			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Putting the Gulf of Mexico Back
			 to Work Act</short-title></quote>.</text>
			</section><section id="idCFF2562FCF004953BB831FF361449DDB" section-type="subsequent-section"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="H9F5F34E8EF8E44A691013E99BB35EEC3"><enum>(1)</enum><header>Covered civil
			 action</header><text display-inline="yes-display-inline">The term <term>covered
			 civil action</term> means a civil action containing a claim under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/702">section
			 702</external-xref> of title 5, United States Code, regarding agency action (as
			 defined for the purposes of that section) affecting a covered energy project in
			 the Gulf of Mexico.</text>
				</paragraph><paragraph id="HF1EB4B1B1A4C4A5D9A1F460543C23908"><enum>(2)</enum><header>Covered energy
			 project</header>
					<subparagraph id="id4FEDCE431C4D4CD28C4CD8EB641F6809"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>covered energy project</term> means the leasing of Federal land of the
			 outer Continental Shelf for the exploration, development, production,
			 processing, or transmission of oil, natural gas, wind, or any other source of
			 energy in the Gulf of Mexico, and any action under a lease.</text>
					</subparagraph><subparagraph id="id54AD955A226E4B01A1B470025B99A0A8"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>covered energy
			 project</term> does not include any dispute between the parties to a lease
			 regarding the obligations under the lease, including any alleged breach of the
			 lease.</text>
					</subparagraph></paragraph><paragraph id="id98B88D67D7F14A16BE709D7D6B142678"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></section><subtitle id="H472C74EE49544C3995C04BD736889A34"><enum>A</enum><header>Outer Continental
			 Shelf land</header>
				<section id="HCA77F314760042A38AA9DCE7D2CD6296"><enum>111.</enum><header>Drilling
			 permits</header><text display-inline="no-display-inline">Section 11 of the
			 Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1340">43 U.S.C. 1340</external-xref>) is
			 amended by striking subsection (d) and inserting the following:</text>
					<quoted-block id="H6CF8E42D4D1945FCB4B7B615F62ED666" style="OLC">
						<subsection id="H961C52AD81A04489937C3961DC99E858"><enum>(d)</enum><header>Drilling
				permits</header>
							<paragraph id="HDA7A26BF28774494AC8C35E29208F78F"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall by regulation require that any lessee
				operating under an approved exploration plan—</text>
								<subparagraph id="H0A5515320A204C5DA03DEB7C9F082A8C"><enum>(A)</enum><text>obtain a permit
				before drilling any well in accordance with the plan; and</text>
								</subparagraph><subparagraph id="H8C9DE1FEEFF8464BB90ECA6D0BE93243"><enum>(B)</enum><text>obtain a new
				permit before drilling any well of a design that is significantly different
				than the design for which the existing permit was issued.</text>
								</subparagraph></paragraph><paragraph id="H8A304A3D63D84352B5BF283C23242C54"><enum>(2)</enum><header>Safety review
				required</header><text>The Secretary shall not issue a permit under paragraph
				(1) without ensuring that the proposed drilling operations meet all—</text>
								<subparagraph id="H1E57AF194D2E46D7B41C1908C43E8D50"><enum>(A)</enum><text>critical safety
				system requirements, including blowout prevention; and</text>
								</subparagraph><subparagraph id="H666356C26BFD4D3DA486D5E8E26C81D4"><enum>(B)</enum><text>oil spill response
				and containment requirements.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H87B80D0239C541038C77E871C255715A"><enum>(3)</enum><header>Timeline</header>
								<subparagraph commented="no" id="H0585E759F998486786A06E607E75E4E3"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				determine whether to issue a permit under paragraph (1) not later than 30 days
				after the date on which the Secretary receives the application for a
				permit.</text>
								</subparagraph><subparagraph commented="no" id="id4B46FE7BF8D14BD8B4629051A46C5587"><enum>(B)</enum><header>Extension of
				time</header>
									<clause commented="no" id="id55394CD9A5D541F0922003C3F4E29D07"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may
				extend the period in which to consider an application for a permit for up to 2
				periods of 15 days each if the Secretary has given written notice of the delay
				to the applicant.</text>
									</clause><clause commented="no" id="id556462F5E89D4996816E31BE6E97EC26"><enum>(ii)</enum><header>Notice</header><text display-inline="yes-display-inline">The notice described in clause (i)
				shall—</text>
										<subclause commented="no" id="id500AD2E8A7F14791A74D0EE019C30FCC"><enum>(I)</enum><text display-inline="yes-display-inline">be in the form of a letter from the
				Secretary or a designee of the Secretary; and</text>
										</subclause><subclause commented="no" id="id43DDBFF874C845B7A8238BB5E7CDEFD3"><enum>(II)</enum><text display-inline="yes-display-inline">include—</text>
											<item commented="no" id="idF678D6E06BCF4EDABC37B387CAC81ADF"><enum>(aa)</enum><text display-inline="yes-display-inline">the name and title of each individual
				processing the application;</text>
											</item><item commented="no" id="id56A13F0A44D2442AB35F1B5022F3DC3B"><enum>(bb)</enum><text display-inline="yes-display-inline">the reason for the delay; and</text>
											</item><item commented="no" id="idB9E2CB58AADA4C3585347A8E2CF7876F"><enum>(cc)</enum><text display-inline="yes-display-inline">the date on which the Secretary expects to
				make a final decision on the application.</text>
											</item></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="HC1C7AE62E4CC46B3AEADEA22C2A37BDF"><enum>(4)</enum><header>Denial of
				application</header><text>If the Secretary denies the application, the
				Secretary shall provide the applicant—</text>
								<subparagraph commented="no" id="HDAB1F410393F42ADB2EF8030C0338727"><enum>(A)</enum><text>a written
				statement that provides clear and comprehensive reasons why the application was
				not accepted and detailed information concerning any deficiency; and</text>
								</subparagraph><subparagraph commented="no" id="HFFDE0FCA8C8B4CD2AE13BB66DF52460F"><enum>(B)</enum><text>an opportunity to
				remedy any deficiencies.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H8953A6BEDB2B4F2D8D507CBD2947FD9E"><enum>(5)</enum><header>Failure to make
				decision within 60 days</header><text>If the Secretary does not make a decision
				on the application by the date that is 60 days from the date on which the
				Secretary receives the application, the application shall be considered
				approved.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section></subtitle><subtitle id="HC75657C819B5488AAF3B2169C3F9AD87"><enum>B</enum><header>Judicial review of
			 agency actions relating to outer Continental Shelf activities in Gulf of
			 Mexico</header>
				<section id="HBC8956BB08D1449C95CAA5A723D5B2AB"><enum>122.</enum><header>Exclusive venue
			 for certain civil actions relating to covered energy projects in Gulf of
			 Mexico</header><text display-inline="no-display-inline">A covered civil action
			 shall be brought only in a judicial district in the Fifth Circuit unless there
			 is no district in that circuit in which the action may be brought.</text>
				</section><section id="H4219D6CFB9C94AACBFF965F8E4C6FB31"><enum>123.</enum><header>Time limitation
			 on filing</header><text display-inline="no-display-inline">A covered civil
			 action is barred unless the action is filed not later than the date that is 60
			 days after the date of the final Federal agency action.</text>
				</section><section id="H52B38BA86D1F46DEB16D76985E70780B"><enum>124.</enum><header>Expedition in
			 hearing and determining action</header><text display-inline="no-display-inline">A court shall endeavor to hear and determine
			 any covered civil action as expeditiously as practicable.</text>
				</section><section id="H481D8EC036984B4BB960CF486A225714"><enum>125.</enum><header>Standard of
			 review</header>
					<subsection id="id94A3243809F94281A99AE8FC2F609E85"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In any judicial
			 review of a covered civil action, administrative findings and conclusions
			 relating to the challenged Federal action or decision shall be presumed to be
			 correct.</text>
					</subsection><subsection id="idFD23F0C04FB94A15A2F089334B238C25"><enum>(b)</enum><header>Standard</header><text display-inline="yes-display-inline">The presumption described in subsection (a)
			 may be rebutted only by a preponderance of the evidence contained in the
			 administrative record.</text>
					</subsection></section><section id="HFD48883899304B199DCA3F418028D55E"><enum>126.</enum><header>Limitation on
			 prospective relief</header><text display-inline="no-display-inline">In a
			 covered civil action, a court shall not grant or approve any prospective relief
			 unless the court finds that the relief is narrowly drawn, extends no further
			 than necessary to correct the violation of a legal requirement, and is the
			 least intrusive means necessary to correct that violation.</text>
				</section><section id="H4A4A38CA75A04B3F98C713B42365D0FE"><enum>127.</enum><header>Limitation on
			 attorneys’ fees</header>

				</subsection></section></title><title id="id97C149BDA56141AB8F8C2C804E095E60"><enum>III</enum><header>Reversing
			 President Obama’s offshore moratorium</header>
			<section id="HFA583B3400DB440AADD01EC7BA9027F1" section-type="subsequent-section"><enum>301.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Reversing President Obama’s
			 Offshore Moratorium Act</short-title></quote>.</text>
			</section><section id="H6D9FF2563DD4486C989A2A14F5012364"><enum>302.</enum><header>Outer
			 Continental Shelf leasing program</header><text display-inline="no-display-inline">Section 18(a) of the Outer Continental Shelf
			 Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C.
			 1344(a)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block id="H08BDAC1467824DA5A622DCBEC6735EA4" style="OLC">
					<paragraph id="H69642D7F421540AAB2FC74A169438FF6"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H6279B294C6CA4C51902D31A05246DBCE"><enum>(A)</enum><text>In each oil and gas
				leasing program under this section, the Secretary shall make available for
				leasing and conduct lease sales that include—</text>
							<clause id="HAA4AA408E9F14CC4B45BB33C0330BE16" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">at least 50 percent of the available
				unleased acreage within each outer Continental Shelf planning area considered
				to have the largest undiscovered, technically recoverable oil and gas resources
				(on a total btu basis) based upon the most recent national geological
				assessment of the outer Continental Shelf, with an emphasis on offering the
				most geologically prospective parts of the planning area; and</text>
							</clause><clause id="H33D39B072036482DB7CEB11EC7C70CC4" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">any State subdivision of an outer
				Continental Shelf planning area that the Governor of the State that represents
				that subdivision requests be made available for leasing.</text>
							</clause></subparagraph><subparagraph id="H315C45D003C0427E803EB8E9B8268E67" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In
				this paragraph, the term <quote>available unleased acreage</quote> means that
				portion of the outer Continental Shelf that is not under lease at the time of a
				proposed lease sale, and that has not otherwise been made unavailable for
				leasing by law.</text>
						</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HB86BBADC4AA4494EB7D4BAC0D9E8ECB8"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD37346B0F4B449BFA634EF2428215134"><enum>(A)</enum><text>For the 2012–2017 5-year
				oil and gas leasing program, the Secretary shall make available for leasing any
				outer Continental Shelf planning areas that are estimated to contain more
				than—</text>
							<clause id="H08DAD6AB022C4704859595540B1BF109" indent="up1"><enum>(i)</enum><text>2,500,000,000 barrels of oil;
				or</text>
							</clause><clause id="HD8C20D3B93E94AFABA9A9B0170D4A445" indent="up1"><enum>(ii)</enum><text>7,500,000,000,000 cubic feet of
				natural gas.</text>
							</clause></subparagraph><subparagraph id="H702069A642D0420D8BCD40936FFC2740" indent="up1"><enum>(B)</enum><text>To determine the planning areas
				described in subparagraph (A), the Secretary shall use the document entitled
				<quote>Minerals Management Service Assessment of Undiscovered Technically
				Recoverable Oil and Gas Resources of the Nation’s Outer Continental Shelf,
				2006</quote>.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H0ADD0647B6EF487594845C81D0D456C0"><enum>303.</enum><header>Domestic oil
			 and natural gas production goal</header><text display-inline="no-display-inline">Section 18 of the Outer Continental Shelf
			 Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C.
			 1344</external-xref>) is amended by striking subsection (b) and inserting the
			 following:</text>
				<quoted-block id="H34B5BAA5B7B24A03AFCE41D240F90513" style="OLC">
					<subsection id="H8C024EB9734B4BB5AB4622ADA482B277"><enum>(b)</enum><header>Domestic oil and
				natural gas production goal</header><text>–</text>
						<paragraph id="H0EEB1514D17F41B6AE724E44A3C00F83"><enum>(1)</enum><header>In
				general</header><text>In developing a 5-year oil and gas leasing program,
				subject to paragraph (2), the Secretary shall determine a domestic strategic
				production goal for the development of oil and natural gas as a result of that
				program, which goal shall be—</text>
							<subparagraph id="HF2556DB3D586423D9C73B98BBAFE195B"><enum>(A)</enum><text>the best estimate
				of the practicable increase in domestic production of oil and natural gas from
				the outer Continental Shelf;</text>
							</subparagraph><subparagraph id="H63CD78CB22DC4FBB80E9BAA5A8722F8B"><enum>(B)</enum><text>focused on meeting
				domestic demand for oil and natural gas and reducing the dependence of the
				United States on foreign energy; and</text>
							</subparagraph><subparagraph id="H08D02D33679241D18EFC32DF334FCE4A"><enum>(C)</enum><text>focused on the
				production increases achieved by the leasing program at the end of the 15-year
				period beginning on the effective date of the program.</text>
							</subparagraph></paragraph><paragraph id="HE08A2A0C634D45EFA3A34A42A5ADF8F6"><enum>(2)</enum><header>2012–2017
				program goal</header><text>For purposes of the 2012–2017 5-year oil and gas
				leasing program, the production goal referred to in paragraph (1) shall be an
				increase by 2027 of not less than—</text>
							<subparagraph id="H76C9CCD4D61D4213B19B8AD9AE2BBEB8"><enum>(A)</enum><text>3,000,000 barrels
				in the quantity of oil produced per day; and</text>
							</subparagraph><subparagraph id="H4A691BD3B1444260B473D6A80964C48A"><enum>(B)</enum><text>10,000,000,000
				cubic feet in the quantity of natural gas produced per day.</text>
							</subparagraph></paragraph><paragraph id="HAC829EE8003348919FD2DD5B12E32851"><enum>(3)</enum><header>Reporting</header><text>Beginning
				at the end of the 5-year period for which the program applies and annually
				thereafter, the Secretary shall submit to the Committee on Natural Resources of
				the House of Representatives and the Committee on Energy and Natural Resources
				of the Senate a report on the progress of the program in meeting the production
				goal that includes an identification of projections for production and any
				problems with leasing, permitting, or production that will prevent meeting the
				goal.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="idB943A00287B345F8AF7A3911965755BD"><enum>IV</enum><header>Jobs and energy
			 permitting</header>
			<section id="H4B61B50A4E184DD482394C978C147A45" section-type="subsequent-section"><enum>401.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Jobs and Energy Permitting Act
			 of 2012</short-title></quote>.</text>
			</section><section id="H0465210DA037405DADE37D70B2E891D1"><enum>402.</enum><header>Air quality
			 measurement</header><text display-inline="no-display-inline">Section 328(a)(1)
			 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7627">42 U.S.C. 7627(a)(1)</external-xref>) is amended in
			 the second sentence by inserting before the period at the end the following:
			 <quote>, except that any air quality impact of any OCS source shall be measured
			 or modeled, as appropriate, and determined solely with respect to the impacts
			 in the corresponding onshore area</quote>.</text>
			</section><section id="H1C00DE4BCA0343E79E69554C92EB037B"><enum>403.</enum><header>OCS
			 source</header><text display-inline="no-display-inline">Section 328(a)(4)(C) of
			 the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7627">42 U.S.C. 7627(a)(4)(C)</external-xref>) is amended
			 in the second sentence of the matter following clause (iii) by striking
			 <quote>shall be considered direct emissions from the OCS source</quote> and
			 inserting <quote>shall be considered direct emissions from the OCS source but
			 shall not be subject to any emission control requirement applicable to the
			 source under subpart 1 of part C of title I of this Act. For platform or drill
			 ship exploration, an OCS source is established at the point in time when
			 drilling commences at a location and ceases to exist when drilling activity
			 ends at the location or is temporarily interrupted because the platform or
			 drill ship relocates for weather or other reasons</quote>.</text>
			</section><section id="H86D47B5BC5A747F09E57266D59360A7B"><enum>404.</enum><header>Permits</header>
				<subsection id="HD70659423F7A47979B29771BDDF50987"><enum>(a)</enum><header>Permits</header><text display-inline="yes-display-inline">Section 328 of the Clean Air Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/7627">42 U.S.C.
			 7627</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4B12A500C7594B9080CB7E552A0C2796" style="OLC">
						<subsection id="H0E13F57D47AE4DFF9F5A67649CFCB863"><enum>(d)</enum><header>Permit
				application</header><text>In the case of a completed application for a permit
				under this Act for platform or drill ship exploration for an OCS source—</text>
							<paragraph id="HBBF5B784955A482CA8641E70C40FD229"><enum>(1)</enum><text>final agency
				action (including any reconsideration of the issuance or denial of such a
				permit) shall be taken not later than 180 days after the date on which the
				completed application is filed;</text>
							</paragraph><paragraph id="H1F25BB59A8754E3681F3F440D52F0A1D"><enum>(2)</enum><text display-inline="yes-display-inline">the Environmental Appeals Board of the
				Environmental Protection Agency shall have no authority to consider any matter
				regarding the consideration, issuance, or denial of the permit;</text>
							</paragraph><paragraph id="H66879D11F1E94A84B0CC46D2EF92F465"><enum>(3)</enum><text display-inline="yes-display-inline">no administrative stay of the effectiveness
				of the permit may extend beyond the date that is 180 days after the date on
				which the completed application is filed;</text>
							</paragraph><paragraph id="H55B7392B381A487599528C87CADAA366"><enum>(4)</enum><text>that final agency
				action shall be considered to be nationally applicable under section 307(b);
				and</text>
							</paragraph><paragraph id="HCE222A7533BE491B8C1A63DA98EDB1FF"><enum>(5)</enum><text>judicial review of
				that final agency action shall be available only in accordance with section
				307(b) without additional administrative review or
				adjudication.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 Project water reliability</header>
				<section id="H1957333CA2334C3C965FBD7A1D9061A1"><enum>511.</enum><header>Amendment to
			 purposes</header><text display-inline="no-display-inline">Section 3402 of the
			 Central Valley Project Improvement Act (Public Law 102–575; 106 Stat. 4706) is
			 amended—</text>
					<paragraph id="HBC2DF7B088F144A0ADEA3BC4534651A4"><enum>(1)</enum><text>in subsection (f),
			 by striking the period at the end; and</text>
					</paragraph><paragraph id="H077C46B3848D4F5D89CD119DDEDA7E9A"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

					</paragraph></section><section id="HB663AA85875842258D81C8D046E5EFBB"><enum>512.</enum><header>Amendment to
			 definition</header><text display-inline="no-display-inline">Section 3403 of the
			 Central Valley Project Improvement Act (Public Law 102–575; 106 Stat. 4707) is
			 amended—</text>
					<paragraph id="HF895864AA575416BB26EF2999124AF85"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
						<quoted-block id="H5FCC56E767684B51BD42AB85980A1E4A" style="OLC">
							<subsection id="H2A2A2D5F42B2473FA2F443B505E69DFC"><enum>(a)</enum><text>the term
				<term>anadromous fish</term> means those native stocks of salmon (including
				steelhead) and sturgeon that—</text>

				1992, were present in the Sacramento and San Joaquin Rivers and the tributaries

				rivers and tributaries to reproduce after maturing in San Francisco Bay or the
				Pacific Ocean;</text>

					</paragraph><paragraph id="H9026095D4BE640D5973439D9736FA5BB"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (i) through
			 (m) as subsections (j) through (n), respectively; and</text>
					</paragraph><paragraph id="HBDB92350EE6745D0A564217E4EDCC76A"><enum>(3)</enum><text>by inserting after
			 subsection (h) the following:</text>

					</paragraph></section><section id="H09C5C80DBC7E44E5A20F48C664E98534"><enum>513.</enum><header>Contracts</header><text display-inline="no-display-inline">Section 3404 of the Central Valley Project
			 Improvement Act (Public Law 102–575; 106 Stat. 4708) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H4847876EAF824309A5A4B7D1AB5EFFE1" style="OLC">
						<section id="id4EC3B12B902146D5A6B58DC162B1FBE2"><enum>3404.</enum><header>Contracts</header>
							<subsection id="H9CDBC7CB6E1241BCAB4D39368296115A"><enum>(a)</enum><header>Renewal of
				existing long-Term contracts</header><text>On request of the contractor, the
				Secretary shall renew any existing long-term repayment or water service
				contract that provides for the delivery of water from the Central Valley
				Project for a period of 40 years.</text>
							</subsection><subsection display-inline="no-display-inline" id="H502325A397E045CB8BFB0B7F10751A12"><enum>(b)</enum><header>Administration
				of contracts</header><text display-inline="yes-display-inline">Except as
				expressly provided by this title, any existing long-term repayment or water
				service contract for the delivery of water from the Central Valley Project
				shall be administered pursuant to the Act of July 2, 1956 (chapter 492; 70
				Stat. 483).</text>
							</subsection><subsection id="HA9F66CAC22AF49E9A3E0CE86D408D399"><enum>(c)</enum><header>Delivery
				charge</header><text>Beginning on the date of enactment of this Act, a contract
				entered into or renewed pursuant to this section shall include a provision that
				requires the Secretary to charge any other party to the contract only for water
				actually delivered by the
				Secretary.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H383115BB09C94D74B0B73EDA921BB82C"><enum>514.</enum><header>Water
			 transfers, improved water management, and conservation</header><text display-inline="no-display-inline">Section 3405 of the Central Valley Project
			 Improvement Act (Public Law 102–575; 106 Stat. 4709) is amended—</text>
					<paragraph id="H75FEBA44C6D24E25A08716C9386A9ECC"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="H82C4AA4BFC294D539B2E83A3A5034A61"><enum>(A)</enum><text>in the second
			 sentence, by striking <quote>Except as provided herein</quote> and inserting
			 <quote>The Secretary shall take all actions necessary to facilitate and
			 expedite transfers of Central Valley Project water in accordance with this
			 title or any other provision of Federal reclamation law and the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.). Except as provided

								<subparagraph id="H160294E95B824BD39F240BCABF1D278B"><enum>(E)</enum><header>Written transfer
				proposals</header>
									<clause id="id4953AA294E184C97879DDB068AED1915"><enum>(i)</enum><header>In
				general</header><text>The contracting district from which the water is
				supplied, the agency, or the Secretary, as applicable, shall determine whether
				a written transfer proposal is complete not later than 45 days after the date
				on which the proposal is submitted.</text>
									</clause><clause id="idA615598B30C44304967C490FB3514BA9"><enum>(ii)</enum><header>Determination</header><text>If
				the contracting district, the agency, or the Secretary determines that the
				proposal described in clause (i) is incomplete, the contracting district,
				agency, or Secretary shall state, in writing and with specificity, the
				conditions under which the proposal would be considered complete.</text>
									</clause></subparagraph><subparagraph id="H26C7E1DC60284B5F9BA0592842FF33AA"><enum>(F)</enum><header>No mitigation
				requirements</header>
									<clause id="id8E7A131C4B8141D1B7DD65AD2C67BE56"><enum>(i)</enum><header>In
				general</header><text>Except as provided in this section, the Secretary shall
				not impose mitigation or other requirements on a proposed transfer.</text>
									</clause><clause id="id5C8E6991B6B24C1A97D85FA7E2A60CBC"><enum>(ii)</enum><header>Applicability</header><text>This
				section shall have no effect on the authority of the contracting district from
				which the water is supplied or the agency under State law to approve or
				condition a proposed transfer.</text>
									</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H435E0C7531864327995720E6475A36A1"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block id="H952B28E4734D4041ACFC0B9BAF5F694E" style="OLC">
								<paragraph id="H9AA38EAAC9CE4D37856D142DEE764D70"><enum>(4)</enum><header>Applicability</header><text display-inline="yes-display-inline">Notwithstanding any other provision of
				Federal reclamation law—</text>
									<subparagraph id="H473E216A63A94829A524EB79C91F73C6"><enum>(A)</enum><text>the authority to
				transfer, exchange, bank, or make recharging arrangements using Central Valley
				Project water that could have been carried out before October 30, 1992, is
				valid, and those transfers, exchanges, or arrangements shall not be subject to,
				limited, or conditioned by this title; and</text>
									</subparagraph><subparagraph id="H4A758E94A2BC46C0B024F5BD3D9BDAC1"><enum>(B)</enum><text>this title does
				not supersede or revoke the authority to transfer, exchange, bank, or recharge
				Central Valley Project water in effect before October 30,
				1992.</text>
									</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H7615C27B4CC94FEEB5254262903106A3"><enum>(2)</enum><text>in subsection
			 (b)—</text>

					</paragraph></section><section id="H0BAA863AB19347198A87D3617042DC44"><enum>515.</enum><header>Fish, wildlife,
			 and habitat restoration</header><text display-inline="no-display-inline">Section 3406 of the Central Valley Project
			 Improvement Act (Public Law 102–575; 106 Stat. 4714) is amended—</text>
					<paragraph id="H44BD347438DF4CB3906A5C4F30D8FDBA"><enum>(1)</enum><text>in subsection
			 (b)—</text>
						<subparagraph id="HA045E101C8014629ADD249F71AC455B4"><enum>(A)</enum><text>by striking
			 paragraph (1)(B) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id99A2392B12B24D63A6412099FE2F1C22" style="OLC">
								<subparagraph id="id7540C4D0871E4C128E10FA6A97937128"><enum>(B)</enum><header>Administration</header>
									<clause id="id6C7C2AF6016E48FD91758B53E0D8E5B8"><enum>(i)</enum><header>In
				general</header><text>As needed to carry out the goals of the Central Valley
				Project, the Secretary may modify Central Valley Project operations to provide
				reasonable flows of suitable quality, quantity, and timing to protect all life
				stages of anadromous fish.</text>
									</clause><clause id="id03804D2E3E85460D8D1C1D405F190E24"><enum>(ii)</enum><header>Requirements</header><text>The
				flows under clause (i) shall be provided from the quantity of water dedicated
				to fish, wildlife, and habitat restoration purposes under paragraph (2) from
				the water supplies acquired pursuant to paragraph (3) and from other sources
				which do not conflict with fulfillment of the remaining contractual obligations
				of the Secretary to provide Central Valley Project water for other authorized
				purposes.</text>
									</clause><clause id="id2F4E66EA715345DEBDAD18C03785A975"><enum>(iii)</enum><header>Determination
				of needs</header><text>The Secretary shall determine the instream reasonable
				flow needs for all Central Valley Project controlled streams and rivers based
				on recommendations of the United States Fish and Wildlife Service and the
				National Marine Fisheries Service after consultation with the United States
				Geological Survey.</text>
									</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H78B95E472C474955BEFD599446C24AF8"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
							<clause id="H9FD37CC631FC4FC1A64475A1FF8E567E"><enum>(i)</enum><text>in
			 the matter preceding subparagraph (A)—</text>
								<subclause id="id9F6BDE9AD6314FCBA4017E34BB58F24F"><enum>(I)</enum><text>in the first
			 sentence, by striking <quote>primary purpose</quote> and inserting
			 <quote>purposes</quote>;</text>

			 end the following: <quote>All Central Valley Project water used for the
			 purposes specified in this paragraph shall be credited to the quantity of
			 Central Valley Project yield dedicated and managed under this paragraph by
			 determining how the dedication and management of that water would affect the
			 delivery capability of the Central Valley Project yield. To the maximum extent
			 practicable and in accordance with section 3411, Central Valley Project water
			 dedicated and managed pursuant to this paragraph shall be reused to fulfill the
			 remaining contractual obligations of the Secretary to provide Central Valley
			 Project water for agricultural or municipal and industrial purposes.</quote>;
			 and</text>
								</subclause></clause><clause id="HCE329EA7573646598611B3FAB170F0C8"><enum>(ii)</enum><text>by
			 striking subparagraph (C) and inserting the following:</text>
								<quoted-block id="H8D5E8B79D9AA4118910C4FA721D871FD" style="OLC">
									<subparagraph id="H88D6B58E1064411DBDC223D0B8537385"><enum>(C)</enum><header>Mandatory
				reduction</header><text>If on March 15 of a given year, the quantity of Central
				Valley Project water forecasted to be made available to water service or
				repayment contractors in the Delta Division of the Central Valley Project is
				less than 75 percent of the total quantity of water to be made available under
				those contracts, the quantity of Central Valley Project yield dedicated and
				managed for that year under this paragraph shall be reduced by 25
				percent.</text>
									</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</clause></subparagraph></paragraph><paragraph id="H76403DE4E98849BF948C0D4F65B55007"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

				of—</text>
										<clause id="idF686453030264FF0859643298178C3CC"><enum>(i)</enum><text>providing for the
				storage or conveyance of non-Central Valley Project water pursuant to Federal
				reclamation laws; or</text>
										</clause><clause id="id65634E974EAA4BF4A764298991BD2E31"><enum>(ii)</enum><text>the delivery of
				water pursuant to section 215 of the Reclamation Reform Act of 1982
				(<external-xref legal-doc="public-law" parsable-cite="pl/97/293">Public Law
				97–293</external-xref>; 96 Stat. 1270); or</text>
										</clause></subparagraph><subparagraph id="id66A7ACFE55C44F7CA38F9B1A46D2EFCC"><enum>(B)</enum><text>for any water
				that is delivered with the sole intent of groundwater
				recharge.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H556F4179C672440285BC64424DC61A61"><enum>(b)</enum><header>Certain
			 payments</header><text display-inline="yes-display-inline">Section 3407(c)(1)
			 of the Central Valley Project Improvement Act (Public Law 102–575; 106 Stat.
			 4726) is amended—</text>
						<paragraph id="H3CE4F7618E164929AD3ED614866B8A03"><enum>(1)</enum><text>by striking
			 <quote>mitigation and restoration payments, in addition to charges provided for
			 or</quote> and inserting <quote>payments, in addition to charges</quote>;
			 and</text>
						</paragraph><paragraph id="HA3AB354B96934F3481B267A72CD5ACC5"><enum>(2)</enum><text>by striking
			 <quote>of fish, wildlife</quote> and all that follows through the period and
			 inserting <quote>of carrying out this title.</quote>.</text>
						</paragraph></subsection><subsection id="H277B8B8DBA8C4FAAB632F0500F2BF9F5"><enum>(c)</enum><header>Adjustment and
			 assessment of mitigation and restoration payments</header><text>Section 3407(d)
			 of the Central Valley Project Improvement Act (Public Law 102–575; 106 Stat.
			 4727) is amended—</text>
						<paragraph id="id1EF6A8272EE5455B9BD7DD4DBF3FE66B"><enum>(1)</enum><text>in paragraph
			 (2)(A)—</text>
							<subparagraph id="id4790BCD02F1847D29F1A910F95AC1F7A"><enum>(A)</enum><text>by striking
			 <quote>, and $12 per acre-foot (October 1992 price levels) for municipal and
			 industrial water sold and delivered by the Central Valley Project</quote> and
			 inserting <quote>$12 per acre-foot (October 1992 price levels) for municipal
			 and industrial water sold and delivered by the Central Valley Project, and
			 after October 1, 2013, $4 per megawatt-hour for Central Valley Project power
			 sold to power contractors (October 2013 price levels)</quote>; and</text>
							</subparagraph><subparagraph commented="no" id="HB6B4AC35A5404EC286A24177140C75C6"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote> but not later than
			 December 31, 2020,</quote> after <quote>That upon the completion of the fish,
			 wildlife, and habitat mitigation and restoration actions mandated under section
			 3406 of this title,</quote>; and</text>
							</subparagraph></paragraph><paragraph commented="no" id="id1A301705BA274BCD8C8C2A07D60C44BD"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

				expenditure of funds</header>
									<paragraph id="id863AC880A06B486CAB1429507D0F03F1"><enum>(1)</enum><header>In
				general</header><text>For each fiscal year, the Secretary, in consultation with
				the Advisory Board, shall submit to Congress a plan for the expenditure of all
				of the funds deposited in the Restoration Fund during the preceding fiscal
				year.</text>
									</paragraph><paragraph id="idCA0C4E08736649EC8A074BFF2AABB9AD"><enum>(2)</enum><header>Contents</header><text>The
				plan shall include an analysis of the cost-effectiveness of each
				expenditure.</text>
									</paragraph></subsection><subsection id="H487CCEBCBBA643EDB1D79EFE97C90C63"><enum>(h)</enum><header>Advisory
				Board</header>
									<paragraph id="H6110113FA4C7485C85859C26F4291774"><enum>(1)</enum><header>Establishment</header><text>There
				is established the Restoration Fund Advisory Board (referred to in this section
				as the <quote>Advisory Board</quote>), which shall be composed of 12 members
				appointed by the Secretary.</text>
									</paragraph><paragraph id="idF9D0B8040111409E91A856EF4E6D2901"><enum>(2)</enum><header>Membership</header>
										<subparagraph id="id755A37BE007448849472FCAF28C95967"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall appoint members to the Advisory Board
				that represent the various Central Valley Project stakeholders, of whom—</text>
											<clause id="idDD6A233239FB49A8A24DE39E9A040252"><enum>(i)</enum><text>4
				members shall be agricultural users of the Central Valley Project;</text>
											</clause><clause id="id1DDEA5DEAC13452A8CAF9CD16F05DB34"><enum>(ii)</enum><text>3 members shall
				be municipal and industrial users of the Central Valley Project;</text>
											</clause><clause id="idDF4EC76517C147EDA94487B09DF37DE4"><enum>(iii)</enum><text>3 members shall
				be power contractors of the Central Valley Project; and</text>
											</clause><clause id="id1E72BD10A38349F98DF0CF8BED14626C"><enum>(iv)</enum><text>2 members shall
				be appointed at the discretion of the Secretary.</text>
											</clause></subparagraph><subparagraph id="id3804EB8139D34791AE36D4E7B9D009D7"><enum>(B)</enum><header>Observers</header><text>The
				Secretary and the Secretary of Commerce may each designate a representative to
				act as an observer of the Advisory Board.</text>
										</subparagraph><subparagraph id="id2FD7C3DEEE0849A8ABA902FF612E965D"><enum>(C)</enum><header>Chairman</header><text>The
				Secretary shall appoint 1 of the members described in subparagraph (A) to serve
				as Chairman of the Advisory Board.</text>
										</subparagraph></paragraph><paragraph id="id26FC8B1C49294A7F8D4AC6C0549F6C73"><enum>(3)</enum><header>Terms</header><text>The
				term of each member of the Advisory Board shall be for a period of 4
				years.</text>
									</paragraph><paragraph id="HB3CC18843E334E1893EA61883CAE73E6"><enum>(4)</enum><header>Duties</header><text>The
				duties of the Advisory Board are—</text>
										<subparagraph id="HE001E25806DE45DFAB57310927E47C09"><enum>(A)</enum><text>to meet not less
				frequently than semiannually to develop and make recommendations to the
				Secretary regarding priorities and spending levels on projects and programs
				carried out under this title;</text>
										</subparagraph><subparagraph id="H4A814A9C61E043778D194CA88026EC9C"><enum>(B)</enum><text>to ensure that any
				advice given or recommendation made by the Advisory Board reflects the
				independent judgment of the Advisory Board;</text>
										</subparagraph><subparagraph id="H2CD362C4F9E042609A63A0B114E0D523"><enum>(C)</enum><text>not later than
				December 31, 2013, and annually thereafter, to submit to the Secretary and
				Congress the recommendations under subparagraph (A); and</text>
										</subparagraph><subparagraph id="H8E80BE74AE0848698AB2C132A26CB3D9"><enum>(D)</enum><text display-inline="yes-display-inline">not later than December 31, 2013, and
				biennially thereafter, to submit to Congress a report that details the progress
				made in achieving the actions required under section 3406.</text>
										</subparagraph></paragraph><paragraph id="H9EAF88D8D91E44F5A351ACCCF0CD73ED"><enum>(5)</enum><header>Administration</header><text>With
				the consent of the appropriate agency head, the Advisory Board may use the
				facilities and services of any Federal
				agency.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="H98C4B2773BFA42C7A1BB15A75496C983"><enum>517.</enum><header>Additional
			 authorities</header>
					<subsection id="H96E3850740B9428A8823D034DE6FF9DE"><enum>(a)</enum><header>Authority for
			 certain activities</header><text>Section 3408 of the Central Valley Project
			 Improvement Act (Public Law 102–575; 106 Stat. 4728) is amended by striking
			 subsection (c) and inserting the following:</text>
						<quoted-block id="HD347B4B3703A477AA36F76D29C6E7DD8" style="OLC">
							<subsection id="H3EB2AA6BA6BB4EA2B13FCF1115CE6A53"><enum>(c)</enum><header>Contracts for
				additional storage and delivery of water</header>
								<paragraph id="H3BC02245353643CFBB42FA40188D5CB2"><enum>(1)</enum><header>In
				general</header><text>The Secretary may enter into contracts under the
				reclamation laws and this title with any Federal agency, California water user
				or water agency, State agency, or private organization for the exchange,
				impoundment, storage, carriage, and delivery of nonproject water for domestic,
				municipal, industrial, fish and wildlife, and any other beneficial
				purpose.</text>
								</paragraph><paragraph id="HA527614685AD46FA89745BE1C774A420"><enum>(2)</enum><header>Limitation</header><text>Nothing
				in this subsection supersedes section 2(d) of the Act of August 26, 1937
				(chapter 832; 50 Stat. 850; 100 Stat. 3051).</text>
								</paragraph><paragraph id="HA5F2BBDDFF584F529EFA422FF96BCB2E"><enum>(3)</enum><header>Authority for
				certain activities</header><text>The Secretary shall use the authority granted
				by this subsection in connection with requests to exchange, impound, store,
				carry, or deliver nonproject water using Central Valley Project facilities for
				any beneficial purpose.</text>
								</paragraph><paragraph id="H7A15D4B77C4C49838ED06AE0A5FD1A41"><enum>(4)</enum><header>Rates</header>
									<subparagraph id="id6CCF7E3177FD422DB7F733C8D7CF673C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				develop rates not to exceed the amount required to recover the reasonable costs
				incurred by the Secretary in connection with a beneficial purpose under this
				subsection.</text>
									</subparagraph><subparagraph id="id33E63032AC204167AC859A2883B35B4B"><enum>(B)</enum><header>Administration</header><text display-inline="yes-display-inline">The rates shall be charged to a party using
				Central Valley Project facilities for a beneficial purpose, but the costs
				described in subparagraph (A) shall not include any donation or other payment
				to the Restoration Fund.</text>
									</subparagraph></paragraph><paragraph id="H83A599501F9F4AD0BCEB9EA2411033C2"><enum>(5)</enum><header>Construction</header><text>This
				subsection shall be construed and implemented to facilitate and encourage the
				use of Central Valley Project facilities to exchange, impound, store, carry, or
				deliver nonproject water for any beneficial
				purpose.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HB8C004A87C3747B490A26DE856C73CA8"><enum>(b)</enum><header>Reporting
			 requirements</header><text>Section 3408(f) of the Central Valley Project
			 Improvement Act (Public Law 102–575; 106 Stat. 4729) is amended—</text>
						<paragraph id="H023F8B75B40F401AAE9D5AB204F0C05A"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>Interior and Insular Affairs and the Committee on
			 Merchant Marine and Fisheries</quote> and inserting <quote>Natural
			 Resources</quote>;</text>
						</paragraph><paragraph id="HA276B5C86D704D13989E5853ACB72665"><enum>(2)</enum><text>in the second
			 sentence, by inserting <quote>, including progress on the plan under subsection
			 (j)</quote> before the period at the end; and</text>

			 increase</header><text>Section 3408(j) of the Central Valley Project
			 Improvement Act (Public Law 102–575; 106 Stat. 4730) is amended—</text>

				general</header><text>The Secretary shall implement the plan under paragraph
				(1) beginning on October 1, 2013.</text>
									</subparagraph><subparagraph id="id337403C294304468901793BC0A6CA914"><enum>(B)</enum><header>Coordination</header><text>In
				carrying out this subsection, the Secretary shall coordinate with the State of
				California in implementing measures for the long-term resolution of problems in
				the San Francisco Bay/Sacramento-San Joaquin Delta Estuary.</text>
									</subparagraph></paragraph><paragraph id="HD94626135AC24BB5A00BB249CE3A067F"><enum>(4)</enum><header>Failure of
				plan</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of the reclamation laws, if by September 30, 2016, the plan
				under paragraph (1) fails to increase the annual delivery capability of the
				Central Valley Project by 800,000 acre-feet, implementation of any nonmandatory
				action under section 3406(b)(2) shall be suspended until the date on which the
				plan achieves an increase in the annual delivery capability of the Central
				Valley Project of 800,000
				acre-feet.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H9FA08C8854154D45B6A3BD207A18B1A5"><enum>(d)</enum><header>Technical
			 corrections</header><text>Section 3408(h) of the Central Valley Project
			 Improvement Act (Public Law 102–575; 106 Stat. 4729) is amended—</text>
						<paragraph id="HC6660CF0A7164033825C1A41C5664597"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>paragraph (h)(2)</quote> and inserting <quote>paragraph

			 project construction</header>
						<paragraph id="id59ACEFD909B64F3D9BDEAC7CF8C2680D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior, acting through the Commissioner of Reclamation, may partner or enter
			 into an agreement relating to the water storage projects described in section
			 103(d)(1) of the Water Supply, Reliability, and Environmental Improvement Act
			 (Public Law 108–361; 118 Stat. 1684) with local joint powers authorities formed
			 under State law by irrigation districts and other local governments or water
			 districts within the applicable hydrological region to advance those water
			 storage projects.</text>
						</paragraph><paragraph id="id8A0DE341B3DB4F469ED10C78F8EAEA29"><enum>(2)</enum><header>No additional
			 Federal amounts</header>
							<subparagraph id="id4072D0F5BCFD4BBB82EFB4E9567330A6"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to
			 subparagraph (B), no additional Federal amounts are authorized to be
			 appropriated to carry out the activities described in clauses (i) through (iii)
			 of sections 103(d)(1)(A) of the Water Supply, Reliability, and Environmental
			 Improvement Act (Public Law 108–361; 118 Stat. 1684)
			 <external-xref legal-doc="public-law" parsable-cite="pl/108/361"> Public Law
			 108–361</external-xref>.</text>
							</subparagraph><subparagraph id="idA66F7EE531F84B7BB4A3D815F47B2A60"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Additional Federal amounts may be
			 appropriated for construction of a project described in subparagraph (A) if
			 non-Federal amounts are used to finance and construct the project.</text>
							</subparagraph></paragraph></subsection></section><section id="H3267B799AF964D8A9464D416A529F70E"><enum>518.</enum><header>Bay-Delta
			 Accord</header>
					<subsection id="H3B9BA44C8FA6406384D9C5D623C12299"><enum>(a)</enum><header>Congressional
			 direction regarding Central Valley Project and California State Water Project
			 operations</header>
						<paragraph id="idFEC68763B2744A85B59177B9D4E5394B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Central Valley
			 Project and the California State Water Project shall be operated strictly in
			 accordance with the water quality standards and operational constraints
			 described in the <quote>Principles for Agreement on the Bay-Delta Standards
			 Between the State of California and the Federal Government</quote> dated
			 December 15, 1994.</text>
						</paragraph><paragraph id="id66D7B53D7B03499489FA065EFB5F46B1"><enum>(2)</enum><header>Applicability
			 of other law</header><text display-inline="yes-display-inline">The Endangered
			 Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) and other
			 applicable law shall not apply to operations described in paragraph (1).</text>
						</paragraph><paragraph id="idA97DB65962094AF193CC578B7182E48D"><enum>(3)</enum><header>Implementation</header><text display-inline="yes-display-inline">Implementation of the <quote>Principles for
			 Agreement on the Bay-Delta Standards Between the State of California and the
			 Federal Government</quote> dated December 15, 1994, shall be in strict
			 compliance with the water rights priority system and statutory protections for
			 areas of origin.</text>
						</paragraph></subsection><subsection id="H03A3E24C04FD4E9E86E56A59F670DA65"><enum>(b)</enum><header>Application of
			 laws to others</header>
						<paragraph id="id1FF5D8FA569A457F8A5764AC0BC1B46C"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As a condition of the
			 receipt of Federal amounts for the Central Valley Project and the California
			 State Water Project, the State of California (including any agency or board of
			 the State of California), on any water right obtained pursuant to State law,
			 including a pre-1914 appropriative right, shall not—</text>
							<subparagraph id="id3218151521494F06BBC231D1009FDF19"><enum>(A)</enum><text display-inline="yes-display-inline">impose any condition that restricts the
			 exercise of that water right that is affected by operations of the Central
			 Valley Project or California State Water Project; or</text>
							</subparagraph><subparagraph id="id49009ED33A654F4297391DDF83AD8EAE"><enum>(B)</enum><text display-inline="yes-display-inline">restrict under the Public Trust Doctrine
			 any public trust value imposed in order to conserve, enhance, recover, or
			 otherwise protect any species.</text>
							</subparagraph></paragraph><paragraph id="idC90BA4102DBB4C4D9C8274C9ADD08DE4"><enum>(2)</enum><header>Federal
			 agencies</header><text>The prohibition under paragraph (1)(A) shall apply to
			 Federal agencies.</text>
						</paragraph></subsection><subsection id="H3F82DAED0A2245B9B3F3FB5A245E5046"><enum>(c)</enum><header>Costs</header><text>No
			 cost associated with the implementation of this section shall be imposed
			 directly or indirectly on any Central Valley Project contractor, or any other
			 person or entity, unless those costs are incurred on a voluntary basis.</text>
					</subsection><subsection id="H540E6A764667444E8ECE699406DEC938"><enum>(d)</enum><header>Native species
			 protection</header><text>This section preempts any law of the State California
			 law restricting the quantity or size of a nonnative fish that is taken or
			 harvested that preys on 1 or more native fish species that occupy the
			 Sacramento and San Joaquin Rivers and the tributaries of those rivers or the
			 Sacramento-San Joaquin Rivers Delta.</text>
					</subsection></section><section id="H037C0FF1B3364E5CAE9C7E41B48AA4FA"><enum>519.</enum><header>Natural and
			 artificially spawned species</header><text display-inline="no-display-inline">After the date of enactment of this Act, and
			 regardless of the date of listing, the Secretaries of the Interior and Commerce
			 shall not distinguish between natural-spawned and hatchery-spawned (or
			 otherwise artificially propagated strains of a species) in making any
			 determination under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et
			 seq.</external-xref>) that relates to an anadromous fish species present in the
			 Sacramento and San Joaquin Rivers or the tributaries of those rivers and that
			 ascends those rivers and tributaries to reproduce after maturing in San
			 Francisco Bay or the Pacific Ocean.</text>
				</section><section id="H51FEE32793C34798B0BAE6EF3BE9AF3F"><enum>520.</enum><header>Authorized
			 service area</header>
					<subsection id="id2B8F8213BDBD4CC788812376C622BABD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of the
			 Interior, acting through the Commissioner of Reclamation, shall include in the
			 service area of the Central Valley Project authorized under the Central Valley
			 Project Improvement Act (Public Law 102–575; 106 Stat. 4706) the area within
			 the boundaries of the Kettleman City Community Services District, California,
			 as those boundaries are defined as of the date of enactment of this Act.</text>
					</subsection><subsection id="idAED40B9AFB40452BB23223C4179028D1"><enum>(b)</enum><header>Long-Term
			 contract</header>
						<paragraph id="id4CFEC385470942E2B468446F697919CC"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding the
			 Central Valley Project Improvement Act (Public Law 102–575; 106 Stat. 4706) and
			 subject to paragraph (2), the Secretary, in accordance with the reclamation
			 laws, shall enter into a long-term contract with the Kettleman City Community
			 Services District or the delivery of not more than 900 acre-feet of Central
			 Valley Project water for municipal and industrial use.</text>
						</paragraph><paragraph id="idC09DF8FA76724ED9BC7211FCE2CBC9F6"><enum>(2)</enum><header>Reduction in
			 contract</header><text display-inline="yes-display-inline">The Secretary may
			 temporarily reduce deliveries of the quantity of water made available under
			 paragraph (1) by not more than 25 percent of the total whenever reductions due
			 to hydrologic circumstances are imposed on agricultural deliveries of Central
			 Valley Project water.</text>
						</paragraph></subsection><subsection id="id529BDED12B27457599E8BABCC30E27C8"><enum>(c)</enum><header>Additional
			 cost</header><text display-inline="yes-display-inline">If any additional
			 infrastructure or related costs are needed to implement this section, those
			 costs shall be the responsibility of the non-Federal entity.</text>
					</subsection></section><section id="HC17BA0A7DABD4D7C82035FD303E30282"><enum>521.</enum><header>Regulatory
			 streamlining</header>
					<subsection id="HFE00539382DF48CD8505077695AA4BD7"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="H9B5EFF68651B4F369BE414065633F881"><enum>(1)</enum><header>CVP</header><text>The
			 term <term>CVP</term> means the Central Valley Project.</text>
						</paragraph><paragraph id="H512577CF48AD4FE8B7FDB2D4426BD268"><enum>(2)</enum><header>Project</header><text>The
			 term <term>project</term>—</text>
							<subparagraph id="HA9AC5397BC744CA48DC30870C270FAB8"><enum>(A)</enum><text>means an activity
			 that—</text>
								<clause id="H31D5089AD49A4717BA523B59AD784772"><enum>(i)</enum><text>is
			 undertaken by a public agency, funded by a public agency, or requires the
			 issuance of a permit by a public agency;</text>
								</clause><clause id="H170BC799DAC0482FBBBC1A775304EF35"><enum>(ii)</enum><text>has
			 a potential to result in a physical change to the environment; and</text>
								</clause><clause id="H4158DE1E5061419B9F701B6EDCCEB674"><enum>(iii)</enum><text>may be subject
			 to several discretionary approvals by governmental agencies;</text>
								</clause></subparagraph><subparagraph id="HD7F1D7FE2CD14A34AFDAFE133903D31F"><enum>(B)</enum><text>may include
			 construction activities, clearing or grading of land, improvements to existing
			 structures, and activities or equipment involving the issuance of a permit;
			 or</text>
							</subparagraph><subparagraph id="H287EEB8462144C9ABC52883D7588C883"><enum>(C)</enum><text>has the meaning
			 given the term defined in section 21065 of the California Public Resource
			 Code.</text>
							</subparagraph></paragraph></subsection><subsection id="id28CFBFF2BFA64AEC8213E68940C4390A"><enum>(b)</enum><header>Applicability
			 of certain laws</header><text display-inline="yes-display-inline">The filing of
			 a notice of determination or a notice of exemption for any project, including
			 the issuance of a permit under State law, for any project of the CVP or the
			 delivery of water from the CVP in accordance with the California Environmental
			 Quality Act shall be considered to meet the requirements for that project or
			 permit under section 102(2)(C) of the National Environmental Protection Act of
			 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C.
			 4332(2)(C)</external-xref>).</text>
					</subsection><subsection id="HC827B31CB8C34B4D9AFC15578F8A3797"><enum>(c)</enum><header>Continuation of
			 project</header><text>The Bureau of Reclamation shall not be required to cease
			 or modify any major Federal action or other activity for any project of the CVP
			 or the delivery of water from the CVP pending completion of judicial review of
			 any determination made under the National Environmental Protection Act of 1969
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4321 et
			 seq.</external-xref>).</text>
					</subsection></section></subtitle><subtitle id="H7402258BA34E42B8B0013375F767DB5C"><enum>B</enum><header>San Joaquin River
			 restoration</header>
				<section commented="no" display-inline="no-display-inline" id="id60701D9FB5144DA59F3804EDFDF619A1" section-type="subsequent-section"><enum>531.</enum><header display-inline="yes-display-inline">Repeal of the San Joaquin River
			 settlement</header><text display-inline="no-display-inline">As of the date of
			 enactment of this Act, the Secretary shall cease any action to implement the
			 Stipulation of Settlement, Natural Resources Defense Council, Inc. v. Rodgers,
			 No. Civ. S–88–1658 LKK/GGH (E.D. Cal. Sept. 13, 2006).</text>
				</section><section id="HADA7E4E041AC4A37A1D5700A70B52ED4"><enum>532.</enum><header>Purpose</header><text display-inline="no-display-inline">Section 10002 of the San Joaquin River
			 Restoration Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11; 123 Stat.
			 1349</external-xref>) is amended by striking <quote>implementation of the
			 Settlement</quote> and inserting <quote>restoration of the San Joaquin
			 River</quote>.</text>
				</section><section id="HCBBD9E4DC46D4A3AAFFE05C27E702454"><enum>533.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 10003 of the San Joaquin River
			 Restoration Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11; 123 Stat.
			 1349</external-xref>) is amended—</text>

				from Friant Dam to ensure that the target flow entering Mendota Pool, located
				approximately 62 river miles downstream from Friant Dam, does not fall below a
				speed of 50 cubic feet per second.</text>

			 <quote>hereby authorized and directed</quote> and all that follows through
			 <quote>in the Settlement:</quote> and inserting <quote>may carry out the
			 following:</quote>;</text>
						</subparagraph><subparagraph id="H873DC97A863F45F7AECDFA9B82C5BD21"><enum>(B)</enum><text>by striking
			 paragraphs (1), (2), (4), and (5);</text>
						</subparagraph><subparagraph id="HDAD5E278BAFD49499C06497AB5877AB6"><enum>(C)</enum><text>by redesignating
			 paragraph (3) as paragraph (1);</text>
						</subparagraph><subparagraph id="HF339CDD6111343EEAC540049B0833570"><enum>(D)</enum><text>in paragraph (1)
			 (as redesignated by subparagraph (C)), by striking <quote>paragraph 13 of the
			 Settlement</quote> and inserting <quote>this part</quote>; and</text>
						</subparagraph><subparagraph id="H1F423653A6E7426786F505F63C6EB010"><enum>(E)</enum><text>by adding at the
			 end the following :</text>
							<quoted-block display-inline="no-display-inline" id="H17692736419C4A468712A7E355C910D5" style="OLC">
								<paragraph id="HC842F314BEA04A39AB1EEC8C62C6404B"><enum>(2)</enum><text>In each water
				year, beginning in the water year commencing on March 1, 2013, the
				Secretary—</text>
									<subparagraph id="HC6AA9F3D257B43FE965414901BE84323"><enum>(A)</enum><text>shall modify
				Friant Dam operations to release the Restoration Flows for that water year,
				unless the year is a critical water year;</text>
									</subparagraph><subparagraph id="HEE9F73ABDE44490D93420E977A274413"><enum>(B)</enum><text>shall ensure
				that—</text>
										<clause id="id1DC5C499F06241C295911FC8989F6DF3"><enum>(i)</enum><text>the release of
				Restoration Flows are maintained at the level prescribed by this part;
				and</text>
										</clause><clause id="id1F5F3E5191FE48BA93B487896EB9928D"><enum>(ii)</enum><text>Restoration
				Flows do not reach downstream of Mendota Pool;</text>
										</clause></subparagraph><subparagraph id="HABCE4D766CEC4D1F86AE79168511EFE6"><enum>(C)</enum><text>shall release the
				Restoration Flows in a manner that improves the fishery in the San Joaquin
				River below Friant Dam and upstream of Gravelly Ford, Nevada, as in existence
				on the date of the enactment of the <short-title>Sacramento and San Joaquin Valleys Water Reliability
				Act</short-title>, including the associated riparian habitat; and</text>
									</subparagraph><subparagraph id="H6720B4AC1DFE44AAB70A2450B58C9505"><enum>(D)</enum><text>may, without
				limiting the actions required under subparagraphs (A) and (C) and subject to
				paragraph (3) and subsection (l), use the Restoration Flows to enhance or
				restore a warm water fishery downstream of Gravelly Ford, Nevada, including to
				Mendota Pool, if the Secretary determines that the action is reasonable,
				prudent, and feasible.</text>
									</subparagraph></paragraph><paragraph id="H32B9B32878EC4860BEFF33108B2F9959"><enum>(3)</enum><text>Not later than 1
				year after the date of enactment of the <short-title>Sacramento and San Joaquin Valleys Water Reliability
				Act</short-title>, the Secretary shall develop and implement, in cooperation
				with the State of California, a reasonable plan—</text>
									<subparagraph id="idD1300BDF4F56423C8704ADA4D57ADE38"><enum>(A)</enum><text>to fully
				recirculate, recapture, reuse, exchange, or transfer all Restoration Flows;
				and</text>
									</subparagraph><subparagraph id="id8E682EA32E3D42648D961EACB2A7ED8C"><enum>(B)</enum><text>to provide the
				recirculated, recaptured, reused, exchanged, or transferred flows to those
				contractors within the Friant Division, Hidden Unit, and Buchanan Unit of the
				Central Valley Project that relinquished the Restoration Flows that were
				recirculated, recaptured, reused, exchanged, or transferred.</text>
									</subparagraph></paragraph><paragraph id="idEA4D045EFE144662952E5FB4E696DDF1"><enum>(4)</enum><text>The plan
				described in paragraph (3) shall—</text>
									<subparagraph id="id75056AD8ADE34DF480B19BA6BFA80887"><enum>(A)</enum><text>address any
				impact on groundwater resources within the service area of the Friant Division,
				Hidden Unit, and Buchanan Unit of the Central Valley Project and mitigation may
				include groundwater banking and recharge projects;</text>
									</subparagraph><subparagraph id="idCA9CC92BFBD74E448A3EFC04561BB8EB"><enum>(B)</enum><text>not impact the
				water supply or water rights of any entity outside the Friant Division, Hidden
				Unit, and Buchanan Unit of the Central Valley Project; and</text>
									</subparagraph><subparagraph id="idAE1A1519D1284399A5DCE907ED161C75"><enum>(C)</enum><text>be subject to
				applicable provisions of California water law and the use by the Secretary of
				the Interior of Central Valley Project facilities to make Project water (other
				than water released from Friant Dam under this part) and water acquired through
				transfers available to existing south of Delta Central Valley Project
				contractors.</text>
									</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H689C158F302F4FA89656CC79F788DF51"><enum>(2)</enum><text>in subsection
			 (b)—</text>
						<subparagraph id="HA3E0F4CB016345FE8D057FF699C63355"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>the
			 Settlement</quote> and inserting <quote>this part</quote>; and</text>

				impacts</header>

				general</header><text>Not later than October 1, 2013 and subject to paragraph
				(2), the Secretary shall identify—</text>
									<subparagraph id="H870FA13439C141DEB3E84853560D7CC7"><enum>(A)</enum><text>the impacts
				associated with the release of Restoration Flows prescribed in this part;
				and</text>
									</subparagraph><subparagraph id="H8EA102C408354D9E94C9656F01F63B49"><enum>(B)</enum><text>the measures to be
				implemented to mitigate impacts on adjacent and downstream water users,
				landowners, and agencies as a result of Restoration Flows.</text>
									</subparagraph></paragraph><paragraph id="H2454F4CDEA894C8CB9AF180190229EB8"><enum>(2)</enum><header>Mitigation
				measures</header><text>Before implementing a decision or agreement to
				construct, improve, operate, or maintain a facility that the Secretary
				determines is necessary to implement this part, the Secretary shall implement
				all mitigation measures identified in paragraph (1)(B) before the date on which
				Restoration Flows are
				commenced.</text>
								</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HEECEEC0BD56A4CA78382503820FC563D"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>the
			 Settlement</quote> and inserting <quote>this part</quote>;</text>
					</paragraph><paragraph id="HFC1D9F12B57B41699F63ECAEB12B226E"><enum>(6)</enum><text>in subsection (f),

				Reliability Act</short-title>, the Secretary shall issue, by regulation, a
				claims process to address claims, including groundwater seepage, flooding, or
				levee instability damages caused as a result of, arising out of, or related to
				implementation of this subtitle.</text>
								</paragraph><after-quoted-block>;

				other interests</header>
								<paragraph id="idD8EA230A547244C68248D8DEA7934293"><enum>(1)</enum><header>In
				general</header><text>No Central Valley Project or other water (other than San
				Joaquin River water impounded by or bypassed from Friant Dam) shall be used to
				implement subsection (a)(2) unless the use is on a voluntary basis.</text>
								</paragraph><paragraph id="id4D4DB9ECF34D40ABA67AD8F25E2E55F0"><enum>(2)</enum><header>Involuntary
				costs</header><text>No cost associated with the implementation of this section
				shall be imposed directly or indirectly on any Central Valley Project
				contractor, or any other person or entity, outside the Friant Division, the
				Hidden Unit, or the Buchanan Unit, unless the cost is incurred on a voluntary
				basis.</text>
								</paragraph><paragraph id="id558E5543555E4EAC9CB4F5394541C7E2"><enum>(3)</enum><header>Reduction in
				water supplies</header><text>The implementation of this part shall not directly
				or indirectly reduce any water supply or water reliability on any Central
				Valley Project contractor, any State Water Project contractor, or any other
				person or entity, outside the Friant Division, the Hidden Unit, or the Buchanan
				Unit, unless the reduction or cost is incurred on a voluntary basis.</text>
								</paragraph></subsection><subsection id="H8784DA94CE7C404693492C72763E441E"><enum>(l)</enum><header>Priority</header><text>Each
				action taken under this part shall be subordinate to the use by the Secretary
				of Central Valley Project facilities to make Project water available to Project
				contractors, other than water released from the Friant Dam under this
				part.</text>
							</subsection><subsection id="H0B35078EB3494A69873A19EB4BA1B224"><enum>(m)</enum><header>Applicability</header>
								<paragraph id="idE657D702509E4DB3BF54773656AACA89"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding section 8 of the Act of June 17, 1902 (32
				Stat. 390, chapter 1093), except as provided in this part and subtitle D of the
				<short-title>Sacramento and San Joaquin Valleys Water
				Reliability Act</short-title>, this part—</text>
									<subparagraph id="id46D3DE5829BC47D39EE4A1E3D86A1847"><enum>(A)</enum><text>preempts and
				supersedes any State law, regulation, or requirement that imposes more
				restrictive requirements or regulations on the activities authorized under this
				part; and</text>
									</subparagraph><subparagraph id="id8D8E45646919413F9D0D65B54600D3F6"><enum>(B)</enum><text>does not alter or
				modify any obligation of the Friant Division, Hidden Unit, and Buchanan Unit of
				the Central Valley Project, or other water users on the San Joaquin River, or
				tributaries of the San Joaquin River, under any order issued by the State Water
				Resources Control Board under the Porter-Cologne Water Quality Control Act
				(California Water Code section 13000 et seq.).</text>
									</subparagraph></paragraph><paragraph id="idB2BE4C82F8CE4B10944780182649E5CF"><enum>(2)</enum><header>Applicability</header><text>An
				order described in paragraph (1)(B) shall be consistent with any congressional
				authorization for any affected Federal facility relating to the Central Valley
				Project.</text>
								</paragraph></subsection><subsection id="HBF553D269E6447E0B11F5C53158BE631"><enum>(n)</enum><header>Project
				implementation</header><text>Any project to implement this part shall be phased
				such that each project shall include—</text>
								<paragraph id="H9D6A65A112174F6384D86ED6A14A5252"><enum>(1)</enum><text>the project
				purpose and need;</text>
								</paragraph><paragraph id="HDDDCC1A78E28499785D441CBC4701ABB"><enum>(2)</enum><text>identification of
				mitigation measures;</text>
								</paragraph><paragraph id="H3E0070B3E2F94D75963FF92B959324A9"><enum>(3)</enum><text>appropriate
				environmental review; and</text>
								</paragraph><paragraph id="H8C6B8FA133594628A0E458D56720AD3B"><enum>(4)</enum><text>prior to releasing
				Restoration Flows under this part the completion of the any required mitigation
				measures and the completion of the
				project.</text>
								</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
					</paragraph></section><section id="H80A4777D57B741D8821ACB810595455D"><enum>535.</enum><header>Disposal of

				<section id="HD6A0EC77A99D4855AC0F313CC8C889BA"><enum>551.</enum><header>Repayment
			 contracts and acceleration of repayment of construction costs</header>
					<subsection id="H17EDEF480FC5409BA724554B2FD614C6"><enum>(a)</enum><header>Conversion of
			 contracts</header>
						<paragraph id="H32DB125105664630B55B1D708A6F2062"><enum>(1)</enum><header>Certain
			 contracts</header>
							<subparagraph id="id54E2BEA530F241E2AABF27D195183DE5"><enum>(A)</enum><header>In
			 general</header><text>Not later than 1 year after the date enactment of this
			 Act, the Secretary of the Interior, on the request of a contractor, shall
			 convert all existing long-term Central Valley Project contracts entered into
			 under section 9(e) of the Act of August 4, 1939 (53 Stat. 1196, chapter 418),
			 to a contract under section 9(d) of that Act (53 Stat. 1195), under mutually
			 agreeable terms and conditions.</text>
							</subparagraph><subparagraph id="H943D93C309DD495DA91B8A0343CDBA40"><enum>(B)</enum><header>Restrictions</header><text>A
			 contract converted under subparagraph (A) shall—</text>
								<clause id="H056C36C170CB47D29939B787379D88CF"><enum>(i)</enum><text>require the
			 repayment, either in lump sum or by accelerated prepayment, of the remaining
			 amount of construction costs identified in the most current version of the
			 Central Valley Project Schedule of Irrigation Capital Allocations by
			 Contractor, as adjusted to reflect payments not reflected in that schedule and
			 properly assignable for ultimate return by the contractor, not later than
			 January 31, 2013 (or if made in approximately equal annual installments, not
			 later than January 31, 2016), which amount shall be discounted by the Treasury
			 rate (defined as the 20-year Constant Maturity Treasury rate published by the
			 Department of the Treasury as of October 1, 2012);</text>
								</clause><clause id="H9C7F8BA7609B4CC5AEB2A44D7F54341F"><enum>(ii)</enum><text>require that,
			 notwithstanding subsection (c)(2), construction costs or other capitalized
			 costs incurred after the effective date of the converted contract or not
			 reflected in the schedule described in clause (i) and properly assignable to
			 that contractor, shall be repaid—</text>
									<subclause id="id65010D4E69134B5396C48F70BAFC8E56"><enum>(I)</enum><text>in not more than
			 5 years after the date on which the contractor is notified of the allocation if
			 that amount is a result of a collective annual allocation of capital costs to
			 the contractors exercising contract conversions under this subsection of less
			 than $5,000,000; or</text>
									</subclause><subclause id="idA82E9F9AB5C144CEB4CDF9B1461D74E3"><enum>(II)</enum><text>if the
			 allocation of capital costs described in subclause (I) equal $5,000,000 or
			 more, as provided by applicable reclamation law, subject to the condition that
			 the reference to the amount of $5,000,000 shall not be a precedent in any other
			 context; and</text>
									</subclause></clause><clause id="HD6AD75D60C3F410F8A1273861E8D12C5"><enum>(iii)</enum><text>provide that
			 power revenues will not be available to aid in the repayment of construction
			 costs allocated to irrigation under the contract.</text>
								</clause></subparagraph><subparagraph id="idB9F4A45B8F1443A2A9059E49F1F94C63"><enum>(C)</enum><header>Estimate</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary of
			 the Interior shall provide to each contractor an estimate of the remaining
			 amount of construction costs under subparagraph (B)(i) as of January 31, 2013,
			 as adjusted.</text>
							</subparagraph></paragraph><paragraph id="HF8BD58BBB17D403999D5F4647C204408"><enum>(2)</enum><header>Other
			 contracts</header>
							<subparagraph id="id3A4F7535AD1B4110AE8A7C5A1D7A2D29"><enum>(A)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, on the request of a contractor, the Secretary may convert any Central
			 Valley Project long-term contract entered into under section 9(c)(2) of the Act
			 of August 4, 1939 (chapter 418; 53 Stat. 1194) to a contract under section
			 9(c)(1) of that Act, under mutually agreeable terms and conditions.</text>
							</subparagraph><subparagraph id="HD7DE90AFD53146C0A444B51539C52A46"><enum>(B)</enum><header>Restrictions</header><text>A
			 contract converted under subparagraph (A) shall—</text>
								<clause id="H14011211263D4E06958A02C7CBFDF3FF"><enum>(i)</enum><text>require the
			 repayment in lump sum of the remaining amount of construction costs identified
			 in the most current version of the Central Valley Project Schedule of Municipal
			 and Industrial Water Rates, as adjusted to reflect payments not reflected in
			 that schedule and properly assignable for ultimate return by the contractor,
			 not later than January 31, 2016; and</text>
								</clause><clause id="H01CACE76F56145639268C0C948B5062B"><enum>(ii)</enum><text>require that,
			 notwithstanding subsection (c)(2), construction costs or other capitalized
			 costs incurred after the effective date of the contract or not reflected in the
			 Schedule described in clause (i), and properly assignable to that contractor,
			 shall be repaid—</text>
									<subclause id="idA5587FEFA8694534A8679CBC30402375"><enum>(I)</enum><text>in not more than
			 5 years after the date on which the contractor is notified of the allocation if
			 the amount is a result of a collective annual allocation of capital costs to
			 the contractors exercising contract conversions under this subsection of less
			 than $5,000,000; or</text>
									</subclause><subclause id="id2006B48FEFB848E689F01571F7D06B41"><enum>(II)</enum><text>if the
			 allocation of capital costs described in subclause (I) equal $5,000,000 or
			 more, as provided by applicable reclamation law, subject to the condition that
			 the reference to the amount of $5,000,000 shall not be a precedent in any other
			 context.</text>
									</subclause></clause></subparagraph><subparagraph id="id947A7A06BF044322957D023493B0FECA"><enum>(C)</enum><header>Estimate</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary of
			 the Interior shall provide to each contractor an estimate of the remaining
			 amount of construction costs under subparagraph (B)(i) as of January 31, 2016,
			 as adjusted.</text>
							</subparagraph></paragraph></subsection><subsection id="H5B4967991C184504A8FB4E64F81240A3"><enum>(b)</enum><header>Final
			 adjustment</header>
						<paragraph id="idBB4AF8A89B15405A9B1F971E7FDACFFF"><enum>(1)</enum><header>In
			 general</header><text>The amounts paid pursuant to subsection (a) shall be
			 subject to adjustment following a final cost allocation by the Secretary of the
			 Interior on completion of the construction of the Central Valley
			 Project.</text>
						</paragraph><paragraph id="id78C22C3646CA4088A2E618CD72EEEE97"><enum>(2)</enum><header>Repayment
			 obligation</header>
							<subparagraph id="id06A707ABFD72466B85A80DC90BB88CF5"><enum>(A)</enum><header>In
			 general</header><text>If the final cost allocation indicates that the costs
			 properly assignable to the contractor are greater than the amount that has been
			 paid by the contractor, the contractor shall pay the remaining allocated
			 costs.</text>
							</subparagraph><subparagraph id="id3E4485E750C346448A183001FDB55A76"><enum>(B)</enum><header>Terms</header><text>The
			 term of an additional repayment contract described in subparagraph (A) shall
			 be—</text>
								<clause id="idE288F2CE1BC24829B3A1F6270AB7AEBD"><enum>(i)</enum><text>for
			 not less than 1 year and not more than 10 years; and</text>
								</clause><clause id="id0910EAB2BAD7495FAF007E2DA084795C"><enum>(ii)</enum><text>based on
			 mutually agreeable provisions regarding the rate of repayment of the amount
			 developed by the parties.</text>
								</clause></subparagraph></paragraph><paragraph id="idE4078158A15A4E8CA7FD2EAC425ED0FB"><enum>(3)</enum><header>Credits</header><text>If
			 the final cost allocation indicates that the costs properly assignable to the
			 contractor are less than the amount that the contractor has paid, the Secretary
			 of the Interior shall credit the amount of the overpayment as an offset against
			 any outstanding or future obligation of the contractor.</text>
						</paragraph></subsection><subsection id="HA8681014690D4B188DBEA8CD8AA69AD5"><enum>(c)</enum><header>Applicability of
			 certain provisions</header>
						<paragraph id="H4CF890B79E3148EBBFED32A72E8237E0"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any repayment obligation under subsection
			 (a)(1)(B)(ii) or subsection (b), on the compliance of a contractor with and
			 discharge of the obligation of repayment of the construction costs under that
			 subsection, the ownership and full-cost pricing limitations of any provision of
			 the reclamation laws shall not apply to land in that district.</text>
						</paragraph><paragraph id="HCC5C7B5EAEFE488E80B9692F1DA8B9BC"><enum>(2)</enum><header>Other
			 contracts</header><text>Notwithstanding any repayment obligation under
			 paragraph (1)(B)(ii) or (2)(B)(ii) of subsection (a) or subsection (b), on the
			 compliance of a contractor with and discharge of the obligation of repayment of
			 the construction costs under that subsection, the contractor shall continue to
			 pay applicable operation and maintenance costs and other charges applicable to
			 the repayment contracts pursuant to then-current rate-setting policy and
			 applicable law.</text>
						</paragraph></subsection><subsection id="H58390A5645824638A13A5F4EEC1AF72A"><enum>(d)</enum><header>Certain
			 repayment obligations not altered</header><text>This section does not—</text>
						<paragraph id="id24BE31CFA76F483FA96FBFCBF8B5E089"><enum>(1)</enum><text>alter the
			 repayment obligation of any other long-term water service or repayment
			 contractor receiving water from the Central Valley Project; or</text>
						</paragraph><paragraph id="idEE01A0BF01F247328A93F66359572DC8"><enum>(2)</enum><text>shift any costs
			 that would otherwise have been properly assignable to a contractor absent this
			 section, including operations and maintenance costs, construction costs, or
			 other capitalized costs incurred after the date of enactment of this Act, to
			 other contractors.</text>
						</paragraph></subsection><subsection id="H0EF7F8EB8A004F119C739BDBB9C25392"><enum>(e)</enum><header>Statutory
			 interpretation</header><text>Nothing in this subtitle affects the right of any
			 long-term contractor to use a particular type of financing to make the payments
			 required in paragraph (1)(B)(i) or (2)(B)(i) of subsection (a).</text>
					</subsection></section></subtitle><subtitle id="HAA76F620575F4404B13E72FF327094B0"><enum>D</enum><header>Bay-Delta
			 Watershed water rights preservation and protection</header>
				<section id="HA134745DBAC64BEF80CC37F785B28F54"><enum>561.</enum><header>Water rights
			 and area-of-origin protections</header><text display-inline="no-display-inline">Notwithstanding the provisions of this
			 title, Federal reclamation law, or the Endangered Species Act of 1973
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et
			 seq.</external-xref>)—</text>
					<paragraph id="HB9610FC6B157429C875F30C1E0DE989E"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of the Interior shall, in the
			 operation of the Central Valley Project—</text>
						<subparagraph id="idF449B2BD275741A18BC60DFDE0B161CA"><enum>(A)</enum><text display-inline="yes-display-inline">strictly adhere to State water rights law
			 governing water rights priorities by honoring water rights senior to those
			 belonging to the Central Valley Project, regardless of the source of priority;
			 and</text>
						</subparagraph><subparagraph id="HD086F9464E1D487AB323A5E0564127F4"><enum>(B)</enum><text>strictly adhere to
			 and honor water rights and other priorities that are obtained or exist pursuant
			 to the California Water Code, including sections 10505, 10505:5, 11128, 11460,
			 11463, and 12220; and</text>
						</subparagraph></paragraph><paragraph id="H90D7E09127874E7489A8C97AE7E9A0BA"><enum>(2)</enum><text display-inline="yes-display-inline">any action that affects the diversion of
			 water or involves the release of water from any Central Valley Project water
			 storage facility taken by the Secretary of the Interior or the Secretary of
			 Commerce to conserve, enhance, recover, or otherwise protect any species listed
			 under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) shall be
			 applied in a manner that is consistent with water right priorities established
			 by State law.</text>
					</paragraph></section><section id="H522788864C02472B87843A15A49F31F6"><enum>562.</enum><header>Sacramento
			 River settlement contracts</header>
					<subsection id="idF0D2ADE855B84137A9D9087A046D8137"><enum>(a)</enum><header>In
			 general</header><text>In carrying out the Endangered Species Act of 1973
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et
			 seq.</external-xref>) in the Bay-Delta and on the Sacramento River, the
			 Secretary of the Interior and the Secretary of Commerce shall apply any
			 limitations on the operation of the Central Valley Project or relating to the
			 formulation of any reasonable prudent alternative associated with the operation
			 of the Central Valley Project in a manner that strictly adheres to and applies
			 the water rights priorities for project water and base supply as provided in
			 the Sacramento River Settlement Contracts.</text>
					</subsection><subsection id="id50DA183F1B9B4FC09BF41CED2CC5C38A"><enum>(b)</enum><header>Applicability</header><text>Article
			 3(i) of the Sacramento River Settlement Contracts shall not be used by the
			 Secretary of the Interior or any other Federal agency head as means to provide
			 shortages that are different from those provided for in Article 5(a) of the
			 Sacramento River Settlement Contracts.</text>
					</subsection></section><section id="H08A51BD1BD5F440197848CB847B625D2"><enum>563.</enum><header>Sacramento
			 River Watershed water service contractors</header>
					<subsection id="HCF6FC98611B4440486ED6CD7D88CE553"><enum>(a)</enum><header>Existing Central
			 Valley Project agricultural water service contractors within Sacramento River
			 Watershed</header><text>In this section, the term <term>existing Central Valley
			 Project agricultural water service contractors within the Sacramento River
			 Watershed</term> means water service contractors within the Shasta, Trinity,
			 and Sacramento River Divisions of the Central Valley Project that have a water
			 service contract in effect on the date of enactment of this Act that provides
			 water for irrigation.</text>
					</subsection><subsection id="H5FC00E1EA94942B3AA1CB2D4BAF05421"><enum>(b)</enum><header>Allocation of
			 water</header><text>Subject to subsection (c) and the absolute priority of the
			 Sacramento River Settlement Contractors to Sacramento River supplies over
			 Central Valley Project diversions and deliveries to other contractors, the
			 Secretary of the Interior shall, in the operation of the Central Valley
			 Project, allocate water provided for irrigation purposes to existing Central
			 Valley Project agricultural water service contractors within the Sacramento
			 River Watershed as follows:</text>
						<paragraph id="H4DF2E7E5C2A84A45B41090C2C48FA07B"><enum>(1)</enum><text>Not less than 100
			 percent of the contract quantities in a <quote>Wet</quote> year (as that term
			 is defined in the Sacramento Valley Water Year Type (40–30–30) Index).</text>
						</paragraph><paragraph id="H3C4BEF69E8074DE887075E20FCECFCA7"><enum>(2)</enum><text>Not less than 100
			 percent of the contract quantities in an <quote>Above Normal</quote> year (as
			 that term is defined in the Sacramento Valley Water Year Type (40–30–30)
			 Index).</text>
						</paragraph><paragraph id="HC8681BD30B754AA5839325B1AD1EACE1"><enum>(3)</enum><text>Not less than 100
			 percent of the contract quantities in a <quote>Below Normal</quote> year (as
			 that term is defined in the Sacramento Valley Water Year Type (40–30–30)
			 Index).</text>
						</paragraph><paragraph id="H009F38B4DCB64F91B573234590E69A8A"><enum>(4)</enum><text>Not less than 75
			 percent of the contract quantities in a <quote>Dry</quote> year (as that term
			 is defined in the Sacramento Valley Water Year Type (40–30–30) Index).</text>
						</paragraph><paragraph id="H3F632EF121EF462D80ADC46EB217567B"><enum>(5)</enum><text>Not less than 50
			 percent of the contract quantities in a <quote>Critically Dry</quote> year (as
			 that term is defined in the Sacramento Valley Water Year Type (40–30–30)
			 Index).</text>
						</paragraph></subsection><subsection id="HA2D22CD597E340CA8DCF4A0496E6E1D7"><enum>(c)</enum><header>Protection of
			 municipal and industrial supplies</header>
						<paragraph id="idD176D8CB94BA48F4A5C9811C6770AE30"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this section—</text>
							<subparagraph id="idB587D87CB33740F38BFB02565CE507CB"><enum>(A)</enum><text>modifies any
			 provision of a water service contract that addresses municipal and industrial
			 water shortage policies of the Secretary of the Interior;</text>
							</subparagraph><subparagraph id="id34745CBBAA1E41B1857E5FDCC860E210"><enum>(B)</enum><text>affects or limits
			 the authority of the Secretary of the Interior—</text>
								<clause id="idC1F5016D0BB842CEB4FFBA40730BCDC9"><enum>(i)</enum><text>to
			 adopt or modify municipal and industrial water shortage policies; or</text>
								</clause><clause id="id17E5F3C6303747BDBCE7848A9201E865"><enum>(ii)</enum><text>to
			 implement municipal and industrial water shortage policies; or</text>
								</clause></subparagraph><subparagraph id="id9373F5D3B8964A8FBD7207C5CB256F6F"><enum>(C)</enum><text>affects
			 allocations to Central Valley Project municipal and industrial contractors
			 pursuant to the water shortage policies of the Secretary of the
			 Interior.</text>
							</subparagraph></paragraph><paragraph id="id2A052362E15440BD8EB485866B259D87"><enum>(2)</enum><header>Applicability</header><text>This
			 section does not constrain, govern, or affect, directly or indirectly, the
			 operations of the American River Division of the Central Valley Project or any
			 deliveries from that Division, including the units and facilities of that
			 Division.</text>
						</paragraph></subsection></section><section id="H93B071E7B54F43AC89F5D29A8AD0547A"><enum>564.</enum><header>No redirected
			 adverse impacts</header><text display-inline="no-display-inline">The Secretary
			 of the Interior shall ensure that there are no redirected adverse water supply
			 or fiscal impacts to the State Water Project or to individuals within the
			 Sacramento River or San Joaquin River watershed arising from the operation of
			 the Secretary of the Central Valley Project to meet legal obligations imposed
			 by or through any Federal or State agency, including—</text>
					<paragraph id="idA69BB79659634E09A62216DCB060E3B5"><enum>(1)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et
			 seq.</external-xref>);</text>
					</paragraph><paragraph id="idDCB933C51C58416D8FF5FB57ED3DFE22"><enum>(2)</enum><text display-inline="yes-display-inline">this title; and</text>
					</paragraph><paragraph id="idA84C15065A3542FEA2703A8EFE823610"><enum>(3)</enum><text display-inline="yes-display-inline">actions or activities implemented to meet
			 the twin goals of improving water supply and addressing the environmental needs
			 of the Bay-Delta.</text>
					</paragraph></section></subtitle><subtitle id="H6410599C809F4C33BFC6F4F88F74BA2B"><enum>E</enum><header>Miscellaneous</header>
				<section id="HF8EFA2974BE14260BB3DD97BC689D475"><enum>571.</enum><header>Precedent</header><text display-inline="no-display-inline">Congress finds that—</text>
					<paragraph id="H34211F02567948F884CA6571B27CCC23"><enum>(1)</enum><text>coordinated
			 operations between the Central Valley Project and the State Water Project, as
			 consented to and requested by the State of California and the Federal
			 Government, require the assertion of Federal supremacy to protect existing
			 water rights throughout the system, a circumstance that is unique to the State
			 of California; and</text>
					</paragraph><paragraph id="idD96EA5E05600446EBA546271D1E8701E"><enum>(2)</enum><text>this title should
			 not serve as precedent for similar operations in any other State.</text>
					</paragraph></section></subtitle></title><title id="id369F0767022649F68050832D9F55CF6A"><enum>VI</enum><header>Reducing
			 regulatory burdens</header>

			</section><section id="HC5F1E60820F144FABE5143A294C315B0"><enum>602.</enum><header>Use of
			 authorized pesticides</header><text display-inline="no-display-inline">Section
			 3(f) of the Federal Insecticide, Fungicide, and Rodenticide Act (7 U.S.C.
			 136a(f)) is amended by adding at the end the following:</text>

				as provided in section 402(s) of the Federal Water Pollution Control Act (33
				U.S.C. 1342(s)), the Administrator or a State may not require a permit under
				that Act for a discharge from a point source into navigable waters of a
				pesticide authorized for sale, distribution, or use under this Act, or the
				residue of the pesticide, resulting from the application of the
				pesticide.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H64C452B9ABA74D418D2F8FB8183E19AC"><enum>603.</enum><header>Discharges of
			 pesticides</header><text display-inline="no-display-inline">Section 402 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1342) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H320D99D65F744971B7DBFE3AE9A20723" style="OLC">
					<subsection id="HC86E024F90784A89B3F354AD179A9528"><enum>(s)</enum><header>Discharges of
				pesticides</header>
						<paragraph id="HFC77B4BFA35C43EA81A99DC0E37625E9"><enum>(1)</enum><header>No permit
				requirement</header><text display-inline="yes-display-inline">Except as
				provided in paragraph (2), a permit shall not be required by the Administrator
				or a State under this Act for a discharge from a point source into navigable
				waters of a pesticide authorized for sale, distribution, or use under the
				Federal Insecticide, Fungicide, and Rodenticide Act (7 U.S.C. 136 et seq.), or
				the residue of the pesticide, resulting from the application of the
				pesticide.</text>
						</paragraph><paragraph id="H8FC2A1EA386E42DCB0E68BA39E557A60"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
				(1) shall not apply to the following discharges of a pesticide or pesticide
				residue:</text>
							<subparagraph id="HE59CB086556A4E9B8B70A56A710B5872"><enum>(A)</enum><text display-inline="yes-display-inline">A discharge resulting from the application
				of a pesticide in violation of a provision of the Federal Insecticide,
				Fungicide, and Rodenticide Act (7 U.S.C. 136 et seq.) that is relevant to
				protecting water quality, if—</text>
								<clause id="H15807AF25672452BB17000D0EDBDBD82"><enum>(i)</enum><text display-inline="yes-display-inline">the discharge would not have occurred but
				for the violation; or</text>
								</clause><clause id="H09ABCF4F66F54068AD71240A792378D4"><enum>(ii)</enum><text display-inline="yes-display-inline">the quantity of a pesticide or pesticide
				residue in the discharge is greater than would have occurred without the
				violation.</text>
								</clause></subparagraph><subparagraph commented="no" id="HCA2066D774754695AC7D24DB9E9B9467"><enum>(B)</enum><text display-inline="yes-display-inline">Stormwater discharges subject to regulation
				under subsection (p).</text>
							</subparagraph><subparagraph commented="no" id="H11C811AF92D64AB6AAC7E74AF174837A"><enum>(C)</enum><text display-inline="yes-display-inline">The following discharges subject to
				regulation under this section:</text>
								<clause commented="no" id="H662EB3852DF14767B269FA6099EC340F"><enum>(i)</enum><text>Manufacturing or
				industrial effluent.</text>
								</clause><clause commented="no" id="H1A72A01C86CA477B9EDFE22760BBD8C8"><enum>(ii)</enum><text>Treatment works
				effluent.</text>
								</clause><clause commented="no" id="H1E113A9B5FFF4CBE9DED8C213C154BDD"><enum>(iii)</enum><text>Discharges
				incidental to the normal operation of a vessel, including a discharge resulting
				from ballasting operations or vessel biofouling
				prevention.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="id39F950FC383042C69C10FDA643DA5B74"><enum>VII</enum><header>Farm dust
			 regulation prevention</header>
			<section id="H7868670122F74F6F827213C761B84972" section-type="subsequent-section"><enum>701.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Farm Dust Regulation Prevention
			 Act of 2012</short-title></quote>.</text>
			</section><section display-inline="no-display-inline" id="H695E08FD223A4C4DB326315F4BFC45AC" section-type="subsequent-section"><enum>702.</enum><header>Temporary
			 prohibition against revising any national ambient air quality standard
			 applicable to coarse particulate matter</header><text display-inline="no-display-inline">Before the date that is 1 year after the
			 date of enactment of this Act, the Administrator of the Environmental
			 Protection Agency (referred to in this title as the <term>Administrator</term>)
			 may not propose, finalize, implement, or enforce any regulation revising the
			 national primary ambient air quality standard or the national secondary ambient
			 air quality standard applicable to particulate matter with an aerodynamic
			 diameter greater than 2.5 micrometers under section 109 of the Clean Air Act
			 (42 U.S.C. 7409).</text>
			</section><section id="H9CA27328A56148F2B7F92B94F99E29DF"><enum>703.</enum><header>Nuisance
			 dust</header><text display-inline="no-display-inline">Part A of title I of the
			 Clean Air Act (42 U.S.C. 7401 et seq.) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HCE1B83BA61C04E6D83A07BBCFCB1DF70" style="OLC">
					<section id="H647CA3C7E5404A6CA9E12231F7E6F91D"><enum>132.</enum><header>Regulation of
				nuisance dust primarily by State, tribal, and local governments</header>
						<subsection id="HA173892302844770B112FC485FE29D3C"><enum>(a)</enum><header>Definition of
				nuisance dust</header><text display-inline="yes-display-inline">In this
				section:</text>
							<paragraph id="idE39709DD9CAC4391977DFE9B5EA740E2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>nuisance dust</term> means particulate matter that—</text>
								<subparagraph id="HD92C4B8D9CA541F2B08D3965DC1DA426"><enum>(A)</enum><text>is generated
				primarily from natural sources, unpaved roads, agricultural activities, earth
				moving, or other activities typically conducted in rural areas;</text>
								</subparagraph><subparagraph id="H7CED16F3888640DC982F2E918721440F"><enum>(B)</enum><text>consists primarily
				of soil, other natural or biological materials, or some combination of those
				materials;</text>
								</subparagraph><subparagraph id="HAAB7D8258C75411EA8E5FFBAEDA700EB"><enum>(C)</enum><text>is not emitted
				directly into the ambient air from combustion, such as exhaust from combustion
				engines and emissions from stationary combustion processes; and</text>
								</subparagraph><subparagraph id="H1298FE0F4FEE4B34A44038101F8660D1"><enum>(D)</enum><text>is not comprised
				of residuals from the combustion of coal.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H18CF5D7358974CA4940B08794BEA702D"><enum>(2)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>nuisance dust</term> does
				not include radioactive particulate matter produced from uranium mining or
				processing.</text>
							</paragraph></subsection><subsection id="H448B2F495AF14591A4066937645063E3"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Except as provided in subsection (c), this
				Act does not apply to, and references in this Act to particulate matter are
				deemed to exclude, nuisance dust.</text>
						</subsection><subsection id="H2B0BE5C346D2424CABF4A7013D5B4A30"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">Subsection (a) does not apply with respect
				to any geographical area in which nuisance dust is not regulated under State,
				tribal, or local law insofar as the Administrator, in consultation with the
				Secretary of Agriculture, finds that—</text>
							<paragraph id="H7581EDE790564556BCF1ED9740619F6D"><enum>(1)</enum><text display-inline="yes-display-inline">nuisance dust (or any subcategory of
				nuisance dust) causes substantial adverse public health and welfare effects at
				ambient concentrations; and</text>
							</paragraph><paragraph id="H49984060767B45FC95FE4E21F808EA2D"><enum>(2)</enum><text display-inline="yes-display-inline">the benefits of applying standards and
				other requirements of this Act to nuisance dust (or a subcategory of nuisance
				dust) outweigh the costs (including local and regional economic and employment
				impacts) of applying those standards and other requirements to nuisance dust
				(or a
				subcategory).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H030B770BD4174AD1AE5BDB9EF9B7273A"><enum>704.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the Administrator should implement an approach to excluding
			 so-called <quote>exceptional events</quote>, or events that are not reasonably
			 controllable or preventable, from determinations of whether an area is in
			 compliance with any national ambient air quality standard applicable to coarse
			 particulate matter that—</text>
				<paragraph id="H1D4836BCA9EA4252B2B65B4D914644D0"><enum>(1)</enum><text>maximizes
			 transparency and predictability for States, Indian tribes, and local
			 governments; and</text>
				</paragraph><paragraph id="HAC00F12569AF45AA8CE46033C5A74351"><enum>(2)</enum><text>minimizes the
			 regulatory and cost burdens States, Indian tribes, and local governments bear
			 in excluding those events.</text>
				</paragraph></section><section id="H8A19DF2445E54B88898BEE70494C77C8"><enum>705.</enum><header>Impacts of EPA
			 regulatory activity on employment and economic activity in agriculture
			 community</header>
				<subsection id="H797B4EE447274BDA8828E7F8B2564FA7"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="H685668C3282E4DE28664B28F76CE1F45"><enum>(1)</enum><header>Covered
			 action</header><text>The term <term>covered action</term> means any of the
			 following actions taken by the Administrator under the Clean Air Act (42 U.S.C.
			 7401 et seq.) relating to agriculture and the national primary ambient air
			 quality standard or the national secondary ambient air quality standard for
			 particulate matter:</text>
						<subparagraph id="H0DFDC75A1990487DA336D8A61B1F75B6"><enum>(A)</enum><text>Promulgating or
			 issuing a regulation, policy statement, guidance, response to a petition, or
			 other requirement.</text>
						</subparagraph><subparagraph id="HEA83372A2B33443BA12A34087003BAB4"><enum>(B)</enum><text>Implementing a new
			 or substantially altered program.</text>
						</subparagraph></paragraph><paragraph id="HA808ECE7C5C741C996FC07C749B4F5AD"><enum>(2)</enum><header>More than a de
			 minimis negative impact</header><text>The term <term>more than a de minimis
			 negative impact</term> means—</text>
						<subparagraph id="H5DA123904DDC41678435DA9543296EDC"><enum>(A)</enum><text>with respect to
			 employment levels, a loss of more than 100 jobs relating to the agriculture
			 industry, as calculated by excluding consideration of any offsetting job gains
			 that result from the hypothetical creation of new jobs through new technologies
			 or government employment; and</text>
						</subparagraph><subparagraph id="H64B2ECECCC0F487C83160BE24BEC741D"><enum>(B)</enum><text>with respect to
			 economic activity, a decrease in agricultural economic activity of more than
			 $1,000,000 over any calendar year, as calculated by excluding consideration of
			 any offsetting economic activity that results from the hypothetical creation of
			 new economic activity through new technologies or government employment.</text>
						</subparagraph></paragraph></subsection><subsection id="HBFC74888533D40D6BEDC24E41EE1BDD5"><enum>(b)</enum><header>Analysis of
			 impacts of actions on employment and economic activity in the agriculture
			 community</header>
					<paragraph id="HF2F3D3165E4348CD82457B022B652FCE"><enum>(1)</enum><header>Analysis</header><text display-inline="yes-display-inline">Before taking a covered action, the
			 Administrator shall analyze the impact, disaggregated by State, of the covered
			 action on—</text>
						<subparagraph id="H7F7CEC062DFC4DFEAC62637104FE8F40"><enum>(A)</enum><text>employment levels
			 in the agriculture industry; and</text>
						</subparagraph><subparagraph id="HABC5F76CFA9E4938B725AF3C381B94B2"><enum>(B)</enum><text>agricultural
			 economic activity, including estimated job losses and decreased economic
			 activity relating to agriculture.</text>
						</subparagraph></paragraph><paragraph id="HB4001FF67D7947B5AD3EE4DB54CFCCF9"><enum>(2)</enum><header>Economic
			 models</header>
						<subparagraph id="H60BFFAB1DB8C4CFCB9D5D1A143CA36F1"><enum>(A)</enum><header>In
			 general</header><text>In carrying out paragraph (1), the Administrator shall
			 use the best available economic models.</text>
						</subparagraph><subparagraph id="H1AEA60E0404743BA84C0158324E848DE"><enum>(B)</enum><header>Annual GAO
			 report</header><text>Not later than December 31 of each year, the Comptroller
			 General of the United States shall submit to Congress a report on the economic
			 models used by the Administrator to carry out this subsection.</text>
						</subparagraph></paragraph><paragraph id="H7E9BB39B13314E02922CF618AABA97F7"><enum>(3)</enum><header>Availability of
			 information</header><text>With respect to any covered action, the Administrator
			 shall—</text>
						<subparagraph id="H6F9973C4FC3247C4B6CB84744DF4851B"><enum>(A)</enum><text>post the analysis
			 under paragraph (1) as a link on the main page of the public Internet website
			 of the Environmental Protection Agency;</text>
						</subparagraph><subparagraph id="HD5FB78272D9B4454AC335BA56501A8B7"><enum>(B)</enum><text>request the
			 Secretary of Agriculture to post the analysis under paragraph (1) as a link on
			 the main page of the public Internet website of the Department of Agriculture;
			 and</text>
						</subparagraph><subparagraph id="HCD7B6E5D700946E7BA19992CE2B24A01"><enum>(C)</enum><text>request that the
			 Governor of any State experiencing more than a de minimis negative impact post
			 the analysis on the main page of the public Interest website of the
			 State.</text>
						</subparagraph></paragraph></subsection><subsection id="H86AA5FA326FD415A881C91607A677BEE"><enum>(c)</enum><header>Public
			 hearings</header>
					<paragraph id="H6896A5524D334603932900197858C84B"><enum>(1)</enum><header>In
			 general</header><text>If the Administrator concludes under subsection (a)(1)
			 that a covered action will have more than a de minimis negative impact on
			 agricultural employment levels or agricultural economic activity in a State,
			 the Administrator shall hold a public hearing in each such State at least 30
			 days before the effective date of the covered action.</text>
					</paragraph><paragraph id="H737014EA2E324403B9AF76823E38349A"><enum>(2)</enum><header>Time, location,
			 and selection</header><text>A public hearing required under paragraph (1) shall
			 be held at—</text>
						<subparagraph id="id8A9709A373D54DDEA06E86F99A8A8682"><enum>(A)</enum><text>a convenient time
			 and location for impacted residents; and</text>
						</subparagraph><subparagraph id="id7B6C834493FC4D0EA958C5FA51091CC4"><enum>(B)</enum><text>at such location
			 selected by the Administrator as shall give priority to locations in the State
			 that will experience the greatest number of job losses.</text>
						</subparagraph></paragraph></subsection><subsection id="H1C911C9F4C1E46DF85E56F552BCCEE4E"><enum>(d)</enum><header>Notification</header><text>If
			 the Administrator concludes under subsection (b)(1) that a covered action will
			 have more than a de minimis negative impact on agricultural employment levels
			 or agricultural economic activity in any State, the Administrator shall give
			 notice of the impact to the congressional delegation, Governor, and legislature
			 of the State at least 45 days before the effective date of the covered
			 action.</text>
				</subsection></section></title><title id="id4815876EF0FB4335A309D1B93AA12113"><enum>VIII</enum><header>Energy tax
			 prevention</header>
			<section id="id62BF85D6128D48D98C5F5AB683A9D186" section-type="subsequent-section"><enum>801.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Energy Tax Prevention Act of
			 2012</short-title></quote>.</text>
			</section><section id="ID0fa2f149f89446389a7f0495b920a1be"><enum>802.</enum><header>No regulation
			 of emissions of greenhouse gases</header><text display-inline="no-display-inline">Title III of the Clean Air Act (42 U.S.C.
			 7601 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id06C1A2F9D37346748FE26CB4353C3537" style="OLC">
					<section id="ID14ffa4f6ab564f45b2d2dbe16ab42139"><enum>330.</enum><header>No regulation
				of emissions of greenhouse gases</header>
						<subsection id="IDdfab7e2f4a6646a68b4086a3133ec0c5"><enum>(a)</enum><header>Definition</header><text>In
				this section, the term <term>greenhouse gas</term> means any of the
				following:</text>
							<paragraph id="IDc05ff74aa1544920896f2c5012bb8d6e"><enum>(1)</enum><text>Water
				vapor.</text>
							</paragraph><paragraph id="ID5648532e20c2476a8b20dda34fa1bd66"><enum>(2)</enum><text>Carbon
				dioxide.</text>
							</paragraph><paragraph id="ID36593c179a9640c3a18aae4de96da519"><enum>(3)</enum><text>Methane.</text>
							</paragraph><paragraph id="IDb0258488722b46d6842870433901d001"><enum>(4)</enum><text>Nitrous
				oxide.</text>
							</paragraph><paragraph id="ID2a86afd2ee4544dfbdf3169b7f96a3c7"><enum>(5)</enum><text>Sulfur
				hexafluoride.</text>
							</paragraph><paragraph id="IDddaed2cd447e4d93a41090c0ab9d1846"><enum>(6)</enum><text>Hydrofluorocarbons.</text>
							</paragraph><paragraph id="ID9e44ad56c10a47f8a44aab04f4d22682"><enum>(7)</enum><text>Perfluorocarbons.</text>
							</paragraph><paragraph id="ID86c3a1b8b5c94c8ebdbbf2c27e2691b2"><enum>(8)</enum><text>Any other
				substance subject to, or proposed to be subject to, regulation, action, or
				consideration under this Act to address climate change.</text>
							</paragraph></subsection><subsection id="IDa1f5e78fb8ee4cc2997acfdc736b02da"><enum>(b)</enum><header>Limitation on
				agency action</header>
							<paragraph id="IDbffff63cc5194d6ca4045979ac169875"><enum>(1)</enum><header>Limitation</header>
								<subparagraph id="IDe081b21cf338468b80a27549f96af817"><enum>(A)</enum><header>In
				general</header><text>The Administrator may not, under this Act, promulgate any
				regulation concerning, take action relating to, or take into consideration the
				emission of a greenhouse gas to address climate change.</text>
								</subparagraph><subparagraph id="IDe94a717f09694ddb985eb1313061141a"><enum>(B)</enum><header>Air pollutant
				definition</header><text>The definition of the term <term>air pollutant</term>
				in section 302(g) does not include a greenhouse gas. Notwithstanding the
				previous sentence, such definition may include a greenhouse gas for purposes of
				addressing concerns other than climate change.</text>
								</subparagraph></paragraph><paragraph id="ID05d240021f2248a79b4bcdb7fb45aa0e"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
				(1) does not prohibit the following:</text>
								<subparagraph id="ID367a9596057f4044b6b815069475f5f3"><enum>(A)</enum><text>Notwithstanding
				paragraph (4)(B), implementation and enforcement of the rule entitled
				<quote>Light-Duty Vehicle Greenhouse Gas Emission Standards and Corporate
				Average Fuel Economy Standards</quote> (75 Fed. Reg. 25324 (May 7, 2010) and
				without further revision) and finalization, implementation, enforcement, and
				revision of the proposed rule entitled <quote>Greenhouse Gas Emissions
				Standards and Fuel Efficiency Standards for Medium- and Heavy-Duty Engines and
				Vehicles</quote> published at 75 Fed. Reg. 74152 (November 30, 2010).</text>
								</subparagraph><subparagraph id="ID128539d966d24dc9a24d41b45f1bfc25"><enum>(B)</enum><text>Implementation
				and enforcement of section 211(o).</text>
								</subparagraph><subparagraph id="IDeb863926d952495eb4b7535f396af0a0"><enum>(C)</enum><text>Statutorily
				authorized Federal research, development, and demonstration programs addressing
				climate change.</text>
								</subparagraph><subparagraph id="ID3954648b1fab4cf69a4f666830421448"><enum>(D)</enum><text>Implementation
				and enforcement of title VI to the extent such implementation or enforcement
				only involves one or more class I or class II substances (as such terms are
				defined in section 601).</text>
								</subparagraph><subparagraph id="ID26ba97f1c43043778c818ddb35be6833"><enum>(E)</enum><text>Implementation
				and enforcement of section 821 (42 U.S.C. 7651k note) of Public Law 101–549
				(commonly referred to as the <quote>Clean Air Act Amendments of
				1990</quote>).</text>
								</subparagraph></paragraph><paragraph id="ID9a048ea87fa641cf911d239f582a9185"><enum>(3)</enum><header>Inapplicability
				of provisions</header><text>Nothing listed in paragraph (2) shall cause a
				greenhouse gas to be subject to part C of title I (relating to prevention of
				significant deterioration of air quality) or considered an air pollutant for
				purposes of title V (relating to air permits).</text>
							</paragraph><paragraph id="IDaaf27840ad6b47e58827f2c96b6a01d0"><enum>(4)</enum><header>Certain prior
				agency actions</header><text>The following rules, and actions (including any
				supplement or revision to such rules and actions) are repealed and shall have
				no legal effect:</text>
								<subparagraph id="id9856FD876DCC4819BA09BA283B71AF0F"><enum>(A)</enum><text><quote>Mandatory
				Reporting of Greenhouse Gases</quote>, published at 74 Fed. Reg. 56260 (October
				30, 2009).</text>
								</subparagraph><subparagraph id="IDdf4d4ef0b50443c288320b659dc88fe8"><enum>(B)</enum><text><quote>Endangerment
				and Cause or Contribute Findings for Greenhouse Gases under section 202(a) of
				the Clean Air Act</quote> published at 74 Fed. Reg. 66496 (Dec. 15,
				2009).</text>
								</subparagraph><subparagraph id="ID6b28a90427d34945a72b8a4a5321ef08"><enum>(C)</enum><text><quote>Reconsideration
				of the Interpretation of Regulations That Determine Pollutants Covered by Clean
				Air Act Permitting Programs</quote> published at 75 Fed. Reg. 17004 (April 2,
				2010) and the memorandum from Stephen L. Johnson, Environmental Protection

								</subparagraph></paragraph><paragraph id="IDf48b0a8e87354de59f5c975e5333367c"><enum>(5)</enum><header>State
				action</header>
								<subparagraph id="IDd71f08fb57a341e8b5d9cb9fcaa86c95"><enum>(A)</enum><header>No
				limitation</header><text>This section does not limit or otherwise affect the
				authority of a State to adopt, amend, enforce, or repeal State laws and
				regulations pertaining to the emission of a greenhouse gas.</text>
								</subparagraph><subparagraph id="IDaf17e5bbc5de4875960b3f56001cc068"><enum>(B)</enum><header>Exception</header>
									<clause id="IDf7abec6340a74dcbbc638f0c759e9719"><enum>(i)</enum><header>Rule</header><text>Notwithstanding
				subparagraph (A), any provision described in clause (ii)—</text>
										<subclause id="ID55287a2535b043b68e7d4408fbb0d513"><enum>(I)</enum><text>is not federally
				enforceable;</text>
										</subclause><subclause id="ID05498fb9d87d4069af9eda69c8e5c9d4"><enum>(II)</enum><text>is not deemed to
				be a part of Federal law; and</text>
										</subclause><subclause id="ID7af48a61cbcd44fe85373925d9a69c13"><enum>(III)</enum><text>is deemed to be
				stricken from the plan described in clause (ii)(I) or the program or permit
				described in clause (ii)(II), as applicable.</text>
										</subclause></clause><clause id="ID339d4b72718845abb21926496cc331ad"><enum>(ii)</enum><header>Provisions
				defined</header><text>For purposes of clause (i), the term
				<term>provision</term> means any provision that—</text>
										<subclause id="ID6819cca0e56042d18432d8977fead6b3"><enum>(I)</enum><text>is contained in a
				State implementation plan under section 110 and authorizes or requires a
				limitation on, or imposes a permit requirement for, the emission of a
				greenhouse gas to address climate change; or</text>
										</subclause><subclause id="IDc5b8531832474292bffc2c5fe83bd66a"><enum>(II)</enum><text>is part of an
				operating permit program under title V, or a permit issued pursuant to title V,
				and authorizes or requires a limitation on the emission of a greenhouse gas to
				address climate change.</text>
										</subclause></clause></subparagraph><subparagraph id="ID6124d784861242b5ade03793185215e1"><enum>(C)</enum><header>Action by
				Administrator</header><text>The Administrator may not approve or make federally
				enforceable any provision described in subparagraph
				(B)(ii).</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDe4c90a0387624432aab93754abc39b33"><enum>803.</enum><header>Preserving one
			 national standard for automobiles</header><text display-inline="no-display-inline">Section 209(b) of the Clean Air Act (42
			 U.S.C. 7543) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0E04828803224B5CAA333EAE2F0502C8" style="OLC">
					<paragraph id="IDacd92a141aad4787b5ca8cff60299b01"><enum>(4)</enum><text>With respect to
				standards for emissions of greenhouse gases (as defined in section 330) for
				model year 2017 or any subsequent model year for new motor vehicles and new
				motor vehicle engines—</text>
						<subparagraph id="IDbad4fab605b447a7ac44876c63b68a7b"><enum>(A)</enum><text>the Administrator
				may not waive application of subsection (a); and</text>
						</subparagraph><subparagraph id="IDea28df0b711b463e92ec824f3724c0fb"><enum>(B)</enum><text>no waiver granted
				prior to the date of enactment of this paragraph may be considered to waive the
				application of subsection
				(a).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
