		  certain land to be held in trust for the Barona Band of Mission Indians, and

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Barona Band of Mission Indians
			 Land Transfer Clarification Act of 2012</short-title></quote>.</text>
		</section><section id="ID1d3dab24d9bd44f5aecf53a9bfebb41f"><enum>2.</enum><header>Findings;
			 purposes</header>
			<subsection id="idBF02861186F641DFB02BFC6DED370D7C"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="id1C67B9EF2EB745CA8C4B7893CB1CF279"><enum>(1)</enum><text display-inline="yes-display-inline">the legal description of land previously
			 taken into trust by the United States for the benefit of the Barona Band of
			 Mission Indians may be interpreted to refer to private, nontribal land;</text>
				</paragraph><paragraph id="id88DBE297EFA04B9B93A8E40CC3B391A8"><enum>(2)</enum><text>there is a
			 continued, unresolved disagreement between the Barona Band of Mission Indians
			 and certain off-reservation property owners relating to the causes of
			 diminishing native groundwater;</text>
				</paragraph><paragraph id="id824AE04997FA40E3831CC3CBEE8546F2"><enum>(3)</enum><text>Congress
			 expresses no opinion, nor should an opinion of Congress be inferred, relating
			 to the disagreement described in paragraph (2); and</text>
				</paragraph><paragraph id="id28003BFB1BC048AD93294A10999EE83B"><enum>(4)</enum><text>it is the intent
			 of Congress that, if the land described in section 121(b) of the Native
			 American Technical Corrections Act of 2004 (118 Stat. 544) (as amended by
			 section 3) is used to bring water to the Barona Indian Reservation, the effort
			 is authorized only if the effort also addresses water availability for
			 neighboring off-reservation land located along Old Barona Road that is occupied
			 as of the date of enactment of this Act by providing guaranteed access to that
			 water supply at a mutually agreeable site on the southwest boundary of the
			 Barona Indian Reservation.</text>
				</paragraph></subsection><subsection id="id65344C07223C4B419431EFE51B855B1E"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id59A77AAE5D27444FA50E6BFE900D9D58"><enum>(1)</enum><text>to clarify the
			 legal description of the land placed into trust for the Barona Band of Mission
			 Indians in 2004; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFBBE4B23E37F40D7BE597B7DF6C31CE8"><enum>(2)</enum><text>to remove all
			 doubt relating to the specific parcels of land that Congress has placed into
			 trust for the Barona Band of Mission Indians.</text>
				</paragraph></subsection></section><section id="id0D03AE3D3B9246A98130A535561CFD8F"><enum>3.</enum><header>Land
			 transfer</header><text display-inline="no-display-inline">Section 121 of the
			 Native American Technical Corrections Act of 2004 (Public Law 108–204; 118
			 Stat. 544) is amended—</text>
			<paragraph id="id407DDD054CFD4EF1934117372B3EED24"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7804A70E9CCF425995C8C1362D583E5C" style="OLC">
					<subsection id="IDc3a8dead23b443b99405e8acdcb9fc64"><enum>(b)</enum><header>Description of
				land</header><text>The land referred to in subsection (a) is land comprising
				approximately 86.87 acres in San Diego County, California, and described more
				particularly as follows: T. 14 S., R. 1 E. San Bernardino Meridian; Section 21,
				SW¼ SW¼, excepting the north 475 ft.; W½ SE¼ SW¼, excepting the north 475 ft.;
				E½ SE¼ SW¼, excepting the north 350 ft.; Together with that portion W½ SE¼,
				lying southwesterly of the following line: Beginning at the intersection of the
				southerly line of said SE¼ Section 21 with the westerly boundary of Rancho
				Canada De San Vicente Y Mesa Del Padre Barona as shown on United States
				Government Resurvey approved January 21, 1939; thence northwesterly along said
				boundary to an intersection with the westerly line of said SE¼; containing
				68.75 acres more or less; Section 28, NW¼ NW¼, excepting the east 750 ft.;
				containing 17.02 acres more or less.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idEA93C3B1E55F44639C774413218A62D9"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE14D6FAFFBC54933BF0FFA9573E81471" style="OLC">
					<subsection id="idC5DBAB7CA7DD4B169120431F68B47915"><enum>(d)</enum><header>Clarifications</header>
						<paragraph id="id3C1D1B72336549939C4C93E8DA8FF104"><enum>(1)</enum><header>Effect on
				section</header><text>The provisions of subsection (c) shall apply to the land
				described in subsection (b), as in effect on the day after the date of
				enactment of the <short-title>Barona Band of Mission
				Indians Land Transfer Clarification Act of 2012</short-title>.</text>
						</paragraph><paragraph id="id7E8D7EFA263B4A71A876B44AECC8BDD5"><enum>(2)</enum><header>Effect on
				private land</header><text>The parcel of private, non-Indian land referenced in
				subsection (a) and described in subsection (b), as in effect on the day before
				the date of enactment of the <short-title>Barona Band of
				Mission Indians Land Transfer Clarification Act of 2012</short-title>, but
				excluded from the revised description of the land in subsection (b) was not
				intended to be—</text>
							<subparagraph id="idAAD63F40247A411CBBBEBEDD08ABC706"><enum>(A)</enum><text>held in trust by
				the United States for the benefit of the Band; or</text>
							</subparagraph><subparagraph id="id6F576402ED2A4FC9B8F1504C653B66EB"><enum>(B)</enum><text>considered to be
				a part of the reservation of the
				Band.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
