		<official-title>To clarify the exception to foreign sovereign immunity
		  set forth in section 1605(a)(3) title 28, United States Code.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Foreign Cultural Exchange
			 Jurisdictional Immunity Clarification Act</short-title></quote>.</text>
		</section><section id="id5fb7a5c3caa541718015998fc5c0dfa1"><enum>2.</enum><header>Clarification of
			 jurisdictional immunity of foreign states</header>
			<subsection id="idCA078EDD9912455093AF1A43B96A9313"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1605 of title
			 28, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="ida1c57c7df85841e0bd5f91bef5e45f91" style="OLC">
					<subsection id="idf5da71b708234670870efa23ff511044"><enum>(h)</enum><header>Jurisdictional
				immunity for certain art exhibition activities</header>
						<paragraph id="id96755565861b4633962938afca6ea987"><enum>(1)</enum><header>In
				general</header><text>If—</text>
							<subparagraph id="id03DF82AD36E04B0EB16B53F74151CC51"><enum>(A)</enum><text>a work is
				imported into the United States from any foreign country pursuant to an
				agreement providing for the temporary exhibition or display of such work
				entered into between a foreign state that is the owner or custodian of such
				work and the United States or 1 or more cultural or educational institutions
				within the United States;</text>
							</subparagraph><subparagraph id="id40D6A56E33A04F2C953245A59DA137A7"><enum>(B)</enum><text>the President, or
				the President's designee, has determined, in accordance with Public Law 89–259
				(79 Stat. 985; 22 U.S.C. 2459), that such work is of cultural significance and
				the temporary exhibition or display of such work is in the national interest;
				and</text>
							</subparagraph><subparagraph id="idD29C7F9B1AC142648202D312A3256D7A"><enum>(C)</enum><text>notice has been
				published in the Federal Register in accordance with Public Law 89–259,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">any
				activity in the United States of such foreign state or any carrier associated
				with the temporary exhibit or display of such work shall not be considered to
				be commercial activity for purposes of subsection (a)(3).</continuation-text></paragraph><paragraph id="id4291ca9bb67a46ddbeb87efb10907116"><enum>(2)</enum><header>Nazi-era
				claims</header><text>Paragraph (1) shall not apply in any case in which—</text>
							<subparagraph id="idf412b5a3a25745f486239db8305af87d"><enum>(A)</enum><text>the action is
				based upon a claim that the work was taken in Europe in violation of
				international law by a covered government during the covered period;</text>
							</subparagraph><subparagraph id="id6475a6eada27477faf0ce19a13b8ee5f"><enum>(B)</enum><text>the court
				determines that the activity associated with the exhibition or display is
				commercial activity; and</text>
							</subparagraph><subparagraph id="id0fcd7e73d4eb4d65909f1e75dfbae31a"><enum>(C)</enum><text>a determination
				under subparagraph (B) is necessary for the court to exercise jurisdiction over
				the foreign state under subsection (a)(3).</text>
							</subparagraph></paragraph><paragraph id="ide74b4b4d9b3f41c4bf9b612b1cc7b73c"><enum>(3)</enum><header>Definitions</header><text>For
				purposes of this subsection—</text>
							<subparagraph id="id664f524c1f744f36b191317ecf6638cb"><enum>(A)</enum><text>the term
				<term>work</term> means a work of art or other object of cultural significance;
				and</text>
							</subparagraph><subparagraph id="ide7edf79b77ed47e8a8ce5ed01eccb853"><enum>(B)</enum><text>the term
				<term>covered government</term> means—</text>
								<clause id="id6d3bf9f9fe764a918663d7afe78aad1a"><enum>(i)</enum><text>the Nazi
				government of Germany;</text>
								</clause><clause id="id12F5090420A8435E872E92ADB247325F"><enum>(ii)</enum><text>any government
				in any area occupied by the military forces of the Nazi government of
				Germany;</text>
								</clause><clause id="idbd7465e5e59e456a95c8108623ced0de"><enum>(iii)</enum><text>any government
				established with the assistance or cooperation of the Nazi government;
				and</text>
								</clause><clause id="id76571032134448e1867b72fedb56d91d"><enum>(iv)</enum><text>any government
				that was an ally of the Nazi government of Germany; and</text>
								</clause></subparagraph><subparagraph id="id905770b96cdc453686f44b0cef35f96f"><enum>(C)</enum><text>the term
				<term>covered period</term> means the period beginning on January 30, 1933, and
				ending on May 8,
				1945.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE82EBD2989294477B260BDBABD37B6A3"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall apply to cases commenced after the date
			 of the enactment of this Act.</text>
