		<legis-type display="yes">AN ACT</legis-type>
		<official-title display="yes">To amend the provisions of title 5, United
		  States Code, which are commonly referred to as the <quote>Hatch Act</quote>, to
		  scale back the provision forbidding certain State and local employees from
		  seeking elective office, clarify the application of certain provisions to the
		  District of Columbia, and modify the penalties which may be imposed for certain
		  violations under subchapter III of chapter 73 of that title.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id9de5b28b-b977-412e-b1ee-b94b33a9c29c" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hatch Act Modernization Act of
			 2012</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id7a0c730c-c2d0-4d64-b0ce-8ee17f2bd721" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Permitting State and local employees to be
			 candidates for elective office</header><text display-inline="no-display-inline">Section 1502(a)(3) of title 5, United States
			 Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idF5D0F8353A6240FC97553969D964A9FB" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="idf40b1d32-4aa3-4d7e-859e-5460430b69b2"><enum>(3)</enum><text display-inline="yes-display-inline">if the salary of the employee is paid
				completely, directly or indirectly, by loans or grants made by the United
				States or a Federal agency, be a candidate for elective
				office.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id70405665-9cf9-4073-828b-39df39301579" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Applicability of provisions relating to
			 State and local employees</header>
			<subsection commented="no" display-inline="no-display-inline" id="id407d0bca-8060-47e1-a56a-388dd26537f7"><enum>(a)</enum><header display-inline="yes-display-inline">State or local agency</header><text display-inline="yes-display-inline">Section 1501(2) of title 5, United States
			 Code, is amended by inserting <quote>, or the executive branch of the District
			 of Columbia, or an agency or department thereof </quote> before the
			 semicolon.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ida3c39bbe-3d5b-44a4-af54-bd1210605c54"><enum>(b)</enum><header display-inline="yes-display-inline">State or local officer or
			 employee</header><text display-inline="yes-display-inline">Section 1501(4) of
			 title 5, United States Code, is amended by striking subparagraph (B) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idfac95543-7ef4-494f-9101-ea4c837bf40f" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="id37b0112e-9856-48aa-9c8f-700bee32a873"><enum>(B)</enum><text display-inline="yes-display-inline">an individual employed by an educational or
				research institution, establishment, agency, or system which is supported in
				whole or in part by—</text>
						<clause commented="no" display-inline="no-display-inline" id="id98f76049-2e6d-479f-88a2-fbcd713a6232"><enum>(i)</enum><text display-inline="yes-display-inline">a State or political subdivision
				thereof;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id37ab1eb7-3131-4867-b18d-51680442da53"><enum>(ii)</enum><text display-inline="yes-display-inline">the District of Columbia; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id1451972f-a66a-4d85-a66f-a946c47a7bcf"><enum>(iii)</enum><text display-inline="yes-display-inline">a recognized religious, philanthropic, or
				cultural
				organization.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="iddae428b7071c4b4b82c0a3cf92f1cf88"><enum>(c)</enum><header display-inline="yes-display-inline">Exception of certain officers</header><text display-inline="yes-display-inline">Section 1502(c)(3) of title 5, United
			 States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id34296b9f77cf4601b3c1d64df106d7f3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>‘or municipality’’ and
			 inserting ‘‘, municipality, or the District of Columbia’</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd6c7b36ed3cd4b019aa8d7c2d4bd1fef"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>‘or municipal’’ and
			 inserting ‘‘, municipal, or the District of Columbia’</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida6a10f58-d36f-465d-bfc7-8a708fefd0ee"><enum>(d)</enum><header display-inline="yes-display-inline">Merit Systems Protection Board
			 orders</header><text display-inline="yes-display-inline">Section 1506(a)(2) of
			 title 5, United States Code, is amended by inserting <quote>(or in the case of
			 the District of Columbia, in the District of Columbia)</quote> after <quote>the
			 same State</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idc7e3822e-3695-49d8-88c1-1bee3c019f0d"><enum>(e)</enum><header display-inline="yes-display-inline">Provisions relating to Federal employees
			 made inapplicable</header><text display-inline="yes-display-inline">Section
			 7322(1) of title 5, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idb2425e38-5647-4c0d-b9af-519ccdf1bb4a"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by adding
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0faf3762-d36e-4066-aa71-dc857f8d85d4"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09080d94-7f11-4eb1-a634-11bea424cc03"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subparagraph (C); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida3c509d1-c44b-4bf8-9fff-3746d492b6b3"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote>services;</quote> and
			 inserting <quote>services or an individual employed or holding office in the
			 government of the District of Columbia;</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id276C1CF5AB3F4ED0B339A3E50151FAC9"><enum>(f)</enum><header display-inline="yes-display-inline">Employees residing in certain
			 municipalities</header><text display-inline="yes-display-inline">Section
			 7325(1) of title 5, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id5653257BD98C4F93BFCF07080461D3BA" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id1850e616f82d44d39d055b09d348f2ae"><enum>(1)</enum><text display-inline="yes-display-inline">the municipality or political subdivision
				is—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id0999BB4F408347949EC1C8498831ECDC"><enum>(A)</enum><text display-inline="yes-display-inline">the District of Columbia;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77D8B692000C4FF3AD8145CDEE7D42B1"><enum>(B)</enum><text display-inline="yes-display-inline">in Maryland or Virginia and in the
				immediate vicinity of the District of Columbia; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE66C290033384A9C80152C4B7BD24B42"><enum>(C)</enum><text display-inline="yes-display-inline">a municipality in which the majority of
				voters are employed by the Government of the United States;
				and</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id58e7610f-5994-42cb-89a0-ee3eefc5bd3b" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Hatch Act penalties for Federal
			 employees</header><text display-inline="no-display-inline">Chapter 73 of title
			 5, United States Code, is amended by striking section 7326 and inserting the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id3b3675d8-cab9-485d-b98f-264ae4f0ea12" style="USC">
				<section commented="no" display-inline="no-display-inline" id="idf3272d17-9a97-4557-bc35-3e3a0da26897" section-type="subsequent-section"><enum>7326.</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="no-display-inline">An employee or individual who violates
				section 7323 or 7324 shall be subject to removal, reduction in grade, debarment
				from Federal employment for a period not to exceed 5 years, suspension,
				reprimand, or an assessment of a civil penalty not to exceed
				$1,000.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id0d38a166-7d1b-4030-a445-46d39b0bc5cf" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Effective date</header>
			<subsection commented="no" display-inline="no-display-inline" id="id614a229f-fc0c-49ca-9b66-6b721d7a3587"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This Act and the amendments made by this
			 Act shall take effect 30 days after the date of enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id3d57a647-8f72-4eba-8471-d91cfade38dd"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability rule</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id660238e1-ca23-4d60-9932-990ae64efda3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the
			 amendment made by section 4 shall apply with respect to any violation occurring
			 before, on, or after the effective date of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f9d289a-b099-4f65-86b7-266be9a08572"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The amendment made by section 4 shall not
			 apply with respect to an alleged violation if, before the effective date of
			 this Act—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id8e517542-303c-41fb-9ef5-66055579d8e3"><enum>(A)</enum><text display-inline="yes-display-inline">the Special Counsel has presented a
			 complaint for disciplinary action, under section 1215 of title 5, United States
			 Code, with respect to the alleged violation; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d8a7843-dc17-4d33-9929-ec6cbb7cb941"><enum>(B)</enum><text display-inline="yes-display-inline">the employee alleged to have committed the
			 violation has entered into a signed settlement agreement with the Special
			 Counsel with respect to the alleged violation.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
