		<official-title>To amend the Truth in Lending Act to require servicers to
		  provide responses to mortgagors requesting residential mortgage loan
		  refinancing, and for other purposes.</official-title>

		<section id="id464A81A36B8F44D5B4AA43BECA35E123" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Stopping
			 Ongoing Lender Delays Act</quote> or the <quote><short-title>SOLD Act</short-title></quote>.</text>
		</section><section id="idEED0E18DFF82419DBE67F8104E293D5A" section-type="subsequent-section"><enum>2.</enum><header>Truth in Lending Act
			 Amendments</header><text display-inline="no-display-inline">Chapter 2 of the
			 Truth in Lending Act (15 U.S.C. 1631 et seq.) is amended by inserting before
			 section 130 (15 U.S.C. 1640) the following new section:</text>

				<section id="id32F2461044AF4AF8989370BE12393AB0"><enum>129I.</enum><header>Responses
				required for mortgagor requests for refinancing</header>
					<subsection id="id196f0110bffa4446b2a516a9cec1d00a"><enum>(a)</enum><header>In
				general</header>
						<paragraph id="ide03873adc25d4799abd7dcb3319a9d20"><enum>(1)</enum><header>Written
				response to mortgagor requests required</header>
							<subparagraph id="idcc6d58bd81b444238e04c006bd467b93"><enum>(A)</enum><header>In
				general</header><text>Each servicer shall respond in writing to a mortgagor of
				a residential mortgage loan who has submitted a written request that meets the
				requirements of subsection (b), not later than the end of the 30-calendar day
				period beginning on the date of receipt of such request, subject to paragraphs
				(2) and (3).</text>
							</subparagraph><subparagraph id="idb75a8edef43e4955a2a9de29323f1bba"><enum>(B)</enum><header>Applicability</header><text>Subparagraph
				(A) shall apply, except as provided in subsection (b), and notwithstanding any
				other provision of law or of any contract, including a contract between a
				servicer of a residential mortgage loan and a securitization vehicle or other
				investment vehicle.</text>
							</subparagraph></paragraph><paragraph id="id619c1574f4a24e4a923864b129e0fad6"><enum>(2)</enum><header>Content</header><text>A
				written response by a servicer under paragraph (1) shall specify—</text>
							<subparagraph id="iddf3e20c6c3154aa19ff642a9c7313832"><enum>(A)</enum><text>a decision on
				whether such request has been denied or approved, or that such request has been
				approved subject to specified changes; or</text>
							</subparagraph><subparagraph id="idc9c15ca9f13944768c94c039e1d508e7"><enum>(B)</enum><text>that additional
				time is required, in which case the servicer shall provide a new decision
				date.</text>
							</subparagraph></paragraph><paragraph id="id7311feda82384a92a3c6e9cbf0c429e7"><enum>(3)</enum><header>Single
				extension of new decision date authorized</header><text>A servicer may, upon
				written notice to the mortgagor, extend a new decision date provided under
				paragraph (2)(B) a single time, for a period of not longer than 30 additional
				calendar days.</text>
						</paragraph></subsection><subsection id="H2E11D1B3B08842959BBDB2C4C70FDC6D"><enum>(b)</enum><header>Inapplicability
				to certain existing mortgages</header><text>Subsection (a) shall not apply with
				respect to any residential mortgage with respect to which the mortgagor and the
				mortgagee or servicer have entered into a written agreement before the date of
				enactment of this Act explicitly providing a procedure or terms for approval of
				a short sale.</text>
					</subsection><subsection id="idf6e3f430c07a4bf687e67758b2de9024"><enum>(c)</enum><header>Mortgagor
				submission</header><text>Subsection (a) shall apply in any case in which the
				mortgagor under a residential mortgage loan submits to the servicer
				thereof—</text>
						<paragraph id="id6ab60f7c81de434f8080bf4f9386bede"><enum>(1)</enum><text>a written offer
				for a short sale of the dwelling or residential real property that is subject
				to the mortgage, deed of trust, or other security interest that secures the
				mortgage loan; and</text>
						</paragraph><paragraph id="id88ae1c06dba44256ad2914c9d7d84864"><enum>(2)</enum><text>all information
				required by the servicer in connection with such a request (including a copy of
				an executed contract between the owner of the dwelling or property and the
				prospective buyer that is subject to approval by the servicer).</text>
						</paragraph></subsection><subsection id="id55325a3410d84515b5c288b6c79411e1"><enum>(d)</enum><header>Civil actions
				authorized</header><text>An aggrieved individual may bring an action in a court
				of competent jurisdiction, asserting a violation of this section. Aggrieved
				individuals may be awarded all appropriate relief, including equitable relief,
				and a monetary award of $1,000 per violation, plus reasonable attorneys' fees,
				or such higher amount as may be appropriate in the case of an established
				pattern or practice of such failures.</text>
					</subsection><subsection id="id0FDBA713438748CABC5185F05CADD584"><enum>(e)</enum><header>Definitions</header>
						<paragraph id="id2d65944911124fde805369a634795113"><enum>(1)</enum><header>Residential
				mortgage loan</header><text>The term <term>residential mortgage loan</term>
				means any consumer credit transaction that is secured by a mortgage, deed of
				trust, or other equivalent consensual security interest on a dwelling or on
				residential real property that includes a dwelling, other than a consumer
				credit transaction under an open end credit plan or an extension of credit
				relating to a plan described in section 101(53D) of title 11, United States
				Code.</text>
						</paragraph><paragraph id="id6174e24aeee04ff08087dc0cfa89ca55"><enum>(2)</enum><header>Servicer</header><text>The
				term <term>servicer</term> has the same meaning as in section 129A, except that
				such term includes a person who makes or holds a residential mortgage loan
				(including a pool of residential mortgage loans), if such person also services
				the loan.</text>
						</paragraph><paragraph id="H4F6807B7101648E58E18603623DDE737"><enum>(3)</enum><header>Short
				sale</header><text display-inline="yes-display-inline">The term <term>short
				sale</term> means the sale of the dwelling or residential real property that is
				subject to the mortgage, deed or trust, or other security interest that secures
				a residential mortgage loan that—</text>
							<subparagraph id="HF21AD384F51D455AACC7F0C0F9C457DD"><enum>(A)</enum><text>will result in
				proceeds in an amount that is less than the remaining amount due under the
				mortgage loan; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H136EE736FD6F4A78A9C21AFA260B95E0"><enum>(B)</enum><text>requires
				authorization by the securitization vehicle or other investment vehicle or
				holder of the mortgage loan, or the servicer acting on behalf of such a vehicle
				or
				holder.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
