		<official-title>To provide liability protection for claims based on the
		  design, manufacture, sale, offer for sale, introduction into commerce, or use
		  of certain fuels and fuel additives, and for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Domestic Fuels Act of
			 2012</short-title></quote>.</text>
		</section><section id="id6503108892334405BBD7FA512D2BA969"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idD4E0F5CB3EB2460AAEC756B45604D13B"><enum>(1)</enum><header>Covered
			 entity</header><text>The term <term>covered entity</term> means—</text>
				<subparagraph id="id47ECD79E03A448FA8E37349310EEA34C"><enum>(A)</enum><text>any entity
			 engaged in the design, manufacture, sale, or distribution of any qualified
			 product, blend stock, or component of any qualified product; or</text>
				</subparagraph><subparagraph id="id7F50CF66FD6843278588E5B7353DD3CC"><enum>(B)</enum><text>any entity
			 engaged in the design, manufacture, sale, or distribution of any motor vehicle,
			 motor vehicle engine, nonroad vehicle, nonroad engine, or nonroad
			 equipment.</text>
				</subparagraph></paragraph><paragraph id="id35055236F4BE450AB76CECF446AEE9B0"><enum>(2)</enum><header>Motor
			 vehicle</header><text>The term <term>motor vehicle</term> has the meaning given
			 the term in section 216 of the Clean Air Act (42 U.S.C. 7550).</text>
			</paragraph><paragraph id="id4007818E570945AB9006D45C07DF101A"><enum>(3)</enum><header>Motor vehicle
			 engine</header><text>The term <term>motor vehicle engine</term> means an engine
			 in a motor vehicle.</text>
			</paragraph><paragraph id="idD1EBAE13B3C141DAB9464F26D0F93CC7"><enum>(4)</enum><header>Nonroad
			 engine</header><text>The term <term>nonroad engine</term> has the meaning given
			 the term in section 216 of the Clean Air Act (42 U.S.C. 7550).</text>
			</paragraph><paragraph id="id748F7DC2136E440CAE42DF0E54B4F80D"><enum>(5)</enum><header>Nonroad
			 equipment</header><text>The term <term>nonroad equipment</term> means any
			 recreational, construction, industrial, agricultural, logging, residential,
			 commercial lawn and garden, or other equipment that incorporates a nonroad
			 engine.</text>
			</paragraph><paragraph id="idB2EC100BB1CB45C7B00160C0F6FAE969"><enum>(6)</enum><header>Nonroad
			 vehicle</header><text>The term <term>nonroad vehicle</term> has the meaning
			 given the term in section 216 of the Clean Air Act (42 U.S.C. 7550).</text>
			</paragraph><paragraph id="id8ED2A7BF248E4ED4A3EB3CF8B9EF0021"><enum>(7)</enum><header>Person</header><text>The
			 term <term>person</term> has the meaning given the term in section 1 of title
			 1, United States Code, except that the term includes any governmental
			 entity.</text>
			</paragraph><paragraph id="idC39C2DEC33264B6CB795DC8B477208C4"><enum>(8)</enum><header>Qualified civil
			 liability action</header><text>The term <term>qualified civil liability
			 action</term> means any civil action or proceeding brought by any person
			 against a covered entity for damages, punitive damages, injunctive or
			 declaratory relief, abatement, restitution, fines, penalties, or other relief,
			 resulting from the introduction of any qualified product into any motor
			 vehicle, motor vehicle engine, nonroad vehicle, nonroad engine, or nonroad
			 equipment.</text>
			</paragraph><paragraph id="idFADA855A9D6F4E5E8EBCB1D5F5E68E7B"><enum>(9)</enum><header>Qualified
			 product</header><text>The term <term>qualified product</term> means—</text>
				<subparagraph id="IDd0ca012e62ab43799481aa0dbad5e8e8"><enum>(A)</enum><text>any
			 transportation fuel or transportation fuel additive that is registered, or for
			 which an updated registration is accepted, for introduction into interstate
			 commerce by the Administrator of the Environmental Protection Agency under
			 section 211(b) of the Clean Air Act (42 U.S.C. 7545(b)) or any other Federal
			 law enacted on or after October 13, 2010; or</text>
				</subparagraph><subparagraph id="ID696b1363610d4873962427235e937dbc"><enum>(B)</enum><text>a transportation
			 fuel or transportation fuel additive that—</text>
					<clause id="id0B6745B52F1C457FA019856E54A896F5"><enum>(i)</enum><text>contains any
			 renewable fuel (as defined in section 211(o)(1) of the Clean Air Act (42 U.S.C.
			 7545(o)(1))); and</text>
					</clause><clause id="idBE2D92F6BF7B4D399FF54A47F5B78C01"><enum>(ii)</enum><text>is
			 designated for introduction into interstate commerce by the Administrator of
			 the Environmental Protection Agency or the Secretary of Energy under the Clean
			 Air Act (42 U.S.C. 7401 et seq.), the Energy Policy Act of 1992 (42 U.S.C.
			 13201 et seq.), or any other Federal law enacted on or after October 13,
			 2010.</text>
					</clause></subparagraph></paragraph><paragraph id="id7CAD822750B147F993AA3696A00BBFBC"><enum>(10)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
				<subparagraph id="id7932EE5FC2AF4706B7148EDF9EB01E70"><enum>(A)</enum><text>each of the
			 several States of the United States;</text>
				</subparagraph><subparagraph id="id870AEDA54F064D1EA84D4826205FCCE9"><enum>(B)</enum><text>the District of
			 Columbia;</text>
				</subparagraph><subparagraph id="id4010064764544314AA244F12F43F8FCD"><enum>(C)</enum><text>the Commonwealth
			 of Puerto Rico; and</text>
				</subparagraph><subparagraph id="idC1445317964049EEA6829F7929869DFD"><enum>(D)</enum><text>any other
			 territory or possession of the United States.</text>
				</subparagraph></paragraph></section><section id="id77409A570F954FD796202626E0D4D244"><enum>3.</enum><header>Fuel
			 Compatibility</header>
			<subsection id="id4F51DE77A8324FD18712644DFF1BCFF5"><enum>(a)</enum><header>Compatibility</header><text>Subtitle
			 I of the Solid Waste Disposal Act (42 U.S.C. 9001 et seq.) is amended—</text>
				<paragraph id="ID628bdc2409ee4e45be345a9e3cee51bb"><enum>(1)</enum><text>by redesignating
			 section 9014 as section 9015; and</text>
				</paragraph><paragraph id="IDace5729440284619a41fc0cc5ab4d2b0"><enum>(2)</enum><text>by inserting
			 after section 9013 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0F0E8044A630406BA9872B3ADEA8ED65" style="OLC">
						<section id="IDc9fad0dad1a740899ef16c8a75715a1b"><enum>9014.</enum><header>Compatibility</header>
							<subsection id="idDB1DCB23031B4009A0F4487E2E8CB757"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="IDd797232a90b04d60b1f7d059eeac3d6c"><enum>(1)</enum><header>Associated
				dispensing equipment</header><text>The term <term>associated dispensing
				equipment</term> means equipment that is—</text>
									<subparagraph id="ID4f39f79b1bd54be1ac10af7554b7f088"><enum>(A)</enum><text>for the storage
				and dispensing of any fuel or fuel additive described in subsection (b)(3) at a
				stationary facility that dispenses the fuel or fuel additive into any fuel tank
				of any motor vehicle, motor vehicle engine, nonroad vehicle, nonroad engine, or
				nonroad equipment; and</text>
									</subparagraph><subparagraph id="IDc08b9a135c414203a2f106aaa8471bd2"><enum>(B)</enum><text>subject to
				regulation under sections 1910.106 and 1926.152 of title 29, Code of Federal
				Regulations (as in effect on the date of enactment of the
				<short-title>Domestic Fuels Act of
				2012</short-title>).</text>
									</subparagraph></paragraph><paragraph id="ID62a931bcfd584157993e5244ae697784"><enum>(2)</enum><header>Compatible</header><text>The
				term <term>compatible</term> has the meaning given the term in section 280.12
				of title 40, Code of Federal Regulations (as in effect on the date of enactment
				of the <short-title>Domestic Fuels Act of
				2012</short-title>).</text>
								</paragraph><paragraph id="IDb2c5c4cad07741f888a97e307a8dc49c"><enum>(3)</enum><header>Provider of
				financial assurance</header><text>The term <term>provider of financial
				assurance</term> has the meaning given the term in section 280.92 of title 40,
				Code of Federal Regulations (as in effect on the date of enactment of the
				<short-title>Domestic Fuels Act of
				2012</short-title>).</text>
								</paragraph><paragraph id="ID19e82e0966664508adda14a6e4e1a780"><enum>(4)</enum><header>Underground
				storage tank</header><text>The term <term>underground storage tank</term> has
				the meaning given the term in section 280.12 of title 40, Code of Federal
				Regulations (as in effect on the date of enactment of the
				<short-title>Domestic Fuels Act of
				2012</short-title>).</text>
								</paragraph><paragraph id="ID1353444a45ff40bd9021356b79994b0b"><enum>(5)</enum><header>Underground
				storage tank system</header><text>The term <term>underground storage tank
				system</term> means an underground storage tank, connected underground piping,
				underground ancillary equipment, and containment system, if any.</text>
								</paragraph></subsection><subsection id="idEABB9267CF414ABC8C9D2AF035EA51BB"><enum>(b)</enum><header>Compatibility
				with fuels</header>
								<paragraph id="id334B087B571A455C87308406A4AD107A"><enum>(1)</enum><header>Liability</header><text>No
				person shall be liable under any provision of this Act or any other Federal,
				State, or local law, including common law, because any underground storage
				tank, underground storage tank system, or associated dispensing equipment that
				stores or dispenses any fuel or fuel additive described in paragraph (3)(A) is
				not compatible with the fuel or fuel additive if the tank, system, or equipment
				has been determined to be compatible with the fuel or fuel additive under the
				guidelines or regulations described in paragraph (3).</text>
								</paragraph><paragraph id="idcab35bc3378a4553a41a143b499f355a"><enum>(2)</enum><header>Financial
				assurance</header><text>A provider of financial assurance shall not deny
				payment for any claim on the basis that any underground storage tank,
				underground storage tank system, or associated dispensing equipment that stores
				or dispenses any fuel or fuel additive described in paragraph (3)(A) is not
				compatible with the fuel or fuel additive if the tank, system, or equipment has
				been determined to be compatible with the fuel or fuel additive under the
				guidelines or regulations described in paragraph (3).</text>
								</paragraph><paragraph id="idd78108cbd146448a91c32a7ce87e3d9d"><enum>(3)</enum><header>Guidelines and
				regulations</header>
									<subparagraph id="idf6b3128844cb4420a0b36f1cba154e62"><enum>(A)</enum><header>In
				general</header><text>Paragraph (1) applies to any underground storage tank and
				underground storage tank system that meets any guidance or regulation, which
				may be revised under subparagraph (B), issued by the Administrator existing on
				the date of enactment of the <short-title>Domestic Fuels
				Act of 2012</short-title> addressing compatibility of such tanks or systems
				with any fuel or fuel additive that is authorized and registered, or for which
				an updated registration is accepted, by the Administrator or under any Federal
				law, for use in a motor vehicle, motor vehicle engine, nonroad vehicle, nonroad
				engine, or nonroad equipment.</text>
									</subparagraph><subparagraph id="idf02dc31f9fe543c59f8bd1f1e5256b99"><enum>(B)</enum><header>Regulations</header>
										<clause id="id74D463BD898D45E5ACB9C57D24C8F885"><enum>(i)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of the
				<short-title>Domestic Fuels Act of 2012</short-title>, the
				Administrator shall promulgate, or if applicable revise, regulations setting
				standards for determining whether any underground storage tank, underground
				storage tank system, and associated dispensing equipment is compatible with any
				fuel or fuel additive that is authorized and registered, or for which an
				updated registration is accepted, by the Administrator or under any Federal law
				for use in a motor vehicle, motor vehicle engine, nonroad vehicle, nonroad
				engine, or nonroad equipment.</text>
										</clause><clause id="id3549B4633BA24B8DB38BD00C73441FE8"><enum>(ii)</enum><header>Minimum
				standards</header><text>Regulations promulgated under subparagraph (B) shall
				include minimum standards and processes for certification by the Administrator,
				owner, operator, manufacturer, or any other entity identified by the
				Administrator to ensure compatibility.</text>
										</clause></subparagraph></paragraph><paragraph id="ID8509f3ea256d4abe8e85d03bd6365513"><enum>(4)</enum><header>Underground
				storage tanks, underground storage tank systems, and associated dispensing
				equipment previously listed as compatible</header><text>Any underground storage
				tank, underground storage tank system, or associated dispensing equipment that,
				as of the date of enactment of the <short-title>Domestic
				Fuels Act of 2012</short-title>, has been listed by a nationally recognized
				testing laboratory as compatible with a fuel or fuel additive described in
				paragraph (3) shall be compatible under the regulations issued under this
				subsection.</text>
								</paragraph><paragraph id="id681CC6FC8F7B4B6CB667AC44C9D2C60D"><enum>(5)</enum><header>Administration</header><text>Nothing
				in this section affects—</text>
									<subparagraph id="idB3E37B4BDD9E45E3806840678B63DC16"><enum>(A)</enum><text>the introduction
				into commerce, offering for sale, or sale of any fuel or fuel additive;
				or</text>
									</subparagraph><subparagraph id="id0883750BC892493D9A1E986D390154EA"><enum>(B)</enum><text>any applicable
				requirement, including any requirement under section 211(o) of the Clean Air
				Act (42 U.S.C.
				7545(o)).</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id9EA118D354C24675ADEB8C9D6E77A394"><enum>(b)</enum><header>Conforming
			 amendments</header><text>The Solid Waste Disposal Act is amended—</text>
				<paragraph id="idFBD8AE8AB97B4DC8B39CAB65758CB9FF"><enum>(1)</enum><text>in section
			 9003(h)(12)(A) (42 U.S.C. 6991b(h)(12)(A)), by striking <quote>section
			 9014(2)(B)</quote> and inserting <quote>section 9015(2)(B)</quote>;</text>
				</paragraph><paragraph id="id39E57426BB3E431781C172BC56869694"><enum>(2)</enum><text>in section
			 9004(f)(1)(A) (42 U.S.C. 6991c(f)(1)(A)), by striking <quote>section
			 9014(2)(A)</quote> and inserting <quote>section 9015(2)(A)</quote>; and</text>
				</paragraph><paragraph id="id84E457A49C4E4139B50AFB618BB91C48"><enum>(3)</enum><text>in section 9011
			 (42 U.S.C. 6991j), by striking <quote>section 9014(2)(D)</quote> and inserting
			 <quote>section 9015(2)(D)</quote>.</text>
				</paragraph></subsection><subsection id="ID6a727cd81b294f52bfb33545c4ecb39d"><enum>(c)</enum><header>Table of
			 contents</header><text>The table of contents contained in section 1001 of the
			 Solid Waste Disposal Act (42 U.S.C. 6901) is amended by striking the item
			 relating to section 9014 and inserting the following:</text>

			</subsection></section><section id="id8FEC6DE83EDE499E9F26031ACBA285B4"><enum>4.</enum><header>Misfueling</header>
			<subsection id="id44F7A7DDEB79449FA1230F54C6726097"><enum>(a)</enum><header>In
			 general</header><text>Section 211(g) of the Clean Air Act (42 U.S.C. 7545(g))
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE2F7234FCAC64651A240C60C34F67A93" style="OLC">
					<paragraph id="ID2ae75f4072cd43caa5c0df89a1a2f5b7"><enum>(3)</enum><header>Regulations</header>
						<subparagraph id="id4E396612E1CE460E861B4E2EDB1AB303"><enum>(A)</enum><header>Definitions</header><text>In
				this paragraph:</text>
							<clause id="id5F2F862BC38E4BC1A01C4522A9BC7316"><enum>(i)</enum><header>Associated
				dispensing equipment</header><text>The term <term>associated dispensing
				equipment</term> has the meaning given the term in section 9014(a) of the Solid
				Waste Disposal Act.</text>
							</clause><clause id="idF98D20433B5E4E24BFE162C3AA6D5ADF"><enum>(ii)</enum><header>Transportation
				fuel</header><text>The term <term>transportation fuel</term> means any fuel
				that contains fuel or fuel additive that is authorized after January 1, 2010,
				by the Administrator or under any Federal law, for use in any motor vehicle,
				motor vehicle engine, nonroad vehicle, nonroad engine, or nonroad
				equipment.</text>
							</clause></subparagraph><subparagraph id="id98F2C449EF4E426A930A875F387F2072"><enum>(B)</enum><header>Liability</header>
							<clause id="idE5739DB5254347929B6D32104E4C6599"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clause (ii), no person shall be
				liable under any provision of this Act or any Federal, State, or local law,
				including common law, if—</text>
								<subclause id="id581E8274790E45A9B2BCB7FB93C67FAE"><enum>(I)</enum><text>a self-service
				purchaser introduces any transportation fuel into any motor vehicle, motor
				vehicle engine, nonroad vehicle, or nonroad equipment for which the fuel has
				not been approved under subsection (f); or</text>
								</subclause><subclause id="id0DDD910B5A3F4BED8480D62E0E73E3FD"><enum>(II)</enum><text>the introduction
				of any transportation fuel voids the warranty of the manufacturer of the motor
				vehicle, motor vehicle engine, nonroad engine, nonroad vehicle, or nonroad
				equipment.</text>
								</subclause></clause><clause id="id3AC7E4946879462A8FEF813141750BA1"><enum>(ii)</enum><header>Exceptions</header><text>Clause
				(i) shall not apply to—</text>
								<subclause id="id42647216B8564A2795F3910E4CD0653D"><enum>(I)</enum><text>a person who
				sells any transportation fuel and does not comply with the misfueling
				regulations adopted by the Administrator under section 80.1501 of title 40,
				Code of Federal Regulations (or successor regulation); or</text>
								</subclause><subclause id="idCC8EF8C2B2414EF298E40AEA204D44FD"><enum>(II)</enum><text>a person who
				intentionally
				misfuels.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idD46B75B2C11C416B9C9A3E3A8763C321"><enum>(b)</enum><header>Penalties</header><text>Section
			 211(d) of the Clean Air Act (42 U.S.C. 7545(d)) is amended—</text>
				<paragraph id="IDda84fd42fecf43de89ef80c3c73cbd1a"><enum>(1)</enum><text>in paragraph (1),
			 in the first sentence, by inserting <quote>(g),</quote> after <quote>or the
			 regulations prescribed under subsection (c),</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDffa1c527621a47f4a3af936a96f61e5b"><enum>(2)</enum><text>in paragraph (2),
			 in the first sentence, by inserting <quote>(g),</quote> after <quote>of the
			 regulations prescribed under subsections (c),</quote>.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id1D5B58F4C47A41C996D62E401B1FBAE5"><enum>5.</enum><header>Qualified civil
			 liability actions in Federal court and State court</header>
			<subsection id="idB46F71B48C874A5CB9983EEAA1DCFEF9"><enum>(a)</enum><header>In
			 general</header><text>No qualified civil liability action shall be filed or
			 maintained in any court of the United States or any State court.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id300EE731A5DD4AD6AB50132DB4BE7545"><enum>(b)</enum><header>Dismissal of
			 pending actions</header><text>Any qualified civil liability action pending in
			 any court of the United States or any State court on or after the date of
			 enactment of this Act shall be dismissed with prejudice.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id48B8AAD1443B4782907C8A39D381559E"><enum>6.</enum><header>Safe
			 Harbor</header><text display-inline="no-display-inline">Notwithstanding any
			 other provision of Federal, State, or local law, including common law, no
			 qualified product, blend stock, or component of a qualified product shall be
			 considered to be a defective product, if the qualified product does not violate
			 a control or prohibition with respect to any characteristic or component of the
			 qualified product imposed by the Administrator of the Environmental Protection
			 Agency under section 211 of the Clean Air Act (42 U.S.C. 7545).</text>
