		<section id="idA27771B57A0A46E5B052FD9736E625C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Orphan Earmarks
			 Act</short-title></quote>.</text>
		</section><section id="idD948F0350CA64CFC842D326CDC26DEB1"><enum>2.</enum><header>Unused
			 earmarks</header>
			<subsection id="id33961C0063884FF8AA351643482677F1"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term
			 <term>earmark</term> means the following:</text>
				<paragraph id="ID62bf5f66c18845ecabd3d161fcde6141"><enum>(1)</enum><text>A congressionally
			 directed spending item, as defined in Rule XLIV of the Standing Rules of the
			 Senate.</text>
				</paragraph><paragraph id="IDb049bd9726b14bcdb817099eb3c5a318"><enum>(2)</enum><text>A congressional
			 earmark, as defined for purposes of Rule XXI of the Rules of the House of
			 Representatives.</text>
				</paragraph></subsection><subsection id="IDbde892ba61344c6c8fc0205eddd00d0e"><enum>(b)</enum><header>Rescission</header><text display-inline="yes-display-inline">Any earmark of funds provided for any
			 Federal agency with more than 90 percent of the appropriated amount remaining
			 available for obligation at the end of the 9th fiscal year following the fiscal
			 year in which the earmark was made available is rescinded effective at the end
			 of that 9th fiscal year, except that the agency head may delay any such
			 rescission if the agency head determines that an additional obligation of the
			 earmark is likely to occur during the following 12-month period.</text>
			</subsection><subsection id="id343AFD98E4374E5E8E98F142B48FCED4"><enum>(c)</enum><header>Identification
			 and report</header>
				<paragraph id="ID1f4423cfdf9648bf8405d9812958eaf2"><enum>(1)</enum><header>Agency
			 identification</header><text>Each Federal agency shall identify and report
			 every project that is an earmark with an unobligated balance at the end of each
			 fiscal year to the Director of OMB.</text>
				</paragraph><paragraph id="ID94b3c6c531b74444bb2ecc9ae2a7291a"><enum>(2)</enum><header>Annual
			 report</header><text>The Director of OMB shall submit to Congress and
			 publically post on the Web site of OMB an annual report that includes—</text>
					<subparagraph id="ID61200e57af75492aadf2b56ad7212551"><enum>(A)</enum><text>a listing and
			 accounting for earmarks with unobligated balances summarized by agency
			 including the amount of the original earmark, amount of the unobligated
			 balance, and the year when the funding expires, if applicable;</text>
					</subparagraph><subparagraph id="IDa3ae6e7d588e4319949dd16dc7162a78"><enum>(B)</enum><text>the number of
			 rescissions resulting from this section and the annual savings resulting from
			 this section for the previous fiscal year; and</text>
					</subparagraph><subparagraph id="ID8960fed000dc430098ec103f0f57ed2c"><enum>(C)</enum><text>a listing and
			 accounting for earmarks provided for Federal agencies scheduled to be rescinded
			 at the end of the current fiscal year.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
