		<section id="id968B2D2E8A7D4C769007A7243F2D462C" section-type="section-one"><enum>1.</enum><header>Election for small businesses
			 to expense depreciable property</header>
			<subsection id="id5E3DC98974F342668B552E1432A5D269"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part VI of subchapter
			 B of chapter 1 of the Internal Revenue Code of 1986 is amended by inserting
			 after section 179E the following new section:</text>

					<section id="idADAD68F24F444CEE8608A121F9C217F8"><enum>179F.</enum><header>Election for
				small businesses to expense certain depreciable property</header>
						<subsection id="idB0BA511CFB9A4C74BFDF75F71031F8E5"><enum>(a)</enum><header>In
				general</header><text>An eligible small business may elect to treat the cost of
				any qualified property as an expense which is not chargeable to a capital
				account.</text>
						</subsection><subsection id="id3A3D3943434D4A60809B315C9E589CF1"><enum>(b)</enum><header>Eligible small
				business</header><text>For purposes of this section—</text>
							<paragraph id="id16577F6D34F04EDDA160F8DAD20BEBC6"><enum>(1)</enum><header>In
				general</header><text>The term <term>eligible small business</term> means, with
				respect to any taxable year, any trade or business the net profit of which does
				not exceed $1,000,000.</text>
							</paragraph><paragraph id="id062B6619CABE4F598383398368D851F5"><enum>(2)</enum><header>Net
				profit</header><text>The term <term>net profit</term> means the excess of the
				aggregate gross receipts over the sum of—</text>
								<subparagraph id="idfaa58a4275fb4718bbdf641b89cb8760"><enum>(A)</enum><text>the costs of
				goods sold which are allocable to such receipts, and</text>
								</subparagraph><subparagraph id="id327aace342f54a3f84b949389c1479a1"><enum>(B)</enum><text>other expenses,
				losses, or deductions which are properly allocable to such receipts.</text>
								</subparagraph></paragraph><paragraph id="id8D3DC47A2B644EF6959B900FAC867F2A"><enum>(3)</enum><header>Aggregation
				rules</header><text>All persons treated as a single employer under subsection
				(a) or (b) of section 52 or subsection (m) or (o) of section 414 shall be
				treated as a single trade or business for purposes of this subsection.</text>
							</paragraph></subsection><subsection id="id0C76BFFA5D084000B964E6E5A462A281"><enum>(c)</enum><header>Election</header><text>An
				election under this section for any taxable year shall be made on the
				taxpayer's return of the tax imposed by this chapter for the taxable year. Such
				election shall be made in such manner as the Secretary may by regulation
				prescribe.</text>
						</subsection><subsection id="id5FC8F72EEC274781A6B6278B6F40ED65"><enum>(d)</enum><header>Definitions and
				special rules</header>
							<paragraph id="idC509228F8C17487DBA7B8DC77084252E"><enum>(1)</enum><header>Qualified
				property</header><text>For purposes of this section, the term <term>qualified
				property</term> means any property which is section 179 property as defined in
				section 179(d)(1), determined—</text>
								<subparagraph id="idE92CF21C1C9749EBA52785C460C0B286"><enum>(A)</enum><text>without regard to
				any placed in service date under subparagraph (A)(ii) thereof, and</text>
								</subparagraph><subparagraph id="idB096DC1EA995438AB1EBF1D9840E161F"><enum>(B)</enum><text>without regard to
				any taxable year limitation under section 179(f).</text>
								</subparagraph></paragraph><paragraph id="idE942C0B0EEB34D6896CA8C4111B2E776"><enum>(2)</enum><header>Special
				rules</header><text>For purposes of this section, rules similar to the rules of
				paragraphs (3), (4), (5), (9), and (10) of section 179(d) shall
				apply.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id7DBE4F4A6D884CD4ADF87D1ACD710CEB"><enum>(b)</enum><header>Clerical
			 amendment</header><text>Part VI of subchapter B of chapter 1 of the Internal
			 Revenue Code of 1986 is amended by inserting after the item relating to section
			 179E the following new item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id59CB99D0B35A4C7EA85CEFA47A767B96"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2012.</text>
