		<official-title>To phase out the Federal sugar program, and for other
		  purposes.</official-title>

		<section id="id859079745DC7429BB696090D8888D46F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stop Unfair Giveaways and Restrictions
			 Act of 2011</short-title></quote> or <quote><short-title>SUGAR Act of 2011</short-title></quote>.</text>
		</section><section id="IDec13324ac8a34706b235b092df1a909d" section-type="subsequent-section"><enum>2.</enum><header>Sugar program</header>
			<subsection id="ID9da5315b8ebd40e286ccab773885edac"><enum>(a)</enum><header>In
			 general</header><text>Section 156 of the Federal Agriculture Improvement and
			 Reform Act of 1996 (7 U.S.C. 7272) is amended—</text>
				<paragraph id="IDc1a4b7b4d313439aa3090285131195d8"><enum>(1)</enum><text>in subsection
			 (d), by striking paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idFAA6A8CFF5EE495E838BC36101DF2DB9" style="OLC">
						<paragraph id="ID19a23dab86964c1794b50d76644a826b"><enum>(1)</enum><header>Loans</header><text>The
				Secretary shall carry out this section through the use of recourse
				loans.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID42f8b2a4236a44febd4dd5ff05e0e7b5"><enum>(2)</enum><text>by redesignating
			 subsection (i) as subsection (j);</text>
				</paragraph><paragraph id="IDa100e9e0bd484f0d8231d7af1b0ba3d6"><enum>(3)</enum><text>by inserting
			 after subsection (h) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id137BBEBD282C4FD5B51ABBEEEDB37705" style="OLC">
						<subsection id="IDd224380e45d3445d9e9f2bff55c73774"><enum>(i)</enum><header>Phased
				reduction of loan rate</header><text>For each of the 2012, 2013, and 2014 crops
				of sugar beets and sugarcane, the Secretary shall lower the loan rate for each
				succeeding crop in a manner that progressively and uniformly lowers the loan
				rate for sugar beets and sugarcane to $0 for the 2015
				crop.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID9248b248f6dc4f86bce1d1437efe47bd"><enum>(4)</enum><text>in subsection (j)
			 (as redesignated), by striking <quote>2012</quote> and inserting
			 <quote>2014</quote>.</text>
				</paragraph></subsection><subsection id="IDdbc0feaf2751429a8d6998ab16463a1a"><enum>(b)</enum><header>Prospective
			 repeal</header><text>Effective beginning with the 2015 crop of sugar beets and
			 sugarcane, section 156 of the Federal Agriculture Improvement and Reform Act of
			 1996 (7 U.S.C. 7272) is repealed.</text>
			</subsection></section><section id="id97230421011A48CB8931F9361CB41160"><enum>3.</enum><header>Elimination of
			 sugar price support and production adjustment programs</header>
			<subsection id="ID1da049e9c3144bf9891210ba127de884"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law—</text>
				<paragraph id="IDe33c3ab6b30b45b7ba06d137997d5010"><enum>(1)</enum><text>a processor of
			 any of the 2015 or subsequent crops of sugarcane or sugar beets shall not be
			 eligible for a loan under any provision of law with respect to the crop;
			 and</text>
				</paragraph><paragraph id="IDcb555e1f1fe64b2d80532438f42f6e6f"><enum>(2)</enum><text>the Secretary of
			 Agriculture may not make price support available, whether in the form of a
			 loan, payment, purchase, or other operation, for any of the 2015 and subsequent
			 crops of sugar beets and sugarcane by using the funds of the Commodity Credit
			 Corporation or other funds available to the Secretary.</text>
				</paragraph></subsection><subsection id="ID66c22d4810d64baf96198d3b8b110455"><enum>(b)</enum><header>Termination of
			 marketing quotas and allotments</header>
				<paragraph id="id77F7D577303148D494898C679AC0F9F2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part VII of subtitle
			 B of title III of the Agricultural Adjustment Act of 1938 (7 U.S.C. 1359aa et
			 seq.) is repealed.</text>
				</paragraph><paragraph id="ID60cc9e0c82ca4e0485b2d86820342e58"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 344(f)(2) of the Agricultural Adjustment Act of
			 1938 (7 U.S.C. 1344(f)(2)) is amended by striking <quote>sugar cane for sugar,
			 sugar beets for sugar,</quote>.</text>
				</paragraph></subsection><subsection id="id3CDEFF845F4D4095B808D46E962508DC"><enum>(c)</enum><header>General
			 powers</header>
				<paragraph id="IDcd7cda8d13be4f4fb8752eddf54d3313"><enum>(1)</enum><header>Section 32
			 activities</header><text>Section 32 of the Act of August 24, 1935 (7 U.S.C.
			 612c), is amended in the second sentence of the first paragraph—</text>
					<subparagraph id="IDd5c80911983f4d169c0ec093d29d6048"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>(other than sugar beets and sugarcane)</quote> after
			 <quote>commodities</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID00a13971eaf2466bb159eede2d20da22"><enum>(B)</enum><text>in paragraph (3),
			 by inserting <quote>(other than sugar beets and sugarcane)</quote> after
			 <quote>commodity</quote>.</text>
					</subparagraph></paragraph><paragraph id="ID1b8385fbed01463bb575b3d672905da5"><enum>(2)</enum><header>Powers of
			 commodity credit corporation</header><text>Section 5(a) of the Commodity Credit
			 Corporation Charter Act (15 U.S.C. 714c(a)) is amended by inserting <quote>,
			 sugar beets, and sugarcane</quote> after <quote>tobacco</quote>.</text>
				</paragraph><paragraph id="IDc1c4cc2bf08c494cb9c1b4674283e569"><enum>(3)</enum><header>Price support
			 for nonbasic agricultural commodities</header><text>Section 201(a) of the
			 Agricultural Act of 1949 (7 U.S.C. 1446(a)) is amended by striking <quote>milk,
			 sugar beets, and sugarcane</quote> and inserting <quote>, and
			 milk</quote>.</text>
				</paragraph><paragraph id="id166203228A1A4F8B9036B7FE31B5BE70"><enum>(4)</enum><header>Commodity
			 Credit Corporation storage payments</header><text>Section 167 of the Federal
			 Agriculture Improvement and Reform Act of 1996 (7 U.S.C. 7287) is
			 repealed.</text>
				</paragraph><paragraph id="idC54437783D4A4636BB922A6077917A7B"><enum>(5)</enum><header>Suspension and
			 repeal of permanent price support authority</header><text>Section 171(a)(1) of
			 the Federal Agriculture Improvement and Reform Act of 1996 (7 U.S.C.
			 7301(a)(1)) is amended—</text>
					<subparagraph id="id7D4C55FF86A547CC960EF0134992CB7C"><enum>(A)</enum><text>by striking
			 subparagraph (E); and</text>
					</subparagraph><subparagraph id="idFA6CE5451E39497BB3A9066A33F1D377"><enum>(B)</enum><text>by redesignating
			 subparagraphs (F) through (I) as subparagraphs (E) through (H),
			 respectively.</text>
					</subparagraph></paragraph><paragraph id="id427D8291F988429BA398A4BEA041FF21"><enum>(6)</enum><header>Storage
			 facility loans</header><text>Section 1402(c) of the Farm Security and Rural
			 Investment Act of 2002 (7 U.S.C. 7971) is repealed.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDae01dc6947b54641895b551fad854e1a"><enum>(7)</enum><header>Feedstock
			 flexibility program for bioenergy producers</header><text>Effective beginning
			 with the 2013 crop of sugar beets and sugarcane, section 9010 of the Farm
			 Security and Rural Investment Act of 2002 (7 U.S.C. 8110) is repealed.</text>
				</paragraph></subsection><subsection id="IDf1305f58e8254995aa4992091ea761d3"><enum>(d)</enum><header>Transition
			 provisions</header><text>This section and the amendments made by this section
			 shall not affect the liability of any person under any provision of law as in
			 effect before the application of this section and the amendments made by this
			 section.</text>
			</subsection></section><section id="id592FA0F52EF344DCB286B847ADEDE4AF"><enum>4.</enum><header>Tariff-rate
			 quotas</header>
			<subsection id="ID7b7d5f36723e47e398576dbea6fda534"><enum>(a)</enum><header>Establishment</header><text>Except
			 as provided in subsection (c) and notwithstanding any other provision of law,
			 not later than October 1, 2011, the Secretary of Agriculture shall develop and
			 implement a program to increase the tariff-rate quotas for raw cane sugar and
			 refined sugars for a quota year in a manner that ensures—</text>
				<paragraph id="ID1413b2c6b69d44949ef9885fae206a0d"><enum>(1)</enum><text>a robust and
			 competitive sugar processing industry in the United States; and</text>
				</paragraph><paragraph id="ID0bd7c83419294cd1bcf5c8498553c517"><enum>(2)</enum><text>an adequate
			 supply of sugar at reasonable prices in the United States.</text>
				</paragraph></subsection><subsection id="ID611c8b2cbaf94e84b87af3f0cdb557f2"><enum>(b)</enum><header>Factors</header><text>In
			 determining the tariff-rate quotas necessary to satisfy the requirements of
			 subsection (a), the Secretary shall consider the following:</text>
				<paragraph id="ID997a30c3dc9f46b7b72bfccb21ccecfb"><enum>(1)</enum><text>The quantity and
			 quality of sugar that will be subject to human consumption in the United States
			 during the quota year.</text>
				</paragraph><paragraph id="IDefc0243a2f3b48f0a27f1874d03b138a"><enum>(2)</enum><text>The quantity and
			 quality of sugar that will be available from domestic processing of sugarcane,
			 sugar beets, and in-process beet sugar.</text>
				</paragraph><paragraph id="IDabe0f1374d2b4d53a30ac3308a341377"><enum>(3)</enum><text>The quantity of
			 sugar that would provide for reasonable carryover stocks.</text>
				</paragraph><paragraph id="ID85fe31ece12540fb8e632d0f4143cc37"><enum>(4)</enum><text>The quantity of
			 sugar that will be available from carryover stocks for human consumption in the
			 United States during the quota year.</text>
				</paragraph><paragraph id="ID43f666591d384a39b80e947517e6946e"><enum>(5)</enum><text>Consistency with
			 the obligations of the United States under international agreements.</text>
				</paragraph></subsection><subsection id="IDaf50d1082c73406abd7cd5c53f9e890e"><enum>(c)</enum><header>Exemption</header><text>Subsection
			 (a) shall not include specialty sugar.</text>
			</subsection><subsection id="id05187B29B4BD4F9BAB9933E15D1EFE88"><enum>(d)</enum><header>Definitions</header><text>In
			 this section, the terms <term>quota year</term> and <term>human
			 consumption</term> have the meaning such terms had under section 359k of the
			 Agricultural Adjustment Act of 1938 (7 U.S.C. 1359kk) (as in effect on the day
			 before the date of the enactment of this Act).</text>
			</subsection></section><section id="ID4c713967f34740ab832b9a1ae7e30a4a"><enum>5.</enum><header>Application</header><text display-inline="no-display-inline">Except as otherwise provided in this Act,
			 this Act and the amendments made by this Act shall apply beginning with the
			 2012 crop of sugar beets and sugarcane.</text>
