Act, those amendments are authorized, approved, and confirmed to the
			 extent those amendments are consistent with this Act.</text>
				</paragraph></subsection><subsection id="idda098413bac442bab443ee9d3fca91c2"><enum>(b)</enum><header>Execution of
			 compact</header><text>On the approval of the Compact by a majority of those
			 eligible members of the Fort Belknap Indian Community casting votes on the day
			 of the vote on the Compact, the Secretary shall—</text>
				<paragraph id="id94e2c5c3ad504ee5b3aa1d6a3d652edb"><enum>(1)</enum><text>promptly execute
			 and implement the Compact, including all exhibits to or parts of the Compact
			 requiring the signature of the Secretary; and</text>
				</paragraph><paragraph id="idf0e026c3371a452590a4061eba6672a2"><enum>(2)</enum><text>take such other
			 actions as are necessary to implement the Compact, including approving
			 modifications to appendices and exhibits to the Compact not inconsistent with
			 this Act, to the extent those modifications do not otherwise require
			 Congressional approval pursuant to section 2116 of the Revised Statutes (25
			 U.S.C. 177) or other applicable Federal law.</text>
				</paragraph></subsection><subsection id="id59b9d01c8fc041c89612f0b056ed3562"><enum>(c)</enum><header>Approval of
			 judicial decree</header>
				<paragraph id="id8cda3d18f6e449928d1430f966a941b4"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date on which the
			 Compact is approved under subsection (b) or the date of enactment of this Act,
			 whichever is later, the United States, the Fort Belknap Indian Community, and
			 the State shall submit to the Montana Water Court, individually or jointly, a
			 petition to approve the decree agreed to by the United States, the Fort Belknap
			 Indian Community, and the State, identified as Appendix 1 to the Compact
			 (including any amendment to the decree).</text>
				</paragraph><paragraph id="ide8b691467a484bd1a136fd8f0d51da28"><enum>(2)</enum><header>Federal united
			 states court</header><text>If the circumstances described in article VII.C.2 of
			 the Compact occur, the United States, the Fort Belknap Indian Community, or the
			 State may submit to the United States district court with appropriate
			 jurisdiction a petition to enter as a consent decree in the United States
			 district court the decree described in paragraph (1).</text>
				</paragraph><paragraph id="id79fd36c62ac646e585295a6b1efaef51"><enum>(3)</enum><header>Effect of
			 failure of approval</header>
					<subparagraph id="idd6ef31ac95b9428fa3106d49ba294bd1"><enum>(A)</enum><header>In
			 general</header><text>If a circumstance described in subparagraph (B)
			 occurs—</text>
						<clause id="id4b88efe178fe4e2f9c1ba3071ccc0192"><enum>(i)</enum><text>the
			 approval of the Compact under subsection (a) shall be void; and</text>
						</clause><clause id="id7a1dfcbefb22479bb6702940f3d274cc"><enum>(ii)</enum><text>the authority
			 under this Act shall terminate.</text>
						</clause></subparagraph><subparagraph id="id2909c25851cd4385858a4e3ab36a9812"><enum>(B)</enum><header>Circumstance</header><text>A
			 circumstance referred to in subparagraph (A) is that—</text>
						<clause id="ide7a644329d3a4736ae434280e085f793"><enum>(i)</enum><text>the
			 Montana Water Court and the United States district court of jurisdiction, as
			 applicable, fail to approve the decree described in paragraph (1) during the
			 5-year period beginning on the date on which the decree is filed in the
			 court;</text>
						</clause><clause id="id56d88e5aea4f4ac6b5b7d985dc3dceae"><enum>(ii)</enum><text>the decree is
			 approved but subsequently set aside by the Montana Water Court or the United
			 States district court; or</text>
						</clause><clause id="id1ff71fa2b4354309a5d9150c9b1f6f33"><enum>(iii)</enum><text>the decree is
			 set aside on direct appeal.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id16e8e9b345a74f37a3a6530bc091136d"><enum>(d)</enum><header>Filing for
			 appointment of water commissioner</header><text>On submission of a petition
			 described in paragraph (1) or (2) of subsection (b), the United States, the
			 Fort Belknap Indian Community, and the State shall jointly petition the
			 appropriate court for appointment of a water commissioner in accordance with
			 article VII.B.3 of the Compact, who shall be appointed not later than 180 days
			 after the date on which the final decree is issued.</text>
			</subsection></section><section id="id768e3f492eb84bdd82ef38831fdd4446"><enum>5.</enum><header>Tribal water
			 rights</header>
			<subsection id="id3a866cf061f4453abf253b59731c04a0"><enum>(a)</enum><header>Treatment</header>
				<paragraph id="id0fd09746974944c09b5f69cc3963d957"><enum>(1)</enum><header>Holding in
			 trust</header><text>The tribal water rights—</text>
					<subparagraph id="id6350c92e28f64a928501bd802c88cc50"><enum>(A)</enum><text>shall be held in
			 trust by the United States for the use and benefit of the Fort Belknap Indian
			 Community and allottees in accordance with this section; and</text>
					</subparagraph><subparagraph id="id780639e025b043e4b282149b9c20338b"><enum>(B)</enum><text>shall not be
			 subject to forfeiture or abandonment.</text>
					</subparagraph></paragraph><paragraph id="id3f76a69b7c1746d5b07054ef2d2b3e88"><enum>(2)</enum><header>Allottees</header><text>Each
			 allottee shall be provided tribal water rights that are equivalent to or exceed
			 the tribal water rights that allottees have on the day before the date of
			 enactment of this Act, taking into consideration—</text>
					<subparagraph id="ide15566d607ea4e9d8840f5c4c93faa0a"><enum>(A)</enum><text>the potential
			 risks, cost, and time delay associated with litigation that would be resolved
			 by the Compact and this Act;</text>
					</subparagraph><subparagraph id="id95b2cbcffdcb4da68426afaf6f3490b8"><enum>(B)</enum><text>the availability
			 of funding under this Act and from other sources;</text>
					</subparagraph><subparagraph id="idcdf05af3e412434a814c1cd6b9a38744"><enum>(C)</enum><text>the availability
			 of water from the tribal water rights; and</text>
					</subparagraph><subparagraph id="id26bee9ea84a94cde95ff05008b6b17be"><enum>(D)</enum><text>the applicability
			 of section 7 of the Act of February 8, 1887 (25 U.S.C. 381) and this Act to
			 protect the interests of allottees.</text>
					</subparagraph></paragraph></subsection><subsection id="id47e7698d705c461d9eec05174c90e271"><enum>(b)</enum><header>Right to
			 use</header><text>Each right to Federal reserved water of a member of the Fort
			 Belknap Indian Community, an allottee, or an owner of fee land located within
			 the Reservation—</text>
				<paragraph id="id692dcf2a1d0f426e9eb5a318a2d05e5f"><enum>(1)</enum><text>shall be
			 considered to be satisfied by the tribal water rights; and</text>
				</paragraph><paragraph id="idf4efa277d11e4320b708f37fc5105a34"><enum>(2)</enum><text>shall be governed
			 by the terms and conditions of the Compact, this Act, and the Tribal Water
			 Code.</text>
				</paragraph></subsection><subsection id="idb95b8e9ec5b540d187411ad839f6d519"><enum>(c)</enum><header>Tribal water
			 code</header>
				<paragraph id="idb8e4e4312d32419cae44d112db466e5b"><enum>(1)</enum><header>Enactment</header><text>Not
			 later than 3 years after the date on which the decree is approved by the
			 appropriate court under section 4(b), the Fort Belknap Indian Community shall
			 enact a Tribal Water Code, subject to applicable laws, that—</text>
					<subparagraph id="id1dd05fb4ff0540fb87e1fa2d744636d7"><enum>(A)</enum><text>regulates the
			 tribal water rights to provide for irrigation, domestic, commercial, municipal,
			 industrial, cultural, recreational, and other uses; and</text>
					</subparagraph><subparagraph id="id2ef47e1c69e245e39a3fd8bac0e729dc"><enum>(B)</enum><text>includes a due
			 process system—</text>
						<clause id="id134cad363e2f48bd90834cccc1471192"><enum>(i)</enum><text>for
			 the consideration and determination of any request by an allottee, or any
			 successor in interest to an allottee, for an allocation of water under the
			 tribal water rights for any lawful purpose on allotted land, including a
			 process for—</text>
							<subclause id="idd213a7ec088448c89a9750eac0e18dba"><enum>(I)</enum><text>appeal and
			 adjudication of denied or disputed distributions of water; and</text>
							</subclause><subclause id="idaf33d7574c4c4e5ab98eabbf07180891"><enum>(II)</enum><text>resolution of
			 contested administrative decisions relating to the tribal water rights;</text>
							</subclause></clause><clause id="idf904b82766e54d15941d45360c87f280"><enum>(ii)</enum><text>to
			 protect the interest of allottees when entering into any lease under subsection
			 (e);</text>
						</clause><clause id="id20c3bae28022469fba35ceb41ecb0595"><enum>(iii)</enum><text>by which an
			 owner of fee land within the Reservation may apply for any lawful use of water
			 under the tribal water rights; and</text>
						</clause><clause id="id4543c018e5db4cedb2d7b0a8980e2771"><enum>(iv)</enum><text>for the
			 establishment and management of a controlled groundwater area in cooperation
			 with establishment of a contiguous controlled groundwater area off the
			 Reservation established pursuant to section B.2. of Article IV of the Compact
			 and State law.</text>
						</clause></subparagraph></paragraph><paragraph id="id7435f69db77243c48f3acd83e08537d4"><enum>(2)</enum><header>Action by
			 secretary</header>
					<subparagraph id="id82415ec7be8c4ad6bd18c933b4027fbe"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall administer the tribal water rights
			 until the Tribal Water Code is enacted in accordance with paragraph (1) and
			 approved under subparagraph (B).</text>
					</subparagraph><subparagraph id="id79e0f7170efb42a4a27ef6c30f602427"><enum>(B)</enum><header>Approval</header><text>The
			 Tribal Water Code shall not be valid unless—</text>
						<clause id="id4c2479978583449288ad4ac76e760814"><enum>(i)</enum><text>the
			 Tribal Water Code is approved by the Secretary; and</text>
						</clause><clause id="idf377a7d330a84164acfd666a56934bba"><enum>(ii)</enum><text>each amendment
			 to the Tribal Water Code that affects the rights of an allottee is approved by
			 the Secretary.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idba53980da16c48b2a647766146da91a5"><enum>(d)</enum><header>Exhaustion of
			 remedies</header><text>A member of the Fort Belknap Indian Community, an
			 allottee, or an owner of fee land within the Reservation shall not bring a
			 claim relating to water under the tribal water rights against the United States
			 under section 7 of the Act of February 8, 1887 (25 U.S.C. 381), or any other
			 applicable law, or otherwise request relief from the Secretary, until the
			 member, allottee, or fee land owner exhausts each applicable remedy under the
			 Tribal Water Code or other applicable tribal law.</text>
			</subsection><subsection id="id5960f6e4eefa4affbc301e5f9709f4e9"><enum>(e)</enum><header>Temporary
			 transfer of tribal water rights</header>
				<paragraph id="ida5575a2ed749473cb1b3e1e8e875e3bc"><enum>(1)</enum><header>In
			 general</header><text>On approval of the Secretary and the State as required
			 under article IV.A.5 of the Compact, the Fort Belknap Indian Community may
			 temporarily transfer by service contract, lease, exchange, or other agreement,
			 certain portions of the tribal water rights, in accordance with article IV.A.5
			 of the Compact, for use off the Reservation within the Missouri River Basin,
			 except as limited by the 1909 Boundary Waters Treaty between Canada and United
			 States.</text>
				</paragraph><paragraph id="id40e89c915f1a4145a5201151a4f4e68c"><enum>(2)</enum><header>Requirements</header><text>An
			 agreement under paragraph (1)—</text>
					<subparagraph id="id9a06f8b4f8d242269a4be52d176b62e0"><enum>(A)</enum><text>shall be for a
			 term of not more than 100 years;</text>
					</subparagraph><subparagraph id="ide5cf8d8b117d4228b1c8cf338f6d294d"><enum>(B)</enum><text>may include
			 provisions for renewal of the agreement for an additional term of not more than
			 100 years; and</text>
					</subparagraph><subparagraph id="id2b8523b3962c4b0ca44803b7542f724d"><enum>(C)</enum><text>shall not
			 permanently alienate any portion of the tribal water rights.</text>
					</subparagraph></paragraph></subsection><subsection id="ide1dd067055d249059623d8df753c9f0b"><enum>(f)</enum><header>Pick-Sloan
			 missouri river basin program power rates</header><text>The Secretary, in
			 cooperation with the Secretary of Energy, shall make available, at project use
			 power pumping preferred rates established as of the date of enactment of this
			 Act, Pick-Sloan Missouri River Basin Program pumping power to not more than
			 27,000 net acres under irrigation pursuant to projects of the Fort Belknap
			 Indian Community.</text>
			</subsection><subsection id="id35c9115a52af4108baa971fad0ba99a9"><enum>(g)</enum><header>Milk river
			 water rights</header>
				<paragraph id="id5964125283bb49a4ba88006a81c8c883"><enum>(1)</enum><header>Identification
			 of alternatives</header><text>The Secretary shall identify and implement
			 alternatives to resolve any conflict between the Milk River water rights of the
			 Blackfeet Tribe and the Fort Belknap Indian Community in a manner that ensures
			 that the full allocation of the water rights of each Indian tribe under the
			 water rights compacts of the Indian tribes are fully satisfied.</text>
				</paragraph><paragraph id="id216945fcae8b41f7a06b4ef8ac991c11"><enum>(2)</enum><header>Agreement of
			 tribes</header><text>The Secretary shall obtain the agreement of the Blackfeet
			 Tribe and the Fort Belknap Indian Community to any alternative identified under
			 subsection (a).</text>
				</paragraph><paragraph id="id728a0a5471fc4f78b9eb94f73f745c3f"><enum>(3)</enum><header>Funding</header><text>Amounts
			 used by the Secretary to implement any alternative identified under subsection
			 (a) shall be in addition to the amounts authorized for the water rights
			 settlements of the Blackfeet Tribe and the Fort Belknap Indian
			 Community.</text>
				</paragraph></subsection></section><section id="ided8048de3f024762b1b493c843ca25bb"><enum>6.</enum><header>Exchange,
			 acquisition, and transfer of public land into trust</header>
			<subsection id="id15f7fa77609a467f8a2eb78cc0890685"><enum>(a)</enum><header>Exchange of
			 State land</header>
				<paragraph id="id94d2d3874aee4342bbc999dd490389f8"><enum>(1)</enum><header>In
			 general</header><text>In partial satisfaction of claims relating to Indian
			 water rights covered by this Act, the Fort Belknap Indian Community shall
			 request and agree to the exchange and transfer of land in accordance with this
			 subsection.</text>
				</paragraph><paragraph id="id47AA7E64F95949D2B25450287BDCB76E"><enum>(2)</enum><header>State
			 land</header><text>The Secretary shall offer to enter into negotiations with
			 the State for the purpose of exchanging Federal land described in paragraph (3)
			 for the following parcels of land owned by the State, located on and off the
			 Reservation:</text>

			 a land exchange under this subsection, the Secretary may exchange any Federal
			 land not identified for disposal pursuant to a resource management plan
			 developed under the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1701 et seq.), including any Bureau of Reclamation land located in section 1,
			 2, 11, or 12 of T. 31 N., R. 32 E.</text>
				</paragraph><paragraph id="ide98554a4b0f946ecac94ad2ba5c04199"><enum>(4)</enum><header>Requirements</header>
					<subparagraph id="id3b43a8e8bd3740f5896d36538110b751"><enum>(A)</enum><header>Value and
			 acreage</header><text>The Secretary shall ensure that—</text>
						<clause id="idf45b3107677b4f688aa634627c2851f9"><enum>(i)</enum><text>the
			 value of any Federal land exchanged for State land under this subsection is
			 equal to or greater than the value of the State land; and</text>
						</clause><clause id="id7933f830100c466fa4dcb1110afb395b"><enum>(ii)</enum><text>the acreage of
			 any Federal land exchanged for State land under this subsection is equal to or
			 greater than the acreage of the State land, unless the Secretary and the State
			 specifically agree otherwise.</text>
						</clause></subparagraph><subparagraph id="id1430eda2e1374251b42367da012bb437"><enum>(B)</enum><header>Basis</header><text>Unless
			 the Secretary and the State specifically agree otherwise, each land exchange
			 under this subsection shall be on a whole-estate for whole-estate basis.</text>
					</subparagraph></paragraph><paragraph id="idee2cf485beba4e3fa4946e1e4d19b50d"><enum>(5)</enum><header>Eligibility of
			 other State parcels</header><text>If, at any time after the date of enactment
			 of this Act, the Fort Belknap Community Council enters into a lease for any
			 other State parcel or secures the written consent of each lessee of any other
			 State parcel, the other State parcel shall be eligible for exchange under this
			 subsection.</text>
				</paragraph><paragraph id="ide195b72c1825488b852fee8cd71b65c9"><enum>(6)</enum><header>Total quantity
			 of State land to be exchanged</header>
					<subparagraph id="id3B97BD3E091F4E6A8A3024C8ADA2A456"><enum>(A)</enum><header>On
			 Reservation</header><text>The total quantity of State land located within the
			 boundaries of the Reservation that may be exchanged under this subsection is
			 20,296.1 acres.</text>
					</subparagraph><subparagraph id="idE392AC738A0642B5B9BE8BAF9E21B4AB"><enum>(B)</enum><header>Off
			 Reservation</header><text>The total quantity of State land located outside of
			 the boundaries of the Reservation that may be transferred under this subsection
			 is 7,413.24 acres.</text>
					</subparagraph></paragraph></subsection><subsection id="idd2932fd22f7b4500bcf6c5db705ddd1b"><enum>(b)</enum><header>Federal land
			 transfers</header>
				<paragraph id="idbe9d361a36cf40c1a13a9630acefb6fd"><enum>(1)</enum><header>In
			 general</header><text>In partial satisfaction of claims relating to Indian
			 water rights covered by this Act, the Fort Belknap Indian Community shall
			 request and agree to the exchange and transfer of land in accordance with this
			 subsection.</text>
				</paragraph><paragraph id="id2054DF67577D44E0AB4CBE91F7036181"><enum>(2)</enum><header>Transfers</header><text>On
			 selection and request by the Fort Belknap Indian Community, the Secretary shall
			 transfer to the United States, to be held in trust for the Fort Belknap Indian
			 Community, all Federal land within the parcels described in paragraph
			 (3)—</text>
					<subparagraph id="id693C97C190014E6280134CCCFFACFC0C"><enum>(A)</enum><text>with the
			 exception of any land subject to valid existing private rights, including land
			 subject to sections 2318 through 2352 of the Revised Statutes (commonly known
			 as the “Mining Law of 1872”) (30 U.S.C. 21 et seq.); and</text>
					</subparagraph><subparagraph id="id81BB08D7D56C453C90B10877E4D23FC4"><enum>(B)</enum><text>subject to the
			 condition that no road necessary for customary access to fee parcels or other
			 private rights within the parcels shall be included in the transfer.</text>

			 effect on the date of enactment of this Act, the Milk River Project and
			 facilities of the Milk River Project, including the Dodson Diversion Dam and
			 the Dodson South Canal within the Dodson land;</text>

			 manage and implement the planning, design, and construction activities
			 described in this section; and</text>

			 agree on the uses to which the Fort Belknap Indian Community may put the land
			 described in clause (iii).</text>

			 Project</header><text>The transfer of the Dodson land shall be subject
			 to—</text>

			 right of ingress and egress by personnel of the Bureau of Reclamation, the
			 Malta Irrigation District, and other authorized personnel for Milk River

			 existing rights-of-way of record or in use for Milk River Project facilities
			 and for access to those facilities for Milk River Project purposes, as

			 right of the Bureau of Reclamation and Malta Irrigation District—</text>

			 and overflow the transferred land for Milk River Project purposes; and</text>

			 and uses</header>
					<subparagraph id="id1286c5987ec546c08e6af867122e5d4e"><enum>(A)</enum><header>Uses</header>
						<clause id="id3C7C789E154145F18E1A43107203AF76"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), any use (including grazing)
			 authorized under a valid lease, permit, or right-of-way on land transferred
			 under paragraph (1), as in effect on the date of the transfer, shall remain in
			 effect until the date on which the lease, permit, or right-of-way
			 expires.</text>
						</clause><clause id="idA11A84DF6BA142A69F72E074F951F731"><enum>(ii)</enum><header>Exception</header><text>Clause
			 (i) shall not apply if the holder of the lease, permit, or right-of-way
			 requests an earlier termination of the lease, permit, or right-of-way, in
			 accordance with existing law.</text>
						</clause></subparagraph><subparagraph id="id905353137D6E47DF98C370F3334102DF"><enum>(B)</enum><header>Improvements</header><text>Any
			 improvements constituting personal property, as defined by State law, on the
			 land by the holder of the lease, permit, or right-of-way shall remain the
			 property of the holder and shall be removed not later than 90 days after the
			 date on which the lease, permit, or right-of-way expires, unless the Fort
			 Belknap Indian Community and the holder agree otherwise.</text>
					</subparagraph><subparagraph id="id7763edad30bf4b81a8612cbf455b2b12"><enum>(C)</enum><header>Payments</header><text>The
			 Secretary shall disburse to the Fort Belknap Indian Community any amounts that
			 accrue to the United States under a lease, permit, or right-of-way on land
			 described in subparagraphs (A), (B), (C), and (D) of paragraph (3) from any
			 sale, bonus, royalty, or rental relating to that land in the same manner as
			 amounts received from other land held by the Secretary in trust for the Fort
			 Belknap Indian Community.</text>
					</subparagraph></paragraph><paragraph id="id6e3f55e0a030487c9189cb1b44c285db"><enum>(5)</enum><header>Survey</header><text>With
			 respect to the transfer of land under this subsection—</text>
					<subparagraph id="idda8e1dfb93784e92a4813ce6db3821eb"><enum>(A)</enum><text>unless the United
			 States or the Fort Belknap Indian Community request an additional survey for
			 the transferred land, the description of land set forth in this section shall
			 be controlling;</text>
					</subparagraph><subparagraph id="idbdbbe46c4f7543d1b642570620ee5160"><enum>(B)</enum><text>if a survey is
			 requested, the Secretary and the Fort Belknap Indian Community shall jointly
			 provide for the survey of the land, including any mining claims; and</text>
					</subparagraph><subparagraph id="id54d20a7e3c53435db8c22535733d09e4"><enum>(C)</enum><text>the descriptions
			 set forth in this section or any survey under subparagraph (B) shall control
			 the total acreage to be transferred.</text>
					</subparagraph></paragraph><paragraph id="idfe6231dbb4e6443f93367d1b3c10c89c"><enum>(6)</enum><header>Date of
			 transfer</header>
					<subparagraph id="id2555CF04CFE34704AE5097A203347654"><enum>(A)</enum><header>In
			 general</header><text>A transfer of land to the United States to be held in
			 trust for the Fort Belknap Indian Community under this subsection shall take
			 effect immediately on the issuance of a trust deed, which shall occur as
			 expeditiously as practicable.</text>
					</subparagraph><subparagraph id="idD83ED11FF12146AFA2FBD9176C8A58C6"><enum>(B)</enum><header>Waivers</header><text>A
			 waiver and release of claims under subsections (a) and (b) of section 10
			 relating to land described in subparagraph (A) shall take effect on the date on
			 which all of the land transfers for land described in subparagraph (A) are
			 complete.</text>
					</subparagraph></paragraph><paragraph id="idfaa7510818e542be83acf966406b6889"><enum>(7)</enum><header>Total amount of
			 federal land to be transferred</header><text>The total amount of Federal land,
			 including the Grinnell land, to be transferred under subsections (A), (B), and
			 (C) of paragraph (3) is 28,303.5 acres.</text>
				</paragraph></subsection><subsection id="id55315d04b7ed4e698126dc21549f99bf"><enum>(c)</enum><header>Foreclosed
			 land</header><text>Any trust land within the Reservation that has been or is
			 foreclosed on by the United States shall be transferred to the United States to
			 be held in trust for the Fort Belknap Indian Community.</text>
			</subsection><subsection id="idda03057e1f8542b4b4d989e216df4f4f"><enum>(d)</enum><header>Fee land
			 exchanges</header>
				<paragraph id="id2e6701c3dbfe47e4ba0e2a310770233c"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall exchange surveyed public land in the
			 State, in compliance with applicable laws (including regulations), for whole
			 estate, surface, or subsurface rights to fee land within or adjacent to the
			 Reservation with the consent of the owner of the rights to the fee land.</text>
				</paragraph><paragraph id="id42acce9b567440b7936ec3dd5a06d9d4"><enum>(2)</enum><header>Value of
			 exchanged land</header>
					<subparagraph id="id3c3d48ece8e640b18b9f5f764bc42e95"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall ensure that the values and rights of
			 public land and to the fee land to be exchanged under paragraph (1) are
			 substantially equal.</text>
					</subparagraph><subparagraph id="id3a071b36d7034634ae741cd78b9c545f"><enum>(B)</enum><header>Improvements</header><text>In
			 determining the value of a parcel exchanged under paragraph (1), the Secretary
			 shall take into account the value or impact of any improvement to the
			 land.</text>
					</subparagraph><subparagraph id="idcf3e74e7db26417e871e98345225f461"><enum>(C)</enum><header>Compensation</header>
						<clause id="idb9cdf13cf61c41f1b3485873e824b8f7"><enum>(i)</enum><header>In
			 general</header><text>If the Secretary determines that, for an exchange under
			 paragraph (1), the value of the public land is greater than the value of the
			 fee land, the Secretary may accept from the owner of the right to fee land such
			 compensation as the Secretary determines to be necessary to compensate for the
			 difference in value.</text>
						</clause><clause id="idcc62620f00b544fb973a2eb6eae7eff3"><enum>(ii)</enum><header>Deposit</header><text>The
			 Secretary shall deposit into the general fund of the Treasury any compensation
			 received under clause (i).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ida90c0cfad7bc4623893c5c0637ff7b9d"><enum>(e)</enum><header>Indemnification</header><text>The
			 United States shall indemnify, defend, and hold harmless the Fort Belknap
			 Indian Community against any liability, damage, loss, claim, demand, action, or
			 expense that arises as a result of a transfer of land under this section,
			 including claims and reasonable attorneys fees that arise in connection
			 with—</text>
				<paragraph id="id747a580441104fc2bb127e25baee30fa"><enum>(1)</enum><text>any act of gross
			 negligence, error, or omission, or any willful misconduct or other fault, by
			 the United States in carrying out any activity to clean up and rehabilitate the
			 land mined or disturbed by the Landusky and Zortman Mines;</text>
				</paragraph><paragraph id="id1b71068767b342bfb6de9907c18ce30c"><enum>(2)</enum><text>any failure by
			 the United States to comply with any law (including regulations) of a public or
			 quasi-public authority with jurisdiction over the cleanup and rehabilitation
			 described in paragraph (1); or</text>
				</paragraph><paragraph id="idc055a75813534a08b9fcaee52d71d0ea"><enum>(3)</enum><text>any breach of an
			 obligation of the United States.</text>
				</paragraph></subsection><subsection id="id01b337fcbcfa41b2898b7d0f1bbcf852"><enum>(f)</enum><header>Impacts on
			 local governments</header><text>The Secretary may, at the discretion of the
			 Secretary, try to ensure that land to be exchanged under this section is
			 selected in a manner that minimizes the financial impact of the exchange on
			 local governments.</text>
			</subsection><subsection id="idfbfb521f1c344ae98e0845919a44d238"><enum>(g)</enum><header>Water
			 rights</header>
				<paragraph id="idf8563158834145f8a02c59b0f8438a58"><enum>(1)</enum><header>Acquisition</header><text>Beginning
			 on the date of the applicable transfer of land to the United States to be held
			 in trust for the Fort Belknap Indian Community under this section, if any
			 Federal, State, or fee land transferred under this section is subject to a
			 water right in existence on the date of the transfer, the Fort Belknap Indian
			 Community shall be the successor in interest with respect to the water right,
			 in accordance with the terms and conditions that applied to the predecessor in
			 interest.</text>
				</paragraph><paragraph id="id82356d609bc2413eba6e31661f59d33e"><enum>(2)</enum><header>No reserved
			 water rights</header><text>No land transferred under this section shall be the
			 basis for any claim by the Fort Belknap Indian Community to any new,
			 additional, or supplemental Federal reserved water right.</text>
				</paragraph></subsection><subsection id="id77958f6a6b4c4ea9bbc25233fb9b992f"><enum>(h)</enum><header>Transfer of
			 title</header><text>Title to all land acquired by the United States under this
			 section shall be transferred, subject to applicable laws (including
			 regulations), without charge, to the United States, to be held in trust for the
			 Fort Belknap Indian Community, pursuant to such method of conveyance as the
			 Secretary determines to be necessary.</text>
			</subsection><subsection id="ida9956a19ab6745b58187be4ee84c6c32"><enum>(i)</enum><header>Jurisdiction of
			 Grinnell land</header>
				<paragraph id="idc3557d19873d495db832c561579ce1f6"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of Federal law, the
			 Fort Belknap Indian Community Council shall have jurisdiction over hunting and
			 fishing and natural resource management on the Grinnell land described in
			 subsection (b)(3)(C) on the date on which the conditions described in paragraph
			 (2) are met.</text>
				</paragraph><paragraph id="id0A5091FD80EE41108E93D55B941DDE54"><enum>(2)</enum><header>Conditions</header><text>The
			 conditions referred to in paragraph (1) are that the Fort Belknap Indian
			 Community Council shall adopt—</text>
					<subparagraph id="idC264A995AF5C45E3A525BF383800FBD3"><enum>(A)</enum><text>hunting and
			 fishing regulations that grant nontribal members equivalent rights and
			 privileges to those that nontribal members enjoy under the hunting and fishing
			 laws (including regulations) of the State, as in effect on the date of
			 enactment of this Act, including rights relating to permit fees and bag limits;
			 and</text>
					</subparagraph><subparagraph id="id882A100F462649DE8953108C2DB63FDF"><enum>(B)</enum><text>public
			 recreational access regulations that grant nontribal members equivalent rights
			 of access for recreational purposes that nontribal members enjoy under Federal
			 law (including regulations), as in effect on the as of the date of enactment of
			 this act.</text>
					</subparagraph></paragraph><paragraph id="id45F7477D83AA45DB86320C1B643E5EA5"><enum>(3)</enum><header>Amendments</header><text>All
			 regulations promulgated by the Fort Belknap Indian Community Council under this
			 subsection shall be approved by the Secretary after providing the State with
			 notice and an opportunity to comment.</text>
				</paragraph><paragraph id="id149dbbe048754342a09f5963b61dcdf2"><enum>(4)</enum><header>Notification
			 after Federal or State amendment</header>
					<subparagraph id="id834F7DAD59674F87A1FBBC2388B8DB97"><enum>(A)</enum><header>In
			 general</header><text>If the Federal or State hunting and fishing or
			 recreational access laws (including regulations) are amended after the date on
			 which jurisdiction over those laws on the Grinnell land is transferred to the
			 Fort Belknap Indian Community Council under this subsection, the head of the
			 appropriate Federal or State agency, as applicable, shall promptly notify the
			 Fort Belknap Indian Community Council of the amendment.</text>
					</subparagraph><subparagraph id="id99687742F88E4C91A668CF5DD4453053"><enum>(B)</enum><header>Response</header>
						<clause id="idB10C962B6A3A46AD906B0A835467DD01"><enum>(i)</enum><header>In
			 general</header><text>Not later than 60 days after the date on which
			 notification is provided to the Fort Belknap Indian Community Council under
			 subparagraph (A), the Fort Belknap Indian Community Council shall amend,
			 subject to approval by the Secretary, the regulations of the Fort Belknap
			 Indian Community Council to comply with the amended law.</text>
						</clause><clause id="id32AD47A5C4444956BE1F4659D7DC87BD"><enum>(ii)</enum><header>Failure to
			 respond</header><text>If the Fort Belknap Indian Community Council fails to
			 comply with clause (i), regulatory jurisdiction shall revert to the United
			 States under paragraph (1) until—</text>
							<subclause id="idAC018261EAA34988AC5CA9272D1F206C"><enum>(I)</enum><text>such time as the
			 regulations of the Fort Belknap Indian Community comply with the amended
			 Federal or State law (including regulations); and</text>
							</subclause><subclause id="idAE7FC2BDFB664D9681381603372E4E27"><enum>(II)</enum><text>the date that is
			 not more than 25 years after the date of enactment of this Act.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="idA529799117A646408D6D3B273B9DF208"><enum>(5)</enum><header>Regulation by
			 Fort Belknap Indian Community Council</header><text>Notwithstanding any other
			 provision of law, on the date that is 25 years after the date of enactment of
			 this Act, the Fort Belknap Indian Community Council, subject to approval by the
			 Secretary, shall be free to regulate the Grinnell land according to tribal
			 law.</text>
				</paragraph></subsection></section><section id="id5132729dd9174e06a4348359ce267830"><enum>7.</enum><header>Lake
			 Elwell</header>
			<subsection id="id8aabb340db3b41b9bc83dbd44ea224e5"><enum>(a)</enum><header>Allocation of
			 water to Fort Belknap Indian Community</header>
				<paragraph id="id9157ce3834664b97bc3ba23d668610c8"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other law, the Secretary shall
			 permanently allocate to the Fort Belknap Indian Community, 20,000 acre-feet per
			 year of stored water from the water rights of the Bureau of Reclamation in Lake
			 Elwell (Tiber Reservoir), Lower Marias Unit, Upper Missouri Division,
			 Pick-Sloan Missouri River Basin Program, Montana, measured—</text>
					<subparagraph id="id56ea36074b27413da853f767b2c32ec3"><enum>(A)</enum><text>at the outlet
			 works of the dam; or</text>
					</subparagraph><subparagraph id="idf053e00531a544bbb76eaa2dca28b072"><enum>(B)</enum><text>at the diversion
			 point from the reservoir.</text>
					</subparagraph></paragraph><paragraph id="id11858567419a4e8a81169b14723f41fa"><enum>(2)</enum><header>Agreement</header><text>The
			 Secretary shall offer to enter into an agreement with the Fort Belknap Indian
			 Community—</text>
					<subparagraph id="id9104fbe70fb04dd493c8b1f4b1c80d53"><enum>(A)</enum><text>to establish a
			 procedure for the allocation under paragraph (1); and</text>
					</subparagraph><subparagraph id="id2a8e70cd8e364bb79ec5ef3a0f1720bf"><enum>(B)</enum><text>to provide for
			 use or transfer by the Fort Belknap Indian Community of water stored in Lake
			 Elwell.</text>
					</subparagraph></paragraph><paragraph id="id88a46ef67a9a4706a0c736c0f54094d6"><enum>(3)</enum><header>Requirements</header>
					<subparagraph id="id4087151a1c3540eab3850c1e7cae48f5"><enum>(A)</enum><header>No
			 increase</header><text>The annual allocation under paragraph (1) shall not be
			 increased by year-to-year carry-over storage.</text>
					</subparagraph><subparagraph id="id19d7976f4cdd4e228b73916398b19f72"><enum>(B)</enum><header>Effective
			 date</header><text>The initial allocation under paragraph (1) shall take effect
			 on the date on which the decree described in section 4(c) is approved by the
			 applicable court.</text>
					</subparagraph><subparagraph id="idcbcbf7873b8b4f9cbeab861d2fb63029"><enum>(C)</enum><header>Priority
			 date</header><text>The priority date for the allocation under paragraph (1)
			 shall be the date decreed by the applicable court under section 4(c) for the
			 water rights of the Bureau of Reclamation for water stored in Lake
			 Elwell.</text>
					</subparagraph><subparagraph id="idfbfe3aef15794cfc957173dc45015a65"><enum>(D)</enum><header>Term</header><text>The
			 agreement shall be without limit as to term.</text>
					</subparagraph><subparagraph id="id11ffa7f9536b421093bccd94abcbb273"><enum>(E)</enum><header>Costs</header>
						<clause id="id27E11F6BDE494464A4903DF3EB561612"><enum>(i)</enum><header>In
			 general</header><text>The Fort Belknap Indian Community shall not be required
			 to pay—</text>
							<subclause id="idb18882816e6d4822b3bcc082302bee5c"><enum>(I)</enum><text>water service
			 capital charges for any water allocated to the Fort Belknap Indian Community
			 under this Act and the agreement, regardless of whether that water is
			 delivered—</text>
								<item id="idDBFD2C0A55A94ABF964F45C2F09CAD14"><enum>(aa)</enum><text>for
			 use by the Fort Belknap Indian Community; or</text>
								</item><item id="id6BABD95A3B254375BA19B815FA7AA2DF"><enum>(bb)</enum><text>under any lease,
			 contract, or agreement the Fort Belknap Indian Community may enter into;
			 and</text>
								</item></subclause><subclause id="id50e8851e047a462fb29be1ad58d632b1"><enum>(II)</enum><text>an amount to the
			 United States for any water allocated to the Fort Belknap Indian Community
			 under this Act and the agreement, except for each acre-foot of stored water
			 leased or sold for industrial purposes.</text>
							</subclause></clause><clause id="idDA411CA02EE144B192DB79375E1CCBF2"><enum>(ii)</enum><header>Other
			 payments</header><text>For each acre-foot of stored water leased or sold by the
			 Fort Belknap Indian Community for industrial purposes, the Fort Belknap Indian
			 Community shall pay annually to the United States an amount to cover the
			 proportionate share of the annual operation, maintenance, and replacement costs
			 for the Lake Elwell storage allocable to the amount of water for industrial
			 purposes leased or sold by the Fort Belknap Indian Community.</text>
						</clause><clause id="id59A76D79BA7B4C9A84CE03E80A9A49D1"><enum>(iii)</enum><header>Review</header><text>The
			 annual payments of the Fort Belknap Indian Community shall be reviewed and
			 adjusted, as appropriate, to reflect the actual operation, maintenance, and
			 replacement costs for the Lake Elwell storage facility.</text>
						</clause></subparagraph></paragraph><paragraph id="idf29d24c6635949e78aab42a436fd2aa7"><enum>(4)</enum><header>Treatment as
			 component of tribal water rights</header>
					<subparagraph id="ide85942d19c054a458e171c781c8b82ff"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), each annual
			 allocation under this subsection shall be—</text>
						<clause id="id8fd6f9a80b7f4701a465b8c1f3434d08"><enum>(i)</enum><text>treated as a
			 component of the tribal water rights; and</text>
						</clause><clause id="id0705e2d680ff42a3a9b0be28a96079a2"><enum>(ii)</enum><text>administered in
			 accordance with this Act and the Compact.</text>
						</clause></subparagraph><subparagraph id="id14b8d4590ecd4f7aa272ab022b6fcde9"><enum>(B)</enum><header>Exception</header><text>Notwithstanding
			 subparagraph (A)(ii), article IV(A)(5)(b)(1)–(3) of the Compact shall not apply
			 to the annual allocations under this subsection, except to the extent that the
			 article pertains to the use of water being limited to a place of use within the
			 Missouri River Basin.</text>
					</subparagraph></paragraph><paragraph id="id2f19d2cc08b1454ea85434b1249ab5b6"><enum>(5)</enum><header>Effect of
			 subsection</header><text>Nothing in this subsection alters or diminishes the
			 allocation from Lake Elwell to the Chippewa Cree Tribe pursuant to the Chippewa
			 Cree Tribe of the Rocky Boy’s Reservation Indian Reserved Water Rights
			 Settlement and Water Supply Enhancement Act of 1999 (Public Law 106–163; 113
			 Stat 1778).</text>
				</paragraph></subsection><subsection id="ide8dcffbc90434c38b017649b324c0ccb"><enum>(b)</enum><header>Use and
			 temporary transfer of allocation</header>
				<paragraph id="id13d7abd95910430d93d7870805809055"><enum>(1)</enum><header>In
			 general</header><text>On approval of the Secretary, subject to the Compact and
			 this Act, the Fort Belknap Indian Community may use water allocated by this
			 section for any purpose, including agricultural, municipal, commercial,
			 industrial, mining, or recreational purposes, on or off the Reservation.</text>
				</paragraph><paragraph id="id2cb8f2082db54afcbec02365d0687ccd"><enum>(2)</enum><header>Agreements by
			 the Fort Belknap Indian Community</header><text>The Fort Belknap Indian
			 Community may use, lease, contract, exchange, or enter into other agreements
			 for use of the water allocated to the Fort Belknap Indian Community under
			 subsection (a)(1) if—</text>
					<subparagraph id="id255a7a3ba22f4fc0b2747e57ed8bda70"><enum>(A)</enum><text>the use of water
			 that is the subject of such an agreement occurs within the Missouri River
			 Basin; and</text>
					</subparagraph><subparagraph id="idde98bb7280594484bf4cd92d4699a733"><enum>(B)</enum><text>the agreement
			 does not permanently alienate any water allocated to the Fort Belknap Indian
			 Community under subsection (a)(1).</text>
					</subparagraph></paragraph></subsection><subsection id="idc5d37032bcc9430a96b7ea5020fd0b09"><enum>(c)</enum><header>Water transport
			 obligation; development and delivery costs</header>
				<paragraph id="idf57f6c82959a4a9cb3a4d16250476b5d"><enum>(1)</enum><header>Water transport
			 obligation</header>
					<subparagraph id="id5358D5ABB97D47DF9D426CAC23C25ACE"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall provide assistance with the planning,
			 design, and construction of the—</text>
						<clause id="idDE53C1ACD4A84739B60245F8C4071E0B"><enum>(i)</enum><text>Fort Belknap
			 water supply infrastructure;</text>
						</clause><clause id="idB1931161DC004291BB0812267E67F5C4"><enum>(ii)</enum><text>Fort Belknap
			 Indian Irrigation Rehabilitation Project;</text>
						</clause><clause id="idA162C165B1CB4AF9B075B9F380D8C02D"><enum>(iii)</enum><text>restoration of
			 historic irrigation projects within the boundaries of the Reservation;
			 and</text>
						</clause><clause id="idCB0B0B689B5C4659ACE5622738EFC61F"><enum>(iv)</enum><text>environmental
			 compliance in the development and construction of all projects under this
			 Act.</text>
						</clause></subparagraph><subparagraph id="id5A395FCAFE9F457E8C3E8ECC11506F8B"><enum>(B)</enum><header>Obligation to
			 provide facility for the transport to Reservation</header><text>Except as
			 otherwise provided in this Act, the United States shall have no obligation
			 under this Act to provide any facility for the transport to the Reservation or
			 any other location of the water allocated under this section to the Fort
			 Belknap Indian Community related to the release of tribal water rights from
			 Lake Elwell Dam and Reservoir in accordance with a request from the Fort
			 Belknap Indian Community.</text>
					</subparagraph></paragraph><paragraph id="idf6c19121575c428ba3587b6cf5f0b572"><enum>(2)</enum><header>Development and
			 delivery costs</header><text>Except for the use of any part of the Federal
			 contributions under section 8, the United States is not required to pay the
			 cost of developing or delivering to the Reservation any water allocated under
			 this subsection.</text>
				</paragraph><paragraph id="id761fedac9cf1481380ff961207055da6"><enum>(3)</enum><header>Authorization
			 of studies</header>
					<subparagraph id="idf3f90d1c31fc4dc58cec2a3e37baf3dc"><enum>(A)</enum><header>In
			 general</header><text>The Secretary, in consultation with the Fort Belknap
			 Indian Community and the State, shall carry out 1 or more studies—</text>
						<clause id="id18751997ce2f4054b1fdb8250e47e454"><enum>(i)</enum><text>to
			 determine the feasibility and design of a water supply and wastewater treatment
			 system for the Fort Belknap Indian Community; and</text>
						</clause><clause id="idba1ce685ff4a47c195bddbfaac6ba7ef"><enum>(ii)</enum><text>to
			 determine the environmental impact and ensure environmental compliance in the
			 development and construction of projects under this Act if the projects are
			 associated with, affected by, or located within the same river basin as a
			 Federal reclamation project that is in existence on the date of enactment of
			 this Act.</text>
						</clause></subparagraph><subparagraph id="id2b479611f6404a08a17b4b9acc53e4ac"><enum>(B)</enum><header>Cooperative
			 agreement with the state and the Fort Belknap Indian
			 Community</header><text>The Secretary may enter into 1 or more cooperative
			 agreements with the State and the Fort Belknap Indian Community to carry out
			 any study described in subparagraph (A) if the Secretary determines that the 1
			 or more cooperative agreements would be cost-effective and efficient.</text>
					</subparagraph><subparagraph id="ide2faad7a1ec247799da8f1b8d5db4502"><enum>(C)</enum><header>Reclamation
			 laws</header><text>No activity carried out under this Act shall be considered
			 to be a supplemental, additional, or new benefit under the reclamation laws,
			 including the Reclamation Reform Act of 1982 (43 U.S.C. 390aa et seq.).</text>
					</subparagraph></paragraph></subsection><subsection id="idf5781633358c41b7a7ea960dbbc104e9"><enum>(d)</enum><header>Section not
			 precedential</header><text>The provisions of this section regarding the
			 allocation of water resources from Lake Elwell to the Fort Belknap Indian
			 Community shall not be construed as precedent in the litigation or settlement
			 of any other Indian water rights claim.</text>
			</subsection></section><section id="idd9ec6b5c2068482a9556d2b943bee2ca"><enum>8.</enum><header>Milk River
			 Project</header>
			<subsection id="id56ddb6e0c91e4921b462b5e87c2a8bb9"><enum>(a)</enum><header>Milk river
			 project modifications</header>
				<paragraph id="iddc299fd4f64e4c3b8b25d564bb8cb884"><enum>(1)</enum><header>Procedures</header>
					<subparagraph id="id46f82a3324984d7cb99a970013a85eda"><enum>(A)</enum><header>In
			 general</header><text>The Commissioner of Reclamation, in consultation with the
			 Assistant Secretary for Indian Affairs, the Fort Belknap Indian Community, the
			 Joint Board, and other affected stakeholders, shall modify the operating
			 procedures of the Milk River Project as the Commissioner determines to be
			 necessary to ensure that the Fresno Reservoir is operated in accordance with
			 article III.A.2 and article IV.E of the Compact.</text>
					</subparagraph><subparagraph id="idad6d5dd68e4d4a5cac4e39ddc434033c"><enum>(B)</enum><header>1946 fresno
			 reservoir agreement</header>
						<clause id="idb63580d66e50490192fe5b3b2fc91082"><enum>(i)</enum><header>In
			 general</header><text>The Commissioner shall carry out such actions as the
			 Commissioner determines to be necessary to provide a more equitable accounting
			 of the <fraction>1/7</fraction> share of the Fort Belknap Indian Community to
			 the Fresno Reservoir total quantity of stored water available for use during
			 each irrigation season from the waters of the Milk River and tributaries of the
			 Milk River, that are impounded and stored in the Fresno Reservoir under the
			 agreement between the Commissioner and the Bureau of Indian Affairs relating to
			 the Milk River Project, numbered I–1–Ind. 18725, and dated July 8, 1946, taking
			 into consideration, and fully accounting for—</text>
							<subclause id="id15D80637880C4D5EAC361FB00E2DE7C4"><enum>(I)</enum><text>the right of the
			 Fort Belknap Indian Community under the Winters decision to 645 cfs of water;
			 and</text>
							</subclause><subclause id="idE997BC36C1E8431E95B1A98ADB8AC8C6"><enum>(II)</enum><text>the tribal water
			 rights.</text>
							</subclause></clause><clause id="id305F5F168DB541978B35D08387E83CE5"><enum>(ii)</enum><header>Downstream
			 release</header><text>Any water stored on behalf of the Fort Belknap Indian
			 Community in the Fresno Reservoir that is available at the end of each
			 irrigation season shall be released downstream for storage by the Fort Belknap
			 Indian Community in the Fort Belknap Reservoir.</text>
						</clause><clause id="id101c8d7d82bf41ce83bf2506cec0e4b6"><enum>(iii)</enum><header>Amendments</header><text>The
			 Commissioner and the Assistant Secretary for Indian Affairs may jointly amend
			 the agreement referred to in clause (i) as the Commissioner and the Assistant
			 Secretary determine to be necessary to provide for an equitable accounting of
			 the share of the Fort Belknap Indian Community described in clause (i).</text>
						</clause></subparagraph></paragraph><paragraph id="ideddead9de64e46fdad4cad06da883cfc"><enum>(2)</enum><header>Facilities</header><text>The
			 Secretary may make such modifications to the federally owned facilities of the
			 Milk River Project as the Secretary determines to be necessary to satisfy the
			 applicable mitigation requirements of the Compact.</text>
				</paragraph></subsection><subsection id="idad6474283b50450b9f13969335c1f144"><enum>(b)</enum><header>Milk river
			 coordinating committee</header>
				<paragraph id="idd9b1288b1d304c6b8b0b249805b23afa"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, acting through the Commissioner, the
			 Director of the Bureau of Indian Affairs, the Director of the United States
			 Geological Survey, the Director of the United States Fish and Wildlife Service,
			 and the Director of the Bureau of Land Management, may participate in the Milk
			 River Coordinating Committee pursuant to article IV.C of the Compact.</text>
				</paragraph><paragraph id="id1183073411ff4bcc902700c0d6bd8b05"><enum>(2)</enum><header>Inapplicability
			 of federal advisory committee act</header><text>The Federal Advisory Committee
			 Act (5 U.S.C. App.) shall not apply to the Milk River Coordinating
			 Committee.</text>
				</paragraph><paragraph id="id61719a8ae5ea4f008db6c88e249d4e0d"><enum>(3)</enum><header>Technical
			 support</header><text>The Secretary may—</text>
					<subparagraph id="iddf3d82da1dd1413c85f7d61bec3a645f"><enum>(A)</enum><text>maintain a
			 publicly accessible database of diversions from the Milk River made—</text>
						<clause id="id3184d101ca6c4efd9424a3f299223347"><enum>(i)</enum><text>pursuant to the
			 Milk River Project;</text>
						</clause><clause id="id295a4949ab0b424da36ccb6fa4daee89"><enum>(ii)</enum><text>under applicable
			 contracts; and</text>
						</clause><clause id="id01e326ca9fac45ae8ee662ce8a67faf8"><enum>(iii)</enum><text>by the Fort
			 Belknap Indian Community; and</text>
						</clause></subparagraph><subparagraph id="id22d896ec22c54611aa02df102322fddb"><enum>(B)</enum><text>provide such
			 other technical support as the Milk River Coordinating Committee may request,
			 including the maintenance of gages necessary to account for daily diversions
			 from the Milk River.</text>
					</subparagraph></paragraph><paragraph id="id70e5d38afb63437fa4eb2e73c3852989"><enum>(4)</enum><header>Coordination of
			 storage and release</header><text>Notwithstanding Article IV.C.11 of the
			 Compact, the Secretary (acting through the Commissioner), and in consultation
			 with the Milk River Coordinating Committee, may develop an accounting for the
			 coordination of storage and release of water from Federal storage facilities
			 within the federally owned portion of the Milk River Basin.</text>
				</paragraph></subsection><subsection id="idf82d7932803c45e585e6f22d82078c3b"><enum>(c)</enum><header>Milk river
			 project mitigation</header>
				<paragraph id="ida1622cb642f3470db34fe1dd6264af5b"><enum>(1)</enum><header>In
			 general</header><text>The State, in consultation with the Secretary, the Fort
			 Belknap Indian Community, the Joint Board, and other affected stakeholders,
			 shall use funds made available under subsections (d) and (e) to provide grants
			 for projects for mitigation of the Milk River Project in accordance
			 with—</text>
					<subparagraph id="id4C18EFA3CCC042F081B8078E1E806FD3"><enum>(A)</enum><text>article VI.B of
			 the Compact; and</text>
					</subparagraph><subparagraph id="id9182B213B7A449DDBDE16EF500912B78"><enum>(B)</enum><text>this Act.</text>
					</subparagraph></paragraph><paragraph id="idca0d13e153524892a50758287a4556e4"><enum>(2)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this subsection, the owner or operator of
			 a project described in paragraph (1) shall submit to the State an application
			 at such time, in such manner, and containing such information as the State may
			 require.</text>
				</paragraph><paragraph id="iddd4f2151909541069eb9767c74b3f0de"><enum>(3)</enum><header>Delegation by
			 state</header><text>The State may delegate any portion of the responsibility of
			 the State under this subsection to any entity organized in accordance with
			 applicable Federal and State laws.</text>
				</paragraph><paragraph id="id99be0c7eaf204960acd866d1fa5c07e3"><enum>(4)</enum><header>Compliance with
			 nepa</header><text>The Secretary shall ensure that each project that receives
			 Federal funds under this subsection is carried out in accordance with the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text>
				</paragraph></subsection><subsection id="id78d5f7538ead43c395268cb982649bb8"><enum>(d)</enum><header>State
			 contributions</header>
				<paragraph id="id6f5df94f712548c7bc1237f1d9a91766"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall treat as a State contribution to
			 mitigation of the Milk River Project—</text>
					<subparagraph id="idb42c52e50c594f63a1b16943d9881258"><enum>(A)</enum><text>the difference
			 between—</text>
						<clause id="id1f4681349bbe4255893886ad95468af9"><enum>(i)</enum><text>the
			 amount authorized by the bill of the Montana House of Representatives numbered
			 540 of the 59th Session (2005); and</text>
						</clause><clause id="id07775960ef4f462f86f0bd7115e5d4cf"><enum>(ii)</enum><text>the $5,000,000
			 requested from the State under section (11)(i); and</text>
						</clause></subparagraph><subparagraph id="id94287322e91e40ebb5bde7c4d03d6eee"><enum>(B)</enum><text>any other funds
			 allocated or previously expended by the State to carry out activities under
			 subsection (a).</text>
					</subparagraph></paragraph><paragraph id="id1d896b81592e421fad2a23b4d14fd01e"><enum>(2)</enum><header>Additional
			 contributions</header><text>The Secretary shall request that the State provide,
			 in addition to the amounts described in paragraph (1)—</text>
					<subparagraph id="idc3416cceb2fd4a718bb781fe92daf32b"><enum>(A)</enum><text>$3,500,000 for
			 purposes of mitigation and watershed improvement activities described in the
			 Compact; and</text>
					</subparagraph><subparagraph id="id9a92333072a04128a736523ad5f3b431"><enum>(B)</enum><text>an amount equal
			 to $4,000,000 of in-kind contributions for technical, modeling, and other
			 services for purposes of identifying, supporting, and enhancing water use and
			 management in the Milk River Basin.</text>
					</subparagraph></paragraph><paragraph id="id3c6317f49769442bb0c8d4ae034daa7d"><enum>(3)</enum><header>Treatment of
			 contributions</header><text>A contribution by the State under this subsection
			 shall be considered to fulfill the obligation of the State under article VI.B
			 of the Compact.</text>
				</paragraph><paragraph id="idcef2153b1e7c4374859a635d471cf428"><enum>(4)</enum><header>Expenditure of
			 funds</header><text>Subject to applicable State law, amounts provided by the
			 State under this subsection may be expended at any time after the date on which
			 funds are provided.</text>
				</paragraph><paragraph id="idc9a88a78a8f140ee9eb41076c2a65dd4"><enum>(5)</enum><header>Report</header><text>Not
			 less frequently than once each year, the Secretary shall request that the State
			 submit to the Fort Belknap Indian Community an accounting of any funds expended
			 by the State under this subsection during the preceding calendar year.</text>
				</paragraph></subsection><subsection id="idf706c9f524db4660905672772f865bea"><enum>(e)</enum><header>Federal
			 contributions</header>
				<paragraph id="id62b14961f0b1467ab917186c28722cf2"><enum>(1)</enum><header>State trust
			 account</header><text>The Secretary shall establish a trust account for the
			 State, consisting of amounts made available by the Secretary to carry out the
			 mitigation and watershed improvement activities described in the
			 Compact.</text>
				</paragraph><paragraph id="id2a9fb9383e0d4f579199053bbd1422a6"><enum>(2)</enum><header>Transfer</header><text>Not
			 later than 60 days after the date on which funds are appropriated pursuant to
			 paragraph (4), the Secretary shall transfer the funds, at no charge to the
			 State, to the State trust account established under paragraph (1).</text>
				</paragraph><paragraph id="id173a7dc32bb647c09266fb96cbd9d3a5"><enum>(3)</enum><header>Allocations</header>
					<subparagraph id="ide9414eb2ae2f452981de78c6e2fff73a"><enum>(A)</enum><header>Interest</header><text>The
			 State may expend the interest accruing on amounts in the State trust account
			 under paragraph (1) as the State determines to be appropriate to fulfill the
			 purposes of the Compact.</text>
					</subparagraph><subparagraph id="idc8c9181c6ac94a0cacc93fd226d7e4b4"><enum>(B)</enum><header>Principal</header><text>The
			 State shall not expend the principal amount in the State trust account
			 until—</text>
						<clause id="id927c1a8b493043fc8f1f6ecf46a2c2cc"><enum>(i)</enum><text>the
			 Fort Belknap Indian Community has developed, or is in the process of
			 developing, the tribal water rights in accordance with the Compact and this
			 Act; and</text>
						</clause><clause id="iddd2b4d1e90274532bc46cab33343b5e4"><enum>(ii)</enum><text>the State, in
			 consultation with the Secretary, determines that a proposed expenditure of the
			 principal amount is necessary to satisfy mitigation or watershed improvement
			 obligations under the Compact.</text>
						</clause></subparagraph></paragraph><paragraph id="ided8033ff869a41a68769e4ca2bd16c5e"><enum>(4)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to the
			 Secretary to carry out this subsection $5,000,000 for each of fiscal years 2012
			 through 2015.</text>
				</paragraph></subsection></section><section id="idb60d5181f3db4ccba27dd7d551520ef2"><enum>9.</enum><header>Settlement in
			 satisfaction of claims</header>
			<subsection id="id7dcfe9c6685b4e05a06e0b512292436b"><enum>(a)</enum><header>In
			 general</header><text>The benefits provided under this Act shall be considered
			 to fully satisfy any claim of the Fort Belknap Indian Community against the
			 United States that is waived and released by the Fort Belknap Indian Community
			 under subsection (a)(1) and (b) of section 10.</text>
			</subsection><subsection id="iddaa2f4985f2c4a1dbe233f9f56dca2c5"><enum>(b)</enum><header>Allottees</header><text>The
			 benefits realized by the allottees under this Act shall fully satisfy—</text>
				<paragraph id="id86f1ff4c2b2d406da8b5d47311dd017d"><enum>(1)</enum><text>all claims waived
			 and released by the United States (acting as trustee for the allottees) under
			 section 10(a)(2); and</text>
				</paragraph><paragraph id="id2e4638ad02ca442eb359ea0e5d24cd1a"><enum>(2)</enum><text>any claims of the
			 allottees against the United States that are similar to the claims described in
			 section 10(b).</text>
				</paragraph></subsection><subsection id="idc03eb299c59a4d80a9ceba7a929a85ed"><enum>(c)</enum><header>No recognition
			 of water rights</header><text>Notwithstanding subsections (a) and (b) and
			 except as provided in section 5, nothing in this Act recognizes or establishes
			 any right of a member of the Fort Belknap Indian Community or an allottee to
			 water in the Reservation.</text>
			</subsection></section><section id="idaf9c2e002dc84b3694e740c40d3e94bd"><enum>10.</enum><header>Waivers and
			 releases of claims</header>
			<subsection id="idb5589d18303248fba34c9db683536a95"><enum>(a)</enum><header>Claims for
			 water rights in the State and Reservation</header><text>Subject to subsection
			 (e), in return for recognition of the tribal water rights and other benefits
			 provided under the Compact and this Act—</text>
				<paragraph id="idADF00DEABCC447E39C8F9A307790D384"><enum>(1)</enum><text>the Fort Belknap
			 Indian Community and the United States (acting as trustee for the Fort Belknap
			 Indian Community) shall execute a waiver and release of all claims for water
			 rights within the State that the Fort Belknap Indian Community or the United
			 States (acting as trustee for the Fort Belknap Community), has asserted or
			 could have asserted, in any proceeding, before or on the enforceability date,
			 except to the extent that those rights are recognized in the Compact or this
			 Act; and</text>
				</paragraph><paragraph id="idc88bfbcb14014579a254478e99f8ab77"><enum>(2)</enum><text>the United States
			 (acting as trustee for allottees) shall execute a waiver and release of all
			 claims for water rights within the Reservation that the United States (acting
			 as trustee for the allottees) has asserted or could have asserted, in any
			 proceeding, before or on the enforceability date, except to the extent that
			 those rights are recognized in the Compact or this Act.</text>
				</paragraph></subsection><subsection id="id60e1619956af4e1aa2d9c74c0aea98a7"><enum>(b)</enum><header>Waiver and
			 release of claims against the united states</header>
				<paragraph id="id5313D5255FF8425F86BABFD99991F2D2"><enum>(1)</enum><header>In
			 general</header><text>Subject to subsection (e), the Fort Belknap Indian
			 Community may execute a waiver and release of all claims described in paragraph
			 (2) against the United States (including an agency or employee of the United
			 States).</text>
				</paragraph><paragraph id="idC86A41C0D99546429D3858DB5A0BD47C"><enum>(2)</enum><header>Description of
			 claims</header><text>The claims referred to in paragraph (1) are—</text>
					<subparagraph id="idcf74d71d96214dc193eaa7b38482b2f3"><enum>(A)</enum><text>any claim for
			 water rights within the State that the United States (acting as trustee for the
			 Fort Belknap Indian Community) asserted, or could have asserted, in any
			 proceeding, except to the extent that those rights are recognized as the tribal
			 water rights in this Act;</text>
					</subparagraph><subparagraph id="id97a4b3769eaf4606af275c879b5d7aa1"><enum>(B)</enum><text>any claim
			 relating to a damage to, loss of, or injury to water, water rights, land, or
			 natural resources due to the loss of water or water rights in the State that
			 first accrued before or on the enforceability date, including claims relating
			 to—</text>
						<clause id="idCAF3E1CD712F4E05A700D2C6F80EF213"><enum>(i)</enum><text>damage, loss, or
			 injury to hunting, fishing, gathering, or cultural rights due to the loss of
			 water or water rights;</text>
						</clause><clause id="idD2B3FF817DF6480C842AC4B88515449F"><enum>(ii)</enum><text>interference
			 with, diversion or taking of water; or</text>
						</clause><clause id="id8A51B32FEC0D49D0AC5218973658A691"><enum>(iii)</enum><text>the failure to
			 protect, acquire, replace, or develop water, water rights, or water
			 infrastructure;</text>
						</clause></subparagraph><subparagraph id="id787325fbe61647f4b490923fe4e13b5d"><enum>(C)</enum><text>any pending
			 litigation in the State relating to the water rights of the Fort Belknap Indian
			 Community; and</text>
					</subparagraph><subparagraph id="ida6b8ef30ad954366a336f005d7d0383c"><enum>(D)</enum><text>any claim arising
			 from the negotiation, execution, or the adoption of—</text>
						<clause id="id9E3B8ED2C498491999AC6F83C1CDE530"><enum>(i)</enum><text>the
			 Compact; or</text>
						</clause><clause id="id449C4833654748AE96A30F3F8DBC7414"><enum>(ii)</enum><text>this Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id0e0d206c619c4e1094d61b27a18ef6d1"><enum>(c)</enum><header>Effectiveness
			 of waivers and releases</header><text>The waivers under subsections (a) and (b)
			 shall take effect on the enforceability date.</text>
			</subsection><subsection id="id429696a477634a58ad6e18132e21a8e8"><enum>(d)</enum><header>Enforceability
			 date</header>
				<paragraph id="id1f6decbf2ac74d3ebc1e98953f19a9ab"><enum>(1)</enum><header>In
			 general</header><text>The enforceability date shall be the date on which the
			 Secretary publishes in the Federal Register a statement of findings
			 that—</text>
					<subparagraph id="ide1ab5d3294684557bb12f3244cd2c552"><enum>(A)</enum><text>the Fort Belknap
			 Indian Community Council has approved the Compact by submitting this Act and
			 the Compact to a vote by the tribal membership for approval or
			 disapproval;</text>
					</subparagraph><subparagraph id="id5aea10ca646c4478976b756c9f624720"><enum>(B)</enum><text>the membership of
			 the Fort Belknap Indian Community has ratified the Compact and this Act, in
			 accordance with section 4(b);</text>
					</subparagraph><subparagraph id="ida7c9ba9c41dc4f84a51ea3504c40483e"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idF7AE9FB1A9B1441DA70AF7CF18F9132F"><enum>(i)</enum><text>the Montana Water Court
			 has issued a final judgment and decree approving the Compact; or</text>
						</clause><clause id="id8f687b6032ce4590b6991bd963a994e6" indent="up1"><enum>(ii)</enum><text>if the Montana Water Court is
			 found to lack jurisdiction—</text>
							<subclause id="id0309C00966E545848B148B864A02B104"><enum>(I)</enum><text>the United States district court of
			 jurisdiction has approved the Compact as a consent decree; and</text>
							</subclause><subclause id="idEB85482BB74B4C7A94ED03CFDF402E21"><enum>(II)</enum><text>the approval under subclause (I) is
			 considered to be final;</text>
							</subclause></clause></subparagraph><subparagraph id="id5aca17b33cb5401b93e51169c1ee74b3"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="idAD5AFA3B9108419DAC967043852116D9"><enum>(i)</enum><text>all of the funds made
			 available under section 11 have been deposited in the accounts identified in
			 section 11(c); and</text>
						</clause><clause id="id2656BC13F1654D53ACC84DA3185F8CCB" indent="up1"><enum>(ii)</enum><text>the transfer of land under section
			 6 has been completed;</text>
						</clause></subparagraph><subparagraph id="id54e7e39345df45e198424fd95b951efd"><enum>(E)</enum><text>the Secretary has
			 executed the agreements with the Fort Belknap Indian Community as required
			 under this Act;</text>
					</subparagraph><subparagraph id="id0560a80c0e2e41e5b8df6ea67a045505"><enum>(F)</enum><text>the State has
			 appropriated and paid the funds relating to Peoples Creek Reservoir in
			 accordance with section 11(i); and</text>
					</subparagraph><subparagraph id="id64c25878951c47a69062ec03e6f4dbf3"><enum>(G)</enum><text>the waivers and
			 releases under subsections (a) and (b) have been executed by the Fort Belknap
			 Indian Community and the Secretary.</text>
					</subparagraph></paragraph></subsection><subsection id="idf0d6910f1c534765b7b47b3ea28db539"><enum>(e)</enum><header>Reservation of
			 rights and retention of claims</header><text>Notwithstanding the waivers and
			 releases authorized under this section, the Fort Belknap Indian Community and
			 the United States (acting as trustee for the Fort Belknap Indian Community and
			 the allottees) retain—</text>
				<paragraph id="id6ed8491d69984ce1ac4cf51a210ddc7f"><enum>(1)</enum><text>all claims for
			 enforcement of the Compact, settlement agreement, the final decree, or this
			 Act, through any legal and equitable remedies that may be available in the
			 appropriate Federal or State court;</text>
				</paragraph><paragraph id="id2d662d229d82481e8896d8bf6fc38035"><enum>(2)</enum><text>all rights to use
			 and protect water rights acquired after the date of enactment of this
			 Act;</text>
				</paragraph><paragraph id="id95f07c7aac914a5e88e37dd7acdca63f"><enum>(3)</enum><text>all claims
			 relating to activities affecting the quality of water, including any claims the
			 Fort Belknap Indian Community might have under—</text>
					<subparagraph id="id92D774D2EE2C43EFA728DB7FE28F4509"><enum>(A)</enum><text>the
			 <act-name parsable-cite="CERCL">Comprehensive Environmental Response,
			 Compensation, and Liability Act of 1980</act-name> (42 U.S.C. 9601 et
			 seq.);</text>
					</subparagraph><subparagraph id="idD2A6C3DCC7A341CB8CA6FD2E19EE4EC7"><enum>(B)</enum><text>the Safe Drinking
			 Water Act (42 U.S.C. 300f et seq.); or</text>
					</subparagraph><subparagraph id="id88711AAC0FF04147B6812484F9489D71"><enum>(C)</enum><text>the Federal Water
			 Pollution Control Act (33 U.S.C. 1251 et. seq.);</text>
					</subparagraph></paragraph><paragraph id="id3466a74b7f11403399dd8b19ab70f9b5"><enum>(4)</enum><text>all claims
			 arising under section 12(k) relating to the enforcement of any Federal, State,
			 or tribal law (including common law); and</text>
				</paragraph><paragraph id="idce47283158464dc182486ef42bdaf777"><enum>(5)</enum><text>all rights,
			 remedies, privileges, immunities, and powers not specifically waived and
			 released under this Act.</text>
				</paragraph></subsection><subsection id="ida889bb8b068b423f9767cd864dc72803"><enum>(f)</enum><header>Tolling of
			 claims</header>
				<paragraph id="idafeb4f57114843d5a209a2b008d47348"><enum>(1)</enum><header>In
			 general</header><text>Each applicable period of limitation and time-based
			 equitable defense relating to a claim described in this section shall be tolled
			 for the period beginning on the date of enactment of this Act and ending on the
			 date on which the amounts made available to carry out this Act are transferred
			 to the Secretary.</text>
				</paragraph><paragraph id="ide5c7fe9a0bd14e5589d68ff4a846a7b2"><enum>(2)</enum><header>Effect of
			 subsection</header><text>Nothing in this subsection revives any claim or tolls
			 any period of limitations or time-based equitable defense that expired before
			 the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="ida52a424d553d4f7697976ad6fd3c6139"><enum>(g)</enum><header>Expiration and
			 tolling</header><text>If all appropriations authorized by this Act have not
			 been made available to the Secretary by June 30, 2042—</text>
				<paragraph id="ida0f14915ba7c461ba16f694bb8dce264"><enum>(1)</enum><text>the waivers
			 authorized in this section shall—</text>
					<subparagraph id="idC4B0B3CB00674D3C816CD18AE3CBA2BA"><enum>(A)</enum><text>expire;
			 and</text>
					</subparagraph><subparagraph id="id23E34CAED4514FD5BB9430D380BE5DA9"><enum>(B)</enum><text>be of no force or
			 effect; and</text>
					</subparagraph></paragraph><paragraph id="id2cb72c4af09445489c10f2ce046f4d6b"><enum>(2)</enum><text>all statutes of
			 limitations applicable to any claim otherwise waived shall be tolled until June
			 30, 2042.</text>
				</paragraph></subsection></section><section id="id380dd05795fd4f6bad920e39fb24aff2"><enum>11.</enum><header>Fort Belknap
			 Indian Community Settlement Fund</header>
			<subsection id="idaa7c4871008441b3be45ba6616b81804"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Treasury a fund, to be known as the <quote>Fort Belknap
			 Indian Community Settlement Fund</quote>, to be administered by the Secretary
			 for the uses described in subsection (c) and any activities necessary to comply
			 with Federal environmental and cultural resource laws.</text>
			</subsection><subsection id="idf298913c8d6646aab3797c8f54aaa120"><enum>(b)</enum><header>Transfers to
			 fund</header><text>The Fund shall consist of such amounts as are deposited in
			 the Fund under subsection (j).</text>
			</subsection><subsection id="idac22b887bef84c8a902287e917c77121"><enum>(c)</enum><header>Accounts of the
			 Fort Belknap Indian Community Settlement Fund</header><text>The Secretary shall
			 establish in the Fund—</text>
				<paragraph id="id15ed3b30a9ca4debbfd275eb4b1d729e"><enum>(1)</enum><text>the Fort Belknap
			 Indian Community Tribal Land and Water Rehabilitation, Modernization, and
			 Expansion account, from which principal and interest may be used to pay or
			 reimburse costs incurred by the United States, the State, and the Fort Belknap
			 Indian Community for activities relating to—</text>
					<subparagraph id="id2e9ed37df0544d5eb19cdd8de06d53f4"><enum>(A)</enum><text>exchanging,
			 transferring, or acquiring land;</text>
					</subparagraph><subparagraph id="id52cfdfaa03bc48e89bd4cf2d5d2c16cc"><enum>(B)</enum><text>rehabilitating or
			 otherwise improving existing and historically irrigated land or
			 projects;</text>
					</subparagraph><subparagraph id="idfb7a6f28b77d4742aaaca8fddf2d356b"><enum>(C)</enum><text>agricultural
			 development;</text>
					</subparagraph><subparagraph id="id8426eccea65f4338bbef9961d3df45fa"><enum>(D)</enum><text>cultural
			 preservation;</text>
					</subparagraph><subparagraph id="id7c082bbb7cbc4eb796528938a64a4d30"><enum>(E)</enum><text>water resources
			 development; and</text>
					</subparagraph><subparagraph id="id5a49d78b229a4df89bf89a216f9f6179"><enum>(F)</enum><text>other land- and
			 water-related projects;</text>
					</subparagraph></paragraph><paragraph id="id02faaa999541453d816a8a06018ccb21"><enum>(2)</enum><text>the Fort Belknap
			 Indian Community Water Resources and Water Rights Administration, Operation,
			 and Maintenance account, from which only interest earned may be used to
			 pay—</text>
					<subparagraph id="id1ad7cfbfd7624cf6b4ef0efbf825b86a"><enum>(A)</enum><text>the costs of
			 administering the tribal water rights, including through—</text>
						<clause id="id6C6C0C7192FC4BBF8A42C53C05B24EE2"><enum>(i)</enum><text>the
			 development or enactment of a Tribal Water Code;</text>
						</clause><clause id="idCD8B8448289940CFBBC6CA8607BC538F"><enum>(ii)</enum><text>the
			 establishment by the Fort Belknap Indian Community of a water resources
			 department; and</text>
						</clause><clause id="idC47335A035F94CFF937192986F8452E7"><enum>(iii)</enum><text>the operation
			 by that water resources department (or successor agency); and</text>
						</clause></subparagraph><subparagraph id="id93f78308404b4d199fc1499277a1a81b"><enum>(B)</enum><text>the annual
			 operation and maintenance costs for tribal and allotted water resources
			 projects, including the share of the Fort Belknap Indian Community of operating
			 and maintaining the Fresno Reservoir;</text>
					</subparagraph></paragraph><paragraph id="id21e17c6c187c46938c8e9344055f1c5c"><enum>(3)</enum><text>the Fort Belknap
			 Indian Community Tribal Economic Development account, from which principal and
			 interest may be used by the Fort Belknap Indian Community to pay the costs for
			 any activity the Fort Belknap Indian Community determines to be necessary to
			 further the economic development of the Fort Belknap Indian Community;
			 and</text>
				</paragraph><paragraph id="id4c05e20272194158854d44c2395d3ba5"><enum>(4)</enum><text>the Fort Belknap
			 Indian Community Water and Wastewater Rehabilitation and Expansion account,
			 from the which principal and interest may be used by the Fort Belknap Indian
			 Community to pay the costs for—</text>
					<subparagraph id="idc166e91080fe4a48bada87ebf9df09e5"><enum>(A)</enum><text>preparation of a
			 feasibility study and design of a water supply and sewer treatment system for
			 the Fort Belknap Indian Community;</text>
					</subparagraph><subparagraph id="id5af2274b7a484417ae3797b86372e6d9"><enum>(B)</enum><text>the planning,
			 design, and construction of a domestic water supply system and related
			 facilities for tribal communities;</text>
					</subparagraph><subparagraph id="idac535db0dd3f4550bfd773f147006c67"><enum>(C)</enum><text>the planning,
			 design, and construction of a wastewater treatment system and related
			 facilities for tribal communities; and</text>
					</subparagraph><subparagraph id="ida539ac3dd6054416aa19812ffc3330e8"><enum>(D)</enum><text>environmental
			 compliance in the development and construction of projects under this
			 Act.</text>
					</subparagraph></paragraph></subsection><subsection id="idcd4aabc6d8ab4c74b14f8e4520ef2c41"><enum>(d)</enum><header>Management of
			 fund</header>
				<paragraph id="ide3b74cb7854a4a12a0a4ac64e6926e59"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage the Fund, including investing
			 and making amounts available from the Fund for distribution to the Fort Belknap
			 Indian Community consistent with—</text>
					<subparagraph id="id7c84205360594335b69722fe4504d3cc"><enum>(A)</enum><text>the American
			 Indian Trust Fund Management Reform Act of 1994 (25 U.S.C. 4001 et
			 seq.);</text>
					</subparagraph><subparagraph id="ide5ddac7eb73244efb7c2313e9c3d0857"><enum>(B)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="id02223b12d2db4fa2b8b0303ea7979b7b"><enum>(C)</enum><text>the
			 Compact.</text>
					</subparagraph></paragraph><paragraph id="id52441e540866497893f89033727ba133"><enum>(2)</enum><header>Investment of
			 Fort Belknap Community Settlement fund accounts</header><text>The Secretary
			 shall invest amounts in the Fund accounts described in subsection (c) in
			 accordance with—</text>
					<subparagraph id="idf9e427d49e5b4d28b93e766d8b8761cc"><enum>(A)</enum><text>the Act of April
			 1, 1880 (25 U.S.C. 161);</text>
					</subparagraph><subparagraph id="idcc2f1fff82294cbaa1858902c29ce259"><enum>(B)</enum><text>the first section
			 of the Act of June 24, 1938 (25 U.S.C. 162a); and</text>
					</subparagraph><subparagraph id="id768a3a04fbac4f249a13c3c93d5c9280"><enum>(C)</enum><text>the obligations
			 of Federal corporations and Federal Government-sponsored entities, the charter
			 documents of which provide that the obligations of the entities are lawful
			 investments for Federally managed funds, including—</text>
						<clause id="id07bffebfd45b4f3190010aeb094d3027"><enum>(i)</enum><text>the
			 obligations of the United States Postal Service described in section 2005 of
			 title 39, United States Code;</text>
						</clause><clause id="ide509049f6a594414b299591447ec02fd"><enum>(ii)</enum><text>bonds and other
			 obligations of the Tennessee Valley Authority described in section 15d of the
			 Tennessee Valley Authority Act of 1933 (16 U.S.C. 831n–4);</text>
						</clause><clause id="ide67ee798382e4ebbb4ef5ee63813952b"><enum>(iii)</enum><text>mortgages,
			 obligations, and other securities of the Federal Home Loan Mortgage Corporation
			 described in section 303 of the Federal Home Loan Mortgage Corporation Act (12
			 U.S.C. 1452); and</text>
						</clause><clause id="idc0a4e304099b47efbe797a7bca859f01"><enum>(iv)</enum><text>bonds, notes,
			 and debentures of the Commodity Credit Corporation described in section 4 of
			 the Act of March 8, 1938 (15 U.S.C. 713a–4).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idfd5c9d4eb175423b8ed427f431dbff49"><enum>(e)</enum><header>Availability of
			 amounts</header>
				<paragraph id="idb5962f9eeec542a2bbb677987b1bea00"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="idCE79E2ACDDD748F981BA9102231E01A5"><enum>(A)</enum><header>Funding</header><text>Except
			 as provided in paragraph (2), the amounts made available under this section
			 shall be available for expenditure or withdrawal by the Fort Belknap Indian
			 Community without fiscal year limitation beginning on the enforceability
			 date.</text>
					</subparagraph><subparagraph id="idCABF7A5835A84CBC935DBA8400596FF3"><enum>(B)</enum><header>Other
			 funding</header><text>In addition to funding specifically made available under
			 this Act, if the Secretary determines that, for a given fiscal, a sufficient
			 amount of funding has not been made available through annual appropriations,
			 the Secretary shall expend from the Reclamation Water Settlements Fund
			 established under section 10501 of the Omnibus Public Land Management Act of
			 2009 (43 U.S.C. 407) such amounts as are necessary to pay the Federal share of
			 the costs associated with the Fund.</text>
					</subparagraph></paragraph><paragraph id="idc7cfb9c84ce6437e9cc787d3c6c092b3"><enum>(2)</enum><header>Exception</header><text>The
			 amounts made available under subsections (c)(2) and (j)(2) shall be available
			 for withdrawal by the Fort Belknap Indian Community beginning on the date on
			 which the Fort Belknap Indian Community approves the Compact as provided in
			 section 4(b).</text>
				</paragraph></subsection><subsection id="idb58a5886c969497eb079b56c69d246b9"><enum>(f)</enum><header>Expenditures
			 and withdrawals</header>
				<paragraph id="id83ec77e5dfba45498c1a38c3cc076a24"><enum>(1)</enum><header>Tribal
			 management plan</header>
					<subparagraph id="id184c992f0eb84721afabe893df460787"><enum>(A)</enum><header>In
			 general</header><text>The Fort Belknap Indian Community may withdraw any
			 portion of amounts in the Fund on approval by the Secretary of a tribal
			 management plan in accordance with the American Indian Trust Fund Management
			 Reform Act of 1994 (25 U.S.C. 4001 et seq.).</text>
					</subparagraph><subparagraph id="idccb6605e29724ac68ca3e6a6d848b295"><enum>(B)</enum><header>Requirements</header><text>In
			 addition to the requirements under the American Indian Trust Fund Management
			 Reform Act of 1994 (25 U.S.C. 4001 et seq.), the tribal management plan of the
			 Fort Belknap Indian Community under subparagraph (A) shall require that the
			 Fort Belknap Indian Community spend any amounts withdrawn from the Fund in
			 accordance with the purposes of this Act.</text>
					</subparagraph><subparagraph id="id8076e467c3e74507bf0fa0bd921dc49d"><enum>(C)</enum><header>Enforcement</header><text>The
			 Secretary may take such judicial and administrative actions as the Secretary
			 determines to be necessary—</text>
						<clause id="id4a7e41f4f68246f3b195e49b69c19297"><enum>(i)</enum><text>to
			 enforce the tribal management plan of the Fort Belknap Indian Community;
			 and</text>
						</clause><clause id="idceee56db79a74000a24bb0a3dd6f7dbc"><enum>(ii)</enum><text>to
			 ensure that amounts withdrawn from the Fund under the plan are used in
			 accordance with this Act and the Compact.</text>
						</clause></subparagraph><subparagraph id="id2681224435eb4a69b5d469a7c124f9ab"><enum>(D)</enum><header>Liability</header><text>The
			 Secretary and the Secretary of the Treasury shall not be liable for the
			 expenditure or investment of amounts withdrawn from a Fund by the Fort Belknap
			 Indian Community under this subsection.</text>
					</subparagraph></paragraph><paragraph id="idd00adebadd8744068c55261a261dde43"><enum>(2)</enum><header>Expenditure
			 plan</header>
					<subparagraph id="id336b5c0557eb4e16aaab9aef98e18a86"><enum>(A)</enum><header>In
			 general</header><text>The Fort Belknap Indian Community shall submit to the
			 Secretary for approval an expenditure plan for any portion of the amounts made
			 available under this section that the Fort Belknap Indian Community does not
			 withdraw to carry out this Act.</text>
					</subparagraph><subparagraph id="id685af2c57771437eba1013ed902d0e5a"><enum>(B)</enum><header>Description</header><text>The
			 expenditure plan shall describe the manner in which, and the purposes for
			 which, amounts remaining in the Funds will be used.</text>
					</subparagraph><subparagraph id="idf569b7b975854839b5ca76404e9e1446"><enum>(C)</enum><header>Approval</header><text>The
			 Secretary shall approve an expenditure plan submitted under subparagraph (A) if
			 the Secretary determines that the plan is reasonable and in accordance with
			 this Act and the Compact.</text>
					</subparagraph></paragraph><paragraph id="id1a8404e5dcf54a3d9d0ab022791b5f95"><enum>(3)</enum><header>Return of funds
			 to treasury</header><text>If the Compact or the approval by this Act of the
			 Compact becomes void under section 4(c), all unexpended funds made available to
			 carry out this Act (including all interest earned on the funds) shall revert to
			 the general fund of the Treasury not later than 1 year after the expiration of
			 the deadline described in section 4(d).</text>
				</paragraph></subsection><subsection id="ide2253d0507d44c09b885907f1dacc332"><enum>(g)</enum><header>Annual
			 report</header><text>For each Fund, the Fort Belknap Indian Community shall
			 submit to the Secretary an annual report that describes all expenditures from
			 the Fund during the preceding year.</text>
			</subsection><subsection id="id478265b1e654421e808027829f37c530"><enum>(h)</enum><header>No per capita
			 payments</header><text>No principal or interest amount in any account
			 established by this Act shall be distributed to any member of the Fort Belknap
			 Indian Community on a per capita basis.</text>
			</subsection><subsection id="id9987707a3a834f43aad6097ceb1d11c0"><enum>(i)</enum><header>Peoples creek
			 reservoir</header><text>To contribute to the cost of design and construction of
			 the Peoples Creek Reservoir, the Secretary shall request that the State pay to
			 the general fund of the Treasury $5,000,000, to be deposited to the credit of
			 the Fund established by subsection (c)(1).</text>
			</subsection><subsection id="id8e04a422bbb44d6f8cd17db497915497"><enum>(j)</enum><header>Authorization
			 of appropriations</header>
				<paragraph id="id9e79fbc1174b43199ce0729a0bd32cf3"><enum>(1)</enum><header>Fort Belknap
			 Indian Community Tribal Land and Water, Rehabilitation, Modernization, and
			 Expansion account</header>
					<subparagraph id="id878ed29a37434c81b8a102771ab24e5e"><enum>(A)</enum><header>Mandatory
			 appropriations</header><text>Out of any funds in the Treasury not otherwise
			 appropriated, the Secretary of the Treasury shall deposit in the Fort Belknap
			 Indian Community Tribal Land and Water, Rehabilitation, Modernization, and
			 Expansion account $134,478,400, adjusted to reflect changes since February 1,
			 2012, in construction cost indices applicable to the types of construction
			 involved in the activities described in subsection (c)(1).</text>
					</subparagraph><subparagraph id="id1669ed5e791a48aea8d62b603299cef1"><enum>(B)</enum><header>Authorization
			 of appropriations</header><text>In addition to amounts made available under
			 subparagraph (A), there is authorized to be appropriated for deposit in the
			 Fort Belknap Indian Community Tribal Land and Water, Rehabilitation,
			 Modernization, and Expansion account $105,661,600, adjusted to reflect changes
			 since February 1, 2012, in construction cost indices applicable to the types of
			 construction involved in the activities described in subsection (c)(1).</text>
					</subparagraph></paragraph><paragraph id="id9e3618cf050b481c9f2801ec29c5b3c6"><enum>(2)</enum><header>Belknap Indian
			 Community Water Resources and Water Rights Administration, Operation, and
			 Maintenance account</header>
					<subparagraph id="id558b5d3426a04209ae0f1ecae20f4f9d"><enum>(A)</enum><header>Mandatory
			 appropriations</header><text>Out of any funds in the Treasury not otherwise
			 appropriated, the Secretary of the Treasury shall deposit in the Belknap Indian
			 Community Water Resources and Water Rights Administration, Operation, and
			 Maintenance account $31,186,500, adjusted to reflect changes since February 1,
			 2012, in construction cost indices applicable to the types of construction
			 involved in the activities described in subsection (c)(2).</text>
					</subparagraph><subparagraph id="id6e39af3d8ee14438a7155025d4dd77eb"><enum>(B)</enum><header>Authorization
			 of appropriations</header><text>In addition to amounts made available under
			 subparagraph (A1), there is authorized to be appropriated for deposit in the
			 Belknap Indian Community Water Resources and Water Rights Administration,
			 Operation, and Maintenance account $29,963,500, adjusted to reflect changes
			 since February 1, 2012, in construction cost indices applicable to the types of
			 construction involved in the activities described in subsection (c)(2).</text>
					</subparagraph></paragraph><paragraph id="id4f2ac60f48414f27b460c2f7fc7b7122"><enum>(3)</enum><header>Fort Belknap
			 Indian Community Tribal Economic Development account</header>
					<subparagraph id="idaee6d816106b443aa165870b56b267fb"><enum>(A)</enum><header>Mandatory
			 appropriations</header><text>Out of any funds in the Treasury not otherwise
			 appropriated, the Secretary of the Treasury shall deposit in the Fort Belknap
			 Indian Community Tribal Economic Development account $55,187,000, adjusted to
			 reflect changes since October 1, 2011, in construction cost indices applicable
			 to the types of construction involved in the activities described in subsection
			 (c)(3).</text>
					</subparagraph><subparagraph id="id42cc16be33ef4c95b1949be508612c6f"><enum>(B)</enum><header>Authorization
			 of appropriations</header><text>In addition to amounts made available under
			 subparagraph (A), there is authorized to be appropriated for deposit in the
			 Fort Belknap Indian Community Tribal Economic Development account $45,153,000,
			 adjusted to reflect changes since October 1, 2011, in construction cost indices
			 applicable to the types of construction involved in the activities described in
			 subsection (c)(3).</text>
					</subparagraph></paragraph><paragraph id="ida38f0266b06e4db8b5e58cfd24452594"><enum>(4)</enum><header>Fort Belknap
			 Indian Community Water and Wastewater Rehabilitation and Expansion
			 account</header>
					<subparagraph id="id61d710f79e0b4cb49db7700a1940d299"><enum>(A)</enum><header>Mandatory
			 appropriations</header><text>Out of any funds in the Treasury not otherwise
			 appropriated, the Secretary of the Treasury shall deposit in the Fort Belknap
			 Indian Community Water and Wastewater Rehabilitation and Expansion account
			 $69,036,800, adjusted to reflect changes since October 1, 2011, in construction
			 cost indices applicable to the types of construction involved in the activities
			 described in subsection (c)(4).</text>
					</subparagraph><subparagraph id="id11e798537bc548f485dae7e97227dc27"><enum>(B)</enum><header>Authorization
			 of appropriations</header><text>In addition to amounts made available under
			 subparagraph (A), there is authorized to be appropriated for deposit in the
			 Fort Belknap Indian Community Water and Wastewater Rehabilitation and Expansion
			 account $54,243,200, adjusted to reflect changes since October 1, 2011, in
			 construction cost indices applicable to the types of construction involved in
			 the activities described in subsection (c)(4).</text>
					</subparagraph></paragraph><paragraph id="id1cbd2bc34fb74802a43b4749a5514648"><enum>(5)</enum><header>Montana
			 Mitigation Fund</header><text>There is authorized to be appropriated to the
			 State for the establishment of the Montana Mitigation Fund $21,000,000 for
			 fiscal year 2013.</text>
				</paragraph><paragraph id="id97ed3602d7b7490094422c6b27b7048b"><enum>(6)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to the
			 Commissioner to carry out improvement activities under this Act $1,100,000 for
			 fiscal year 2013.</text>
				</paragraph></subsection><subsection id="idd2f0798e60c64a9692400291b427a9d8"><enum>(k)</enum><header>Restriction</header><text>Any
			 amounts made available under this section shall be nonreimbursable.</text>
			</subsection></section><section id="id87b707caf5954970a13084799a174864"><enum>12.</enum><header>Administration</header>
			<subsection id="idee3ad67e0fd34284adc14e31ca989092"><enum>(a)</enum><header>Elimination of
			 debts or liens against allotments of the fort belknap indian community
			 members</header><text>The Secretary shall cancel and eliminate all debts or
			 liens against the allotments of land held by the Fort Belknap Indian Community
			 and the members of the Fort Belknap Indian Community due to construction
			 assessments, annual operation and maintenance charges, and any other charge
			 that may have been levied relating to irrigation projects of the Department of
			 the Interior for the Fort Belknap Indian Community.</text>
			</subsection><subsection id="idBC72616943ED4A31BB46D9CA4BAA92E4"><enum>(b)</enum><header>Applicability</header><text>Nothing
			 in this Act—</text>
				<paragraph id="idde931892f0fc4935a3fc7f031f031299"><enum>(1)</enum><text>affects the
			 authority of the Fort Belknap Indian Community to enforce the laws of the Fort
			 Belknap Indian Community with respect to environmental protections;</text>
				</paragraph><paragraph id="idb2f779a2b65a40f38120013d738c29ab"><enum>(2)</enum><text>affects, alters,
			 or amends Federal law (including regulations), including—</text>
					<subparagraph id="id0E138CF5947341F587CA84EDABA5608E"><enum>(A)</enum><text>the Federal Water
			 Pollution Control Act (33 U.S.C. 1251 et seq.);</text>
					</subparagraph><subparagraph id="id59297728FC60438D96C112D7377172C5"><enum>(B)</enum><text>Safe Drinking
			 Water Act (42 U.S.C. 300f et seq.);</text>
					</subparagraph><subparagraph id="idDE269D256DBA48C0ADA8CB0B42CFC614"><enum>(C)</enum><text><act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and
			 Liability Act of 1980</act-name> (42 U.S.C. 9601 et seq.); and</text>
					</subparagraph><subparagraph id="id66F70077DB3845C9B1ABFA9C48FD57B1"><enum>(D)</enum><text>the
			 <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (42 U.S.C.
			 6901 et seq.);</text>
					</subparagraph></paragraph><paragraph id="id4ff56f4a799c4ede9bf33dc2e4a4aeba"><enum>(3)</enum><text>affects the
			 authority of the United States to take actions acting as trustee for any other
			 Indian tribe or allottee of any other Indian tribe;</text>
				</paragraph><paragraph id="id30931e50a0ce48728ce6c2472f85416a"><enum>(4)</enum><text>confers
			 jurisdiction on any State court—</text>
					<subparagraph id="id8a63b6cdb8814777b397893826cd66f3"><enum>(A)</enum><text>to interpret
			 Federal law regarding health, safety, or the environment;</text>
					</subparagraph><subparagraph id="id99cb6af45d9541fbaefb1ff795563314"><enum>(B)</enum><text>to determine the
			 duties of the United States or other parties pursuant to Federal law regarding
			 health, safety, or the environment; or</text>
					</subparagraph><subparagraph id="id966b5d2fbaa0484bae13b55affb8ca27"><enum>(C)</enum><text>to conduct
			 judicial review of a Federal agency action; or</text>
					</subparagraph></paragraph><paragraph id="id9b12deaf2a314892a7e47bd98a130fbe"><enum>(5)</enum><text>waives any claim
			 of a member of the Fort Belknap Indian Community that does not derive from a
			 right of the Fort Belknap Indian Community.</text>
				</paragraph></subsection><subsection id="ide1c2100bc6554e06a5524ea3b99a2c41"><enum>(c)</enum><header>Waiver of
			 sovereign immunity by the united states</header><text>Except as provided in
			 subsections (a) through (c) of section 208 of the Department of Justice
			 Appropriation Act, 1953 (43 U.S.C. 666), nothing in this Act waives the
			 sovereign immunity of the United States.</text>
			</subsection><subsection id="idb490791c67544d599f25c1cc2990ecf1"><enum>(d)</enum><header>Execution of
			 compact</header><text>The execution of the Compact by the Secretary under
			 section 4(b) shall not constitute a major Federal action under the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.).</text>
			</subsection><subsection id="idec0032589073498381ca88cc77c15ef1"><enum>(e)</enum><header>Environmental
			 compliance</header><text>In carrying out the Compact, the Secretary shall
			 comply with—</text>
				<paragraph id="id5c639369149a4e61981f10af77eacb11"><enum>(1)</enum><text>the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.);</text>
				</paragraph><paragraph id="id4d7537bb388d40de9d54d2ce438539f5"><enum>(2)</enum><text>the Endangered
			 Species Act of 1973 (16 U.S.C. 1531 et seq.); and</text>
				</paragraph><paragraph id="id41de314793014f25973aef74f9ff31fb"><enum>(3)</enum><text>all other
			 applicable environmental laws (including regulations).</text>
				</paragraph></subsection><subsection id="id1cd559cd5c654825be83b6253bc549b8"><enum>(f)</enum><header>Additional
			 funding</header><text>Nothing in this Act prohibits the Fort Belknap Indian
			 Community from seeking—</text>
				<paragraph id="idcd312bdc403048a398bc88243ce5375c"><enum>(1)</enum><text>additional funds
			 for tribal programs or purposes; or</text>
				</paragraph><paragraph id="id9575efe55539480496aa920d93efefef"><enum>(2)</enum><text>funding from the
			 United States or the State based on the status of the Fort Belknap Indian
			 Community as an Indian tribe.</text>
				</paragraph></subsection><subsection id="id391e8e83ba6d43a5a5b9b6aa0d33f48c"><enum>(g)</enum><header>Rights under
			 state law</header><text>Except as provided in section 1 of article III of the
			 Compact (relating to the closing of certain water basins in the State to new
			 appropriations in accordance with the laws of the State), nothing in this Act
			 or the Compact precludes the acquisition or exercise of a Right Arising Under
			 State Law (as defined in section 6 of article II of the Compact) to the use of
			 water by the Fort Belknap Indian Community, or a member or allottee of the Fort
			 Belknap Indian Community, outside the Reservation by—</text>
				<paragraph id="id63e3ce7c55b74240b3e1980cb16d65b5"><enum>(1)</enum><text>purchase of the
			 right; or</text>
				</paragraph><paragraph id="ida81b6e0fe2024d1aba7834fbd0838754"><enum>(2)</enum><text>submitting to the
			 State an application in accordance with State law.</text>
				</paragraph></subsection><subsection id="ida0f9541e742447079bcfffcf2d2f9d18"><enum>(h)</enum><header>Objections in
			 montana water court</header><text>Nothing in this Act or the Compact prohibits
			 the Fort Belknap Indian Community, a member of the Fort Belknap Indian
			 Community, an allottee, or the United States in any capacity from objecting to
			 any claim to a water right filed in any general stream adjudication in the
			 Montana Water Court.</text>
			</subsection><subsection id="idd9a9a9c0ca474543b92b4e322421a456"><enum>(i)</enum><header>Interference
			 with tribal water rights</header><text>Nothing in this Act or the Compact
			 prevents the Fort Belknap Indian Community, a member of the Fort Belknap Indian
			 Community, an allottee, or the United States on behalf of the Fort Belknap
			 Indian Community, a member of the Fort Belknap Indian Community, or an allottee
			 from filing in a court of competent jurisdiction an action to prevent any
			 Person or Party (as defined in sections 29 and 30 of article II of the Compact)
			 from interfering with the enjoyment of the tribal water rights of—</text>
				<paragraph id="id15344128b0bc4e9bab24568c128161a0"><enum>(1)</enum><text>the Fort Belknap
			 Indian Community;</text>
				</paragraph><paragraph id="idefa78b9d301342adbc65255d3cfc58cd"><enum>(2)</enum><text>a member of the
			 Fort Belknap Indian Community; or</text>
				</paragraph><paragraph id="idc4eeba58b771400dbfb97c21aa9cd167"><enum>(3)</enum><text>an
			 allottee.</text>
				</paragraph></subsection><subsection id="id1eaf1315d5a045edb069b34d14ed81b5"><enum>(j)</enum><header>Water storage
			 and importation</header><text>Nothing in this Act or the Compact prevents the
			 Fort Belknap Indian Community from participating in any project to import water
			 to, or improve storage in, the Milk River Basin.</text>
			</subsection><subsection id="ide2561a81d0fe47d9b470c6c65cfcb604"><enum>(k)</enum><header>Environmental
			 protection</header>
				<paragraph id="ida6794f4ba2754a45ae083bd22830bd98"><enum>(1)</enum><header>Definition of
			 little rocky mountains</header><text>In this subsection, the term <term>Little
			 Rocky Mountains</term> means the mountains that—</text>
					<subparagraph id="idb1526dadfcac4dd7aa61878c7d0dea6b"><enum>(A)</enum><text>form the southern
			 boundary of the Reservation; and</text>
					</subparagraph><subparagraph id="id60622c7ff20e4df4be2340b7f0f31a8d"><enum>(B)</enum><text>are sacred and
			 culturally significant to the Fort Belknap Indian Community.</text>
					</subparagraph></paragraph><paragraph id="id200868993074422bbbb5377a39bfb7bb"><enum>(2)</enum><header>Protection</header><text>Nothing
			 in the Compact or this Act limits—</text>
					<subparagraph id="id24c7ee293df84099aff05d201a93761d"><enum>(A)</enum><text>the authority of
			 the United States, the State, or the Fort Belknap Indian Community to enforce
			 any Federal, State, or tribal law (including common law) relating to the
			 protection of the environment; or</text>
					</subparagraph><subparagraph id="id2e78fdad31204b8d849878bfa385a2b8"><enum>(B)</enum><text>any claim of the
			 Fort Belknap Indian Community, a member of the Fort Belknap Indian Community,
			 or an allottee, or of the United States on behalf of the Fort Belknap Indian
			 Community, a member of the Fort Belknap Indian Community, or an allottee,
			 for—</text>
						<clause id="ida4fd89f4fa934a9a9e4c8c8c52558d63"><enum>(i)</enum><text>damage to water
			 quality caused by mining activities in the Little Rocky Mountains; or</text>
						</clause><clause id="idc28dc7b5f9c7467c8e4525b14459e4e9"><enum>(ii)</enum><text>depletion in
			 surface flows or groundwater on the southern end of the Reservation.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idba1c8f6c236b47d18de3f324bdd8e945"><enum>(l)</enum><header>No precedent
			 established</header><text>Nothing in this Act establishes any precedent
			 for—</text>
				<paragraph id="id011a859352064b2bb9c07e3bcf9245a1"><enum>(1)</enum><text>the litigation of
			 reserved water rights; or</text>
				</paragraph><paragraph commented="no" id="id8b87b519c5b6426b9d507373c1b2d045"><enum>(2)</enum><text>the
			 interpretation or administration of any compact between the United States and
			 the State or any other State.</text>
				</paragraph></subsection><subsection id="id1bf50634e2b546c7a7bc3ae6e7d8c515"><enum>(m)</enum><header>Eligibility for
			 other federal services</header><text>No payment made or benefit provided
			 pursuant to this Act shall result in the reduction or denial of any Federal
			 service or program to any Indian tribe, or to any member of an Indian tribe, to
			 which the Indian tribe or member of the Indian tribe is entitled to, or
			 eligible for, because of—</text>
				<paragraph id="id1a9a38c3e51040dd9519f9b6ede84404"><enum>(1)</enum><text>the status of the
			 Indian tribe as a federally recognized Indian tribe; or</text>
				</paragraph><paragraph id="idea6e3bc9323442b3a87e8ae4b50697be"><enum>(2)</enum><text>the status of an
			 individual as an Indian.</text>
				</paragraph></subsection><subsection id="id8a78ccd876e04f32a3c1d82fd9219263"><enum>(n)</enum><header>Leases of
			 allotted land</header>
				<paragraph id="id435c3248baa44045b8b68ab6b6aaf733"><enum>(1)</enum><header>Definition of
			 eligible lessor</header><text>In this subsection, the term <term>eligible
			 lessor</term> means—</text>
					<subparagraph id="id6bd14a628e664593b539e8d2c9eac6c0"><enum>(A)</enum><text>the Fort Belknap
			 Indian Community; and</text>
					</subparagraph><subparagraph id="id47717978e61140629fc51fb5c84963fe"><enum>(B)</enum><text>a tribal farming
			 enterprise or irrigation district approved by the Fort Belknap Community
			 Council.</text>
					</subparagraph></paragraph><paragraph id="idD493C186B8DC4EB599A7DED79A6DC9F6"><enum>(2)</enum><header>Program</header><text>An
			 eligible lessor may enter into a lease or other agreement for the development
			 of the Fort Belknap Indian Irrigation Project or any other irrigation project
			 on the Reservation in the Milk River and Peoples Creek Basins.</text>
				</paragraph><paragraph id="idade705f067eb4635b3d8389a5be7f962"><enum>(3)</enum><header>Approval</header>
					<subparagraph id="id13df33cf69de4466859852990e73f86d"><enum>(A)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, the Secretary
			 may approve a lease or agreement of an eligible lessor of individually owned
			 allotted land held in trust or restricted status by the United States for the
			 Fort Belknap Indian Community if the Secretary determines that—</text>
						<clause id="id94d0787f87924447985f6b34cce91c28"><enum>(i)</enum><text>the
			 owners of a majority of the undivided interest in the trust or restricted land
			 consent to the lease or agreement; and</text>
						</clause><clause id="ida0574be8d4594fa5a4e700a761df46e2"><enum>(ii)</enum><text>approving the
			 lease or agreement is in the best interest of the owners of the trust or
			 restricted land.</text>
						</clause></subparagraph><subparagraph id="idf36e32e7aa8a4b11b94289bb713930a0"><enum>(B)</enum><header>Effect</header><text>On
			 approval by the Secretary under subparagraph (A), a lease or agreement shall be
			 binding, to the same extent as if all owners of the trust or restricted land
			 involved had consented to the lease or agreement, on—</text>
						<clause id="id26409000b59a4e1291a4ada57d64bbb4"><enum>(i)</enum><text>each owner of an
			 undivided interest in the trust or restricted land subject to the lease or
			 agreement (including any interest owned by an Indian tribe); and</text>
						</clause><clause id="id8ec5491a3cae41e287024efa92aee02d"><enum>(ii)</enum><text>each other party
			 to the lease or agreement.</text>
						</clause></subparagraph></paragraph><paragraph id="idf200891361c646ed92f38bc4db0d08c3"><enum>(4)</enum><header>Distribution of
			 proceeds</header><text>The proceeds derived from a lease or agreement approved
			 by the Secretary under paragraph (3) shall be distributed to each owner of land
			 subject to the lease or agreement, in proportion to the interest owned by the
			 owner.</text>
				</paragraph><paragraph id="id05d8604b73fa455287c1229be12cbcf9"><enum>(5)</enum><header>Execution of
			 lease or agreement by secretary</header><text>The Secretary may execute a lease
			 or agreement that affects individually owned trust or restricted land on behalf
			 of an owner of the land if—</text>
					<subparagraph id="id01b0c444a7e5480b8aede500a7f1da6c"><enum>(A)</enum><text>the owner
			 is—</text>
						<clause id="id55b8f45160094ba8a19e44c7b295b483"><enum>(i)</enum><text>a
			 member of an Indian tribe; and</text>
						</clause><clause id="id452be4b0be5e473ca5a9a12ca31d20e2"><enum>(ii)</enum><text>deceased;
			 and</text>
						</clause></subparagraph><subparagraph id="id960214ec4f964cf4804e93fa53c18dae"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id55D9FFE45CEC43809B6D52BEC038E0E6"><enum>(i)</enum><text>the heirs to, or
			 devisees of, the interest of the owner have not been determined; or</text>
						</clause><clause id="id194271856978427f8c756479829cc98c" indent="up1"><enum>(ii)</enum><text>the heirs or devisees referred to
			 in clause (i) have been determined, but 1 or more of the heirs or devisees
			 cannot be located.</text>
						</clause></subparagraph></paragraph><paragraph id="id256246d92628432699e8d9c88c809178"><enum>(6)</enum><header>Reserved
			 rights-of-way</header>
					<subparagraph id="idCA0059C384CC454197D1AABAAB8221A0"><enum>(A)</enum><header>In
			 general</header><text>The United States, acting as trustee for the Fort Belknap
			 Indian Community, shall reserve from the individually owned allotted land
			 rights-of-way on that land for irrigation purposes carried out under this Act
			 and according to the Tribal Water Code.</text>
					</subparagraph><subparagraph id="id2260167D70A54D3BB920E0BC0D50F9C2"><enum>(B)</enum><header>Use</header><text>The
			 rights-of-way retained under subparagraph (A) shall be granted to a tribal
			 farming enterprise or irrigation district if the tribal farming enterprise or
			 irrigation district is—</text>
						<clause id="id02deb5fea71040d59ee78f259702124a"><enum>(i)</enum><text>formed for the
			 purpose of irrigation or drainage; and</text>
						</clause><clause id="id147f7717b2794f459606d069a44f5b20"><enum>(ii)</enum><text>approved by the
			 Fort Belknap Community Council.</text>
						</clause></subparagraph><subparagraph id="ide0eae94ffe604f9c8278802cc216e17d"><enum>(C)</enum><header>Compensation
			 for rights-of-way on individually owned allotted lands</header><text>The Fort
			 Belknap Indian Community shall pay just compensation, including severance
			 damages, to the individual owners of allotted land from which rights-of-way are
			 reserved under this paragraph, except that the compensation shall not apply to
			 any lease entered into under this section.</text>
					</subparagraph></paragraph><paragraph id="id084838f7013444fb9cbcb5a7cd5f062c"><enum>(7)</enum><header>Public auction
			 or advertised sale not required</header>
					<subparagraph id="idf709354e8d984013b21e57b8d6d3c21b"><enum>(A)</enum><header>In
			 general</header><text>It shall not be a requirement for the approval or
			 execution of a lease or agreement under this subsection that the lease or
			 agreement be offered for sale through a public auction or advertised
			 sale.</text>
					</subparagraph><subparagraph id="idee8f6580a5d444c1bd577fd94302e270"><enum>(B)</enum><header>Effect on other
			 law</header><text>To the extent provided under subparagraph (A), the Act of
			 March 3, 1909 (35 Stat. 781, chapter 263) shall not apply to this
			 subsection.</text>
					</subparagraph></paragraph></subsection><subsection id="id01d559a39baf4ffa908713abd5258a6a"><enum>(o)</enum><header>Conflict of
			 provisions</header><text>If any provision of this Act conflicts with a
			 provision of the Compact, the provision of this Act shall prevail.</text>
			</subsection></section><section id="id18fe3d736f444f1fa35df2639d653b38"><enum>13.</enum><header>Antideficiency</header><text display-inline="no-display-inline">The United States shall not be liable for
			 any failure to carry out any obligation or activity authorized by this Act
			 (including any obligation or activity under the Compact) if adequate
			 appropriations are not provided expressly by Congress to carry out the purposes
			 of this Act in—</text>
			<paragraph id="idA5E4B5CFD95349F68A84732301B2644F"><enum>(1)</enum><text display-inline="yes-display-inline">the Reclamation Water Settlements Fund
			 established under section 10501 of the Omnibus Public Land Management Act of
			 2009 (43 U.S.C. 407); or</text>
			</paragraph><paragraph id="idF84A406663724DF791C34D6841C94796"><enum>(2)</enum><text display-inline="yes-display-inline">the Emergency Fund for Indian Safety and
			 Health established by section 601(a) of the Tom Lantos and Henry J. Hyde United
			 States Global Leadership Against HIV/AIDS, Tuberculosis, and Malaria
			 Reauthorization Act of 2008 (25 U.S.C. 443c(a)).</text>
