		<official-title>To amend the Magnuson-Stevens Fishery Conservation and
		  Management Act to require that fishery impact statements be updated each year
		  and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 titles</header><text display-inline="no-display-inline">This Act may be cited
			 as the <quote><short-title>Fishing Impact Statement
			 Honesty Act of 2011</short-title></quote> or as the <quote><short-title>FISH Act of 2011</short-title></quote>.</text>
		</section><section id="idE96C5A68A45D43848CCFB4EDBB142391"><enum>2.</enum><header>Fishery impact
			 statements</header><text display-inline="no-display-inline">Section 303 of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1853) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idB40DC8D4715A4852A71F3F42334922F4" style="OLC">
				<subsection id="id53A5206EFE5543599B1759953352FF05"><enum>(d)</enum><header>Fishery impact
				statement</header>
					<paragraph id="idCE4737D2B67542008149C5D5DC49294A"><enum>(1)</enum><header>Annual
				updates</header><text>Each fishery impact statement prepared pursuant to
				subsection (a)(9) shall be updated and republished—</text>
						<subparagraph id="idE1E979837D0943E3ABAA30F87CC7EC86"><enum>(A)</enum><text>in the case of a
				fishery management plan or amendment submitted to the Secretary under section
				304(a) after the date of the enactment of the <short-title>Fishing Impact Statement Honesty Act of
				2011</short-title>—</text>
							<clause id="idF06D6FACD4FC415AA9410BB3667509F7"><enum>(i)</enum><text>6
				months after the date the plan or amendment takes effect;</text>
							</clause><clause id="idD79ADB9F1EEA47B3BF39DAA34CAF898B"><enum>(ii)</enum><text>1 year after
				such date; and</text>
							</clause><clause id="idD9217DC2F1A149A3A5E8A36294DD2771"><enum>(iii)</enum><text>once each year
				thereafter; and</text>
							</clause></subparagraph><subparagraph id="id1D0445574BCE463E9D2F17080B6138CF"><enum>(B)</enum><text>in the case of a
				fishery management plan or plan amendment submitted to the Secretary under
				section 304(a) prior to such date, once each year.</text>
						</subparagraph></paragraph><paragraph id="id3294CD9EF52F4A2BBB7914A152E9D480"><enum>(2)</enum><header>Preparation of
				statement</header><text>Each fishery impact statement prepared pursuant to
				paragraph (1) shall be prepared by an objective person who is—</text>
						<subparagraph id="id850CEA2C17F649CAB12A50A71C270BFF"><enum>(A)</enum><text>not an officer,
				employee, or entity of the United States Government; and</text>
						</subparagraph><subparagraph id="id772760CFD2EA4001A9E3C5F7C95A9C54"><enum>(B)</enum><text>selected by the
				Comptroller General of the United States.</text>
						</subparagraph></paragraph><paragraph id="ID4ccea627b3764ebd83a2e678888265c0"><enum>(3)</enum><header>Determinations</header><text>Each
				fishery impact statement prepared pursuant to paragraph (1) or subsection
				(a)(9) shall determine if the fishery management plan or amendment is
				consistent with section 301(a)(8), including if the conservation and management
				measures in the plan or amendment provide for the sustained participation of
				fishing communities and, to the extent practicable, minimize adverse economic
				impacts on such communities.</text>
					</paragraph><paragraph id="IDac6a3500ecf34453a18896fa597a21ec"><enum>(4)</enum><header>Mitigation
				Plan</header><text>Not later than 60 days after the date on which a statement
				is published pursuant to paragraph 1, the Secretary shall prepare, publish, and
				begin implementation of a comprehensive mitigation plan to—</text>
						<subparagraph id="ID82ea84dbf8a641798c1acf9e2b58e3ef"><enum>(A)</enum><text>address any
				negative economic or social impacts identified in a fishery impact statement
				prepared pursuant to paragraph (1); and</text>
						</subparagraph><subparagraph id="IDde99701eb83e43148c5bdbcc1d30442b"><enum>(B)</enum><text>correct any
				inconsistencies determined pursuant to paragraph
				(3).</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
