		<legis-type>A BILL</legis-type>
		<official-title>To amend the Immigration and Nationality Act by
		  establishing an F–4 nonimmigrant visa for aliens pursuing an advanced degree in
		  mathematics, engineering, technology, or the physical sciences in the United
		  States, to authorize such aliens to become permanent residents if they obtain
		  employment in the United States related to their field of study, and for other
		  purposes.</official-title>

		<section id="idA55611AEC50246A4B85AF29D54A93A26" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sustaining our Most Advanced
			 Researchers and Technology Jobs Act of 2012</short-title></quote> or the
			 <quote><short-title>SMART Jobs
			 Act</short-title></quote>.</text>
		</section><section id="id2CB9555CFB51402F8726D471E7327083" section-type="subsequent-section"><enum>2.</enum><header>Definition of STEM
			 field</header><text display-inline="no-display-inline">Section 101(a) of the
			 Immigration and Nationality Act (8 U.S.C. 1101(a)) is amended by inserting
			 after paragraph (36) the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="id4C3E25532D204A549A58B6CB090FFFC8" style="OLC">
				<paragraph id="id0240E9C2BDFE499183DCD7EDEE8DBCEF"><enum>(36A)</enum><text>The term
				<quote>STEM field</quote> means a field of study or occupation included on the
				most recent STEM-designated Degree Program List published by the Department of
				Homeland Security referred to in section 214.2(f)(11)(C)(2) of title 8, Code of
				Federal Regulations (or similar successor
				regulation).</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id4B8A0DC72ABB41AB878A07176F5B78EF" section-type="subsequent-section"><enum>3.</enum><header>Visas for graduate
			 students in mathematics, engineering, technology, or the physical
			 sciences</header>
			<subsection id="id721A669F3A7E481FB4D21D6620169D7A"><enum>(a)</enum><header>New STEM
			 nonimmigrant visa category</header><text>Section 101(a)(15)(F) of the
			 Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(F)) is amended—</text>
				<paragraph id="id4A3DE37152F544238C83E282FC1885C1"><enum>(1)</enum><text>in clause
			 (i)—</text>
					<subparagraph id="idCACD926A512C4FA5940FDB4BF760E2F0"><enum>(A)</enum><text>by inserting
			 <quote>(except for a graduate program described in clause (iv))</quote> after
			 <quote>full course of study</quote>;</text>
					</subparagraph><subparagraph id="idAF9D535252584E2E8803E6A90D7B7528"><enum>(B)</enum><text>by striking
			 <quote>214(<italic>l</italic>)</quote> and inserting <quote>214(m)</quote>;
			 and</text>
					</subparagraph><subparagraph id="idE9E72C0BC563462FB19F06E06B8D371F"><enum>(C)</enum><text>by striking the
			 comma at the end and inserting a semicolon;</text>
					</subparagraph></paragraph><paragraph id="id544E309089414402A4FAA24CF3C73DE1"><enum>(2)</enum><text>in clause
			 (ii)—</text>
					<subparagraph id="id26410118DF7F4F16BBC96B989414AC45"><enum>(A)</enum><text>by inserting
			 <quote>or clause (iv)</quote> after <quote>clause (i)</quote>; and</text>
					</subparagraph><subparagraph id="id26D90699C9A546A894EF74C1AA7CF7B1"><enum>(B)</enum><text>by striking
			 <quote>, and</quote> and inserting a semicolon;</text>
					</subparagraph></paragraph><paragraph id="id037FCCAD6BA843FB95FFB6685D169BA1"><enum>(3)</enum><text>in clause (iii),
			 by adding <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="id8228FE3BD784436A8AE24DEC3441D4FD"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id96327738B14B4264B12D78F2DF257735" style="OLC">
						<clause id="id796B36C04ADC4AE0AB0B0C833169F6CB" indent="up1"><enum>(iv)</enum><text>an alien described in clause (i)
				who has been accepted and plans to attend an accredited graduate program in a
				STEM field at an institution of higher education (as defined in section 101 of
				the Higher Education Act of 1965 (20 U.S.C. 1001)) for the purpose of obtaining
				an advanced
				degree;</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id2A7055E85EC749FBB38C3124A9702B05"><enum>(b)</enum><header>Requirements
			 for obtaining an F–4 visa</header><text>Section 214(m) of the Immigration and
			 Nationality Act (8 U.S.C. 1184(m)) is amended—</text>
				<paragraph id="id08355FFDF13F41F4ACC7C214FCEAAD49"><enum>(1)</enum><text>by striking the
			 matter preceding paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA229317B369D457E8F1461BEA0F9BACB" style="OLC">
						<subsection id="id299A7062F6EF43D49CFE2CE566601887"><enum>(m)</enum><header>Nonimmigrant
				elementary, secondary, and post-Secondary school
				students</header>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idC9756A15D228456A8FE83AA1207CB2EB"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id86BBEB10EC4946BC94DE1139F514F7C8" style="OLC">
						<paragraph id="id69CC10A5D48246AB87554E092A90EF91" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id254F8710AA0B4B11B52805BF7BE192DF"><enum>(A)</enum><text>An alien who obtains
				the status of a nonimmigrant under section 101(a)(15)(F)(iv) shall demonstrate
				an intent to—</text>
								<clause id="idD1C37879A28644FABEEC61F6E70D3D4C" indent="up1"><enum>(i)</enum><text>return to the country of residence of
				such alien immediately after the completion or termination of the graduate
				program qualifying such alien for such status; or</text>
								</clause><clause id="id045126D2D2D34C7B9D0A2CABEFE24D15" indent="up1"><enum>(ii)</enum><text>obtain employment in the United
				States in a STEM field and become a permanent resident of the United States
				upon the completion of the graduate program, which was the basis for such
				nonimmigrant status.</text>
								</clause></subparagraph><subparagraph id="id20AC430F6A044A83A2507D9D59CE9907" indent="up1"><enum>(B)</enum><text>A visa issued to an alien under
				section 101(a)(15)(F)(iv) shall be valid—</text>
								<clause id="idF7FD970F04D9445F82DCA16CAE3CD242"><enum>(i)</enum><text>during the intended period of study in
				a graduate program described in such section;</text>
								</clause><clause id="id9FE7C6C663FD4C73B5358EE1072D901D"><enum>(ii)</enum><text>for an additional period, not to
				exceed 1 year beyond the completion of the graduate program, if the alien is
				actively pursuing an offer of employment in a STEM field; and</text>
								</clause><clause id="id72F03B108EBF4B29ABF8A8172D5E260E"><enum>(iii)</enum><text>for an additional period, not to
				exceed 6 months, while the alien’s application for adjustment of status under
				section 245(i)(4) is pending.</text>
								</clause></subparagraph><subparagraph id="idA903789CA6BE4F829F9BA1AAA8A4732D" indent="up1"><enum>(C)</enum><text>An alien shall qualify for adjustment
				of status to that of a person admitted for permanent residence if the
				alien—</text>
								<clause id="idEFED88D6398F4F75B458BA2E0B76F415"><enum>(i)</enum><text>has the status of a nonimmigrant under
				section 101(a)(15)(F)(iv);</text>
								</clause><clause id="idA1F575E6FE3941BFAEBBB049EB4B6342"><enum>(ii)</enum><text>has successfully earned an advanced
				degree in a STEM field at an institution of higher education (as defined in
				section 101 of the Higher Education Act of 1965 (20 U.S.C. 1001)); and</text>
								</clause><clause id="idAE3BA385B09F436DA048FEAFBE9303BF"><enum>(iii)</enum><text>is employed full-time in the United
				States in a position in a STEM
				field.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id52C1685BAE7A4D2BAA857E7B1FE5D76D"><enum>(c)</enum><header>Adjustment of
			 status</header><text>Section 245(i) of the Immigration and Nationality Act (8
			 U.S.C. 1255(i)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2A561C3A38D648ADBA2FF36A85E87232" style="OLC">
					<paragraph id="id304B101A784F45EEB333E28C4B90115C" indent="up1"><enum>(4)</enum><text>The Secretary of Homeland Security
				may adjust the status of an alien who meets the requirements under section
				214(m)(3) to that of an alien lawfully admitted for permanent residence if the
				alien—</text>
						<subparagraph id="id967EC82794EC4523B38FD9916E13ECD3"><enum>(A)</enum><text>makes an application for such
				adjustment;</text>
						</subparagraph><subparagraph id="id3318DBBE81C24CB39F2C4656B3D3F703"><enum>(B)</enum><text>is eligible to receive an immigrant
				visa;</text>
						</subparagraph><subparagraph id="idFBD3BD3F7EC34F99BC5ECB9203A5FFAB"><enum>(C)</enum><text>is admissible to the United States for
				permanent residence; and</text>
						</subparagraph><subparagraph id="idE26EE9B999E8415C80E27365D6D30875"><enum>(D)</enum><text>remits a fee in an amount to be
				determined by the
				Secretary.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id97EAAB6D436746629722F69073365864"><enum>(d)</enum><header>Use of
			 fees</header>
				<paragraph id="id91763C04D85A437E8356E1C7A698BF02"><enum>(1)</enum><header>Job training;
			 scholarships</header><text>Section 286(s)(1) of the Immigration and Nationality
			 Act (8 U.S.C. 1356(s)(1)) is amended by inserting <quote>and 80 percent of the
			 fees collected under section 245(i)(4)</quote> before the period at the
			 end.</text>
				</paragraph><paragraph id="idC0598FFA8B6545D8A2DF56A3656C79E0"><enum>(2)</enum><header>Fraud
			 prevention and detection</header><text>Section 286(v)(1) of the Immigration and
			 Nationality Act (8 U.S.C. 1356(v)(1)) is amended by inserting <quote>and 20
			 percent of the fees collected under section 245(i)(4)</quote> before the period
			 at the end.</text>
				</paragraph></subsection></section><section id="id56BA06C4A7C9442E852D3BD5D994DAEB"><enum>4.</enum><header>Aliens not
			 subject to numerical limitations on employment-based immigrants</header>
			<subsection id="id67477A9DD8494C8086487E8EC84730A4"><enum>(a)</enum><header>In
			 general</header><text>Section 201(b)(1) of the Immigration and Nationality Act
			 (8 U.S.C. 1151(b)(1)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7BB5DA7B2CB545ED800BCAFD3793E393" style="OLC">
					<subparagraph id="idADEDB124FD4343FA9AD386D809522487" indent="up1"><enum>(F)</enum><text>Aliens who have earned an advanced
				degree in a STEM field and have been working in a STEM field in the United
				States under a nonimmigrant visa during the 3-year period preceding their
				application for an immigrant visa under section
				203(b).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC33DB2D600E34DE2890F0D00263B4B0E"><enum>(b)</enum><header>Applicability</header><text>The
			 amendments made by subsection (a) shall apply to any visa application—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id47BB2434EEEE4A33B514BC529F75C9D1"><enum>(1)</enum><text>pending on the
			 date of the enactment of this Act; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9CFA3768EB6F4D4EAD373EA818E1D865"><enum>(2)</enum><text>filed on or after
			 such date of enactment.</text>
				</paragraph></subsection></section><section id="id93BFF12543F345C6A175E0A9537662B7"><enum>5.</enum><header>Annual report on
			 STEM nonimmigrant visas</header>
			<subsection id="id95085D8EEBA547659BD4056A8780ABC8"><enum>(a)</enum><header>Requirement for
			 report</header><text>The Secretary of Homeland Security shall submit to
			 Congress an annual report on the nonimmigrant visas granted pursuant to clause
			 (iv) of section 101(a)(15)(F) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(15)(F)), as added by section 3(a).</text>
			</subsection><subsection id="id0EB555CE2EC0471D88B7CF702BCF4642"><enum>(b)</enum><header>Content</header><text>Each
			 report required by subsection (a) shall include the following:</text>
				<paragraph id="idF3DC196442FD4FEAB8469C97929B16C1"><enum>(1)</enum><text>The number of
			 nonimmigrant visas granted during the previous year pursuant to clause (iv) of
			 section 101(a)(15)(F) of the Immigration and Nationality Act, as added by
			 section 3(a).</text>
				</paragraph><paragraph id="id2CF19139774F4269B837564560036500"><enum>(2)</enum><text>The countries of
			 origin of the aliens granted nonimmigrant visas pursuant to such clause
			 (iv).</text>
				</paragraph><paragraph id="id673E303D05DC42F78F523EDC0E20DE94"><enum>(3)</enum><text>The number of
			 degrees granted to such aliens and the fields of such degrees.</text>
				</paragraph><paragraph id="idFF5C6CFB76BC4B2CBF1FC456C899EE4D"><enum>(4)</enum><text>A description of
			 the employers of such aliens.</text>
				</paragraph></subsection></section></legis-body>
