		<official-title>To authorize the Secretary of the Army to carry out
		  activities to manage the threat of Asian carp traveling up the Mississippi
		  River in the State of Minnesota, and for other purposes.</official-title>

		<section id="H4EDF42B6F0E043F7BD4E7AC26090FF1F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Upper Mississippi Conservation and
			 River Protection Act of 2012</short-title></quote> or the <quote><short-title>Upper Mississippi CARP Act</short-title></quote>.</text>
		</section><section id="HDD9BBEA8ABC741698672AF0C41B775F6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HB43FE481B8054AB0ADEEE53255175F9B"><enum>(1)</enum><header>Alternative
			 technology barrier</header><text display-inline="yes-display-inline">The term
			 <term>alternative technology barrier</term> means—</text>
				<subparagraph id="idBA5D713D653B429D8FB7F51E76AF6D39"><enum>(A)</enum><text display-inline="yes-display-inline">an electric barrier;</text>
				</subparagraph><subparagraph id="id8ABC6546C73943878CD27ADA6348E719"><enum>(B)</enum><text display-inline="yes-display-inline">an acoustic barrier;</text>
				</subparagraph><subparagraph id="idEBC6F70B6D134AFCB99CB9F65E31AEE2"><enum>(C)</enum><text display-inline="yes-display-inline">a bubble barrier; and</text>
				</subparagraph><subparagraph id="idA1C836B7FC534857BC3994AC86EC1538"><enum>(D)</enum><text display-inline="yes-display-inline">any other barrier the Secretary determines
			 to be appropriate.</text>
				</subparagraph></paragraph><paragraph id="H637152F8ED804ADFB78EA802C9643D88"><enum>(2)</enum><header>Asian
			 carp</header><text>The term <term>Asian carp</term> means—</text>
				<subparagraph id="HC3BF94CD312B49D681F775E43293611D"><enum>(A)</enum><text display-inline="yes-display-inline">grass carp (Ctenopharyngodon
			 idella);</text>
				</subparagraph><subparagraph id="HB0DDF25058284CBFAAD48B1E15FC46A9"><enum>(B)</enum><text>silver carp
			 (Hypophthalmichthys molitrix);</text>
				</subparagraph><subparagraph id="HF72E9CE5CA404A929EB2375EB9882749"><enum>(C)</enum><text>bighead carp
			 (Hypophthalmichthys nobilis); and</text>
				</subparagraph><subparagraph id="HEA38AFADB2E2464C998C91C85FF4CD62"><enum>(D)</enum><text>black carp
			 (Mylopharyngodon piceus).</text>
				</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H4CC8C0B14A30484CA3C44CF3CF687D73"><enum>(3)</enum><header>Lock and Dam
			 2</header><text display-inline="yes-display-inline">The term <term>Lock and Dam
			 2</term> means the lock and dam located on Mississippi River mile 815.2
			 upstream of Hastings, Minnesota.</text>
			</paragraph><paragraph display-inline="no-display-inline" id="HD39176FB12D04058828F22378D773833"><enum>(4)</enum><header>Lock and Dam
			 4</header><text display-inline="yes-display-inline">The term <term>Lock and Dam
			 4</term> means the lock and dam located on Mississippi River mile 752.8 in
			 Alma, Wisconsin.</text>
			</paragraph><paragraph id="H659EEAD03E4D4D59AE2A92250193888B"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Army, acting through the
			 Chief of Engineers.</text>
			</paragraph><paragraph id="H284E979CA7BC477CAE9B72E489545EBF"><enum>(6)</enum><header>Upper St.
			 Anthony Falls Lock and Dam</header><text display-inline="yes-display-inline">The term <term>Upper St. Anthony Falls Lock
			 and Dam</term> means the lock and dam located on Mississippi River mile 853.9
			 in Minneapolis, Minnesota.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H049C469B0182487782FF605EB35E99F9" section-type="subsequent-section"><enum>3.</enum><header>Feasibility study on
			 temporary closure of Upper St. Anthony Falls Lock</header>
			<subsection id="HFD30DF4362464BDBA9A333A9AE9BDA6D"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary shall conduct a study on the
			 feasibility of temporarily closing the lock at the Upper St. Anthony Falls Lock
			 and Dam to manage the threat of Asian carp traveling up the Mississippi River
			 in the State of Minnesota.</text>
			</subsection><subsection id="H34952F9C5C9B4A6081C7B0F2AE8D1982"><enum>(b)</enum><header>Potential
			 impacts</header><text>In conducting the study, the Secretary shall assess the
			 potential impacts, including environmental and economic impacts of—</text>
				<paragraph id="H6FC09D6422D245EEAE15DD7D2D3D9AE1"><enum>(1)</enum><text>temporary closure
			 of the lock; and</text>
				</paragraph><paragraph id="HC39F657D6D344099BB787B90D3C9841B"><enum>(2)</enum><text>continuing to
			 operate the lock.</text>
				</paragraph></subsection><subsection id="H6EFC83E8778C4F48811C491CB47B80BC"><enum>(c)</enum><header>Consultation</header><text>The
			 Secretary shall carry out the study in consultation with the Secretary of the
			 Interior and appropriate Federal, State, and local entities.</text>
			</subsection><subsection id="H54CC0E349FBB4CBCBEAFDC1D7F23A99E"><enum>(d)</enum><header>Public
			 comment</header><text>In conducting the study, the Secretary shall provide an
			 opportunity for, and take into consideration, public comments.</text>
			</subsection><subsection id="HCF02E09D52CA4EE0A06EC77AFC51DC98"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Secretary shall submit to Congress a report on the
			 results of the study.</text>
			</subsection></section><section id="H1F73AF124A3141D1B1D954A26914621D"><enum>4.</enum><header>Feasibility study
			 on use of other Asian carp control measures</header>
			<subsection id="H7061D629ECD149A08AFBBAD4E3CA08BE"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary shall conduct a study on the
			 feasibility of implementing control measures at the Upper St. Anthony Falls
			 Lock and Dam to manage the threat of Asian carp traveling up the Mississippi
			 River in the State of Minnesota.</text>
			</subsection><subsection id="HEAB14DC7E92E4F698689C458C0619F48"><enum>(b)</enum><header>Types of control
			 measures</header><text>The study shall include an examination of—</text>
				<paragraph id="HCC6B5ED9F5D0404EABC9271D2F9B2C9D"><enum>(1)</enum><text>permanent closure
			 of the lock;</text>
				</paragraph><paragraph id="H3DE9D9FD2A194E94B4731B14AF1A7192"><enum>(2)</enum><text display-inline="yes-display-inline">modified lock operations;</text>
				</paragraph><paragraph id="HBCED53835ABB4DA69CD4EC9672ED31D7"><enum>(3)</enum><text display-inline="yes-display-inline">the use of an alternative technology
			 barrier; and</text>
				</paragraph><paragraph id="HECD24C7C5B9D4A2AAB93F71303E11C63"><enum>(4)</enum><text>any other control
			 measures the Secretary determines to be appropriate.</text>
				</paragraph></subsection><subsection id="HBE3A2C2083A64FCA9242C797C624BA14"><enum>(c)</enum><header>Potential
			 impacts</header><text>In conducting the study, the Secretary shall assess the
			 potential impacts, including environmental and economic impacts of—</text>
				<paragraph id="H21877894E2084BDCA9216E36AF7F3A89"><enum>(1)</enum><text>implementing each
			 of the control measures described in subsection (b); and</text>
				</paragraph><paragraph id="H912DF79A62F14F99BF382E062B2582FC"><enum>(2)</enum><text>not implementing
			 any control measures.</text>
				</paragraph></subsection><subsection id="HC56B664E52D54029A2EFB3EC0F758781"><enum>(d)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall carry out the study in
			 consultation with the Secretary of the Interior and appropriate Federal, State,
			 and local entities.</text>
			</subsection><subsection display-inline="no-display-inline" id="H8E7CFEB892254EF1AF660337695C6D96"><enum>(e)</enum><header>Public
			 comment</header><text>In conducting the study, the Secretary shall provide an
			 opportunity for, and take into consideration, public comments.</text>
			</subsection><subsection id="HA68FBFCF7A2043CCA2CC984B6F371EFC"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Secretary shall submit to Congress a report on the
			 results of the study.</text>
			</subsection></section><section id="H9EE277011FA949B0B0DE0CCBEA61F84A"><enum>5.</enum><header>Closure of locks
			 to prevent spread of Asian carp</header>
			<subsection id="H345C05AB795048EEBBEB3943985CD523"><enum>(a)</enum><header>Discretionary
			 closure</header><text display-inline="yes-display-inline">The Secretary may
			 close the lock at the Upper St. Anthony Falls Lock and Dam if the Secretary
			 determines in writing, based on the assessment of potential impacts under
			 section 3(b), that closure of the lock is justified as a method to manage the
			 threat of Asian carp traveling up the Mississippi River in the State of
			 Minnesota.</text>
			</subsection><subsection id="HD75661196422458092F78D7D9BAD44A3"><enum>(b)</enum><header>Mandatory
			 closure</header><text>The Secretary shall close the lock at the Upper St.
			 Anthony Falls Lock and Dam if the Secretary determines that—</text>
				<paragraph id="H23B54BF5451142778FA0B82CFAEC0F0F"><enum>(1)</enum><text>1
			 or more live adult Asian carp has been captured above Lock and Dam 2; or</text>
				</paragraph><paragraph id="HD61D0A9EF10D4EAF880171DCE2B009F2"><enum>(2)</enum><text display-inline="yes-display-inline">1 or more juvenile Asian carp has been
			 captured above Lock and Dam 4.</text>
				</paragraph></subsection><subsection commented="no" id="HF204363E2F2346DCA0DBF07D9EB5AFD8"><enum>(c)</enum><header>Period of
			 closure</header><text>If the Secretary closes the lock under this section, the
			 Secretary may reopen the lock after the Secretary determines in writing that
			 adequate measures are in place to manage the threat of Asian carp moving
			 upstream of the Upper St. Anthony Falls Lock and Dam.</text>
			</subsection><subsection commented="no" id="HF76712E1CD054FB2AE63B9CE336C86F2"><enum>(d)</enum><header>Emergency
			 operations</header><text display-inline="yes-display-inline">Nothing in this
			 section shall prevent the Secretary from carrying out emergency lock operations
			 necessary to mitigate flood damage.</text>
			</subsection></section><section id="H4E3F4BC232524ED588452174EB821F7B"><enum>6.</enum><header>Asian Carp
			 Control Strategy Framework</header><text display-inline="no-display-inline">The
			 Council on Environmental Quality shall incorporate the Upper Mississippi River
			 and tributaries, the Minnesota River, and the St. Croix River into the Asian
			 Carp Control Strategy Framework of the Council.</text>
		</section><section id="HEC7EB880579D453BAF8CC22D943BC5BD"><enum>7.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that, to the maximum extent practicable, Federal agencies researching
			 Asian carp control technologies should partner with State and local
			 shareholders, giving priority to those collaborative partnerships in which the
			 State and local shareholders contribute to the cost of the research.</text>
