		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Small Business Reorganization
			 Efficiency and Clarity Act </short-title></quote>.</text>
		</section><section id="ID127328d9a9d044bcac440bdcdb02a924"><enum>2.</enum><header>Flexibility in
			 confirmation</header><text display-inline="no-display-inline">Section 1129(e)
			 of title 11, United States Code, is amended by striking <quote>45 days</quote>
			 and inserting <quote>90 days</quote>.</text>
		</section><section id="ID0d25aa0aa1de4f4d81cb462ac6785596"><enum>3.</enum><header>Clarity in
			 periodic reporting requirements</header><text display-inline="no-display-inline">Section 308(b) of title 11, United States
			 Code, is amended—</text>
			<paragraph id="id517B1229206748D6B13681D029DB2E46"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by adding
			 <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="id9F531B3CF2674812AF226235C0A62EFA"><enum>(2)</enum><text>in paragraph (5),
			 by striking <quote>; and</quote> at the end and inserting a period; and</text>
			</paragraph><paragraph id="id9918256F13174AE4B287893716D55C1B"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (6).</text>
			</paragraph></section><section id="idD12D2BF3C2EC402E98CDD9A42C26DD62"><enum>4.</enum><header>Retaining
			 professional services</header>
			<subsection id="idC2E5A743A4E346D7B69E74A57A9974A4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 327 of title
			 11, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idDF00E044069F4F2C8586E651CA77AB05" style="OLC">
					<subsection id="idFA35A56A0ACC4B35AEABCCB9C45A013A"><enum>(g)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), a person is
				not disqualified for employment under this section by a small business debtor
				solely because such person holds a claim of less than $5,000 that arose prior
				to the date of commencement of the
				case.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id8229D68CDAAF4EDDA3ADCE3D78DFE6FD"><enum>(b)</enum><header>Adjustments to
			 dollar amount</header><text>Section 104 of title 11, United States Code, is
			 amended by inserting <quote>327(g),</quote> after
			 <quote>303(b),</quote>.</text>
			</subsection></section><section id="IDd265fe4f98ba4946a0f35eb6747cd506"><enum>5.</enum><header>Enforcement of
			 small business selection</header><text display-inline="no-display-inline">Section 1112(b)(4) of title 11, United
			 States Code, is amended—</text>
			<paragraph id="idA1EE51080A464D69A2C34CE62CF479F1"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (O) and (P)
			 as subparagraphs (P) and (Q), respectively; and</text>
			</paragraph><paragraph id="id78768953C51940FFA359592518938319"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (N) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id265C5688934B47C981DBAB558163B3F4" style="OLC">
					<subparagraph id="idB4658BB2AB264AFC84B30FF5014203BE"><enum>(O)</enum><text display-inline="yes-display-inline">failure of a small business debtor to
				designate itself as a small business
				debtor;</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id6C05AB6FCB5A4F508B8C4B077D28578A"><enum>6.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 12 months after the date of
			 enactment of this Act, the Comptroller General of the United States, in
			 consultation with the Administrative Office of United States Courts and the
			 Executive Office of United States Trustees, shall submit a report to Congress
			 detailing—</text>
			<paragraph id="id18ED3B089C194345B64D0F228EF1DDCD"><enum>(1)</enum><text display-inline="yes-display-inline">the number and percentage of all cases
			 filed under chapter 11 of title 11, United States Code, in which the debtor is
			 a small business debtor, as that term is defined in section 101(51D) of title
			 11, United States Code;</text>
			</paragraph><paragraph id="id608572665B1E4FB984546E1F4C0AB31F"><enum>(2)</enum><text display-inline="yes-display-inline">the number of cases and rates of
			 confirmations for small business debtors in cases filed under chapter 11 of
			 title 11, United States Code, as compared with—</text>
				<subparagraph id="id820D76C8CA1E499E89BC9A6CB1FE4616"><enum>(A)</enum><text display-inline="yes-display-inline">all debtors in cases filed under that
			 chapter 11;</text>
				</subparagraph><subparagraph id="idD6D62366DCDB4DB3842C82B55C41AB5D"><enum>(B)</enum><text display-inline="yes-display-inline">all debtors in cases filed under that
			 chapter 11 that are not small business debtors;</text>
				</subparagraph><subparagraph id="id0F310A1498DC4B4195945D5313039D82"><enum>(C)</enum><text display-inline="yes-display-inline">debtors in cases filed under that chapter
			 11 that—</text>
					<clause id="id69B40DF50DBB4EDEAEB2803DB7A9B4ED"><enum>(i)</enum><text display-inline="yes-display-inline">are not small business debtors; and</text>
					</clause><clause id="idC23FDB05EC90406189657C2DC4D8BFDF"><enum>(ii)</enum><text display-inline="yes-display-inline">have less than $5,000,000 in debt;</text>
					</clause></subparagraph><subparagraph id="id3F9ED8494F484431A3088B745B8A4975"><enum>(D)</enum><text display-inline="yes-display-inline">debtors in cases filed under that chapter
			 11 that—</text>
					<clause id="id9325E735124A45AE93B4D47E5A122C3F"><enum>(i)</enum><text display-inline="yes-display-inline">are not small business debtors; and</text>
					</clause><clause id="idB77B89715D2946968E94130C957D7C74"><enum>(ii)</enum><text display-inline="yes-display-inline">have less than $10,000,000 in debt;</text>
					</clause></subparagraph><subparagraph id="id87AC002D41E34188AD36D6C774E4D4A4"><enum>(E)</enum><text display-inline="yes-display-inline">debtors in cases filed under chapter 12 of
			 title 11, United States Code; and</text>
				</subparagraph><subparagraph id="idC7FB447E421C4938B5F1F7B0ABB0B549"><enum>(F)</enum><text display-inline="yes-display-inline">debtors in cases filed under that chapter
			 13 that are business cases;</text>
				</subparagraph></paragraph><paragraph id="idC556CC6B859946B6A5A8439F78F3928F"><enum>(3)</enum><text display-inline="yes-display-inline">the number of cases filed under chapter 11
			 of title 11, United States Code, in which the debtor has less than $2,190,000
			 in debt outstanding, but does not designate itself a small business
			 debtor;</text>
			</paragraph><paragraph id="idE50BB62AF8A5488BBB2A56047A57598E"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for improving the
			 confirmation rate for small business debtors; and</text>
			</paragraph><paragraph id="id79D0B4A155C14643845058AFE5125EC2"><enum>(5)</enum><text display-inline="yes-display-inline">an analysis on whether the definition of
			 the term <quote>small business debtor</quote> should be amended to include
			 businesses with—</text>
				<subparagraph id="idF457DCB4F6224EBE9F80B0765404209B"><enum>(A)</enum><text display-inline="yes-display-inline">less than $5,000,000 in debt; and</text>
				</subparagraph><subparagraph id="idF640CF3485EB4155B1968881761D50F1"><enum>(B)</enum><text display-inline="yes-display-inline">less than $10,000,000 in debt.</text>
				</subparagraph></paragraph></section></legis-body>
