		<official-title>To make it unlawful to alter or remove the identification
		  number of a mobile device. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Mobile Device Theft Deterrence Act
			 of 2012</short-title></quote>.</text>
		</section><section id="idDF69C24814B043A8921F7324751A936A"><enum>2.</enum><header>Altering or
			 removing cellular telephone identification numbers</header>
			<subsection id="id4F9A5DEB78634F67A9CD3632FEA67FE4"><enum>(a)</enum><header>In
			 general</header><text>Chapter 25 of title 18, United States Code, is amended by
			 adding at the end the following:</text>

					<section id="id57E238E73AC842B2A27F478EEB3489FA"><enum>515.</enum><header>Altering or
				removing mobile device identification numbers</header>
						<subsection id="id34B563C06EC04970A2324F7E9BDFBDEC"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="idF60D46E5180044E7BFABFCBE10BE1432"><enum>(1)</enum><text>the term
				<term>manufacturer</term> means a person who has lawfully obtained the right to
				assign a mobile device identification number to a mobile device before the
				initial sale of the mobile device; and</text>
							</paragraph><paragraph id="idECB4B81C97EE4173B95551052DB067B4"><enum>(2)</enum><text>the term
				<term>mobile device identification number</term> means an international mobile
				equipment identity number, electronic serial number, or any other number or
				signal that identifies a specific mobile wireless communications device.</text>
							</paragraph></subsection><subsection id="id0C68D9890DC1475C8C2E4D2FC739972F"><enum>(b)</enum><header>Prohibition</header><text>Except
				as provided in subsection (d), it shall be unlawful to—</text>
							<paragraph id="id5ABDCAF14EDB48AF830946C01D518046"><enum>(1)</enum><text>knowingly remove,
				obliterate, tamper with, or alter a mobile device identification number;
				or</text>
							</paragraph><paragraph id="id5BD88F98312D4FBD9AA03E379116F2BE"><enum>(2)</enum><text>knowingly use,
				produce, traffic in, have control or custody of, or possess hardware or
				software, knowing it has been configured to engage in the conduct described in
				paragraph (1).</text>
							</paragraph></subsection><subsection id="id567475C07F00425B9129F310035669E3"><enum>(c)</enum><header>Penalty</header><text>Any
				person who violates subsection (b) shall be fined under this title, imprisoned
				not more than 5 years, or both.</text>
						</subsection><subsection commented="no" id="id52D1789860194B3D965AF035FD3F107D"><enum>(d)</enum><header>Exception</header><text>Subsection
				(b) shall not apply to the manufacturer of a mobile device or a person who
				repairs or refurbishes a mobile device unless the manufacturer or person knows
				that the mobile device or part involved is
				stolen.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE99CCAF081584BB78CD4554CD151B5A1"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 25 of
			 title 18, United States Code, is amended by inserting after the item relating
			 to section 514 the following:</text>
