		<official-title>To preempt regulation of, action relating to, or
		  consideration of greenhouse gases under Federal and common law on enactment of
		  a Federal policy to mitigate climate change.</official-title>

		<section id="id9F5615509F644F8F882B6031532C11C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Defending America’s Affordable Energy
			 and Jobs Act</short-title></quote>.</text>
		</section><section id="id3D12067A4AC64135862854DDF5E1A244"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="id704C2936318341828E3A0804CA876AE1"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph id="ID120a940ea6894d7998cc4e725e90dc4c"><enum>(1)</enum><text>the climate of
			 the Earth is dynamic, and changes in climate are caused by a complex
			 combination of factors;</text>
				</paragraph><paragraph id="IDf11f444bbb0d4910af30e59780612e14"><enum>(2)</enum><text>greenhouse gases
			 are globally dispersed, and any attempt by a country to reduce the greenhouse
			 gas emissions of the country must be undertaken in coordination with the
			 international community, including the developing world, in order to have any
			 significant impact;</text>
				</paragraph><paragraph id="ID017236689d43412c96bbf5dc9b6e50e3"><enum>(3)</enum><text>regulating the
			 emission of greenhouse gases under Federal regulatory mechanisms in existence
			 as of the date of enactment of this Act is divorced from any intent expressed
			 by the Congress during the enactment of the authorizing statutes governing
			 those mechanisms;</text>
				</paragraph><paragraph id="ID3c00c96a538e4d0bbaec69af8f2e7970"><enum>(4)</enum><text>any action to
			 control emissions of greenhouse gases in the United States would result in
			 substantial impacts to major sectors of the economy of the United States and
			 interstate commerce and should therefore be explicitly authorized and
			 prescribed by Congress;</text>
				</paragraph><paragraph id="IDeee990da0ade4d8eb434d43a78c22ec3"><enum>(5)</enum><text>the consequences
			 of poorly designed Federal or State regulation of greenhouse gases—</text>
					<subparagraph id="idEA3C8A6FB8D4489E85FE8D15805E72CE"><enum>(A)</enum><text>are
			 well-documented; and</text>
					</subparagraph><subparagraph id="id033FC552E3064860859778C21FAE7CF7"><enum>(B)</enum><text>consist of lower
			 economic growth, reductions in new and existing employment, and reduced
			 economic competitiveness; and</text>
					</subparagraph></paragraph><paragraph id="IDcb951e92568049e0b1c44f9ace78376b"><enum>(6)</enum><text>substantial
			 policy options, short of regulatory authority, exist to spur technology
			 innovation to promote energy security and produce cleaner energy
			 sources.</text>
				</paragraph></subsection><subsection id="ID471e9a3197304affb43af72927ae6f0d"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="id8AF94A46C0B846D08BCEEB769767C037"><enum>(1)</enum><text>to ensure that
			 the consequences of ill-suited regulations are not imposed on the economy of
			 the United States; and</text>
				</paragraph><paragraph id="idF2CE5CAA7AE04F3982555B41D32E1959"><enum>(2)</enum><text>to allow
			 sufficient time for Congress to develop and authorize an appropriate mechanism
			 to address the energy needs of the United States and the potential global
			 challenges posed by a changing climate.</text>
				</paragraph></subsection></section><section id="id24F82B1EFBF4417DBB92CBF728F578D3" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id1336220A0FF94120ACE5D443F95AB574"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
			</paragraph><paragraph id="id69DD071B7EE94A02848AE51536D448AE"><enum>(2)</enum><header>Greenhouse
			 gas</header><text>The term <term>greenhouse gas</term> means any of the
			 following:</text>
				<subparagraph id="ID371cf0a5ffdd41b8917681a0fb6ff449"><enum>(A)</enum><text>Carbon
			 dioxide.</text>
				</subparagraph><subparagraph id="ID9c0d7cf029a84ff0a55a21b6c158de2d"><enum>(B)</enum><text>Methane.</text>
				</subparagraph><subparagraph id="ID84d8bc024dca476a93f80016d48ed2c7"><enum>(C)</enum><text>Nitrous
			 oxide.</text>
				</subparagraph><subparagraph id="ID1cd2ed9f23a34bf799a2c736f0cb3c42"><enum>(D)</enum><text>Sulfur
			 hexafluoride.</text>
				</subparagraph><subparagraph id="IDe3d6202d99b24d43bc8acf9a63f294f1"><enum>(E)</enum><text>Any
			 hydrofluorocarbon.</text>
				</subparagraph><subparagraph id="ID156ad5605d17453dad506b9b76956595"><enum>(F)</enum><text>Any
			 perfluorocarbon.</text>
				</subparagraph><subparagraph id="ID028213d31afa422f83d78441052a2a47"><enum>(G)</enum><text>Nitrogen
			 trifluoride.</text>
				</subparagraph><subparagraph id="ID942f9ec900f14beabbcc0d709b0be9ed"><enum>(H)</enum><text>Any other
			 substance subject to regulation, action, or consideration due to the
			 contribution of the substance to climate change.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4716E297685E4785ACD3710DA5D6416A"><enum>(3)</enum><header>Stationary
			 source</header><text>The term <term>stationary source</term> has the meaning
			 given the term in section 302 of the Clean Air Act (42 U.S.C. 7602).</text>
			</paragraph></section><section id="id524A463CF6A24138B26CF5CE18D45723" section-type="subsequent-section"><enum>4.</enum><header>Regulation of
			 greenhouse gases</header>
			<subsection id="IDb652bc9ca9b543638791131f48a5b2c4"><enum>(a)</enum><header>Regulation,
			 action, and consideration for effects other than climate change</header>
				<paragraph id="idD1F219316188414AA2923A574DD32E66"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the President or the
			 head of a Federal department or agency may not promulgate regulations providing
			 for the control of emissions of a greenhouse gas, enforce or implement any law
			 (including a regulation) enacted or promulgated as of the date of enactment of
			 this Act that provides for the control of emissions of a greenhouse gas, take
			 action relating to or take into consideration the climate effects of emissions
			 of a greenhouse gas, consider climate effects in implementing or enforcing any
			 law (including a regulation), or condition or deny any approval based on
			 climate effects unless the law, regulation, action, or consideration is—</text>
					<subparagraph id="idC8F5CF7BFA3947CC9F4F27F966F65433"><enum>(A)</enum><text>determined by the
			 President or head of a Federal department or agency, as applicable, after
			 notice and opportunity for comment, to be necessary to protect the public
			 health from imminent and substantial harm caused by direct human exposure to
			 the relevant greenhouse gas in a concentration that is substantially greater
			 than current and projected future average concentrations of that greenhouse gas
			 in the global atmosphere; and</text>
					</subparagraph><subparagraph id="id46636001EC82425EBB728DCC9F3B86A4"><enum>(B)</enum><text>based solely on
			 effects other than effects relating to atmospheric concentrations of greenhouse
			 gases, including climate change.</text>
					</subparagraph></paragraph><paragraph id="ID3af73f59fa56462cafabb8cd51308e54"><enum>(2)</enum><header>Exception</header><text>The
			 limitation under paragraph (1) does not prohibit—</text>
					<subparagraph id="idF535B12D28A34696960D504DC6262995"><enum>(A)</enum><text>regulation of,
			 action with respect to, or consideration of a greenhouse gas under title VI of
			 the Clean Air Act (42 U.S.C. 7671 et seq.) other than for the potential or
			 actual effect of the greenhouse gas on climate change; or</text>
					</subparagraph><subparagraph id="id22DE9C3FF1D8445089183A819ACA648E"><enum>(B)</enum><text>voluntary
			 incentive programs to promote the development or deployment of technologies
			 that reduce greenhouse gas emissions.</text>
					</subparagraph></paragraph><paragraph id="ID1152e918e9ef4d4d8a12382ee9a1eb98"><enum>(3)</enum><header>Exclusive
			 authority; CAFE regulations; challenges to rules</header>
					<subparagraph id="id0CE3E8DDABB14A8DA416CC7BC628BD82"><enum>(A)</enum><header>Exclusive
			 authority</header><text>The authority of the Secretary of Transportation under
			 chapter 329 of title 49, United States Code—</text>
						<clause id="idDE16001E846143B79DB5EE7C3E40DA45"><enum>(i)</enum><text>does not include
			 any authority with respect to greenhouse gases; and</text>
						</clause><clause id="idFF694E7F2F88463AA268FAA62C67BB6F"><enum>(ii)</enum><text>is
			 unaffected by this section.</text>
						</clause></subparagraph><subparagraph id="id80C2B5A5F4794D73BE22953B046433FB"><enum>(B)</enum><header>CAFE
			 regulations</header><text>Notwithstanding any provision to the contrary in this
			 Act, the requirements set forth in the final rule entitled <quote>Light-Duty
			 Vehicle Greenhouse Gas Emission Standards and Corporate Average Fuel Economy
			 Standards; Final Rule</quote> (75 Fed. Reg. 25324 (May 7, 2010)), shall remain
			 in effect without further modification or revision.</text>
					</subparagraph><subparagraph id="id053912B5582541B0AE91CF493B102126"><enum>(C)</enum><header>Challenges to
			 rules</header><text>Nothing in this subsection affects—</text>
						<clause id="id704190757ACE4826A35437C46CE9AFBC"><enum>(i)</enum><text>any
			 challenge to the final rule described in subparagraph (B) that—</text>
							<subclause id="id41DDE9BCC7ED4784A6F554B1F6A7DB42"><enum>(I)</enum><text>as of the date of
			 enactment of this Act, is pending in court; or</text>
							</subclause><subclause id="idF5B0468CF7924FF4B484D0A490570D0B"><enum>(II)</enum><text>is filed after
			 that date of enactment; or</text>
							</subclause></clause><clause id="idB98775325B574136B94118CE88CD7EFA"><enum>(ii)</enum><text>any pending or
			 future challenge to any current or future rules promulgated under the authority
			 referred to in subparagraph (A).</text>
						</clause></subparagraph></paragraph><paragraph id="ID5fee0fc360c04c6ea924aad99ad6194e"><enum>(4)</enum><header>Certain prior
			 agency actions</header>
					<subparagraph id="id061B464ABAF04EDDB8216D2B2B19A223"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in paragraph (3), each rule
			 promulgated and action taken by the Administrator before the date of enactment
			 of this Act to regulate greenhouse gases for effects relating to atmospheric
			 concentrations of greenhouse gases (including climate change), including each
			 rule and action referred to in subparagraph (B), shall have no force or
			 effect.</text>
					</subparagraph><subparagraph id="id74A5878A28F0446CADEFFA28700AD6C9"><enum>(B)</enum><header>Rules and
			 actions</header><text>The rules and actions referred to in subparagraph (A)
			 include—</text>
						<clause id="IDdf4d4ef0b50443c288320b659dc88fe8"><enum>(i)</enum><text>the
			 final rule entitled <quote>Endangerment and Cause or Contribute Findings for
			 Greenhouse Gases under section 202(a) of the Clean Air Act</quote> (74 Fed.
			 Reg. 66496 (Dec. 15, 2009));</text>
						</clause><clause id="ID6b28a90427d34945a72b8a4a5321ef08"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4212AA5C11D4488594A2885FC446BF14"><enum>(I)</enum><text>the memorandum from
			 Stephen Johnson, Administrator of the Environmental Protection Agency, to
			 Regional Administrators of the Environmental Protection Agency, with the
			 subject line stating <quote>EPA’s Interpretation of Regulations that Determine
			 Pollutants Covered by Federal Prevention of Significant Deterioration (PSD)
			 Permit Program</quote> and dated Dec. 18, 2008; and</text>
							</subclause><subclause id="idA066E7F582094C8FA62DE8CA6AE493A3" indent="up1"><enum>(II)</enum><text>the final action on reconsideration of
			 that memorandum entitled <quote>Reconsideration of the Interpretation of
			 Regulations That Determine Pollutants Covered by Clean Air Act Permitting
			 Programs</quote> (75 Fed. Reg. 17004 (April 2, 2010));</text>
							</subclause></clause><clause id="ID1ad34c8bbb914d3aa7c7d221ce17db56"><enum>(iii)</enum><text>the final rule
			 entitled <quote>Prevention of Significant Deterioration and Title V Greenhouse
			 Gas Tailoring Rule</quote> (75 Fed. Reg. 31514 (June 3, 2010));</text>
						</clause><clause id="ID9f97f6a1488b479fa593c7296e0ef205"><enum>(iv)</enum><text>the final rule
			 entitled <quote>Action To Ensure Authority To Issue Permits Under the
			 Prevention of Significant Deterioration Program to Sources of Greenhouse Gas
			 Emissions: Finding of Substantial Inadequacy and SIP Call</quote> (75 Fed. Reg.
			 77698 (December 13, 2010));</text>
						</clause><clause id="ID1d918bf661f341ebbeaf4d0ab3b0a7c0"><enum>(v)</enum><text>the
			 final rule entitled <quote>Action To Ensure Authority To Issue Permits Under
			 the Prevention of Significant Deterioration Program to Sources of Greenhouse
			 Gas Emissions: Federal Implementation Plan</quote> (75 Fed. Reg. 82246

			 Deterioration Provisions Concerning Greenhouse Gas Emitting-Sources in State
			 Implementation Plans; Final Rule</quote> (75 Fed. Reg. 82536 (December 30,
			 2010));</text>
						</clause><clause id="IDe764acdd0627470f856482e1de2bc95c"><enum>(viii)</enum><text>the final rule
			 entitled <quote>Action To Ensure Authority To Implement Title V Permitting
			 Programs Under the Greenhouse Gas Tailoring Rule</quote> (75 Fed. Reg. 82254
			 (December 30, 2010));</text>
						</clause><clause id="ID9216b80f853e4c86a73cee06515b74d5"><enum>(ix)</enum><text>the final rule
			 entitled <quote>Action to Ensure Authority to Issue Permits Under the
			 Prevention of Significant Deterioration Program to Sources of Greenhouse Gas
			 Emissions: Finding of Failure to Submit State Implementation Plan Revisions
			 Required for Greenhouse Gases</quote> (75 Fed. Reg. 81874 (December 30,
			 2010));</text>
						</clause><clause id="ID28039d29ff4b47d6a674222acedffdea"><enum>(x)</enum><text>the
			 final rule entitled <quote>Determinations Concerning Need for Error Correction,
			 Partial Approval and Partial Disapproval, and Federal Implementation Plan
			 Regarding Texas Prevention of Significant Deterioration Program</quote> (75
			 Fed. Reg. 82365 (December 30, 2010));</text>
						</clause><clause id="ID3f12bad83f234acb92fe9bd700e54cdb"><enum>(xi)</enum><text>any final rule
			 providing for a waiver under section 209 of the Clean Air Act (42 U.S.C. 7543)
			 with respect to greenhouse gases or establishing any other requirements with
			 respect to greenhouse gases pursuant to section 177 of that Act (42 U.S.C.
			 7507);</text>
						</clause><clause id="ID3b09ee826e06428699350f2a3cc0d4e7"><enum>(xii)</enum><text>the final rule
			 entitled <quote>Mandatory Reporting of Greenhouse Gases</quote> (74 Fed. Reg.
			 56260 (October 30, 2009)) and the definition of the term <term>emissions
			 data</term> in section 2.301 of title 40, Code of Federal Regulations (or a
			 successor regulation);</text>
						</clause><clause id="IDda1ae0b2a68c419fb60d0475ab8d438b"><enum>(xiii)</enum><text>any final
			 action taken by the Administrator with respect to State implementation plans,
			 Federal implementation plans, and policy guidance regarding construction or
			 operating permits or permit requirements for stationary sources emitting
			 greenhouse gases that is issued or taken before, on, or after the date of
			 enactment of this Act; and</text>
						</clause><clause id="ID8ba932ebf5e14e6290a297735a9ab2de"><enum>(xiv)</enum><text>any guidance,
			 regulations, interpretive regulations, or policy regarding the emissions of
			 greenhouse gases or climate change impacts of greenhouse gases promulgated or
			 issued by the Administrator under any Federal law (including a
			 regulation).</text>
						</clause></subparagraph></paragraph><paragraph id="id8E33BE241ED84505AFD677D88051F38A"><enum>(5)</enum><header>Regulation
			 under other provisions</header>
					<subparagraph id="id5872D280680F4DA881DDF405F9DF6241"><enum>(A)</enum><header>In
			 general</header><text>Neither the regulation referred to in paragraph (3)(B)
			 nor any other provision of law (including a regulation) or action relating to
			 greenhouse gases shall—</text>
						<clause id="idF7C96DE5CEAC4237885D7AD2ED7DD5C1"><enum>(i)</enum><text>have any impact
			 on the regulation of stationary sources under title I of the Clean Air Act (42
			 U.S.C. 7401 et seq.); or</text>
						</clause><clause id="id0C5A5DD4B5C445EB881C682444BFF4E1"><enum>(ii)</enum><text>be
			 considered to be the regulation of pollutants under that Act (42 U.S.C. 7401 et
			 seq.) for any purpose (other than for the regulation of greenhouse gas
			 emissions for light-duty motor vehicles from model years 2012 through 2016, as
			 required by the rule described in paragraph (3)(B)), including for the purpose
			 of issuing permits or establishing regulatory standards.</text>
						</clause></subparagraph><subparagraph commented="no" id="id65C9BC62EBE348388C1DD64EE0E19EBD"><enum>(B)</enum><header>Requests for
			 waivers</header><text>Section 209(b) of the Clean Air Act (42 U.S.C. 7543(b))
			 is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id1671FED95BD4430A8994E37465DDB22F" style="OLC">
							<paragraph commented="no" id="id23DDD04BA90A4B7CA633EA1D86BB8030"><enum>(4)</enum><header>Requests for
				waivers</header><text>Notwithstanding any other provision of this Act or any
				other law—</text>
								<subparagraph commented="no" id="id2E8577F70E2B47D0B96B124150ACC8AC"><enum>(A)</enum><text>no request for a
				waiver of the application of this section by any State for standards to control
				emissions of any air pollutant that is a greenhouse gas (as defined in section
				3 of the <short-title>Defending America’s Affordable
				Energy and Jobs Act</short-title>) from new motor vehicles or new motor vehicle
				engines of model year 2017 or later may be granted by the Administrator;
				and</text>
								</subparagraph><subparagraph commented="no" id="idEACDC6612B4B4CAE9BA514597238BF09"><enum>(B)</enum><text>no grant of any
				waiver by the Administrator before the date of enactment of this paragraph
				shall be considered by the Administrator, the requesting State, or any court as
				waiving the application of subsection (a), or any other provision of this
				section, to standards adopted by the State for control of emissions of any air
				pollutant that is a greenhouse gas (as defined in section 3 of the
				<short-title>Defending America’s Affordable Energy and
				Jobs Act</short-title>) from new motor vehicles or new motor vehicle engines of
				model year 2017 or
				later.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID0ff8823a0dce42298b0edea9dc804da0"><enum>(6)</enum><header>Impacts on
			 State laws</header>
					<subparagraph id="idD9E96FBEB8F943BAA7C3FA84732E786D"><enum>(A)</enum><header>In
			 general</header><text>Any provision of a State implementation plan designating
			 greenhouse gases as pollutants that are subject to regulation or as regulated
			 pollutants, or otherwise authorizing or requiring limitations on the emission
			 of greenhouse gases under State law—</text>
						<clause id="id6B1C39CDC0F04C21A26D51CE266CA3E2"><enum>(i)</enum><text>shall not be
			 federally enforceable;</text>
						</clause><clause id="id7E62E0551CA646868C05FDF2A0379696"><enum>(ii)</enum><text>shall not be
			 deemed to be Federal law; and</text>
						</clause><clause id="idAD1F5636A9F24A09BC323DD027A14D9A"><enum>(iii)</enum><text>shall be deemed
			 to be stricken from the State implementation plan.</text>
						</clause></subparagraph><subparagraph id="id78D409AE84144D8BA72756CB722FAB36"><enum>(B)</enum><header>Authority of
			 States</header>
						<clause id="id105BEF4B7E5144888F97A9F8CC58783E"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), nothing in this section affects
			 any State law (including a regulation) or the authority of any State to adopt a
			 law or promulgate a regulation.</text>
						</clause><clause id="id2EA437E891A64DECA95ED52FDC3BDFDB"><enum>(ii)</enum><header>Authority of
			 Administrator</header><text>Notwithstanding clause (i), the Administrator shall
			 have no authority to approve or make federally enforceable any provision of a
			 State implementation plan requiring the control of greenhouse gas
			 emissions.</text>
						</clause><clause id="id90C232223368422DB5CFFA4A1627AA45"><enum>(iii)</enum><header>Amendment of
			 existing laws</header><text>If, as a result of the regulations referred to in
			 paragraph (4), a State adopted any law (including a regulation) designating
			 greenhouse gases as pollutants that are subject to regulation or as regulated
			 pollutants, or authorizing or requiring limitations on the emission of
			 greenhouse gases under State law, the State may amend the adopted law to remove
			 any restrictions on greenhouse gas emissions.</text>
						</clause></subparagraph><subparagraph id="id60624B50DF524A558A8E5EAC3A7C3A4F"><enum>(C)</enum><header>Federalization
			 of SIP requirements</header><text>The Administrator shall have no authority to
			 approve or make federally enforceable any provision of a State implementation
			 plan requiring the control of greenhouse gas emissions.</text>
					</subparagraph></paragraph><paragraph id="ID27758f1774ec41359c3ec361894fdbf7"><enum>(7)</enum><header>Presidential
			 findings and conclusions</header><text>Except as authorized by this subsection
			 or another Act of Congress, the President or the head of a Federal department
			 or agency may not examine or make findings or conclusions, such as those
			 contained in the final rule referred to in paragraph (4)(B)(i), for purposes of
			 promulgating or issuing policy, guidance, or regulations to address the impacts
			 of greenhouse gas emissions on climate change.</text>
				</paragraph><paragraph id="id5424B3E8320F4B13B91BA6212B560ED3"><enum>(8)</enum><header>Judicial
			 review</header>
					<subparagraph id="id8C70A5D271DC4A68A96F8345D2C39DB9"><enum>(A)</enum><header>In
			 general</header><text>In addition to any other remedies available, any person
			 affected by a regulation, action, or consideration concerning the control of
			 emissions of a greenhouse gas that fails to meet the criteria described in
			 paragraph (1) may challenge the regulation, action, or consideration.</text>
					</subparagraph><subparagraph id="id67FF7127F3894F7EA2799514CE6329A6"><enum>(B)</enum><header>Jurisdiction</header><text>The
			 United States Court of Appeals for the District of Columbia Circuit shall have
			 exclusive jurisdiction over any review of any Federal, State, or other
			 regulation, action, or consideration challenged under subparagraph (A).</text>
					</subparagraph></paragraph></subsection><subsection id="id9B82DDC74B7E49929CA3588CE8BE9772"><enum>(b)</enum><header>Actions at
			 law</header><text>No cause of action, whether based on common law or civil tort
			 (including nuisance) or any other legal or equitable theory, may be brought or
			 maintained, and no liability, money damages, or injunctive relief arising from
			 such an action may be imposed, for—</text>
				<paragraph id="ID7eae9076fc1f4c2da05c79ac090d785d"><enum>(1)</enum><text>any potential or
			 actual contribution of a greenhouse gas to climate change; or</text>
				</paragraph><paragraph id="ID81639aef2e3e48fa9a59586e23daf322"><enum>(2)</enum><text>any direct or
			 indirect effect of potential or actual atmospheric concentrations of a
			 greenhouse gas.</text>
				</paragraph></subsection><subsection id="idBE072B1BE1204FEBA44100459BD66448"><enum>(c)</enum><header>Allowances</header><text>No
			 State shall have authority—</text>
				<paragraph id="id7962D7C317C24F9AA1470F901A5BC34D"><enum>(1)</enum><text>to require any
			 entity to procure, hold, or surrender allowances for the emission of greenhouse
			 gases that takes place outside of the State; or</text>
				</paragraph><paragraph id="id23F5AA8133AE48A0B00094D5A40A8912"><enum>(2)</enum><text>to
			 otherwise—</text>
					<subparagraph id="id3288A9797EE04F6BB905EBCAED251B56"><enum>(A)</enum><text>regulate or tax,
			 directly or indirectly, greenhouse gas emissions produced outside of the State;
			 or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6CDBDB6EE8C54EE8AA9BF41C6F96FB95"><enum>(B)</enum><text>to otherwise
			 limit the importation of products or electricity into the State based on
			 greenhouse gas emissions occurring outside the State.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
