		<official-title display="yes">To provide for the exchange of certain land
		  located in the Arapaho-Roosevelt National Forests in the State of Colorado, and
		  for other purposes</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="HDB152FD543404D08876683719C8A230D" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sugar Loaf Fire Protection District
			 Land Exchange Act of 2011</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HCF523128B0CE46B4826640136642FAC5" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HBC310BB6EFC9467E8A918AE85AA4568E"><enum>(1)</enum><header display-inline="yes-display-inline">District</header><text display-inline="yes-display-inline">The term <term>District</term> means the
			 Sugar Loaf Fire Protection District of Boulder, Colorado.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B036EDFCA2B46E7A08030CE4EE4A4B2"><enum>(2)</enum><header display-inline="yes-display-inline">Federal land</header><text display-inline="yes-display-inline">The term <term>Federal land</term>
			 means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HC1C3D07A16EE4FEF8D628120ABAC538D"><enum>(A)</enum><text display-inline="yes-display-inline">the parcel of approximately 1.52 acres of
			 land in the National Forest that is generally depicted on the map numbered 1,
			 entitled <quote>Sugarloaf Fire Protection District Proposed Land
			 Exchange</quote>, and dated November 12, 2009; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD94EDEEF40DB40679736EE57C12ABEC8"><enum>(B)</enum><text display-inline="yes-display-inline">the parcel of approximately 3.56 acres of
			 land in the National Forest that is generally depicted on the map numbered 2,
			 entitled <quote>Sugarloaf Fire Protection District Proposed Land
			 Exchange</quote>, and dated November 12, 2009.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B1EB3C7A5AD4FCA9D4090A549B543ED"><enum>(3)</enum><header display-inline="yes-display-inline">National forest</header><text display-inline="yes-display-inline">The term <term>National Forest</term> means
			 the Arapaho-Roosevelt National Forests located in the State of Colorado.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE6CBBE34A38F40CFBC2338AF5899359C"><enum>(4)</enum><header display-inline="yes-display-inline">Non-Federal land</header><text display-inline="yes-display-inline">The term <term>non-Federal land</term>
			 means the parcel of approximately 5.17 acres of non-Federal land in
			 unincorporated Boulder County, Colorado, that is generally depicted on the map
			 numbered 3, entitled <quote>Sugarloaf Fire Protection District Proposed Land
			 Exchange</quote>, and dated November 12, 2009.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0097F17DF7F3444486946A3186BAA874"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Agriculture.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H71665755A3FF44D48C2CC13E26ADBC10" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Land exchange</header>
			<subsection commented="no" display-inline="no-display-inline" id="H1A39C0FCC5D84E08A62834FFBFEA6E2C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to the provisions of this Act, if
			 the District offers to convey to the Secretary all right, title, and interest
			 of the District in and to the non-Federal land, and the offer is acceptable to
			 the Secretary—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE70F9B47690246B988299BC4A6896459"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary shall accept the offer;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H24CC52DAC9A14074A1B4BA641DC14658"><enum>(2)</enum><text display-inline="yes-display-inline">on receipt of acceptable title to the
			 non-Federal land, the Secretary shall convey to the District all right, title,
			 and interest of the United States in and to the Federal land.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB73D0FCBEE824B748A3E42565AD6978B"><enum>(b)</enum><header display-inline="yes-display-inline">Applicable
			 law</header><text display-inline="yes-display-inline">Section 206 of the
			 Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716) shall apply to
			 the land exchange authorized under subsection (a), except that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H27F957737E2B40199A1F6ED7680D9615"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary may accept a cash
			 equalization payment in excess of 25 percent of the value of the Federal land;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4989295A5E5144E3BB9E44AEE976A4BC"><enum>(2)</enum><text display-inline="yes-display-inline">as a condition of the land exchange under
			 subsection (a), the District shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HCBED8BB7B5DA4CEDB6802A6B0D0F05A4"><enum>(A)</enum><text display-inline="yes-display-inline">pay each cost relating to any land surveys
			 and appraisals of the Federal land and non-Federal land; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20333E4F029E40AAB75A0B65CFF39CCB"><enum>(B)</enum><text display-inline="yes-display-inline">enter into an agreement with the Secretary
			 that allocates any other administrative costs between the Secretary and the
			 District.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H56F0ADBD2BE44970AB50FC558E3BAC88"><enum>(c)</enum><header display-inline="yes-display-inline">Additional terms and
			 conditions</header><text display-inline="yes-display-inline">The land exchange
			 under subsection (a) shall be subject to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H753029E516D24523AFB8F4CC5EFEA531"><enum>(1)</enum><text display-inline="yes-display-inline">valid existing rights; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBF2B6E053E304A1F991D70C6E95368F2"><enum>(2)</enum><text display-inline="yes-display-inline">any terms and conditions that the Secretary
			 may require.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H712F21222A61453E9F5448031EC8B994"><enum>(d)</enum><header display-inline="yes-display-inline">Time for completion of land
			 exchange</header><text display-inline="yes-display-inline">It is the intent of
			 Congress that the land exchange under subsection (a) shall be completed not
			 later than 1 year after the date of enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD98A68878EB141FBBE78A41326399165"><enum>(e)</enum><header display-inline="yes-display-inline">Authority of Secretary To conduct sale of
			 Federal land</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HEECDC693137D4D5B91DA1EA8B1818CC9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with paragraph (2), if the
			 land exchange under subsection (a) is not completed by the date that is 1 year
			 after the date of enactment of this Act, the Secretary may offer to sell to the
			 District the Federal land.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71762C3F16AE4A3F8714643F469B7C8F"><enum>(2)</enum><header display-inline="yes-display-inline">Value of Federal land</header><text display-inline="yes-display-inline">The Secretary may offer to sell to the
			 District the Federal land for the fair market value of the Federal land.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF85CE6DF00AB441082C628F4AA73BE01"><enum>(f)</enum><header display-inline="yes-display-inline">Disposition of proceeds</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H9B20386C10D8416BA11936D8864B011A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall deposit in the fund
			 established under Public Law 90–171 (commonly known as the <quote>Sisk
			 Act</quote>) (16 U.S.C. 484a) any amount received by the Secretary as the
			 result of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HBA575CE962EB48B9AC108A881A6D04B7"><enum>(A)</enum><text display-inline="yes-display-inline">any cash equalization payment made under
			 subsection (b); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB629208948CE4144A64B76EFEC2EFD2C"><enum>(B)</enum><text display-inline="yes-display-inline">any sale carried out under subsection
			 (e).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H608285B1F376439E852B20A16BEEC09C"><enum>(2)</enum><header display-inline="yes-display-inline">Use of proceeds</header><text display-inline="yes-display-inline">Amounts deposited under paragraph (1) shall
			 be available to the Secretary, without further appropriation and until
			 expended, for the acquisition of land or interests in land in the National
			 Forest System.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB63F1607D61449C89BF641ED8EAADC6E"><enum>(g)</enum><header display-inline="yes-display-inline">Management and status of acquired
			 land</header><text display-inline="yes-display-inline">The non-Federal land
			 acquired by the Secretary under this section shall be—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H647B3BE3FC244A808AF049FD56827B1B"><enum>(1)</enum><text display-inline="yes-display-inline">added to, and administered as part of, the
			 National Forest; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6ECF866568F24B5EAE1476523C1708F2"><enum>(2)</enum><text display-inline="yes-display-inline">managed by the Secretary in accordance
			 with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H59059E30752140A891895B2560D3C657"><enum>(A)</enum><text display-inline="yes-display-inline">the Act of March 1, 1911 (commonly known as
			 the <quote>Weeks Law</quote>) (16 U.S.C. 480 et seq.); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5FC9FB2C10C144FDA668BEA48A8815FE"><enum>(B)</enum><text display-inline="yes-display-inline">any laws (including regulations) applicable
			 to the National Forest.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC072855FEBF54C77BDFEE7A9031E8AD6"><enum>(h)</enum><header display-inline="yes-display-inline">Revocation of orders; withdrawal</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2A13E350FFBC4DC69B05FB98615BB4BE"><enum>(1)</enum><header display-inline="yes-display-inline">Revocation of orders</header><text display-inline="yes-display-inline">Any public order withdrawing the Federal
			 land from entry, appropriation, or disposal under the public land laws is
			 revoked to the extent necessary to permit the conveyance of the Federal land to
			 the District.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC02718676EE64B919A208D9307A58887"><enum>(2)</enum><header display-inline="yes-display-inline">Withdrawal</header><text display-inline="yes-display-inline">On the date of enactment of this Act, if
			 not already withdrawn or segregated from entry and appropriation under the
			 public land laws (including the mining and mineral leasing laws) and the
			 Geothermal Steam Act of 1970 (30 U.S.C. 1001 et seq.), the Federal land is
			 withdrawn until the date of the conveyance of the Federal land to the
			 District.</text>
				</paragraph></subsection></section></legis-body>
