		<official-title>To amend the Toxic Substances Control Act relating to
		  lead-based paint renovation and remodeling activities.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Lead Exposure Reduction Amendments
			 Act of 2012</short-title></quote>.</text>
		</section><section id="id4C2D70F39FC4413B904C00EE62EBBF33"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 401 of the Toxic Substances Control
			 Act (15 U.S.C. 2681) is amended—</text>
			<paragraph id="idE0CDC5A0287C469CBB9CC5C565480E6D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
				<subparagraph id="id982C540C9FF7469B84187A54BEAF9C1C"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B)
			 as clauses (i) and (ii), respectively, and indenting the clauses
			 appropriately;</text>
				</subparagraph><subparagraph id="id021FA7C495754219870C1F89D31A5C5B"><enum>(B)</enum><text>in the first
			 sentence, by striking <quote>The term</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id04676A06A060408AA7E34117789D804D" style="OLC">
						<subparagraph id="idF9A916423117478A98BD4FA284613509"><enum>(A)</enum><header>In
				general</header><text>The
				term</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idA0A5956827E34DD8A56BF506B9DA2637"><enum>(C)</enum><text>by striking
			 <quote>Such term includes—</quote> and inserting the following:</text>

						<subparagraph id="id4F24FDE645E744E381A0DCBABCDE2147"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>abatement</term> includes—</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idF479FDF6A7144502BDA3AC78B031FC61"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idCE896CDB7F0F44C0BAC0002B208AC78A" style="OLC">
						<subparagraph id="idCC1DBB4699F44F948F0471C69FB9EA3D"><enum>(C)</enum><header>Exclusions</header><text>The
				term <term>abatement</term> does not include any renovation, remodeling,
				landscaping, or other activity—</text>
							<clause id="id2F041C3A8AB344DFAEAE73DA87BA38CB"><enum>(i)</enum><text>the primary
				purpose of which is to repair, restore, or remodel a structure or dwelling;
				and</text>
							</clause><clause id="idD8FDE39E09504EECAA82EFAF57485C9C"><enum>(ii)</enum><text>that
				incidentally results in a reduction or elimination of lead-based paint
				hazards.</text>
							</clause></subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id394A20DDA0B64F0BA58C9240DDF6AF37"><enum>(2)</enum><text>by redesignating
			 paragraphs (4) through (12) and paragraphs (13) through (17) as paragraphs (5)
			 through (13) and paragraphs (15) through (19), respectively;</text>
			</paragraph><paragraph id="id7A99087D7C5B4247A7A8D820ABC901FF"><enum>(3)</enum><text>by inserting
			 after paragraph (3) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9CD90CC891C247EAB5C3688CE68C3AA2" style="OLC">
					<paragraph id="id5685CA18468D496B9AFE391B37679E48"><enum>(4)</enum><header>Emergency
				renovation</header><text>The term <term>emergency renovation</term> means a
				renovation, replacement, or repair activity that—</text>
						<subparagraph id="id117A8915D11A46149CE67432BEFC89B7"><enum>(A)</enum><text>was not planned;
				and</text>
						</subparagraph><subparagraph id="idC8251EEDA387412A97FFCAB7BFFD1DB6"><enum>(B)</enum><text>results from a
				sudden, unexpected event that, if not immediately attended to—</text>
							<clause id="id195A5895A04846C990251605096E9E4F"><enum>(i)</enum><text>presents a risk
				to the public health or safety; or</text>
							</clause><clause id="id7ECC6DC422F24E3EA1D74D779C9922C4"><enum>(ii)</enum><text>threatens to
				cause significant damage to equipment or
				property.</text>
							</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id77692101629F4C44AD565930CB1D073D"><enum>(4)</enum><text>by striking
			 paragraph (10) (as redesignated by paragraph (2)) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id1572BEA1B0C948B38FE503C345FBC44D" style="OLC">
					<paragraph id="idAC0A8A89BFC84A73BD44C5F2EFBDBF66"><enum>(10)</enum><header>Lead-based
				paint</header><text>The term <term>lead-based paint</term> means paint or other
				surface coatings that contain lead—</text>
						<subparagraph id="idF653D36A126847209F82561ADFDE77EA"><enum>(A)</enum><text>in excess
				of—</text>
							<clause id="id49B42433FADA4991832CDEA5C0ADDFF0"><enum>(i)</enum><text>1.0 milligrams
				per centimeter squared; or</text>
							</clause><clause id="id4027C916E9C94DD6BCE4EED3131B0360"><enum>(ii)</enum><text>0.5 percent by
				weight; or</text>
							</clause></subparagraph><subparagraph id="id9156683708844B7CBEEA883479756A87"><enum>(B)</enum><text>in the case of
				paint or other surface coatings on target housing, the lower level established
				by the Secretary of Housing and Urban Development under section 302(c) of the
				Lead-Based Paint Poisoning Prevention Act (42 U.S.C. 4801 et
				seq.).</text>
						</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id857817E8DFA44B3E9D8AB3D07B888C4C"><enum>(5)</enum><text>by inserting
			 after paragraph (13) (as redesignated by paragraph (2)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idCEFA01B076744C4BA65C6E9FFB669276" style="OLC">
					<paragraph id="id84F6EFCE7A6449F897630605F42A5FB5"><enum>(14)</enum><header>Post-abatement
				clearance testing</header><text>The term <term>post-abatement clearance
				testing</term> means a test that—</text>
						<subparagraph id="idA0DDEDF3AB4E41C0985F57751BD651C2"><enum>(A)</enum><text>is carried out on
				the completion of any lead-based paint activity to ensure that—</text>
							<clause id="id5B4FE6211B4E4C2EA340547D56F7F3A0"><enum>(i)</enum><text>the reduction is
				complete; and</text>
							</clause><clause id="id66926C944E98400D888B1ABE331D83B8"><enum>(ii)</enum><text>no
				lead-contaminated dust hazards remain in the dwelling unit or worksite;
				and</text>
							</clause></subparagraph><subparagraph id="idA7E4F14035F94A03815D8D7949BF4B68"><enum>(B)</enum><text>includes a visual
				assessment and the collection and analysis of environmental samples from the
				dwelling or worksite.</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idC9A1A8ABAE9D4F34AC0AD8D1267CCE45"><enum>(6)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1B2DA3553A5A4F3788D60CC558E5C4B8" style="OLC">
					<paragraph id="id36D7D896B522485FBB2549C9B3B5AC30"><enum>(20)</enum><header>Test
				kit</header><text>The term <term>test kit</term> means a chemical test that has
				the ability to determine the presence of lead in a paint chip, paint powder, or
				painted surface at a level that is equal to or in excess of—</text>
						<subparagraph id="id3C616E5288324A5D97AEAE38D821D3F7"><enum>(A)</enum><text>1.0 milligrams
				per centimeter squared; or</text>
						</subparagraph><subparagraph id="id884F7EC72E894F17B12B20319F449708"><enum>(B)</enum><text>0.5 percent by
				weight.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id6AA2AFA495E343CAA95A9BAEBB276DE9"><enum>3.</enum><header>Lead-based paint
			 activities training and certification</header><text display-inline="no-display-inline">Section 402(c) of the Toxic Substances
			 Control Act (15 U.S.C. 2682(c)) is amended—</text>
			<paragraph id="id584028C53F744E3E9972D726729D0921"><enum>(1)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id53E44F19979E4636A262F8458FD8396C" style="OLC">
					<paragraph id="id69B3C66E2DE540079D82117326F8E8E6"><enum>(2)</enum><header>Study of
				certification</header>
						<subparagraph id="idD94D2AF9711A404D9F9643A500F20EF6"><enum>(A)</enum><header>In
				general</header><text>Prior to proposing any new regulation applicable to
				target housing or public or commercial buildings constructed before 1978, the
				Administrator shall conduct a study of the extent to which persons engaged in
				various types of renovation and remodeling activities in the target housing or
				public or commercial buildings constructed before 1978—</text>
							<clause id="idC67F9DB9C48D4E238F8EE6EC4659B938"><enum>(i)</enum><text>are exposed to
				lead in the conduct of those activities; or</text>
							</clause><clause id="id723944C7197E41468438D45343912F02"><enum>(ii)</enum><text>disturb lead and
				create a lead-based paint hazard on a regular or occasional basis.</text>
							</clause></subparagraph><subparagraph id="idB8BBE691064443988848EB05510B8D1A"><enum>(B)</enum><header>Completion</header><text>The
				Administrator shall complete each study under subparagraph (A) and publish the
				results of that study not later than 1 year prior to proposing any new
				regulation applicable to a structure or dwelling described in subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
			</paragraph><paragraph id="id1D68310126B74577AC7AFAF9C26363FE"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
				<subparagraph id="id4294A066BCC4464D9461F8972E305441"><enum>(A)</enum><text>in the first
			 sentence, by striking <quote>Within 4 years</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id58C2AEA6869E495C8B9A6939E245535B" style="OLC">
						<subparagraph id="idDF20A5847437480797A30137BF89A501"><enum>(A)</enum><header>In
				general</header><text>Not later than 4
				years</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idF809896246B74E5BB6F7F8A0810EB88B"><enum>(B)</enum><text>in the second
			 sentence, by striking <quote>In determining</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idE037EE4E68404CD9B18773B643E11EBE" style="OLC">
						<subparagraph id="idCAAEC4654032444CA5AF051A666F3B1E"><enum>(B)</enum><header>Use of
				study</header><text>In
				determining</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="id96A5CFC9578F4F63B7AA795F04191583"><enum>(C)</enum><text>in the third
			 sentence, by striking <quote>If the Administrator</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idDF5ADE8B0A0F43649BEFF77A4DBB9B29" style="OLC">
						<subparagraph id="idD23B56D1024D46E98F2EB0F1879C2B47"><enum>(C)</enum><header>Determination
				of Administrator</header><text>If the
				Administrator</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="id40FC948FF33C465BBBC036320C2CD99F"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0E6BF4C0662C4C0BAF6A4EA6C6135D86" style="OLC">
						<subparagraph id="id5A3819F0B0A14DC795F690EEDB3BB64C"><enum>(D)</enum><header>Exemption</header><text>An
				emergency renovation shall be exempt from any regulation promulgated by the
				Administrator under this paragraph.</text>
						</subparagraph><subparagraph id="id6464D3F66A2F47F2AE1D74C4BC168C04"><enum>(E)</enum><header>Prohibition on
				post-abatement clearance requirement</header><text>No regulation promulgated by
				the Administrator under this paragraph shall require post-abatement clearance
				testing.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id07307AA70777413EAD740AF9118321FE"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE82E467A2E714842B4508C6668B042A9" style="OLC">
					<paragraph id="id51F90773120348679298AD3120EF6CA5"><enum>(4)</enum><header>Target housing
				owners</header>
						<subparagraph id="idF7EBCE5126A749F387C889DCC8091B08"><enum>(A)</enum><header>In
				general</header><text>Not later than 60 days after the date of enactment of
				this paragraph and subject to subparagraph (B), in promulgating any regulation
				relating to renovation or remodeling activities in target housing in which the
				owner resides, the Administrator shall include a provision that permits the
				owner to authorize the renovation or remodeling contractor to forego compliance
				with that regulation.</text>
						</subparagraph><subparagraph id="idF758D52FCB5148D288A27AE66D63D27E"><enum>(B)</enum><header>Restriction</header><text>The
				Administrator shall only permit an owner of target housing to forgo compliance
				with a regulation under this paragraph if—</text>
							<clause id="id6F9422216B4743FCAAB897746A2CA04C"><enum>(i)</enum><text>no pregnant woman
				or child under the age of 6 resides in the target housing as of the date on
				which the renovation or remodeling commences; and</text>
							</clause><clause id="id6E4693207A3D452E9006CF1DB047C32C"><enum>(ii)</enum><text>the owner
				submits to the renovation or remodeling contractor written certification
				that—</text>
								<subclause id="id813E5F4C2F1A43ACA30768EE03034702"><enum>(I)</enum><text>the renovation or
				remodeling project is to be carried out at the target housing of the
				owner;</text>
								</subclause><subclause id="idFE3AC41E8827415FB8E1227100DA6DDD"><enum>(II)</enum><text>no pregnant
				woman or child under the age of 6 resides in the target housing as of the date
				on which the renovation or remodeling commences; and</text>
								</subclause><subclause id="id6E5E0BF79B324CD99C79B025F16EC4B6"><enum>(III)</enum><text>the owner
				acknowledges that, in carrying out the project, the renovation or remodeling
				contractor will be exempt from employing the work practices required by a
				regulation promulgated under this subsection.</text>
								</subclause></clause></subparagraph><subparagraph id="idA468E8B1C16D43FF87B67287DA6968C3"><enum>(C)</enum><header>Limitation of
				contractor liability</header><text>A contractor that receives written
				certification described in subparagraph (B)(ii) shall be exempt from liability
				resulting from any misrepresentation of the owner of the target housing.</text>
						</subparagraph></paragraph><paragraph id="idD453443053C949F19D10737EFB250B80"><enum>(5)</enum><header>Test
				kits</header>
						<subparagraph id="idEE88C6192F2C458E9E24B3240D14336D"><enum>(A)</enum><header>In
				general</header><text>In making a certification determination under this
				subsection, the Administrator shall allow contractors to use commercially
				available lead-based paint test kits that comply with the positive and negative
				response criteria established by the Administrator.</text>
						</subparagraph><subparagraph id="id79D754E3848C4AF988B9745549CCB1E9"><enum>(B)</enum><header>Test kit
				approval</header>
							<clause id="id690A55DA0C7C49A2B12AFD2861A1F526"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall establish a process by which the
				Administrator shall identify and approve a test kit that—</text>
								<subclause id="idB53078AF892A47BB9A333CCB727B1A73"><enum>(I)</enum><text>meets the
				criteria described in subparagraph (A);</text>
								</subclause><subclause id="idABB41D34570A430B904007E6E7EFD9FE"><enum>(II)</enum><text>is inexpensively
				and commercially available;</text>
								</subclause><subclause id="id285D890D9D384DEE866837D3435C0F43"><enum>(III)</enum><text>does not
				require special training to use the test kit; and</text>
								</subclause><subclause id="id31C3628873204FCC892234F18B6199DE"><enum>(IV)</enum><text>enables users to
				determine the presence of lead at the job site in accordance with the criteria
				described in subparagraph (A) without the need for off-site laboratory
				analysis.</text>
								</subclause></clause><clause id="idAFDBE05BCDEC4C7E8E43BED64962EB9E"><enum>(ii)</enum><header>Suspension of
				regulations</header>
								<subclause id="idB9E2FC16BC5F41ADB1A46368FCA47168"><enum>(I)</enum><header>In
				general</header><text>If the Administrator is unable to determine that 1 or
				more test kits under clause (i) exists, the Administrator shall suspend the
				implementation of any applicable regulation under this subsection relating to
				renovation or remodeling, except for owners described in paragraph (4)(B),
				until the date on which the Administrator—</text>
									<item id="id2BE8AB9B45C5473A848552059FD08AD7"><enum>(aa)</enum><text>identifies and
				approves 1 or more test kits under clause (i); and</text>
									</item><item id="idE17B2C7492954FAEAFB3EF3AB0F96C5B"><enum>(bb)</enum><text>publishes in the
				Federal Register notice of that identification and approval.</text>
									</item></subclause><subclause id="id2E94652143F742A4A5573928896A76C7"><enum>(II)</enum><header>Duration</header><text>The
				Administrator shall remove the suspension under this clause not earlier than 45
				days after the date on which notification of the identification and approval of
				the test kit is published in the Federal Register in accordance with subclause
				(I)(bb).</text>
								</subclause><subclause id="id6579110D7F7343838E4913D2C21D98E9"><enum>(III)</enum><header>Applicability</header><text>This
				clause shall—</text>
									<item id="id8B73101AD13247B7AB85F65D88773BCD"><enum>(aa)</enum><text>only apply to
				regulations that permit an owner of target housing to authorize a renovation or
				remodeling contractor to forego compliance with the regulation; and</text>
									</item><item id="idCAE502BB307A4915A0BAF2EC8F111218"><enum>(bb)</enum><text>not affect any
				other regulation issued under this subsection.</text>
									</item></subclause></clause></subparagraph></paragraph><paragraph id="id0F79C2D84BCD4FEA89FF3BEDCA018A2C"><enum>(6)</enum><header>Applicability
				of certain penalties</header><text>Any regulation promulgated by the
				Administrator under this section requiring the submission of documentation to
				the Administrator shall provide—</text>
						<subparagraph id="id729AA5D326AD4647AA407A81CF6F535D"><enum>(A)</enum><text>an exemption from
				penalty for a person who—</text>
							<clause id="id982B65D3799E427CA21C6F33F26F9BC2"><enum>(i)</enum><text>is submitting the
				required documentation for the first time; and</text>
							</clause><clause id="idBDC5CE1CDBBE454F86F96612E3DA5425"><enum>(ii)</enum><text>submits
				documentation that contains de minimus or typographical errors, as determined
				by the Administrator; and</text>
							</clause></subparagraph><subparagraph id="idF44E4C2D33E442D695D5FE6B3A086EDC"><enum>(B)</enum><text>a process by
				which a person described in subparagraph (A) may resubmit the required
				documentation.</text>
						</subparagraph></paragraph><paragraph id="idFC1298DB809A49108632C2FF224B51C1"><enum>(7)</enum><header>Accreditation
				of recertification courses</header><text>Subsection (a)(2)(D) shall not apply
				to any certified renovator recertification course that is accredited by the
				Environmental Protection
				Agency.</text>
