		<official-title>To amend title 10, United States Code, to limit increases
		  in the certain costs of health care services under the health care programs of
		  the Department of Defense, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Military Health Care Protection
			 Act of 2012</short-title></quote>.</text>
		</section><section id="ida02d516c4c514faab2f7dd8852ade51c"><enum>2.</enum><header>Sense of
			 Congress</header>
			<subsection id="id1786e58e69ec46d1aa7a4e4626d4f248"><enum>(a)</enum><header>Sense of
			 congress</header><text>It is the sense of Congress that—</text>
				<paragraph id="id6c7d0121b33847b786082b8e80a55d29"><enum>(1)</enum><text>career members of
			 the uniformed services and their families endure unique and extraordinary
			 demands and make extraordinary sacrifices over the course of a 20-year to
			 30-year career in protecting freedom for all Americans; and</text>
				</paragraph><paragraph id="idf6e05f35370649959f88697b37b395ec"><enum>(2)</enum><text>those decades of
			 sacrifice constitute a significant pre-paid premium for health care during a
			 career member's retirement that is over and above what the member pays with
			 money.</text>
				</paragraph></subsection></section><section id="idfca419d05d044638954e2245a4e2c631"><enum>3.</enum><header>Limitations on
			 certain increases in health care costs for uniformed services
			 beneficiaries</header>
			<subsection id="id6e2112355328406eb7a66ab55ba911ea"><enum>(a)</enum><header>Pharmacy
			 benefits program</header><text>Section 1074g(a)(6) of title 10, United States
			 Code, is amended by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="id3C633EE72E5D4BFFB48965C7EB02F99C" style="OLC">
					<subparagraph id="ida48be8d5eefa46c991eee05d69b63f48" indent="up2"><enum>(C)</enum><text>The amount of any cost sharing
				requirements under this paragraph may not be increased in any year by a
				percentage that exceeds the percentage by which retired pay is increased under
				section 1401a(b)(2) of this title. Increases shall be made only in whole dollar
				amounts. To the extent that the percentage increase under such section
				1401a(b)(2) in any year would yield an increase of less than one dollar, the
				accumulated increase shall be carried over to the subsequent year, until the
				accumulated increase equals at least one
				dollar.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id5555a0a99df0436ebfaa4b8bbe692cdc"><enum>(b)</enum><header>Deductible
			 amounts under CHAMPUS</header>
				<paragraph id="id6E97EB648F7D4BE9B6DBAB1A9FBD28D4"><enum>(1)</enum><header>Self-only
			 coverage</header><text>Subsection 1086(b)(1) of such title is amended by adding
			 at the end the following sentences: <quote>For each fiscal year beginning after
			 September 30, 2012, the Secretary of Defense may only increase the deductible
			 amount by a percentage not to exceed the percentage by which retired pay is
			 increased under section 1401a(b)(2) of this title. Any resulting increase shall
			 be rounded down to the nearest whole dollar.</quote>.</text>
				</paragraph><paragraph id="id60c2ce373fb34b44a8e37df0db684285"><enum>(2)</enum><header>Family
			 coverage</header><text>Subsection 1086(b)(2) of such title is amended by adding
			 at the end the following sentences: <quote>For each fiscal year beginning after
			 September 30, 2012, the Secretary of Defense may only increase the deductible
			 amount by a percentage not to exceed the percentage by which retired pay is
			 increased under section 1401a(b)(2) of this title. Any resulting increase shall
			 be rounded down to the nearest whole dollar.</quote>.</text>
				</paragraph></subsection><subsection id="id09251de45da543598fc3d24d1394d8f4"><enum>(c)</enum><header>Inpatient
			 charges under CHAMPUS</header><text>Section 1086(b)(3) of such title is amended
			 by striking <quote>25 percent</quote> and all that follows through
			 <quote>September 30, 2011.</quote> and inserting <quote>25 percent of the
			 charges for inpatient care, except that in no case shall such charges exceed
			 $708 per day.</quote>.</text>
			</subsection><subsection id="ida245935e33bd4f30b1631a12c5f09620"><enum>(d)</enum><header>Catastrophic
			 cap on fees under CHAMPUS</header><text>Section 1086(b)(4) of such title is
			 amended—</text>
				<paragraph id="id913243712a7a423c8ab167114b2198de"><enum>(1)</enum><text>by striking
			 <quote>A member</quote> and inserting <quote>For fiscal years ending before
			 October 1, 2012, a</quote>; and</text>
				</paragraph><paragraph id="ida37aae2d7f9d4f0591273c13ebcc7f5b"><enum>(2)</enum><text>by adding at the
			 end the following new sentences: <quote>For each fiscal year beginning after
			 September 30, 2012, the Secretary of Defense may only increase the amount in
			 the preceding sentence by a percentage not to exceed the percentage by which
			 retired pay is increased under section 1401a(b)(2) of this title. Any resulting
			 increase shall be rounded down to the nearest whole dollar.</quote>.</text>
				</paragraph></subsection><subsection id="id03eeeeee737240f4a93f9036339b5b80"><enum>(e)</enum><header>Prohibition of
			 enrollment fees for certain persons under CHAMPUS</header><text>Section 1086(b)
			 of such title is further amended by adding at the end the following new
			 paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="id0D05AA9B9A3B4BD797E33D783BD6D522" style="OLC">
					<paragraph id="id1ffbe73bd1c2452fb5d8a754e067d4d5"><enum>(5)</enum><text>A person covered
				by subsection (c) may not be charged an enrollment fee for coverage under this
				section.</text>
					</paragraph><paragraph id="idbf59d9e77c97439792fc27aeee3c9076"><enum>(6)</enum><text>A person covered
				by subsection (c) shall not be subject to denial of claims for coverage under
				this section for failure to enroll for such coverage. To the extent enrollment
				may be required, enrollment shall be automatic for any such person filing a
				claim under this section. In such cases of automatic enrollment, annual
				re-enrollment shall be automatic unless the beneficiary expressly declines to
				re-enroll.</text>
