		<official-title>To reduce the rape kit backlog and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Justice for Survivors of Sexual
			 Assault Act of 2011</short-title></quote>.</text>
		</section><section id="ID1ad913d8b04a40c8938608fdee1e4020"><enum>2.</enum><header>Rape exam
			 payments</header><text display-inline="no-display-inline">Section 2010 of title
			 I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3796gg–4) is amended—</text>
			<paragraph id="id536418FE9AD24E87954829300257B697"><enum>(1)</enum><text>in subsection
			 (a)(1)—</text>
				<subparagraph id="id2975E627957D40168ACC41A51A338F10"><enum>(A)</enum><text>by striking
			 <quote>entity incurs the full</quote> and inserting the following:
			 “entity—</text>
					<quoted-block display-inline="no-display-inline" id="idD9ED726F676C4BABB3DF3DFCFFA81811" style="OLC">
						<subparagraph id="id70550600AE71422ABD644158E20C7CCF"><enum>(A)</enum><text>incurs the
				full</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="id403DFCC5A6D04705AD69FE45A8A32B78"><enum>(B)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="idCCC03F2F7DBD4C7F9B0FEB94376002BB"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC788439D62BB4AC1BB5C4D053D8C9644" style="OLC">
						<subparagraph id="idEEC18B0F4C954AFDABD02927D85405C2"><enum>(B)</enum><text>coordinates with
				regional health care providers to notify victims of sexual assault of the
				availability of rape exams at no cost to the
				victims.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="idC3F78FA0B2574E6CB06CBCD9FF8423C6"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="idEC0A16E3FE274677A080809760D5CBA3"><enum>(A)</enum><text>in paragraph (1),
			 by adding <quote>or</quote> at the end;</text>
				</subparagraph><subparagraph id="idB8E2216F7DAC499DA3D11C05120FE71C"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>; or</quote> and inserting a period; and</text>
				</subparagraph><subparagraph id="id6654552B92904F33ADCA086AD9DA574A"><enum>(C)</enum><text>by striking
			 paragraph (3); and</text>
				</subparagraph></paragraph><paragraph id="idF0CB7D0B54D341B2BA983AAFC6BA8CC2"><enum>(3)</enum><text>in subsection
			 (d), by striking <quote>(d) <header-in-text level="subsection" style="OLC">Rule
			 of construction</header-in-text>.—</quote> and all that follows through the end
			 of paragraph (1) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id21BF2CBF60884B3880C03CF9B078F955" style="OLC">
					<subsection id="IDd80400b418384073a2bc258351bf1765"><enum>(d)</enum><header>Noncooperation</header>
						<paragraph id="IDc94f69eed86c4819992ffbfce0386ecb"><enum>(1)</enum><header>In
				general</header><text>To be in compliance with this section, a State, Indian
				tribal government, or unit of local government shall comply with subsection (b)
				without regard to whether the victim participates in the criminal justice
				system or cooperates with law
				enforcement.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID8323b2f069574963a3a470504d23e5f6"><enum>3.</enum><header>Additional
			 Debbie Smith Grant Requirements</header><text display-inline="no-display-inline">Section 2(f) of the DNA Analysis Backlog
			 Elimination Act of 2000 (42 U.S.C. 14135(f)) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="idC7F1F768954C4297BB333BFC91118BEA" style="OLC">
				<subsection id="idB95A11AAB84F480B9567DD062533309A"><enum>(f)</enum><header>Reports to the
				Attorney General</header>
					<paragraph id="idC11ED95D47C4474596027FC46FBBC89D"><enum>(1)</enum><header>In
				general</header><text>Each State or unit of local government that receives a
				grant under this section shall submit to the Attorney General, for each year in
				which funds from a grant received under this section is expended, a report at
				such time and in such manner as the Attorney General may reasonably require,
				which contains—</text>
						<subparagraph id="IDb4fc8d50e4e646cf88894f9ca621e8d8"><enum>(A)</enum><text>a summary of the
				activities carried out under the grant and an assessment of whether such
				activities are meeting the needs identified in the application;</text>
						</subparagraph><subparagraph id="IDe57d34c8bca0454ba3655d7ea1754c8e"><enum>(B)</enum><text>a specific
				breakdown of the number of sexual assault cases that are in a backlog for DNA
				case work;</text>
						</subparagraph><subparagraph id="IDd5c37d0eac5f47fcbc8f534fcf0c8b91"><enum>(C)</enum><text>the percentage of
				the amounts received under the grant allocated to reducing the backlog of DNA
				case work in sexual assault cases; and</text>
						</subparagraph><subparagraph id="ID95640a31b42d4be7a17a0dc212b847e8"><enum>(D)</enum><text>such other
				information as the Attorney General may require.</text>
						</subparagraph></paragraph><paragraph id="ID59acff58b7834caab90473805c6356ed"><enum>(2)</enum><header>Penalty for
				Noncompliance</header>
						<subparagraph id="ID7564872d74ee42fab2f0560670a4ee10"><enum>(A)</enum><header>Annual
				list</header><text>The Attorney General shall on an annual basis—</text>
							<clause id="idD689773BFF7A40C48F2FE047042053D6"><enum>(i)</enum><text>compile a list of
				the States and units of local government receiving a grant under this section
				that have failed to provide the information required under paragraph (1);
				and</text>
							</clause><clause id="id406DB09D2B154DDFA1848F5E81E092D8"><enum>(ii)</enum><text>publish each
				list compiled under clause (i) on the Web site of the Department of
				Justice.</text>
							</clause></subparagraph><subparagraph id="IDffbb0654881e46d38a54c35914e7a6bd"><enum>(B)</enum><header>Penalty</header><text>If
				the Attorney General determines that a State or unit of local government has
				failed to provide the information required under paragraph (1), the Attorney
				General may not award a grant to the State or unit of local government under
				this section for the fiscal year beginning after the fiscal year in which the
				determination was made in an amount that is more than 50 percent of the amount
				the State or unit of local government would have otherwise received under this
				section.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
