		<official-title>To provide for the coverage of medically necessary food
		  under Federal health programs and private health insurance.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Medical Foods Equity Act of
			 2011</short-title></quote>.</text>
		</section><section id="id80F4918639154328A4F61FBFDB20F735"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID56211031972940008c60d746f145fa4a"><enum>(1)</enum><text>Newborns are
			 screened for inborn errors of metabolism, but treatment for such conditions is
			 not uniformly covered by insurance.</text>
			</paragraph><paragraph id="IDd5224151eb8e434099bf5b81b3584097"><enum>(2)</enum><text>Each year
			 approximately 2,550 children in the United States are diagnosed with an inborn
			 error of metabolism disorder, requiring foods modified to be void of the
			 nutrient or nutrients the child’s body is incapable of processing, or requiring
			 supplementation with vitamins or amino acids.</text>
			</paragraph><paragraph id="ID24c32641eddf44539e93c9809a1c0595"><enum>(3)</enum><text>More than 35
			 States have passed laws to at least partially address the inequity in coverage
			 for medically necessary foods, critical treatment for such disorders.</text>
			</paragraph><paragraph id="ID5f37efa5080e4ef5806fcb0d0b6da44e"><enum>(4)</enum><text>The cost
			 associated with providing medically necessary foods presents a large financial
			 burden for many families.</text>
			</paragraph><paragraph id="IDdff6505ae078476fa8c5f1588b815527"><enum>(5)</enum><text>There is no
			 current cure for inborn errors of metabolism disorders and treatment is
			 necessary during the entire lifespan of the individual.</text>
			</paragraph></section><section id="id9C57743E6D4945E18DFC930E4763629D"><enum>3.</enum><header>Coverage in
			 Federal health programs of medically necessary food and food modified to be low
			 protein</header>
			<subsection id="idCCA39FCC746A43A28DAD1377176445EE"><enum>(a)</enum><header>Coverage under
			 the Medicare program</header>
				<paragraph id="id23936C2A0D4E4427828F66DD29B09ACE"><enum>(1)</enum><header>Coverage of
			 medically necessary food under the original medicare fee-for-service
			 program</header>
					<subparagraph id="id58C3E030DC7744469C22585B60E3360F"><enum>(A)</enum><header>In
			 general</header><text>Section 1861(s)(2) of the Social Security Act (42 U.S.C.
			 1395x(s)(2)) is amended—</text>
						<clause id="IDf8be7f3c320948529997169a0b89bf61"><enum>(i)</enum><text>in
			 subparagraph (EE), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="ID1355995b68c7417299957b86fd55d71b"><enum>(ii)</enum><text>in
			 subparagraph (FF), by inserting <quote>and</quote> at the end; and</text>
						</clause><clause id="IDa04bb629f0b3426bbaaf2470b6ac5143"><enum>(iii)</enum><text>by adding at
			 the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="id00302705374C490A947A46A42315790D" style="OLC">
								<subparagraph id="IDb33e028419a94647b7cba1d705d028c7" indent="up1"><enum>(GG)</enum><text>medically necessary food (as defined
				in subsection (iii)) and food modified to be low protein that is formulated to
				be consumed or administered under the supervision of a qualified medical
				provider, for the treatment of conditions as recommended by the Advisory
				Committee on Heritable Disorders in Newborns and Children, and the medical
				equipment and supplies necessary to administer such
				food;</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="ID17d25b71ac3c453287705f49fed41e35"><enum>(B)</enum><header>Definition</header><text>Section
			 1861 of the Social Security Act (42 U.S.C. 1395x) is amended by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="idE727E0267CF5449BB92102326630A206" style="OLC">
							<subsection id="id4496A7C209D04779863FC2F26C700FA8"><enum>(iii)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id8EC1EFAAD49A40B6A0F5B29666918353"><enum>(1)</enum><text>The term
				<term>medically necessary food</term>—</text>
									<subparagraph id="id74B6D739BD4C45D5987B5313FDD3F600" indent="up1"><enum>(A)</enum><text>means a food which is formulated to be
				consumed or administered enterally under the supervision of a physician and
				which is intended for the specific dietary management of a disease or condition
				for which distinctive nutritional requirements, based on recognized scientific
				principles, are established by medical evaluation; and</text>
									</subparagraph><subparagraph id="idEBA6DA433CA047D08DBC7EFAC037EF11" indent="up1"><enum>(B)</enum><text>includes nutritionally modified
				counterparts of traditional foods and other forms of foods such as formulas,
				pills, capsules, and bars, so long as consumed or administered
				enterally.</text>
									</subparagraph></paragraph><paragraph id="id1EBDABBE86E74CE882BFC80CC9586CC8" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the
				term <term>enterally</term> refers to consumption or administration through the
				gastrointestinal tract, whether orally or by
				tube.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="idE5E90198D50B444B8EA19BACE68FE3D2"><enum>(C)</enum><header>Payment</header><text>Section
			 1833(a)(1) of the Social Security Act (42 U.S.C. 1395l(a)(1)) is
			 amended—</text>
						<clause id="IDc09a1480103a419db58f55fcf37e8d52"><enum>(i)</enum><text>by
			 striking <quote>and</quote> before <quote>(Z)</quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID84495b5e897d4b3dbc7ccd3ec771534e"><enum>(ii)</enum><text>by inserting
			 before the semicolon at the end the following: “, and (AA) with respect to
			 medically necessary food and pharmacological doses of vitamins and amino acids
			 under section 1861(s)(2)(GG), the amounts paid shall be 80 percent of the
			 lesser of the actual charge for the services or 85 percent of the amount
			 determined under the fee schedule established under section 1848(b) for the
			 same services if furnished by a physician”.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52CAE1ED20D54B7BA8F9074FDE48EBFA"><enum>(2)</enum><header>Inclusion of
			 pharmacological doses of vitamins and amino acids as a covered part D
			 drug</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id49F195C5E94045A6997664B6A2AAEEE9"><enum>(A)</enum><header>In
			 general</header><text>Section 1860D–2(e)(1) of the Social Security Act (42
			 U.S.C. 1395w–102(e)(1)) is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="idA1865DB52F8B43F9ADF846E045010EF6"><enum>(i)</enum><text>in subparagraph
			 (A), by striking <quote>or</quote> at the end;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idE9473EFEF1DF47B8A3E28E42E8A5F24D"><enum>(ii)</enum><text>in subparagraph
			 (B), by striking the comma at the end and inserting <quote>; or</quote>;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id0E84BF35ED324BD1B08A4523BAAEF491"><enum>(iii)</enum><text>by inserting
			 after subparagraph (B) the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="id0F676C31A7234C9B8D0B17DC18F3126A" style="OLC">
								<subparagraph commented="no" display-inline="no-display-inline" id="id8B1C43E783704E269377098382F3E91C"><enum>(C)</enum><text>pharmacological
				doses of vitamins and amino acids used for the treatment of inborn errors of
				metabolism, for the treatment of conditions as recommended by the Advisory
				Committee on Heritable Disorders in Newborns and Children and as prescribed by
				a qualified medical
				provider,</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1F35DF95F05F4511AFEF1F3F168DCF66"><enum>(B)</enum><header>Effective
			 date</header><text>The amendments made by subparagraph (A) shall apply to plan
			 years beginning on or after the date that is 6 months after date of enactment
			 of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="idF2C06331F7214B9F8568C4B43328873C"><enum>(b)</enum><header>Coverage under
			 the Medicaid program</header>
				<paragraph id="id1B1CAC4D6C6049D7BE895CEEA70E9C67"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1905 of the
			 Social Security Act (42 U.S.C. 1396d) is amended—</text>
					<subparagraph id="HA45DC36D5A7F40F0BD22A8EDE11F578C"><enum>(A)</enum><text>in subsection
			 (a)—</text>
						<clause id="id8672EB974A864B80B7D8D98C9D166605"><enum>(i)</enum><text>in
			 paragraph (12), by inserting <quote>including pharmacological doses of vitamins
			 and amino acids used for the treatment of inborn errors of metabolism, for the
			 treatment of conditions as recommended by the Advisory Committee on Heritable
			 Disorders in Newborns and Children and as prescribed by a qualified medical
			 provider,</quote> after <quote>prescribed drugs,</quote>;</text>
						</clause><clause id="H00AE09514F7C4330811C6625CA92A1B4"><enum>(ii)</enum><text>in
			 paragraph (28), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="id5BC566B243EF43A6AD2CC1F701C8D0C8"><enum>(iii)</enum><text>in paragraph
			 (29), by striking the comma at the end and inserting <quote>; and</quote>;
			 and</text>

			 inserting after paragraph (29) the following new paragraph:</text>

				subsection (ee)) and food modified to be low protein that is formulated to be
				consumed or administered under the supervision of a qualified medical provider,
				for the treatment of conditions as recommended by the Advisory Committee on
				Heritable Disorders in Newborns and Children, and the medical equipment and
				supplies necessary to administer such
				food,</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8EFE0A54E6D8475D9CB1E5C029507D1"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="idB4D8EF20AFC541FF93C2AA3D081341AD" style="OLC">
							<subsection id="H1C79C9EEA3ED4FB58C6D6D52864E9593"><enum>(ee)</enum><header>Medically
				necessary food defined</header>
								<paragraph id="id1FD3B782DA68476FA84D1A097CF7C15D"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsection (a)(30), the term
				<term>medically necessary food</term>—</text>
									<subparagraph id="idE272E46836AB4FAFAEA245C64A2B48F3"><enum>(A)</enum><text>means a food
				which is formulated to be consumed or administered enterally under the
				supervision of a physician and which is intended for the specific dietary
				management of a disease or condition for which distinctive nutritional
				requirements, based on recognized scientific principles, are established by
				medical evaluation; and</text>
									</subparagraph><subparagraph id="id9B298C447F594F2FB9E3E67F5A526494"><enum>(B)</enum><text>includes
				nutritionally modified counterparts of traditional foods and other forms of
				foods such as formulas, pills, capsules, and bars, so long as consumed or
				administered enterally.</text>
									</subparagraph></paragraph><paragraph id="id1F664B6926F940A3B4ADF326F870E884"><enum>(2)</enum><header>Enterally</header><text>For
				purposes of paragraph (1), the term <term>enterally</term> refers to
				consumption or administration through the gastrointestinal tract, whether
				orally or by
				tube.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30B70ECFC7B44695AE06C30591FCDFC4"><enum>(2)</enum><header>Exception to
			 rebate exclusion</header><text>Section 1927(d)(2)(E) of the Social Security Act
			 (42 U.S.C. 1396r–8(d)(2)(E)) is amended by inserting <quote>, pharmacological
			 doses of vitamins and amino acids used for the treatment of inborn errors of
			 metabolism, for the treatment of conditions as recommended by the Advisory
			 Committee on Heritable Disorders in Newborns and Children and as prescribed by
			 a qualified medical provider,</quote> after <quote>prenatal
			 vitamins</quote>.</text>
				</paragraph><paragraph id="HD1F951EF21E84155B85F911D6C7FD648"><enum>(3)</enum><header>Conforming
			 amendment</header><text>Section 1902(a)(10)(A) of the Social Security Act (42
			 U.S.C. 1396a(a)(10)(A)) is amended, in the matter preceding clause (i), by
			 striking <quote>and (28)</quote> and inserting <quote>(28), and
			 (30)</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H45431AF6263543F19E01E08B21F2BD5B"><enum>(4)</enum><header>Exception to
			 effective date if state legislation required</header><text>In the case of a
			 State plan for medical assistance under title XIX of the Social Security Act
			 which the Secretary of Health and Human Services (referred to in this Act as
			 the <quote>Secretary</quote>) determines requires State legislation (other than
			 legislation appropriating funds) in order for the plan to meet the additional
			 requirement imposed by the amendments made by this subsection, the State plan
			 shall not be regarded as failing to comply with the requirements of such title
			 solely on the basis of its failure to meet this additional requirement before
			 the first day of the first calendar quarter beginning after the close of the
			 first regular session of the State legislature that begins after the date of
			 the enactment of this Act. For purposes of the previous sentence, in the case
			 of a State that has a 2-year legislative session, each year of such session
			 shall be deemed to be a separate regular session of the State
			 legislature.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6415159777764CD78F18A0E297218D34"><enum>(c)</enum><header>Coverage under
			 CHIP</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id5FD2AC6291F747B49690028DC154FDEE"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id00FF422273914C61B232A0E152444682"><enum>(A)</enum><header>Medically
			 necessary food</header><text>Section 2103(c) of the Social Security Act (42
			 U.S.C. 1397cc(c)) is amended by adding at the end the following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="idBA9FA2EFBD5E418E91B1B7F3A96E877E"><enum>(9)</enum><header>Medically

								<subparagraph commented="no" display-inline="no-display-inline" id="id32D9599B9A4D49E8BC41FD454F185F18"><enum>(A)</enum><header>In
				general</header><text>The child health assistance provided to a targeted
				low-income child under the plan shall include coverage of medically necessary
				food and food modified to be low protein that is formulated to be consumed or
				administered under the supervision of a qualified medical provider, for the
				treatment of conditions as recommended by the Advisory Committee on Heritable
				Disorders in Newborns and Children, and the medical equipment and supplies
				necessary to administer such food.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id060EA20DB7D345DAA4ECEE93CDBC6B61"><enum>(B)</enum><header>Definitions</header><text>In
				this paragraph—</text>
									<clause id="id61F3E800528F46B9B56DAF0BB0FF223A"><enum>(i)</enum><text>the term
				<term>medically necessary food</term>—</text>
										<subclause id="id855B42D686DD4C9D999DB2738CE756F0"><enum>(I)</enum><text>means a food
				which is formulated to be consumed or administered enterally under the
				supervision of a physician and which is intended for the specific dietary
				management of a disease or condition for which distinctive nutritional
				requirements, based on recognized scientific principles, are established by
				medical evaluation; and</text>
										</subclause><subclause id="id59D8116FD5A34C94AFBC34E5910CFA16"><enum>(II)</enum><text>includes
				nutritionally modified counterparts of traditional foods and other forms of
				foods such as formulas, pills, capsules, and bars, so long as consumed or
				administered enterally; and</text>
										</subclause></clause><clause id="id535F7949A982477A9BA7828C25EFF016"><enum>(ii)</enum><text>the term
				<term>enterally</term> refers to consumption or administration through the
				gastrointestinal tract, whether orally or by
				tube.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1986CB8CD96C4028B9A46791373D9B60"><enum>(B)</enum><header>Vitamins and
			 amino acids</header><text>Section 2110(a)(6) of the Social Security Act (42
			 U.S.C. 1397jj(a)(6)) is amended by striking <quote>and biologicals and the
			 administration of such drugs and biologicals, only if such drugs and
			 biologicals</quote> and inserting <quote>, pharmacological doses of vitamins
			 and amino acids used for the treatment of inborn errors of metabolism, for the
			 treatment of conditions as recommended by the Advisory Committee on Heritable
			 Disorders in Newborns and Children and as prescribed by a qualified medical
			 provider, and biologicals, and the administration of such drugs, vitamins and
			 amino acids, and biologicals, only if such drugs, vitamins and amino acids, and
			 biologicals</quote>.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1A19AB89A66C4AB5B8D0F7A69940B924"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 2103(a) of the Social Security Act (42 U.S.C.
			 1397cc(a)) is amended, in the matter preceding paragraph (1), by striking
			 <quote>, and (7)</quote> and inserting <quote>, (7), and (9)</quote>.</text>
				</paragraph></subsection><subsection id="idE00BC58761FA40D3A63CDE89C4926385"><enum>(d)</enum><header>Availability of
			 medically necessary food, food modified To be low protein, and related items
			 under the TRICARE program</header><text display-inline="yes-display-inline">Section 1077(a)(8) of title 10, United
			 States Code, is amended by striking <quote>including</quote> and all that
			 follows and inserting “including the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4D17F0616A744010BEC83C69BBBEF9BF" style="OLC">
					<subparagraph id="id8DBB78C7CE034DB3843763613DE74AAF"><enum>(A)</enum><text>Well-baby care
				that includes one screening of an infant for the level of lead in the blood of
				the infant.</text>
					</subparagraph><subparagraph id="idCA1DB30E2BD1453B9B364D0C2CE789FC"><enum>(B)</enum><text>Medically
				necessary food (as defined in section 1861(iii) of the Social Security Act) and
				food modified to be low protein that is formulated to be consumed or
				administered under the supervision of a qualified medical provider, for the
				treatment of conditions as recommended by the Advisory Committee on Heritable
				Disorders in Newborns and Children, and the medical equipment and supplies
				necessary to administer such food.</text>
					</subparagraph><subparagraph id="idC80652FFDFCB4F4A851A7773BF6F5633"><enum>(C)</enum><text>Pharmacological
				doses of vitamins and amino acids used for the treatment of inborn errors of
				metabolism and other conditions as recommended by the Advisory Committee on
				Heritable Disorders in Newborns and
				Children.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idA2A5967DE89349B68B66A7A322C96EEA"><enum>4.</enum><header>Coverage in the
			 private insurance market of medically necessary food and food modified to be
			 low protein</header>
			<subsection id="idB5A86FB868ED4442B33DB3B8C9F9ED6B"><enum>(a)</enum><header>Group health
			 plans</header>
				<paragraph id="id579A7D1CB0794AC2A87BF75E3739B3AD"><enum>(1)</enum><header>Amendments to
			 ERISA</header>
					<subparagraph id="H5F7D4BAA03614580A6B08C331DF6E8BF"><enum>(A)</enum><header>In
			 general</header><text>Subpart B of part 7 of title I of the Employee Retirement
			 Income Security Act of 1974 (29 U.S.C. 1185 et seq.) is amended by adding at
			 the end the following:</text>

				medically necessary food and food modified to be low protein</header>
								<subsection id="id38AFA80CE1B643BD900D5419FB36A2B2"><enum>(a)</enum><header>Definition</header><text>In
				this section—</text>
									<paragraph id="id45C32ECEA21E4643904E587437DA7F2B"><enum>(1)</enum><text>the term
				<term>medically necessary food</term>—</text>
										<subparagraph id="id1B8D98618F5F452F8534753A3FDEE196"><enum>(A)</enum><text>means a food
				which is formulated to be consumed or administered enterally under the
				supervision of a physician and which is intended for the specific dietary
				management of a disease or condition for which distinctive nutritional
				requirements, based on recognized scientific principles, are established by
				medical evaluation; and</text>
										</subparagraph><subparagraph id="idD21547BA2DE440079F83A123BF04BAAF"><enum>(B)</enum><text>includes
				nutritionally modified counterparts of traditional foods and other forms of
				foods such as formulas, pills, capsules, and bars, so long as consumed or
				administered enterally; and</text>
										</subparagraph></paragraph><paragraph id="idC495D8D7B71F4EAAAA072AB7CEC21E0A"><enum>(2)</enum><text>the term
				<term>enterally</term> refers to consumption or administration through the
				gastrointestinal tract, whether orally or by tube.</text>
									</paragraph></subsection><subsection id="idCE8E132D3C304DE7AA77DCD9B3585BCE"><enum>(b)</enum><header>Coverage</header>
									<paragraph id="id2E6C5125E58E4CF6B8FC9D9AD4299554"><enum>(1)</enum><header>Medically
				necessary food and food modified to be low protein</header><text>A group health
				plan, or a health insurance issuer that provides health insurance coverage in
				connection with a group health plan, shall provide coverage for medically
				necessary food and food modified to be low protein that is formulated to be
				consumed or administered under the supervision of a qualified medical provider,
				for the treatment of conditions as recommended by the Advisory Committee on
				Heritable Disorders in Newborns and Children, and the medical equipment and
				supplies necessary to administer such food.</text>

				the Advisory Committee on Heritable Disorders in Newborns and Children and as
				prescribed by a qualified medical provider, to the same extent as other

				this section—</text>
								<paragraph id="id367BEA694AC349F99CBDECFED2044C7A"><enum>(1)</enum><text>the term
				<term>medically necessary food</term>—</text>
									<subparagraph id="id64EB29653AE3464F8BAD2BBD5E8CA192"><enum>(A)</enum><text>means a food
				which is formulated to be consumed or administered enterally under the
				supervision of a physician and which is intended for the specific dietary
				management of a disease or condition for which distinctive nutritional
				requirements, based on recognized scientific principles, are established by
				medical evaluation, and</text>
									</subparagraph><subparagraph id="idC882B771E6664B8F84BEDC86C37FEA7A"><enum>(B)</enum><text>includes
				nutritionally modified counterparts of traditional foods and other forms of
				foods such as formulas, pills, capsules, and bars, so long as consumed or
				administered enterally; and</text>
									</subparagraph></paragraph><paragraph id="idAFBD7441E559467AABAE1191A0F099FC"><enum>(2)</enum><text>the term
				<term>enterally</term> refers to consumption or administration through the
				gastrointestinal tract, whether orally or by tube.</text>
								</paragraph></subsection><subsection id="id98CF16A011064D7BAC64ADBE7A3173EE"><enum>(b)</enum><header>Coverage</header>
								<paragraph id="id9B4643FC67DD4C63A5DB529CB6A974DD"><enum>(1)</enum><header>Medically
				necessary food and food modified to be low protein</header><text>A group health
				plan, or a health insurance issuer that provides health insurance coverage in
				connection with a group health plan, shall provide coverage for medically
				necessary food and food modified to be low protein that is formulated to be
				consumed or administered under the supervision of a qualified medical provider,
				for the treatment of conditions as recommended by the Advisory Committee on
				Heritable Disorders in Newborns and Children, and the medical equipment and
				supplies necessary to administer such food.</text>
								</paragraph><paragraph id="idA5F41AC5FC154A97AF0EE977B337EA78"><enum>(2)</enum><header>Vitamins and
				amino acids</header><text>A group health plan, or a health insurance issuer
				that provides health insurance coverage in connection with a group health plan,
				that provides prescription drug coverage, shall provide coverage for
				pharmacological doses of vitamins and amino acids used for the treatment of

			 general</header><text>Subchapter B of chapter 100 of the Internal Revenue Code
			 of 1986 (relating to other group health plan requirements) is amended by
			 inserting after section 9813 the following new section:</text>

				this section—</text>

										<subparagraph id="id1240A564C71B4A04BB30244BA0A38289"><enum>(A)</enum><text>means a food
				which is formulated to be consumed or administered enterally under the

				medically necessary food and food modified to be low protein that is formulated
				to be consumed or administered under the supervision of a qualified medical
				provider, for the treatment of conditions as recommended by the Advisory
				Committee on Heritable Disorders in Newborns and Children, and the medical
				equipment and supplies necessary to administer such food.</text>
									</paragraph><paragraph id="id88E59C6A47244C24A963E0889CAE9A07"><enum>(2)</enum><header>Vitamins and
				amino acids</header><text>A group health plan, or a health insurance issuer
				that provides health insurance coverage in connection with a group health plan,

			 following new section:</text>

					<section id="idA5EAFD2F832742119CBD6AD4C5978FF5"><enum>2754.</enum><header>Coverage of
				medically necessary food and food modified to be low protein</header><text display-inline="no-display-inline">The provisions of section 2729 shall apply
				to health insurance coverage offered by a health insurance issuer in the
				individual market in the same manner as they apply to health insurance coverage
				offered by a health insurance issuer in connection with a group health plan in
				the small or large group
				market.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idAB76064AEEF547A3AE4CF08BDAAAFBE6"><enum>(c)</enum><header>Amendment to
			 PPACA</header><text>Section 1302(b)(1) of the Patient Protection and Affordable
			 Care Act (42 U.S.C. 18022(b)(1)) is amended by adding at the end the
			 following:</text>

			</subsection></section><section id="ID07e595274aa04d1ea2b717e45adbf79a"><enum>5.</enum><header>Effective date;
			 determination of minimum yearly coverage</header>
			<subsection id="idBF679CA6479D45AAAB3C5C906D17B65D"><enum>(a)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 sections 3 and 4 shall apply to plan years beginning after the date that is 180
			 days after the date of enactment of this Act.</text>
			</subsection><subsection id="id247E79269C7D4625ACAB1D2FD97871D9"><enum>(b)</enum><header>Determination
			 by Secretary</header>
				<paragraph id="idC957788E64694764A725FD8E33A2E7B6"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Prior to the date
			 described under subsection (a), the Secretary of Health and Human Services
			 (referred to in this Act as the <term>Secretary</term>) shall determine the
			 minimum yearly coverage for all health insurance plans pursuant to the
			 amendments made by this Act. Such minimum yearly coverage shall apply to an
			 individual during any period when the individual is covered under the plan and
			 for as long as deemed medically necessary. The Secretary may establish
			 age-specific minimum levels of coverage and periodically update these levels
			 based on a standard cost of living index, the actual cost of treatment, and
			 other appropriate measures as determined by the Secretary.</text>
				</paragraph><paragraph id="idE72280931834407CA3BA1F873B463417"><enum>(2)</enum><header>No
			 preemption</header><text>The minimum yearly coverage determined by the
			 Secretary under paragraph (1) shall not preempt any State standards that
			 require a higher minimum yearly coverage level for the same services and
			 benefits.</text>
