			<paragraph commented="no" display-inline="no-display-inline" id="HCDBEB50C26D649A3AA03AF1F23880028"><enum>(1)</enum><header display-inline="yes-display-inline">DWI</header><text display-inline="yes-display-inline">The term <term>DWI</term> means driving
			 while intoxicated and any similar motor vehicle violation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD0FE495835F46E68F570898FC935F38"><enum>(2)</enum><header display-inline="yes-display-inline">Federal immigration database</header><text display-inline="yes-display-inline">The term <term>Federal immigration
			 database</term> means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HCE1CB6F94AEC4058BA30A835675B205D"><enum>(A)</enum><text display-inline="yes-display-inline">the database of the LESC insofar as it
			 relates to immigration information;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCF29630BDC24481E8CE3244CE9710793"><enum>(B)</enum><text display-inline="yes-display-inline">the database of the NCIC insofar as it
			 relates to immigration information; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93E3AD59AC604295B9E583291049379F"><enum>(C)</enum><text display-inline="yes-display-inline">any other database containing immigration
			 information identified by the Secretary of Homeland Security.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C320768EF624CF9957FBFED9EFF5989"><enum>(3)</enum><header display-inline="yes-display-inline">Immigration information</header><text display-inline="yes-display-inline">The term <term>immigration
			 information</term> means information specified by the Secretary, in
			 consultation with the Attorney General, relating to immigration, including
			 illegal immigration.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF6A9B5671C3C4360A700942C00B7813B"><enum>(4)</enum><header display-inline="yes-display-inline">LESC</header><text display-inline="yes-display-inline">The term <term>LESC</term> means the Law
			 Enforcement Support Center.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H657A083E197749CB96EBF3DFA00A010"><enum>(5)</enum><header display-inline="yes-display-inline">NCIC</header><text display-inline="yes-display-inline">The term <term>NCIC</term> means the
			 National Crime Information Center of the Federal Bureau of
			 Investigation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2101D3A166414FC29D7502A186C522D4"><enum>(6)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Homeland Security.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HD8E34E65F66C4B24A6DE089C33F8D659" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Improved Federal sharing of immigration
			 information</header>
			<subsection commented="no" display-inline="no-display-inline" id="H5A53B86D3F914155ABEA8C0A6E899C4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall share immigration
			 information with the Attorney General.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H8C0C2ED799AC41A08E97C65B96812F9F"><enum>(b)</enum><header display-inline="yes-display-inline">Improved operation of Federal immigration
			 databases</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HC4EAB0B1646D4007B809FC3451D17DCF"><enum>(1)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 the enactment of this Act, the Secretary and the Attorney General shall jointly
			 submit to Congress a report on methods for improving performance of Federal
			 immigration databases to ensure the prompt entry of immigration information
			 into such databases.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBAB5450F3A3F477E81AF25E7A2D2657E"><enum>(2)</enum><header display-inline="yes-display-inline">Compatibility</header><text display-inline="yes-display-inline">The report submitted under paragraph (1)
			 shall contain proposals to improve the compatibility among Federal immigration
			 databases in order to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H8412181BECD94B5E99BAE1E5D2B33D6B"><enum>(A)</enum><text display-inline="yes-display-inline">improve data entry, including eliminating
			 data entry backlogs;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9C045BDF3D964CDA9B00D298D0000061"><enum>(B)</enum><text display-inline="yes-display-inline">improve the means by which immigration
			 information is exchanged; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD1DD38CA1FF04884ACC7A0B2AB8834A6"><enum>(C)</enum><text display-inline="yes-display-inline">increase accessibility of information to
			 Federal, State, and local law enforcement agencies.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H427A6B2D87D64B9DB11DDAEB73399E3F"><enum>(3)</enum><header display-inline="yes-display-inline">Progress</header><text display-inline="yes-display-inline">The report submitted under paragraph (1)
			 shall describe—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idE12BC17B1364435EB5A1A4D10EBF8909"><enum>(A)</enum><text display-inline="yes-display-inline">the progress made in eliminating data entry
			 backlogs in such databases; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA780A020A3540BA9FF4042DDFDB446B"><enum>(B)</enum><text display-inline="yes-display-inline">any additional resources required to
			 eliminate such backlogs.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HAF4BF460FE0640D7001E311845FE7F61" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">State and local reporting of immigration
			 information</header>
			<subsection commented="no" display-inline="no-display-inline" id="H75AAF4A13E064A9FA7835E0047F097BA"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H490D64F6B15F4D1597D9B24124A76500"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (c), the director of
			 each State and local law enforcement agency receiving Federal financial
			 assistance under section 241(i) of the Immigration and Nationality Act (8
			 U.S.C. 1231(i)) shall, as a condition of such assistance, submit a report to
			 the Secretary, in such form, in such manner, and containing such immigration
			 and DWI information collected in the course of the director’s normal duties as
			 the Secretary requires for entry into Federal immigration databases.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFE78DCF2357A496D8373CECBEFBAB1"><enum>(2)</enum><header display-inline="yes-display-inline">Report on resources</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 the enactment of this Act, the Secretary and the Attorney General shall jointly
			 submit to Congress a report on additional resources required by State and local
			 law enforcement agencies to comply with the requirement under paragraph
			 (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC45F345464D745A791DEA99B00AE7EF8"><enum>(b)</enum><header display-inline="yes-display-inline">Promotion of Law Enforcement Support
			 Center</header><text display-inline="yes-display-inline">The Secretary shall
			 promote the use of the LESC by State and local law enforcement agencies.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H2BFC29791EAF4A568B1050EA0071D0F3"><enum>(c)</enum><header display-inline="yes-display-inline">Exemption from State and local reporting
			 requirement</header><text display-inline="yes-display-inline">State and local
			 law enforcement agencies are not required to collect or report immigration
			 information relating to any individual who assists law enforcement agencies in
			 the performance of the duties of such agencies, including assistance as an
			 informant, a witness, or in a similar capacity.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H43E3D993F1E94C1A86AB4B4368CE1DD0" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">DWI and immigration information in the
			 National Criminal Information Center</header>
			<subsection commented="no" display-inline="no-display-inline" id="HDA616FB780BB479A983C26A99A496E0"><enum>(a)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">DWI and immigration information in the
			 NCIC—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HBCC507D0A532443DB836F449005E66E7"><enum>(1)</enum><text display-inline="yes-display-inline">shall appear as a flag in the Wanted Person
			 File of the NCIC database; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6097244EEBCE4E6E904861CCDB310B6"><enum>(2)</enum><text display-inline="yes-display-inline">shall be timely and readily available to
			 State and local law enforcement officers while they are in the course of their
			 normal duties.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3ADCD70B080B47148F7FA9A8E0DD4ECC"><enum>(b)</enum><header display-inline="yes-display-inline">Mandatory detention</header><text display-inline="yes-display-inline">A State or local law enforcement officer
			 who finds a flag for a DWI and immigration violation of an alien in the Wanted
			 Person File of the NCIC and who arrests the alien shall detain the alien in a
			 State or local jail until the alien can be transferred to Federal
			 custody.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H4F4DEB87C0654DAAB4034CBAD58B4C00" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">State and local enforcement of Federal
			 immigration laws</header>
			<subsection commented="no" display-inline="no-display-inline" id="H1DBA94DC238D4404A6FAECB71F611C9F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 287(g) of the Immigration and
			 Nationality Act (8 U.S.C. 1357(g)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H2FF3D0EC2F834C2E83034BC2043557C1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>may
			 enter</quote> and inserting <quote>shall enter</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1AC06F8BCA0047E9ACDB00A6984BC3C1"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by adding at the end the
			 following: <quote>If such training is provided by a State or political
			 subdivision of a State to an officer or employee of such State or political
			 subdivision of a State, the cost of such training (including applicable
			 overtime costs) shall be reimbursed by the Secretary of Homeland
			 Security.</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC2171480201441B80F8E5007646EF00"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (9); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6BC1E668D8F470BA6BAD37AF80AB767"><enum>(4)</enum><text display-inline="yes-display-inline">by redesignating paragraph (10) as
			 paragraph (9).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H88A262641FF9467F9729774B648B025B"><enum>(b)</enum><header display-inline="yes-display-inline">Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary shall issue regulations to carry out the
			 amendments made by subsection (a).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id321356470FE045308A92C23661B90ECC"><enum>(c)</enum><header display-inline="yes-display-inline">Effective dates</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id3AADA01140E34ED4B574C286FACF41EE"><enum>(1)</enum><header display-inline="yes-display-inline">Requirement for agreement</header><text display-inline="yes-display-inline">Except as provided under paragraph (2), the
			 amendments made by subsection (a) shall take effect on the earlier of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idBE98D9B33A334CF4AB22AAD003DEE783"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which regulations are issued
			 under paragraph (1); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC14B0D61C8D0473E8261C42FBCBCA561"><enum>(B)</enum><text display-inline="yes-display-inline">the date that is 1 year after the date of
			 the enactment of this Act.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC469D3F87B5F484582451767A0D61F64"><enum>(2)</enum><header display-inline="yes-display-inline">Payment for training costs</header><text display-inline="yes-display-inline">The amendment made by subsection (a)(2)
			 shall take effect on the first day of the first fiscal year beginning after the
			 date of the enactment of this Act.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H9876AC8ED7E448C7954E2DA700FED2A2" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Detention and deportation of aliens for
			 driving while intoxicated</header>
			<subsection commented="no" display-inline="no-display-inline" id="H704C6EE12D5B4DD1BDF5D6F7C21F2C5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 236 of the Immigration and
			 Nationality Act (8 U.S.C. 1226) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HB883AED8421D4AF1994800AF97756BD"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HDC349232326C4397B1E00F6752678CC"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>,
			 or</quote> at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6DD0C38FD5A44B98A1BC872AA65D42"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking the comma
			 at the end and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2E7029376BCE47529F0056C4485231E1"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (D) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="HD83B912D98C4450195055E6D2DCE42BC" style="traditional">
							<subparagraph commented="no" display-inline="no-display-inline" id="H2061FB6FC3364FF4BFC22CD5ABB369AE"><enum>(E)</enum><text display-inline="yes-display-inline">is deportable on any grounds and is
				apprehended for driving while intoxicated, driving under the influence, or
				similar violation of State law (as determined by the Secretary of Homeland
				Security) by a State or local law enforcement officer covered under an
				agreement under section
				287(g),</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H643FDFAE87B5403CBB096593A664A5A4"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (e) as
			 subsection (f); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8855B22813A473DBA4C199730B2CE4C"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HBF8880D1BA7245FB9F6B00EB27788C80" style="traditional">
						<subsection commented="no" display-inline="no-display-inline" id="HD627B9EEA2A4421AA834DCF88D62AE09"><enum>(e)</enum><header display-inline="yes-display-inline">Driving while intoxicated</header><text display-inline="yes-display-inline">If a State or local law enforcement officer
				apprehends an individual for an offense described in subsection (c)(1)(E) and
				the officer has reasonable grounds to believe that the individual is an
				alien—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H8EB5B97122D444D6B58F80A01F6ECC39"><enum>(1)</enum><text display-inline="yes-display-inline">the officer shall use the databases of the
				Federal Government, including the National Criminal Information Center and the
				Law Enforcement Support Center, to determine if the individual—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idC75A7B76858442AE906235FF3A47A30F"><enum>(A)</enum><text display-inline="yes-display-inline">is an alien; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1CCAEB31287048DFB4930BC2F4161D5B"><enum>(B)</enum><text display-inline="yes-display-inline">is unlawfully present in the United States;
				and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B814DCB164240E1B4941E5C12BF7F3D"><enum>(2)</enum><text display-inline="yes-display-inline">if any database under paragraph (1)
				indicates that the individual is an alien unlawfully present in the United
				States—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H47DD4D697A5F4678925734204DF6C0FE"><enum>(A)</enum><text display-inline="yes-display-inline">an officer covered under an agreement under
				section 287(g) may issue a Federal detainer to maintain the alien in custody in
				accordance with such agreement until the alien is convicted for such offense or
				the alien is transferred to Federal custody;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2850945B7EC541E8B6CDE228603831BD"><enum>(B)</enum><text display-inline="yes-display-inline">the officer may transport the alien to a
				location where the alien can be transferred to Federal custody and removed from
				the United States in accordance with applicable law; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3867E18BBD04406B74CD2C6CA27D5C5"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security shall
				reimburse the State and local law enforcement agencies involved for the costs
				of transporting aliens when such transportation is not done in the course of
				their normal duties; or</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H00672CC3866549DE99F78D8307743DFF"><enum>(3)</enum><text display-inline="yes-display-inline">if any database under paragraph (1)
				indicates that the individual is an alien that is not unlawfully present in the
				United States, the officer shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id6AD27C3EF0BD4637A340E38A015B974B"><enum>(A)</enum><text display-inline="yes-display-inline">take the alien into custody for such
				offense in accordance with State law;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD6C2953F5F4F4DE19D58599E4060316C"><enum>(B)</enum><text display-inline="yes-display-inline">promptly notify the Secretary of Homeland
				Security of such apprehension; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C8554C64D584768B7AC16A70E925EF0"><enum>(C)</enum><text display-inline="yes-display-inline">maintain the alien in custody pending a
				determination by the Secretary with respect to any action to be taken by the
				Secretary against such
				alien.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEAEAC782D32C455A8D6134C35E08E719"><enum>(b)</enum><header display-inline="yes-display-inline">Deportation for driving while
			 intoxicated</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2C06BA9FACDA40D786B369ACADA373D0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 237(a)(2) of the Immigration and
			 Nationality Act (8 U.S.C. 1227(a)(2)) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HA872577CE97B449D864B7FED22291B7C" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="H6CD36EB3A18D44C4AFB1EAD63B669600"><enum>(G)</enum><header display-inline="yes-display-inline">Driving while intoxicated</header><text display-inline="yes-display-inline">Any alien who is convicted of driving while
				intoxicated, driving under the influence, or a similar violation of State law
				(as determined by the Secretary of Homeland Security), or who refuses, in
				violation of State law, to submit to a Breathalyzer test or other test for the
				purpose of determining blood alcohol content is deportable and shall be
				deported.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2E657E450A8A46E29251D22CBEA02151"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 paragraph (1) shall apply to violations or refusals occurring after the date of
			 enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H574112058D4841AE9C793CE121AB7EC"><enum>(c)</enum><header display-inline="yes-display-inline">Sharing of information by motor vehicle
			 administrators regarding DWI convictions and refusals</header><text display-inline="yes-display-inline">Each State motor vehicle administrator
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE2133303BD1042729FC7C9781E92906C"><enum>(1)</enum><text display-inline="yes-display-inline">share information with the Secretary
			 relating to any alien who has a conviction or refusal described in section
			 237(a)(2)(G) of the Immigration and Nationality Act (8 U.S.C.
			 1227(a)(2)(G));</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAF1D0A304724243982417F1A69D38D1"><enum>(2)</enum><text display-inline="yes-display-inline">share such information with other State
			 motor vehicle administrators through the Drivers License Agreement of the
			 American Association of Motor Vehicle Administrators; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H30A3362F85944529B1E657A390EB3533"><enum>(3)</enum><text display-inline="yes-display-inline">provide such information to the NCIC at
			 such time and in such form as the Secretary may require.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HE159A6064D0C49FEB11E0051D8D152EF" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Federal detention facilities</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE2B520D3E79C445884E7B128D7A6F9CB"><enum>(a)</enum><header display-inline="yes-display-inline">Report on current allocation formula;
			 recommendations for stop-Gap measures</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 the enactment of this Act, the Secretary shall submit a report to Congress that
			 describes the formula for allocation of Federal detention facilities for aliens
			 under section 241(g) of the Immigration and Nationality Act (8 U.S.C. 1231(g)).
			 The report shall include proposals for the temporary expansion of State and
			 local jails to detain increased numbers of illegal aliens pending construction
			 or expansion of Federal detention facilities.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5225D03EF6A444FEACC59249CBE4514E"><enum>(b)</enum><header display-inline="yes-display-inline">New construction in high concentration
			 areas</header><text display-inline="yes-display-inline">In accordance with such
			 section 241(g), the Secretary shall ensure that, to the greatest extent
			 practicable, construction of new detention facilities is undertaken in or near
			 areas in which the Secretary has determined that there is a high concentration
			 of illegal aliens.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HCCA1774E9B9E46C7B894AE8FE300BEA3"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 section.</text>
